No. EDN(TE)B(6)11/2019.—In exercise of the powers conferred by sub-section (1) of Section 21 of the Rights of Persons with Disabilities Act, 2016 (Act no. 49 of 2016) the Governor, Himachal Pradesh is pleased to notify Equal Opportunity Policy for employees with Disabilities in respect of Department of Technical Education in the State as per Annexure "A" with immediate effect.

ANNEXURE-"A" Equal Opportunity policy in respect of Employees of Department of Technical Education, Himachal Pradesh.

1. Background:

The Government of India has enacted Rights of Persons with Benchmark Disabilities (RPwD) Act, 2016. The Section 21(1) of the Act states that every establishment shall notify Equal Opportunity Policy and section 21(2) of the Act, envisages that every establishment shall register a copy of the said policy with the State Commissioner for the Persons with Disability.

2. Objective:

The objective of this policy is to ensure that there is an improvement in the quality of life of all the Persons with Benchmark Disability working in the Department and to promote and safeguard equality, self determination, dignity and social inclusion of such persons.

3. Applicability:

This policy is applicable to the employees of the Department having Benchmark Disability. This policy shall be applicable throughout the period of employment of the employee right from his recruitment till his/her retirement. The persons with Benchmark Disabilities include those who have long term physical, mental, intellectual or sensory impairments and possess certificate of disability issued by a competent authority under section 57 of the RPwD Act, 2016.

4. Policy:

It is the aim of Department of Technical Education, Vocational & Industrial Training, Himachal Pradesh, to provide equal employment opportunities, without any discrimination on the grounds of caste, colour, disability, marital status, nationality, race, religion, sexual orientation. The Department strives to maintain a work environment that is free from any harassment based on above considerations.

This Equal Opportunity Policy is subject to applicable regulations, qualifications and merit of the individual. This Policy will consistently be applied throughout the period of employment of the individual, right from the recruitment process till retirement from service.

5. Accessibility features for making infrastructure disabled friendly:

The Govt. of India has directed the State Govt. that all the public buildings are to be made disabled friendly right from the entrance to the complex and the building till any area that is accessed through the corridors. The accessibility features for making infrastructure disabled friendly are given below:—

A. Outdoor Features:

1. Accessible route and pathway to entrance 2. Reserved parking near entrance 3. Ramp at entrance of building

B. Indoor Features:

1. Accessible corridors 2. Accessible reception 3. Accessible lifts 4. Accessible toilets 5. Staircases and ramps with handrails 6. Auditory, Visual and floor signage 7. Accessible drinking water provisions 8. Tactile Flooring

i. Proposed New Buildings:

It is proposed that the key accessibility features for making the buildings disabled friendly will be incorporated in the drawings of all buildings and guidelines. The approval of building drawing shall be given only if above provisions are incorporated by the executing agencies.

ii. Building under Construction Stage:

The Executing agencies will be provided with the guidelines for incorporating the key accessibility features in the building under construction. Revised estimate alongwith drawings for making buildings disabled friendly will be submitted to the department for approval and release of additional funds.

iii Existing Buildings:

In most of the institutions there are various obstacles for providing the accessible facilities for the persons with disabilities. Following measures can be taken at institute level to make the buildings disabled friendly.

(a) Accessible pathway from the entrance gate to parking and main gate of buildings/block.

(b) Reserve parking facility near entrance of the building/blocks (c) Provision of Ramps at the entrance of building/blocks (d) Accessible reception2524 राजपत्र, हिमाचल प्रदेश, 11 अगस्त, 2021/20 श्रावण, 1943 (e) Accessible toilets on the ground floor (f) Accessible drinking water provision

(g) Provision of signages

(h) Tactile flooring if sufficient space is available

(i) Provision of handrails in existing staircases/ramps

(j) Provision of ramps connecting various floors, if sufficient space is available (k) Provision of lifts if sufficient space is not available for construction of ramps for connecting various floors in the buildings.

6. Equal Opportunity and Non-Discrimination:

In accordance with the provisions of the Rights of Persons with Disabilities Act, 2016 and Rules, 2017, it is the policy of Department of Technical Education to ensure that the work environment is free from any discrimination against the Persons with Benchmark Disabilities. Further, the department will take actions to ensure that a conducive environment is provided to persons with benchmark disabilities to perform their role and excel in the same. The Department of Technical Education strives toward establishing systems and processes to ensure:

1. That appropriate facilities and amenities would also be provided to persons with disabilities to enable them to effectively discharge their duties in the establishment and no officer/official shall be deprived of his or her personal liberty on the ground of disability.

2. That provision shall be made for an accessible environment, accessible buildings and availability of assistive environment as required to enable the persons with benchmark disabilities to effectively discharge their duties in the establishment.

3. That a Grievance Redressal Mechanism for addressing the matters related to the employment of persons with benchmark disabilities is available. Joint Director, Technical Education is the Grievance Redressal Officer who will look after all the grievances of the PwDs in the Department of Technical Education and the same is accountable to Director, Technical Education.

4. That the various sections in the Directorate and in the respective line offices at Districts will ensure that if any grievance does arise & is brought up to the concerned committee/officer with respect to selection of Persons(s) with Benchmark disabilities for any position, training, promotion, transfer posting, leave, assistive aid & preference in accommodation allocation etc. will be dealt within a fair and equitable manner free from any discrimination.

5. That no opportunities are denied to persons with disabilities merely on the ground of his disability.

6. No discriminatory practices are to be engaged in the course of employment of persons with a benchmark disability , including recruitment and career advancement. Any employee who acquires a disability during the service & is not suitable to the post he was holding, shall be shifted to some other post with the same pay scale and service benefits. Provided further that if it is not possible to adjust the employee against any2525 राजपत्र, हिमाचल प्रदेश, 11 अगस्त, 2021/20 श्रावण, 1943 post, he may be kept on a supernumerary post until a suitable post is available or he/she attains the age of superannuation, whichever is earlier.

7. Identification of Posts for Reservation.

The Directorate of Technical Education shall identify the posts reserved for Persons with Benchmark Disabilities as per section 34(1) of the RPwD Act, 2016 that provides 4% reservation to the Persons with Benchmark Disabilities. The Information regarding identified posts and vacancies would be notified and uploaded on the website of the Directorate. The identified posts shall be filled up by the Department as per the directions issued by the State Govt. from time to time and the same shall also be furnished to the employment exchange.

8. Manner of Selection:

The department of Technical Education adopts the selection policy of the State Government regarding filling up of posts reserved for the Persons with Disabilities.

9. Leave:

The Specially Abled employees of this Department will be governed by the rules of leave specified by the State Government from time to time.

10. Liaison Officer:

The Administration (Establishment) of Directorate of Technical Education Vocational & Industrial Training, Himachal Pradesh will ensure that a Liaison Officer is designated at Directorate level to oversee the provision of required facilities/amenities including the process of recruitment of Persons with Benchmark Disabilities. Such officer shall be accountable to Director, Technical Education directly.

11. Complaints/Grievance and their Disposal:

A Register of complaints/grievances will be maintained in the office and a Grievance Redressal Officer will be appointed to hear the request/grievances of Persons with Disabilities working in the Department of Technical Education.

12. Responsibility:

• Directorate of Technical Education is responsible for implementation of the latest applicable laws and rules for Persons with Disabilities.

• All the Principals of the Concerned Institutes are responsible for giving effect to this policy at Institution level.

• Any employee who violates this policy shall be dealt in accordance with applicable rules and laws.

13. Communication of Policy:

This Policy will be available to all employees via the Directorate website.

14. Maintenance of Record:

Records shall be maintained as per the provisions of laws and the rules thereunder, in relation to the matter of employment, facility provided and other necessary information in compliance with the provisions of laws.

हिमाचल प्रदेश भू-जोत अधिकतम सीमा अधिनियम, 1972 (1973 का अधिनियम संंख्यांक 19) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के बहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.-इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश भू-जोत अधिकतम सीमा (संशोधन) अधिनियम, 2021 है।

2. धारा 6-क का संशोधन.-हिमाचल प्रदेश भू-जोत अधिकतम सीमा अधिनियम, 1972 (जिसे इसमें इसके पश्चात "मूल अधिनियम" कहा गया है) की धारा 6-क में, ''इस बात का विचार किए बिना कि यह धारा 4 के अधीन विहित अनुज्ञेय क्षेत्र से अधिक है," और "राज्य सरकार की अनुज्ञा के बिना'', शब्दों, अंकों और चिह्नों का लोप किया जाएगा।

3. धारा 7-क का संशोधन.-मूल अधिनियम की धारा 7-क की उपधारा (1) में, "राज्य सरकार की अनुज्ञा के सिवाय," शब्दों और चिह्न का लोप किया जाएगा।2541 राजपत्र, हिमाचल प्रदेश, 11 अगस्त, 2021/20 श्रावण, 1943

उद्‌देश्यों और कारणों का कथन

हिमाचल प्रदेश भू-जोत अधिकतम सीमा अधिनियम, 1972 (1973 का अधिनियम संख्यांक 19) बड़ी भू-धृतियों की अधिकतम सीमाएं निर्धारित करने के लिए अधिनियमित किया गया था। तथापि, राज्य में चाय उद्योग को प्रोत्साहित करने के उद्‌देश्य से चाय सम्पदा के अन्तर्गत भूमि को इस अधिनियम की धारा 5 के खण्ड (छ) के अधीन उक्त अधिनियम के कार्यान्वयन से छूट प्रदान की गई थी। वर्तमानतः, अधिनियम की धारा 6-क और 7-क सरकार की पूर्व अनुज्ञा से चाय सम्पदा के अधीन क्रमशः भू-उपयोग के परिवर्तन और भूमि के हस्तान्तरण के लिए उपबंध करती है। यह पाया गया है कि चाय संपदा के अन्तर्गत भूमि का सदैव चाय बागान से भिन्न प्रयोजनों के लिए उपयोग किया गया है या इन उपबंधों का आश्रय लेकर विक्रय आदि के माध्यम से हस्तान्तरण किया गया है, जो कि विधान की भावना और आशय के विरूद्ध है। विवाद्यकों का समाधान करने के आशय से एक उच्च स्तरीय समिति का गठन किया गया था, जिसमें समस्त राजनैतिक दलों से विधान सभा के सदस्य सम्मिलित किए गए थे। उक्त समिति ने भी अपनी संस्तुतियां दे दी हैं। इसलिए, राज्य में चाय उद्योग को प्रोत्साहित करने के आशय से अधिनियम की धारा 6-क और 7-क में उपयुक्त संशोधन करने की आवश्यकता है, ताकि चाय सम्पदा के अन्तर्गत ऐसी भूमियों के भू-उपयोग में परिवर्तन और इसके विक्रय आदि के माध्यम से भूमि के हस्तान्तरण को हतोत्साहित किया जा सके। ऐसे उल्लंघनों की दशा में सरकार में भूमि के निहित होने से संबंधित अधिनियम के उपबंध, समस्त विल्लंगमों से रहित, प्रवर्तित हो जाएंगे।

यह विधेयक उपर्युक्त उद्‌देश्यों की पूर्ति के लिए है।

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-second Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Ceiling on Land Holdings (Amendment) Act, 2021.

2. Amendment of section 6-A.—In section 6-A of the Himachal Pradesh Ceiling on Land Holdings Act, 1972 (hereinafter referred to as the "principal Act"), the words and figure "irrespective of its being in excess of the permissible area prescribed under section 4" and "without the permission of the State Government" shall be omitted .

3. Amendment of section 7-A.—In section 7-A of the principal Act, the words "except with the permission of the State Government" shall be omitted.

STATEMENT OF OBJECTS AND REASONS

The Himachal Pradesh Ceiling on Land Holdings Act, 1972 (Act No.19 of 1973), was enacted to put ceiling on the big land holdings. However, with an objective to promote tea industry in the State, the lands under tea estate were exempted from the operation of the Act under clause (g) of section 5 of this Act. Presently, sections 6-A and 7-A of the Act provide for change of land use and transfer of land under the tea estate respectively with the prior permission of the Government. It has been observed that the lands under the tea estate have been invariably used for purposes other than tea plantation or have been transferred by way of sale etc. by resorting to these provisions which is against the spirit and intention of the legislation. In order to address the issue, a high powered committee was constituted, wherein the members of the Legislative Assembly from all the political parties were included. The said committee has given its recommendations. Thus, in order to promote the tea industry in the State, there is a need to amend the Act by making suitable amendments in sections 6-A and 7-A, so as to discourage change of land use and transfer of lands2543 राजपत्र, हिमाचल प्रदेश, 11 अगस्त, 2021/20 श्रावण, 1943 under the tea estate thereof by way of sale etc. In case of such violations the provisions of the Act with regard to vesting of land with the Government, free from all encumbrances, shall come into operation.

This Bill seeks to achieve the aforesaid objectives.

श्री दुर्गेश चन्द्र पुत्र श्री तेजेन्द्र सिंह, निवासी गांव व डाकघर कामरू, तहसील सांगला, जिला किन्नौर (हि0 प्र0) ने भूमि खाता खतौनी संख्या 4 मिन/15, खसरा संख्या 311, रकबा तादादी 00-11-51 है0, मुहाल कामरू खास के खाना नम्बर 4 (नाम काश्तकार व एहवाल) में कब्जा देवता पर्वोराजेस बजरिया जमुला वाशिन्दगान देह काबिज की दुरुस्ती करने बारे दरख्वास्त इस अदालत में गुजारी है। 2550 राजपत्र, हिमाचल प्रदेश, 11 अगस्त, 2021/20 श्रावण, 1943 उपरोक्त तथ्यों कि मौका छानबीन गिरदावर कानूनगो कामरू द्वारा दिनांक 21-11-2020 को कि गई मौका छानबीन से पाया कि अराजी खसरा नम्बर 311, रकबा तादादी 00-11-51 है0, वाका उप-महाल कामरू खास में प्रार्थी दुर्गेश चन्द्र के कब्जे में है। मौके पर उक्त रकबा पर देवता प्रर्वोराजेस बजरिया जुमला बाशिन्दगान देह का कब्जा हीं है। मुताबिक राजस्व अभिलेख उक्त अराजी खसरा नम्बर 311, रकबा तादादी 00-11-51 है0, वाका उप-महाल कामरू खास मलकीयत दुर्गेश चन्द्र पुत्र तेजेन्दर सिंह दर्ज माल कागजात है। उक्त रकबा की कब्जा दुरुस्ती बारे मोहतमिन मन्दिर देवता श्री बद्री विशाल कामरू ने अनापति प्रमाण-पत्र दी है। ग्रामवासियों के मुताबिक उक्त रकबा अराजी खसरा नम्बर 311, उप-महाल कामरू खास पर उनके जानने में देवता प्रर्वाेराजेस बजरिया जमुला वाशिन्दगान देह काबिज न रहा। उक्त रकबा पर पहले देवा चन्द्र का कब्जा रहा उसके बाद देवा चन्द्र की मृत्यु के बाद वर्तमान में उक्त रकबा पर प्रार्थी दुर्गेश चन्द्र पुत्र तेजेन्द्र सिंह का कब्जा है। उक्त रकबा का कब्जा जमाबंदी खाना काश्त में देवता प्रर्वोराजेस बजरिया जुमला वाशिन्दगान देह काबिज के बजाये काश्त व कब्जा दुर्गेश चन्द्र काश्त व कब्जा स्वयं दुरुस्त की जाये उन्हे कोई आपत्ति न है। (ब्यान ग्र्रामवासी कल्मबद्ध)।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त भूमि खाता खतौनी संख्या 4 मिन/15, खसरा संख्या 311, रकबा तादादी 00-11-51 है0, मुहाल कामरू खास के राजस्व कागजात खाता नम्बर 4 में कब्जा देवता प्रर्वाेराजेस बजरिया जुमला वाशिन्दगान देह काबिज के स्थान कब्जा दुर्गेश चन्द्र पुत्र तेजेन्दर सिंह, निवासी कामरू कब्जा दुरुस्ती की जाने बारे किसी भी व्यक्ति को कोई आपत्ति हो तो वह दिनांक 14-08-2021 को प्रातः 10.00 बजे असालतन अथवा वकालतन हाजिर होकर अपना उजर एवं एतराज प्रस्तुत कर सकता है। इसके उपरान्त कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार नाम कब्जा काश्त दुरुस्ती करने के आदेश पारित किए जाएंगे।

उपरोक्त तथ्यों कि मौका छानबीन गिरदावर कानूनगो सांगला द्वारा दिनांक 14-11-2019 को कि गई मौका छानबीन से पाया कि कुमारी गंगा देवी व श्रीमती सुन्दर दाई अरसा 3-4 वर्ष पहले मृत्यु पा चुकी है मुताबिक वाजिब उल अरज के संजीव कुमार, मदन मोहन द्वारा अपनी बुआ कुमारी गंगा देवी व श्रीमती सुन्दर दाई को अराजी खसरा नम्बरान 483, 482, 576, 1286 व 207, कित्ता-5, रकबा तादादी 00-09-17 है0, उप-महाल बटसेरी में काश्त करने बारे दिया है और राजस्व अभिलेख में कब्जा दर्ज है। बाद मृत्यु कुमारी गंगा देवी व श्रीमती सुन्दर दाई के उपरोक्त खसरा नम्बरान में काश्त व कब्जा संजीव कुमार, मदन मोहन मालकान स्वयं कर रहे हैं, राजस्व अभिलेख में कब्जा दुरुस्त किया जाना वाजिब है।
