स्ांख्या एफ.डी.एस.-(ए)3-2/2019.--हिमाचल प्रदेश के राज्यपाल, उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का 35) की धारा 2(19), 28(2)(ख), 33(3), 38(2), 41, 42(3), 46(3), 70(5) और धारा 102 की उपधारा (2) के खण्ड (क), (छ), (झ), (), (ट), (ठ), (ढ), (ण) और (थ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

89—राजपत्र/2021-27-08-2021 (2977) 2978 राजपत्र, हिमाचल प्रदेश, 27 अगस्त, 2021/05 भाद्रपद, 1943 1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश उपभोक्ता संरक्षण (साधारण) नियम, 2021 है।

(2) ये नियम राजपत्र (ई-गज़ट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. परिभाषाएं-(1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से, उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का 35) अभिप्रेत है ;

(ख) ''आयोग'' से, यथास्थिति, जिला आयोग और राज्य आयोग अभिपे्रत है;

(ग) ''अध्यक्ष'' से, यथास्थिति, जिला आयोग या राज्य आयोग का अध्यक्ष अभिपे्रत है;

(घ) ''धारा'' से, अधिनियम की धारा अभिपे्रत है; और

(ङ) ''राज्य सरकार'' से, हिमाचल प्रदेश सरकार अभिपे्रत है।

(2) उन शब्दों और पदों, जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, के वही अर्थ होंगे जो अधिनियम में उनके हैं।

3. जिला आयोग की बैठक का स्थान.--जिला आयोग का कार्यालय जिला के मुख्यालय में अवस्थित होगा और जहां राज्य सरकार एकल जिला आयोग, जो एक से अधिक जिलों में अधिकारिता रखता हो, की स्थापना करने का विनिश्चय करती है तो यह इस प्रकार स्थापित जिला आयोग का स्थान और अधिकारिता अधिसूचित करेगी।

4. जिला आयोग और राज्य आयोग के कार्य दिवस और काम के घण्टे.--जिला आयोग और राज्य आयोग के कार्य दिवस और काम के घण्टे वही होंगे जैसे कि राज्य के जिला न्यायालयों और उच्च न्यायालय के हैं।

5. मुहर और प्रतीक.--जिला आयोग और राज्य आयोग की आधिकारिक मुहर और प्रतीक ऐसे होंगे जैसे राज्य सरकार निर्दिष्ट करे।

6. जिला आयोग और राज्य आयोग की बैठकें.--जिला आयोग और राज्य आयोग का अध्यक्ष उपभोक्ता-मामलों के त्वरित निपटान के लिए उस आयोग की बैठकें, जब कभी आवश्यक हों आयोजित करेगा।

7. स्थापित की जाने वाली लोक उपयोगी सेवाएं.--लोक उपयोगी सेवाएं, अधिनियम की धारा 2 के खण्ड (19) के प्रयोजनों के लिए स्थापित की जाएंगी।

8. जिला आयोग में सदस्यों की संख्या.--जिला आयोग में एक अध्यक्ष और दो सदस्य होंगे, जिनमें से कम से कम एक सदस्य या अध्यक्ष महिला होगी।

9. जिला आयोग के अधिकारी एवं अन्य कर्मचारिवृंद.--जिला आयोग के अधिकारियों और अन्य कर्मचारियों को संदेय वेतन, भत्ते और सेवा की अन्य निबन्धन तथा शर्तें ऐसे नियमों, विनियमों और आदेशों, जो उस स्थान पर कार्यरत राज्य सरकार के अधिकारियों व अन्य कर्मचारियों को लागू हों, द्वारा विनियमित की जाएंगी। ऐसे अधिकारियों/कर्मचारियों को संदेय वेतन राज्य सरकार की समेकित निधि से चुकता किया जाएगा।

10. विश्लेषण और परीक्षण के लिए जिला आयोग और राज्य आयोग द्वारा माल के अधिप्रमाणन की रीति.--(1) जिला आयोग और राज्य आयोग परिवादी को परीक्षण या विश्लेषण के प्रयोजनों के लिए स्वच्छ2979 राजपत्र, हिमाचल प्रदेश, 27 अगस्त, 2021/05 भाद्रपद, 1943 पात्रों (कंटेनरज़) में समुचित रूप से लगाए गए काम/डाट सहित माल के एक या एक से अधिक नमूने उपलब्ध करवाने के लिए निदेश दे सकेगा।

(2) ऐसे माल के नमूने प्राप्त करने पर, जिला आयोग और राज्य आयोग उनको सीलबन्द करेगा और निम्नलिखित सूचनाओं वाले पात्रों (कंटेनरों) पर नामपत्र (लेबिल) लगाएगा, अर्थात्‌ः-

(क) मान्यता प्राप्त प्रयोगशाला का नाम और पता, जिसको विश्लेषण और परीक्षण के लिए नमूना भेजा जाना है;

(ख) यथास्थिति, जिला आयोग और राज्य आयोग का नाम और पता;

(ग) केस संख्याय; और

(घ) यथास्थिति, जिला आयोग या राज्य आयोग की आधिकारिक मुहर।

(3) सीलबंद नमूने को जिला आयोग और राज्य आयोग द्वारा मान्यता प्राप्त प्रयोगशाला को भेजा जाएगा।

(4) मान्यता प्राप्त प्रयोगशाला, सीलबंद नमूना प्राप्त करने के पश्चात्‌ उसका परीक्षण करेगी, अपनी रिपोर्ट, पैंतालीस दिन के भीतर या ऐसे विस्तारित समय के भीतर, जो जिला आयोग और राज्य आयोग द्वारा प्रदान किया जाए, खराबी (कमी) की प्रकृति और रिपोर्ट की प्रस्तुति की तारीख विनिर्दिष्ट करते हुए, जिला आयोग या राज्य आयोग को अग्रेषित करेगी।

11. रकम का पचास प्रतिशत जमा करने की रीति.--जहां धारा 41 के अधीन कोई अपील फाइल की जाती है, वहां उक्त धारा के द्वित्तीय परन्तुक में यथा उपबंधित अपीलार्थी द्वारा जमा की जाने वाली रकम रजिस्ट्रार, हिमाचल प्रदेश राज्य उपभोक्ता आयोग के पक्ष में किसी राष्ट्रीयकृत बैंक में आहरित किए जाने वाले शिमला में संदेय रेखांकित (क्रॉस्ड) डिमाण्ड ड्राफ्ट के रूप में विप्रेषित की जाएगी।

12. राज्य आयोग में सदस्यों की संख्या.-राज्य आयोग में एक अध्यक्ष और चार सदस्य होंगे, जिनमें कम से कम एक सदस्य या अध्यक्ष महिला होगी।

13. राज्य आयोग के अधिकारी एवं अन्य कर्मचारिवृंद.--राज्य आयोग के अधिकारियों और कर्मचारियों को संदेय वेतन, भत्ते और सेवा की अन्य निबन्धन तथा शर्तें ऐसे नियमों, विनियमों और आदेशों, जो उस स्थान पर कार्यरत राज्य सरकार के अधिकारियों और अन्य कर्मचारियों को लागू हों, द्वारा विनियमित की जाएगी। ऐसे अधिकारियों/कर्मचारियों को संदेय वेतन राज्य सरकार के समेकित निधि से चुकता किया जाएगा। 14. राज्य आयोग द्वारा सूचना प्रस्तुत करने का प्ररूप और रीति.--राज्य आयोग त्रैमासिक या राज्य सरकार द्वारा मामलों के लम्बन सहित कोई सूचना, जब कभी अपेक्षित हो, अनुसूची-1 में यथा विनिर्दिष्ट प्ररूप में प्रस्तुत करेगा।

NOTIFICATION

Shimla, the 24th August, 2021

No. FDS-A(3)-2/2019.—In exercise of the powers conferred by sections 2(19), 28(2)(b), 33(3), 38(2), 41, 42(3), 46(3), 70(5) and clauses (a), (g), (i), (j), (k), (l), (n), (o) and (q) of sub- section (2) of section 102 of the Consumer Protection Act, 2019 (35 of 2019), the Governor of Himachal Pradesh is pleased to make the following rules, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Consumer Protection (General) Rules, 2021.

2. Definitions.— (1) ln these rules, unless the context otherwise requires,—

(a) 'Act' means the Consumer Protection Act, 2019 (35 of 2019);

(b) 'Commission' means the District Commission and the State Commission, as the case may be;

(c) 'President' means the President of the District Commission or the State Commission, as the case may be;

(d) 'Section' means a section of the Act; and

(e) 'State Government' means the Government of Himachal Pradesh.

(2) The words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Act.

3. Place of sitting of the District Commission.—The office of the District Commission shall be located at the headquarters of the District and where the State Government decides to establish a single District Commission having jurisdiction over more Districts than one it shall notify the place and jurisdiction of the District Commission so established.

4. Working days and office hours of District Commission and State Commission.— The working days and office hours of the District Commission and the State Commission shall be the same as that of the District Courts and High Court of the State.

5. Seal and emblem.—The official seal and emblem of the District Commission and State Commission shall be such as the State Government may specify.

6. Sittings of the District Commission and the State Commission.—The President of the District Commission and State Commission shall convene sittings of that Commission as and when it may be necessary for speedy disposal of the consumer cases.

7. Public utility services to be established.—Public utility services shall be established for the purpose of Clause (19) of section 2 of the Act.

8. Number of members in District Commission.—The District Commission shall consist of a President and two members of whom at least one member or the President shall be a woman.

9. Officers and other employees of District Commission.—The salaries and allowances payable to and the other terms and conditions of the service of, the officers and other employees of the District Commission shall be regulated by the rules, regulations and orders as are applicable to the officers and other employees of the State Government stationed at those places. The salary payable to such officers/officials shall be defrayed out of the Consolidated Fund of the State Govt. 10. Manner of authentication of goods by District Commission and State Commission for analysis and testing.—(1) The District Commission and State Commission may direct the2983 राजपत्र, हिमाचल प्रदेश, 27 अगस्त, 2021/05 भाद्रपद, 1943 complainant to provide one or more than one sample of the goods in clean Containers with stopper properly fixed on them for the purposes of testing or analysis.

(2) On receiving the samples of such goods, the District Commission and State Commission shall seal the same and fix labels on the containers carrying the following information, namely:—

(a) The name and address of the recognized laboratory to whom sample shall be sent for analysis and test;

(b) The name and address of the District Commission and State Commission, as the case may be;

(c) The case number; and

(d) The official seal of the District Commission or the State Commission, as the case may be.

(3) The sealed sample shall be sent to the recognised laboratory by the District Commission and State Commission.

(4) The recognized laboratory shall, after receiving sealed sample examine the same, forward its report to the District Commission and State Commission within forty-five days or within such extended time as may be granted by the District Commission and State Commission, specifying the nature of the defect and date of submission of report.

11. Manner of depositing fifty percent of the amount.—Where an appeal is filed under section 41, the amount to be deposited by the appellant as provided in the second proviso to the said section shall be remitted in the form of a crossed Demand Draft drawn on a nationalised bank in favour of the Registrar, Himachal Pradesh State Consumer Commission, payable at Shimla.

12. Number of members in State Commission.—The State Commission shall consist of a President and four members out of whom at least one member or the President shall be a woman.

13. Officers and other employees of State Commission.—The salaries and allowances payable to and the other terms and conditions of service of, the officers and other employees of the State Commission shall be regulated by the rules, regulations and orders as are applicable to the officers and other employees of the State Government stationed at those places. The salary payable to such officers/officials shall be defrayed out of the Consolidated Fund of the State Govt. 14. Form and manner for furnishing of information by State Commission.—The State Commission shall furnish, quarterly or as and when required by the State Government any information including pendency of cases in the form as specified in the following Schedule I :—

संख्या एफ.डी.एस.-ए(3)-2/2019.--हिमाचल प्रदेश के राज्यपाल, उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का 35) की धारा 102 की उपधारा (2) के खण्ड (ग), (घ), (ङ) और (च) के साथ पठित धारा 2986 राजपत्र, हिमाचल प्रदेश, 27 अगस्त, 2021/05 भाद्रपद, 1943 6(2)(ख), 6(4), 8(2)(ख), 8(4) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश उपभोक्ता संरक्षण (राज्य उपभोक्ता संरक्षण परिषद्‌ और जिला उपभोक्ता संरक्षण परिषद्‌) नियम, 2021 है।

(2) ये नियम राजपत्र (ई-गज़ट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. परिभाषाएं.--(1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) "अधिनियम" से, उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का 35) अभिप्रेत है;

(2) उन शब्दों और पदों, जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, के वही अर्थ होंगे जो अधिनियम में उनके हैं।

3. राज्य परिषद्‌ की संरचना.--राज्य सरकार, राजपत्र में अधिसूचना द्वारा राज्य परिषद्‌ की स्थापना करेगी, जिसमें तेरह से अनधिक निम्नलिखित सदस्य होंगे, अर्थात्‌ः-

(क) राज्य सरकार में उपभोक्ता मामले का प्रभारी मन्त्री, राज्य परिषद्‌ का अध्यक्ष होगा;

(ख) विधानसभा के दो सदस्य जिनमें से एक महिला सदस्य होगी;

(ग) राज्य सरकार के उपभोक्ता मामले का प्रभारी प्रशासनिक सचिव;

(घ) रजिस्ट्रार, राज्य उपभोक्ता विवाद प्रतितोष आयोग, हिमाचल प्रदेश;

(ङ) राज्य सरकार द्वारा नामनिर्दिष्ट किए जाने वाले उपभोक्ता संगठनों के तीन से अनधिक प्रतिनिधि;

(च) उपभोक्ता संगठनों, उपभोक्ता सक्रिय कार्यकर्त्ता, अनुसंधान एवं प्रशिक्षण संगठनों, अकादमीशियनों, व्यापार या उद्योग-जगत में से उपभोक्ता हितों का प्रतिनिधित्व करने में सक्षम सिद्ध विशेषज्ञता और अनुभव रखने वाले तीन से अनधिक प्रतिनिधि जिनमें से कम से कम एक महिला प्रतिनिधि होगी; और

(छ) निदेशक, खाद्य, नागरिक आपूर्ति एवं उपभोक्ता मामले, हिमाचल प्रदेश, राज्य परिषद्‌ का सदस्य-सचिव होगा।

4. राज्य परिषद्‌ का कार्यकाल.--राज्य परिषद्‌ का कार्यकाल तीन वर्ष का होगाः

परन्तु राज्य परिषद्‌ तीन मास की और अवधि तक या इसका पुनर्गठन किए जाने की अवधि तक, जो भी पूर्वतर हो, कार्य करती रहेगी।

5. राज्य परिषद्‌ की बैठकें, इसके उद्‌देश्य और कारबार का संव्यवहार.--(1) राज्य परिषद का मुख्यालय शिमला में होगा।

(2) राज्य परिषद्‌ की बैठकें जब भी आवश्यक हो, आयोजित की जांएगी, किन्तु प्रत्येक वर्ष दो से अन्यून बैठकें आयोजित की जाएंगी।2987 राजपत्र, हिमाचल प्रदेश, 27 अगस्त, 2021/05 भाद्रपद, 1943 (3) राज्य परिषद्‌ की बैठक, अध्यक्ष के अनुमोदन से प्रत्येक सदस्य को बैठक की आशयित तारीख से कम-से-कम पंद्रह दिन पहले डाक द्वारा या ई-मेल के माध्यम से त्वरित संचार को सुकर बनाने के लिए लिखित सूचना देते हुए बुलाई जा सकेगी।

(4) राज्य परिषद्‌ की प्रत्येक बैठक की सूचना द्वारा बैठक का समय, तारीख और स्थान तथा बैठक के लिए कार्यसूची की मदें संसूचित की जाएंगी।

(5) राज्य परिषद्‌ की बैठक के दौरान कार्यसूची में सम्मिलित न किए गए किसी भी कारबार पर अध्यक्ष की अनुज्ञा के सिवाय संव्यवहार नहीं किया जाएगा।

(6) किसी रिक्ति के होने अथवा राज्य परिषद्‌ के गठन में किसी त्रुटि के होने मात्र से राज्य परिषद्‌ की कोई भी कार्यवाही अविधिमान्य नहीं होगी।

6. जिला परिषद्‌ की संरचना.--हिमाचल प्रदेश सरकार, राजपत्र में अधिसूचना द्वारा जिला परिषद्‌ की स्थापना करेगी, जिसमें दस से अनधिक निम्नलिखित सदस्य होंगे, अर्थात्‌ः-

(क) सम्बद्ध जिला का उपायुक्त, जिला परिषद्‌ का अध्यक्ष होगा;

(ख) अतिरिक्त उपायुक्त या अतिरिक्त जिला मजिस्ट्रेट जिला परिषद्‌ का उपाध्यक्ष होगा;

(ग) सम्बद्ध जिला उपभोक्ता आयोग का एक सदस्य, जिसे उस आयोग के अध्यक्ष द्वारा नामनिर्दिष्ट किया गया हो;

(घ) राज्य सरकार द्वारा नामनिर्दिष्ट किए जाने वाले उपभोक्ता संगठनों के दो से अनधिक प्रतिनिधि;

(ङ) उपभोक्ता संगठनों, उपभोक्ता सक्रिय कार्यकर्ता, अनुसंधान एवं प्रशिक्षण संगठनों, अकादमीशियनों, कृषकों, व्यापार या उद्योग-जगत में से उपभोक्ता हितों का प्रतिनिधित्व करने में सक्षम सिद्ध विशेषज्ञता और अनुभव रखने वाले दो से अनधिक प्रतिनिधि जिनमें से कम से कम एक महिला प्रतिनिधि होगी; और

(च) जिला का जिला नियन्त्रक, खाद्य, नागरिक आपूर्ति एवं उपभोक्ता मामले जिला परिषद्‌ का सदस्य-सचिव होगा।

7. जिला परिषद्‌ का कार्यकाल.--जिला परिषद्‌ का कार्यकाल तीन वर्ष का होगाः

परन्तु जिला परिषद्‌ तीन मास की और अवधि तक या इसका पुनर्गठन किए जाने की अवधि तक, जो भी पूर्वतर हो, कार्य करती रहेगी।

8. जिला परिषद्‌ की बैठकें, इसके उद्‌देश्य और कारबार का संव्यवहार.--(1) जिला परिषद्‌ जब भी आवश्यक हो बैठक करेगी, किन्तु प्रत्येक वर्ष दो से अन्यून बैठकें आयोजित की जाएंगी।

(3) जिला परिषद्‌ की प्रत्येक बैठक की सूचना द्वारा बैठक का समय, तारीख और स्थान तथा बैठक के लिए कार्यसूची की मदें संसूचित की जाएंगी।

(4) जिला परिषद्‌ की बैठक के दौरान कार्यसूची में सम्मिलित न किए गए किसी भी कारबार पर अध्यक्ष की अनुज्ञा के सिवाय संव्यवहार नहीं किया जाएगा। 2988 राजपत्र, हिमाचल प्रदेश, 27 अगस्त, 2021/05 भाद्रपद, 1943 (5) जिला परिषद्‌ की कोई कार्यवाही केवल किसी रिक्ति के होने या जिला परिषद्‌ के गठन में किसी त्रुटि के कारण अविधिमान्य नहीं होगी।

9. व्यय और बैठक फीस की प्रतिपूर्ति.--राज्य परिषद्‌ और जिला परिषद्‌ के गैर-सरकारी सदस्य राज्य परिषद्‌ या जिला परिषद्‌ की बैठकों में उपस्थित होने के प्रयोजन के लिए प्रति बैठक एक हजार रुपए के मानदेय और टैक्सी के किराए के लिए हकदार होंगे।

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Consumer Protection (State Consumer Protection Council and District Consumer Protection Council) Rules, 2021.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Definitions.—(1) ln these rules, unless the context otherwise requires,—

(a) "Act" means the Consumer Protection Act, 2019 (35 of 2019);

(b) "Chairperson" means the Chairperson of the State Council and District Council;

(c) "State Council" and "District Council" means the State Consumer Protection Council and District Consumer Protection Council established under sub-section (1) of section 6 and sub-section (1) of section 8, respectively of the Act.

(2) The words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Act.

3. Composition of State Council.—The Government of H.P. shall, by notification in the Official Gazette, establish the State Council which shall consist of the following members, not exceeding thirteen, namely: —

(a) The Minister-in-charge of Consumer Affairs in the State Government who shall be the Chairperson of the State Council;

(c) The Administrative Secretary-in-charge of Consumer Affairs in the State Government; (d) The Registrar, H.P. State Consumer Disputes Redressal Commission;

(e) Representatives of consumer organisations not exceeding three, to be nominated by the State Government;

(f) Representatives with proven expertise and experience who are capable of representing consumer interests, drawn from amongst consumer organisations, consumer activists, research and training organisations, academicians, trade or industry, not exceeding three, of whom at least one shall be a woman; and

(g) The Director (FCS & CA), Himachal Pradesh shall be the Member-Secretary of the State Council.

4. Term of State Council.––The term of the State Council shall be three years:

Provided that the State Council shall continue to function for a further period of three months or till it is reconstituted, whichever is earlier.

5. Meetings of State Council, its objects and transaction of business.—(1) The Headquarter of the State Council shall be at Shimla.

(2) The meetings of the State Council shall be held as and when necessary but not less than two meetings shall be held every year.

(3) A meeting of the State Council may be called with the approval of the Chairperson by issuing a notice in writing to every member at least fifteen days before the intended date of the meeting by post, or through e-mail to facilitate speedy communication.

(4) The notice of every meeting of the State Council shall intimate the time, date, and place of the meeting and the items of agenda for the meeting.

(5) Any business not included in the agenda shall not be transacted at a meeting of the State Council except with the permission of the Chairperson.

(6) No proceedings of the State Council shall be invalid merely by reasons of existence of any vacancy in or any defect in the constitution of the State Council.

6. Composition of District Council.—The Government of Himachal Pradesh shall, by notification in the Official Gazette, establish the District Council which shall consist of the following members, not exceeding ten, namely: —

(a) Deputy Commissioner of the concerned District who shall be the Chairperson of the District Council;

(b) Additional Deputy Commissioner or Additional District Magistrate who shall be the Vice Chairperson;

(c) A Member of the concerned District Consumer Commission nominated by the President of that Commission;

State Government;

(e) Representatives with proven expertise and experience who are capable of representing consumer interests, drawn from amongst consumer organisations, consumer activists, research and training organisations, academicians, farmers, trade or industry, not exceeding two, of whom at least one shall be a woman; and

(f) District Controller, Food, Civil Supplies and Consumer Affairs of the District who shall be the Member-Secretary of the District Council.

7. Term of District Council.––The term of the District Council shall be three years:

Provided that the District Council shall continue to function for a further period of three months or till it is reconstituted, whichever is earlier.

8. Meetings of District Council, its objects and transaction of business.—(1) The District Council shall meet as and when necessary but not less than two meetings shall beheld every year.

(2) A meeting of the District Council may be called with the approval of the Chairperson by issuing a notice in writing to every member at least fifteen days before the intended date of the meeting by post, or through e-mail to facilitate speedy communication.

(3) The notice of every meeting of the District Council shall intimate the time, date, and place of the meeting and the items of agenda for the meeting.

9. Reimbursement of expenses and sitting fees.—Non-official members of the State Council and District Council shall be entitled to honorarium of rupees one thousand per sitting plus taxi fare for the purpose of attending meetings of State Council and District Council.

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश उपभोक्ता संरक्षण (मध्यस्थता) नियम, 2021 है।

(2) ये नियम राजपत्र (ई-गज़ट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. परिभाषाएं.--(1) इन नियमों में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) "अधिनियम" से, उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का 35) अभिप्रेत है;

(ख) "आयोग" से, यथास्थिति, जिला आयोग या राज्य आयोग अभिप्रेत है; और

(ग) "मध्यस्थता प्रकोष्ठ" से, अधिनियम की धारा 74 की उपधारा (1) के अधीन स्थापित मध्यस्थता प्रकोष्ठ अभिप्रेत है।

(2) उन शब्दों और पदों, जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, के वही अर्थ होंगे जो अधिनियम में उनके हैं।

3. मध्यस्थता प्रकोष्ठ.--(1) किसी जिला आयोग और राज्य आयोग में स्थापित प्रत्येक मध्यस्थता प्रकोष्ठ में, उस आयोग के अध्यक्ष और सदस्य से मिलकर बनने वाली चयन समिति की सिफारिश पर मध्यस्थों का एक पैनल होगा।

(2) मध्यस्थता प्रकोष्ठ में उतनी संख्या में सहायक कर्मचारिवृंद होंगे, जितने राज्य आयोग/ज़िला आयोग का अध्यक्ष राज्य सरकार के परामर्श से निर्धारित करे तथा सरकार आयोग द्वारा अपेक्षित समस्त प्रशासनिक सहायता और अवसंरचना सुविधाएं उपलब्ध कराएगी।

No. FDS-A(3)-2/2019.—In exercise of the powers conferred by section 74(3) read with clause (p) of sub-section (2) of section 102 of the Consumer Protection Act, 2019 (35 of 2019), the Governor of Himachal Pradesh is pleased to make the following rules, namely: —

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Consumer Protection (Mediation) Rules, 2021.

(2) These rules shall come into force on the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

(a) "Act" means the Consumer Protection Act, 2019 (35 of 2019);

(b) "Commission" means District Commission or State Commission, as the case may be;

and

(c) "Mediation cell" means a consumer mediation cell established under sub-section (1) of section 74 of the Act.

(2) The words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Act.

3. Mediation Cell.—(1) Every Mediation Cell set up in a District Commission and the State Commission shall have a panel of mediators on the recommendation of a selection committee consisting of the President and a member of that Commission.

(2) The Mediation Cell shall have such supporting staff as may be decided by the President of State Commission/District Commission in consultation with the State Government and the Government shall provide all administrative assistance and infrastructure facilities required by the Commission.

(क) 'अधिनियम' से, उपभोक्ता संरक्षण अधिनियम, 2019 (2019 का 35) अभिप्रेत है;

(ख) 'सदस्य' से, यथास्थिति, जिला आयोग या राज्य आयोग का सदस्य अभिपे्रत है,

4. जिला आयोग के अध्यक्ष को संदेय वेतन.--(1) यदि कोई व्यक्ति, जो जिला न्यायाधीश है, जिला आयोग के अध्यक्ष के रूप में नियुक्त किया जाता है तो वह ऐसे वेतन, जो वह उसकी ऐसी नियुक्ति की तारीख को प्राप्त कर रहा था, प्राप्त करने का हकदार होगा।

(2) यदि सेवानिवृा जिला न्यायाधीश को जिला आयोग के अध्यक्ष के रूप में नियुक्त किया जाता है तो वह ऐसे वेतन का हकदार होगा जैसा राज्य के जिला न्यायाधीश को उसके द्वारा आहरित पैन्शन की कुल रकम को घटाकर, अनुज्ञेय है।

(3) यदि जिला आयोग का अध्यक्ष जिला न्यायाधीश बनाए जाने के लिए अर्हित है तो वह राज्य के जिला न्यायाधीश के वेतनमान का न्यूनतम वेतन लेने का हकदार होगा।

5. जिला आयोग के सदस्यों को संदेय पारिश्रमिक/मानदेय.--जिला आयोग के सदस्यों को अंशकालिक आधार पर नियुक्त किया जाएगा और उन्हें राज्य सरकार द्वारा समय समय पर निर्धारित समेकित पारिश्रमिक/मानदेय संदत्त किया जाएगा।

6. राज्य आयोग के अध्यक्ष को संदेय वेतन.--(1) यदि कोई व्यक्ति, जो उच्च न्यायालय का न्यायाधीश है, राज्य आयोग के अध्यक्ष के रूप में नियुक्त किया जाता है तो वह ऐसे वेतन, जो वह उसकी ऐसी नियुक्ति के समय प्राप्त कर रहा था, प्राप्त करने का हकदार होगा।

(2) यदि उच्च न्यायालय के सेवानिवृा न्यायाधीश को राज्य आयोग के अध्यक्ष के रूप में नियुक्त किया जाता है तो वह ऐसे वेतन का हकदार होगा जैसा राज्य के उच्च न्यायालय के पीठासीन न्यायाधीश को, उसके द्वारा आहरित पैन्शन की कुल रकम को घटाकर, अनुज्ञेय है।

7. राज्य आयोग के सदस्यों को संदेय पारिश्रमिक/मानदेय.--राज्य आयोग के सदस्यों को अंशकालिक आधार पर नियुक्त किया जाएगा और उन्हें प्रति बैठक दो हजार पांच सौ रुपए का समेकित पारिश्रमिक/मानदेय संदत्त किया जाएगा।

8. चिकित्सा स्वस्थता.--किसी भी व्यक्ति को जिला आयोग या राज्य आयोग के अध्यक्ष के रूप में तब तक नियुक्त नहीं किया जाएगा जब तक कि राज्य सरकार द्वारा इस निमित विनिर्दिष्ट किसी प्राधिकारी द्वारा उसे चिकित्सक दृष्टया स्वस्थ घोषित नहीं कर दिया जाता है।

9. मकान किराया भाा.--जिला आयोग और राज्य आयोग का अध्यक्ष राज्य सरकार के तत्स्थानी प्रास्थिति के गे्रड-I के अधिकारी को यथा अनुज्ञेय दर पर मकान किराया भो का हकदार होगा। 10. यात्रा और दैनिक भता.--(1) जिला आयोग और राज्य आयोग के अध्यक्ष और सदस्य सरकारी दौरे पर राज्य सरकार के तत्स्थानी प्रास्थिति के ग्रेड-I के अधिकारियों की हकदारी के समरूप यात्रा भत्ता और दैनिक भत्तों के लिए हकदार होंगे।

(2) जिला आयोग और राज्य आयोग का अध्यक्ष सम्बद्ध यान (अटैच्चड व्हीकल) का हकदार होगा। 11. छुट्‌टी और चिकित्सा उपचार तथा अस्पताल सुविधाएं.--जिला आयोग और राज्य आयोग का अध्यक्ष राज्य सरकार के कर्मचारियों को यथा लागू उपबंधों के अनुसार छुट्‌टी, चिकित्सा उपचार और अस्पताल सुविधाओं के लिए हकदार होगा। 2994 राजपत्र, हिमाचल प्रदेश, 27 अगस्त, 2021/05 भाद्रपद, 1943 12. वित्तीय और अन्य हितों की घोषणा.--जिला आयोग और राज्य आयोग के अध्यक्ष और सदस्य अपने पद पर कार्यग्रहण करने से पूर्व अपनी परिसम्पाियां, और अपने दायित्वों और वित्तीय तथा अन्य हितों की घोषणा करेंगे/करेंगी।

13. सेवा की अन्य शर्तें.--(1) अध्यक्ष की सेवा के निबन्धन और शर्तें, जिनकी बाबत इन नियमों में कोई स्पष्ट उपबन्ध नहीं किया गया है, ऐसी होंगी, जैसी राज्य सरकार के तत्स्थानी प्रास्थिति के 'ग्रेड-I' अधिकारी को अनुज्ञेय है।

(2) अध्यक्ष, यथास्थिति, जिला आयोग या राज्य आयोग का पद छोड़ने के पश्चात्‌ राष्ट्रीय आयोग, राज्य आयोग या जिला आयोग में व्यवसाय (प्रैक्टिस) नहीं करेगा।

(3) अध्यक्ष या सदस्य, यथास्थिति, जिला आयोग या राज्य आयोग में इन हैसियतों में कृत्य करते हुए माध्यस्थम का कोई भी कार्य नहीं करेगा।

(4) यथास्थिति, जिला आयोग या राज्य आयोग का अध्यक्ष उस तारीख, जिसको वह पद पर नहीं रहता है, से दो वर्ष की अवधि के लिए, किसी व्यक्ति, जो जिला आयोग या राज्य आयोग की कार्यवाहियों में पक्षकार रहा है, से इसके प्रबन्धन या प्रशासन से सम्बद्ध कोई नियोजन स्वीकार नहीं करेगाः

परन्तु इन नियमों में अन्वर्दिष्ट कोई बात केन्द्रीय सरकार या राज्य सरकार या स्थानीय प्राधिकरण या किसी कानूनी प्राधिकरण या किसी केन्द्रीय, राज्य या प्रान्तीय अधिनियम द्वारा या के अधीन स्थापित किसी निगम या कम्पनी अधिनियम, 2013 (2013 का 18) की धारा 2 के खण्ड (45) में यथा परिभाषित किसी सरकारी कम्पनी के अधीन किसी नियोजन को लागू नहीं होगी।

14. पद और गोपनीयता की शपथ.--अध्यक्ष और सदस्य नियुक्त किए जाने वाला प्रत्येक व्यक्ति अपना पद ग्रहण करने से पूर्व इन नियमों से संलग्न प्ररूप-1 में पद की शपथ और प्ररूप-2 में गोपनीयता की शपथ लेगा और हस्ताक्षर करेगा।

15. वेतन, पारिश्रमिक और अन्य भत्ते राज्य की संचित निधि में से चुकता किए जाएंगे।

16. जिला आयोग या राज्य आयोग के अध्यक्ष और सदस्य की सेवा के निबन्धन और शर्तें उनके पद के कार्यकाल के दौरान प्रतिकूलतः परिवर्तित नहीं की जाएंगी।

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Consumer Protection (Salary and other terms and conditions of service of the President and Members of the District Commission/State Commission) Rules, 2021.

(2) These rules shall come into force on the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Scope and applicability.—These rules shall apply to those incumbents who are appointed on or after coming into force of the Consumer Protection Act, 2019 (35 of 2019) in the State of Himachal Pradesh.

3. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) 'Act' means the Consumer Protection Act, 2019 (35 of 2019);

(b) 'Member' means a member of the District Commission or the State Commission, as the case may be;

(c) 'President' means the President of the District Commission or the State Commission, as the case may be; and

(d) 'State Government' means Government of Himachal Pradesh.

(2) The words and expressions used in these rules but not defined shall have the same meaning as assigned to them in the Act.

4. Salaries payable to President of District Commission.—(1) If a person who is District Judge is appointed as the President of the District Commission then he shall be entitled to receive the salary which he was getting on the date of his such appointment.

(2) In case the retired District Judge has been appointed as President of the District Commission then he shall be entitled to such salary as is admissible to District Judge of the State reduced by the gross amount of pension drawn by him.

(3) If the President of the District Commission is a person qualified to be District Judge then he shall be entitled to salary to the minimum of the pay scale of the District Judge of the State.

5. Remuneration/honorarium payable to members of District Commission.—The members of the Commission shall be appointed on part-time basis and shall be paid a consolidated remuneration/honorarium as may be prescribed from time to time by the State Government. 6. Salaries payable to President of the State Commission.—(1) If a person who is Judge of the High Court is appointed as President of the State Commission then he shall receive the salary which he was receiving at the time of his such appointment.

(2) In case the retired Judge of the High Court has been appointed as President of the State Commission then he shall be entitled to such salary as is admissible to the sitting Judge of High Court of the State reduced by the gross amount of pension drawn by him.

7. Remuneration/honorarium payable to members of State Commission.—The members of the State Commission shall be appointed on part-time basis and shall be paid a consolidated remuneration/ honorarium of rupees two thousand five hundred per sitting.

8. Medical fitness.—No person shall be appointed as President of the District Commission and State Commission unless he/she is declared medically fit by an authority specified by the State Government in this behalf.

9. House rent allowance.—The President of the District Commission and State Commission shall be entitled to house rent allowance at the same rate as is admissible to 'Grade-I' Officer of the State Government of a corresponding status.

10. Travelling and daily allowance.—(1) The President and the members of the District Commission and State Commission shall be entitled to travelling and daily allowances on official tours equivalent to the entitlements of 'Grade-I' Officers of the State Government of corresponding status.

(2) President of the District Commission and State Commission shall be entitled to an attached vehicle.

11. Leave and medical treatment and hospital facilities.—The President of the District Commission and the State Commission shall be entitled to leave, medical treatment and hospital facilities as per the provisions as are applicable to the employees of the State Government. 12. Declaration of Financial and other Interests.—The President and Member of the District Commission and State Commission shall, before entering upon his/her office, declare his/her assets, and his/her liabilities and financial and other interests.

13. Other conditions of service.—(1) The terms and conditions of service of the President with respect to which no express provision has been made in these rules, shall be such as are admissible to a 'Grade-I' Officer of the State Government of a corresponding status.

(2) The President shall not practise before the National Commission, the State Commission or the District Commission after demitting the office of the District Commission or the State Commission, as the case may be.

(3) The President or member shall not undertake any arbitration work while functioning in these capacities in the District Commission or the State Commission, as the case may be.

(4) The President of the District Commission or the State Commission, as the case may be, shall not, for a period of two years from the date on which they cease to hold office, accept any employment in, or connected with the management or administration of, any person who has been a party to a proceeding before the District Commission or the State Commission:

Provided that nothing contained in these rules shall apply to any employment under the Central Government or a State Government or a local authority or in any statutory authority or any corporation established by or under any Central, State or Provincial Act or a Government company as defined in clause (45) of section 2 of the Companies Act, 2013 (18 of 2013).

14. Oaths of office and secrecy.—Every person appointed to be the President and Member shall, before entering upon his/her office, make and subscribe an oath of office in Form-I and oath of secrecy in Form-II appended to these rules.
