संख्याः जीएडी-बी-(ए) 1-5/2021.--हिमाचल प्रदेश के राज्यपाल की राय है कि लोकहित में ऐसा करना आवश्यक और समीचीन है कि जिला मण्डी, हिमाचल प्रदेश में उप-मण्डल (नागरिक), गोहर की तहसील बालीचौकी के चौदह पटवार वृत्त, उप-मण्डल (नागरिक), थुनाग की तहसील बालीचौकी के एक पटवार वृत्त और उप-मण्डल (नागरिक), सदर की तहसील औट के सात पटवार वृत्तों के सम्पूर्ण क्षेत्रों को 116—राजपत्र/2021-01-10-2021 (4113) 4114 राजपत्र, हिमाचल प्रदेश, 01 अक्तूबर, 2021/09 आश्विन, 1943 अपवर्जित करके उप-मण्डल (नागरिक), बालीचौकी के नाम से ज्ञात एक नए उप-मण्डल (नागरिक) का सृजन किया जाए, ताकि नजदीक के गांवों के सम्बद्ध लोगों को बेहतर सेवाएं उपलब्ध करवाई जा सकें और जिससे उन्हें होने वाली असुविधा से निवारित किया जा सके तथा बेहतर प्रशासनिक नियन्त्रण हो सके।

अतः, हिमाचल प्रदेश के राज्यपाल, दण्ड प्रक्रिया संहिता, 1973 की धारा 7 की उप-धारा (3) के साथ पठित हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) की धारा 6 और रजिस्ट्रीकरण अधिनियम, 1908 (1908 का अधिनियम संख्यांक 16 ) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश उच्च न्यायालय के परामर्श से, उप-मण्डल (नागरिक) गोहर की तहसील बालीचौकी के चौदह पटवार वृत्त, उप-मण्डल (नागरिक) थुनाग की तहसील बालीचौकी के एक पटवार वृत्त और उप-मण्डल (नागरिक)सदर की तहसील औट के सात पटवार वृत्तों के सम्पूर्ण क्षेत्रों को अपवर्जित करते हैं और जिला मण्डी, हिमाचल प्रदेश में नए उप-मण्डल (नागरिक) बालीचौकी, जिसका मुख्यालय बालीचौकी मेंं होगा, का तुरन्त प्रभाव से सृजन करते हैं, जिसमें निम्नलिखित पटवार वृत्त समाविष्ट होंगेः--

No. GAD-B-(A)1-5/2021.—WHEREAS, the Governor of Himachal Pradesh is of the opinion that it is necessary and expedient in the public interest to do so that a new Sub-Division (Civil) to be known as Sub-Division (Civil) Balichowki in District Mandi, Himachal Pradesh may be created by excluding the entire area of Tehsil Balichowki, having 14 Patwar Circles of Sub- Division (Civil) Gohar and 1 Patwar Circle of Tehsil Balichowki in Sub-Division(C) Thunag and 7 Patwar Circles from Tehsil Aut of Sub-Division (C) Sadar to provide better services to the concerned people of nearby villages and to avoid inconvenience being faced by them and to have better administrative control.

NOW, THEREFORE, in exercise of the powers conferred by section 6 of the Himachal Pradesh Land Revenue Act, 1954 (Act No. 6 of 1954) and section 5 of the Registration Act, 1908 (Act No. 16 of 1908) read with sub-section (3) of section 7 of the Code of Criminal Procedure, 1973, the Governor of Himachal Pradesh, in consultation with the High Court of Himachal Pradesh, is pleased to exclude the entire area of Tehsil Balichowki of Sub-Division (Civil) Gohar having 14 Patwar Circles, 1 Patwar Circle from Tehsil Balichowki of Sub-Division(C) Thunag and 7 Patwar circles from Tehsil Aut of Sub-Division(C) Sadar and to create a new Sub-Division (Civil) Balichowki with its headquarter at Balichowki in District Mandi, Himachal Pradesh, which shall consist of the following Patwar Circles with immediate effect:—

NOTIFICATION

Shimla-2, the 17th September, 2021

No. FFE-B-A(4)-1/2016.—WHEREAS, the "Sale Linked Price" is applicable in the Private Sale Cases of scheduled species which are worked by the H.P. State Forest Development Corporation Limited in the Himachal Pradesh under Himachal Pradesh Forest Produce (Regulation of Trade) Act, 1982.

AND WHEREAS, the Pricing Committee in its meeting held on 5th March, 2021 has recommended that royalty for lots worked under experimental silviculture marking in 2018-19 will be charged on sale linked price.

NOW, THEREFORE, the Governor of Himachal Pradesh is pleased to give approval of the procedure on the Experimental Silviculture marking of Khair, Chil, Sal and Eucalyptus species in Nurpur, Bilaspur and Paonta Forest Division during 2018-19 for charging the royalty on sale linked price is as under:—

(A) Actual final sale realization, excluding rebate (including forfeiture of securities, earnest money, insurance claim, if any) of the forest produce.

(B) Actual direct expenses on felling, conversion, carriage, transportation, loading, unloading, stacking, insurance, road tax, rent of land hired for stacking of forest produce, export permit fee, videography etc.

(C) Interest on investment i.e. on Item No. B ibid, at the borrowing rate of interest, prevalent 1st March of each year.

(D) Handling Charges as per the Balance Sheet of relevant year on final sale realization excluding rebate.

(E) Price of the forest produce payable as royalty to HP FD. =A-(B+C+D).

The payment of royalty worked out above i.e. (E) for each lot shall be paid by the HPSFDC Ltd. within 90 days from the date of issuance of this notification otherwise interest as approved by the Pricing Committee shall be charged from the HPSFDC Ltd.

This would be a one time decision and not to be quoted as a precedence for fixation of royalty rates in future green markings.

1. हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास के सोना और चाँदी सहित समस्त प्राप्तियों या चढ़ावों को केवल हिन्दुओं से सम्बन्धित कल्याण और अन्य कार्यकलापों से सम्बन्धित प्रयोजनों के लिए ही उपयोग में लाया जाएगा। किसी/किन्हीं भी (प्राप्ति) प्राप्तियों या (चढ़ावा) चढ़ावे को गैर-हिन्दुओं से सम्बन्धित कार्यकलापों से सम्बद्ध प्रयोजनों के लिए उपयोग में नहीं लाया जाएगा।

2. सुरक्षा आदि से सम्बन्धित कार्मिकों सहित समस्त अधिकारी और कर्मचारी, चाहे वे नियुक्त किए गए हों या तैनात किए गए हों या अन्य-स्त्रोतीकरण के आधार पर लगाए गए हों, केवल हिन्दू धर्म को मानने वाले व्यक्तियों में से ही होंगे।

1. All the receipts or offerings including gold and silver of the Hindu Public Religious Institutions and Charitable Endowments shall be used only for the purposes pertaining to the welfare and other activities relating to only Hindus. No receipts or offerings shall be used for the purposes associated with activities relating to Non-Hindus.

2. All the officers and officials including the personnel related to security etc., whether appointed or deputed or taken on outsourcing basis shall be out of the persons professing the Hindu religion only.

(आ) उक्त निर्वाचन के सम्बन्ध में, निम्नलिखित निर्धारित करता हैः--
