No. MCS/Comm/956/Mu/2021-2778.—Whereas, an intention to declare ambulance road from Tutikandi Gali to Jajhotka Bag i.e. R.D. 0/270 to R.D. 1/120 having width of 3.00 mtrs. leading through Khasra No.1425, 1426, 1427, 1429, 1430,1431 & 1517 situated in Mohal Panjri, Tehsil Shimla (Urban), District Shimla, H.P. was issued under section 226(2) of HPMC Act, 1994 through a public notice for inviting objection/suggestion from general public on 23-02-2021.

And Whereas, Sh. Jai Chand Thakur, Prabhari, Ward No. 10,Tutikandi raised objection that the alignment of the proposed ambulance road is faulty and will benefit only private commercial Hotel Complex being constructed on Sankat Mochan, Tutikandi road and it is not going to benefit the population of adjoining Rirka village.

And Whereas, as per the report of Patwari, Municipal Corporation Shimla which is based on the entries in the revenue record, the land comprising in Khasra No.1425, 1426, 1427, 1429, 1430,1431& 1517 situated in Mohal Panjri, Tehsil Shimla (Urban), District Shimla, H.P. is in the ownership of the Govt. of Himachal Pradesh and under possession कब्ज़ा स्वयं तांबे हक़ूक़ बर्तन बर्तनदारान मुताबिक नक्शा बर्तन।

And Whereas, the statements of S/Sh. Jai Chand Thakur and Ravinder Thakur S/o Late Sh. Shadi Ram, village Jajotka Bag recorded by the Patwari of Municipal Corporation Shimla were placed on record. Both, S/Sh. Jai Chand Thakur and Ravinder Thakur were heard in person. The contention of Sh. Ravinder Thakur that he is the owner of the land on which the proposed ambulance road is to be constructed is contrary to the entries in revenue record as the land in question is under the ownership of the State Government and is in possession of the local residents having rights on the said land. Moreover, the contention of objector that the proposed ambulance road will benefit only a commercial establishment is also not sustainable for the reason that it will benefit the residents of the area in its entirety. The village Rirka is already connected with road, therefore, contention of the objector that the proposed road is not beneficial if the same is not connected to village Rirka. Thus keeping in view the demand of the local residents, it has been considered desirable that the existing path from Tutikandi Gali to Jajhotka Bag be declared as ambulance road for the convenience of the residents of the area.

Now therefore, the undersigned in exercise of the powers conferred upon me by Section 226(2) of the Himachal Pradesh Municipal Corporation Act, 1994, I, Ashish Kohli, HAS, Commissioner, Municipal Corporation, Shimla hereby declare ambulance road from Tutikandi Gali4439 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2021/19 आश्विन, 1943 to Jajhotka Bag i.e. R.D. 0/270 to R.D. 1/120 having and length of 850 mtrs. with width of 3.00 mtrs leading through Khasra No.1425, 1426, 1427, 1429, 1430, 1431 & 1517 situated in Mohal Panjri, Tehsil Shimla in the larger Public interest.

No. MCS/Comm/GA/2075/Mu./2021-2779.—Whereas, an intention to declare ambulance road from Gahan road (near Thaper house) to Andri Summerhill i.e. R.D. 0/0 to 0/120 meter having width of 3.40 mtrs. leading through Khasra No. 493/1 & 682/6/1 measuring total area 352-70 (i.e. Khasra No.493/1 area 34-25 & Khasra No. 682/6/1 area 318-45 kita 2) situated in Mohal Andri, Tehsil Shimla (Urban), District Shimla, H.P. was issued under section 226(2) of HPMC Act, 1994 through a public notice for inviting objection/suggestion from general public on 15-06-2021.

And Whereas, the Executive Engineer-I, Central Public Works Department, Kennedy Cottage Shimla-4 vide letter No. 20 (Misc) यो0शा0/शि0के0म0-1/2021-1605 dated 09-07-2021 has raised objection that the land in question may not be used for proposed construction of ambulance road as the Government of India (CPWD) is the owner of the land comprised in Khasra No. 493 and 682/6 situated in Mohal Andri, Tehsil Shimla (Urban), District Shimla, H.P.

And Whereas, the Assistant Engineer and Junior Engineer, CPWD appeared on behalf of CPWD submitted that since the proposed ambulance road would prove beneficial to the residents of the area including the inhabitants of Block of CPWD, therefore, they have no objection provided the necessary permission of their appropriate authorities is taken.

And Whereas, the revenue record vis-à-vis the submissions made by the officials of the CPWD have been duly considered. The proposed ambulance road would benefit not only old and sick people who need ambulance but also it will prove beneficial to the residents of the area including the residents residing in the colony of CPWD. Accordingly, keeping in view the utility of the proposed ambulance road, it is considered desirable that the existing path leading from Gahan road (near Thaper house) to Andri Summerhill be declared as ambulance road for the convenience of the residents of the area including the residents of CPWD Colony.

Now therefore, the undersigned in exercise of the powers conferred upon me by Section 226(2) of the Himachal Pradesh Municipal Corporation Act, 1994, I, Ashish Kohli, HAS, Commissioner, Municipal Corporation, Shimla hereby declare ambulance road from Gahan road (near Thaper house) to Andri Summerhill i.e. R.D. 0/0 to 0/120 meter having width of 3.40 mtrs. leading through Khasra No. 493/1 & 682/6/1 measuring total area 352-70 (i.e. Khasra No.493/1 area 34-25 & Khasra No. 682/6/1 area 318-45 kita 2) situated in Mohal Andri, Tehsil Shimla (Urban), District Shimla, H.P. in the larger Public interest. Objection against Public Notification vide endorsement No. 2017-549, dated 18-02-2017.

No.MCS/1940/Comm/2017-2787.—That in exercise of the powers conferred by Section 226(1) of the Himachal Pradesh Municipal Corporation Act, 1994 the area falling under Khasra Numbers 1744, 1767 (old) 1948/1767 and 1947/1767 situated at Up-Muhal Dhar, Tehsil Urban Shimla was notified/declared as Ambulance Road/Public path vide order dated on 06-03-2012 by the then Commissioner, Municipal Corporation Shimla after hearing objections so received from the inhabitants/ owners of the land of the area.

Pursuant to the declaration of the area falling under Khasra Numbers 1744, 1767 (old) 1948/1967 and 1947/1767 as Ambulance Road/Public path, the construction work of the same was undertaken by the Roads & Building Deptt., MC Shimla during the year 2012-2013. On completion of the construction of the road, joint inspection was carried out by the representative of the Revenue authorities in the year 2015 at the instance of one Sh. Sanjeev Kuthiala.

That during the course of inspection, it was observed that the Road/Public path actually passes through Khasra Numbers 1744, 1767 (old) 1948/1767 and 1750 and the area falling under Khasra Number 1947/1767 situated at Up-Muhal Dhar, Tehsil Urban Shimla remained unutilized.

That Sh. Sanjeev Kuthiala moved an application dated 12-02-2016 for correction of order to the extent that since no path is constructed upon Khasra Number 1947/1767 and rather it existed upon Khasra Number 1750, hence the original order dated 06-03-2012 be modified as per actual position on the spot.

That on consideration, the original order dated 06-03-2012 was rescinded by the Joint Commissioner and fresh notice inviting objections were issued by the Joint Commissioner without any authority which were set aside vide order dated 26-08-2017. However a fresh notice inviting objections from the owners of the land of Khasra Numbers 1744, 1767 (old) 1948/1767, 1947/1767 and 1750 vide public notice dated 14-11-2017 was issued.

That one Sh. Anil Tanwar S/o Late Sh. M.S. Tanwar, R/O Daulat Niwas, Tutikandi Shimla has raised objection for inclusion of Khasra Number 1750 instead of Khasra Number 1947/1767 in the said road stating that Sh. Sanjeev Kuthiala willingly has given affidavit for construction of Ambulance road/public path through Khasra No. 1947/1767 and therefore he has no claim for exclusion of this Khasra Number from the road under reference. Further the objector has claimed that Commissioner cannot review any order passed in the past as it my amount review of its own orders.

The power to review has been prescribed under section 402-A of HPMC Act, 1994 which provides as under:—

"The Commissioner may, on his own or on the application made by any of the party to the proceedings review the order passed by him under this Act in accordance with the provisions of order XLVII of the Code of Civil Procedure, 1908 and may modify or reverse the same accordingly."

"The objections raised by Sh. Anil Tanwar has been considered on the basis of demarcation report and also in terms of the existing position on the spot and it has been observed that the Ambulance Road/Public path exist on Khasra Number 1744, 1767 (old) 1948/1767 and 1750. The ownership of Khasra Number 1750 is that of Govt. of Himachal Pradesh and in possession of Municipal Corporation Shimla. The demarcation report clearly stipulates that the Ambulance Road/Public path passes through Khasra Number 1750 and is being utilized by the public at large. During execution of work the area falling under Khasra Number 1947/1767 has not fallen under the road alignment and remain unutilized. It is pertinent to mention that while the work was under progress, none has raised objection in this regard. Thus the very purpose of acquisition of Khasra Number 1947/1767 has been defeated and the same is required to be rescinded to the actual owner of the land.

The objector was given fresh opportunity of hearing by the undersigned also, but the grounds taken by the objector in his representation as well as orally are contrary to the facts on record as well as the contention put forth by him with regard to the competency of the Commissioner, Municipal Corporation is contrary to the provision as contained in Section 402–A of HPMC Act, 1994, therefore the objections raised by him is not sustainable and are hereby rejected.

Accordingly the undersigned in exercise of the powers conferred by Section 402-A read with Section 226(1) of Himachal Pradesh Municipal Corporation Act, 1994 partially modify the order No. 06 dated 06-03-2012 thereby declaring the Khasra Number 1744, 1767 (old) 1948/1767 and 1750 as Ambulance Road/Public path situated at Up-Mohal Dhar, Tehsil Urban Shimla. Further the Khasra Number 1947/1767 situated at Up-Mohal Dhar, Tehsil Urban Shimla is hereby rescinded to the actual owner.

No. 3/4/ID/2021/SDR/VOL.II.—1. Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing impersonation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing impersonation of electors and facilitating their identification at the time of poll, the issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and

3. Whereas, Rules 49H(3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Electors Photo Identity Card at the polling station and failure or refusal on their part to produce those Electors Photo Identity Card may result in the denial of permission to vote; and

4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Electors Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and

5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

6. Whereas, Electors Photo Identity Card have been issued to approximate 100% electors in the States/UT of Dadra & Nagar Haveli and Daman & Diu, Madhya Pradesh, Himachal Pradesh, Andhra Pradesh, Assam, Bihar, Haryana, Karnataka, Maharashtra, Meghalaya, Mizoram, Nagaland, Rajasthan, Telangana & West Bengal; and4443 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2021/19 आश्विन, 1943 7. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that for current bye-elections from 3 Parliamentary Constituencies of UT of Dadra & Nagar Haveli and Daman & Diu, Madhya Pradesh & Himachal Pradesh States & 30 Assembly Constituencies of 14 States (As per Annexure-I) notified on 01-10-2021, all electors who have been issued EPIC shall produce the EPIC for their identification at the polling station before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity :—

(i) Aadhaar Card,

(ii) MNREGA Job Card,

(iii) Passbooks with photograph issued by Bank/Post Office,

(iv) Health Insurance Smart Card issued under the scheme of Ministry of Labour, (v) Driving License,

(vi) PAN Card,

(vii) Smart Card issued by RGI under NPR,

(viii) Indian Passport,

(ix) Pension document with photograph,

(x) Service Identity Cards with photograph issued to employees by Central /State Govt./PSUs/Public Limited Companies and

(xi) Official identity cards issued to MPs/MLAs/MLCs.

8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an EPIC, which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification provided the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 above.

9. Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral rolls under Section 20A of the Representation of the People Act, 1950, based on the particulars in their Indian Passport, shall be identified on the basis of their original passport only (and no other identity document) in the polling station.

सं. 3/4/आई.डी./2021/एसडीआर/खण्ड-II.--1. यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61 में यह उपबंधित है कि निर्वाचकों के प्रतिरूपण का निवारण करने की दृष्टि से, ताकि उक्त4445 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2021/19 आश्विन, 1943 अधिनियम की धारा 62 के अधीन वास्तविक निर्वाचकों का उनके मत देने के अधिकार को और अधिक प्रभावी बनाया जा सके, मतदान के समय निर्वाचकों की पहचान सुनिश्चित करने के साधन के रूप में निर्वाचकों के लिए निर्वाचक फोटो पहचान पत्र के उपयोग हेतु नियमों के द्‌वारा उपबंध किए जा सकते हैं, तथा 2. यतः, निर्वाचकों का रजिस्टी्रकरण नियम, 1960 का नियम 28 निर्वाचन आयोग को, इस दृष्टि से कि निर्वाचकों के प्रतिरूपण का निवारण हो सके तथा मतदान के समय उनकी पहचान को सरल बनाया जा सके, निर्वाचकों को राज्य की लागत पर फोटोयुक्त निर्वाचक फोटो-पहचान पत्र जारी करने के लिए निदेश देने की शक्ति प्रदान करता है; तथा

3. यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 49 ज (3) और 49 ट (2) (ख) में यह उपबंधित है कि जहां किसी निर्वाचन क्षेत्र के निर्वाचकों को निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 28 के उक्त उपबंधों के अधीन निर्वाचक फोटो पहचान पत्र दिए गए हैं, वहां निर्वाचकों को मतदान केन्द्र में अपना निर्वाचक फोटो पहचान- पत्र दिखाना होगा तथा उनकी ओर से उन निर्वाचक फोटो पहचान पत्रों को नहीं दिखाए जाने या दिखाने में असमर्थ होने पर उन्हें मत डालने की अनुमति देने से इनकार किया जा सकता है; तथा

4. यतः, उक्त अधिनियम और नियमों के उपर्युक्त उपबंधों को मिलाकर एवं सामंजस्यपूर्ण ढंग से उनके अध्ययन से यह स्पष्ट होता है कि यद्‌यपि मत देने का अधिकार निर्वाचक नामावली में नाम के होने से ही होता है, यह निर्वाचन आयोग द्‌वारा राज्य की लागत पर, मतदान के समय उनकी पहचान सुनिश्चित करने के साधन के रूप में प्रदान करवाए गए निर्वाचक फोटो पहचान पत्र के प्रयोग पर भी निर्भर करता है, तथा दोनों का एक साथ प्रयोग करना होता है; तथा

5. यतः, निर्वाचन आयोग ने एक समयबद्ध कार्यक्रम के अनुसार सभी निर्वाचकों को निर्वाचक फोटो पहचान पत्र ई0पी0आई0सी0 जारी करने का निदेश देते हुए 28 अगस्त, 1993 को एक आदेश जारी किया है; तथा

6. यतः, संघ राज्य क्षेत्र दादरा एवं नागरा हवेली एवं दमन और दीव, मध्यप्रदेश, हिमाचल प्रदेश, आंध्रप्रदेश, असम, बिहार, हरियाणा, कर्नाटक, महाराष्ट्र, मेघालय, मिजोरम, नागालैण्ड, राजस्थान, तेलंगाना और पश्चिम बंगाल में निर्वाचकों को 100ः निर्वाचक फोटो पहचान पत्र जारी किए जा चुके हैं; तथा 7. अतः, अब, सभी संबद्ध कारकों तथा विधिक एवं तथ्यात्मक स्थितियों को ध्यान में रखते हुए, निर्वाचन आयोग, एतद्‌द्वारा, यह निदेश देता है कि दिनांक 01-10-2021 को अधिसूचित चालू उप-निर्वाचनों में 3 संसदीय निर्वाचन क्षेत्रों संघ राज्य क्षेत्र दादरा और नागर हवेली एवं दमन और दीव, मध्यप्रदेश एवं हिमाचल प्रदेश राज्यों और 14 राज्यों के 30 विधान सभाओं (अनुलग्नक के अनुसार) के उप निर्वाचनों के लिए सभी निर्वाचक जिन्हें निर्वाचक फोटो पहचान पत्र जारी किए गए हैं, मतदान स्थल पर अपना मत डालने से पहले अपनी पहचान सुनिश्चित करने हेतु अपना निर्वाचक फोटो पहचान-पत्र दिखाएंगे। ऐसे निर्वाचक जो अपना फोटो पहचान-पत्र प्रस्तुत नहीं कर पाते हैं, उन्हें अपनी पहचान स्थापित करने के लिए निम्नलिखित वैकल्पिक फोटो पहचान दस्तावेजों में से कोई एक प्रस्तुत करना होगाः-- (i) आधार कार्ड,

(ii) मनरेगा जॉब कार्ड,

(iii) बैंकों/डाकघरों द्‌्‌वारा जारी की गई फोटोयुक्त पासबुक,

(iv) श्रम मंत्रालय की योजना के अन्तर्गत जारी स्वास्थ्य बीमा स्मार्ट कार्ड,

(v) ड्राइविंग लाइसेन्स,

(vi) पैन कार्ड,4446 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2021/19 आश्विन, 1943 (vii) एनपीआर के अंतर्गत आरजीआई द्‌वारा जारी किए गए स्मार्ट कार्ड, (viii) भारतीय पासपोर्ट,

(ix) फोटोयुक्त पेंशन दस्तावेज,

(x) राज्य/केन्द्र सरकार के लोक उपक्रम, पब्लिक लिमिटेड कम्पनियों द्‌वारा अपने कर्मचारियों को जारी किए गए फोटोयुक्त सेवा पहचान-पत्र,

बनाम आम जनता ...प्रत्यार्थी। विषय.-- 13(3) जन्म एवम्‌ मृत्यु पंजीकरण अधिनियम, 1969 के अन्तर्गत जन्म पंजीकरण करने बारे।4455 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2021/19 आश्विन, 1943 प्रार्थिया श्रीमती गीता देवी पत्नी हरी राम, ग्राम शराहन, डाकघर सरी, तहसील चौपाल ने अधोहस्ताक्षरी के न्यायालय में एक आवेदन-पत्र प्रस्तुत किया है कि उसने अपने पुत्र का नाम व जन्म तिथि ग्राम पंचायत थुन्दल के जन्म पंजीकरण रजिस्टर में दर्ज नहीं करवाया है, तथा प्रार्थिया अब अपने पुत्र का नाम व जन्म तिथि ग्राम पंचायत थुन्दल के जन्म पंजीकरण रजिस्टर में निम्न प्रकार से दर्ज करवाना चाहती है।

अतः आम जनता को बजरिया इश्तहार सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त जन्म पंजीकरण बारे कोई आपत्ति हो तो इस इश्तहार के प्रकाशन से 30 दिन के भीतर किसी भी कार्य दिवस पर प्रातः 10.00 बजे से सायं 5.00 बजे तक असालतन या वकालतन हाजिर अदालत आकर अपनी आपत्ति प्रस्तुत करें अन्यथा आवेदन-पत्र पर आवश्यक आदेश पारित करके ग्राम पंचायत थुन्दल को आगामी कार्यान्वयन हेतु भेज दिया जायेगा।

यह दरख्वास्त इस न्यायालय में श्री योगिन्द्र सिंह पुत्र श्री फकीर चन्द, गांव पलजारा, डाकघर बाहली, उप-तहसील तकलेच, जिला शिमला (हि0प्र0) ने इस आशय के साथ प्रस्तुत की है कि वादी का नाम मुताबिक नकल परिवार रजिस्टर, आधार कार्ड व मतदान-पत्र में योगिन्द्र सिंह सही व दुरुस्त है परन्तु खाता/खतौनी नं0 15/83, 14/43 ता 82, 12/39 ता 40, 11/36 ता 38, 10/35, 13/41 ता 42 वाका चक पलजारा के खाना मालिक में वादी का नाम जोगिन्द्र सिंह दर्शाया गया है जो सही नहीं है। वादी उपरोक्त राजस्व कागजात माल वाका चक पलजारा में अपना नाम जोगिन्द्र सिंह के स्थान पर योगिन्द्र सिंह सही व दुरुस्त करवाना चाहता है। 4456 राजपत्र, हिमाचल प्रदेश, 11 अक्तूबर, 2021/19 आश्विन, 1943 अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त वादी का नाम दुरुस्त करने बारे राजस्व अभिलेख के माल कागजात वाका चक पलजारा में किसी का कोई उजर व एतराज हो तो दिनांक 29-10-2021 को या इससे पूर्व अदालत हज़ा में हाज़िर आकर अपना उजर व एतराज दर्ज़ करवा सकता है। बाद गुजरने मियाद कोई भी उजर व एतराज काबिले समायत न होगा तथा नियमानुसार वादी का नाम दुरुस्त करने के आदेश पारित किये जाएंगे।

आज दिनांक 28-09-2021 को मेरेे हस्ताक्षर व मोहर अदालत से जारी किया गया।
