संख्याः एफ0एफ0ई0-बी0-एफ0(14)-19/2021.--भारतीय वन अधिनियम, 1927 (1927 का अधिनियम संख्यांक 16) की धारा 29 की उपधारा (3) के अधीन यथा अपेक्षित के अनुसार इस अधिसूचना 139—राजपत्र/2021-06-11-2021 (5039) 5040 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर, 2021/15 कार्तिक, 1943 से संलग्न अनुसूची में विनिर्दिष्ट वन भूमि या बंंजर भूमि में या उस पर सरकार तथा प्राइवेट व्यक्तियों के अधिकारों के स्वरूप और विस्तारकी जांच कर ली गई है और उन्हें अभिलिखित कर लिया गया है;

और उक्त अनुसूची में दर्शित वन भूमि या बंजर भूमि, सरकार की सम्पत्ति है, या जिस पर सरकार के सांपत्तिक अधिकार हैं या सरकार उसकी वन उपज के सम्पूर्ण या किसी भाग की हकदार है;

अतः हिमाचल प्रदेश के राज्यपाल, पूर्वाेक्त अधिनियम की धारा 29 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, घोषणा करते हैं कि उक्त अधिनियम के अध्याय-4 के उपबन्ध उक्त वन भूमि या बंजर भूमि को लागू होंगे और जो इसके पश्चात्‌ पूर्वाेक्त अधिनियम की धारा 29 की उपधारा (2) के उपबन्धों के अधीन ''संरक्षित वन'' कहलाएगी।

NOTIFICATION

Shimla-2, the 27th October, 2021

No. FFE-B-F(14)-19/2021.—WHEREAS, the nature and extent of the rights of the Government and of the Private Persons in or over the forest land or waste land specified in the SCHEDULE appended to this Notification have been enquired into and recorded, as required under sub-section (3) of section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

AND WHEREAS, the forest land or waste land shown in the said SCHEDULE is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the forest produce therein;

NOW THEREFORE, in exercise of the powers conferred by sub-section(1) of section 29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter-IV of the said Act shall apply to the said forest land or waste land and shall hereafter be called as "protected forests" under the provisions of sub-section (2) of section-29 of the Act ibid.

प्रार्थी श्री सोनम राम पुत्र श्री अमर सिंह, निवासी कसारला, डाकघर रती, तहसील बल्ह, जिला मण्डी (हि0 प्र0) आवेदन-पत्र अतिरिक्त जिला पंजीकार (जन्म एवं मृत्यु) एवं चिकित्सा अधिकारी मण्डी के माध्यम से इस अदालत में प्राप्त हुआ है। जिसमें प्रार्थी श्री सोनम राम ने अपने maternal grandfarher-in-law श्री परस राम पुत्र श्री उत्तम की दिनांक 04-04-1988 को मृत्यु होना दर्शाई गई है। परन्तु किसी कारणवश वह अपने maternal grandfather-in-law श्री परस राम की मृत्यु तिथि का पंजीकरण ग्राम पंचायत डुम्मट बैहली के रिकार्ड में दर्ज नहीं करवा पाया। आवेदन पत्र की पुष्टि में आवेदक द्वारा स्वयं का एक ब्यान हल्फी व दो5065 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर, 2021/15 कार्तिक, 1943 गवाहों के शपथ-पत्र भी प्रार्थना-पत्र के साथ संलग्न किए हैं। प्रार्थी इस न्यायालय के माध्यम से अपने maternal grandfather-in-law की मृत्यु तिथि पंजीकरण करवाने के आदेश ग्राम पंचायत डूम्मट बैहली को जारी करवाना चाहता है।
