No. Home-B(B)14-1/2013-Vol-I.—WHEREAS, the High Court of Himachal Pradesh vide its Memorandum bearing No. HHC/GAZ/14-2872005-inquiry-1332 dated 06-07-2017 proposed to hold an inquiry against Sh. Gaurav Sharma, Civil Judge-cum-ACJM (under suspension) under Rule 14 155—राजपत्र/2021-27-11-2021 (5603)5604 राजपत्र, हिमाचल प्रदेश, 27 नवम्बर, 2021/06 मार्गशीर्ष, 1943 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 and the inquiry was got conducted by the High Court.

WHEREAS, as a result of the inquiry, all the charges have been proved and the High Court has decided to recommend that the punishment of dismissal from service which shall ordinarily be a disqualification for future employment under the Government, as defined in clause (ix) of Rule 11 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 be imposed upon Sh. Gaurav Sharma, Senior Civil Judge (under suspension).

Now, therefore, the Governor, Himachal Pradesh having considered the recommendations of the High Court and in exercise of the powers vested in him under clause (ix) of Rule 11 of the CCS (CCA) Rules, 1965 and all other powers enabling him in this behalf, hereby orders dismissal of Sh. Gaurav Sharma from the Himachal Pradesh Judicial Services with immediate effect.

No. Home-B.B(1)7/2021.—The Governor, Himachal Pradesh, on the recommendations of the Hon'ble High Court of Himachal Pradesh and in exercise of powers vested in him under Clause (1) of Article 233 of Constitution of India is pleased to appoint following Senior Civil Judges as Additional District & Sessions Judge as under:—

The Governor, Himachal Pradesh is further pleased to order that before giving effect to this notification, the Registrar General, High Court of H.P. shall ensure that these appointment/postings are strictly in accordance with the provisions contained in Para 6 of Scheme on FTSC, 2019, Himachal Pradesh Judicial Service Rules, 2004 and amendments made therein from time to time besides provisions relating to officiating/adhoc appointments contained in Para 16.36 of Hand Book on Personnel Matters Vol-I. It is further clarified that the appointment of judicial officers mentioned at Sr. Nos. 3 to 14, above, which is purely on adhoc basis, shall not claim/entitled to any seniority or any other right subject to their appointment on regular basis after the suitability test.

This shall come into force with immediate effect.

No. Home-B.A(1)2/2019-Vol-I.—Whereas the Registrar General, High Court vide his letter No. HHC/GAZ/14-351/2015-13254 dated 06-07-2021 has informed that Sh. Anuj Bahal, ex-member of Himachal Pradesh Judicial Services (HPJS) had joined Delhi Judicial Service as Civil Judge, after tendering technical resignation, which was accepted by the competent authority on 24-09-2019. It has further been informed that Sh. Anuj Bahal has requested that he may be allowed to rejoin as member of HPJS in the cadre of Civil Judge against his lien over the post.

Whereas, The Registrar General, Delhi High Court vide its letter No. 1892/DHC/Gaz/G- 7/Misc./2021 dated 27-05-2021 has informed that Sh. Anuj Bahal, Delhi Judicial Service Officer has not yet been confirmed in Delhi Judicial Service.

And whereas, the matter was examined and it has been found that the technical resignation of Sh. Anuj Bahal was accepted by the Government vide notification No. Home-B(A)1-2/2019 dated 24-09-2019 with immediate effect. Further, he has requested to rejoin within a period of 2 years for which lien is permissible under section 9(3) of the Fundamental Rules and he can be permitted to join back in H.P. Judicial Services.

Now, therefore, the Governor, Himachal Pradesh, is pleased to order rejoining of Sh. Anuj Bahal (presently serving under the Delhi Judicial Service), in the Himachal Pradesh Judicial Services. The seniority of Sh. Anuj Bahal shall be fixed/determined by the Registrar General, High Court of H.P., as per relevant rules.

No. SEC(F)1/2019-II-7055-7243.—In exercise of the powers vested in it under Article 243K of the Constitution of India, Section 160 of Himachal Pradesh Panchayati Raj Act,1994 read with Rule 22 of the H.P. Panchayati Raj Elections Rule,1994, the State Election Commission, Himachal Pradesh hereby directs special revision of the Electoral Rolls in respect of 4 Gram Panchayats of District Kullu viz. Gram Panchayat Jaban & Namhog of Development Block Ani and Karjan and Soyal of Development Block Naggar as per programme mention below:—

The Commission hereby directs that the qualifying date for inclusion of names of eligible electors in the said electoral rolls shall be 01-11-2021 as required under Rule 14(e) of the Rules ibid. The Commission further directs that the special revision of electoral rolls with 01-11-2021 as qualifying date shall also be applicable in all those Panchayats of the State where any casual vacancy has occurred or any post remained vacant after conduct of general elections/bye-elections.

The final electoral rolls updated during the recently held general elections with 01-12-2020 as qualifying date shall be notified as draft electoral rolls in accordance with Rule 15 of the rules ibid. Wide publicity may be made of the qualifying date and the programme for the preparation of electoral roll through media/loudspeaker/announcements and other means or communication.

The District Election Officer (P) will appoint Revising Authorities under Rule 17 of the H.P. Panchayati Raj (Elections) Rules, 1994. The claims, objections and appeals shall be received and5607 राजपत्र, हिमाचल प्रदेश, 27 नवम्बर, 2021/06 मार्गशीर्ष, 1943 decided even on holidays. All claims, objections etc. shall be entered in Forms 5,6 and 7 to be maintained on the prescribed registers under Rule 18(4) of the ibid Rules.

After all the claims/objections and appeals received during the period have been decided, the District Election Officer (P) shall prepare a supplementary list, 2021 through ERMS Software and shall issue notice of final publication of electoral rolls on Form-15 as per schedule fixed by the Commission. The finally published electoral rolls shall be uploaded on the official website of the State Election Commission.

As soon as the notice of final publication is issued by the District Election Officer (P) the intimation of the same may be sent to the Commission immediately through E-mail followed by confirmation by post. Thereafter 15 copies of the Supplementary List, 2021 shall be printed locally after completing the codal formalities. These supplementary lists shall be added to the main electoral roll prepared in 2020. These electoral rolls with supplementary, 2021 shall be used in the ensuing elections.

The copies of the electoral rolls be made available for sale at the cost of Rs.5/- per page to be paid in cash against receipt. However a person interested in purchasing of electoral roll shall have to purchase full set of electoral rolls of the concerned Ward.

The relevant provisions & procedure of ibid Rules enshrined under Chapter-Ill of the Rules ibid shall be adhered to strictly for the preparation of the said electoral rolls through special revision. Needless to say that the aforesaid programme should be implemented in letter and spirit. If any violation of this programme is noticed, it will be in contravention of the mandate of the Constitution of India and the relevant statutory provisions, which may lead to serious consequences in view of Section 160-E of the H.P. Panchayati Raj Act, 1994.
