संख्या इण्ड-II (बी)2-3/2017-I.—हिमाचल प्रदेश के राज्यपाल भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, 162—राजपत्र/2021-06-12-2021 (5753) 5754 राजपत्र, हिमाचल प्रदेश, 06 दिसम्बर, 2021/15 मार्गशीर्ष, 1943 इस विभाग की अधिसूचना संख्याः इण्ड-II (बी)2-6/2006] तारीख 09-06-2015 द्वारा अधिसूचित हिमाचल प्रदेश उद्योग विभाग में खनन निरीक्षक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2015 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश उद्योग विभाग खनन निरीक्षक वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2021 है।

(2) ये नियम राजपत्र, हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत होंगे।

2. उपाबन्ध ''क'' के स्तम्भ संख्या 7 का संशोधन.--(1) हिमाचल प्रदेश उद्योग विभाग खनन निरीक्षक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2015 के उपाबन्ध ''क'' में-

स्तम्भ संख्या 7 (क) के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात :-- (क) अनिवार्य अर्हताएं;

''किसी मान्यता प्राप्त विश्वविद्यालय से भूविज्ञान विषय सहित विज्ञान में स्नातक की उपाधि।''।

No. Ind-II(B)2-3/2017-I.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Department of Industries Mining Inspector, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2015 notified vide this departments Notification No. Ind- II(B)2-6/2006, dated 9-6-2015, namely:—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh, Department of Industries, Mining Inspector, Class-III (Non-Gazetted) Recruitment and Promotion (First Amendment) Rules, 2021.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette) Himachal Pradesh.

2. Amendment in Column No. 7 of "Annexure- A".—In "Annexure-A" to the Himachal Pradesh, Department of Industries Mining Inspector, Class-III (Non-Gazetted)5755 राजपत्र, हिमाचल प्रदेश, 06 दिसम्बर, 2021/15 मार्गशीर्ष, 1943 Recruitment and Promotion Rules, 2015,— For the existing provision against Column No. 7(a), the following shall be substituted, namely:—

" (a) Essential Qualification (s);

B.Sc. Degree in Science with Geology from a recognized University"

No. Ind.-A(F)2-1/2018-I.—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Department of Industries (hereinafter referred to as 'Department') was administering the Mukhya Mantri Swavlamban Yojna (MMSY), 2018. The State Govt. has framed "Mukhya Mantri Swavalamban Yojana 2019" by merging the two existing schemes i.e. "Mukhya Mantri Swavlamban Yojana—2018" & "Mukhya Mantri Yuva Aajeevika Yojna—2018" in order to provide livelihood to local youth by encouraging local entrepreneurship and to promote self employment opportunities amongst the Bonafide Youth of Himachal Pradesh having age 18-45 years;

And whereas, the salient features of MMSY includes 25% investment subsidy up to maximum investment ceiling of Rs. 60 lakh in plant & machinery (or equipments) with total project cost not exceeding Rs. 100 lakh (including working capital). In case such enterprise is setup by bonafide Himachali women, the rate of investment subsidy would be 30% and 35% for widows. Interest subsidy is admissible @ 5% for 3 years on loan upto Rs.60 lakh. The bank will sanction 90% of the project cost and disburse full amount suitable for setting up of the project. Government land with Department of Industries which includes plots, shops and sheds in Industrial Areas/Industrial Estates established in category 'C' areas only would be given @ 25% of prevailing premium at the time of allotment;

And whereas, scheme involves expenditure incurred from the Consolidated Fund of Himachal Pradesh.

Now, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Governor of Himachal Pradesh hereby notifies the following, namely:—

1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such individuals shall visit any Aadhaar enrolment centre list available at the Unique Identification Authority of India(UIDAI) website www.uidai.gov.in to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhaar is assigned to the individual, the benefit under the MMSY shall be given to such individual subject to production of the following documents, namely:—

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and

(b) any one of the following documents, namely:—

(i) Bonafide Himachali (100 KB) only JPG/PNG file, certificate of proprietor/all partners/ all Directors of the company/ all promoters of the company, as the case may be.

(ii) Age Proof (10th DMC/Birth Certificate/Passport/ (100KB) only JPG/PNG file.

(iii) Preliminary Project Report/PPR(600 KB) only Pdf file:

Provided further that the above documents may be checked by the General Manager, District Industries Centre of the Department of Industries for that purpose.

2. In order to provide benefits to the beneficiaries under the MMSY conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through media shall be given to the beneficiaries to make them aware of the said requirement.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time based One-Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. In addition to the above, in order to ensure that no bonafide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing agency shall follow the exception handling mechanism as outlined in the Office Memorandum of DBT Mission, Cabinet Secretariat, Government of India dated 19th December, 2017 (Annexure).

5. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette).

No: FDS-KNR/93-III -3536-76.—In super session of all previous notifications and in exercise of the powers conferred upon me under clause 2(d) (1) of the Kerosene (Restriction on use and Fixation of ceiling Price) Order, 1993, I, Abid Hussain Sadiq, IAS District Magistrate, Distt. Kinnaur at Reckong Peo (HP), do hereby fix Wholesale and Retail Sale Rate of PDS Kerosene Oil in Kinnaur District, which may be charged by the Wholesaler and Retailer as under:—

Conditions for Wholesale/Retail Dealers and Consumers:—

1. The Wholesaler of Kinnaur District shall report to the Distt. Controller, Food, Civil Supplies & Consumer Affairs, Kinnaur and the authorized Inspector regarding receipt of K. Oil Tanker before proceeding on route and supply only to those authorized Retailers, who have been specifically mentioned in the Route Chart.

2. The Wholesale Dealer will issue PDS K. Oil only to the authorized retailer/ Fair Price Shop/ Persons and will get signatures on the Cash Memo and shall keep the record for inspection purpose.

3. The Wholesale Dealer would make all arrangement to purchase/lift monthly allotted quota within the fixed period.

4. No Retailer shall sell or offer for sale a quantity of Kerosene Oil more than the quantity so fixed by the Govt. as given below on any consumer Card at one time. The Retailer shall obtain the signature of the recipient of the quantity in sale register / cash Memo and issue Kerosene Oil Strictly as per the norms given below:—

6. Both the Wholesaler/ Retailer shall have to display the stock as well as rates at their place of business in Dev Nagri script.

7. No Consumer Card holder shall further sell K. Oil purchased from the Fair Price Shop against their Consumer Card.

8. The Wholesaler of K. Oil would submit monthly report of K. Oil (as per prescribed Performa given below) received and supplied to the authorized Fair Price Shops/ Depot during the month along with the Cash Memo issued to the Depot Holder.

The Dealer whether Wholesaler or a Retailer deals in Kerosene Oil under Public Distribution System shall act in accordance with the provision of Kerosene (Restriction on use and Fixation of ceiling Prices) Order, 1993 and shall also comply with the provision of the H.P. Specified Articles (Regulation of Distribution) Order, 2019 and terms and conditions of the authorization issued there under and instructions given by the State Government from time to time.

No. Pub-B(9)-1/2018.—In pursuance to the instructions of the Department of Personnel issued vide letter no. Per(AP)C-B(2)-1/2019, dated 30th March, 2021 and on the recommendation of the Departmental Screening Committee constituted for the purpose, the Governor, Himachal Pradesh is pleased to order the regularisation of Sh. Arun Patial, District Public Relations Officer/Information Officer in Information and Public Relations Department in the pay band of `10300—34800+`5400 Grade Pay, after completion of three years service on contract basis as on 30-09-2021.

II. The officer is regularised subject to the following terms and conditions:—

1. The Officer will be on probation for a period of two years.

2. The contractual appointee will be eligible for regularisation against available vacancies.

3. The regularisation will be strictly on the basis of seniority subject to condition that eligibility criteria etc., prescribed in the Recruitment and Promotion Rules for the post have been observed at the time of their initial recruitment on contract basis. The seniority of above DPRO/IO shall remain intact as per the initial contract irrespective of his joining. The name of aforesaid officer will be kept below i.e. immediate after last DPRO/IO presently working in the Department on regular basis in the seniority list of the DPRO/IO and will not confer any right to him for claiming seniority above the regular DPRO/IO already working in the Department.

4. The candidate should be medically fit for the post against which he/she is being considered for regularisation. Obtaining the Medical fitness certificate of the candidate (from the concerned CMO which will further be furnished to the Director, I&PR through concerned Controlling Officer) shall be ensured in accordance with the provisions contatined in FR 10 and SR 4(1), 4(2) and 4(3).

5. The regularisation shall be subject to verification of character and antecedents of the candidate being considered for regularisation as provided in the H.P. Financial Rules, 2009.

6. For determination of the date of birth of the candidate concerned, the criteria as laid down in Rule, 172 of the Himachal Pradesh Financial Rules, 2009 shall be observed.

7. The contractual appointee who is to be regularised shall be appointed at the minimum of the time scale of the post.

8. The contractual appointee who is to be regularised shall be liable to be posted anywhere in the State.

9. The regularsiation will be with prospective effect i.e. from the date of issue of regularsation orders.

10. Observance of reservation in the service as per instructions of the State Government from time to time have already been done at the time of initial appointment on contract basis.

11. The regularisation will be governed by Service Rules and orders etc. in force from time to time as applicable in H.P. Government and Central Rules such as CCA Rules, 1961 and Conduct Rules, 1964 as are applicable in Himachal Pradesh.

12. The appointment is provisional and subject to the educational qualification and other certificates being verified by the Director, Information and Public Relations, H.P.

13. He will have to give a declaration to the effect that he has only one living spouse, if married.

14. He will have to take an oath of allegiance/faithfulness to the Constitution of India or making a solemn affirmation.

15. He will have to produce all the certificates in original at the time of joining in the Directorate of Information and Public Relations.

16. The selected Officer will submit a statement of his movable and immovable properties as per the proforma prescribed in the CCS (Conduct Rules) 1964, within a period of 30 days.

III. If above terms and conditions are acceptable to him/her, he/she is directed to report for duty to the concerned controlling officer within a period of two weeks from issuance of this notification failing which his appointment order shall stand cancelled and no further extension shall be granted.

IV. Above Officer is directed to continue to work at same station. However, he is required to join duty on regularisation and send his joining report to this department through proper channel.

प्रार्थी श्री राजिन्द्र सिंह पुत्र श्री किकर सिंह, निवासी गांव जैंट, डा0 राम नगर, तहसील इन्दौरा, जिला कांगड़ा (हि0प्र0) ने प्रार्थना-पत्र प्रस्तुत करते हुए निवेदन किया है कि उसका जन्म दिनांक 20-05-1979 को गांव जैंट, डा0 राम नगर, तहसील इंदौरा, जिला कांगड़ा हि0प्र0 में हुआ था। जो कि ग्राम पंचायत दीणी खास के अभिलेख में दर्ज न है जो कि दर्ज किया जाए।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि उक्त विषय से सम्बन्धित एतराज हो तो वह असालतन या वकालतन दिनांक 09-12-2021 को प्रातः 10.00 बजे अदालत हजा में हाजिर होकर अपना एतराज दें। कोई एतराज न होने की सूरत में जन्म पंजीकरण के आदेश पारित कर दिए जाएंगे। आज दिनांक 03-11-2021 को मेरे हस्ताक्षर व मोहर अदालत सहित जारी किया गया।

प्रार्थी श्री सुरिन्द्र कुमार पुत्र दलीप सिंह, निवासी महाल सुदर लाहड़, डा0 सुदर लाहड़, मौजा महादेव, तहसील खुण्डियां, जिला कांगड़ा (हि0 प्र0) ने स्वयं उपस्थित होकर प्रार्थना-पत्र नाम दुरुस्ती प्रस्तुत किया है कि उसका नाम पटवार वृा बड़ोग लाहड़ के राजस्व महाल सुदर लाहड़ व राजस्व महाल विसीं के अभिलेख में गलती से सुरेन्द्र सिंह पुत्र दलीप सिंह दर्ज हो गया है जबकि परिवार रजिस्टर, आधार कार्ड, स्कूली5773 राजपत्र, हिमाचल प्रदेश, 06 दिसम्बर, 2021/15 मार्गशीर्ष, 1943 दस्तावेजों व अन्य कागजातों में उसका नाम सुरिन्द्र कुमार पुत्र दलीप सिंह दर्ज है जो कि उसका सही नाम है। दो अलग-अलग नाम हो जाने के कारण प्रार्थी को दिक्कतों का सामना करना पड़ रहा है। अतः प्रार्थी का आग्रह है कि उपरोक्त वर्णित महालात के राजस्व अभिलेख में उसका नाम सुरेन्द्र सिंह उपनाम सुरिन्द्र कुमार पुत्र दलीप सिंह दर्ज किया जाये।

अतः सर्वसाधारण को सुनवाई हेतु बजरिये इश्तहार व मुस्त्री मुनादी द्वारा सूचित किया जाता है कि इस नाम दुरुस्ती के सम्बन्ध में किसी प्रकार का उजर/एतराज हो तो वह दिनांक 10-12-2021 को असालतन व वकालतन पेश होकर अपना एतराज दर्ज करवा सकता है। उसके उपरान्त कोई भी उजर/ एतराज जेर समायत न होगा तथा प्रार्थी श्री सुरिन्द्र कुमार पुत्र दलीप सिंह, निवासी महाल सुदर लाहड़, मौजा महादेव, तहसील खुण्डियां, जिला कांगड़ा (हि0 प्र0) का नाम राजस्व महाल सुदर लाहड़ व राजस्व महाल विसीं के अभिलेख में सुरेन्द्र सिंह उपनाम सुरिन्द्र कुमार पुत्र दलीप सिंह दर्ज करने के आदेश पारित कर दिये जायेंगे।
