संख्या टीपीटी-बी (6)-1/2000-II.—हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, इस विभाग की अधिसूचना संख्याः टीपीटी-ख(2)-1/96 तारीख 13 दिसम्बर, 2004 द्वारा अधिसूचित हिमाचल प्रदेश परिवहन विभाग, क्षेत्रीय परिवहन अधिकारी, वर्ग-I (राजपत्रित), भर्ती एवं प्रोन्नति नियम 2004 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश परिवहन विभाग, क्षेत्रीय परिवहन अधिकारी, वर्ग-I (राजपत्रित) भर्ती एवं प्रोन्नति (प्रथम संशोधन) नियम, 2021 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध-"क" का संशोधन.--हिमाचल प्रदेश परिवहन विभाग, क्षेत्रीय परिवहन अधिकारी, वर्ग-I (राजपत्रित) भर्ती एवं प्रोन्नति नियम, 2004 के उपाबन्ध- "क" में,-

(क) स्तम्भ संख्या 2 के सामने विद्यमान उपबन्धाें के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- "15 (पंद्रह)

(i) 08 हिमाचल प्रदेश प्रशासनिक सेवा के लिए; और

(ii) 07 परिवहन विभाग के लिपिक वर्गीय/तकनीकी कर्मचारिवृन्द के लिए।"।

(ख) स्तम्भ संख्या 4 के सामने विद्यमान उपबन्धाें के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- "पे बैण्ड ` 15600-39100 जमा ` 5400 ग्रेड पे।"।

(ग) स्तम्भ संख्याः 10 के सामने विद्यमान उपबन्धाें के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- "(i) तिरपन प्रतिशत हिमाचल प्रदेश प्रशासनिक सेवा के प्रवर्ग में से नियुक्ति द्वारा;

(ii) सैंतालीस प्रतिशत स्थानन/प्रोन्नति द्वारा।"।

(घ) स्तम्भ संख्या 11 के सामने विद्यमान उपबन्धाें के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-5853 राजपत्र, हिमाचल प्रदेश, 09 दिसम्बर, 2021/18 मार्गशीर्ष, 1943 (i) 66 ²/³ % अधीक्षक ग्रेड-I में से स्थानन द्वारा; ऐसा न होने पर, अधीक्षक ग्रेड-I के पद के खाली रहने के अध्यधीन, अधीक्षक ग्रेड-II में से प्रोन्नति द्वारा जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा यदि कोई हो, को सम्मिलित करके ; और

4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनिश दरकाली और काशापाट 5. कुल्लू जिला का पन्द्रह बीस परगना

6. कांगड़ा जिला के बैजनाथ उप-मण्डल का बड़ा भंगाल क्षेत्र

7. जिला किन्नौर

8. सिरमौर जिला में उप-तहसील कमरउ के काठवाड़ और कोरगा पटवार वृत्त, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृत्त और शिलाई तहसील का कोटा पाब पटवार वृत्त। 9. मण्डी जिला में करसोग तहसील का खन्योल-बगड़ा पटवार वृत्त, बाली चौकी उप-तहसील के गाडा गोसाईं, मठियानी, घनयाड़, थाची, बागी, सोमगाड़ और खोलानाल पटवार वृत्त, पद्धर तहसील के झारवाड़, कुटगढ़, ग्रामन, देवगढ़, ट्रैला, रोपा, कथोग, सिल्ह-भड़वानी, हस्तपुर, घमरेड़ और भटेढ़ पटवार वृत्त, थुनाग तहसील के चियूणी, कालीपार, मानगढ़, थाच-बगड़ा उत्तरी मगरू और दक्षिणी मगरू पटवार वृत्त और सुन्दरनगर तहसील का बटवाड़ा पटवार वृत्त। स्पष्टीकरण-III.—उपर्युक्त परन्तुक (1) के प्रयोजन के लिए दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगेः-

(i) उप-मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान। (ii) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहां के लिए बस सेवा उपलब्ध नहीं है और 3 किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है। (iii) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना, अपने गृहनगर या गृहनगर क्षेत्र के साथ लगता 20 किलोमीटर की परिधि के भीतर का क्षेत्र।

(II) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः

(i) परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहाँ कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।5855 राजपत्र, हिमाचल प्रदेश, 09 दिसम्बर, 2021/18 मार्गशीर्ष, 1943 स्पष्टीकरण.-अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जो आपातकाल की अवधि के दौरान सशस्त्र बलों में शामिल हुए हैं और जिसे डिमोबिलाइज्ड आर्मड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल स्टेट नॉन-टैक्नीकल सर्विसिज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल स्टेट नॉन-टैक्नीकल सर्विसिज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(ii) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

परन्तु की गई तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।"।

NOTIFICATION

Shimla-2, the 6th December, 2021

No. TPT-B(6)-1/2000-II.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Himachal Pradesh Department of Transport Regional Transport Officer, Class-I Gazetted Recruitment and Promotion Rules, 2004 notified vide this Department notification No. TPT- Kha(2)-1/96, dated 13-12-2004, namely: —

1. Short title and commencement.— (1) These rules may be called the Himachal Pradesh Department of Transport Regional Transport Officer (Class-I Gazetted), Recruitment and Promotion (First Amendment) Rules, 2021.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Amendment of Annexure-"A".— In Annexure-"A" of the Himachal Pradesh Department of Transport Regional Transport Officer (Class-I, Gazetted) Recruitment and Promotion Rules, 2004,—

(a) for the existing provisions against Column No. 2, the following shall be substituted, namely:—

"15 (Fifteen)

(i) 08 earmarked to HAS; and

(ii) 07 Ministerial/Technical Staff of Transport Department.".

(b) for the existing provisions against Column No. 4, the following shall be substituted, namely:—

"Pay band ` 15600-39100+ ` 5400 Grade Pay.".

(c) for the existing provisions against Column No. 10, the following shall be substituted, namely:—

"(i) 53% by appointment from HAS Cadre; and

(ii) 47% by placement/promotion.".

(d) for the existing provision against Column No. 11 the following shall be substituted, namely:—

" (i) 66 ²/³ % by placement from amongst the Superintendent, Grade-I; failing which by promotion from amongst the Superintendent, Gr-II with five years regular service or regular combined with continuous adhoc service, if any, in the grade, subject to the condition that the post of Superintendent, Gr-I remains unfilled; and

Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation except posting/transfer in remote/rural area. However, this condition of five years shall not be applicable in cases of promotion:

Provided further that Officers/Officials who have not served atleast one tenure in Tribal/Difficult/Hard areas and remote/rural areas shall be transferred to such areas strictly in accordance with his /her seniority in the respective cadre.

Explanation-I.—For the purpose of proviso (I) supra the "term" in Tribal/Difficult/Hard areas/remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/convenience.

Explanation-II.—For the purpose of proviso (I) supra the Tribal/Difficult Areas shall be as under:—

1. District Lahaul & Spiti

2. Pangi and Barmour Sub-Division of Chamba District

3. Dodra Kawar Area of Rohru Sub-Division

4. Pandrah Bis Pargana, Munish Darkali and Gram panchayat Kashapat of Rampur Tehsil of District Shimla.

5. Pandrah Bis Pargana of Kullu District

6. Bara Bhangal Areas of Baijnath Sub-Division of Kangara District

7. District Kinnaur

8. Kathwar and Korga Patwar Circles of Kamrau Sub Tehsil, Bhaladh Bhalana and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil, in Sirmaur District.

9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada-Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of Bali-Chowki Sub Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla , Ropa, Kathog, Silh Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh, Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Batwara Patwar Circle of Sunder Nagar Tehsil in Mandi District.

Explanation-III.—For the purpose of proviso (I) supra the Remote/Rural Areas shall be as under:—

(i) All stations beyond the radius of 20 Kms. from Sub Division/Tehsil Headquarter.

ii) All Stations beyond the radius of 15 Kms. from State Headquarter and District Head- quarters where bus service is not available and on foot journey is more than 3 (three) Kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the employee regardless of its category.

(II) In all cases of promotion, the continuous ad hoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the conditions that the ad hoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:

(i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on ad hoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of atleast three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible persons happened to be ex-servicemen who have joined Armed Forces during the period of emergency and recruited under the provisions of rule -3 of the Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non- Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of rule-3 of the Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.

(ii) Similarly, in all cases of confirmation, continuous ad hoc service rendered on the feeder post if any, prior to the regular appointment against such posts shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, ad hoc service rendered shall remain unchanged".

No. TPT-A(3)-3/2015.—In exercise of the powers conferred by sub-section (1) of Section 3-C of Himachal Pradesh Motor Vehicles Taxation Act, 1972(Act 4 of 1973), the Governor of Himachal Pradesh proposes to carry out following amendments in SCHEDULE-III appended to the Act ibid, and the same are hereby published in the Rajpatra (e-Gazette), Himachal Pradesh for the information of the general public;

If any person, likely to be affected by the proposed amendments has any objection/ suggestion, he/ she may send the same to the Additional Chief Secretary (Transport) to the Government of Himachal Pradesh, Armsdale Building, Shimla-2, within seven days from the date of publication of the notification in the Rajpatra (e-Gazette), Himachal Pradesh;

The Objection(s) or suggestion(s), if any, received within the above stipulated period, shall be considered by the Government of Himachal Pradesh, before finalizing the same, namely:-

(सी सी)5-2/71-एल, तारीख 04-09-2020 द्वारा परिहवन विभाग को यात्री और माल कर के प्रशासनिक नियंत्रण के हस्तांतरण के परिणामस्वरूप, हिमाचल प्रदेश मोटरयान कराधान अधिनियम, 1972 (1973 का अधिनियम संख्यांक 4) की धारा 3-ग की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और इस विभाग की अधिसूचना संख्या टी0पी0टी0-सी (9)-6/2004, तारीख 09-01-2006 के अनुक्रम में आदेश देते हैं कि हिमाचल प्रदेश में उपयोग किए गए या उपयोग के लिए रखे गए, समस्त निम्नलिखित परिवहन यानों पर राज्य सरकार को "यात्री और माल कर" के बदले "विशेष पथ कर (एस आर टी)" निम्नवर्ण्ाित दरों पर उद्‌गृहीत, प्रभारित और संदत्त किया जाएगाः-

हिमाचल प्रदेश के राज्यपाल यह भी आदेश देते हैं कि यात्री और माल कर के बदले उद्‌गृहित या प्रभारित किया जाने वाला विशेष पथ कर अग्रिम रूप में संदेय होगा और कर के संदाय और घोषणा के प्रदाय का समय दी हिमाचल प्रदेश मोटर व्हीकल टैकशेसन रूल्ज, 1974 के रूल 4 के अनुसार होगा।

कर के संदाय में विलम्ब की दशा में, शास्ति उक्त नियमों के नियम 4-क के अन्तर्गत प्रभारित की जाएगी और उपरोक्त यानों के मामले में उक्त नियमों में प्रत्येक मास की 16 तारीख को शास्ति (जुर्माने) की गणना का उपाबन्ध लागू नहीं होगा। तथापि, संविदा गाड़ी बसों के मामले में प्रचालक (ऑपरेटर) प्रत्येक मास की 15 तारीख से पहले अंतिम निर्धारण के आधार पर मासिक औसत रकम (राशि) जमा करेगा और तत्पश्चात्‌ आगामी तिमाही के प्रथम मास की 15 तारीख तक कराधान प्राधिकरण (संबंधित आर टी ओ) को तिमाही विवरणी प्रस्तुत करेगा। विलंब की दशा में शास्ति उक्त नियमों के नियम 4-क मेें यथाउपबन्धित के अनुसार प्रत्येक मास की 16 तारीख को संगणित की जाएगी।

इस बाबत प्राप्त संदायों को हिमाचल प्रदेश के सरकारी कोष में राज्य मोटर यान कराधान अधिनियम के अधीन प्राप्तियां मुख्य शीर्ष "0041 वाहनों पर कर" लघु शीर्ष "102, उप शीर्ष (i) "ओ एस-विशेष पथ कर" (ii) 06-विशेष पथ कर पर शास्ति" के अधीन जमा किया जाएगा और संदाय के टोकन में प्राप्त कोषागार चालान कराधान प्राधिकारी को भेजा जाएगा।

नए रजिस्ट्रीकृत यानों के संबंध में यह अधिसूचना राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रभावी होगी। हिमाचल प्रदेश यात्रियों और सामान पर कर लगाने का अधिनियम, 1955 के अधीन पहले से रजिस्ट्रीकृत यानों के मामले में कराधान विभाग अग्रिम में 31 दिसंबर, 2021 तक यात्री और सामान पर कर का संग्रहण करेगा और 01-01-2022 से यात्री और सामान पर कर का संग्रहण करना बन्द करेगा 5864 राजपत्र, हिमाचल प्रदेश, 09 दिसम्बर, 2021/18 मार्गशीर्ष, 1943 तथा ऐसे प्रचालकों (ऑपरेटरों) के पक्ष में अनापाि और कर समाशोधन (एन ओ टी सी) प्रमाण-पत्र जारी करेगा ताकि साथ-साथ ही परिवहन विभाग 1 जनवरी, 2022 से समस्त पात्र यानों के स्वामियों से विशेष पथ कर का संग्रहण करना आरंभ कर सके। यदि किसी प्रचालक (ऑपरेटर) ने सम्पूर्ण वर्ष के लिए यात्री और सामान पर कर (पी जी टी) का संदाय कर दिया है, तो वह भी आबकारी एवं कराधान प्राधिकारी द्वारा जारी अनापत्ति प्रमाण-पत्र (एन ओ सी) को परिवहन विभाग के सम्बन्धित कराधान प्राधिकारी के पास जमा करने पर "विशेष पथ कर" संदाय, करना भी आरंभ कर सकते हैं।

No. TPT-A(3)-3/2015.—Consequent upon the transfer of the Administrative Control of the Passenger and Goods Tax to the Transport Department vide Government Notification No. GAD (CC)5-2/71-L, dated 04-09-2020, the Governor of Himachal Pradesh in exercise of the powers conferred by sub-section (1) of section 3-A of Himachal Pradesh Motor Vehicles Taxation Act 1972(Act 4 of 1973), in continuation of this Department's Notification No. TPT-C(9)-6/2004, dated 09-01-2006, is pleased to order that "Special Road Tax (SRT)" in lieu of Passenger and Goods Tax shall be levied, charged and paid to the State Government on all the following Transport vehicles used or kept for use, in Himachal Pradesh at the rates mentioned below:—

The Governor, Himachal Pradesh is further pleased to order that the Special Road Tax in lieu of Passenger and Goods Tax to be levied or charged shall be payable in advance and time for payment of tax and delivery of declaration shall be as per rule 4 of the Himachal Pradesh Motor Vehicles Taxation Rules, 1974.

In case of delay in payment of tax, penalty shall be charged under rule 4-A of the said rules and the provision of computing penalty on the 16th day of every month in said rules shall not be applicable in case of the above vehicles.

However, in case of Contract Carriage buses the operator will deposit average amount monthly on the basis of last assessment before the 15th of each month and further submit quarterly return to the taxation authority (RTO concerned) by 15th of next quarter of first month. In case of delay penalty shall be computed on the 16th day of every month as provided in rule 4-A of the said rules.

The payments received on this account shall be deposited into Government Treasury under Himachal Pradesh under Major Head "0041— Taxes on Vehicles" Minor Head "102-Receipts under the State Motor Vehicles Taxation Act" Sub-Heads (i) "OS-Special Road Tax" (ii) "06- Penalty on Special Road Tax" and the treasury challan received in token of the payment shall be sent to the Taxation Authority.

This notification in respect of newly registered vehicles shall come into effect from the date of publication in Rajpatra (e-Gazette), HP. In case vehicles already registered under The Himachal Pradesh Passenger and Goods Taxation Act, 1955, Department of Excise shall collect advance Passengers and Goods Tax till 31st December, 2021 and stop collecting Passenger and Goods Tax from 01-01-2022 and issue No Objection and Tax Clearance (NOTC) certificate in favour of such operators so that simultaneously Department of Transport could start collecting Special Road Tax from all owners of vehicles from 1st January, 2022. In case of operators who have paid PGT for the whole year can also start paying Special Road Tax with the Department of Transport on production of NOC issued by the Excise and Taxation Authority to the concerned taxation authority.

Therefore, by this notice the public in General is informed that if anyone has any objection regarding registration of this marriage, he may present before this court on or before 18-12-2021 for hearing of objections if any. In case no objection is received by dated 18-12-2021, it will be presumed that there is no objection to the registration of the above said marriage and the same will be registered on the said date.
