संख्याः एग्र0-बी-एफ(1)-25/2021.--सेवाआें या प्रसुविधाओं या सहायिकियों के परिदान के लिए आधार का एक पहचान दस्तावेज के रूप में उपयोग, सरकार की परिदान प्रक्रिया को सुगम बनाता है, पारदर्शिता और दक्षता लाता है और लाभार्थियों को सुविधाजनक और निर्बाध रीति में अपनी पहचान साबित करने के बहुविध दस्तावेज प्रस्तुत करने की आवश्यकता हटाकर, प्रत्यक्षतः उन्हें अपनी हकदारियां प्राप्त करने हेतु समर्थ बनाता है;

कृषि विभाग (जिसे इसमें इसके पश्चात्‌ विभाग कहा गया है) किसानों को उनके खेतों को जंगली जानवरों से संरक्षित करने के लिए, बाड़ लगाने की व्यवस्था करवाकर सहायता देने हेतु पत्र संख्या एग्र0-एससी.एच(एच)6-5/2016 (एमएमकेएसवाई) वॉल. III, तारीख 31-08-2019 को जारी ''मुख्य मन्त्री खेत संरक्षण योजना'' (जिसे इसमें इसके पश्चात्‌ स्कीम कहा गया है), प्रशासित कर रहा है, जिसे कृषि निदेशालय हिमाचल प्रदेश, शिमला-5 (जिसे इसमें इसके पश्चात्‌ कार्यान्वयन अभिकरण कहा गया है) के माध्यम से कार्यान्वित किया जा रहा है;

स्कीम के अन्तर्गत, किसानों (जिन्हें इसमें इसके पश्चात्‌ लाभार्थी कहा गया है) को विभिन्न प्रकार की बाड़ जैसे कांटेदार तार और चैनलिंक बाड़ लगाने के लिए 50 प्रतिशत, सौर चालित बाड़ (व्यक्तिगत) लगाने के लिए 80 प्रतिशत (सामुदायिक) 85 प्रतिशत और कंपोजिट बाड़ लगाने के लिए 70 प्रतिशत की वित्तीय सहायता (जिसे इसमें इसके पश्चात्‌ प्रसुविधा कहा गया है) विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार कार्यान्वयन अभिकरण द्वारा प्रदान की जाती है;

पूर्वोक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि में से उपगत किया जाने वाला आवर्ती व्यय अन्तर्वलित है;

अतः हिमाचल प्रदेश के राज्यपाल, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (जिसे इसमें इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 7 द्वारा पदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अधिसूचित करते हैं, अर्थात्‌ः-

1. (1) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने के लिए पात्र किसी व्यष्टि को एतद्‌द्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना होगा या आधार अधिप्रमाणन प्राप्त करना होगा।

(2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वांछा रखने वाला कोई व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए नामांकित नहीं है, को स्कीम के लिए रजिस्ट्रीकरण से पूर्व आधार के नामांकन के लिए आवेदन करना अपेक्षित होगा यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसे व्यष्टि आधार का अभ्यावेशन करवाने के लिए किसी आधार अभ्यावेशन केन्द्र (सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0आई0डी0ए0आई0) वैबसाइट www.uidai.gov. पद पर उपलब्ध है) पर जाएंगेः

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग को अपने कार्यान्वयन अभिकरण के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करने की आवश्यकता है जो अभी तक आधार के लिए नामांकित नहीं है और यदि संबंधित खण्ड या तहसील में कोई आधार नामांकन केन्द्र अवस्थित नहीं है, तो विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यूआईडीएआई के विद्यमान रजिस्ट्रार के समन्वय से सुविधाजनक स्थानों पर या स्वयं ही यूआईडीएआई रजिस्ट्रार की हैसियत से आधार नामांकन सुविधाएं प्रदान करेगाः

परन्तु जब तक की व्यष्टि को आधार समनुदेशित नहीं किया जाता है, तब तक ऐसे व्यष्टि को निम्नलिखित दस्तावेज प्रस्तुत करने के अध्यधीन स्कीम के अधीन प्रसुविधा प्रदान की जाएगी, अर्थात्‌्‌ः- 6998 राजपत्र, हिमाचल प्रदेश, 27 जनवरी, 2022/7 माघ, 1943 (क) यदि वह उसकीे आधार अभ्यावेशन पहचान पर्ची के साथ अभ्यावेशित किया गया है, तो उसकी आधार अभ्यावेशन पहचान पर्ची; और

(ख) निम्नलिखित में से कोई दस्तावेज है, अर्थात्‌्‌ः-

(i) फोटो सहित बैंक या पोस्ट ऑफिस पासबुक; या

(ii) स्थायी खाता संख्या (पी0ए0एन0) कार्ड; या

(iii) पासपोर्ट; या

(iv) राशन कार्ड; या (v) मतदाता पहचान पत्र; या

(vi) मनरेगा कार्ड; या

(vii) किसान फोटो पासबुक; या

(viii) मोटर यान अधिनियम,1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी चालन अनुज्ञप्ति; या

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा शासकीय शीर्षनामा पर जारी ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाण पत्र; या

(x) विभाग द्वारा यथाविनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह कि उपरोक्त दस्तावेजों की जांच विभाग द्वारा उस प्रयोजन के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा की जाएगी।

2. स्कीम के अन्तर्गत सुविधापूर्वक लाभार्थियों को प्रसुविधाएं उपलब्ध करवाने के आशय से विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि उक्त लाभार्थियों को अपेक्षाओं के सम्बंध में, उन्हें जागरूक करने के लिए, लाभार्थियों हेतु मीडिया के माध्यम से, व्यापक प्रचार किया जाएगा।

3. उन समस्त मामलों में जहां लाभार्थियों के अस्पष्ट (अपकृष्ट) बायोेमैट्रिक के कारण या किसी अन्य कारण से, आधार प्रमाणन असफल रहता है, वहां निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृृत की जाएगी, अर्थात्‌्‌ः-

(क) अस्पष्ट उंगली छाप क्वालिटी की दशा में, अधिप्रमाणन हेतु आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन सुविधा अंगीकृत की जाएगी, तद्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाओं के परिदान हेतु उंगली-छाप अधिप्रमाणन सहित आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन के लिए व्यवस्थाएं करेगा;

(ख) उंगली छाप या आंख की पुतली का स्कैन या चेहरा अधिप्रमाणन के माध्यम से बायोमैट्रिक अधिप्रमाणन की असफलता की दशा में, जहां कहीं भी साध्य और ग्राह्‌य है, वहां अधिप्रमाणन सीमित समय वैधता सहित, यथास्थिति, एक मुश्त आधार पासवर्ड या समयाधारित एक मुश्त पासवर्ड द्वारा प्रदान किया जाएगा;

(ग) उन समस्त अन्य मामलों में, जहां बायोमैट्रिक या एक मुश्त आधार पासवर्ड या समय आधारित एक मुश्त पासवर्ड अधिप्रमाणन सम्भव नहीं है, वहां स्कीम के अन्तर्गत प्रसुविधाएं वस्तुगत आधार वर्ण (अक्षर) के आधार पर दी जा सकेगी, जिनकी अधिप्रमाणिकता आधार पर मुद्रित तुरन्त प्रत्युत्तर (क्यू.आर.) कोड के माध्यम6999 राजपत्र, हिमाचल प्रदेश, 27 जनवरी, 2022/7 माघ, 1943 से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर (क्यू.आर.) कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी। 4. उपरोक्त के अतिरिक्त यह सुनिश्चित करने के आशय से, कि कोई वास्तविक लाभार्थी स्कीम के अन्तर्गत उनको देय प्रसुविधाओं से वंचित न हो, विभाग अपने कार्यान्यन अभिकरण के माध्यम से डी0बी0टी0 मिशन, कैबिनेट सैक्रेटेरिएट, भारत सरकार के कार्यालय ज्ञापन तारीख 19 दिसम्बर, 2017 में यथा सारांशित अपवाद का निपटान करने के लिए क्रियाविधि का अनुसरण करेगा।

5. यह अधिसूचना राजपत्र (ई-गजट), हिमाचल प्रदेश में इसके प्रकाशन की तारीख से प्रवृृत्त होगी।

NOTIFICATION

Shimla-2, the 17th January, 2022

No. Agr-B-F(1)-25/2021.—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Department of Agriculture (hereinafter referred to as the Department), is administering the "Mukhya Mantri Khet Sanrakshan Yojna" (hereinafter referred to as the Scheme) issued vide letter No. Agr.SC.H(H)6-35/2016(MMKSY)-Vol.-III, dated 31-08-2019 to help the farmers by providing the fencing in their fields to protect from wild animals which is being implemented through the Directorate of Agriculture, Himachal Pradesh, Shimla-5 (hereinafter referred to as the Implementing Agency);

And whereas, under the Scheme, financial assistance in different types of fencing provided as 50% in Barbed and Interlink chain, 80% in Solar Fencing (Individual), 85% (Community) and 70% Composite Fencing (hereinafter referred to as the benefit) is given to the agricultural farmers (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh;

Now, therefore, in exercise of powers conferred by section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, the Governor, Himachal Pradesh is pleased to notify following, namely:—

1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such individuals shall visit any Aadhaar enrolment centre [list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in] to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in co-ordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhaar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely :– (a) if he has enrolled, his Aadhaar Enrolment Identification slip; and

(b) any one of the following documents, namely:—

(i) Bank or Post Office Passbook with Photo; or

(ii) Permanent Account Number (PAN) Card; or

(iii) Passport; or

(iv) Ration Card; or

(v) Voter Identity Card; or

(vi) MGNREGA card; or

(vii) Kisan Photo passbook; or

(viii)Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or

(x) any other document as specified by the Department:

Provided further that the above documents may be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through the media shall be given to the beneficiaries to make them aware of the said requirement.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One- Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. In addition to the above, in order to ensure that no bonafide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall follow the exception handling mechanism as outlined in the Office Memorandum of DBT Mission, Cabinet Secretariat, Government of India dated 19th December 2017.

5. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

7002 राजपत्र, हिमाचल प्रदेश, 27 जनवरी, 2022/7 माघ, 1943 स्कीम के अन्तर्गत कृषि भूमि वाले किसानों (जिन्हें इसमें इसके पश्चात्‌ लाभार्थी कहा गया है), लघु और सीमांत किसानों को 85 प्रतिशत और मध्यम और बड़े किसानों को 80 प्रतिशत की वित्तीय सहायता, (जिसे इसमें इसके पश्चात्‌्‌ प्रसुविधा कहा गया है) विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार कार्यान्वयन अभिकरण द्वारा प्रदान की जाती है;

अतः हिमाचल प्रदेश के राज्यपाल, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (जिसे इसमें इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अधिसूचित करते हैं, अर्थात्‌ः-

NOTIFICATION

Shimla-2, the 17th January, 2022

No. Agr-B-F(1)-27/2021.—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Department of Agriculture (hereinafter referred to as the Department), is administering the "Saur Sinchayee Yojna" (hereinafter referred to as the Scheme) to help the farmers by providing solar pumps to lift the water for irrigation purpose which is being implemented through the Directorate of Agriculture, Himachal Pradesh, Shimla-5 (hereinafter referred to as the Implementing Agency);

And whereas, under the Scheme, financial assistance is provided as 85% for Small and Marginal farmers and 80% for Medium and Big farmers (hereinafter referred to as the benefit) is given to the farmers having agricultural land (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh;

Now, therefore, in exercise of the powers conferred by section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Governor, Himachal Pradesh is pleased to notify following, namely:—

1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in co- ordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhaar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely:—

(b) any one of the following documents, namely:—

(i) Bank or Post Office Passbook with Photo; or

(ii) Permanent Account Number (PAN) Card; or

(iii) Passport; or

(iv) Ration Card; or

(v) Voter Identity Card; or (vi) MGNREGA card; or

(vii) Kisan Photo passbook; or

(viii)Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or

(x) any other document as specified by the Department:

Provided further that the above documents may be checked by an officer specifically designated by the Department for that purpose.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

In addition to the above, in order to ensure that no bona fide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall follow the exception handling mechanism as outlined in the Office Memorandum of DBT Mission, Cabinet Secretariat, Government of India dated 19th December, 2017.

5. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

HPERC-(H)(1)-1/2012.—The Himachal Pradesh Electricity Regulatory Commission in exercise of the powers conferred under Clauses (r) and (s) of sub-section (2) of Section 181, read with sub-sections (5) to (8) of Section 42, of the Electricity Act, 2003 (36 of 2003) and all other powers enabling it in this behalf, after previous publication, hereby makes the following amendment in the Himachal Pradesh Electricity Regulatory Commission (Consumer Grievances Redressal Forum and Ombudsman) Regulations, 2013, namely:—

REGULATIONS

1. Short title and commencement.—(1) These Regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Consumer Grievances Redressal Forum and Ombudsman) (Second Amendment) Regulations, 2022.

(2) These Regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of Regulation 3.—In Regulation 3 of the said Regulations.—In Sub- regulation (1), for item (f), the following shall be substituted, namely:—

"(f) "Forum" means a Forum, established or to be established, by the distribution licensee under sub-section (5) of Section 42 of the Act, as per the guidelines contained in these Regulations;"

3. Amendment of Regulation 5.—In Regulation 5 of the said Regulations.—(i) in Sub-regulation (1), for the sign ":", the sign "." shall be substituted and the proviso thereto shall be omitted; and

(ii) for Sub-regulation (2), the following shall be substituted, namely :- "(2) The distribution licensee may, after considering various related factors such as the number of consumers under different categories of retail tariff, number of representations generally received and disposed of, ease of access for the consumers in the various areas, establish by order, under intimation to the7007 राजपत्र, हिमाचल प्रदेश, 27 जनवरी, 2022/7 माघ, 1943 Commission, additional Forum in its area of supply and in that event each Forum shall have the jurisdiction, linked to any one or more relevant parameters such as geographical/operational areas, the tariff related categories of consumers etc., as the distribution licensee may, by order, define from time to time:

Provided that in addition to the Forum established as per Sub-regulation (1), the distribution licensee, shall, latest by 30th April, 2022, also establish under intimation to the Commission, at least one additional Forum for each of its operation circles and the jurisdiction thereof in relation to the consumers under the respective operation circles, shall be as follows, namely :—

(i) in case of the consumers covered under single part retail tariff- all types of complaints, whether monetary or non- monetary ; and

(ii) in case of the consumers covered under two part retail tariff – all types of complaints whether monetary or non monetary, where the following conditions are met – (a) the amount of dispute / claim does not exceed two lakh in each case; and (b) the standard supply voltage does not exceed 22kV:

Provided further that in the event of establishing additional Forums at Divisional/Sub- divisional level, the distribution licensee shall also modify, under intimation to the Commission, the territorial jurisdiction of the Forum established at the head quarter of that Circle.

(3) The Commission may, duly taking into account the factors mentioned in Sub- regulation (1), direct, from time to time, the distribution licensee to establish, under intimation to the Commission, the additional Forums at various locations and also to define/modify the jurisdiction of each Forum established, or to be established, under the provisions of these Regulations.

(4) The complaints not falling under the jurisdiction of the additional Forums, established as per Sub-regulation (2) and sub-regulation (3) of Regulation 5, shall continue to fall under the jurisdiction of Forum established under Sub- regulation (1) of Regulation 5.

4. Amendment of Regulation 6.—For Regulation 6 of the said Regulations, the following shall be substituted, namely:—

"6. Headquarters of Forum.—The head quarter of the Forum, established as per Sub- regulation (1) of Regulation 5, shall preferably be at the head quarter of the distribution licensee. The head quarter for additional Forums established as per the first proviso to the sub-regulation (2) of Regulation 5, shall be at the headquarters of the respective operation circles. The head quarters of the other Forums, if any, established as per sub-regulation (2) and Sub-regulation (3) of Regulation 5, shall be fixed by the distribution licensee. Each Forum may, with the overall objective of ensuring that the complaints/grievances are heard and redressed within the time limit specified under these Regulations, conduct its sittings preferably in the areas, within its territorial jurisdiction, having industrial belts, as it may consider appropriate."

5. Amendment of Regulation7.—In Regulation 7 of the said Regulations.—

(I) In sub-regulation (1) –7008 राजपत्र, हिमाचल प्रदेश, 27 जनवरी, 2022/7 माघ, 1943 (i) for the sign ";" appearing in sub-clause (b) of clause (i), the sign ":" shall be substituted and thereafter the following provisos shall be inserted, namely:—

"Provided that in case of additional Forum established, or to be established, as per Sub-regulation (2) and Sub-regulation (3) of Regulation 5, the distribution licensee shall designate, on Ex-officio basis, the Members of each such Forum out of its serving officers having appropriate qualifications, who shall perform their functions in the said Forums in addition to their normal assigned duties and out of such designated Members, one Member shall be designated as Chairperson of that Forum:

Provided further that no officer of a rank of less than Superintending Engineer shall be designated as Member-cum-Chairperson of any additional Forum to be established as per first proviso to Sub-regulation (2) of Regulation 5:

Provided further that the Member, other than that designated as Chairperson of a Forum shall not be of a rank which is lower, by more than one step, than the rank held by the Member designated as Chairperson of that Forum:

Provided further that no such officer shall be designated as Member-cum- Chairperson of an additional Forum established, or to be established as per Sub-regulation (2) and Sub-regulation (3) of Regulation 5, who is posted in operation Sub-division/Division/ Circle, as the case may be, in the territorial jurisdiction of that Forum or of such other additional Forum which is chaired by an officer posted in the territorial jurisdiction of that Forum;"; and (ii) for Sub-clause (a) of clause (ii), the following shall be substituted, namely :—

"(a) who have retired after serving the State Government or of its Undertakings at the posts which are not lower, by more than one step, than the rank held by the Chairperson of that Forum and are familiar with the consumer affairs or regulatory affairs; or" ; and

(II) for sub-regulation (3), the following shall be substituted, namely :—

"(3) The licensee shall immediately, but not later than seven days, after the appointment, or designation, of the Members (other than the Independent Member) provide details to the Commission regarding qualifications and experience of the Member(s) so appointed or designated."

6. Amendment of Regulation 9.—In Regulation 9 of the said Regulations.—

(i) in sub-regulation (1), for the sign ".", the sign ":" shall be substituted and thereafter the following proviso shall be inserted, namely :—

"Provided that in cases where the Members of the Forums are to be designated, on Ex-officio basis, as per the provisos to clause (i) of sub-regulation (1) of Regulation 7, the Member designated as such, shall be the Chairperson of that Forum." ; and

(ii) in Sub-regulation (3), for the words, brackets, sign and figures "Member appointed under sub-clause (b) of clause (i) of sub- regulation (1) of regulation 7", the7009 राजपत्र, हिमाचल प्रदेश, 27 जनवरी, 2022/7 माघ, 1943 words, brackets, sign and figures "Member appointed under sub-clause (b) of clause (i) of Sub-regulation (1) of Regulation 7, or the other Member designated as per the provisos thereto" shall be substituted.

7. Amendment of Regulation 13.—In Regulation 13 of the said Regulations.—In clause (a) of Sub-regulation (1), for the words "the Members appointed,", the words and sign "the Members appointed, or designated on ex-officio basis," shall be substituted.

8. Amendment of Regulation 14.—In Regulation 14 of the said Regulations.—In Sub-regulation (2), for the sign ".", the sign ":" shall be substituted and thereafter the following proviso shall be inserted, namely:—

"Provided that in each case where an additional Forum is established as per Sub-regulation (2) and Sub-regulation (3) of Regulation 5, the distribution licensee shall designate, on Ex-officio basis, a suitable serving official, who shall perform his duties as Secretary of the Forum in addition to his normal assigned duties."

9. Amendment of Regulation 15.—In Regulation 15 of the said Regulations, at the end of para, the following sentence shall be added, namely :— "The distribution licensee shall also provide a link on its web portal and mobile app for registering the complaint/grievance in relevant Forum and also shall provide online tracking system of the complaints as well as status of compliance of the Forum's order by it."

10. Amendment of Regulation 16.—In Regulation 16 of the said Regulations.—In Sub-regulation (1), for the words "under the jurisdiction of the Forum", the words "under the jurisdiction of the relevant Forum" shall be substituted.

11. Amendment of Regulation 17.—In Regulation 17 of the said Regulations.— In Sub-regulation (1), for the words and sign "submit his grievance, either in person or through post, e-mail or fax or online through the website of the Forum", the words and sign "submit his grievance to the relevant Forum, through any channel i.e. in person, through post, e- mail, fax, online through the website / mobile app of the distribution licensee," shall be substituted.

12. Amendment of Regulation 26.—In Regulation 26 of the said Regulations.—

(I) in Sub-clause (ii) of clause (a) of Sub-regulation (2), for the words and figure "15 percent", the words and figure "12 percent" shall be substituted;

(II) in Sub-regulation (4), for the words "The Order of the Forum shall be reasoned", the words "The Order of the Forum shall be speaking and reasoned" shall be substituted; and

(III) in Sub-regulation (6), at the end of para, the following new sentence shall be added, namely :—

"Each such order shall also be displayed on the website of the distribution licensee." 13. Amendment of Regulation 27.—In Regulation 27 of the said Regulations.—In Sub-regulation (1), for the words and figure "21 days", the words and figure "30 days" shall be substituted.

14. Amendment of Regulation 29.—In Regulation 29 of the said Regulations.—In clause (a) of Sub-regulation (4), for the words "with regards to levels", the words "duly taking into account the levels" shall be substituted.

प्रार्थिया उपरोक्त ने इस न्यायालय में प्रार्थना-पत्र मय शपथ-पत्र इस आशय से पेश किया है कि उनका जन्म गांव, डाकघर व ग्राम पंचायत डंई, तहसील धीरा, जिला कांगड़ा (हि0प्र0) में दिनांक 18-02-1982 को हुआ है। मगर अज्ञानतावश उनकी जन्म तिथि सम्बन्धित ग्राम पंचायत डंई के अभिलेख में दर्ज न है जिसे कि वह सम्बन्धित ग्राम पंचायत डंई के अभिलेख में दर्ज करवाना चाहती है।

अतः इस बारे ईश्तहार राजपत्र हि0 प्र0 व मुस्त्री मुनादी द्वारा उपरोक्त प्रत्यार्थी व सर्वसाधारण को सूचित किया जाता है कि यदि किसी को उक्त जन्म पंजीकरण बारे कोई उजर या एतराज हो तो वह इस ईश्तहार/नोटिस के जारी होने की तिथि से एक माह के भीतर या दिनांक 31-01-2022 को प्रातः 10.30 बजे असालतन या वकालतन इस अदालत में हाजिर आकर अपना उजर व एतराज पेश कर सकता है। इसके उपरान्त कोई भी उजर या एतराज काबले समायत न होगा तथा आवेदिका की जन्म तिथि दिनांक 18-02-1982 को दर्ज करने के आदेश सम्बन्धित ग्राम पंचायत डंई को पारित कर दिये जायेंगे।
