ई.एक्स.एन.-एफ.(10)-4/2021-वॉल-1.--हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) की धारा 9 की उपधारा (1) और धारा 15 की उप धारा (5), के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, राज्यपाल, हिमाचल प्रदेश, परिषद्‌ की सिफारिशाें के आधार पर हिमाचल प्रदेश सरकार की 201—राजपत्र/2022-01-02-2022 (7053) 7054 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 अधिसूचना संख्या 1/2017-राज्य कर (दर) दिनांक 30-06-2017 जोकि हिमाचल प्रदेश के राजपत्र में संख्या ई0एक्स0एन (एफ)10-14/2017-लूज दिनांक 30-06-2017 को प्रकाशित की गई थी, में निम्नलिखित संशोधन करते हैं, अर्थात्‌ः-

उक्त अधिसूचना में,-

क. अनुसूची I - 2.5% में,-

(i) क्रम संख्या 2 के समक्ष, कॉलम (2) में प्रविष्टि ''0303, 0304, 0305, 0306, 0307, 0308, 0309'' को प्रतिस्थापित किया जाएगा;

(ii) क्रम संख्या 9 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''दही; क्रीम, केफिर और अन्य किण्वित या अम्लीकृत दूध और क्रीम, चाहे सांद्रित हो या नहीं या जिसमें चीनी या अन्य मीठा पदार्थ या कोई स्वाद या फल, नट्‌स या कोको मिलाया गया हो या नहीं'' को प्रतिस्थापित किया जाएगा;

(iii) क्रम संख्या 14 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''कीडे़ और अन्य प्राणीजन्य अन्य खाद्य उत्पाद, जो अन्यत्र निर्दिष्ट या शामिल न हो'' को प्रतिस्थापित किया जाएगा;

(iv) क्रम संख्या 87 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''अन्य अवाष्पशील वनस्पतियां या माइक्रोबियल वसा और तेल (जोजोबा तेल सहित) और उनके अंश, चाहे परिष्कृत हों अथवा नहीं, किन्तु रासायनिक रूप से संशोधित न किए गए हों'' को प्रतिस्थापित किया जाएगा;

(v) क्रम संख्या 107 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''तेल-केक और अन्य ठोस अवशेष, चाहे वह ग्राउन्डेड हो या नहीं या छर्रों के रूप में हों, जो वनस्पति या माइक्रोबियल वसा या तेल के निष्कर्षण से उत्पन्न होता है, शीर्षक 2304 या 2305 के अलावा तथा बिनौला तेल-केक के अलावा'' को प्रतिस्थापित किया जाएगा;

(vi) क्रम संख्या 127 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''डोलोमाइट, चाहे कैलसिंड या सिन्टर्ड हो या नहीं, जिसमें डोलोमाइट को मोटे तौर पर ट्रिम किया गया हो या केवल काटकर, आरी से या अन्यथा, एक आयताकार के ब्लॉक या स्लैब के (वर्ग सहित) आकार के हों, 2518 10 डोलोमाइट, कैलसिंड या सिन्टर्ड न हो'' को प्रतिस्थापित किया जाएगा;

(vii) क्रम संख्या 186क और उससे संबंधित प्रविष्टयों के स्थान पर निम्नलिखित क्रम संख्या और संबंधित प्रविष्टियों को प्रतिस्थापित किया जाएगा, यथाः-

(viii) क्रम संख्या 232 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''8419 12'' को प्रतिस्थापित किया जाएगा;

(ix) क्रम संख्या 244 और उससे संबंधित प्रविष्टयों के स्थान पर निम्नलिखित क्रम संख्या और संबंधित प्रविष्टियों को प्रतिस्थापित किया जाएगा, यथाः-

(x) क्रम संख्या 245 के समक्ष, कॉलम (2) में प्रविष्टि के स्थान पर, प्रविष्टि ''8807'' और कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''शीर्षक 8802 या 8806 के अंतर्गत आने वाले उत्पाद (अनुसूची III में क्रमांक संख्या 383 में शामिल मदों के पुर्जाें को छोड़कर), के पुर्जे'' को प्रतिस्थापित किया जाएगा;

(xi) क्रम संख्या 258 के समक्ष, कॉलम (2) में प्रविष्टि के स्थान पर, प्रविष्टि ''9405'' को प्रतिस्थापित किया जाएगा;

ख. अनुसूची II-6% में,-

(i) क्रम संख्या 15 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''अन्य नट्‌स, सूखे, चाहे कवच रहित या छिलका रहित हों या नहीं, जैसे बादाम, हेज़लनट्‌स या फ़िलबर्ट्‌स (कोरिलस एसपीपी.), चेस्टनट (कास्टेनिया एसपीपी.), पिस्ता, मैकाडामिया नट्‌स, कोला नट्‌स, कोला नट्‌स (कोला एसपीपी.), पाइन नट्‌स [सूखी अरीका नट्‌स से भिन्न]'' को प्रतिस्थापित किया जाएगा;

(ii) क्रम संख्या 25 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''पशु या माइक्रोबियल वसा और पशु या माइक्रोबियल तेल और उनके अंश, आंशिक रूप से या पूरी तरह से हाइडो्रजनीकृत, अंतर-एसिट्रफ़ाइड, री-एसिट्रफ़ाइड या इलडिनाइज़्ड, चाहे परिष्कृत है या नहीं, किन्तु आगे निर्मित नहीं हों'' को प्रतिस्थापित किया जाएगा;

(iii) क्रम संख्या 26 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि '' पशु वसा या माइक्रोबियल वसा या माइक्रोबियल वसा पशु तेल या इस अध्याय से विभिन्न पशु वसा या माइक्रोबियल वसा या पशु तेल या माइक्रोबियल तेल के अंश से बना खाद्य मिश्रण या निर्मितियाँ, शीर्षक 1516 के खाद्य वसा या तेल या उनके अंशों के अलावा'' को प्रतिस्थापित किया जाएगा;

(iv) क्रम संख्या 27 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''पशु या माइक्रोबियल वसा और पशु या माइक्रोबियल तेल उनके अंश, उबला हुआ, ऑक्सीकृत, निर्जलित, सल्फरयुक्त, उड़ा, निर्वात या निष्क्रिय में गर्मी द्वारा बहुलकीकृत गैस या अन्यथा रासायनिक रूप से संशोधित, शीर्षक 1516 को छोड़कर; अखाद्य मिश्रण या पशु, वनस्पति या माइक्रोबियल वसा या तेल या इस अध्याय के विभिन्न वसा या तेलों के अंश, किन्तु अन्यत्र विनिर्दिष्ट न होेंं'' को प्रतिस्थापित किया जाएगा;

(v) क्रम संख्या 28 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''मांस, मांसावशिष्ट, रक्त या कीडे़ के सासेज और वैसे ही उत्पाद; इन उत्पादों पर आधारित खाद्य निर्मितियाँ'' को प्रतिस्थापित किया जाएगा;

(vi) क्रम संख्या 29 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''अन्य निर्मित या परिरक्षित मांस, मांसावशिष्ट, रक्त या कीड़े'' को प्रतिस्थापित किया जाएगा;

(vii) क्रम संख्या 41 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''फलों या नट्‌स के रस (अंगूर सहित) और सब्जियों के रस, बिना किण्वित और अतिरिक्त स्प्रिट युक्त नहीं,7056 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 चाहे अतिरिक्त चीनी या अन्य मीठा पदार्थ मिलाया गया हो या नहीं'' को प्रतिस्थापित किया जाएगा;

(viii) क्रम संख्या 41 और उससे संबंधित प्रविष्टयों के स्थान पर निम्नलिखित क्रम संख्या और संबंधित प्रविष्टियों को प्रतिस्थापित किया जाएगा, यथाः-

(ix) क्रम संख्या 49 और उससे संबंधित प्रविष्टियों का लोप किया जाएगा;

(x) क्रम संख्या 144 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि '' कालीन और अन्य कपडाें़ के फर्श कवरिंग (टर्फ सहित), गुच्छेदार, चाहे बने बनाए हों अथवा नहीं'' को प्रतिस्थापित किया जाएगा;

(xi) क्रम संख्या 185क के समक्ष, कॉलम (2) में प्रविष्टि के स्थान पर, प्रविष्टि ''7419 80 30'' को प्रतिस्थापित किया जाएगा;

(xii) क्रम संख्या 225 के समक्ष, कॉलम (2) में प्रविष्टि के स्थान पर, प्रविष्टि ''9405'' को प्रतिस्थापित किया जाएगा;

(xiii) क्रम संख्या 236 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''पेंटिंग, ड्रॉइंग और पेस्टल, पूरी तरह से हाथ से निष्पादित, शीर्षक 4906 के डा्रइंग से भिन्न और हाथ से पेंट या हाथ से सजाए गए निर्मित वस्तुओं से भिन्न; कोलाजें, मोजा़ इकें और इसी तरह से सजावटी प्लाक'' को प्रतिस्थापित किया जाएगा;

ग. अनुसूची III-9% में,-

(i) क्रम संख्या 26क से 26ठ तक और उससे संबंधित प्रविष्टियों के स्थान पर, निम्नलिखित क्रम संख्या और संबंधित प्रविष्टियों को प्रतिस्थापित किया जाएगा, यथाः-

(ii) क्रम संख्या 41 और उससे संबंधित प्रविष्टियों का लोप किया जाएगा;

(iii) क्रम संख्या 72 के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''सुरक्षा फ़्यूज;

विस्फोट कैप्स; इगनाइटर्स; इलेक्ट्रिक डेटोनेटर्स'' को प्रतिस्थापित किया जाएगा;

(iv) क्रम संख्या 98 और उससे संबंधित प्रविष्टयों के बाद, निम्नलिखित क्रम संख्या और प्रविष्टियों को अन्तःस्थापित किया जाएगा, यथाः-

(xvii) क्रम संख्या 411ज के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''लेजर, लेजर डायोड से भिन्न; अन्य ऑप्टिकल उपकरण और यंत्र, जो निर्दिष्ट नहीं हैं या इस अध्याय में कहीं और शामिल नहीं है'' को प्रतिस्थापित किया जाएगा;

(xx) क्रम संख्या 441क के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''टै्रवलिंग सर्कस और टै्रवलिंग मेनेजरीज; एम्यूजमैंट पार्क राइड्‌स एंड वाटर पार्क एम्यूजमेंट; फेयरग्राउंड एम्यूजमेंट, जिसमें शूटिंग गैलरी शामिल है; टै्रवलिंग थिएटर'' को प्रतिस्थापित किया जाएगा;

(xxi) क्रम संख्या 449ख के समक्ष, कॉलम (3) में प्रविष्टि के स्थान पर, प्रविष्टि ''वैक्यूम फ्लास्क और अन्य वैक्यूम वेसल, पूर्ण; कांच के अंदरूनी हिस्सों से भिन्न उसके हिस्से'' को प्रतिस्थापित किया जाएगा;

घ. अनुसूची IV-14% में,-

(i) क्रम संख्या 15 और उससे संबंधित प्रविष्टियों के बाद, निम्नलिखित क्रम संख्या और प्रविष्टयों को अन्तःस्थापित किया जाएगा, यथाः-

Shimla-2, the 27th January, 2022

No. EXN-F(10)-4/2021-Vol-I.—In exercise of the powers conferred by sub-section (1) of section 9 and sub- section (5) of section 15 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on the recommendations of the Council, is pleased to make the following further amendments in the notification of the Government of Himachal Pradesh, No.1/2017-State Tax (Rate), dated the 30th June, 2017, published in the Gazette of Himachal Pradesh, vide number EXN-F(10)-14/2017-Loose dated 30th June, 2017, namely:—

In the said notification, -

a. in Schedule I – 2.5%, -

(i) against S. No. 2, for the entry in column (2), the entry "0303, 0304, 0305, 0306, 0307, 0308, 0309" shall be substituted;

(ii) against S. No. 9, for the entry in column (3), the entry "Yoghurt; Cream, kephir and other fermented or acidified milk and cream, whether or not concentrated or containing added sugar or other sweetening matter or flavored or containing added fruit, nuts or cocoa" shall be substituted;

(iii) against S. No. 14, for the entry in column (3), the entry "Insects and other edible products of animal origin, not elsewhere specified or included" shall be substituted;

(iv) against S. No. 87, for the entry in column (3), the entry "Other fixed vegetable or microbial fats and oils (including jojoba oil) and their fractions, whether or not refined, but not chemically modified." shall be substituted;

(v) against S. No. 107, for the entry in column (3), the entry "Oil-cake and other solid residues, whether or not ground or in the form of pellets, resulting from the extraction of vegetable or microbial fats or oils, other than those of heading 2304 or 2305 other than cottonseed oil cake" shall be substituted;

(vi) against S. No. 127, for the entry in column (3), the entry "Dolomite, whether or not calcined or sintered, including dolomite roughly trimmed or merely cut, by sawing or otherwise, into blocks or slabs of a rectangular (including square) shape;2518 10 dolomite, Not calcined or sintered", shall be substituted;

(vii) for S. No. 186A and the corresponding entries relating thereto, the following S. Nos. and the corresponding entries shall be substituted, namely:—

(viii) against S. No. 232, for the entry in column (2), the entry "8419 12"shall be substituted;

(ix) For S. No. 244 and the corresponding entries relating thereto, the following Sl.

No. and entries shall be substituted, namely:—

(x) against S. No. 245, for the entry in column (2), the entry "8807", and for the entry in column (3), the entry "Parts of goods of heading 8802 or 8806 (except parts of items covered in Sl. No. 383 in Schedule III)",shall be substituted;

(x) against S. No. 258, for the entry in column (2), the entry "9405", shall be substituted;

b. in Schedule II – 6%, -

(i) against S. No. 15, for the entry in column (3), the entry "Other nuts, dried, whether or not shelled or peeled, such as Almonds, Hazelnuts or filberts (Corylus spp.), Chestnuts (Castanea spp.), Pistachios, Macadamia nuts, Kola nuts (Cola spp.), Pine nuts [other than dried areca nuts]" shall be substituted;

(ii) against S. No. 25, for the entry in column (3), the entry "Animal or microbial fats and animal or microbial oils and their fractions, partly or wholly hydrogenated, inter-esterified, re-esterified or elaidinised, whether or not refined, but not further prepared." shall be substituted;

ई.एक्स.एन.-एफ.(10)-4/2021-वॉल-1.--हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10) की धारा 11 की उपधारा (1) के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, राज्यपाल, हिमाचल प्रदेश, परिषद्‌ की सिफारिशाें के आधार पर हिमाचल प्रदेश सरकार की अधिसूचना संख्या 2/2017-राज्य कर (दर) दिनांक 30-06-2017 जोकि हिमाचल प्रदेश के राजपत्र में संख्या ई0एक्स0एन0 (एफ)10-14/ 2017-लूज दिनांक 30-06-2017 को प्रकाशित की गई थी, में और आगे भी निम्नलिखित संशोधन करते हैं, यथाः-

1. उक्त अधिसूचना में, अनुसूची में,-

(i) क्रम संख्या 22 के समक्ष, कॉलम (2) में प्रविष्टि के स्थान पर, प्रविष्टि ''0303, 0304, 0305, 0306, 0307, 0308, 0309'' को प्रतिस्थापित किया जाएगा;

No. EXN-F(10)-4/2021-Vol-I.—In exercise of the powers conferred by sub-sections (1) of section 11 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on the recommendations of the Council, is pleased to make the following further amendments in the notification of the Government of Himachal Pradesh, No. 2/2017-State Tax (Rate), dated the 30th June, 2017, published in the Gazette of Himachal Pradesh, vide number EXN-F(10)-14/2017-Loose dated 30th June, 2017, namely :—

In the said notification, in the Schedule,-

(i) against S. No. 22, for the entry in column (2), the entry "0303, 0304, 0305, 0306, 0307, 0308, 0309" shall be substituted;

(ii) against S. No. 43B, in column (3), for the entry, the entry "Vegetables provisionally preserved, but unsuitable in that state for immediate consumption" shall be substituted;

(iii) against S. No. 49, in column (3), for the entry, the entry "Other nuts, fresh such as Almonds, Hazelnuts or filberts (Corylus spp.), walnuts, Chestnuts (Castanea spp.), Pistachios, Macadamia nuts, Kola nuts (Cola spp.), Areca nuts, Pine nuts, fresh, whether or not shelled or peeled" shall be substituted;

संख्याः एग्र0-बी-एफ(1)-26/2021.--सेवाआें या प्रसुविधाओं या सहायिकियों के परिदान के लिए आधार का एक पहचान दस्तावेज के रूप में उपयोग, सरकार की परिदान प्रक्रिया को सुगम बनाता है, पारदर्शिता और दक्षता लाता है और लाभार्थियों को सुविधाजनक और निर्बाध रीति में अपनी पहचान साबित करने के बहुविध दस्तावेज प्रस्तुत करने की आवश्यकता हटाकर, प्रत्यक्षतः उन्हें अपनी हकदारियां प्राप्त करने हेतु समर्थ बनाता है;

कृषि विभाग (जिसे इसमें इसके पश्चात्‌्‌ विभाग कहा गया है) किसानों को सहायता करने के लिए उनकी सिंचाई क्षमता बढ़ाने हेतु ''प्रवाह सिंचाई स्कीम'' (जिसे इसमें इसके पश्चात्‌्‌ स्कीम कहा गया है) प्रशासित कर रहा है, जिसे कृषि निदेशालय, हिमाचल प्रदेश, शिमला-5 (जिसे इसमें इसके पश्चात्‌्‌ कार्यान्वयन अभिकरण कहा गया है) के माध्यम से कार्यान्वित किया जा रहा है;

स्कीम के अन्तर्गत, किसानों (जिन्हें इसमें इसके पश्चात्‌ लाभार्थी कहा गया है) को, सामुदायिक स्कीमों पर शत प्रतिशत और बोरवैल और उथले कुएं के लिए पचास प्रतिशत की वित्तीय सहायता (जिसे इसमें इसके पश्चात्‌्‌ प्रसुविधा कहा गया है) विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार कार्यान्वयन अभिकरण द्वारा प्रदान की जाती है;

7070 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 पूर्वोक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि में से उपगत किया जाने वाला आवर्ती व्यय अन्तर्वलित है;

अतः हिमाचल प्रदेश के राज्यपाल, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (जिसे इसमें इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित स्कीम अधिसूचित करते हैं, अर्थातः--

(1) (1) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने के लिए पात्र किसी व्यष्टि को एतद्‌द्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना होगा या आधार अधिप्रमाणन प्राप्त करना होगा।

(2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वॉँछा रखने वाला कोई व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए नामांकित नहीं है, को स्कीम के लिए रजिस्ट्रीकरण से पूर्व आधार के नामांकन के लिए आवेदन करना अपेक्षित होगा यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसे व्यष्टि आधार का अभ्यावेशन करवाने के लिए किसी आधार अभ्यावेशन केन्द्र [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0 आई0 डी0 ए0 आई0) वैबसाइट www.uidai.gov. पद पर उपलब्ध है] पर जाएंगे।

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग को अपने कार्यान्वयन अभिकरण के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करने की आवश्यकता है जो अभी तक आधार के लिए नामांकित नहीं है और यदि संबंधित खण्ड या तहसील में कोई आधार नामांकन केन्द्र अवस्थित नहीं है, तो विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यूआईडीएआई के विद्यमान रजिस्ट्रार के समन्वय से सुविधाजनक स्थानों पर या स्वयं ही यूआईडीएआई रजिस्ट्रार की हैसियत से आधार नामांकन सुविधाएं प्रदान करेगाः

परन्तु जब तक की व्यष्टि को आधार समनुदेशित नहीं किया जाता है, तब तक ऐसे व्यष्टि को निम्नलिखित दस्तावेज प्रस्तुत करने के अध्यधीन स्कीम के अधीन प्रसुविधा प्रदान की जाएगी, अर्थात्‌्‌ः- (क) यदि वह उसकीे आधार अभ्यावेशन पहचान पर्ची के साथ अभ्यावेशित किया गया है तो उसकी आधार अभ्यावेशन पहचान पर्ची; और

(ख) निम्नलिखित में से कोई दस्तावेज है, अर्थात्‌्‌ः--

(i) फोटो सहित बैंक या पोस्ट ऑफिस पासबुक; या

(ii) स्थायी खाता संख्या (पी0ए0एन0) कार्ड; या

(iii) पासपोर्ट; या

(iv) राशन कार्ड; या

(v) मतदाता पहचान पत्र; या

(vi) मनरेगा कार्ड; या

(vii) किसान फोटो पासबुक; या

(viii) मोटर यान अधिनियम, 1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी चालन अनुज्ञप्ति; या

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा शासकीय शीर्षनामा पर जारी ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाण पत्र; या7071 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 (x) विभाग द्वारा यथाविनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह कि उपरोक्त दस्तावेजों की जांच विभाग द्वारा उस प्रयोजन के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा की जाएगी।

2. स्कीम के अन्तर्गत सुविधापूर्वक लाभार्थियों को प्रसुविधाएं उपलब्ध करवाने के आशय से विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि उक्त लाभार्थियों को अपेक्षाओं के सम्बंध में, उन्हें जागरूक करने के लिए, लाभार्थियों हेतु मीडिया के माध्यम से, व्यापक प्रचार किया जाएगा।

3. उन समस्त मामलों में जहाँ लाभार्थियों के अस्पष्ट (अपकृष्ट) बायोेमिट्रिक के कारण या किसी अन्य कारण से, आधार प्रमाणन असफल रहता है, वहां निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृृत की जाएगी, अर्थात्‌्‌ः--

(क) अस्पष्ट उंगली छाप क्वालिटी की दशा में, अधिप्रमाणन हेतु आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन सुविधा अंगीकृत की जाएगी, तद्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाओं के परिदान हेतु उंगली छाप अधिप्रमाणन सहित आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन के लिए व्यवस्थाएं करेगा;

(ख) उंगली छाप या आंख की पुतली का स्कैन या चेहरा अधिप्रमाणन के माध्यम से बायोमिट्रिक अधिप्रमाणन की असफलता की दशा में, जहां कहीं भी साध्य और ग्राहय है, वहां अधिप्रमाणन सीमित समय वैधता सहित, यथास्थिति, एक मुश्त आधार पासवर्ड या समयाधारित एक मुश्त पासवर्ड द्वारा प्रदान किया जाएगा;

(ग) उन समस्त अन्य मामलों में, जहां बायोमिट्रिक या एक मुश्त आधार पासवर्ड या समय आधारित एक मुश्त पासवर्ड अधिप्रमाणन सम्भव नहीं है, वहां स्कीम के अन्तर्गत प्रसुविधाएं वस्तुगतः आधार वर्ण (अक्षर) के आधार पर दी जा सकेगी, जिनकी अधिप्रमाणिकता आधार पर मुद्रित तुरन्त प्रत्युत्तर (क्यू.आर.) कोड के माध्यम से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर (क्यू.आर.) कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी।

4. उपरोक्त के अतिरिक्त यह सुनिश्चित करने के आशय से, कि कोई वास्तविक लाभार्थी स्कीम के अन्तर्गत उनको देय प्रसुविधाओं से वंचित न हो, विभाग अपने कार्यान्यन अभिकरण के माध्यम से डी0बी0टी0 मिशन, कैबिनेट सैक्रेटेरिएट, भारत सरकार के कार्यालय ज्ञापन तारीख 19 दिसम्बर, 2017 में यथा सारांशित अपवाद का निपटान करने के लिए क्रियाविधि का अनुसरण करेगा।

AGRICULTURE DEPARTMENT

NOTIFICATION

No. Agr-B-F(1)-26/2021.—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Department of Agriculture (hereinafter referred to as the Department), is administering the "Flow Irrigation Scheme" (hereinafter referred to as the Scheme) to help the farmers for increasing their irrigation potential which is being implemented through the Directorate of Agriculture, Himachal Pradesh, Shimla-5 [hereinafter referred to as the Implementing Agency (ies)];

And whereas, under the Scheme, financial assistance is being provided as 100% on Community schemes and 50% for bore-well and shallow well (hereinafter referred to as the benefit) is to the agricultural farmers (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh;

Now, therefore, in exercise of the powers conferred by Section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016, the Governor, Himachal Pradesh is pleased to notify following, namely:—

1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitled to obtain Aadhaar as per Section 3 of the said Act, and such individuals shall visit any Aadhaar enrolment centre (list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in co-ordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhaar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely:—

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and

(b) any one of the following documents, namely:—

(i) Bank or Post office Passbook with Photo; or7073 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 (ii) Permanent Account Number (PAN) Card; or (iii) Passport; or

(iv) Ration Card; or

(v) Voter Identity Card; or

(vi) MGNREGA card; or

(vii) Kisan Photo passbook; or

(viii) Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or

(x) any other document as specified by the Department:

Provided further that the above documents may be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through the media shall be given to the beneficiaries to make them aware of the said requirement.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication alongwith fingerprint authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One- Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. In addition to the above, in order to ensure that no bonafide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall7074 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 follow the exception handling mechanism as outlined in the Office Memorandum of DBT Mission, Cabinet Secretariat, Government of India dated 19th December, 2017.

5. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

कृषि विभाग पात्र किसान उत्पादक संगठन (एफपीओ) की सहायता के लिए सामूहिकीकरण के माध्यम से खेती को एक लाभदायक उद्यम बनाने हेतु हिमाचल प्रदेश राज्य में अधिसूचना संख्याः-एग्र0-बी-सी(5)-39/2020, तारीख 04-03-2021 द्वारा अधिसूचित "मुख्य मन्त्री कृषि कोष योजना" प्रशासित कर रहा है, जिसे राज्य स्तर पर कृषि निदेशालय के माध्यम से कार्यान्वित किया जा रहा है;

स्कीम के अन्तर्गत, पात्र एफपीओज छह लाख रुपए की अधिकतम सीमा के अध्यधीन, कुल परियोजना लागत का 30 प्रतिशत तक की सीड मनी या एफपीओ द्वारा जुटाई गई साधारण पूँजी (इक्विटी) का आधा, जो भी कम हो विद्यमान स्कीम के मार्गदर्शक सिद्वान्तों के अनुसार कार्यान्वयन अभिकरण के माध्यम से प्राप्त कर सकते हैं;

पूर्वोक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि में से उपगत किया जाने वाला आवर्ती व्यय अन्तर्वलित है; अतः हिमाचल प्रदेश के राज्यपाल, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (जिसे इसमें इसके पश्चात्‌ उक्त अधिनियम कहा गया है) की धारा 7 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अधिसूचित करते हैं, अर्थात्‌ः--

1. (1) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने के लिए पात्र व्यष्टि को एतद्‌द्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना होगा या आधार अधिप्रमाणन प्राप्त करना होगा।

(2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वॉँछा रखने वाले व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए नामांकित नहीं है, को स्कीम के लिए रजिस्ट्रीकरण से पूर्व आधार के नामांकन के लिए आवेदन करना अपेक्षित होगा यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसे व्यष्टि आधार का अभ्यावेशन करवाने के लिए किसी आधार अभ्यावेशन केन्द्र [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0 आई0 डी0 ए0 आई0) वैबसाइट www.uidai.gov. in पर उपलब्ध है) पर जाएगा।7075 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 (3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग को अपने कार्यान्वयन अभिकरण के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करने की आवश्यकता है जो अभी तक आधार के लिए नामांकित नहीं है और यदि संबंधित खण्ड या तहसील में कोई आधार नामांकन केन्द्र अवस्थित नहीं है, तो विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यूआईडीएआई के विद्यमान रजिस्ट्रार के समन्वय सेे सुविधाजनक स्थानों पर या स्वयं ही यूआईडीएआई रजिस्ट्रार की हैसियत से आधार नामांकन सुविधाएं प्रदान करेगाः

परन्तु जब तक व्यष्टि को आधार समनुदेशित नहीं किया जाता है, तब तक ऐसे व्यष्टि को निम्नलिखित दस्तावेज प्रस्तुत करने के अध्यधीन स्कीम के अधीन प्रसुविधा प्रदान की जाएंगी, अर्थात्‌्‌ः-- (क) यदि उसको आधार अभ्यावेशन पहचान पर्ची के साथ अभ्यावेशित किया गया है तो उसकी आधार अभ्यावेशन पहचान पर्ची; और

(ख) निम्नलिखित में से कोई दस्तावेज है, अर्थात्‌्‌ः--

(i) फोटो सहित बैंक या पोस्ट ऑफिस पासबुक; या

(ii) स्थायी खाता संख्या (पी0ए0एन0) कार्ड; या

(iii) पासपोर्ट; या

(iv) राशन कार्ड; या

(v) मतदाता पहचान पत्र; या

(vi) मनरेगा कार्ड; या

(vii) किसान फोटो पासबुक; या

(viii) मोटर यान अधिनियम,1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी चालन अनुज्ञप्ति; या

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा शासकीय शीर्षनामा पर जारी ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाण-पत्र; या

(x) विभाग द्वारा यथाविनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह कि उपरोक्त दस्तावेजों की विभाग द्वारा उस प्रयोजन के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा जांच की जाएगी।

2. स्कीम के अन्तर्गत सुविधापूर्वक लाभार्थियों को प्रसुविधाएं उपलब्ध करवाने के आशय से विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि लाभार्थियों को उक्त अपेक्षाओं के सम्बंध में, उन्हें जागरूक करने के लिए, मीडिया के माध्यम से, व्यापक प्रचार किया जाएगा।

3. उन समस्त मामलों में जहाँ लाभार्थियों के अस्पष्ट (अपकृष्ट) बायोेमिट्रिक के कारण या किसी अन्य कारण से, आधार प्रमाणन असफल रहता है, वहां निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृृत की जाएगी, अर्थात्‌्‌ः-

(क) अस्पष्ट उंगली छाप क्वालिटी की दशा में, अधिप्रमाणन हेतु आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन सुविधा अंगीकृत की जाएगी, तद्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम7076 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाओं के परिदान हेतु उंगली छाप अधिप्रमाणन सहित आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन के लिए व्यवस्थाएं करेगा;

(ख) उंगली छाप या आंख की पुतली का स्कैन या चेहरा अधिप्रमाणन के माध्यम से बायोमिट्रिक अधिप्रमाणन की असफलता की दशा में, जहां कहीं भी साध्य और ग्राहय है, वहां अधिप्रमाणन सीमित समय वैधता सहित, यथास्थिति, एक मुश्त आधार पासवर्ड या समयाधारित एक मुश्त पासवर्ड द्वारा प्रदान किया जाएगा;

And whereas, the Department of Agriculture is administering the Mukhyamantri Krishi Kosh Yojna notified vide notification No. Agr-B-C(5)-39/2020,dated 04-03-2021 to support the eligible Farmer's Producer Organization (FPOs) in the State of H.P. to make the farming a profitable venture through collectivization, which is being implemented through the Directorate of Agriculture at State level.

And whereas, under the Scheme, eligible FPOs can avail seed money up to 30% of the total project cost with a maximum ceiling of Rs. 6.00 lakh or one half times of equity raised by the FPOs, whichever is less, by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh;

1. (1) स्कीम के अधीन प्रसुविधाएं प्राप्त करने के लिए पात्र किसी व्यष्टि को एतदद्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना या आधार अधिप्रमाणन प्रस्तुत करना अपेक्षित होगा।

(2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वाँछा रखने वाला कोई व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए अभ्यावेशित नहीं है, को स्कीम के लिए रजिस्ट्रीकरण से पूर्व आधार के अभ्यावेशन के लिए आवेदन करना अपेक्षित होगा, यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसा व्यष्टि आधार का अभ्यावेशन करवाने के लिए किसी आधार अभ्यावेशन केन्द्र [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0आई0डी0ए0आई0) वैबसाइट www.uidai.gov.in पर उपलब्ध है] पर जाएगा ।

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार विभाग अपने कार्यान्वयन अभिकरण के माध्यम से ऐसे हिताधिकारियों, जिनका अभी तक आधार के लिए नामांकन नहीं हुआ है, के लिए आधार अभ्यावेशन सुविधाएं प्रस्थापित करना अपेक्षित है और यदि सम्बन्धित खण्ड या तालुका या तहसील में अभी तक कोई आधार नामांकन केन्द्र अवस्थित नहीं है, तो विभाग अपने कार्यान्वयन अभिकरण के माध्यम से भारतीय विशिष्ट पहचान प्राधिकरण (यू0आई0डी0ए0आई0) के वर्तमान रजिस्ट्रारों के साथ समन्वय करके या स्वयं यू0आई0डी0ए0आई0 रजिस्ट्रार के रूप में सुविधाजनक स्थानों पर आधार नामांकन सुविधाएं प्रदान करेगा। परन्तु जब तक व्यष्टि को आधार समनुदेशित किया जाता है तब तक ऐसे व्यक्ति को स्कीम के अधीन निम्नलिखित दस्तावेजों को प्रस्तुत करने के अध्यधीन प्रसुविधांए प्रदान की जाएगी, अर्थातः--

(क) यदि उसने स्वयं को अभ्यावेशित कर दिया है तो उसकी आधार अभ्यावेशन पहचान पर्ची; और

(ख) निम्नलिखित में से कोई दस्तावेज है, अर्थातः-

(i) फोटो सहित बैंक या पोस्ट ऑफिस पासबुक; या

(ii) स्थायी लेखा संख्या (पी.ए.एन.) कार्ड; या7080 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 (iii) पारपत्र; या (iv) राशन कार्ड; या

(v) मतदाता पहचान कार्ड; या

(vi) मनरेगा कार्ड; या

(vii) किसान फोटो पासबुक; या

(viii) मोटर यान अधिनियम, 1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी चालन अनुज्ञप्ति; या

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा शासकीय शीर्षनामा पर जारी ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाण-पत्र; या

(x) विभाग द्वारा यथा विनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह और कि उपरोक्त दस्तावेजों की विभाग द्वारा उस प्रयोजन के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा जाँच की जाएगी। 2. स्कीम के अधीन सुविधापूर्वक हिताधिकारियों को प्रसुविधाएं उपलब्ध करवाने के आशय से विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि हिताधिकारियों को उक्त अपेक्षाओं के सम्बन्ध में उन्हें जागरूक करने के लिए, मीडिया के माध्यम से व्यापक प्रचार किया जाएगा।

3. उन समस्त मामलों मेें जहां हिताधिकारियों के खराब (अपकृष्ट) (अस्पष्ट) बायोमिट्रिक्स के या किसी अन्य कारण से आधार प्रमाणन असफल रहता है तो निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृत की जाएगी, अर्थात :--

(क) खराब (अस्पष्ट) उंगली छाप क्वालिटी की दशा में आंख के पुतली स्कैन या चेहरा प्रणालीकरण प्रसुविधाएं प्रमाणीकरण के लिए अंगीकृत की जाएगी तद्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाएं प्रदान करने हेतु उंगली छाप अधिप्रमाणन सहित आंख के पुतली स्कैन या चेहरा प्रमाणीकरण की प्रसुविधा की व्यवस्थाएं करेगा;

(ख) उंगली छाप या आंख की पुतली का स्कैन या चेहरा प्रमाणीकरण के माध्यम से बायोमिट्रिक अधिप्रमाणन की असफलता की दशा में जहां कहीं भी साध्य और अनुज्ञेय हो सीमित समय विधिमान्यता सहित यथास्थिति एक बार आधार पासवर्ड या समय आधारित एक बार पासवर्ड प्रदान किया जाएगा;

(ग) उन समस्त अन्य मामलों में जहां बायोमिट्रिक या एक बार आधार पासवर्ड या एक बार समय आधारित एक बार पासवर्ड अधिप्रमाणन सम्भव नहीं है तो, स्कीम के अधीन प्रसुविधाएं आधार वर्ण (अक्षर), के आधार पर दी जाएंगी, जिसकी अधिप्रमाणिकता आधार पर मुद्रित तुरन्त प्रत्युत्तर कोड के माध्यम से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी ।

NOTIFICATION

Shimla -171 002, the 20th January, 2022

No. RD-F (9)-1/2021.—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Rural Development Department (hereinafter referred to as the Department), is administering the Mukhya Mantri Awaas Yojana (hereinafter referred to as the Scheme) to eligible rural BPL houseless beneficiaries, which is being implemented through the Rural Development Department [hereinafter referred to as the Implementing Agency(ies)];

And whereas, under the Scheme, an amount of 1.50 lakh (hereinafter referred to as the benefit) is given to the rural eligible BPL beneficiaries (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extent Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh;

Now, therefore, in pursuance of Section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Government of Himachal Pradesh hereby notifies the following, namely:—

1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, Shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitiled to obtain Aadhaar as per Section 3 of the said Act, and such individuals shall visit any Aadhaar enrolment centre [list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in] to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations; 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency Shall provide Aadhaar enrolment facilities at convenient locations in coordination with existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that untill the Aadhar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely:—

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and

(b) any one of the following documents, namely:—

(i) Bank or Post office Passbook with Photo; or

(ii) Permanent Account Number (PAN) Card; or

(iii) Passport; or

(iv) Ration Card; or

(v) Voter Identity Card; or

(vi) MGNREGA Card; or

(vii) Kisan Photo passbook; or

(viii) Driving license issued by the Lincensing Authority under the Motor Vehicles Act,1988 (59 of 1988) ; or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or

(x) any other document as specified by the Department:

Provided further that the above documents may be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through the media shall be given to the beneficiaries to make them aware of the said requirement.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iries scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication alongwith finger-print authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-Based One –Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time–based One-Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. In addition to the above, in order to ensure that no bonafide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall follow the exception handling mechanism as outlined in the Office Memorandum of Direct Benefit Transfer (DBT) Mission, Cabinet Secretariat, Government of India dated 19th December, 2017.

5. This notification shall come into effect from the date of its publication in the Official Gazette.

और ग्रामीण विकास विभाग (जिसे इसमें इसके पश्चात्‌ विभाग कहा गया है) कुटुम्ब के उन सदस्यों/बीमाकृत महिलाओं को किसी प्रकार की दुर्घटना, शल्य-चिकित्सा जैसे नसबंदी, शिशु के जन्म/प्रसूति के समय पर अनिष्टपात, डूबने या बाढ़ में बह जाने, भूस्खलन, कीट के काटने और सर्पदंश आदि के कारण उद्‌भूत (उत्पन्न होने वाली) उनकी मृत्यु या किसी दिव्यांगता की दशा में राहत (अनुतोष) प्रदान करने के लिए मातृ शक्ति बीमा (जिसे इसमें इसके पश्चात्‌ स्कीम कहा गया है) प्रशासित कर रहा है, जिसे ग्रामीण विकास विभाग (जिसे इसमें इसके पश्चात्‌ कार्यान्वयन अभिकरण कहा गया है) के माध्यम से कार्यान्वित किया जा रहा है;

स्कीम के अन्तर्गत गरीबी रेखा से नीचे के ग्रामीण कुटुम्बों (जिसे इसमेें इसके पश्चात्‌ हिताधिकारी कहा गया है) को, किसी प्रकार की दुर्घटना, शल्य चिकित्सा जैसे नसबंदी, शिशु के जन्म/प्रसूति के सयम पर अनिष्टपात, डूबने, बाढ़ में बहने, भूस्खलन, कीट के काटने और सर्पदंश आदि के कारण होने वाली उनकी मृत्यु या उदभूत दिव्यांगता की दशा में कार्यान्वयन अभिकरण द्वारा विद्यमान स्कीम के मार्गदशक सिद्धान्तों के अनुसार दो लाख रुपये (जिसे इसमें इसके पश्चात्‌ 'प्रसुविधा' कहा गया है) की रकम प्रदान की जाती है। उपर्युक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि से उपगत होने वाला आवर्ती व्यय अन्तर्वलित है । 7084 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 अतः हिमाचल प्रदेश के राज्यपाल, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18), जिसे इसमें इसके पश्चात्‌ उक्त अधिनियम कहा गया है की धारा 7 के अनुसरण में एतदद्वारा निम्नलिखित अधिसूचित करते है, अर्थात्‌ :-

1. (1) स्कीम के अधीन प्रसुविधाएं प्राप्त करने के लिए पात्र किसी व्यष्टि को एतदद्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना या आधार अधिप्रमाणन प्रस्तुत करना अपेक्षित होगा ।

(2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वाँछा रखने वाला कोई व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए अभ्यावेशित नहीं है, को स्कीम के लिए रजिस्ट्रीकरण से पूर्व आधार के अभ्यावेशन के लिए आवेदन करना अपेक्षित होगा, यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसा व्यष्टि आधार का अभ्यावेशन करवाने के लिए किसी आधार अभ्यावेशन केन्द्र [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0आई0डी0ए0आई0) वैबसाइट www uidai.gov.in पर उपलब्ध है] पर जाएगा ।

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार विभाग अपने कार्यान्वयन अभिकरण के माध्यम से ऐसे हिताधिकारियों, जिनका अभी तक आधार के लिए नामांकन नहीं हुआ है, के लिए आधार अभ्यावेशन सुविधाएं प्रस्थापित करना अपेक्षित है और यदि सम्बन्धित खण्ड या तालुका या तहसील में अभी तक कोई आधार नामांकन केन्द्र अवस्थित नहीं है, तो विभाग अपने कार्यान्वयन अभिकरण के माध्यम से भारतीय विशिष्ट पहचान प्राधिकरण (यू0आई0डी0ए0आई0) के वर्तमान रजिस्ट्रारों के साथ समन्वय करके या स्वयं यू0आई0डी0ए0आई0 रजिस्ट्रार के रूप में सुविधाजनक स्थानों पर आधार नामांकन सुविधाएं प्रदान करेगा :

परन्तु जब तक व्यष्टि को आधार समनुदेशित नहीं किया जाता है तब तक ऐसे व्यक्ति को स्कीम के अधीन निम्नलिखित दस्तावेजों को प्रस्तुत करने के अध्यधीन प्रसुविधाएं प्रदान की जाएंगी, अर्थात :--

(क) यदि उसने स्वयं को अभ्यावेशित कर दिया है तो उसकी आधार अभ्यावेशन पहचान पर्ची; और

(ख) निम्नलिखित में से कोई दस्तावेज है, अर्थातः-

(i) फोटो सहित बैंक या पोस्ट ऑफिस पासबुक ; या

(ii) स्थायी लेखा संख्या (पी.ए.एन) कार्ड; या

(iii) पारपत्र; या

(iv) राशन कार्ड; या

3. उन समस्त मामलों मेें जहां हिताधिकारियों के अपकृष्ट (अस्पष्ट) (खराब) बायोमिट्रिक्स के या किसी अन्य कारण से आधार प्रमाणन असफल रहता है तो निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृत की जाएगी, अर्थातः--

(क) अस्पष्ट (खराब) उगंली छाप क्वालिटी की दशा में अधिप्रमाणन हेतु आंख के पुतली स्कैन या चेहरा प्रमाणीकरण सुविधाएं अंगीकृत की जाएगी तद्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाएं प्रदान करने हेतु उंगली छाप अधिप्रमाणन सहित आंख के पुतली स्कैन या चेहरा प्रमाणीकरण की प्रसुविधा की व्यवस्थाएं करेगा;

(ख) यदि उंगली छाप या आंख की पुतली का स्कैन या चेहरा प्रमाणीकरण के माध्यम से बायोमिट्रिक प्रमाणीकरण सफल नहीं है तो जहां कहीं भी साध्य और अनुज्ञेय हो, यथास्थिति, एक मुश्त आधार पासवर्ड द्वारा या सीमित समय विधिमान्यता सहित समय आधारित एक मुश्त पासवर्ड प्रदान किया जाएगा;

(ग) उन समस्त अन्य मामलों में जहां बायोमिट्रिक या एक मुश्त आधार पासवर्ड या समय आधारित एक बार पासवर्ड अधिप्रमाणन सम्भव नहीं है तो, स्कीम के अधीन प्रसुविधाएं आधार वर्ण (अक्षर), के आधार पर दी जाएंगी, जिसकी अधिप्रमाणिकता आधार पर मुद्रित तुरन्त प्रत्युत्तर कोड के माध्यम से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी ।

And whereas, the Rural Development Department (hereinafter referred to as the Department), is administering the Matri Shakti Bima Yojana (hereinafter referred to as the Scheme) to grant relief to family members/insured women in case of their death or disablement arising due to any kind of accident, surgical operations like sterilization, mishap at the time of child birth/delivery, drowning, washing away in floods, landslide, insect bite and snakebite etc. which is being implemented through the Rural Development Department [hereinafter referred to as the Implementing Agency(ies)];

And whereas, under the Scheme, an amount of 2 lakh (hereinafter referred to as the benefit) is given to the rural BPL family in case of their death or disablement arising due to any kind of accident, surgical operations like sterilization, mishap at the time of child birth/delivery, drowning, washing away in floods, Landslide, insect bite and snakebite etc. (hereinafter referred to as the beneficiaries),by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh.

Now, therefore, in pursuance of Section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Government of Himachal Pradesh hereby notifies the following, namely:—

1. (1) An individual eligible for receiving the benefits under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing benefits under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, Shall be required to make application for Aadhaar enrolment before registering for the Scheme provided that he is entitiled to obtain Aadhaar as per Section 3 of the said Act, and such individuals shall visit any Aadhaar enrolment centre [list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in] to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations; 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency Shall provide Aadhaar enrolment facilities at convenient locations in coordination with existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that untill the Aadhar is assigned to the individual, benefits under the Scheme shall be given to such individual, subject to the production of the following documents, namely:—

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and7087 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 (b) any one of the following documents, namely:—

(i) Bank or Post office Passbook with Photo; or

(ii) Permanent Account Number (PAN) Card; or

(iii) Passport; or

(iv) Ration Card; or

(v) Voter Identity Card; or

(vi) MGNREGA Card; or

(vii) Kisan Photo passbook; or

(viii) Driving license issued by the Lincensing Authority under the Motor Vehicles Act,1988 (59 of 1988) ; or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or (x) Any other document as specified by the Department:

Provided further that the above documents may be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through the media shall be given to the beneficiaries to make them aware of the said requirement.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) In case of poor fingerprint quality, iries scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication alongwith finger-print authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-Based One –Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time –based One- Time Password authentication is not possible, benefits under the Scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. In addition to the above, in order to ensure that no bonafide beneficiary under the Scheme is deprived of his due benefits, the Department through its Implementing Agency shall7088 राजपत्र, हिमाचल प्रदेश, 1 फरवरी, 2022/12 माघ, 1943 follow the exception handling mechanism as outlined in the Office Memorandum of Direct Benefit Transfer (DBT) Mission, Cabinet Secretariat, Government of India dated 19th December, 2017.

5. This notification shall come into effect the date of its publication in the Official Gazette.
