No. IND-A-A004/2/2022-IND-A-GoHP.—The Governor, Himachal Pradesh is pleased to constitute a Project Monitoring Committee (PMC) of State to implement beneficiary oriented 14—राजपत्र/2022-20-04-2022 (373)374 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2022/30 चैत्र, 1944 components under Central Sector Scheme "Silk Samagra-2" and also to review/monitor process on implementation of the scheme for the next five years i.e. 2021-22 to 2025-26. The Constitution of the Committee will be as under:-—

Terms of references of the Committee will be as under:

1. Formulation of projects with convergence from other funding agencies and yearly Action Plan.

2. Monitor progress on implementation of Silk Samagra-2 components at the grass roots level in close association with the district/division/field level implementing agencies.

3. To ensure submission of Utilization Certificates as per GFR & progress reports to CSB for release of funds and updating beneficiary details in DBT-Serviceplus portal.

4. Finalization of beneficiary list along with Aadhar Number and other details. 5. To constitute sub-committee under the Chairmanship of DoS involving CSB and State representatives to scrutinize and recommend purchase proposals and for other matters involved in Silk Samagra-2 components.

6. Monitor production of bivoltine and other varieties of silk on quarterly basis against targets and suggest interventions in case of shortfall.

7. Review progress on utilization of infrastructure created for sericulture in earlier periods for maximization of benefits, keeping in view the mapping exercise carried out.

8. Review production and productivity improvement. 9. Discuss coverage of beneficiaries under different categories. 10. Review of schemes and programmes of other Ministries/Departments implemented for sericulture development (financial and physical) and to ensure submission of progress report to CSB.

11. Follow up action on the decisions of AAMC and other review meetings. 12. To consider re-appropriation of fund from one component to another within the overall frame-work of scheme guidelines, with justification.

13. Updation of State profile on quarterly basis and review geotagging of assets. 14. Maintenance and review of district-wise database on support under the Silk Samagra/Other scheme.

15. To list out issues/constraints relating to sericulture development and suggest remedial measures.

16. To organize concurrent evaluation and social audit. 17. Other matters which are important for successful implementation of Silk Samagra-2. 18. The committee shall meet once in a quarter by physical or virtual mode. 19. PMC may co-opt any other member or form other sub-committees, if need arises.

NOTIFICATION

No. IND-A-F005/3/2022-IND-A-GoHP.—The Government of India has enacted the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006) [hereinafter referred as MSMED Act, 2006]. The Section 18(3) of the MSMED Act envisages arbitration in the claim applications filed before the Micro and Small Enterprises Facilitation Council once the conciliation between the parties in dispute is not successful. Section 18(3) of MSMED Act provides as under:

"(3) Where the conciliation initiated under sub-section (2) is not successful and stands

terminated without any settlement between the parties, the Council shall either itself take up

the dispute for arbitration or refer to it any institution or centre providing alternate dispute

resolution service for such arbitration and provisions of the Arbitration Council Act, 1996

(26 of 1996) shall then apply to the dispute as if the arbitration was in pursuance of an

arbitration agreement referred to in sub-section (1) of Section 7 of the Act."

The Government of Himachal Pradesh, Department of Industries vide notification No. Ind. A(F)19-21/2006 dated 12-10-2007 has notified Himachal Pradesh Micro and Small Enterprises Facilitation Council Rules-2007, as amended vide Notification No. Ind. A(F)19-21-2005-I dated 17-3-2015 [hereinafter referred as HPM&SFC Rules]. The Government of Himachal Pradesh, Department of Industries in exercise of powers conferred by Section 20 of MSMED Act, 2006 has also constituted and notified Himachal Pradesh Micro and Small Enterprises Facilitation Council (hereinafter referred as HPM & SEF Council) vide Notification No. Ind. A(F)19-21/2006 dated 12-10-2007.

Rule 10 of HPM & SFC Rules-2007 as amended vide Notification No. Ind. A(F) 19-21/2005-I dated 17-3-2015 refers to the issue of Arbitration for final settlement of the disputes in the cases filed before the HPM&SEF Council. Rule 10 of Himachal Pradesh Micro and Small Enterprises Facilitation Council Rules-2007 provides:

"(10) When such conciliation mentioned in sub-rule (9) does not lead to settlement of the

dispute, the Council shall either itself act Arbitration for final settlement of the dispute or

refer it to an institution for such arbitration, in accordance with the provisions of the

Arbitration and Conciliation Act, 1996. The supplier or the buyer may, either in person or

through its legal representatives, present his case before the Council or the institute during

the arbitration proceeding. The institute shall submit its report to the Council within such

time as the Council it may stipulate."

Keeping in view the need for expeditious disposal of arbitration cases, the following are hereby empanelled as Arbitrators to whom the cases can be entrusted by the Council for376 राजपत्र, हिमाचल प्रदेश, 20 अप्रैल, 2022/30 चैत्र, 1944 conciliation or arbitration in accordance to provisions made under Section 18 of the MSMED Act and Rule 8 to 10 of Himachal Pradesh Micro and Small Enterprises Facilitation Council Rules-2007 as amended vide notification No. Ind.A(F)19-21/2005-I dated 17-3-2015. This issues in supersession to this Department's Notification No. Ind.A(F)19-21/2005-I dated 18-9-2015:—

The aforesaid fee structure may be revised by the Government from time to time. The arbitration fee as mentioned above would be paid by the parties to dispute. The matter regarding apportionment of the fees between the parties and mode/manner of payment shall be decided by the Arbitrator. The Arbitrators(s) would take least time for deciding the arbitration award, which would in no case exceed the time limit as prescribed under MSMED Act-2006 for disposal and processing of such cases.

(ii) Existing post of Draughtsman in the technical staff of the Board; is upgraded to the post of Divisional Head Draughtsman in the pay band of Rs. 10,300-34,800+4200 grade pay(Pre-revised) as a measure personal to the existing incumbent. However the upgraded post shall revert back on his retirement on superannuation.

अतः इस नोटिस के माध्यम से समस्त जनता तथा सम्बन्धित रिश्तेदारों को सूचित किया जाता है कि यदि किसी को शादी पंजीकरण बारे कोई एतराज/आपत्ति हो तो वह दिनांक 23-04-2022 को प्रातः 10.00 बजे या उससे पहले असालतन या वकालतन हाजिर अदालत होकर अपनी स्थिति/एतराज प्रस्तुत कर सकता है। निश्चित तिथि पर कोई एतराज प्राप्त न होने की सूरत में प्रार्थी को शादी पंजीकरण प्रमाण-पत्र जारी कर दिया जायेगा। अतः बाद में कोई उजर काबिले समायत न होगा।
