The dispute between the parties having been referred for determination to the National Lok Adalat and the parties having compromised/settled the case/matter, the following award is passed in terms of the settlement:

Learned counsel for the parties have submitted that the matter stands amicably settled between the parties and in terms of joint statement of the parties recorded on 7-3-2022, the Award443 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2022/03 वैशाख, 1944 may be passed for the amicable settlement. Shri Gopal Singh petitioner and Shri Parveen Thakur, General Manager of respondent had deposed on oath on 7-3-2022 as under:

"We have settled the present dispute amicably and respondent the Project Incharge,

General Manager, M/s. Kapil Mohan & Associates Hydro Power Project Pvt. Ltd.

Beaskund (HEP), VPO Palchan, Tehsil Manali, District Kullu, H.P., has agreed to pay

Rs.2,50,000/- to petitioner Shri Gopal Singh as full and final settlement of his claim against

the respondent, which amount shall be transferred through cheque or RTGS to petitioner by

respondent on or before 17-3-2022. Accordingly, this matter is requested to be taken up in

the National Lok Adalat on 12th March, 2022 for final amicable settlement and passing of

Award accordingly".

Accordingly, in view of the aforestated joint statement of the parties the present reference is disposed off as amicably settled. Accordingly, Award is passed to this effect that the respondent shall pay Rs. 2,50,000/- to petitioner Shri Gopal Singh as full and final settlement of his claim against respondent, through cheque/RTGS on or before 17-3-2022, failing which the same shall carry interest @6% per annum. Joint statement aforementioned shall form part of this Award.

The parties are informed that the Court fee, if any, paid by any of them shall be refunded.

Learned counsel for the parties have submitted that the matter stands amicably settled between the parties and in terms of separate statements of the parties recorded on 12-01-2022, the Award may be passed for the amicable settlement.

On 12-1-2022 Shri Satish Kumar petitioner had made statement on oath in the Court of having settled the present dispute with respondent. He had received Cheque No. 819429 dated 08-01-2022 of Punjab National Bank for sum of Rs. 31,358/- as settlement of his claim. Besides he was to receive Rs. 5,000/- which the respondent had agreed to pay on or before 31-1-2022 with receipt aforementioned amounts his claim against respondent shall stand settled in full and final. Thus, he prayed for passing compromise decree in the Lok Adalat.

Shri Raj Kumar Bhatia, HR Manager of respondent vide separate statement recorded on oath on 12-1-2022 agreed to the statement of petitioner on behalf of respondent.

Today learned counsel for petitioner has placed on record photocopy of receipt of Rs.5,000/- received by Shri Satish Kumar petitioner from respondent. With the receipt of aforestated amount of Rs. 5,000/-, the matter stands compromised in full and final. Accordingly, Award to the said effect is passed. The statements aforementioned recorded as well receipt shall form part of this Award.

The parties are informed that the Court fee, if any, paid by any of them shall be refunded.

AWARD

The following reference has been received from the appropriate Government for adjudication under section 10 (1) of the Industrial Disputes Act, 1947 (hereinafter referred to as 'the Act' for short).

"Whether termination of the services of Shri Devi Singh s/o Shri Dheerju, r/o Village Anu, P.O. Behali, Sub-Tehsil Nihri, District Mandi, H.P. during August, 2008 by the Divisional Forest Officer, Suket Forest Division, Sunder Nagar, District Mandi, H.P., without complying with the provisions of the Industrial Disputes Act, 1947, is legal and justified? If not, what amount of back wages, seniority, past service benefits and compensation the above worker is entitled to from the above employer?"

2. After the notices of the Reference were served upon the parties, the petitioner filed his statement of claim on the averments that he was engaged in the year 2004 as a workman by the respondent and thereafter fictional breaks were intentionally given to him so that he could not complete 240 days in each calendar year and later on his services were terminated without one month's prior notice. The petitioner has further averred that workmen junior to him namely Shri Jai Lal s/o Shri Gouri Dutt, Shri Madan Lal s/o Shri Dila Ram etc. have been retained by the respondent and they have also been regularized, whereas, by giving intentional fictional breaks to the petitioner, the respondent indulged in unfair labour practices. On such averments the petitioner prayed for his reinstatement with seniority, continuity and regularization alleging that there was violation of Sections 25-F & 25-G of theact.

3. The respondent has resisted and contested the claim and submitted in the reply that the petitioner was engaged only as a casual labourer w.e.f. February, 2005 and he worked as such till August, 2008 and that too intermittently. As per the respondent, the petitioner thereafter left the job at his own sweet will and he was neither terminated nor he was subjected to unfair labour practices as alleged. In reply, the respondent submitted that Shri Jai Lal s/o Shri Gouri Dutt, Shri Madan Lal s/o Shri Dila Ram were engaged prior to the petitioner and Smt. Sita Devi w/o Shri Bodh Raj was engaged on compensate grounds, hence, there is no violation of any of the provisions of the Act.

4. Before the proceedings could proceed further, the petitioner absented himself and his counsels also failed to put their appearance before this Court. Taking into account the beneficial nature of legislation notices were issued to the advocates as well as to the petitioner time and again. Though the notices were received by the petitioner as well as one of his advocate Shri Ritesh Sharma but none chose to put their appearance and such a conduct on their part is suggestive of the447 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2022/03 वैशाख, 1944 fact that the petitioner is not interested in pursuing the matter any further and he is not interested in the work or the relief any more. Taking into all these fact, the petitioner was, thus preceded against exparte by my learned predecessor vide order dated 24-2-2022. Since this court was dealing with a reference made by the appropriate Government, therefore, it is the duty of the court to answer the same irrespective of the fact whether the parties pursued the same or not.

5. It is in this background the present reference is answered as under.

6. It is the basic principle of civil law that anything pleaded by the parties has to be proved by leading evidence and only then the same can be read by the court in order to grant or refuse the claimed. In case evidence is not led in support of the pleadings, the pleadings are rendered meaningless. The Court cannot take into account the pleadings and the documents at the time of adjudication unless evidence is led in support of the same. Once the pleadings and the documents are not proved, even the beneficial nature of the legislation cannot come to help the petitioner in obtaining the relief claimed. As aforesaid, the petitioner never appeared before this Court despite of due notice and opportunity granted to him time and again to lead evidence and thus the statement of claim of the petitioner was not proved. The petitioner has thus failed to prove that he was terminated in violation to the provisions of the Act. The petitioner has also failed to prove that the juniors to him were retained and regularized, whereas, fictional breaks were given to him solely with a view to not let him complete 240 days in a calendar year. When all these facts have not been established by the petitioner, the respondent was not duly bound to lead evidence as the petitioner has to stand on his own legs. Unless, the petitioner proves his case prima-facie, the onus does not shifted upon the respondent. As aforesaid, the petitioner has not led any evidence in support of his case which makes this court to presume that he is feeling no more aggrieved by the alleged acts of the respondent. It appears that the petitioner is no more interested either in continuing with the work he was earlier doing or in obtaining the compensation or other benefits which are permissible under law. Thus, in the aforesaid background, the reference is answered in negative. Parties are left to bear their costs.

7. A copy of this Award be sent to the appropriate Government for publication in the official gazette. File after due completion be consigned to the Record Room.

No. EXN-F(10)-5/2022.—In exercise of the powers conferred by sub-section (1) of Section 9 and sub-section (5) of Section 15 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on the recommendations of the Council, is pleased to make the following449 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2022/03 वैशाख, 1944 further amendments in the notification of the Government of Himachal Pradesh, No. 1/2017-State Tax (Rate), dated the 30th June 2017, published in the e-Gazette of Himachal Pradesh vide number EXN-F(10)- 14/2017-Loose, dated 20th June, 2017, namely: —

NOTIFICATION No. 2/2022-State Tax (Rate)

Shimla-2, the 22nd April, 2022

No. EXN-F(10)-5/2022.—In exercise of the powers conferred by sub-section (1) of Section 11 and sub-section (1) of Section 16 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, on the recommendations of the Council, is pleased to exempt the intra-state supplies of goods, the description of which is specified in column (3) of the table below, falling under the tariff item, sub-heading, heading or Chapter, as specified in the corresponding entry in column (2) of the said table, from so much of the central tax leviable thereon under section 9 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017) as is in excess of the amount calculated at the rate specified in the corresponding entry in column (4) of the said table and subject to the relevant conditions annexed to this451 राजपत्र, हिमाचल प्रदेश, 23 अप्रैल, 2022/03 वैशाख, 1944 notification, the condition number of which is mentioned in the corresponding entry in column (5) of the said table:—

Explanation.— (i) For the purposes of this notification, "Tariff item", "sub-heading", "heading" and "Chapter" shall mean respectively a tariff item, sub-heading, heading and chapter as specified in the First Schedule to the Customs Tariff Act, 1975 (51 of 1975).

(ii) The rules for the interpretation of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), including the Section and Chapter Notes and the General Explanatory Notes of the First Schedule shall, so far as may be, apply to the interpretation of this notification.

2. This notification shall come into force on the 1st day of April, 2022
