This Department is administrative Department in reference to Directorate of Transport, Himachal Road Transport Corporation, Himachal Pradesh City Transport & Bus Stand Management & Development Authority and Ropeways and Rapid Transport System Development Corporation.

(ii) THE POWERS AND DUTIES OF ITS OFFICERS AND EMPLOYEES;

Secretary/Principal Secretary/Additional Chief Secretary (Transport) to the Government of Himachal Pradesh.—Additional Chief Secretary/Principal Secretary/ Secretary (Transport) is the Administrative head of the Department and maintains overall control of the Department.

Special/Additional /Joint/ Deputy /Under Secretary (Transport).—To assist the Additional Chief Secretary/Principal Secretary/Secretary (Transport) to the Government of Himachal Pradesh on the issues as stated above.

Section Officer:—The Section Officer is the in-charge of the Section. He/she performs following duties:—

1. Supervise all the work of Section and marking dak to the Assistants

2. Ensure timely submission of time bound cases/court cases

3. Ensure all the Dealing Asstts. and Diarist are maintaining all required registers and keep the same updated.

4. To keep carefully watch on the movements of dak /files between Section and higher authorities.

Superintendent Gr-II.—Superintendents Grade-II working in the Secretariat supervises work of the dealing assistants posted in the Section and submits their cases through the Section Officer. In the absence of Section Officer, the Superintendent Grade-II supervises the work of entire Section.

Senior/Junior Assistants.—Senior/Junior Assistants deal with receipts and submit cases to the Section Officer through Superintendent. They are required to compile data or information and deal with matters including Cabinet Memorandums/Court Cases/ replies of Vidhan Sabha Question, so as to present complete cases with all relevant data and information with past precedents and viable/ feasible solutions to facilitate the authorities to arrive at a definite decision. They are also required to maintain record/registers.

Clerks.—Clerk posted in the Section perform duties and functions as assigned to them by the Section Officer/Superintendent including the Diary/Dispatch work, maintain leave account, distribute dak after diarying to dealing assistants in the Section and open new files and also do the dealing of miscellaneous subjects.

Personal Staff.—The general function of Personal staff i.e. Spl. Private Secretary/Private Secretary/Personal Assistant/Senior and Junior Scale Stenographers/Steno Typists is to assist the Secretary and other Middle level Officers in their day-to-day disposal of work and carry out such duties officially assigned to them. They have to handle files/records of confidential or secret nature and as such, they have to retain the faith reposed in them by maintaining secrecy. They are also supposed to be fully equipped with knowledge of both Hindi and English shorthand and typewriting to assist the authorities in quick decision-making through dictation and typing. Further they have to perform the duties of Receipt of dak, preparation of notes and drafts. Attendance of telephones, Maintenance of Engagement Diary, Control over Vehicle/Driver, Arrangements for tours/pay etc. and also for maintenance of records.

(iii) THE PROCEDURE FOLLOWED IN THE DECISION MAKING PROCESS, INCLUDING CHANNELS OF SUPERVISION AND ACCOUNTABILITY.—All the cases received in Transport Section are submitted on files by the concerned dealing assistants, supervised by the Superintendent and submitted to the Section Officer. He/She submits it further to the Special/Additional /Joint/ Deputy /Under Secretary (Transport) and then to the Additional Chief Secretary/Principal Secretary/ Secretary (Transport) to the Government of Himachal Pradesh. Routine matters and informatory references are disposed of at Section Officer/Under/Deputy/ Joint/Addl./Special Secretary level.

(iv) THE NORMS SET BY IT FOR THE DISCHARGE OF ITS FUNCTIONS.—As stated at point (iii) above.

(v) THE RULES, REGULATIONS, INSTRUCTIONS MANUALS & RECORDS HELD BY IT OR UNDER ITS CONTROL OR USED BY ITS EMPLOYEES FOR DISCHARGING ITS FUNCTIONS.—The following various rules, regulations, instructions are followed while functioning the different works:—

• Vigilance Manual • Instructions regarding maintenance of ACRs. Instructions regarding pay fixation, Stepping up of pay, granting of ACPS benefits and removal of anomaly in pay of senior and junior officers and other relevant instructions issued by the advisory departments from time to time.

संख्याः रैव.-ए(ए)3-5/2017.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए़, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, राजस्व491 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल 2022/05 वैशाख, 1944 विभाग, हिमाचल प्रदेश भू-एकत्रीकरण निदेशालय में सहायक भू-एकत्रीकरण अधिकारी, वर्ग-II (अराजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध-'क' के अनुसार भर्ती और प्रोन्नति नियम बनाते हैं, अर्थात्‌-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम राजस्व विभाग, हिमाचल प्रदेश, भू-एकत्रीकरण निदेशालय, सहायक भू-एकत्रीकरण अधिकारी, वर्ग-II (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2022 है।

(2) ये नियम राजपत्र (ई गजट)ए हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. निरसन और व्यावृतियां.--(1) इस विभाग की अधिसूचना संख्याः राज-ए(ए)3-2/94(ए0सी0ओ0) तारीख 13 जून, 1997 द्वारा अधिसूचित निदेशालय, भू-एकत्रीकरण विभाग, हिमाचल प्रदेश, सहायक भू-एकत्रीकरण अधिकारी, वर्ग-III (अराजपत्रित) भर्ती एवं प्रोन्नति नियम, 1997 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी उपर्युक्त उप-नियम (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

10. भर्ती की पद्धति, भर्ती सीधी होगी या प्रोन्नति/सैकण्डमैंट/स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--शतप्रतिशत प्रोन्नति द्वारा।

11. प्रोन्नति/सैकण्डमैंट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति/ सैकण्डमैंट/स्थानान्तरण किया जाएगा.--निम्नलिखित में से प्रोन्नति द्वारा जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा को सम्मिलित करके पांच वर्ष का नियमित सेवाकाल होः-- (i) फील्ड कानूनगो = 85%

(ii) वरिष्ठ सहायक/वरिष्ठ वेतनमान आशुलिपिक = 15%

ऐसा न होने पर वर्ग-III के सम्भरक (पोषक) पदों में पच्चीस वर्ष की संयुक्त नियमित सेवाकाल के साथ कानूनगो/वरिष्ठ सहायक/वरिष्ठ वेतनमान आशुलिपिक में से जिसमें वर्तमान ग्रेड में दो वर्ष का अनिवार्य सेवाकाल भी सम्मिलित होगा। पदोन्नति के प्रयोजन हेतु वरिष्ठ सहायक/वरिष्ठ वेतनमान आशुलिपिक के पद के पात्र पदधारियों की सेवाकाल के आधार पर उनकी संवर्गवार पारस्परिक वरिष्ठता को छेड़े बिना संयुक्त वरिष्ठता सूची विहित की जाएगी।

प्रोन्नति के प्रयोजन के लिएः

(क) कानूनगो द्वारा नायब-तहसीलदार की परीक्षा उत्तीर्ण की होनी चाहिए

(ख) वरिष्ठ सहायक/वरिष्ठ वेतनमान आशुलिपिक के मामले में, प्रोन्नति के पश्चात्‌ दो वर्षो के भीतर उन्हें नायब तहसीलदार की परीक्षा उत्तीर्ण करनी होगीय ऐसा न होने पर पर उन्हें प्रत्यावर्तित कर दिया जाएगा।

(ग) वरिष्ठ सहायक और वरिष्ठ वेतनमान आशुलिपिक के ग्रेड से प्रोन्नति के मामले में उन्हें बंदोबस्त और भू-एकत्रीकरण में छह मास का प्रशिक्षण करना होगा, और तत्पश्चात्‌ ही उन्हें सक्षम प्राधिकारी द्वारा अर्हित घोषित किया जा सकेगा।

(घ) सहायक भू-एकत्रीकरण अधिकारियों द्वारा वर्ग-II राजपत्रित की हैसियत राजस्व नायब तहसीलदारी सेवाओं के लिए तातपर्यित अनिवार्य प्रशिक्षण और विभागीय परीक्षा के समस्त पेपरों को उत्तीर्ण करने के अध्यधीन, प्रयोज्य होगी और जो वैसे ही कृत्यों का निर्वहन और कर्त्तव्यों का पालन करेंगे जो राजस्व विभाग के नायब तहसीलदारों द्वारा निष्पादित किए जा रहे हैंः परन्तु सहायक भू-एकत्रीकरण अधिकारी के पद को भरने के लिए निम्नलिखित बीस बिन्दु पद आधारित रोस्टर का अनुसरण किया जाएगाः--

टिप्पणः--रोस्टर प्रत्येक बीसवें बिन्दु के पश्चात्‌ तब तक दोहराया जाता रहेगा, जब तक कि समस्त प्रवर्गों को दी गई प्रतिशतता तक प्रतिनिधित्व प्राप्त नहीं हो जाता। तत्पश्चात्‌, रिक्ति उसी प्रवर्ग में से भरी जाएगी जिससे पद रिक्त होता है।

(I) प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में पद(पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगी :

परन्तु दूरस्थ ग्रामीण क्षेत्रों में तैनाती/स्थानान्तरण के सिवाय, उपरोक्त परन्तुक (I) उन कर्मचारियों के मामले में लागू नहीं होगा जिनकी अधिवर्षिता के लिए पांच वर्ष या उससे कम की सेवा शेष रही हो। तथापि पांच वर्ष की यह शर्त प्रोन्नति के मामले में लागू नहीं होगीः

परन्तु यह और भी कि उन अधिकारियों/कर्मचारियों को, जिन्होंने जनजातीय/दुर्गम/दूरस्थ/ग्रामीण क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपने संवर्ग (काडर) में सर्वथा वरिष्ठता के अनुसार स्थानान्तरित किया जाएगा।

स्पष्टीकरण Iः--उपरोक्त परन्तुक (I) केे लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में ''कार्यकाल'' से प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए, साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिपे्रत होगी।

स्पष्टीकरण IIः--उपरोक्त परन्तुक (I) के प्रयोजन के लिए जनजातीय/कठिन क्षेत्र निम्न प्रकार से होंगेः--

1. जिला लाहौल एवं स्पिति

2. चम्बा जिला के पाँगी और भरमौर उप-मण्डल

3. रोहडू. उपमण्डल का डोडरा क्वार क्षेत्र

4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनिश दरकाली और ग्राम पंचायत काशापट।

5. जिला कुल्लू का पन्द्रह बीस परगना

6. कांगड़ा जिला के बैजनाथ उप-मण्डल का बड़ा भंगाल क्षेत्र

7. जिला किन्नौर

8. सिरमौर जिला में उप तहसील कमरउ के काठवाड़ और कोरगा पटवार वृत्त, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृत्त और शिलाई तहसील का कोटा पाब पटवार वृत्त। 9. मण्डी जिला में, करसोग तहसील का खन्योल-बगड़ा पटवार वृत्त, बाली चौकी उप-तहसील के गाड़ा गोसाईं, मठयानी, घनयाड़, थाची, बागी, सोमगाढ़ और खोलानाल, पटवार वृत्त, पद्धर तहसील के झारवाड़, कुटगढ़, ग्रामन, देवगढ़, टै्रला, रोपा, कथोग, सिलह-भड़वाणी, हस्तपुर, घमरेड़ और भटेढ़ पटवार वृत्त थुनाग तहसील के चियूणी, कालीपार, मानगढ़, थाच-बगड़ा, उत्तरी मगरू और दक्षिणी मगरू पटवार वृत्त और सुन्दरनगर तहसील का बटवाड़ा पटवार वृत्त। स्पष्टीकरण IIIः--उपर्युक्त परन्तुक (I) के प्रयोजन के लिए और दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगेः--494 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल 2022/05 वैशाख, 1944 (i) उप-मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान (ii) राज्य मुख्यालय ओर जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहाँ के लिए बस सेवा उपलब्ध नहीं है और 3 (तीन) किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है।

(iii) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना, अपने गृहनगर या गृहनगर क्षेत्र के साथ लगता 20 किलोमीटर की परिधि के भीतर का क्षेत्र।

(II) प्रोन्नति के सभी मामलों में, पद पर नियमित नियुक्ति से पूर्व, सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवाए यदि कोई होए इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अघ्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः (i) परन्तु उन सभी मामलों में, जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता हैए वहाँ उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः

परन्तु यह और कि उन सभी पदधारियों कीए जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अहर्ता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवाए जो भी कम होए होगीः

परन्तु यह और भी कि जहाँ कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरणः--अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जिसने आपातकाल के दौरान सशस्त्र बलों में कार्यग्रहण किया था और जिसे डिमोबिलाइजड आर्मड फोर्सिस परसोनल (रिजर्वेशन ऑफ वेकेन्सीज इन हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रुल्ज, 1972 के नियम 3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैन (रिजर्वेशन ऑफ वेकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसिज) रुल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों।

(ii) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति/प्रोन्नति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना मे ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

परन्तु की गई तदर्थ सेवा को गणना मे लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरुप पारस्परिक वरीयता अपरिवर्तित रहेगी।

12. यदि विभागीय प्रोन्नति समिति/विभागीय स्थायीकरण समिति विद्यमान हो, तो उसकी संरचनाः--(क) विभागीय प्रोन्नति समितिः--जैसी सरकार द्वारा समय-समय पर गठित की जाए। (ख) विभागीय स्थायीकरण समितिः--लागू नहीं

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछडे़ वर्गों और अन्य प्रवर्गों के व्यक्तियों के लिए सेवा में आरक्षण की बावत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.--सेवा के प्रत्येक सदस्य को समय-समय पर यथा संशोधित हिमाचल प्रदेश विभागीय परीक्षा नियम, 1997 में यथा विहित विभागीय परीक्षा पास करनी होगी।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वहए कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

No. Rev-A(A)3-5/2017.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the H.P. Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Assistant Consolidation Officer, Class-II (Non-Gazetted) in the Directorate of Consolidation of Holdings, Department of Revenue, Himachal Pradesh, as per Annexure-"A" attached to this notification, namely :—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Directorate of Consolidation of Holdings, Department of Revenue, Assistant Consolidation Officer, Class-II (Non-Gazetted), Recruitment and Promotion Rules, 2022.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Repeal & Savings.—(1) The Himachal Pradesh, Directorate of Consolidation of Holdings, Assistant Consolidation Officer, Class-III (Non-Gazetted), Recruitment and Promotion Rules, 1997 notified vide this Department's Notification No. Rev.A(A)3-2/94(ACO) dated 13-06-1997, are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the rules so repealed under sub-rule (1) supra shall be deemed to have been validity made or done or taken under these rules.

RECRUITMENT AND PROMOTION RULES FOR THE POST OF ASSISTANT

CONSOLIDATION OFFICER, CLASS-II (NON-GAZETTED) IN THE

DIRECTORATE OF CONSOLIDATION OF HOLDINGS,

DEPARTMENT OF REVENUE, HIMACHAL PRADESH

1. Name of Post.—Assistant Consolidation Officer

2. Number of Post (s).—18 (Eighteen)

3. Classification.—Class-II (Non-Gazetted)

4 Scale of Pay.—As per Rule 3(j) of the H.P. Civil Services (Revised Pay) Rules, 2022 5. Whether "Selection" Post or "Non-Selection" post.—Non selection

9. Period of Probation, if any.—Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

secondment/transfer and the percentages of post (s) to be filled in by various methods.—100%

by promotion.

11. In case of recruitment by promotion/secondment/transfer, grade(s) from which promotion/secondment/transfer is to be made.—By promotion from amongst the following with 05 years regular service or regular combined with continuous adhoc service in the grade:—

(i) Field Kanungo=85%

(ii) Senior Assistant/Senior Scale Stenographer = 15%

Failing which from amongst the Kanungo/ Senior Assistant/ Senior Scale

Stenographer with 25 years combined regular service in Class-III feeder posts which shall

also include 02 (two) years essential service in the present grade.

For the purpose of promotion, a combined seniority list of eligible incumbents of the

post of Senior Assistant/Senior Scale Stenographer on the basis of length of service without

disturbing their cadre wise inter-se-seniority shall be prescribed.

(a) Kanungo should have passed Naib-Tehsildar examination.

(b) In case of Senior Assistant/Senior Scale Stenographer, they should qualify the Naib- Tehsildar examination within two years after promotion, failing which they shall be reverted.

(c) In case of promotion from the grade of Senior Assistant and Senior Scale Stenographer, they shall have to undergo the training in the settlement and consolidation for six months and thereafter may be declared qualified by the competent authority.

(d) The status of Class-II Gazetted will be applicable to the Assistant Consolidation Officers subject to essential training and passing of all papers of departmental examination meant for Revenue Naib Tehsildar's services and who will perform the same functions and duties which are being performed by Naib Tehsildars of the Revenue Department:

Provided further that for filling up the posts of Asstt. Consolidation Officer by promotion the following 20 points post based roster shall be followed:—

Note:—The roster point will be rotated after every 20th point till the representation to all categories is achieved. Thereafter, the vacancy is to be filled up from the category which vacates the post.

(I) Provided that for the purpose of promotion every employee shall have to serve atleast one term in the Tribal/ Difficult/ Hard areas and remote/rural areas subject to adequate number of post(s) available in such areas:

Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation except posting/ transfer in remote/ rural area. This condition of five years shall not be applicable in case of promotion:

Provided further that Officers/Officials who have not served at least one tenure in Tribal/Difficult/Hard areas and remote/rural areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation I:—For the purpose of proviso (I) supra the "term" in Tribal/Difficult/Hard areas/remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/ convenience.

Explanation II:—For the purpose of proviso (I) supra the Tribal/Difficult Areas shall be as under:—

Explanation III:—For the purpose of (I) Supra the Remote/Rural Areas shall be as under:

(i) All station beyond the radius of 20 Kms. from Sub Division/Tehsil headquarters (ii) All stations beyond the radius of 15 kms. from State Headquarter and District headquarters where bus service is not available and on foot journey is more than 3 (three) Kms.

(iii) Home town or area adjoining to area to home town within the radius of 20 kms. of the employee regardless of its category.

(I) In all cases of promotion , the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rule for promotion subject to the conditions that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R&P Rules:

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service /appointment) in the feeder post in view of the provisions referred to above , all persons senior to him/her in the respective category/ post/ cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation:—The last proviso shall not be rendered the junior incumbents ineligible for consideration for promotion if the senior ineligible person(s) happened to be Ex-servicemen who499 राजपत्र, हिमाचल प्रदेश, 25 अप्रैल 2022/05 वैशाख, 1944 have joined armed forces during the period of emergency and recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non- Technical Services) Rules, 1972 and having been given the benefits of seniority there-under or recruited under the provision of Rule-3 of Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Services) Rules, 1985 and having been given the benefit of seniority thereunder.

(ii) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post if any, prior to the regular appointment against such posts shall be taken into account towards the length of service, if the adhoc appointment/ promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered shall remain unchanged.

12. If a Departmental Promotion Committee/Departmental Confirmation Committee exists, what is its composition.—(a) Departmental Promotion Committee:—As may be constituted by the Government from time to time.

(b) Departmental Confirmation Committee:—Not applicable

13. Circumstances under which the Himachal Pradesh Public Service Commission

(H.P.P.S.C.) is to be consulted in making recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—Not applicable

15. Selection for appointment to the post by direct recruitment.—Not applicable

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Caste/Scheduled Tribes/Other Backward Classes/Other Categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Every member of the service shall pass a Departmental Examination as prescribed in the Himachal Pradesh Departmental Examination Rules, 1997, as amended from time to time.

18. Power to Relax.—Where the State Govt. is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these rules with respect to any class or category of person(s) or post(s).

अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि यदि किसी भी व्यक्ति को श्री देवराज की जन्म तिथि ग्राम पंचायत रामपुर भारापुर उप-तहसील माजरा में दर्ज करने बारे कोई एतराज हो तो वह इश्तहार प्रकाशन होने के 30 दिन के अंदर या इससे पूर्व हमारे न्यायलय में हाजिर होकर लिखित अथवा मौखिक एतराज पेश कर सकता है।

उक्त निश्चित तिथि के बाद कोई भी एतराज मान्य नहीं होगा और समझा जाएगा कि उक्त श्री हसंराज की जन्म तिथि को सम्बन्धित ग्राम पंचायत रामपुर भारापुर में दर्ज करने बारे किसी को कोई एतराज नहीं है तथा नियमानुसार जन्म तिथि पंजीकरण के आदेश जारी कर दिये जायेंगे।

विषय.--दुरुस्ती नाम हि0 प्र0 रा0 अधिनियम, 1954 की जेर धारा 37 के तहत महाल जनकौर हार में नाम दुरुस्ती बारे।

उपरोक्त मुकद्दमा बारे प्रार्थीया ने इस न्यायालय में प्रार्थना-पत्र गुजारा है जिसमें लिखा है कि वह स्वयं का नाम उषा गोले से चमन देवी करवाना चाहती है, जबकि महाल जनकौर हार के राजस्व अभिलेख में उसका स्वयं का नाम उषा गोले दर्ज है, जोकि गलत इन्द्राज हुआ है। प्रार्थीया उक्त नाम को दरुस्त करके उषा गोले उपनाम चमन देवी पत्नी सुरिन्दर सिंह गोले दर्ज करवाना चाहती है।

अतः उक्त प्रार्थना-पत्र के सन्दर्भ में उपरोक्त नाम की दुरुस्ती बारे किसी को कोई उजर या एतराज हो तो वह असालतन या वकालतन इस न्यायालय में दिनांक 30-04-2022 को सुबह 10.00 बजे हाजिर आ सकता है। हाजिर न आने की स्थिति में एकतरफा कार्यवाही अमल में लाई जाकर आगामी आदेश पारित कर दिये जाएंगे। इसके बाद कोई भी उजर या एतराज काबिले समायत न होगा।
