संख्या : एच० स०जी०-ए(3)-7/2020.—हिमाचल प्रदेश के राज्यपाल, भू-सम्पदा (विनियमन और विकास) अधिनियम, 2016 (2016 का अधिनियम संख्यांक 16) की धारा 75 के 30—राजपत्र/2022-10-05-2022 (925)926 राजपत्र, हिमाचल प्रदेश, 10 मई 2022/20 वैशाख, 1944 साथ पठित धारा 84 की उप-धारा (2) के खण्ड (य च ) द्वारा प्रदत शक्तियों का प्रयोग करते हुए, "हिमाचल प्रदेश भू-सम्पदा विनियमन निधि" के गठन के लिए निम्नलिखित नियम बनाते है; अर्थात्:—

1. संक्षिप्त नाम और प्रारम्भ.—(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश भू- सम्पदा भू-सम्पदा विनियमन निधि का गठन और लागू करने की रीति नियम, 2022 है I (2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत होंगे I 2. परिभाषाएं.—इन नियमों में, जब तक कि सन्दर्भ से अन्यथा अपेक्षित हो.—

(क) "अधिनियम" से, भू-सम्पदा (विनियमन और विकास) अधिनियम, 2016 अभिप्रेत है;

(ख) "लेखा अवधि" से, वह अवधि अभिप्रेत है – जिसके लिए प्राधिकरण द्वारा लेखों को तैयार किया जाना है जो वित्तीय वर्ष के समवर्ती होगी ;

(ग) "आहरण और संवितरण अधिकारी (डी०डी०ओ०)" से, प्राधिकरण द्वारा प्राधिकृ त अधिकारी या प्राधिकरण की ओर से निधि से धन निकालने और प्राधिकृ त भुगतान करने के लिए अधिनियम की धारा 75 की उपधारा (3) के उपबंधों के अनुसार गठित समिति, अभिप्रेत है;

(घ) "(cid:7390)य" से, अधिनियम के अधीन अपने कृ त्यों के निर्वहन में प्राधिकरण द्वारा उपगत किया जाने वाला (cid:7390)य अभिप्रेत है;

(ङ) "कर्मचारी" से, प्राधिकरण के कर्मचारी अभिप्रेत है; (च) "निधि" से, अधिनियम की धारा 75 की उपधारा (1) के उपबंधों के अनुसार गठित की जाने वाली हिमाचल प्रदेश भू-सम्पदा विनियामक निधि अभिप्रेत है;

(छ) "वित्तीय वर्ष" से, किसी वर्ष के 01 अप्रैल से आरम्भ होने वाले और आगामी वर्ष के 31 मार्च को समाप्त होने वाले वारह कै लेंडर मॉस से अनधिक अवधि, अभिप्रेत है;

(ज) "सरकार" से, हिमाचल प्रदेश सरकार अभिप्रेत है; और (झ) "पारिर्शमिक" से, प्राधिकरण के अध्यक्ष, सदस्यों और अधिकारियों तथा कर्मचारियों को संदत्त किया जाने वाला पारिर्शमिक, अभिप्रेत है I

(2) इन शब्दों और पदों के , जो इन नियमों में प्रयुक्त हैं और इन में परिभाषित नह(cid:7277) हैं, किन्तु अधिनियम में परिभाषित हैं, के वही अर्थ होंगे जो कर्मश: अधिनियम में हैं I

3. निधि का गठन.—(1) सरकार, अधिनियम की धारा 75 की उपधारा (1) के उपबंधों के अनुसार एतदद्वारा हिमाचल प्रदेश भू-सम्पदा विनियामक निधि के नाम से ज्ञात एक निधि का गठन करेगी I

(2) निधि में निम्नलिखित सम्मिलित होगा.—

(क) प्राधिकरण द्वारा प्राप्त सभी सरकारी अनुदान;

(ख) अधिनियम के अधीन प्राधिकरण द्वारा प्राप्त फीस; (ग) खण्ड (क) और (ख) में निदिष्ट रकमों पर प्रोद्भूत ब्याज I

4. निधि का उपयोजन.—निधि निम्नलिखित (cid:7390)यों को चुकाने के लिए उपयोजित की जाएगी:--

(i) अध्यक्ष, न्यायनिर्णायक अधिकारी को संदेय वेतन और भत्तों सहित प्राधिकरण और अपील अधिकरण के अधिकारियों और कर्मचारियों को संदेय वेतन और भतों तथा प्रशासनिक (cid:7390)य I प्राधिकरण के वल उन्ह(cid:7277) पदों के लिए (cid:7390)य का वहन करेगा जो अधिनियम (2016 का अधिनियम संख्यांक 16) की धारा 28 के अधीन हिमाचल प्रदेश सरकार द्वारा अनुमोदित किए गए हैं I

(ii) प्राधिकरण द्वारा गठित सलाहकार समिति के सदस्यों को संदत्त किया जाने वाला मानदेय I

(iii) प्रशासनिक और सामान्य (cid:7390)य I

(iv) कार्यालय परिसरों की मरम्मत और रखरखाव और अनुमोदित मानदंडो के अनुसार भाड़े पर परिसरों को लेने के लिए किराया आदि का संदाय I

(v) परामर्शी कार्य पर (cid:7390)य I

(vi) विधिक (cid:7390)य, जिसमें प्राधिकरण द्वारा नियुक्त अधिवक्ताओं को फीस का संदाय भी सम्मिलित है I

(vii) कर्मचारिवृन्द को ऋण और अगिर्म I

(viii) कर्मचारिवृन्द कल्याण उपायों में अभिदाय I

(ix) कानूनी जमा I

(x) परिसंपत्तियों और अन्य पू ंजीगत मदों आदि की खरीद (र्कय) I

(xi) प्राधिकरण के लेखों की संपरीक्षा के लिए फीस I

(xii)अधिनियम की धारा 34 और 35 के अधीन अपने कृ त्यों के निर्वहन में प्राधिकरण के (cid:7390)य I

(xiii) विविध और अन्य (cid:7390)य I

5. निधि की संर्किया.—(1) निधि को ऐसे सदस्यों की समिति के माध्यम से प्राधिकरण द्वारा प्रशासित किया जायेगा, जैसा की अध्यक्ष द्वारा अवधारित किए जाएँ I928 राजपत्र, हिमाचल प्रदेश, 10 मई 2022/20 वैशाख, 1944 (2) बजट उपबंधों के अधीन सरकार द्वारा आवंटित अनुदानों को उप-नियम (1) के अधीन गठित समिति के आहरण और संवितरण अधिकारी द्वारा निधि में आहरित एवं जमा करने की (cid:7390)वस्था की जाएगी I

(3) प्राप्त समस्त निधियां बैंक में प्राधिकरण के खाते में जमा की जाएगी और समिति द्वारा प्राधिकृ त अधिकारियों द्वारा अनुमोदन के सिवाय आहरित नह(cid:7277) की जाएगी I

(4) पदाभिहित अधिकारी, प्राधिकरण द्वारा गठित समिति की ओर से प्राप्तियों के समुचित सं(cid:7390)व्दारों और संदायों के लिए उत्तरदायी होगा I

6. निधि का बंद होना.--(1) जब तक अधिनियम के सुसंगत उपबंध प्रवृत रहेंगे, निधि तब तक प्रवर्तनशील रहेगी I

(2) निधि के अधीन शेष अतिशेष या जब निधि की आवश्यकता नह(cid:7277) रह जाती है तब निधि के बंद होने की तारीख से तीन मास के भीतर उसका सरकारी लेखा (खाते) में परिहार कर दिया जायेगा I

NOTIFICATION

Shimla-2, the 7th May, 2022

No. HSG-A(3)-7/2020.—In exercise of powers conferred by clause (zf) of sub-section (2) of section 84 read with section 75 of the Real Estate (Regulation and Development) Act (Act No. 16 of 2016) the Governor, Himachal Pradesh, is pleased to make the following rules for the constitution of the "Himachal Pradesh Real Estate Regulatory Fund", namely:—

1. Short title and commencement.—(1) These rules may be called the constitution and manner of application of "Himachal Pradesh Real Estate Regulatory Fund Rules, 2022.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Definitions.—In these rules, unless the context otherwise requires,—

(a) "Act" means the Real Estate (Regulation and Development) Act, 2016;

prepared by the Authority and shall be concurrent with the Financial Year;

(c) "Drawing and Disbursing Officer" (DDO) means officer authorized by the Authority or the committee constituted as per the provisions of sub-section (3) of section 75 of the Act to draw money from the Fund and make authorized payments on behalf of the Authority;

(d) "expenses" means the expenses to be incurred by the Authority in the discharge of its functions under the Act;

(e) "employees" means the employees of the Authority;

(f) "Fund" means the Himachal Pradesh Real Estate Regulatory Fund to be constituted as per provisions of sub-section (1) of section 75 of the Act; (g) "Financial Year" means a period not exceeding twelve calendar months commencing from 1st April of a year and concluding on 31st March of the next year;

(h) "Government" means the Government of Himachal Pradesh; and

(i) "Remuneration" means the remuneration to be paid to the Chairperson, Members, and Officers and employees of the Authority;

(2) Words or expressions used in these rules and not defined herein but defined in the Act shall have the same meaning(s) as respectively assigned to them in the Act. 3. Constitution of Fund.—(1)The Government hereby constitutes a Fund to be called the Himachal Pradesh Real Estate Regulatory Fund in terms of the provisions of sub-section (1) of section 75 of the Act.

(2) The Fund shall comprise of,—

(a) all Government grants received by the authority;

(b) fees received by the Authority under the Act;

(c) the interest accrued on the amounts referred to in clause (a) and (b).

4. Application of Fund.—The fund shall be applied for meeting the following expenses:—

(i) The salaries and allowances payable to the Chairperson, Members, the Adjudicating Officer and the administrative expenses including the salaries and allowances payable to the officers and other employees of the Authority and the Appellate Tribunal. The Authority will meet expenditure for only those posts which are approved by the Government of Himachal Pradesh under section 28 of the Act (Act No. 16 of 2016).

(ii) Honorarium to be paid to the members of Advisory Committee constituted by the Authority.

(iii) Administrative and general expenses.

(v) Consultancy expenditure.

(vi) Legal expenses, which include the payment of fees to the counsels engaged by the Authority.

(vii) Loans and advances to the staff.

(viii) Contribution to staff welfare measures.

(ix) Statutory deposits.

(x) Purchase of assets and other capital items, etc.

(xi) Fees for the audit of the accounts of the Authority.

(xii) The expenses of the Authority in discharge of its functions under section 34 and 35 of the Act.

(xiii) Miscellaneous and other expenses.

5. Operation of the Fund.—(1)The Fund shall be administered by the Authority through a committee of such members as may be determined by the Chairperson.

(2) The grants allocated by the Government under budgetary provisions shall be arranged to be drawn and deposited into the Fund by the Drawing and Disbursing Officer of the committee constituted under sub-rule (1).

(3) All funds received shall be deposited into the Authority's account in the bank and shall not be withdrawn except on approval by the officers authorized by the committee.

(4) The officer designated shall be responsible for monitoring the proper transactions of receipts and payments on behalf of the committee constituted by the Authority.

6. Closure of Fund.—(1) The Fund shall remain operational as long as the relevant provisions of the Act remain in force.

(2) The remaining balance under the fund or when the fund is no longer required shall be remitted into the Government Account within three months from the date of closure of the fund.

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) की धारा 6 और रजिस्ट्रीकरण अधिनियम, 1908 (1908 का अधिनियम संख्यांक 16) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित पटवार वृत्तों से समाविष्ट उप-तहसील उदयपुर, जिला लाहौल एवं स्पिति, हिमाचल प्रदेश का दर्जा बढ़ाकर तहसील का दर्जा प्रदान करते हैंः--
