No. HPERC/151/Vol-III.—In exercise of the powers conferred by sub-section (1) of section 92 and clause (zl) of sub-section (2) of section 181 of the Electricity Act, 2003 (36 of1170 राजपत्र, हिमाचल प्रदेश, 21 मई 2022/31 वैशाख, 1944 2003), read with section 21 of the General Clauses Act, 1897(10 of 1897), and all other powers enabling it in this behalf as contained in the Electricity Act,2003 and any other law for the present being in force, the Himachal Pradesh Electricity Regulatory Commission proposes to make the following draft regulations further to amend the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) Regulations, 2005, published in the Rajpatra, Himachal Pradesh (Extraordinary), dated 14th January, 2005 and as required by sub-section (3) of section 181 of the said Act and rule 3 of the Electricity (Procedure for Previous Publication) Rules, 2005, the said draft regulations are hereby published for the information of all the persons likely to be affected thereby; and notice is hereby given that the said draft regulations will be taken into consideration, after the expiry of thirty days from the date of their publication in the Rajpatra, Himachal Pradesh, together with any objections or suggestions which may within the aforesaid period be received in respect thereto.

DRAFT REGULATIONS

1. Short title and commencement.—(1) These regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) (Twelfth Amendment) Regulations, 2022.

(2) These regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of the Schedule.—In the Schedule i.e. "Fee Structure" annexed to the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) Regulations, 2005—

संख्या जीएडी-ई-डी(6)-1/2021.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश लोकतन्त्र प्रहरी सम्मान अधिनियम, 2021 (2021 का अधिनियम संख्यांक 5) की धारा 10 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः- 1. संक्षिप्त नाम.--इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश लोकतन्त्र प्रहरी सम्मान नियम, 2022 है।

2. परिभाषाएं.--(1) इन नियमों में जब तक कि कोई बात विषय या संदर्भ के विरूद्ध न हो,- (क) ''अधिनियम'' से, हिमाचल प्रदेश लोकतन्त्र प्रहरी सम्मान अधिनियम, 2021 अभिप्रेत है;

(ख) ''प्ररूप'' से, इन नियमों से संलग्न प्ररूप अभिप्रेत है; और

(ग) ''प्रमाण-पत्र'' से, जेल या पुलिस थाना में निरूद्ध रहने का प्रमाण-पत्र अभिप्रेत है।

(2) शब्दों और पदों के जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं है, के वही अर्थ होंगे जो क्रमशः अधिनियम में उनके हैं।

3. सम्मान राशि की रकम और सम्मान राशि प्राप्त करने के लिए पात्रता.--(1) लोकतन्त्र प्रहरी को सम्मानित करने के लिए प्रदान की जाने वाली सम्मान राशि और सम्मान राशि को प्राप्त करने के लिए निरूद्ध रहने की उपयुक्त अवधि ऐसी होगी जैसी राज्य सरकार द्वारा अधिसूचित की जाएः

परन्तु यदि लोकतन्त्र प्रहरी के निरूद्ध रहने की अवधि से सम्बन्धित अभिलेख उपलब्ध नहीं है या अपर्याप्त है तो वह किन्हीं दो लोकतन्त्र प्रहरियों, जिनके अपने अभिलेख हैं, द्वारा सम्यक रूप से सत्यापित विहित प्ररूप-1 में प्रमाण-पत्र को प्रस्तुत करने के पश्चात्‌ सम्मान राशि प्राप्त करने के लिए पात्र होगा।

(2) मृतक लोकतन्त्र प्रहरी के पति या पत्नी सम्मान राशि की समस्त राशि प्राप्त करने के लिए पात्र होंगेः

परन्तु उसे लोकतन्त्र प्रहरी की मृत्यु की तारीख से दो मास के भीतर प्ररूप-2 में सामान्य प्रशासन विभाग के प्रशासनिक सचिव को आवेदन करना होगा, यदि लोकतन्त्र प्रहरी की मृत्यु इस अधिनियम के प्रारम्भ के पश्चात्‌ हुई है। यदि लोकतन्त्र प्रहरी के पति या पत्नी दो मास की विहित समय सीमा के पश्चात्‌ आवेदन करते हैं तो उसे सम्मान राशि नियम 5 के अधीन गठित समिति द्वारा की गई सिफारिश की तारीख से संदत्त की जाएगीः

परन्तु यदि लोकतन्त्र प्रहरी की मृत्यु हो चुकी है और उसे सम्मान राशि स्वीकृत नहीं की गई थी तो लोकतन्त्र प्रहरी के पति या पत्नी को प्रशासनिक सचिव (सामान्य प्रशासन विभाग), हिमाचल प्रदेश सरकार को आवेदन करना होगा।

(3) कोई भी लोकतन्त्र प्रहरी जो उपरोक्त नियम 3(1) के अधीन विनिर्दिष्ट सम्मान राशि की तुलना में अन्य राज्यों से कम सम्मान राशि/पेंशन प्राप्त कर रहा है तो वह ऐसी विनिर्दिष्ट सम्मान राशि की अन्तर रकम को प्राप्त करने के लिए पात्र होगा। 1172 राजपत्र, हिमाचल प्रदेश, 21 मई 2022/31 वैशाख, 1944 4. आवेदन प्रस्तुत करना.--आवेदक सम्मान राशि स्वीकृत करने के लिए समस्त विशिष्टियों को विनिर्दिष्ट करते हुए प्ररूप-3 में सामान्य प्रशासन विभाग के प्रशासनिक सचिव को आवेदन करेगा। वह प्ररूप-4 में अपेक्षित ब्यौरे विनिर्दिष्ट करते हुए शपथ-पत्र भी प्रस्तुत करेगा।

5. सम्मान राशि की सिफारिश/स्वीकृत करने की प्रक्रिया.--(1) निम्नलिखित समिति सम्मान राशि स्वीकृत करने के लिए प्राप्त आवेदनों की संवीक्षा करने के पश्चात्‌ आवेदक की पात्रता या अपात्रता के बारे में सिफारिश करेगीः-

1. श्री सुरेश भारद्वाज - अध्यक्ष; माननीय शहरी विकास मन्त्री, हिमाचल प्रदेश

2. श्री प्रवीण शर्मा - सदस्य; भूतपूर्व मन्त्री, हिमाचल प्रदेश

3. श्री विजय सिंह कंवर, - सदस्य; गाँव लोअर बढेड़ा, डाकघर बढेड़ा, तहसील हरोली, जिला ऊना, हिमाचल प्रदेश

4. श्री सुनील मनोचा - सदस्य; और कोतवाली बाजार, धर्मशाला, जिला कांगड़ा, हिमाचल प्रदेश

5. सचिव (सामान्य प्रशासन विभाग), - सदस्य-सचिव । हिमाचल प्रदेश सरकार।

(2) उपरोक्त उपनियम (1) के अधीन विनिर्दिष्ट समिति किसी आवेदन को स्वप्रेरणा से स्वीकार कर सकेगी और इसे सम्मान राशि प्राप्त करने के लिए संस्तुत कर सकेगी। समिति सम्मान राशि से सम्बन्धित किसी भी रूप रेखा को तैयार करने के लिए सक्षम होगी।

(3) समिति की सिफारिश के पश्चात्‌ स्वीकृत सम्मान राशि समिति की सिफारिश की तारीख से संदेय होगी।

(4) समिति की सिफारिशों के आधार पर सम्मान राशि को स्वीकृत करने या अस्वीकृत करने का आदेश प्रशासनिक सचिव, सामान्य प्रशासन विभाग, हिमाचल प्रदेश सरकार के द्वारा जारी किया जाएगा। 6. सम्मान राशि का संदाय.--(1) सम्मान राशि किसी राष्ट्रीयकृत बैंक/हिमाचल प्रदेश राज्य के सहकारी बैंक के माध्यम से संदेय होगी जिसके लिए हिताधिकारी को आधार आधारित बैंक खाता खोलना होगा और इसका ब्यौरा सामान्य प्रशासन विभाग को विहित प्ररूप पर देना होगा।

(2) सरकारी पेंशनधारकों को लागू ट्रेजरी कोड और नियमों के उपबन्ध यथा अपेक्षित आवश्यक परिवर्तनों सहित सम्मान राशि के प्राप्तकर्ताओं को भी लागू होंगे।

(3) सम्मान राशि के हिताधिकारी को प्रत्येक वर्ष अप्रैल मास में सामान्य प्रशासन विभाग को सम्बद्ध पंचायत प्रधान/तहसीलदार द्वारा सम्यक्‌ रूप से सत्यापित जीवन प्रमाण-पत्र (लाईफ सर्टिफिकेट) प्रस्तुत करना होगा। जीवन प्रमाण-पत्र प्रस्तुत न किए जाने की दशा में हिताधिकारी की सम्मान राशि बिना किसी सूचना के रोक दी जाएगी।1173 राजपत्र, हिमाचल प्रदेश, 21 मई 2022/31 वैशाख, 1944 (4) यदि सम्मान राशि प्राप्तकर्त्ता की मृत्यु हो जाती है तो हिताधिकारी के कुटुम्ब/विधिक वारिसों के लिए, सामान्य प्रशासन विभाग को इस सम्बन्ध में मृत्यु प्रमाण पत्र की प्रति के साथ-साथ सूचना देना और मृतक हिताधिकारी को प्रदान की गई अधिक सम्मान राशि को एकमुश्त राज्य सरकार को लौटाना अनिवार्य होगा।

(5) इसके मद्‌दे व्यय मुख्य शीर्ष 2235- सामाजिक सुरक्षा और कल्याण 60-अन्य सामाजिक सुरक्षा और कल्याण कार्यक्रम, 200-अन्य कार्यक्रम, 27-हिमाचल प्रदेश लोकतन्त्र प्रहरी सम्मान राशि राज्य स्कीम ''अन्य प्रभार'' (गैर-योजना) से किया जाएगा।

7. कपटपूर्वक प्राप्त सम्मान राशि का रद्‌दकरण/वसूली.--यदि कोई व्यक्ति सम्मान राशि प्राप्त करने के लिए पात्रता न होने के बाबजूद भी मिथ्या सूचना या मिथ्या दस्तावेजों के आधार पर सम्मान राशि प्राप्त करता है, तो ऐसी स्थिति में, ऐसे व्यक्ति की सम्मान राशि रद्‌द कर दी जाएगी और पूर्व में प्राप्त की गई सम्मान राशि उसके द्वारा एकमुश्त राज्य सरकार को निक्षिप्त/वापस की जाएगी। यदि सम्मान राशि सम्बद्ध व्यक्ति द्वारा निक्षिप्त/वापस नहीं की जाती है तो उससे ऐसी राशि भू-राजस्व के बकाया के रूप में वसूलीय होगी।

No. GAD-E-D(6)-1/2021.—In exercise of powers conferred by section 10 of the Himachal Pradesh Loktantra Prahri Samman Act, 2021 (Act No. 5 of 2021), the Governor of Himachal Pradesh is pleased to make the following rules for carrying out the purposes of the said Act, namely:—

1. Short title.—These rules may be called the Himachal Pradesh Loktantra Prahri Samman Rules, 2022.

2. Definition.—(1) In these rules, unless there is anything repugnant in the subject or context,—

(a) "Act" means the Himachal Pradesh Loktantra Prahri Samman Act, 2021;

(b) "Form" means the Form appended to these rules; and

(c) "Certificate" means the Certificate of detention in jail or in police station.

(2) words and expressions used in these rules but not defined shall have the meanings respectively assigned to them in the Act.

3. Amount of Samman Rashi and eligibility for receiving Samman Rashi.—(1) The Samman Rashi awarded to honour the Loktantra Prahri and the eligible period of detention for receiving the Samman Rashi shall be such as may be notified by the State Government :

Provided that in case, the record relating to detention period of the Loktantra Prahri is not available or is incomplete, then he will be eligible to receive Samman Rashi after production of1177 राजपत्र, हिमाचल प्रदेश, 21 मई 2022/31 वैशाख, 1944 certificate on the prescribed FORM-I duly verified by any two Loktantra Prahris, who have their own record.

(2) The spouse of the deceased Loktantra Prahri will be eligible to receive full amount of samman rashi:

Provided that he/she will have to apply in FORM-II to the Administrative Secretary in the General Administration Department within two months from the date of death of the Loktantra Prahri if the Loktantra Prahri has died after the commencement of Act. In case, the spouse of the Loktantra Prahri apply after the prescribed time limit of two months, then, the samman rashi will be payable to him/her from the date of recommendation made by the Committee constituted under rule 5:

Provided that in case, the Loktantra Prahri had been deceased and samman rashi was not sanctioned to him/her, then, the spouse of the deceased Loktantra Prahri shall have to apply to the Administrative Secretary (General Administration Department), Government of Himachal Pradesh.

(3) Any Loktantra Prahri, who is receiving less Samman Rashi/ pension from other States in comparison to the Samman Rashi specified under rule 3(1) supra, shall be eligible to receive the difference amount of such specified Samman Rashi.

4. Submission of application.—The applicant shall apply to the Administrative Secretary in the General Administration Department in FORM-III specifying all particulars to sanction the Samman Rashi. He/she will also furnish an affidavit on FORM-IV specifying therein the requisite details.

5. Procedure of recommendation/sanctioning Samman Rashi.—(1) The following Committee will recommend about eligibility or non-eligibility of the applicant after scrutinizing the applications received for sanctioning samman rashi:—

1. Shri Suresh Bhardwaj, – Chairperson Hon'ble Urban Development Minister, Himachal Pradesh.

2. Shri Praveen Sharma, – Member Ex-Minister, Himachal Pradesh.

3. Shri Vijay Singh Kanwar, – Member Village Lower Badheda, Post Office Badheda, Tehsil Haroli, District Una, Himachal Pradesh.

4. Shri Suneel Manocha, – Member Kotwali Bazaar, Dharamshala, District Kangra, Himachal Pradesh.

5. Secretary (GAD) to the – Member Secretary Government of Himachal Pradesh.

(2) The Committee specified under sub-rule(1) supra, may suo-motu accept any application and recommend same for samman rashi. The Committee shall also be competent to devise any modality regarding Samman Rashi.

(3) The Samman Rashi sanctioned after the recommendation of the Committee will be payable from the date of recommendation of the Committee.

(4) On the basis of Committee's recommendation, the sanction or rejection order of Samman Rashi shall be issued by the Administrative Secretary, General Administration Department, Government of Himachal Pradesh.

6. Payment of Samman Rashi.—(1) The Samman Rashi shall be payable through any nationalized bank/co-operative bank of the State of Himachal Pradesh for which the beneficiary will have to open the Aadhar based bank account and to provide its detail on the prescribed form to the General Administration Department.

(2) The provisions of treasury code and rules applicable on the Government pensioners shall also be applicable on the recipients of Samman Rashi with necessary changes as required.

(3) The beneficiary of Samman Rashi will have to submit the life certificate duly attested by the concerned Panchayat Pradhan/ Tehsildar in the month of April in each year to the General Administration Department. In case of non-submission of the life certificate, the Samman Rashi of the beneficiary will be stopped without any intimation.

(4) In case of the death of Samman Rashi recipient, it will be mandatory for the family/legal heir of the beneficiary to give intimation to the General Administration Department alongwith a copy of death certificate in this regard and to return the excess Samman Rashi granted to the deceased beneficiary in lump-sum to the State Government.

(5) The expenditure on this account will be debited to the Major Head 2235—Social Security and Welfare, 60—Other Social Security and Welfare Programmes, 200—Other Programmes, 27—Himachal Pradesh Loktantra Prahri Samman Rashi State Scheme "other charges" (Non-Plan).

7. Cancellation/recovery of Samman Rashi obtained fraudulanty.—If any person receives the Samman Rashi on the basis of false information or documents despite not having the eligibility for receiving Samman Rashi, then in such a situation, the Samman Rashi of such person will be cancelled and Samman Rashi received in the past shall be deposited/returned in lump-sum to the State Government by him. In case, the Samman Rashi is not deposited/ returned by the concerned person, then the same will be recoverable from him as arrears of land revenue.
