संख्याः श्रम (ए)3-9/2021-लूज़.-हिमाचल प्रदेश के राज्यपाल, भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्त विनियमन) अधिनियम 1996 की धारा 18 के साथ पठित धारा 40 और 62 द्वारा1351 राजपत्र, हिमाचल प्रदेश, 27 मई 2022/6 ज्येष्ठ, 1944 प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम की धारा 5 के अधीन गठित विशेषज्ञ समिति के परामर्श के पश्चात्‌ इस विभाग की अधिसूचना संख्याः श्रम (ए)4-6/2007-बी.ओ.सी.डब्ल्यू, तारीख 4 दिसम्बर, 2008 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 8 दिसम्बर, 2008 को प्रकाशित हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्तें विनियमन) नियम, 2008 का और संशोधन करने हेतु निम्नलिखित नियम बनाते हैं, अर्थातः-

1. संक्षिप्त नाम और प्रारम्भ.-(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्तें विनियमन) प्रथम संशोधन, नियम, 2022 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 251 का संशोधन.--हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा शर्तें विनियमन) नियम, 2008 के नियम 251 के उपनियम (2) के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

''(2) बोर्ड के शासकीय सदस्यों से अन्यथा अध्यक्ष और सदस्यों की पदावधि उनकी नियुक्ति की तारीख से तीन वर्ष की होगीः

परन्तु राज्य सरकार अध्यक्ष या इसके द्वारा नियुक्त किसी सदस्य को किसी भी समय हटा सकेगी।''। आदेश द्वारा, हस्ताक्षरित/- अतिरिक्त मुख्य सचिव (श्रम एवं रोजगार)

No. Shram(A)3-9/2021-Loose.—In exercise of powers conferred by section 40 and 62 read with section 18 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, the Governor, Himachal Pradesh, after consultation with the expert committee, constituted under section 5 of the said Act is pleased to make the following rules further to amend the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008, notified vide this Department's Notification No. Shram(A)4-6/2007-BOCW, dated 4th December, 2008 and published in the Rajpatra, Himachal Pradesh, dated 8th December, 2008, namely:—

1. Short-title and commencement.—(1) These rules may be called the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) First Amendment Rules, 2022.

2. Amendment of rule 251.—For sub-rule (2) of rule 251 of the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008, the following shall be substituted, namely:—

"(2) The term of the office of the Chairperson and the members of the Board other than the official members shall be three years from the date of their appointment:

Provided that the State Government may remove Chairperson or any member appointed by it at any time.".
