संख्याः आर.डी.(जी)1-3/2022.—हिमाचल प्रदेश के राज्यपाल, जिला कांगड़ा के वर्तमान विकास खण्ड, देहरा को विभाजित/पुनर्गठित करके नया विकास खण्ड, खुन्डियां में खोलने की स्वीकृृति जनहित में निम्न प्रकार से सहर्ष प्रदान करते हैंः--

जब तक पंचायत समिति की 5 वर्ष की अवधि पूर्ण नहीं हो जाती तब तक नव सृजित विकास खण्ड खुन्डियां की 20 ग्राम पंचायतों के पंचायत समिति सदस्य, पंचायत समिति देहरा के अन्तर्गत ही रहेंगे। नव सृजित विकास खण्ड खुन्डियां के लिए निम्न पदों के सृजन की भी स्वीकृति प्रदान की जाती हैः-

क्रमांक संख्या 1 से 9 व 11 से 13 पर अंकित सृजित पदों का वेतन मुख्य शीर्ष 2515-00- 102-01-सून (CD) of RD Non Plan तथा क्रमांक 10 की नियुक्ति अनुबन्ध आधार पर मनरेगा कार्यक्रम के प्रशासनिक मद में से ग्रामीण विकास विभाग की अधिसूचना संख्या एस0एम0आई0-9/99-2007- आर0डी0डी0 दिनांक 14-09-2007 द्वारा जारी नीति व दिशा-निर्देशों तथा अधिसूचना संख्या आर0 डी0डी0- 111-बी(15)4/2013-Vol-V-5594-5769, दिनांक 9-10-2017 के अनुसार वहन किया जाएगा। 1562 राजपत्र, हिमाचल प्रदेश, 01 जून 2022/11 ज्येष्ठ, 1944 इसके अतिरिक्त नव सृजित विकास खण्ड खुन्डियां का कार्यालय भवन लोक निर्माण विभाग के अनुसार निर्धारित मापदण्डों के अनुसार किराये पर लिया जाए।

No. HHC/Rules/Vol.V./97-II.—In exercise of the powers conferred by Section 23 of the State of Himachal Pradesh Act, 1970 read with Section 129 of the Code of Civil Procedure, 1908,1563 राजपत्र, हिमाचल प्रदेश, 01 जून 2022/11 ज्येष्ठ, 1944 Article 225 of the Constitution of India and all other powers enabling in this behalf, the High Court of Himachal Pradesh is pleased to make following amendments in the High Court of Himachal Pradesh (Original Side) Rules, 1997, as under:—

1. Short Title.—These Rules shall be called the High Court of Himachal Pradesh (Original Side) 15th amendment Rules, 2022.

2. Commencement .—These Rules shall come into force with immediate effect.

3. Amendment (S).—In Chapter-II Rule 3 "Powers of Registrar" Sub-Rule(38) shall be inserted as under:

(38) Recording of evidence in Civil Suit, COMS and any other ancillary proceeding, however, any objection raised with respect to admissibility, relevancy and/or mode of proof etc. shall be recorded by the Registrar in evidence, and the same shall be considered and decided by the Court, either on reference by Registrar or at the time of final hearing depending upon urgency and necessity.

1. Short Title .—These Rules shall be called the High Court of Himachal Pradesh (Appellate Side) 10th Amendment Rules-2022.

2. Commencement .—These Rules shall come into force with immediate effect.

3. Amendment(s).—In Chapter-4, Rule 1 "Powers delegated in the Registrar in Criminal cases", Sub-Rules(xvii) (xviii) and (xix) shall be inserted as under:

(xvii) To decide uncontested applications for orders for payment of money realised in execution or otherwise deposited in Court including uncontested applications to share the assets realised under Section 73 of the Code;

(xviii) To decide applications under Section 52 of the Code or Order XXII of the Code for bringing on record the Legal Representatives of a deceased party:

Provided that no order of substitution or revival shall be made by the Registrar1564 राजपत्र, हिमाचल प्रदेश, 01 जून 2022/11 ज्येष्ठ, 1944 (i) where a question arises as to whether any person is or is not a legal representative of the deceased party, or (ii) where a question of setting aside the abatement of the cause is involved:

In such a case the Registrar shall after making an inquiry place the matter with his report and the findings before the Judge in the Chambers.

(xix) To record evidence/additional evidence in appeals and any other ancillary proceeding however any objection raised with respect to admissibility, relevancy and/or mode of proof etc. shall be recorded by the Registrar in evidence, and the same shall be considered and decided by the Court, either on reference by Registrar or at the time of final hearing depending upon urgency and necessity.

शिमला-2, 31 मई, 2022

संख्याः रैव-बी-ए(3)-9/2021.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश आबादी देह (अधिकारों-अभिलेख) अधिनियम, 2021 की धारा 29 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाते हैं; अर्थात्‌ः-

1. स्ांक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश आबादी देह (अधिकारों-अभिलेख) नियम, 2022 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. परिभाषाएंं.--(1) इन नियमों में जब तक संदर्भ से अन्यथा अपेक्षित न हो,-

(क) "अधिनियम" से हिमाचल प्रदेश आबादी देह (अधिकारों-अभिलेख) अधिनियम, 2021 अभिप्रेत है;

(ख) "क्षेत्र पुस्तक" (फील्ड बुक) से प्ररूप-"क" में अनुरक्षित पुस्तक अभिप्रेत है और यह स्थायी अधिकारों के अभिलेख का हिस्सा होगी;

(ग) "प्ररूप" से इन नियमों से संलग्न प्ररूप अभिप्रेत है;

(घ) "धारा" से अधिनियम की धारा अभिप्रेत है; और

(ङ) "उप-विभाजित सर्वेक्षण इकाई" से सर्वेक्षण इकाई का कोई भाग अभिप्रेत है जो एक पृथक इकाई बनाता है और जो प्रमुख (मूल) संख्या के अंश द्वारा संख्याकित की गई है।

(2) उन शब्दों और पदों के जोड़ इसमें प्रयुक्त हैं और परिभाषित नहीं है किन्तु अधिनियम में परिभाषित किए गए हैं के वही अर्थ होंगे जो अधिनियम में क्रमशः उनके हैं।1565 राजपत्र, हिमाचल प्रदेश, 01 जून 2022/11 ज्येष्ठ, 1944 3. सर्वेक्षण अधिकारी और सहायक सर्वेक्षण अधिकारी की नियुक्ति.--राजस्व विभाग के अधीन कार्यरत कानूनगो और पटवारी अधिनियम के अधीन ऐसे अधिकारियों के कृत्यों का निर्वहन करने हेतु क्रमशः सर्वेक्षण अधिकारी और सहायक सर्वेक्षण अधिकारी होंगे।

(2) अधिनियम की धारा 6 की उप-धारा (2) के अधीन उपबंधित किन्हीं कार्यों और कृत्यों का जब किसी अधिसूचित अभिकरण द्वारा निर्वहन किया जाता है तो ऐसा अभिकरण इस प्रकार किए गए कार्यों और कृत्यों के लिए सर्वेक्षण अधिकारी समझा जाएगा।

(3) मुख्य अभिलेखन और समाधान अधिकारी एक से अधिक ऐसे सर्वेक्षण अधिकारी और सहायक सर्वेक्षण अधिकारी नियुक्त कर सकेगा, जैसे प्रत्येक आबादी के लिए अपेक्षित हों।

(4) यदि किसी आबादी देह के लिए एक से अधिक सर्वेक्षण अधिकारी और सहायक सर्वेक्षण अधिकारी नियुक्त किए गए हैं तो मुख्य अभिलेखन और समाधान अधिकारी आबादी देह का क्षेत्र विनिर्दिष्ट करेगा जिसके लिए ऐसे प्रत्येक सर्वेक्षण अधिकारी और सहायक सर्वेक्षण अधिकारी द्वारा सर्वेक्षण संचालित किया जाना है।

4. ग्रामीण समिति.--किसी आबादी के भीतर सामान्य प्रयोजनों के लिए निर्धारित सर्वेक्षण इकाइयों और सामान्य क्षेत्रों के स्वामित्व की पहचान करने के लिए सात से अनधिक सदस्यों से गठित ग्रामीण समिति को सहायक अभिलेखन और समाधान अधिकारी द्वारा निम्नलिखित रीति में नामनिर्दिष्ट किया जाएगाः- (क) किसी ग्राम की दशा में, ग्राम पंचायत का प्रधान या उसके नामनिर्देशिती के रूप में पंचायत का सम्बद्ध वार्ड सदस्य; और किसी शहरी स्थानीय निकाय की दशा में, महापौर या शहरी स्थानीय निकाय का अध्यक्ष या शहरी स्थानीय निकाय का सम्बद्ध पार्षद्‌ या वार्ड सदस्य;

(ख) ग्राम या नगरपालिका क्षेत्र का नम्बरदार जिसके स्थायी अधिकार-अभिलेख तैयार किए जाने हैं;

और

(ग) ग्राम या नगरपालिका निकाय की आबादी देह का कोई अन्य सम्मानीय निवासी जो उचित समझा जाएः

परन्तु ग्रामीण समिति में कम से कम एक महिला और अनुसूचित जाति प्रवर्ग से एक व्यक्ति सम्मिलित किया जाएगा।

5. माप.--अधिनियम और नियमों के प्रयोजनों के लिए माप की मूल इकाई मीटर प्रणाली में होगी और सर्वेक्षण इकाई का क्षेत्र वर्ग मीटर में भी वर्णित किया जाएगा।

6. स्थायी अधिकारों-अभिलेख को तैयार करने के लिए सर्वेक्षण इकाइयों की भूमि, आवास और निवास क्षेत्रों में प्रवेश.--(1) इस अधिनियम के अधीन कोई अधिकारी और उसके आदेशाधीन कार्य कर रहा कोई व्यक्ति अधिनियम के अधीन किसी कर्त्तव्य के निर्वहन में आबादी देह क्षेत्र के निवासियों को पूर्व नोटिस के पश्चात्‌ सर्वेक्षण इकाइयों की भूमि, आवास और निवास क्षेत्रों में प्रवेश कर सकेगा।

(2) सर्वेक्षण अधिकारी.--(i) ग्राम में घोषणा के द्वारा;

(ii) किसी राजस्व सम्पदा या किसी शहरी स्थानीय निकाय के आबादी देह में किसी सहजदृश्य स्थान पर नोटिस का चसपान करके; और

(iii) ग्राम पंचायत के प्रधान या शहरी स्थानीय निकाय के महापौर/अध्यक्ष/प्रधान को सूचना देकर सर्वेक्षण इकाइयों की सीमाओं, निशानदेही, माप लेने और संख्याओं की पहचान करने के प्रयोजन के लिए आबादी देह क्षेत्र में उसके आगमन की तारीख की सम्यक्‌ सूचना दे सकेगा और प्रचार कर सकेगा। 1566 राजपत्र, हिमाचल प्रदेश, 01 जून 2022/11 ज्येष्ठ, 1944 (3) सर्वेक्षण अधिकारी सर्वेक्षण के प्रयोजन के लिए.--(क) साधारण बैठक में निवासियों द्वारा अपनाई जाने वाली प्रक्रिया की व्याख्या करेगा;

(ख) अधिनियम की धारा 6 की उप-धारा (2) के अधीन तैयार किए गए नक्शे के आधार पर प्रत्येक सर्वेक्षण इकाई के क्षेत्र का माप लेगा, सीमाओं की निशानदेही और अभिलेखन करेगा तथा प्ररूप ''क'' में क्षेत्र पुस्तक (फील्ड बुक) में इन्हें अभिलिखित करेगा;

(ग) आबादी-देह में सर्वेक्षण इकाइयों की संख्या एक से प्रारम्भ करके अंकों में क्रमानुसार क्रमवर्ती रूप में संख्यांकित करेगा; और

(घ) सर्वेक्षण इकाई का प्रकार जैसे कि भवन, गली, दुकान, संस्थागत भवन, खुला क्षेत्र, सामान्य क्षेत्र और मार्ग वर्णित करेगा।

(4) सर्वेक्षण इकाई के क्षेत्र, सीमा और प्रकार को अवधारित करते हुए सर्वेक्षण अधिकारी हितबद्ध व्यक्ति द्वारा प्रस्तुत किए गए ऐसे दस्तावेज या लेखन पर विचार कर सकेगा जो सर्वेक्षण इकाई की सीमा, क्षेत्र या प्रकार को दर्शाता या अवधारित करता हो और उसके आधार पर माप सकेगा और अभिलेख तैयार कर सकेगा।

(5) सर्वेक्षण अधिकारी इस नियम के अधीन तैयार किए गए अभिलेख को प्ररूप-''क'' में क्षेत्र पुस्तक (फील्ड बुक) के साथ संकलित करेगा उसे सहायक अभिलेखन और समाधान अधिकारी को स्थायी अधिकारों-अभिलेख को तैयार करने हेतु प्रस्तुत करेगा।

7. स्वत्वधारियों के अधिकारों का अभिलेखन.--सहायक अभिलेखन और समाधान अधिकारी ग्रामीण समिति की सहायता से और हितबद्ध पक्षकारों को सुनने के पश्चात्‌,-

(i) किसी स्वत्वधारी या किसी हितबद्ध व्यक्ति द्वारा सर्वेक्षण इकाई में उसके दावे के समर्थन में प्रस्तुत किए गए ऐसे सुसंगत और तात्विक दस्तावेज या लेखन पर विचार करेगा जिसे वह न्यायसंगत और उचित समझे;

(ii) यदि किसी सर्वेक्षण इकाई को उपविभाजित किया गया पाया जाता है, तो उस सर्वेक्षण इकाई के उपविभाजित भाग को 1/1, 1/2, 1/3, 1/4; 2/1, 2/2, 2/3, 2/4; 1/1/1, 1/1/2, 1/1/3, 1/1/4 इत्यादि में ऐसे चिह्नित करेगा जैसे उपयुक्त और उचित समझा जाए और प्रत्येक उपविभाजित सर्वेक्षण इकाई के क्षेत्र का अभिलेखन करेगा; और

(iii) संक्षिप्त रीति में अभिलेख तैयार करेगा और प्ररूप-''ख'' में आबादी-देह क्षेत्र के किसी सहजदृश्य स्थान पर स्वत्वधारियों की प्रस्तावित प्रविष्टियों और सर्वेक्षण इकाइयों में उनके स्वत्वधारी अधिकारों तथा नियत दिवस को ऐसी उपविभाजित सर्वेक्षण इकाइयों को प्रदर्शित करेगा। 8. आक्षेपों का समाधान.--(1) नियम 6 के अधीन सर्वेक्षण इकाई द्वारा तैयार किया गया सीमाकंन, सीमा और क्षेत्रफल सहित सर्वेक्षण नक्शा और किसी सर्वेक्षण इकाई में आक्षेप, यदि कोई है/हैं; को आमन्त्रित करने के प्रयोजन के लिए नियम 7 के अधीन प्ररूप-''ख'' में स्वत्वधारियों की प्रविष्टियों का अभिलेख सहायक अभिलेखन और समाधान अधिकारी द्वारा गांव में किसी एक या एक से अधिक सहजदृश्य स्थान (स्थानों), जैसे, यथास्थिति, पंचायतघर, ग्राम सहकारिता सोसाइटी, पटवारखाना, धर्मशाला, सामुदायिक केन्द्र या ग्राम या शहरी स्थानीय निकायों में सामूहिक धार्मिक स्थानों (स्थलों) में प्रदर्शित किया जाएगा।

(2) उपरोक्त उप-नियम (1) के अधीन अभिलेख की प्रतियां किसी कृत्यकारी पदाधिकारी के माध्यम से अभिस्वीकृति के विरुद्ध ग्राम पंचायत के प्रधान या शहरी स्थानीय निकाय के मेयर/अध्यक्ष/प्रधान को दी जाएगी।

(3) अधिनियम की धारा 11 के अधीन फाइल किए गए आक्षेप, यदि कोई है/हैं, प्ररूप-''ग'' में सहायक अभिलेखन और समाधान अधिकारी के समक्ष फाइल किया जाएगा/किए जाएंगे।1567 राजपत्र, हिमाचल प्रदेश, 01 जून 2022/11 ज्येष्ठ, 1944 (4) प्राप्त हुए या फाइल किए गए आक्षेप (आक्षेपों) को इनकी प्राप्ति की तारीख सहित एक पृथक रजिस्टर में क्रमबद्ध क्रम में क्रमांकित किया जाएगा।

(5) धारा 11 की उप-धारा (1) के अधीन आक्षेपों के फाइल करने से तीस दिन की अवधि के अवसान पर सहायक अभिलेखन और समाधान अधिकारी प्राप्त हुए या फाइल किए गए आक्षेपों की संख्या को प्रमाणित करेगा और इस निमित्त अभिलेखन और समाधान अधिकारी को एक रिपोर्ट भेजेगा।

(6) सहायक अभिलेखन और समाधान अधिकारी आक्षेपों पर विचार करेगा और ऐसी जांच, जो यह उपयुक्त समझे, संचालित करेगा तथा प्रत्येक आक्षेप की बाबत धारा 11 की उप-धारा (2) के अधीन एक आख्यापक आदेश पारित करेगा।

(7) उपरोक्त उप-नियम (6) के अधीन आदेश पारित करते समय स्थलीय (क्षेत्र), सीमा या किसी सर्वेक्षण इकाई के आयाम में किया गया कोई सुधार या संशोधन सहायक अभिलेखन और समाधान अधिकारी द्वारा स्थलीय क्षेत्र पुस्तक (फील्ड बुक) में प्ररूप-''क'' में लाल स्याही से सम्मिलित किया जाएगा। 9. अधिकार-अभिलेख को अंतिम रूप दिया जाना.--(1) इन नियमों के नियम 7 के अधीन अभिलिखित प्रविष्टियों की बाबत यदि कोई आक्षेप नहीं है तो सहायक अभिलेखन और समाधान अधिकारी उसे प्ररूप ''घ'' में सर्वेक्षण इकाई के अधिकार-अभिलेख में सम्मिलित करेगा।

(2) इन नियमों के नियम 7 के अधीन प्रविष्टियों की बाबत आक्षेपों की दशा में सहायक अभिलेखन और समाधान अधिकारी प्रभावित पक्षकारों और सांपत्तिक अधिकारों, क्षेत्रफल, सीमा, आयामों या उप-विभाजन, यदि कोई है, के अभिलेखन की बाबत आक्षेपों के निपटान के पश्चात्‌ उसे परिनिर्धारित विनिश्चय के अनुसार प्ररूप-''घ'' में सर्वेक्षण इकाई के अभिलेख में सम्मिलित करेगा।

(3) स्थायी अधिकार-अभिलेख के शीर्षक में, इसके साथ "आबादी देह'' शब्द जोड़ कर राजस्व सम्पदा का हदबस्त नम्बर अन्तर्विष्ट होगा।

10. स्थायी अधिकार-अभिलेख का अंतरण और प्रेषण.--(1) धारा 11 की उप धारा (4) के अधीन यथा अंतिम रूप प्रदत्त स्थायी अधिकार-अभिलेख आबादी देह क्षेत्र में किसी सहजदृश्य स्थल पर प्रदर्शित किया जाएगा।

(2) उप नियम (1) के अधीन अभिलेख अधिनियम की धारा 15 के अधीन जिला क्लक्टर को अंतरित किया जाएगा तथा जिला कार्यालय में अभिलेख को प्रेषित किया जाएगा।

(3) नियम 9 के अधीन प्ररूप-''घ'' में अंतिम रूप प्रदत्त अधिकार-अभिलेख का एक सैट पटवारी के पास पटवारखाने में अनुरक्षित किया जाएगा।

11. अधिकारों के नामान्तरण के लिए प्ररूप.--विरासत, उत्तराधिकार, क्रय, बन्धक द्वारा या अन्यथा राजस्व पटवारी की रिपोर्ट पर किसी सर्वेक्षण इकाई में अधिकारों के अर्जन का नामांतरण प्ररूप-''ङ'' में दर्ज (प्रविष्ट) किया जाएगा।

12. लेखन त्रुटि और अंकगणितीय भूल का सुधार.--आदेशों या कार्यवाहियों में लेखन या अंकगणितीय त्रुटियां अभिलेखन और समाधान अधिकारी या सहायक अभिलेखन और समाधान अधिकारी जिसने या जिसके पद-उत्तरवर्ती ने आदेश पारित किया है, द्वारा किसी भी समय या तो स्वप्रेरणा से या किसी पक्षकार के आवेदन करने पर सुधारी जा सकेगी और ऐसे सुधार की संसूचना बिना किसी प्रभार के पक्षकारों को और इसके कार्यान्वयन हेतु सम्बद्ध अधिकारी को भी दी जाएगी।

13. प्रतियों का प्रदाय.--मामलों के अभिलेख के निरीक्षण और हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) के उपबंधों के अधीन कार्यवाहियों की बाबत दस्तावेजों की प्रतियां 1568 राजपत्र, हिमाचल प्रदेश, 01 जून 2022/11 ज्येष्ठ, 1944 जारी करने के लिए यथा लागू प्रक्रिया अधिनियम और इन नियमों के अधीन स्थायी अधिकार-अभिलेख के सम्बन्ध में कार्यवाहियों के लिए, यथावश्यक परिवर्तन सहित लागू होगी।

14. विधिमान्यकरण.--सरकार द्वारा समय-समय पर जारी अनुदेशों, निर्देशों या आदेशों के अनुसार केन्द्रीय या राज्य सरकार के किसी अभिकरण द्वारा किसी आबादी देह में सीमा परिलक्षित करना और आबादी देह में सर्वेक्षण इकाई का सीमांकन करना विधिमान्य होगा और ऐसा कोई कृत्य या कार्यवाही केवल इस आधार पर कि, यह अधिनियम या इन नियमों के प्रारम्भ से पूर्व कार्यान्वित किया गया था, प्रश्नगत नहीं होगा।

NOTIFICATION

Shimla-171 002, the 31st May, 2022

No. Rev-B-A(3)9/2021.—In exercise of the powers conferred by Section 29 of the Himachal Pradesh Abadi Deh (Record of Rights) Act, 2021, the Governor of Himachal Pradesh is pleased to make the following rules for carrying out the purposes of the said Act, namely: – 1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Abadi Deh (Record of Rights) Rules, 2022,

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Himachal Pradesh Abadi Deh (Record of Rights) Act, 2021;

(b) "Field book" means the book maintained in Form "A" and shall form part of the standing record of rights;

(c) "Form" means the Form appended to these rules;

(d) "section" means a section of the Act;

(e) "Sub-divided survey unit" means a part of a survey unit which forms a separate unit and has been numbered by a fraction of the principal number.

(2) Words and expressions, used herein and not defined, but defined in the Act shall carry the meanings respectively assigned to them in the Act.

3. Appointment of Survey Officer and Assistant Survey Officer.—(1) The Kanungo and Patwari serving under the Revenue Department shall be the Survey Officer and Assistant Survey Officer, respectively, to perform the functions of such officers under the Act.

(2) Where any of the acts and functions provided under sub-section (2) of Section 6 of the Act are performed by a notified agency, such agency shall be deemed to be the Survey Officer for the acts and functions so performed.

(3) The Chief Recording and Resolution Officer may appoint more than one Survey Officer and Assistant Survey Officer as may be required for each abadi deh.

(4) In case more than one Survey Officer and Assistant Survey Officer have been appointed for any abadi deh, the Chief Recording and Resolution Officer shall specify the area of the abadi deh for which the survey is to be conducted by each such Survey Officer and Assistant survey Officer.

4. Village Committee.—To identify the ownership of survey units and common areas set apart for common purposes within the abadi deh the Village Committee comprising of not more than seven members in the following manner shall be nominated by the Assistant Recording and Resolution Officer:—

(a) In case of a village, the Pradhan of the Gram Panchayat, or concerned ward member of the Panchayat as his nominee; and in case of a Urban Local Body, the Mayor or Chairman of the Urban Local Body or concerned counselor or ward member of the Urban Local Body;

(b) The Numbardar of the village or the municipal area of which the standing record of rights is to be prepared;

(c) Any other respectable resident of the abadi deh of the village or municipal body considered proper:

Provided that atleast one woman and a person from scheduled caste category shall be included in Village Committee.

5. Measurement.—The base unit of measurement for the purposes of the Act and the rules shall be in meter system and the area of the survey unit shall also be mentioned in square meter.

6. Entry upon land, dwelling and habitation areas of survey units for preparation of standing record of rights.—(1) The officers under the Act and any person acting under their orders may, in the discharge of any duty under the Act enter upon land, dwelling and habitation areas of survey units with prior notice to the residents of the abadi deh area.

(2) The Survey Officer by,—

(i) proclamation in the village;

(ii) pasting a notice at conspicuous places in the abadi deh of a revenue estate or a urban local body; and

(iii) informing the Pradhan of the Gram Panchayat or Mayor/Chairman/President of Urban Local Body; give due intimation and publicity of the date of his visit to the abadi deh area for the purpose of identifying the boundaries, demarcation, taking measurements and numbering of the survey units.

(3) The Survey Officer shall for the purpose of survey,—

(a) explain the procedure to be followed to the inhabitants in a general gathering;

(b) take measurements, demarcate the boundary and record the area of each survey unit on the map prepared under sub-Section (2) of section 6 of the Act and record these in the field book in Form "A";

(c) number consecutively in serial order of the survey units in the abadi deh in numerals commencing from number 1; and

(d) mention of type of the survey unit such as house, street, shop, institutional building, open area, common area and path.

(4) In determining the area, boundary and type of survey unit, the Survey Officer may take into consideration such document or writing submitted by a person interested, which shows or determines boundary, area or type of the survey unit, and take measurements and prepare the record on its basis.

(5) The Survey Officer shall compile and submit the record prepared under this rule along- with the field book in Form "A" to the Assistant Recording and Resolution Officer for preparing the standing record of rights.

7. Recording of rights of proprietors.—The Assistant Recording and Resolution Officer with the assistance of the Village Committee and after hearing the interested parties shall,—

(i) take into consideration such relevant and material document or writing, considered just and proper, submitted by a proprietor or person interested, in support of his claim in the survey unit;

(ii) in case a survey unit is found to be sub-divided, mark the sub-divided part of the survey unit like 1/1, 1/2, 1/3, 1/4; 2/1, 2/2, 2/3, 2/4; 1/1/1, 1/1/2, 1/1/3, 1/1/4 and so on as may be considered suitable and proper, and record the area of each sub- divided survey unit; and

(iii) proceed to record in a summary manner and display at the conspicuous place in the abadi deh area in Form "B" the proposed entries of the proprietors and their proprietary rights in the survey units and sub-divided survey units as on the appointed day.

8. Resolution of objections.—(1) The survey map with demarcation, boundary and area of the survey unit prepared under rule 6, and the record of entries of proprietors in a survey unit prepared under rule 7 in Form "B" shall for the purpose of inviting objections, if any, be displayed by the Assistant Recording and Resolution Officer at any one or more of the conspicuous places in the village like Panchayat Ghar, Village co-operative society, Patwar Khana, Dharamsala, community centre or common religious places in the village or Urban Local Bodies, as the case may be.

(2) Copies of the record under sub-rule (1) above shall be given to the Pradhan of the Gram Panchayat or the Mayor/Chairman/President of the Urban Local Body, through an official functionary against receipt.

(3) The objections, if any, filed under Section 11 of the Act shall be filed before the Assistant Recording and Resolution Officer in Form "C".

(4) The objections received or filed shall be numbered in serial order in a separate register with the date of its receipt.

(5) The Assistant Recording and Resolution Officer on the expiry of thirty days of filing objections under sub-section (1) of Section 11 shall certify the number of objections received or filed and shall send a report in this regard to the Recording and Resolution Officer.

(6) The Assistant Recording and Resolution Officer shall consider the objections, conduct such inquiry as he thinks fit and pass a speaking order under sub-section (2) of Section 11 in respect of each objection.

(7) Any correction or amendment made in the area, boundary or dimension of a survey unit while passing an order under sub-rule (6) above shall be incorporated by the Assistant Recording and Resolution Officer in red ink in the field book in Form "A".

9. Finalisation of record of rights.—(1) In case there is no objection to the entries recorded under rule 7 of these rules, the Assistant Recording and Resolution Officer shall incorporate them in the record of rights of the survey unit in Form "D".

(2) In case of objections to the entries under Rule 7 of these rules, the Assistant Recording and Resolution Officer after hearing the affected parties and disposing the objections regarding recording of proprietary rights, area, boundary, dimensions or sub-division, if any, shall incorporate them in the record of rights of the survey unit in Form "D" in accordance with the decision reached at.

(3) The heading of the standing record of rights shall contain the hadbast number of the revenue estate by suffixing to it the words, "abadi deh".

10. Transfer and Consignment of standing record of rights.—(1) The standing record of rights as finalized shall be displayed at conspicuous place in the abadi deh area under sub-section (4) of Section 11.

(2) The record under sub-rule (1) shall be transferred to the District Collector under Section 15 of the Act and shall be consigned to record in the district office.

(3) One set of the record of rights finalized under rule 9 in Form "D" shall be maintained with the patwari at the patwarkhana.

11. Form for mutation of rights.—The mutation of acquisition of rights in a survey unit by inheritance, succession, purchase, mortgage or otherwise on being reported to the revenue patwari shall be entered in Form "E".

12. Correction of clerical errors and arithmetical mistakes.—Clerical or arithmetical errors, in orders or proceedings may at any time be corrected by the Recording and Resolution Officer or the Assistant Recording and Resolution Officer who passed the order or by his successor either on his own motion or on the application of any party, and an intimation of such correction shall be made to the parties free of any charges and also to the officer concerned for its implementation.

13. Supply of copies.—The procedure as applicable for inspection of record of cases, and issuance of copies of documents in respect of proceedings under the Himachal Pradesh Land Revenue Act, 1954 (Act No. 6 of 1954) shall apply mutatis mutandis to proceedings in respect of the standing record of rights under the Act and these rules.

14. Validation.—The survey conducted and the mapping done by an agency of the Central or the State Government for identifying the boundary of an abadi deh and demarcating the survey units within the abadi deh in accordance with the instructions, directions or orders issued by the Government from time to time shall be valid and no such act or proceeding shall be questioned merely on the ground that it had been carried out before the commencement of the Act or these rules.
