Shimla was issued under Section 226(2) of HPMC Act, 1994 through a public notice for inviting objection/suggestion form general public on 16-03-2022.

That Sh. Sunder Singh s/o late Sh. Roop Chand, r/o Sunder Bhawan, Apple Garden near SSB Gate Kasumpati raised objection that he is owner of the land comprising in Khasra No. 1132/1013 measuring 75.90 sq. mtrs. situated at Mohal Kasumpati Jajhot Shimla (Rural) and the existing path of 10 feet width was constructed by the objector and his brother for their personal use and therefore no other person including the local resident have any kind of right, title and interest over the said land/path.

That Smt. Shanti Devi w/o Sh. Tara Chand has raised her objection that the residents of the locality has constructed the road in Khasra No. 1124/1001/1 and 1123/1001 without the consent of her husband being the owner of the said land. Sh. Tara Chand has also raised objections that he is the owner of the land comprised in above Khasra Nos., no one can be allowed to utilize my land for their own benefits.

That all the objectors namely Sh. Sunder Singh, Smt. Shanti Devi and Sh. Tara Chand were heard in person on 23-04-2022. During the course of personal hearing, Sh. Sunder Singh gave in writing that the road in question be declared as public road, but the retaining wall to his house be constructed. Sh. Tara Chand and Smt. Shanti Devi w/o Sh. Tara Chand consented to surrender his land for path only but not for ambulance road.

That some of the beneficiaries namely Sh. Chuni Lal, Sh. Ramesh Roach and Sh. Bhagwan Chand submitted that in revenue record the path is already shown as Share-Aam in revenue record. It has further been submitted by them that Sh. Tara Chand & Sh. Sunder Singh has already given no objection certificate in the shape of affidavit to enter 2 karam path already existing and in use by the Public in the revenue record. In support of their contention they have submitted photocopy of affidavit in this regard. It has further been submitted by them that out of seven persons only one is not willing to surrender the land for the construction of ambulance road in question. It has also been brought on record that as many as 175 persons will be benefitted by this ambulance road. The above beneficiaries prayed that the damaged retaining wall in respect of the house of Sh. Sunder Singh may be constructed.

That the revenue record vis-a vis the location plan of the existing path having width of 3.00 mtrs. from RD 0/00 to 0/370 as placed on record has also been perused. Further the plea taken by the objectors and the beneficiaries has been considered. The location plan of the existing path shows that the road from RD 0/00 to 0/370 having width of 3.00 mtrs. is existing at site. From the perusal of the location plan it is revealed that about 33 households abutting to the existing road would be benefitted. Sh. Tara Chand one of the objector has already consented to surrender the land for path which is already existing at site having width of 3.00 mtrs. The another objector has also consented for declaration of public road. Thus keeping in view the demand of the local residents, it has been considered desirable that the existing path having 3.00 mtrs. Width from SSB Gate & Apple Garden to Mankotia House be declared as ambulance road for the convenience of the residents of the area as the upkeep and maintenance of the same can be undertaken by the Municipal Corporation Shimla only when it is vested in Municipal Corporation Shimla after its declaration as public path.

Now therefore, the undersigned in exercise of the powers conferred upon me by Section 226(2) of the Himachal Pradesh Municipal Corporation Act, 1994, I, Ashish Kohli, HAS, Commissioner, Municipal Corporation, Shimla hereby declare ambulance road from SSB gate & Apple Garden to Mankotia House i.e. RD 0/00 to 0/370 having existing width of 3.00 mtrs. leading through Khasra Nos. 1002, 1129/1010/2/1, 1132/1013, 1137/10/3/1, 1123/1001, 1124/1001/1, 983/2/1, 995, 1082/1025, 1028, 1029, 1088/1030, 1150/1057, 1152/1057 and 1152/1027/3/2 having area of 74.10 sq. mtrs., 45.31 sq. mtrs., 75.90 sq. mtrs., 73.95 sq. mtrs., 41.26 sq. mtrs., 39.67 sq. mtrs., 26.10 sq. mtrs., 243.22 sq. mtrs., 80.05 sq. mtrs., 2.00 sq. mtrs., 1.50 sq. mtrs., 142.70 sq. mtrs., 68.75 sq. mtrs., 57.00 sq. mtrs. and 36.00 sq. mtrs. respectively situated at Mohal Kasumpati Jajhot Shimla (Rural), Teh. & Distt. No. FDS-KNR/93-(I)-IV-959-997.—In super session of all previous notifications and in exercise of the powers conferred upon me under clause 2(d) (1) of the Kerosene (Restriction on use and Fixation of ceiling Price) Order, 1993, I, Abid Hussain Sadiq , IAS District Magistrate, District Kinnaur HP, do hereby fix Wholesale and Retail Sale Rate of Kerosene Oil to be distributed under the public distribution system in Kinnaur, District, which may be charged by the Wholesaler and Retailer as under:—

Conditions for Wholesale/Retail Dealers and Consumers:—

1. The Wholesaler of Kinnaur District shall report to the Distt. Controller, Food, Civil Supplies & Consumer Affairs, Kinnaur and the authorized Inspector regarding receipt of K. Oil Tanker before proceeding on route and supply only to those authorized Retailers, who have been specifically mentioned in the Route Chart.

2. The Wholesale Dealer will issue PDS K. Oil only to the authorized retailer/ Fair Price Shop/ Persons and will get signatures on the Cash Memo and shall keep the record for inspection purpose.

3. The Wholesale Dealer would make all arrangement to purchase/lift monthly allotted quota within the fixed period.

4. No Retailer shall sell or offer for sale a quantity of Kerosene Oil more than the quantity so fixed by the Govt. as given below on any consumer Card at one time. The Retailer shall obtain the signature of the recipient of the quantity in sale register / cash Memo and issue Kerosene Oil Strictly as per the norms given below:—

Note: As per stocks available equitable distribution may be made.

5. Both the Wholesaler and Retailer shall not supply / sell K. Oil after the sun set till 8:00 A.M. and Retailer shall not sell the K. Oil to the consumer without cash memo.

6. Both the Wholesaler/ Retailer shall have to display the stock as well as rates at their place of business in Dev Nagri script.

7. No Consumer Card holder shall further sell K. Oil purchased from the Fair Price Shop against their Consumer Card.

8. The Wholesaler of K. Oil would submit monthly report of K. Oil (as per prescribed Performa given below) received and supplied to the authorized Fair Price Shops/ Depot during the month alongwith the Cash Memo issued to the Depot Holder.

9. No Wholesaler/Retailer under Public Distribution System shall not charge more than maximum price so fixed by the District Magistrate, Kinnaur.

10. The Dealer whether Wholesaler or a Retailer deals in Kerosene Oil under Public Distribution System shall act in accordance with the provision of Kerosene (Restriction on use and Fixation of ceiling Prices) Order, 1993 and shall also comply with the provision of the H.P. Specified Articles (Regulation of Distribution) Order, 2019 and terms and conditions of the authorization issued thereunder and instructions given by the State Government from time to time.
