संख्याः पीसीएच-एचए(1)-3/2019-एल--48096-48250.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या पीसीएच-एचए(3)6/94, तारीख 7 फरवरी, 1995 द्वारा अधिसूचित और तारीख 8 फरवरी, 1995 को राजपत्र, हिमाचल प्रदेश (असाधारण) में प्रकाशित हिमाचल प्रदेश पंचायती राज (निर्वाचन) नियम, 1994 का और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और इनका राजपत्र (ई-गजट) हिमाचल प्रदेश में सतद्‌द्वारा प्रकाशन किया जाता है। इन प्रारूप नियमों से संभाव्य प्रभावित होने वाले हितबद्ध किसी व्यक्ति को यदि प्रस्तावित नियमों की बाबत कोई आक्षेप/सुझाव है/हैं तो वह लिखित आक्षेप (आक्षेपों)/सुझाव (सुझावों) को प्रस्तावित राजपत्र में (ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर निदेशक, पंचायती राज, हिमाचल प्रदेश, एस.डी.ए. कम्पलैक्स, कसुम्पटी शिमला-171009 को भेज सकेगा/सकेगी;

उपर्युक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप(पों)/सुझाव(वों) यदि कोई हो/हों पर राज्य सरकार द्वारा प्रस्तावित प्रारूप नियमों को अंतिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पंचायती राज (निर्वाचन) संशोधन नियम, 2022 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। नियम 35 का संशोधन.--हिमाचल प्रदेश पंचायती राज (निर्वाचन) नियम, 1994 जिन्हें इसके पश्चात "उक्त नियम" कहा गया है) के नियम 35 के, उप नियम (2) के नीचे परन्तुक में, "प्ररूप 18-क में जारी अदेय प्रमाण-पत्र संलग्न किया जाएगा "शब्दों, अंकों, चिन्ह और वर्ण "के पश्चात्‌ और यह घोषित करते हुए कि वह हिमाचल प्रदेश राज्य में संचालित किसी सहकारी सोसाइटी का व्यतिक्रमी नहीं है, शपथ-पत्र देगा" शब्द और चिन्ह अन्तःस्थापित किए जाएंगे।

प्ररूप 18-ख का जोड़ा जाना.--उक्त नियमों में प्ररूप 18-क के पश्चात निम्नलिखित प्ररूप 18-ख जोड़ा जाएगा, अर्थात्‌ः-

Shimla-171 009, the 06th July, 2022

No. PCH-HA(1)-3/2019-L-48096-480250.—In exercise of the powers conferred by section 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994), the Governor Himachal Pradesh, proposes to make the following rules further to amend the Himachal Pradesh Panchayati Raj (Election) Rules, 1994 notified vide this Department Notification No. PCH-HA (3) 6/94, dated 7th February, 1995 and published in the Rajpatra, Himachal Pradesh (Extra-ordinary), on 8th February, 1995 and the same are hereby published in the Rajpatra (e-Gazette), Himachal Pradesh, for the information of the general public;

If any person interested is likely to be affected by these draft rules or has any objection(s)/suggestion(s) with regard to the proposed rules, he/she may send the written objections or suggestions to the Director Panchayati Raj, Himachal Pradesh, SDA Complex, Kasumpti, Shimla-171009, within a period of thirty days from the date of publication of the proposed rules in the Rajpatra, (e-Gazette), Himachal Pradesh ;

The objection(s) /suggestion(s), if any, received within the period stipulated above shall be taken into consideration by the State Government before finalizing the proposed draft rules, namely:—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Panchayati Raj (Election) Amendment Rules, 2022.

(2) They shall come into force from the date of publication in Rajpatra (e-gazette) Himachal Pradesh.

Amendment of rule 35.—In rule 35 of the Himachal Pradesh Panchayati Raj (Election) Rules, 1994 (herein after referred to as the "said rule" in the proviso under sub rule (2), after the words, figures, sign and alphabet "Form 18-A" the words and sign "and shall furnish an affidavit declaring that he/she is not the defaulter of any co-operative Society operating in the State of Himachal Pradesh shall be inserted.

Addition of form 18-B.—In the said rules after the Form 18-A, the following From 18-B shall be added, namely:—

No. 479/2022(1).—Whereas, the Election Commission of India, in connection with conduct of Presidential Election, 2022, has notified under Rule 7 of the Presidential and Vice-Presidential2670 राजपत्र, हिमाचल प्रदेश, 12 जुलाई 2022/21 आषाढ़, 1944 Elections Rules, 1974, vide its Notification No. 479/2022(1) dated 15th June, 2022, the Place of polling and Group of electors who will be entitled to vote at those places of poll; and

Whereas, in the Note to the said Notification, a limit of 10 days before the date of poll has been fixed, before which any Member of Parliament/Member of Legislative Assembly, on account of exigency for special circumstances, has to intimate if he/she desires to vote at place of polling other than the one notified for his/her group, by directly applying to the Election Commission of India in the prescribed format; and

Whereas, the Commission has decided to liberalise the above said stipulation of 10 days' prior intimation in case of extreme urgent situation;

Now, therefore, the Commission has decided that the requests for the aforesaid purpose, received in the Commission, even after 10 days before the date of poll, if any, may be considered by the Commission based upon the circumstances of individual case and allow such Member of Parliament/Member of Legislative Assembly to cast vote at place of polling other than the one notified for his/her group, if there is sufficient time available for making necessary arrangements in this regard.

सं. 479/2022(1).--यतः, भारत निर्वाचन आयोग ने राष्ट्रपतीय निर्वाचन, 2022 के संचालन के संबंध में राष्ट्रपतीय और उप-राष्ट्रपतीय निर्वाचन नियम 1974ए के नियम 7 के अधीन दिनांक 15 जून, 2022 को जारी अपनी अधिसूचना सं. 479/2022(1) के द्वारा मतदान का स्थान व निर्वाचकों का समूह, जो उन मतदान स्थलों पर मतदान करने का पात्र होगा, उनको अधिसूचित कर दिया है; और

यतः, उक्त अधिसूचना की टिप्पणी में मतदान की तारीख से 10 दिन पहले की सीमा उस रूप में निर्धारित की गई है, जिससे पहले कोई भी संसद सदस्य/विधान सभा सदस्य किसी विशेष परिस्थिति के कारण यदि उनके समूह के लिए अधिसूचित मतदान-स्थल के अलावा अन्य मतदान स्थल पर मतदान करना चाहता/चाहती हो तो उसे निर्धारित प्रपत्र में भारत निर्वाचन आयोग को सीधे आवेदन करते हुए सूचित करना होगा; और

र्क्त शर्त को उदार बनाने का यतः, आयोग ने अत्यन्त तात्कालिक स्थिति के मामले में 10 दिन पूर्व सूचना की उपयु निर्णय लिया है;

र्क्त प्रयोजन के लिए आयोग में मतदान की तारीख से 10 दिन पूर्व अतः, अब आयोग ने यह निर्णय लिया है कि उपयु की अवधि के प(cid:7391)ात भी प्राप्त अनुरोध, यदि कोई है, तो आयोग द्वारा उस पर (cid:7390)क्तिगत मामले की स्थिति के आधार पर2671 राजपत्र, हिमाचल प्रदेश, 12 जुलाई 2022/21 आषाढ़, 1944 विचार किया जा सकता है और आयोग ऐसे संसद सदस्य/विधान सभा सदस्य को उनके समूह के लिए अधिसूचित स्थान के अलावा अन्य मतदान स्थल पर मतदान करने की अनुमति दे सकता है, यदि इस संबंध में आवश्यक (cid:7390)वस्था करने के लिए पर्याप्त समय उपलब्ध हो।

अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि किसी को उक्त विषय से सम्बन्धित कोई एतराज हो तो वह असालतन या वकालतन दिनांक 10-08-2022 को प्रातः 10.00 बजे अदालत हजा में उपस्थित होकर अपना एतराज दें, कोई एतराज न होने की सूरत में जन्म तिथि को दुरुस्त करने के आदेश पारित किए जाएंगे।

प्रार्थी श्री लखविन्द्र सिंह पुत्र राम स्वरुप, वासी बढेडा, तहसील हरोली, जिला ऊना व श्रीमती शिल्पा शर्मा पुत्री वलदेव राज, वासी पंडोगा, तहसील हरोली, जिला ऊना ने प्रार्थना-पत्र प्रस्तुत करके निवेदन किया है कि उन की शादी दिनांक 14-05-2021 को गांव बढेडा में हुई है। लेकिन उनकी शादी ग्राम पंचायत बढेडा में दर्ज नहीं हुई है। अतः प्रतिवादीगण को वजरिया मुशत्री-मुनादी इश्तहार सूचित किया जाता है कि यदि किसी व्यक्ति को उक्त शादी बारे कोई उजर/एतराज हो तो वह निर्धारित तारीख पेशी दिनांक तक असालतन या वकालतन इस न्यायालय में पेश कर सकता है। अन्यथा उसके बाद कोई एतराज मान्य नहीं होगा और उक्त शादी पंजीकरण करने के लिये सम्बन्धित पंचायत को आदेश दे दिया जायेगा और मुकद्दमा का निपटारा/फैसला नियमानुसार कर दिया जायेगा।
