NOTIFICATION

Shimla-171 002, the 26th August, 2022

No. SJE-B-C(17)-1/2021.—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a 117—राजपत्र/2022-31-08-2022 (4439)4440 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Department of Social Justice & Empowerment (hereinafter referred to as the Department), is administering the Disability Relief Allowance Scheme under Himachal Pradesh Social Security (Pension/Allowance) Rules, 2010 (hereinafter referred to as the Scheme) to provide Disability Relief Allowance to those having disability 40% and above but below 70% whose annual income does not exceed 50,000 Per Annum and without any income criteria to those having disability 70% & above and are not getting any other type of pension, which is being implemented through the District Welfare Officers under Directorate for the Empowerment of SCs, OBCs, Minorities & the Specially Abled of the Department; (hereinafter referred to as the Implementing Agency).

And whereas, under the Scheme, the amount of Disability Relief Allowance as notified by the Government from time to time (hereinafter referred to as the benefit) is given to the eligible Divyangjan (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh.

Now, therefore, in pursuance of Section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Government of Himachal Pradesh hereby notifies the following, namely:—

1. (1) An individual desirous of availing the benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent as his parents or guardians (in case of child beneficiaries) provided that he is entitled to obtain Aadhaar as per Section 3 of the said Act, and such children shall visit any Aadhaar enrolment centre [list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in] to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhaar is assigned to the individual, the benefits under the Scheme shall be given to such individuals, subject to production of the following documents, namely :—

(a) if the child has been enrolled after attaining the age of five years (with biometrics collection), his Aadhaar Enrolment Identification slip, or of bio- metric update identification slip; and

(b) any one of the following documents, namely:—

(i) Birth Certificate; or Record of birth issued by the appropriate authority;

(ii) School identity card, duly signed by the Principal of the School, containing parents' names; and

(c) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely:—

(i) Birth Certificate; or Record of birth issued by the appropriate authority;

(ii) Ration Card; or

(iii) Ex-Servicemen Contributory Health Scheme (ECHS) Card; or Employees' State Insurance corporation (ESIC) Card; or Central Government Health Scheme (CGHS) Card; or

(iv) Pension Card; or

(v) Army Canteen Card; or

(vi) any Government Family Entitlement Card; or

(vii) any other document as specified by the Department.

II. For beneficiaries above 18 years old:

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and (b) any one of the following documents, namely :—

Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or (x) any other document as specified by the Department:

Provided further that the above documents shall be checked by an

officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through under the Scheme shall be given to the beneficiaries to make them aware of the requirement of Aadhaar.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its implementing Agency shall make provisions for iris scanners or face authentication alongwith fingerprint authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One-Time Password authentication is not possible, benefits under the scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. The benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses I. (b) and I. (c) of the proviso of sub-paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.

5. In order to ensure that no bonafide beneficiary (other than children) under the Scheme is deprived of his due benefits, the concerned Department in the State Governments and Union Territory Administrations shall follow the exception handling mechanism as specified in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India letter No. D-26011/04/2017-DBT, dated the 19th December, 2017 (available on https://dbtbharat/gov.in/).

6. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

संख्याः एस0जे0ई0-बी0-सी0(17)-1/ 2021.-- सेवाआें या प्रसुविधाओं या सहायिकियों को प्रदान करने के लिए आधार का एक पहचान दस्तावेज के रूप में प्रयोग, सरकार की परिदान प्रक्रिया को सुगम बनाने, पारदर्शिता और दक्षता लाने और लाभार्थियों को सुविधाजनक और निर्बाध रीति में किसी की पहचान साबित करने के बहुविध दस्तावेज प्रस्तुत करने की आवश्यकता हटाकर प्रत्यक्षतः उन्हें हकदारियां प्राप्त करने हेतु समर्थ बनाता है;

सामाजिक न्याय एवं अधिकारिता विभाग (जिसे इसमें इसके पश्चात्‌्‌ विभाग कहा गया है) हिमाचल प्रदेश सामाजिक सुरक्षा (पेंशन/भत्ता) नियम, 2010 के अधीन अपंग राहत भत्ता स्कीम (जिसे इसमें इसके पश्चात्‌ स्कीम कहा गया है) उन अपंगों को अपंग राहत भत्ता प्रदान करने, जिनकी विकलांगता चालीस प्रतिशत और इससे अधिक, किन्तु सत्तर प्रतिशत से कम है, जिनकी वार्षिक आय 50000/- रुपए से अधिक नहीं है और उन अपंगों को बिना किसी आय मानदण्ड के, जिनकी विकलांगता सत्तर प्रतिशत या इससे अधिक है तथा जो कोई किसी अन्य प्रकार की पेंशन नहीं ले रहे हैं, के लिए प्रशासित कर रहा है, जिसे निदेशालय अनुसूचित जाति, अन्य पिछड़ा वर्ग, अल्पसंख्यक और विशेष रूप से सक्षम निदेशालय (जिसे इसके पश्चात्‌ कार्यान्वयन अभिकरण कहा गया है) के अधीन जिला कल्याण अधिकारी/अधिकारियों के माध्यम से कार्यान्वित किया जा रहा है;

स्कीम के अधीन पात्र दिव्यांगजनों (जिन्हें इसमें इसके पश्चात्‌ लाभार्थी कहा गया है) को समय-समय पर सरकार द्वारा यथा अधिसूचित अपंग राहत सहायता भत्ता (जिसे इसमें इसके पश्चात्‌ प्रसुविधा कहा गया है) कार्यान्वित अभिकरण द्वारा विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार प्रदान किया जाता है। और पूर्वाक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि से उपगत होने वाला आवर्ती व्यय अन्तर्वलित है।

अतः हिमाचल प्रदेश सरकार, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18), (जिसे इसमें इसके पश्चात्‌्‌ उक्त अधिनियम कहा गया है) की धारा 7 के अनुसरण में एतद्‌द्वारा निम्नलिखित अधिसूचित करते हैं, अर्थात्‌्‌ः-

(1) स्कीम के अधीन प्रसुविधा प्राप्त करने की वाँछा रखने वाले किसी व्यष्टि को एतद्‌द्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना होगा या आधार अधिप्रमाणन प्राप्त करना होगा। (2) स्कीम के अधीन प्रसुविधाएं प्राप्त करने की वाँछा रखने वाला कोई व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए नामांकित नहीं है, को माता-पिता या संरक्षक की सहमति के अध्यधीन (बालक लाभार्थी की दशा में) आधार के नामांकन के लिए आवेदन करना अपेक्षित होगा, यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसा बालक आधार का अभ्यावेशन करवाने के लिए आधार अभ्यावेशन केन्द्र [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0 आई0 डी0 ए0 आई0) वैवसाइट www uidai. gov.in पर उपलब्ध है] पर जाएगा।

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग को अपने कार्यान्वयन अभिकरण के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करना अपेक्षित है जो अभी तक आधार के लिए नामांकित नहीं है और यदि सम्बन्धित खण्ड या तालुका या तहसील में कोई आधार नामांकन केन्द्र स्थित नहीें है तो विभाग अपनी कार्यान्वयन4444 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 अभिकरण के माध्यम से यू0 आई0 डी0 ए0 आई0 के विद्यमान रजिस्ट्रार की हैसियत से सुविधाजनक स्थानों पर आधार नामांकन सुविधाएं प्रदान कर सकेगाः

परन्तु जब तक किसी व्यष्टि को आधार समनुदेशित नहीं किया जाता है, तब तक ऐसे व्यष्टि को निम्नलिखित दस्तावेजों के प्रस्तुत करने के अध्यधीन स्कीम के अधीन प्रसुविधाएं प्रदान की जाएंगी, अर्थात्‌्‌ः-

I. अठारह वर्ष से कम आयु के बालकों के लिएः

(क) यदि बालक को पांच वर्ष की आयु (बायोमिट्रिक संग्रह सहित), प्राप्त करने के पश्चात्‌ नामांकित किया गया है, तो उसकी आधार नामांकन पहचान पर्ची या बायोमिट्रिक अपडेट पहचान पर्ची; और

(ख) निम्नलिखित में से कोई एक दस्तावेज, अर्थातः-

(i) जन्म प्रमाण-पत्र; या समुचित प्राधिकारी द्वारा जारी जन्म का अभिलेख; या (ii) स्कूल के प्रिंसिपल द्वारा सम्यक्‌ रूप से हस्ताक्षरित माता-पिता के नाम से युक्त स्कूल पहचान कार्ड; और

(ग) विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार लाभार्थी के माता-पिता या विधिक संरक्षक के साथ सम्बन्ध के प्रमाण-पत्र के रूप में निम्नलिखित में से कोई दस्तावेज, अर्थात्‌ः

(i) जन्म प्रमाण-पत्र; या समुचित प्राधिकारी द्वारा जारी किए गए जन्म का अभिलेख; या

(ii) राशन कार्ड; या

(iii) भूतपूर्व सैनिक अंशदायी स्वास्थ्य योजना (ई0 सी0 एच0 एस0) कार्ड; या कर्मचारी राज्य बीमा निगम (ई0 एस0 आई0 सी0) कार्ड; या केन्द्रीय सरकार स्वास्थ्य योजना (सी0 जी0 एच0 एस0) कार्ड; या

(iv) पेंशन कार्ड; या (v) सेना कैंटीन कार्ड; या

(vi) कोई सरकारी कुटुम्ब हकदारी कार्ड; या

(vii) विभाग द्वारा यथा विनिर्दिष्ट कोई अन्य दस्तावेज।

II. अठारह वर्ष से अधिक आयु के लाभार्थियों के लिए :

(क) यदि उसने स्वयं को अभ्यावेशित कर दिया है, तो उसकी आधार अभ्यावेशन पहचान पर्ची, और

(ख) निम्नलिखित में से कोई एक दस्तावेज है, अर्थात्‌्‌ः-

(i) फोटो सहित बैंक या पोस्ट ऑफिस पासबुक; या (ii) स्थायी लेखा संख्या (पी.ए.एन.) कार्ड; या (iii) पारपत्र (पासपोर्ट); या (iv) राशन कार्ड; या (v) मतदाता पहचान कार्ड; या (vi) मनरेगा कार्ड; या (vii) किसान फोटो पासबुक; या4445 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 (viii) मोटर यान अधिनियम, 1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी चालन अनुज्ञप्ति; या

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा शासकीय शीर्षनामा पर जारी ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाण-पत्र; या

(x) विभाग द्वारा यथा विनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह और कि उपरोक्त दस्तावेजों की विभाग द्वारा उस, प्रयोजन के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा जाँच की जाएगी। 2. स्कीम के अधीन लाभार्थियों को सुविधापूर्वक प्रसुविधाएं उपलब्ध करवाने के आशय से अपने कार्यान्वयन अभिकरण के माध्यम से विभाग यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि स्कीम के अधीन आधार की अपेक्षाओं हेतु उन्हें जागरूक करने के लिए, लाभार्थियों हेतु मीडिया के माध्यम से व्यापक प्रचार किया गया है।

3. उन समस्त मामलों में, जहाँ लाभार्थियों के अस्पष्ट बायोेमिट्रिक्स या किसी अन्य कारण से आधार प्रमाणन असफल रहता है, वहां निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृृत की जाएगी, अर्थात्‌्‌ः- (क) अस्पष्ट उंगली छाप क्वालिटी की दशा में आंख के पुतली स्कैन या चेहरा प्रणालीकरण प्रसुविधाएं प्रमाणीकरण के लिए अंगीकृृत की जाएगी तद्‌्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाएं प्रदान करने हेतु उंगली छाप प्रमाणन सहित आंख के पुतली स्कैन या चेहरा प्रमाणीकरण की प्रसुविधा की व्यवस्थाएं करेगा;

(ख) यदि उंगली छाप या आंख की पुतली का स्कैन या चेहरा प्रमाणीकरण के माध्यम से बायोमिट्रिक प्रमाणीकरण सफल नहीं है तो, जहां कही भी साध्य और अनुज्ञेय हो, वहां अधिप्रमाणन, यथास्थिति, एक बार आधार पासवर्ड द्वारा या सीमित समय वैधता सहित समय आधारित एक बार पासवर्ड सहित प्रदान किया जाएगा;

(ग) उन समस्त अन्य मामलों में जहां बायोमिट्रिक या एक बार आधार पासवर्ड या समय आधारित एक बार पासवर्ड प्रमाणीकरण सम्भव नहीं है तो, स्कीम के अधीन प्रसुविधाएं वस्तुगत आधार कार्ड, के आधार पर दी जाएंगी, जिसकी प्रामाणिकता आधार पर मुद्रित तुरन्त प्रत्युत्तर कोड के माध्यम से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा अपने कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी।

4. उपरोक्त अन्तर्विष्ट किसी बात के होते हुए भी, किसी भी बालक को स्कीम के अन्तर्गत प्रसुविधा प्रदान करने से, यदि वह अधिप्रमाणन द्वारा पहचान स़िद्ध करने में असफल रहता है, या आधार नम्बर धारण करने के सबूत प्रस्तुत न करने, या किसी ऐसे बालक, जिसे कोई आधार नम्बर समनुदेशित नहीं किया गया है की दशा में अभ्यावेशन के लिए आवेदन प्रस्तुत न करने पर इनकार नहीं किया जाएगा। उसे पैरा 1 के उप पैरा (3) के परन्तुक के खण्ड (ख) और (ग) में यथा वर्णित अन्य दस्तावेजों के आधार पर, उसकी पहचान का सत्यापित करके प्रसुविधा प्रदान की जाएगी और जब प्रसुविधा ऐसे अन्य दस्तावेजों के आधार पर प्रदान की गई है तो उसको रिकार्ड करने के लिए एक पृथक रजिस्टर अनुरक्षित किया जाएगा, जिसे विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से कालिकतः पुनरीक्षित किया जाएगा।

5. यह सुनिश्चित करने के आशय से कि कोई वास्तविक लाभार्थी (बालकों से अन्यथा) स्कीम के अधीन उनको देय प्रसुविधाओं से वंचित न हो, राज्य सरकार के सम्बद्ध विभाग और संघ क्षेत्रीय प्रशासन डी0 बी0 टी0 मिशन कैबिनेट सैक्रेटेरिएट भारत सरकार के कार्यालय ज्ञापन डी-26011/04/2017, तारीख 19 दिसम्बर, 2017 (https://dbtbharat/gov.in/ पर उपलब्ध है) में यथा विनिर्दिष्ट अपवाद व्यवहृत क्रियाविधि का अनुसरण करेगा। 4446 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 6. यह अधिसूचना राजपत्र (ई-गजट), हिमाचल प्रदेश में इसके प्रकाशन की तारीख से प्रवृृत्त होगी।

And whereas, under the Scheme, the amount of Transgender Pension as notified by the Government from time to time (hereinafter referred to as the benefit) is given to the Transgender person (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh.

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and (b) any one of the following documents, namely :—

Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or (x) any other document as specified by the Department:

Provided further that the above documents shall be checked by an

officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its implementing Agency shall make all the required arrangements to ensure that wide publicity through media shall be given to the beneficiaries to make them aware of the requirement of Aadhaar under the Scheme.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. (c) of the proviso of sub-paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.

5. In order to ensure that no bonafide beneficiary (other than children) under the Scheme is deprived of his due benefits, the concerned Department in the State Governments and Union Territory Administrations shall follow the exception handling mechanism as specified in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India letter no. D-26011/04/2017-DBT, dated the19th December 2017(available on https://dbtbharat.gov.in/).

6. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

सामाजिक न्याय एवं अधिकारिता विभाग (जिसे इसमें इसके पश्चात्‌्‌ विभाग कहा गया है) हिमाचल प्रदेश सामाजिक सुरक्षा (पैंशन/भत्ता) नियम, 2010 के अधीन विपरितलिंगी (टरेन्सजैण्डर) पैंशन स्कीम (जिसे इसके पश्चात्‌्‌ स्कीम कहा गया है) उन विपरितलिंगी (टरेन्सजैण्डर) जिनकी पहचान स्वास्थ्य विभाग द्वारा की गई है, उनकी आयु और वार्षिक आय को विचार में लाए बिना प्रशासित कर रहा है जिसे अनुसूचित जाति, अन्य पिछड़ा वर्ग, अल्पसंख्यक एवं विशेष रूप से सक्षम विभाग के निदेशालय (जिसे इसमें इसके पश्चात्‌्‌ कार्यान्वयन अभिकरण कहा गया है) के अधीन जिला कल्याण अधिकारियों के माध्यम से कार्यान्वित किया जा रहा है;

स्कीम के अन्तर्गत सरकार द्वारा समय-समय पर यथा अधिसूचित विपरितलिंगी (टरेन्सजैण्डर) पेंशन की रकम (जिसे इसमें पश्चात्‌ प्रसुविधा कहा गया है) को विपरितलिंगी (टरेन्सजैण्डर) (जिन्हें इसमें इसके पश्चात्‌्‌ लाभार्थी कहा गया है) कार्यान्वयन अभिकरण द्वारा विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार प्रदान किया जाता है;

और पूर्वोक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि में से उपगत होने वाला आवर्ती व्यय अन्तर्वलित है। 4450 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 अतः हिमाचल प्रदेश सरकार, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18), (जिसे इसमें इसके पश्चात्‌्‌ उक्त अधिनियम कहा गया है) की धारा 7 के अनुसरण में एतद्‌द्वारा निम्नलिखित अधिसूचित करते हैं, अर्थात्‌्‌ः-

(1) स्कीम के अधीन प्रसुविधा प्राप्त करने की वाँछ रखने वाले किसी व्यष्टि को एतद्‌द्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना होगा या आधार अधिप्रमाणन प्राप्त करना होगा। (2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वॉछा रखने वाला कोई व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए नामांकित नहीं है, को माता-पिता या संरक्षकक की सहमति के अधधीन (बालक लाभार्थी की दशा में) आधार के नामांकन के लिए आवेदन करना अपेक्षित होगा, यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसा बालक आधार का अभ्यावेशन करवाने के लिए आधार अभ्यावेशन केन्द्र [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0 आई0 डी0 ए0 आई0) वैवसाइट www uidai. gov.in पर उपलब्ध है] पर जाएगा।

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग को अपने कार्यान्वयन अभिकरण के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करना अपेक्षित है जो अभी तक आधार के लिए नामांकित नहीं है और यदि सम्बन्धित खण्ड या तालुका या तहसील में कोई आधार नामांकन केन्द्र स्थित नहीें है तो विभाग अपनी कार्यान्वयन अभिकरण के माध्यम से यू0 आई0 डी0 ए0 आई0 के विद्यमान रजिस्ट्रार के समन्वय में पर या स्वयं ही यू0 आई0 डी0 ए0 आई0 रजिस्ट्रार की हैसियत से सुविधाजनक स्थानों पर आधार नामांकन सुविधाएं प्रदान कर सकेगाः

I. अठारह वर्ष से कम आयु के बालकों के लिएः

(क) यदि बालक को पांच वर्ष की आयु (बायोमिट्रिक संग्रह सहित), प्राप्त करने के पश्चात्‌ नामांकित किया गया है, तो उसकी आधार नामांकन पहचान पर्ची या बायोमैट्रिक अपडेट पहचान पर्ची; और

(ख) निम्नलिखित में से कोई एक दस्तावेज, अर्थातः-

(i) जन्म प्रमाण-पत्र; या समुचित प्राधिकारी द्वारा जारी जन्म का अभिलेख; या (ii) स्कूल के प्रिंसिपल द्वारा समयक्‌ रूप से हस्ताक्षरित माता-पिता के नाम सेयुक्त स्कूल पहचान कार्ड; और

(ग) विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार लाभार्थी के माता-पिता या विधिक संरक्षक के साथ सम्बन्ध के प्रमाण-पत्र के रूप में निम्नलिखित में से कोई दस्तावेज, अर्थात्‌ः-

(ii) राशन कार्ड; या

(v) सेना कैंटीन कार्ड; या

(vi) कोई सरकारी कुटुम्ब हकदारी कार्ड; या

(vii) विभाग द्वारा यथा विनिर्दिष्ट कोई अन्य दस्तावेज।

II. अठारह वर्ष से अधिक आयु के लाभार्थियों के लिए

(ख) निम्नलिखित में से कोई एक दस्तावेज है, अर्थात्‌्‌ः-

(i) फोटो सहित बैंक या पोस्ट आफिस पासबुक; या (ii) स्थायी लेखा संख्या (पी.ए.एन.) कार्ड; या (iii) पारपत्र (पासपोर्ट); या (iv) राशन कार्ड; या (v) मतदाता पहचान कार्ड; या (vi) मनरेगा कार्ड; या (vii) किसान फोटो पासबुक; या (viii) मोटर यान अधिनियम, 1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी

द्वारा जारी चालन अनुज्ञप्ति; या

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा शासकीय शीर्षनामा पर जारी

ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाण-पत्र; या

(x) विभाग द्वारा यथा विनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह और कि उपरोक्त दस्तावेजों की जांच विभाग द्वारा उस, प्रयोजन

के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा की जाएगी। 2. स्कीम के अधीन लाभार्थियों को सुविधापूर्वक प्रसुविधाएं उपलब्ध करवाने के आशय से अपने कार्यान्वयन अभिकरण के माध्यम से विभाग यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि स्कीम के अधीन आधार की अपेक्षाओं हेतु उन्हें जागरूक करने के लिए, लाभार्थियों हेतु मीडिया के माध्यम से व्यापक प्रचार किया गया है।

3. उन समस्त मामलों में जहाँ लाभार्थियों के अस्पष्ट बायोेमीट्रिक्स के या किसी अन्य कारण से आधार प्रमाणन असफल रहता है वहां निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृृत की जाएगी, अर्थात्‌्‌ः- (क) अस्पष्ट उंगली छाप क्वालिटी की दशा में आंख की पुतली के स्कैन या चेहरा प्रणालीकरण अधिप्रमाणन प्रसुविधाएं प्रमाणीकरण के लिए अंगीकृृत की जाएगी तद्‌्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाएं प्रदान करने हेतु उंगली-छाप प्रमाणन सहित आंख की पुतली स्कैन या चेहरा प्रमाणीकरण की व्यवस्थाएं करेगा;

(ख) यदि उंगली छाप या आंख की पुतली का स्कैन या चेहरा प्रमाणीकरण के माध्यम से बायोमीट्रिक प्रमाणीकरण सफल नहीं है तो, जहां कही भी साध्य और अनुज्ञेय हो, वहां अधिप्रमाणन, यथास्थिति, एक बार आधार पासवर्ड द्वारा या सीमित समय वैधता सहित समय आधारित एक बार पासवर्ड सहित प्रदान किया जाएगा;

4452 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 (ग) उन समस्त अन्य मामलों में जहां बायोमीट्रिक या एक बार आधार पासवर्ड या समय आधारित एक बार पासवर्ड प्रमाणीकरण सम्भव नहीं है तो, स्कीम के अधीन प्रसुविधाएं वस्तुगत आधार कार्ड के आधार पर दी जाएंगी, जिसकी प्रमाणिकता आधार पर मुद्रित तुरन्त प्रत्युत्तर कोड के माध्यम से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा अपने कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी।

4. उपरोक्त अन्तर्विष्ट किसी बात के होते हुए भी, किसी भी बालक को स्कीम के अन्तर्गत प्रसुविधा प्रदान करने से, यदि वह अधिप्रमाणन द्वारा पहचान सिद्ध करने में असफल रहता है, या आधार नम्बर धारण करने के सबूत प्रस्तुत न करने, या किसी ऐसे बालक, जिसे कोई आधार नम्बर समनुदेशित नहीं किया गया है की दषा में अभ्यावेशन के लिए आवेदन प्रस्तुत न करने पर इनकार नहीं किया जाएगा। उसे पैरा 1 के उप पैरा (3) के परन्तुक के खण्ड (ख) और (ग) में यथा वर्णित अन्य दस्तावेजों के आधार पर, उसकी पहचान का सत्यापित करके प्रसुविधा प्रदान की जाएगी और जब प्रसुविधा ऐसे अन्य दस्तावेजों के आधार पर प्रदान की गई है तो उसको रिकार्ड करने के लिए एक पृथक रजिस्टर अनुरक्षित किया जाएगा, जिसे विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से कालिकतः पुनरीक्षित किया जाएगा।

5. यह सुनिश्चित करने के आशय से कि कोई वास्तविक लाभार्थी (बालकों से अन्यथा) स्कीम के अधीन उनको देय प्रसुविधाओं से वंचित न हों, राज्य सरकार के सम्बद्ध विभाग और संघ क्षेत्रीय प्रशासन डी0 बी0 टी0 मिशन कैबिनेट सैक्रेटेरिएट भारत सरकार के कार्यालय ज्ञापन डी-26011/04/2017, तारीख 19 दिसम्बर, 2017 (https://dbtbharat/gov.in/ पर उपलब्ध है) में यथा विनिर्दिष्ट अपवाद व्यवहृत क्रियाविधि का अनुसरण करेगा।

6. यह अधिसूचना राजपत्र (ई-गजट), हिमाचल प्रदेश में इसके प्रकाशन की तारीख से प्रवृृत्त होगी।

And whereas, the Department of Social Justice & Empowerment (hereinafter referred to as the Department), is administering the Widow/Deserted/Ekal Nari Pension Scheme under Himachal Pradesh Social Security (Pension/allowance) Rules, 2010 (hereinafter referred to as the Scheme) to provide Widow/Deserted/Ekal Nari Pension to those whose annual income is below 50,000/- Per Annum and are not getting any other type of pension, which is being implemented through the District Welfare Officers under Directorate for the Empowerment of SCs, OBCs, Minorities & the Specially Abled of the Department; (hereinafter referred to as the Implementing Agency).

And whereas, under the Scheme, the amount of Widow/Deserted/Ekal Nari Pension as notified by the Government from time to time (hereinafter referred to as the benefit) is given to the eligible Widows, Deserted ladies & Single Women(hereinafter referred to as the beneficiaries) by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh.

Now, therefore, in pursuance of section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Government of Himachal Pradesh is hereby notifies following, namely:—

1. (1) An individual desirous of availing benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent of his parents or guardians (in case of child beneficiaries) provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such children shall visit any Aadhaar enrolment centre [list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in] to get enrolled for Aadhaar.

Provided that till the time Aadhaar is assigned to the individual, the benefits under the Scheme shall be given to such individuals subject to production of the following documents, namely :—

For beneficiaries above 18 years old:

(i) फोटो सहित बैंक या पोस्ट आफिस पासबुक; या (ii) स्थायी लेखा संख्या (पी.ए.एन.) कार्ड; या (iii) पारपत्र; (पासपोर्ट) या (iv) राशन कार्ड; या (v) मतदाता पहचान कार्ड; या (vi) मनरेगा कार्ड; या (vii) किसान फोटो पासबुक; या (viii) मोटर यान अधिनियम, 1988 (1988 का 59) के अधीन अनुज्ञापन प्राधिकारी द्वारा जारी चालन अनुज्ञप्ति; या

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा सरकारी लैटर हैड पर जारी ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाणपत्र; या (x) विभाग द्वारा यथाविनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह और कि उपरोक्त दस्तावेजों की विभाग द्वारा उस प्रयोजन के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा जांच की जाएगी।

2. स्कीम के अधीन लाभार्थियों को सुविधापूर्वक प्रसुविधाएं उपलब्ध करवाने के आश्य से विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि लाभार्थियों को उक्त अपेक्षाओं के सम्बन्ध में उन्हें जागरूक करने के लिए, लाभार्थियों हेतु मीडिया के माध्यम से व्यापक प्रचार किया जाएगा।

3. उन समस्त मामलों में, जहां लाभार्थियों के अस्पष्ट बायोेमेट्रिक्स या किसी अन्य कारण से आधार प्रमाणन असफल रहता है, वहां निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृृत की जाएगी, अर्थात्‌्‌ः- (क) अस्पष्ट उंगली छाप क्वालिटी की दशा में आंख के पुतली स्कैन या चेहरा प्रणालीकरण प्रसुविधाएं प्रमाणीकरण के लिए अंगीकृृत की जाएगी तद्‌्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाएं प्रदान करने हेतु उंगली छाप प्रमाणन सहित आंख के पुतली स्कैन या चेहरा प्रमाणीकरण की प्रसुविधा की व्यवस्थाएं करेगा;

(ख) यदि उंगली छाप या आंख की पुतली का स्कैन या चेहरा प्रमाणीकरण के माध्यम से बायोमैट्रिक प्रमाणीकरण सफल नहीं है तो, जहां कहीं भी साध्य और अनुज्ञेय हो, वहां अधिप्रमाणक, यथास्थिति, एक बार आधार पासवर्ड द्वारा या सीमित समय वैधता सहित समय आधारित एक बार पासवर्ड सहित प्रदान किया जाएगा;

(ग) उन समस्त अन्य मामलों में जहां बायोमीट्रिक या एक बार आधार पासवर्ड या समय आधारित एक बार पासवर्ड प्रमाणीकरण सम्भव नहीं है तो, स्कीम के अधीन प्रसुविधाएं वस्तुगत आधार कार्ड, के आधार पर दी जाएंगी, जिसकी प्रामाणिकता आधार पर मुद्रित4457 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 तुरन्त प्रत्युत्तर कोड के माध्यम से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा अपने कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी।

4. उपरोक्त अन्तर्विष्ट किसी बात के होते हुए भी, किसी भी बालक को स्कीम के अन्तर्गत प्रसुविधा प्रदान करने से, यदि वह अधिप्रमाणन द्वारा पहचान सिद्ध करने में असफल रहता है, या आधार नम्बर धारण करने के सबूत प्रस्तुत न करने, या किसी ऐसे बालक, जिसे कोई आधार नम्बर समनुदेशित नहीं किया गया है की दशा में अभ्यावेशन के लिए आवेदन प्रस्तुत न करने पर इन्कार नहीं किया जाएगा। उसे पैरा 1 के उप पैरा (3) के परन्तुक के खण्ड (ख) और (ग) में यथा वर्णित अन्य दस्तावेजों के आधार पर, उसकी पहचान को सत्यापित करके प्रसुविधा प्रदान की जाएगी और जब प्रसुविधा प्रदान की गई है तो उसको रिकार्ड करने के लिए एक पृथक रजिस्टर अनुरक्षित किया जाएगा, जिसे विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से कालिकतः पुनरीक्षित किया जाएगा।

5. यह सुनिश्चित करने के आशय से कि कोई वास्तविक लाभार्थी (बालकों से अन्यथा) स्कीम के अधीन उनको देय प्रसुविधाओं से वंचित न हों, राज्य सरकार के सम्बद्ध विभाग और संघ क्षेत्रीय प्रशासन डी0 बी0 टी0 मिशन कैबिनेट सैक्रेेटेरिएट भारत सरकार के कार्यालय ज्ञापन डी-26011/04/2017 तारीख 19 दिसम्बर, 2017 (https:dbtbharat/gov.in/ पर उपलब्ध है) में यथाविनिर्दिष्ट अपवाद व्यवहृत क्रियाविधि का अनुसरण करेगा।

And whereas, the Department of Social Justice & Empowerment (hereinafter referred to as the Department), is administering the Rehabilitation Allowance to Lepers Scheme under Himachal Pradesh Social Security (Pension/allowance) Rules, 2010 (hereinafter referred to as the Scheme) to provide Rehabilitation Allowance to the patient of leprosy who have been identified by the Health Department irrespective of their age and annual income, which is being implemented through the District Welfare Officers under Directorate for the Empowerment of SCs, OBCs, Minorities & the Specially Abled of the Department; (hereinafter referred to as the Implementing Agency).

And whereas, under the Scheme, the amount of Rehabilitation Allowance to lepers as notified by the Government from time to time (hereinafter referred to as the benefit) is given to the4458 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 eligible patients of leprosy, (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh.

1. (1) An individual desirous of availing the benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent of his parents or guardians (in case of child beneficiaries) provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such children shall visit any Aadhaar enrolment centre [list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in] to get enrolled for Aadhaar.

Provided that till the time Aadhaar is assigned to the individual, the benefits under the Scheme shall be given to such individual, subject to production of the following documents, namely :—

I: For children below 18 years old—

(a) if the child has been enrolled after attaining the age of five years (with biometrics collection), his Aadhaar Enrolment Identification slip, or of bio-metric update identification slip; and

(b) anyone of the following documents, namely:—

(i) Birth Certificate; or Record of birth issued by the appropriate

authority; or

(ii) School identity card, duly signed by the Principal of the School,

containing parents' names; and

(C) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely:—

(i) Birth Certificate; or Record of birth issued by the appropriate

authority; or4459 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 (ii) Ration Card; or (iii) Ex-Servicemen Contributory Health Scheme (ECHS) Card; or Employees' State Insurance corporation (ESIC) Card; or Central Government Health Scheme (CGHS) Card;or

(iv) Pension Card;or (v) Army Canteen Card; or (vi) any Government Family Entitlement Card; or (v) any other document as specified by the Department:

II: For beneficiaries above 18 years old—

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and (b) any one of the following documents, namely :—

Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or (x) any other document as specified by the Department:

Provided further that the above documents shall be checked by an officer specifically designated by the Department for that purpose.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;

(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One-Time Password authentication is not possible, benefits under the scheme may4460 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. The benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses I (b) and I (C) of the proviso of sub-paragraph (3) of paragraph1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.

5. In order to ensure that no bonafide beneficiary (other than children) under the Scheme is deprived of his due benefits, the concerned Department in the State Governments and Union Territory Administrations shall follow the exception handling mechanism as specified in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India letter No. D-26011/04/2017-DBT dated the 19th December 2017 (available on https://dbtbharat.gov.in/).

6. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

स्कीम (जिसे इसमे इसके पश्चात्‌ प्रसुविधा कहा गया है) के अन्तर्गत सरकार द्वारा समय-समय पर यथा अधिसूचित कुष्ठ रोगी पुनर्वास भत्ता (जिसे इसमें इसके पश्चात्‌ भत्ता कहा गया है) की रकम पात्र कुष्ठ रोगियों को विभाग द्वारा विद्यमान स्कीम के मार्गदर्शक सिद्धांतों के अनुसार प्रदान किया जाता है। और पूर्वाक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि से उपगत होने वाला आवर्ती व्यय अन्तर्वलित है।

(1) स्कीम के अधीन प्रसुविधा प्राप्त करने की वांछा रखने वाले किसी व्यष्टि को एतद्‌द्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना होगा या आधार अधिप्रमाणन प्राप्त करना होगा। (2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वांछा रखने वाला कोई व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए नामांकित नहीं है, को माता-पिता या संरक्षक की सहमति के अध्यधीन (बालक लाभार्थी की दशा में) आधार के नामांकन के लिए आवेदन करना अपेक्षित होगा, यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसा बालक आधार का अभ्यावेशन करवाने के लिए आधार अभ्यावेशन केन्द्र [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0 आई0 डी0 ए0 आई0) वैबसाइट www uidai. gov.in/ पर उपलब्ध है] पर जाएगा।

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग को अपने कार्यान्वयन अभिकरण के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करना अपेक्षित है जो अभी तक आधार के लिए नामांकित नहीं है और यदि सम्बन्धित खण्ड या तालुका या तहसील में कोई आधार नामांकन केन्द्र स्थित नहीें है तो विभाग अपनी कार्यान्वयन अभिकरण के माध्यम से यू0 आई0 डी0 ए0 आई0 के विद्यमान रजिस्ट्रार के समन्वय में पर या स्वयं ही यू0 आई0 डी0 ए0 आई0 रजिस्ट्रार की हैसियत से सुविधाजनक स्थानों पर आधार नामांकन सुविधाएं प्रदान कर सकेगाः

I. अठारह वर्ष से कम आयु के बालकों के लिए-

(क) यदि बालक को पांच वर्ष की आयु (बायोमैट्रिक संग्रह सहित), प्राप्त करने के पश्चात्‌ नामांकित किया गया है, तो उसकी आधार नामांकन पहचान पर्ची या बायोमैट्रिक अपडेट पहचान पर्ची; और

(ख) निम्नलिखित में से कोई एक दस्तावेज, अर्थातः-

(i) जन्म प्रमाण पत्र; या समुचित प्राधिकारी द्वारा जारी जन्म का अभिलेख; या (ii) स्कूल के प्रिंसिपल द्वारा सम्यक्‌ रूप से हस्ताक्षरित माता-पिता के नाम से युक्त स्कूल पहचान कार्ड; और

(ग) विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार लाभार्थी के माता-पिता या विधिक संरक्षक के साथ सम्बन्ध के प्रमाण-पत्र के रूप में निम्नलिखित में से कोई दस्तावेज, अर्थात्‌ः4462 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 (i) जन्म प्रमाण-पत्र; या समुचित प्राधिकारी द्वारा जारी किए गए जन्म का अभिलेख; या

(ii) राशन कार्ड; या (iii) भूतपूर्व सैनिक अंशदायी स्वास्थ्य योजना (ई0 सी0 एच0 एस0) कार्ड; या कर्मचारी राज्य बीमा निगम (ई0 एस0 आई0 सी0) कार्ड; या केन्द्रीय सरकार स्वास्थ्य योजना (सी0 जी0 एच0 एस0) कार्ड; या

(iv) पेंशन कार्ड; या (v) सेना कैंटीन कार्ड; या (vi) कोई सरकारी कुटुम्ब हकदारी कार्ड; या (vii) विभाग द्वारा यथा विनिर्दिष्ट कोई अन्य दस्तावेज।

II. अठारह वर्ष से अधिक आयु के लाभार्थियों के लिए-

(क) यदि उसने स्वयं को अभ्यावेशित कर दिया है, तो उसकी आधार अभ्यावेशन पहचान पर्ची; और

(ख) निम्नलिखित में से कोई एक दस्तावेज है, अर्थात्‌्‌ :-

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा शासकीय शीर्षनामा पर जारी ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाणपत्र; या (x) विभाग द्वारा यथा विनिर्दिष्ट कोई अन्य दस्तावेजः

And whereas, under the Scheme, the amount of Old Age Pension as notified by the Government from time to time (hereinafter referred to as the benefit) is given to the eligible old age persons of 60 years and above, (hereinafter referred to as the beneficiaries) by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh.

1. (1) An individual desirous of availing the benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any individual desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent of his parents or guardians (in case of child beneficiaries) provided that he is entitled to obtain Aadhaar as per section 3 of the said Act, and such children shall visit any Aadhaar enrolment centre (list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar.

Provided that till the time Aadhaar is assigned to the individual, the benefits under the Scheme shall be given to such individual, subject to production of the following documents, namely :—

For beneficiaries above 18 years old

(a) if he has enrolled, his Aadhaar Enrolment Identification slip; and (b) any one of the following documents, namely :—

(i) Bank or Post office Passbook with Photo; or (ii) Permanent Account Number (PAN) Card; or (iii) Passport; or (iv) Ration Card; or (v) Voter Identity Card; or (vi) MGNREGA card; or4465 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 (vii) Kisan Photo passbook; or (viii) Driving license issued by the Licensing Authority under the Motor

Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or

(x) any other document as specified by the Department:

Provided further that the above documents shall be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through media shall be given to the beneficiaries to make them aware of the requirement of Aadhaar under the Scheme.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;

4. Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. The benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses I (b) and I (C) of the proviso of sub-paragraph(3) of paragraph1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.

5. In order to ensure that no bonafide beneficiary (other than children) under the Scheme is deprived of his due benefits, the concerned Department in the State Governments and Union Territory Administrations shall follow the exception handling mechanism as specified in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India letter No. D-26011/04/2017-DBT dated the19th December 2017 (available on https://dbtbharat.gov.in/).

संख्याः एस0जे0ई0-बी0-सी0(17)-1/ 2021.--सेवाआें या प्रसुविधाओं या सहायिकियों के परिदान के लिए आधार का एक पहचान दस्तावेज के रूप में उपयोग, सरकार की परिदान प्रक्रिया को सुगम बनाता है, पारदर्शिता और दक्षता लाता और लाभार्थियों को, सुविधाजनक और निर्बाध रीति में अपनी पहचान साबित करने के बहुविध दस्तावेज प्रस्तुत करने की आवश्यकता हटाकर प्रत्यक्षतः उन्हें हकदारियां प्राप्त करने हेतु समर्थ बनाता है;

सामाजिक न्याय एवं अधिकारिता विभाग (जिसे इसमें इसके पश्चात्‌्‌ विभाग कहा गया है) हिमाचल प्रदेश सामाजिक सुरक्षा (पैंशन/भत्ता) नियम, 2010 के अधीन वृद्धावस्था पैंशन प्रदान करने के लिए, उन वृद्धजनों को जिन्होनें 60 वर्ष या इस से ऊपर की आयु प्राप्त कर ली है, को बिना किसी आय के मानदण्ड से वृद्धावस्था पेंशन सकीम (जिसे इसमें इसके पश्चात्‌ स्कीम कहा गया है) प्रशासित कर रहा है जिसे अनुसूचित जाति, अन्य पिछड़ा वर्ग, अल्पसंख्यक और विशेष रूप से सक्षम विभाग (जिसे इसमें इसके पश्चात्‌ कार्यान्वयन अभिकरण कहा गया है) के अधीन जिला कल्याण अधिकारियों के माध्यम से कार्यान्वित किया जा रहा है। स्कीम के अन्तर्गत सरकार द्वारा समय-समय पर यथा अधिसूचित वृद्धावस्था पैंशन (जिसे इसमे इसके पश्चात्‌ प्रसुविधा कहा गया है ) 60 वर्ष या इससे अधिक की आयु के पात्र वृद्ध व्यक्तियों (जिन्हें इसमें इसके पश्चात्‌ लाभार्थी कहा गया है) को कार्यान्वयन अभिकरण द्वारा विद्यमान स्कीम के मार्गदर्शन सिद्धान्तों के अनुसार प्रदान किया गया है।

और पूर्वाक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि से उपगत होने वाला आवर्ती व्यय अन्तर्वलित है।

अतः हिमाचल प्रदेश सरकार, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18), (जिसे इसमें इसके पश्चात्‌्‌ उक्त अधिनियम कहा गया है), की धारा 7 के अनुसरण में एतद्‌द्वारा निम्नलिखित अधिसूचित करते हैं, अर्थात्‌्‌ः-

(1) स्कीम के अधीन प्रसुविधा प्राप्त करने की वांछा रखने वाले किसी व्यष्टि को एतद्‌द्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना होगा या आधार अधिप्रमाणन प्राप्त करना होगा। (2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वांछा रखने वाला कोई व्यष्टि, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए नामांकित नहीं है, को माता-पिता या संरक्षक की सहमति के अध्यधीन (बालक लाभार्थी की दशा में) आधार के नामांकन के लिए आवेदन करना अपेक्षित होगा, यदि वह उक्त अधिनियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसा बालक आधार का अभ्यावेशन करवाने के लिए आधार अभ्यावेशन केन्द्र4467 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 [सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0 आई0 डी0 ए0 आई0) वैबसाइट www uidai. gov.in/ पर उपलब्ध है] पर जाएगा।

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग को अपने कार्यान्वयन अभिकरण के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करना अपेक्षित है जो अभी तक आधार के लिए नामांकित नहीं है और यदि सम्बन्धित खण्ड या तालुका या तहसील में कोई आधार नामांकन केन्द्र स्थित नहीें है तो विभाग अपनी कार्यान्वयन अभिकरण के माध्यम से यू0 आई0 डी0 ए0 आई0 के विद्यमान रजिस्ट्रार के समन्वय में पर या स्वयं ही यू0 आई0 डी0 ए0 आई0 रजिस्ट्रार की हैसीयत से सुविधाजनक स्थानों पर आधार नामांकन सुविधाएं प्रदान कर सकेगाः

अठारह वर्ष से अधिक आयु के लाभार्थियों के लिए

(ख) निम्नलिखित में से कोई एक दस्तावेज, अर्थात्‌्‌ :-

(ix) राजपत्रित अधिकारी या तहसीलदार द्वारा शासकीय शीर्षनामा पर जारी ऐसे व्यक्ति के फोटो की पहचान वाला प्रमाणपत्र; या (x) विभाग द्वारा यथा विहित कोई अन्य दस्तावेजः

परन्तु यह और कि उपरोक्त दस्तावेजों की विभाग द्वारा उस, प्रयोजन के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा जांच की जाएगी।

2. स्कीम के अधीन लाभार्थियों को सुविधापूर्वक प्रसुविधाएं उपलब्ध करवाने के आशय से अपने कार्यान्वयन अभिकरण के माध्यम से विभाग यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि स्कीम के अधीन आधार की अपेक्षाओं हेतु उन्हें जागरूक करने के लिए, लाभार्थियों हेतु मीडिया के माध्यम से व्यापक प्रचार किया जाएगा।

4468 राजपत्र, हिमाचल प्रदेश, 31 अगस्त, 2022/09 भाद्रपद, 1944 (ख) यदि उंगली छाप या आंख की पुतली का स्कैन या चेहरा प्रमाणीकरण के माध्यम से बायोमैट्रिक प्रमाणीकरण सफल नहीं है तो, जहां कहीं भी साध्य और अनुज्ञेय हो, वहां अधिप्रमाणक, यथास्थिति, एक बार आधार पासवर्ड द्वारा या सीमित समय वैधता सहित समय आधारित एक बार पासवर्ड सहित प्रदान किया जाएगा;

(ग) उन समस्त अन्य मामलों में जहां बायोमीट्रिक या एक बार आधार पासवर्ड या समय आधारित एक बार पासवर्ड प्रमाणीकरण सम्भव नहीं है तो, स्कीम के अधीन प्रसुविधाएं वस्तुगत आधार कार्ड, के आधार पर दी जाएंगी, जिसकी प्रामाणिकता आधार पर मुद्रित तुरन्त प्रत्युत्तर कोड के माध्यम से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा अपने कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी।

4. उपरोक्त अन्तर्विष्ट किसी बात के होते हुए भी, किसी भी बालक को स्कीम के अन्तर्गत प्रसुविधा प्रदान करने से, यदि वह अधिप्रमाणन द्वारा पहचान सिद्ध करने में असफल रहता है, या आधार नम्बर धारण करने के सबूत प्रस्तुत न करने, या किसी ऐसे बालक, जिसे कोई आधार नम्बर समनुदेशित नहीं किया गया है की दशा में अभ्यावेशन के लिए आवेदन प्रस्तुत न करने पर इनकार नहीं किया जाएगा। उसे पैरा 1 के उप पैरा (3) के परन्तुक के खण्ड (ख) और (ग) में यथावर्णित अन्य दस्तावेजों के आधार पर, उसकी पहचान को सत्यापित करके प्रसुविधा प्रदान की जाएगी और जब प्रसुविधा ऐसे अन्य दस्तावेजों के आधार पर प्रदान की गई है तो उसको रिकार्ड करने के लिए एक पृथक रजिस्टर अनुरक्षित किया जाएगा, जिसे विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से कालिकतः पुनरीक्षित किया जाएगा।

5. यह सुनिश्चित करने के आशय से कि कोई वास्तविक लाभार्थी (बालकों से अन्यथा) स्कीम के अधीन उनको देय प्रसुविधाओं से वंचित न हों, राज्य सरकार के सम्बद्ध विभाग और संघ क्षेत्रीय प्रशासन डी0 बी0 टी0 मिशन कैबिनेट सैक्रेटेरिएट भारत सरकार के कार्यालय ज्ञापन डी-26011/04/2017 तारीख 19 दिसम्बर, 2017 (https:dbtbharat/gov.in/ पर उपलब्ध है) में यथाविनिर्दिष्ट अपवाद व्यवहृत क्रियाविधि का अनुसरण करेगा।
