संख्याः राजस्व-घ/(एफ) 4-7/2020-(कुल्लू).--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) की धारा 6 और रजिस्ट्रीकरण अधिनियम, 1908 (1908 का अधिनियम संख्यांक 16) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तहसील सैंज, जिला 153—राजपत्र/2022-17-10-2022 (5793) 5794 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2022/25 आश्विन, 1944 कुल्लू से बुंगा पटवार वृत्त को अपवर्जित करने और इसे तहसील बंजार, जिला कुल्लू में क्रमशः सम्मिलित करने के सहर्ष आदेश देते हैं। इस पुनर्गठन के पश्चात्‌ तहसील सैंज तथा तहसील बंजार की स्थिति निम्न प्रकार होगीः-

No. Rev-D(F)4-7/2020-(Kullu).—In exercise of the powers conferred by section 6 of the Himachal Pradesh Land Revenue Act, 1954 (Act No. 6 of 1954) and section 5 of the Registration Act, 1908 (Act No. 16 of 1908), the Governor, Himachal Pradesh is pleased to exclude Patwar Circle Bunga from Tehsil Sainj, District Kullu and to include the same in Tehsil Banjar, District Kullu. After this re-organization, the position of Tehsil Sainj and Tehsil Banjar will be as under :—

संख्याः राजस्व-डी(ए)1-7/2021-लूज(शिमला).--हिमाचल प्रदेश के राज्यपाल की यह राय है कि लोक हित में ऐसा करना आवश्यक और समीचीन है कि जिला शिमला, हिमाचल प्रदेश में एक नई उप-तहसील कोटी सृजित की जाए, ताकि नजदीक के गावों के लोगों को बेहतर सेवाएं उपलब्ध करवाई जा सकें और जिससे उनको होने वाली किसी असुविधा से निवारित किया जा सके तथा बेहतर प्रशासनिक नियंत्रण हो सके;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) की धारा 6 और रजिस्ट्रीकरण अधिनियम, 1908 (1908 का अधिनियम संख्यांक 16) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, जिला शिमला, हिमाचल प्रदेश में तहसील जुन्गा के प्रशासनिक नियंत्रण के अधीन निम्न स्तम्भ संख्या 6 में दर्शाए गए 5 पटवार वृत्तों से गठित एक नई उप-तहसील कोटी, जिसका मुख्यालय कोटी में होगा, का तुरन्त प्रभाव से सृजन करते है :-

No. Rev-D(A)1-7/2021-Loose(SML).—WHEREAS, the Governor of Himachal Pradesh is of the opinion that it is necessary and expedient in the public interest to create a new Sub-Tehsil Koti in District Shimla, Himachal Pradesh, so as to provide better services to the people of nearby villages and to avoid any inconvenience being faced by them and to have better administrative control;

NOW, THEREFORE, in exercise of the powers conferred by section 6 of the Himachal Pradesh Land Revenue Act, 1954 (Act No. 6 of 1954) and section 5 of the Registration Act, 1908 (Act No. 16 of 1908), the Governor of Himachal Pradesh is pleased to create a new Sub-Tehsil Koti with its headquarter at Koti under administrative control of Tehsil Shimla (Rural) in District Shimla, Himachal Pradesh, consisting of 5 Patwar Circles shown in column No.6 below with immediate effect:—

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश भू-राजस्व अधिनियम, 1954 (1954 का अधिनियम संख्यांक 6) की धारा 6 और रजिस्ट्रीकरण अधिनियम, 1908 (1908 का अधिनियम संख्यांक 16) की धारा 5 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, जिला बिलासपुर, हिमाचल प्रदेश में तहसील झण्डूता के प्रशासनिक नियंत्रण के अधीन निम्न स्तम्भ संख्या 6 में दर्शाए गए 4 पटवार वृत्तों से गठित एक नई उप-तहसील तलाई, जिसका मुख्यालय तलाई में होगा, का तुरन्त प्रभाव से सृजन करते हैं :-

No. Rev-D(A)1-3/2021(BLP).—WHEREAS, the Governor of Himachal Pradesh is of the opinion that it is necessary and expedient in the public interest to create a new Sub-Tehsil Talai in District Bilaspur, Himachal Pradesh, so as to provide better services to the people of nearby villages and to avoid any inconvenience being faced by them and to have better administrative control;

NOW, THEREFORE, in exercise of the powers conferred by Section 6 of the Himachal Pradesh Land Revenue Act, 1954 (Act No. 6 of 1954) and Section 5 of the Registration Act, 1908 (Act No. 16 of 1908), the Governor of Himachal Pradesh is pleased to create a new Sub-Tehsil Talai with its headquarter at Talai under administrative control of Tehsil Jhanduta in District Bilaspur, Himachal Pradesh, consisting of 4 Patwar Circles shown in column No.6 below, with immediate effect:—

स्ांख्या: जीएडी-ए(बी)3-1/77-II.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, हिमाचल प्रदेश सचिवालय, (सामान्य प्रशासन विभाग) में मैकेनिक, वर्ग-III (अराजपत्रित) के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध "क" के अनुसार भर्ती और प्रोन्नति, नियम बनाते हैं, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(i) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सचिवालय, (सामान्य प्रशासन विभाग), मैकेनिक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2022 हैं।

(ii) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. निरसन और व्यावृत्तियां.--(i) इस विभाग की अधिसूचना संख्या जीएडी-ए(बी)3)-1/77-II, दिनांक 31-8-2001 द्वारा अधिसूचित और तारीख 03 नवम्बर, 2001 को राजपत्र, हिमाचल प्रदेश में प्रकाशित, हिमाचल प्रदेश सचिवालय (सामान्य प्रशासन विभाग) मकैनिक, वर्ग-III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2011 का एतद्‌द्वारा निरसन किया जाता है।

(ii) ऐसे निरसन के होते हुए भी उपर्युक्त उपनियम (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

7. सीेधी भर्तीे किए जाने वाले व्यक्ति (व्यक्तियों) के लिए अपेक्षित शैक्षिक और अन्य अर्हताएं.--लागू नहीं।

9. परिवीक्षा की अवधि, यदि कोई हो.--दो वर्ष, जिसका, एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणों को लिखित में अभिलिखित करके आदेश दे।

10. भर्ती की पद्धति, भर्ती सीधी होगी या प्रोन्नति/सैकेण्डमैंट/स्थानातंरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदां)े की प्रतिशतता.--शत प्रतिशत सीधी भर्ती द्वारा, ऐसा न होने पर सैकेंडमैंट आधार पर।

11. प्रोन्नति/सैकेण्डमैंट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियांं (गे्रड) जिनसे प्रोन्नति/ सैकेण्डमैन्ट/स्थानान्तरण किया जाएगा.--फिटरों/कनिष्ठ तकनीशियन(नों) (ऑटो इलैक्ट्रीशियन) में से प्रोन्नति द्वारा जिनका पांच वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को परिमलित करके पांच वर्ष का नियमित सेवाकाल हो ऐसा न होने पर हिमाचल प्रदेश सरकार के अन्य विभागोें से इस पद पर समतुल्य वेतनमान में कार्यरत मैकेनिकों में से सैकेंडमैंट आधार परः

परन्तु प्रोन्नति के प्रयोजन के लिए, फिटरों और कनिष्ठ तकनिशिन(नों) (ऑटो इलैक्ट्रीशियन) की बाबत, उनके अपने-अपने संवर्ग में, उनकी नियुक्ति की तारीख से उनके सेवाकाल के आधार पर, उनकी युनिटवाइज़ पारस्परिक वरिष्ठता को छेड़े बिना संयुक्त वरिष्ठता सूची तैयार की जाएगीः

(1) परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/कठिन/दुर्गम/अगम्य क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगीः

परन्तु यह और कि उपर्युक्त परन्तुक (1) उन कर्मचारियों के मामले में लागू नहीं होगा, जिनकी अधिवर्षिता के लिए पांच वर्ष की या उससे कम की सेवा शेष रही हो। तथापि उनकी प्रोन्नति के ऐसे पदधारियों की तैनाती/ स्थानान्तरण दूरस्थ/ग्रामीण क्षेत्रों में की जा सकेः5817 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2022/25 आश्विन, 1944 परन्तु यह और भी कि उस अधिकारी/कर्मचारी को, जिसने जनजातीय/दुर्गम/अगम्य क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, उसके अपने संवर्ग (काडर) में सर्वथा उसकी वरिष्ठता के अनुसार स्थानान्तरित किया जाएगा।

स्पष्टीकरण I.— उपर्युक्त परन्तुक (1) के प्रयोजन के लिए जनजातीय/दुर्गम/अगम्य क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में "कार्यकाल" से, प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए, साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी।

स्पष्टीकरण II.--उपर्युक्त परन्तुक (1) के प्रयोजन के लिए जनजातीय/दुर्गम क्षेत्र निम्न प्रकार से होंगेः- 1. जिला लाहौल एवं स्पिति। 2. चम्बा जिला का पांगी और भरमौर उप-मण्डल। 3. रोहड़ू उपमण्डल का डोडरा क्वार क्षेत्र। 4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनीश, दरकाली और ग्राम पंचायत काशापाट।

5. जिला कुल्लू का पन्द्रह बीस परगना। 6. कांगड़ा जिला के बैजनाथ उप-मण्डल का बड़ा भंगाल क्षेत्र। 7. जिला किन्नौर। 8. सिरमौर जिला में, उप तहसील कमरउ के काठवाड़ और कोरगा पटवार वृत्त, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृत्त और शिलाई तहसील का कोटा पाब पटवार वृत्त। 9. मण्डी जिला में, करसोग तहसील का खनयोल-बगड़ा पटवार वृत्त, बाली चौकी उपतहसील के गाड़ा गुशैणी, मठियानी, घनयाड़, थाची, बागी, सोमगाड और खोलानाल, पटवार वृत, पद्धर तहसील के झारवाड़, कुटगढ़ ग्रामन, देवगढ, ट्रैला, रोपा, कथोग, सिलह-भडवानी, हस्तपुर, घमरेहर और पटवार वृत, थुनाग तहसील के चिउणी, कालीपार, मानगढ़, थाच-बगड़ा उत्तरी मगरू और दक्षिणी मगरू पटवार वृत और सुन्दरनगर तहसील का बटवाड़ा पटवार वृत। स्पष्टीकरण III.—उपर्युक्त परन्तुक (1) के प्रयोजन के लिए और दूरस्थ़/ग्रामीण क्षेत्र निम्न प्रकार से होंगेः- (i) उप-मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान (ii) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहां के लिए बस सेवा उपलब्ध नहीं है और 3 (तीन) किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है।

(iii) कर्मचारी का, उसके प्रवर्ग को घ्यान में लाए बिना अपने गृह नगर या गृह नगर क्षेत्र के साथ लगती 20 किलोमीटर की परिधि के भीतर का क्षेत्र।

(2) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्त से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः

(i) परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे ओैर विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएगेः 5818 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2022/25 आश्विन, 1944 परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.--अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जो आपातकाल की अवधि के दौरान सशस्त्र बलों में भर्ती हुए हैं और जिसे डिमोबिलाइज्ड आर्मड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन हिमाचल स्टेट नॉन-टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत्‌ भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसिज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत्‌ भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(ii) इसी प्रकार, स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबंधों के अनुसार की गई थी :

परन्तु की गई तदर्थ सेवा को गणना में लेने के पश्चात्‌ स्थाईकरण के फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

12. यदि विभागीय प्रोन्नति समिति/ विभागीय स्थायीकरण समिति विद्यमान है तो उसकी संरचना.--(क) विभागीय प्रोन्नति समिति : जैसी सरकार द्वारा समय-समय पर गठित की जाए। (ख) विभागीय स्थायीकरण समिति : लागू नहीं ।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षाः.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयनः.--लागू नहीं

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिये सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.--लागू नहीं ।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।5819 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2022/25 आश्विन, 1944

No. GAD-A(B)3-1/77-II.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment and Promotion Rules for the post of Mechanic, Class-III (Non-Gazetted), in the General Administration Department, Himachal Pradesh Secretariat, as per Annexure "A" attached to the notification, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Secretariat (General Administration Department), Mechanic, Class-III (Non Gazetted) Recruitment and Promotion Rules, 2022.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Repeal and savings. —(1) The Himachal Pradesh Secretariat(General Administration Department), Mechanic Class-III (Non Gazetted) Recruitment and Promotion Rules, 2001 notified vide this Department Notification No. GAD-A(B)3-1/77-II, dated 31-08-2001 and published in Rajpatra, Himachal Pradesh dated 3rd November, 2001 are, hereby, repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the rules so repealed under sub-rule (1) supra, shall be deemed to have been validly made or done or taken under these rules.

ANNEXURE-"A" RECRUITMENT AND PROMOTION RULES FOR THE POST OF MECHANIC, CLASS- III (NON-GAZETTED) IN THE DEPARTMENT OF GENERAL ADMINISTRATION, HIMACHAL PRADESH SECRETARIAT

1. Name of the post.—Mechanic

2. Number of post:.—02 (Two)

3. Classification.—Class-III (Non-Gazetted)

4. Scale of pay.—Pay scale : Level-6 of Pay Matrix of ` 25600-81200/- of the H.P. Civil Services (Revised Pay) Rules, 2022.

6. Age for direct recruitment.—Not applicable

7. Minimum educational and other qualifications required for direct recruit (s).—(a) Essential Qualification(s) : Not applicable

(b) Desirable Qualification(s) : Not applicable

8. Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of the promotee(s).—Age : Not applicable.

9. Period of probation, if any.—Two years, subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

10. Method(s) of recruitment, whether by direct recruitment or by promotion/secondment/transfer and the percentage of post(s) to be filled in by various methods.—100% by promotion failing which on secondment basis.

11. In case of recruitment by promotion/secondment/ transfer, grade(s) from which promotion/ secondment/transfer is to be made.—By promotion from amongst the Fitter/Junior Technician(s) (Auto Electrician) who possess five years regular service or regular combined with continuous adhoc service, if any, in the grade failing which on secondment basis from amongst Mechanics working in the identical pay scale of this post from other H.P. Government Departments:

Provided that for the purpose of promotion a combined seniority list in respect of Fitters and Junior Technician(s) (Auto Electrician) on the basis of length of service from their date(s) of appointment(s) in their respective cadre without disturbing their unitwise inter-se-seniority, shall be prepared.

(I) Provided that for the purpose of promotion every employee shall have to serve atleast one term in the Tribal/Difficult/Hard areas and remote/rural areas subject to adequate number of post(s) available in such areas:

Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation. However, such incumbents may be posted/transferred to remote/rural areas in their promotion:

Provided further that Officers/Officials who have not served atleast one tenure in Tribal/Difficult/Hard areas and remote/rural areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation I.—For the purpose of proviso (I) supra the "term" in Tribal/ Difficult/Hard areas and remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/convenience.

Explanation II—For the purpose of proviso (I) supra the Tribal/Difficult Areas shall be as under:—

1. District Lahaul & Spiti. 2. Pangi and Bharmour Sub Division of Chamba District.

3. Dodra Kawar Area of Rohru Sub Division. 4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashpat of Rampur Tehsil of District Shimla.

5. Pandrah Bis Pargana of Kullu District. 6. Bara Bhangal Areas of Baijnath Sub Division of Kangra District. 7. District Kinnaur. 8. Kathwar and Korga Patwar Circles of Kamrau Sub Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil, in Sirmaur District.

9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada-Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of Bali-Chowki Sub Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa, Kathog, Silh-Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh, Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Batwara Patwar Circle of Sunder Nagar Tehsil in Mandi District.

Explanation III.—For the purpose (I) supra the Remote/Rural Areas shall be as under :—

(i) All stations beyond the radius of 20 Kms. from Sub Division/Tehsil headquarters. (ii) All stations beyond the radius of 15 Kms. from State Headquarters and District headquarters where bus service is not available and on foot journey is more than 3 (three) Kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the employee regardless of its category.

(II) In all cases of promotion, the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the conditions that the ad hoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules:

(i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis following by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be in-eligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible persons happened to be Ex-servicemen who have joined Armed Forces during the period of emergency and recruited under the provisions of rule-3 of Demobilized Armed Forces Personnel (Reservation of vacancies in Himachal State Non-Technical Services) Rules, 1972 and having been given the benefit of Seniority thereunder or recruited under the provisions of rule-3 of Ex-Servicemen (Reservation of Vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.

(ii) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post, if any, prior to the regular appointment against such posts shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered shall remain unchanged.

12. If a Departmental Promotion/ Departmental Confirmation Committee exists, what is its composition.—(a) Departmental Promotion Committee : As may be constituted by the Government from time to time.

(b) Departmental Confirmation Committee : Not applicable

13. Circumstances under which the Himachal Pradesh Public Service Commission

(H.P.P.S.C.) is to be consulted in making recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—Not applicable

15. Selection for appointment to the post by direct recruitment.—Not applicable

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/ Scheduled Tribal/ Other Backward Classes/ other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Not Applicable

18. Power to Relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any class or category of person(s) or post(s).

No. Agr. B-B(8)-3/2022.—The Governor, Himachal Pradesh is pleased to revise the pay structure of the existing teaching/equivalent personnel of Himachal Pradesh Krishi Vishvavidyalaya, Palampur as notified vide this department notification No. Agr. A(10)-5/82-III dated 30th November, 2009 in the revised Pay Matrix with effect from 1-1-2016 as per following detail.

The pay of the above mentioned teaching/equivalent personnals of CSKHPKV Palampur by way of allowing conversion/fixation at the corresponding appropriate level in the Pay Matrix as mentioned in Annexure-I appended to this notification by multiplying the existing basis pay (Pay in the Pay Band plus Academic Grade Pay) as on 31-12-2015 or as per option exercised (According to Annexure-III), by a factor of 2.57, on or with effect from 1st January, 2016, subject to the following conditions:—

1. Existing staff/post structure/nomenclature/staffing pattern shall not be changed/disbursed.

2. Revised pay be given from prospective effect/date. Arrears from 01-01-2016 to date may be paid as per State Govt. orders to be issued separately.

3. Benefits of career Advancement scheme already allowed under existing pay structures, Scales till the date of issue of this notification be protected in case of eligible academic staff by allowing only conversion.

4. Career Advancement scheme and Incentive Increments on attaining the higher qualification will be allowed on issuance of separate orders by the State Government. 5. Revised Dearness Allowance be allowed on revision of pay structure as per letter No. Fin.(C) –B(7)-1/2001 dated 3rd January, 2022.

6. The Interim Relief already allowed to the employees from time to time shall be adjusted in the revised emoluments and the employees shall be entitled to draw only the additional amount on account of the difference between revised emoluments and the emoluments is drawn by the employees on the corresponding date. In case, emoluments in the revise pay structure becomes lower than the emoluments being drawn on the corresponding date, due to payment of interim relief, the extra amount , if any , shall be adjusted against the pay arrear and future increases of salary on account of grant of annual increments/dearness allowance etc.

7. An undertaking as per Annexure-II shall be taken from every employee to the effect that any excess payment made on account of incorrect fixation of pay in the revised pay Level or grant of inappropriate pay level and pay cells or any other excess payment made shall be adjusted against the future payments due or otherwise to the employee.

8. The annual increments to each employee will be granted by moving up from the existing cell to the immediate next higher cell in the same level. A Government employee who reaches the maximum of the Pay Matrix level applicable to him shall not be granted any further increment.

9. The orders regulating all other allowances and entitlements by whatsoever name called, including Special Pay/Allowance, HRA, TA etc. will be governed by existing orders of the Government issued with reference to pre-revised pay structures, until separate orders are issued revising the old rates.

10. The pay of the Vice-Chancellor shall be fixed at Rs. 2,10,000 (Fixed).

This issues with the prior concurrence of the Finance Department obtained vide their U.O.No.5513195-Fin-E dated 24-09-2022.

Guidelines for Voting through postal ballot by Absentee Voters in the category of Senior

Citizens, PwDs and Covid-19 suspect or affected persons

1. In pursuance of the Conduct of Elections (Amendment) Rules, 2019, and the Conduct of Elections (Amendment) Rules, 2020 read with the Election Commission's decision dated 16th July, 2020 following categories of Absentee voters have been given the facility of voting through postal ballot(PB) paper:

(i) Senior citizens (above 80 years of age),

(ii) Persons with disability flagged in the database for electoral roll and

(iii) COVID 19 suspect or affected persons.

2. Process for applying PB by absentee voters.

(2.1) An Absentee Voter wishing to vote by postal ballot has to make application to the Returning Officer (RO) of the constituency concerned, in Form-12D, giving all requisite particulars. Such application seeking postal ballot facility should reach to the RO from date of announcement of election to five days following the date of notification of the election concerned.

(2.2) As per the amended provisions under Rule 27E and 27-1 of CER, 1961 the issue of Postal ballot paper to the absentee voter and return of the ballot paper after voting shall be in such manner as the Commission may direct. Accordingly, the Commission has laid down the following procedure/ guidelines for facilitating voting through postal ballot by the absentee voters of senior citizen category (AVSC), absentee voters belonging to PWD category (AVPD) and absentee voters belonging to COVID 19 category (AVCO)

(2.3) If any elector at the time of election is hospitalized on account of COVID-19, in a hospital within the State or is in Home/ Institutional Quarantine on account of COVID- 19 and hence not be in a position to cast vote personally at the polling station as per medical advice and if such elector makes request for issue of Postal Ballot, the RO concerned, on being satisfied about the genuineness of the application, shall provide5841 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2022/25 आश्विन, 1944 the postal ballot to the elector. The RO shall make arrangement to deliver Postal Ballot and to get the same collected back from the said elector before the date fixed for poll in the Constituency. This arrangement shall be made in coordination with the Nodal Officer for COVID19, designated by the Chief Secretary, on the directions of the Commission. Application for postal ballot paper from such electors (Form 12D) should be accompanied by copy of certificate/ instructions from competent health authorities which show that the applicant is hospitalized in the State or is in quarantine within the State (Home or Institutional) on account of COVID 19.

2.4 In case of absentee voters belonging to PWD category (AVPD), who opt for postal

ballot, application (Form 12D) should be accompanied by a copy of benchmark

disability certificate (not less than 40% of a specified disability) as certified by the

concerned certifying authority, under Section 2 of the Rights of Persons with

Disabilities Act, 2016.

3. Action by RO-

(3.1) Distribution of Form 12D by BLO:

(a) BLO will visit to the houses of the absentee voters in category of AVSC, AVPD

and AVCO, as per details provided by the RO, in the Polling Station area and

deliver Form 12D to the concerned electors and obtain acknowledgements from

them.

(b) BLO shall deposit all the Acknowledgements obtained from the electors with the

RO.

(c) If an elector is not available, BLO will share his/her contact details and revisit to

collect it within period of five days following the date of the notification.

(d) The elector may or may not opt for Postal Ballot. If he/she opts for Postal Ballot,

then the BLO will collect the filled-in-Form 12D from the house of the elector and

deposit with the RO forthwith within period of five days following the date of the

notification.

(e) Sector Officer shall supervise the process of distribution and collection of Form

12D by BLOs under the overall supervision of RO.

(3.2) The RO will draw a list (form at as annexure-l) of all Absentee Voters in the 3 categories, i.e.(a) 'AVSC', (b) 'AVPD' and (c)AVCO, whose applications have been received in time and are in order.

(3.3) On the last date for making nominations for the election, the electoral roll is frozen for that election and no further addition or deletion can be carried out in the roll till the completion of the election. At this stage, RO shall verify and ensure that the applicants for postal ballots are registered as elector and their electoral particulars given in Form 12-D are correct with reference to the existing electoral roll. Form 12D of all the electors, whose particulars with reference to the electoral roll have been found to be correct, shall be approved for issue of postal ballot paper as Absentee Voters in the category of AVSC and AVPD. In case of Absentee Voters belonging to the category of COVID-19 (AVCO), before approving FORM 12D, for postal ballot the RO shall check certificate of competent authority, duly appointed by the State Government /UT administration to the effect that the elector is under home quarantine or institutional quarantine due to COVID-19.

(3.4) The RO shall indicate entry 'PB' in the marked copy of the electoral roll against the names of such electors, to show that a postal ballot paper has been issued to them, without however recording therein the Sl. no. of the ballot papers issued to them.

(3.5) The RO shall also ensure that elector who has been issued postal ballot is not allowed to vote at a polling station.

(3.6) Further, the RO shall share list of all such PwD and 80+ electors, whose

applications in Form 12D for availing Postal Ballot facility have been approved

by him, with the Contesting Candidates of recognized political parties in printed

hardcopy.

4. Form and design of Postal ballot paper:

The postal ballot paper for Absentee Voters shall be of the same Form and language as the postal ballot paper for the voters on election duty. In this connection, reference is invited to the Commission's Directions No. 52/2015/SDR/Vol.1 dated 18th September, 2015 and 52/2016/SDR/ Vol.1 dated 24th February, 2016, regarding the Form of postal ballot paper for voters on election duty (copy enclosed).

5. Visits of Polling Officials, briefing of electors and collection of marked ballot

papers:

(5.1) Separate teams of poll officers, comprising two officials out of which at least one should be not below the rank/level of the official appointed as polling officer for Polling Station in the State, should be appointed for the purpose. A micro observer should also accompany the teams of Poll officers.

(5.2) Number of teams of Poll Officers to be appointed would depend on the number of Absentee Voters in the constituency to whom postal ballot papers have been issued.

(5.3) The team of poll officers shall visit the electors at the address mentioned in their application in Form 12D for facilitating their voting by postal ballot paper.

(5.4) The electors will be intimated, in advance, about the date and approximate time of visit of poll officers. Such intimation may be given through SMS on the mobile phone number wherever the same has been mentioned in the application in Form-12D. In other cases, the intimation may be given by post and/or through the BLO.

(5.5) If the elector is not present at the given address at the first visit, the team shall pay a second visit after leaving intimation about the time of second visit. If the elector is not present even at the second visit, no further visit or action is required in his/her case.

(5.6) The candidates shall be informed about the schedule of visit for the delivery and collection of postal ballots for this category. They may, if desired, depute their authorized representatives (including BLAs), with prior intimation to the Returning Officer, to watch the process.

(5.7) The list of AVSCs, AVPDs and AVCOs shall be divided for distribution among the different teams of Poll Officers in such manner that each team gets a list of persons in geographically compact area.

(5.8) The visiting poll officers shall ascertain the identity of the elector before issuing postal ballot paper.

(5.9) Name of elector and the document produced for identification shall also be entered in a register (annexed as annexure-2) to be maintained for the purpose, and signature/thumb impression of the elector obtained therein. Further, a tick mark shall be placed against the name of the elector in the list of AVSC, AVPD and AVCO to indicate that the person has voted. The counterfoil with the serial number and part number of elector duly filled up shall be got detached and kept in safe custody by the team.

(5.10) It shall be the responsibility of each team of poll officers to (a) issue postal ballot to each of the Absentee Voters assigned to it, (b) brief the elector about the procedure to be followed for voting through postal ballot, (c) make sure that the elector votes without anyone influencing his/her choice, and ensuring the secrecy of voting, all activities at the address of the elector concerned. However, if any elector is not able to cast vote by himself due to blindness or physical infirmity, he/she shall be allowed to take the assistance of any adult person for casting vote. In this matter, all the provisions of Rule 49N of Conduct of Elections Rules, 1961will be applicable the companion has to give declaration in the Form prescribed by the Commission and Poll officers shall keep a record of such cases in Form 14A, assistance of polling agents or candidates or prohibited parties may not be taken. The companion should keep the vote secret and he/she can be acted as the companion of only one elector.

(5.11) While briefing the electors about the procedure of voting and formalities to be observed on their part, the polling official shall clearly explain the following points to them:

(a) making the declaration in Form 13A and getting it attested by the poll officer himself, (b) entering the serial number of postal ballot paper, both on Form13A and on the smaller envelope (Form 13B)

(c) manner of marking vote, i.e. by placing either cross mark or tick mark against the name of the candidate of choice,

(d) folding and placing the marked ballot in the smaller envelope and closing the envelope, (e) Placing the declaration in Form 13A, duly filled up, signed and attested alongwith closed envelope (Form 13B) containing the marked ballot paper inside the larger envelope (Form 13C),

(f) Closing the larger envelope and handing over the same to the poll officer.

(5.12) Poll officer is authorized to attest the declaration in Form 13A in the case of AVSC, AVPD and AVCO. While attesting the declaration, the poll officer shall write his full name and also the designation 'poll officer'. In the case of a COVID affected person on treatment in Hospital, the Medical Officer attending to the person also authorized to attest the declaration.

(5.13) After vote is cast on postal ballot and the envelope in Form 13C is ready, the Poll Officers will collect the same.

(5.14) Each team of poll officers should be provided with the list of AVSC, AVPD and AVCO electors, adequate number of postal ballot papers, envelopes, pen, ink-pad (for thumb impression wherever required), glue stick for closing the envelopes, a5844 राजपत्र, हिमाचल प्रदेश, 17 अक्तूबर, 2022/25 आश्विन, 1944 sufficiently big canvas bag for keeping the envelopes of polled ballots and the counterfoils safely and other essential stationeries that may be considered necessary.

(5.15) Police Security cover shall be provided to the poll officers for their visits. Arrangement for videography of the proceedings at the address of AVSC/ AVPD/AVCO should also be made. For this purpose, a videographer should accompany the poll officers. It shall be ensured that the secrecy of vote is not violated while carrying out the videography exercise.

(5.16) Visits by teams of poll officers to the address of AVSC, AVPD and AVCO electors should be planned in such a way that the same is completed one day prior to the date fixed for poll in the constituency. For instance, if poll is scheduled for 10th of Month, the postal voting for AVSC, AVPD and AVCO should be completed by 9th of that Month.

(5.17) For the poll officers deputed to AVCO electors appropriate protection equipment including PPE kit shall be provided. This should be done in Consultation with the Nodal Health Officer for AVCOs.

6. Deposit of envelopes containing marked ballot papers and counterfoils

At the end of each day of visit by poll officers to the address of AVSC/AVPD/AVCO electors, the envelopes in Form-l3C containing postal ballot paper etc. and the counterfoils of ballot papers containing the signature/thumb impression of electors and other particulars, shall be collected by the ARO designated of postal voting by the absentee voters. The ARO shall make arrangements to have the same delivered at the headquarters of the RO for keeping them in safe custody. The ARO shall maintain the record indicating the number of ballots sent on each day. This should also be shared with the RO on a daily basis.

7. Contesting candidates will be duly informed about the Election Commission's above guidelines.

who on account of being on duty on the day of poll in the current general election to Legislative Assembly of Himachal Pradesh scheduled to be notified on 17-10-2022, will not be able to be present in their respective polling station, as a class of persons to give vote by postal ballot in the said general election as per the provisions of Part-IIIA of the Conduct of Elections Rules, 1961, as amended vide Ministry of Law & Justice, Govt. of India, Notification, SO No. 3786(E), dated 22nd October, 2019, and directions and guidelines issued by the Election Commission, in this behalf.

By the Conduct of Elections (Amendment) Rules, 2019, 'Absentee Voters' have been given the facility of voting through postal ballot paper.

2. Provisions made by the amendments

2.1 'Absentee Voter' has been defined in clause (a) of Rule-27A of the Conduct of Elections Rules, 1961 as a person belonging to the class of persons notified by the Commission in terms of clause (c) of Section 60 of the Representation of the People Act, 1951 comprising persons employed in essential services who, on account of the compulsion of their duties, are not able to be present in their polling station on the day of poll. This category would also include senior citizens of 80 plus age and those belonging to the category of physically disabled (PwD).

2.2 The Election Commission in consultation with the Government has notified the class of persons employed in essential services vide it's Notification No.52/2022/SDR/Vol. I dated 17th October, 2022. Accordingly, the officials of these categories who are enrolled in the electoral roll in Himachal Pradesh and who would be certified to be on duty on the day of poll 12-11-2022, and on account of their such official duties, will not be able to be present in the polling station for voting on that day, will be eligible for voting through postal ballot as absentee voters in the essential service category.

2.3 Absentee Voter wishing to vote by postal ballot has to make application to the Returning Officer in Form-12D giving all requisite particulars. In the case of those Absentee Voters belonging to the category of essential services, their application is required to be verified by the Nodal officer appointed by the organization concerned. Such application seeking postal ballot facility should reach the RO during the period from date of announcement of election to five days following the date of notification of the election concerned.

2.4 As per the amended provisions under Rule 27E and 27-I of the Conduct of Elections Rules, 1961, the issue of Postal ballot paper to the absentee voter and return of the ballot paper after voting shall be in such manner as the Election Commission may direct. Accordingly, the Election Commission has laid down the following procedure/guidelines in the matter of facilitating postal ballot voting by the absentee voters in the category of persons on essential service (denoted for convenience as 'AVES').

3. Action by Returning Officer

3.1 Adequate publicity should be given to the facility being provided to these categories of electors. Form- 12D should be put on the website of the District Election Officer and also made available to the Nodal Officer of the organization for dissemination to the electors concerned.

3.2 On receipt of application in Form-12D, the RO will draw a list of all Absentee Voters on Essential Service (AVES) whose application have been received in time and are in order. The list shall be drawn in the format in Annexure- A

3.3 The RO shall verify and ensure that the electoral roll particulars of the applicants for postal ballot mentioned in Form-12D match with the particulars in the electoral roll and they are registered as elector. All the electors whose particulars with reference to the electoral roll have been found to be correct shall be issued postal ballot paper as Absentee Voters.

3.4 After the list of Absentee voters in this category voting through postal ballot paper is finalized, entry 'PB' shall be entered in the marked copy of the electoral roll against the names of such electors.

4. Form and design of postal ballot paper

The postal ballot paper for Absentee Voters shall be of the same form and language as the postal ballot paper for the voters on election duty. In this connection, reference is invited to the Election Commission's Directions No. 52/2015/SDR/Vol.1 dated 18th September, 2015 and 52/2016/SDR/Vol.1 dated 24th February, 2016, regarding the form of postal ballot paper for voters on election duty.

5. Assistant Returning Officer for voting through postal ballot by Absentee Voters

One ARO shall be assigned to handle all work related to postal ballot voting by Absentee Voters. It shall be the responsibility of such ARO to carry forward the postal voting programme from the stage of receipt of applications in Form 12D, and take all necessary action in this regard.

6.1 As per the second proviso to Rule-27E, issue of postal ballot paper to absentee voters shall be in the manner as specified by the Election Commission. Sub-rule (3) of Rule-27F provides that recording of vote by Absentee Voter shall be in such centre as specified by the Election Commission.

6.2 In the constituencies where there are Absentee Voters in the essential service category found eligible for postal ballot facility, the RO shall identify a suitable venue and room to be used as the place for issuing of postal ballot paper to such Absentee Voters and for facilitating their voting in such centre and thereafter for collection of the postal ballot paper. For this purpose, the RO shall identify a suitable location to be the Postal Voting Centre (PVC) for the absentee voters. Such venue shall be within the territory of the Constituency, and should be located, as far as possible, towards the central part of the constituency area so that the travelling distance for the voters to get to the PVC is not unduly long.

7. Intimation regarding issue of Postal Ballot Paper and Voting

7.1 All the persons who have applied for postal ballot paper in AVES category shall be duly intimated about the following:

(i) The full address of the Postal Voting Centre venue where postal ballot voting is to be arranged ; (ii) Dates on which the postal ballot voting facility will remain open; (iii) The hours fixed for postal ballot voting.

7.2 The intimation may be given through SMS on the mobile phone number wherever the same has been mentioned in the application in Form-12D. In other cases, the intimation may be given by post and/or through the BLO. In addition, this information should also be disseminated through the Nodal Officer of the Organization concerned and advertisements in local newspapers and also through the website of the District Election Officer. It should be explained that the absentee voters who have applied for postal ballot voting may come for casting vote on any of the three days during the hours fixed for the purpose and that they should produce their service identity card.It should also be explained that those who have been approved for voting though this facility can only vote at such PVCs and not in any other manner.

7.3 The contesting candidates in the constituency shall also be given prior intimation on the above mentioned points so that they may, if they so desire, appoint agents for watching the proceedings in the PVC. While intimating about the postal voting at the PVC, they should also be informed in writing that they may appoint their agents for watching the proceedings. The appointment should be made by the candidate or the election agent in writing and under their signature. Form-10 (the format for appointment of polling agents in polling stations) may be used for appointment of agent for the PVC.

8. Appointment of staff for the postal voting centre(PVC)

Each postal voting centre should have adequate staff for smoothly carrying out the work in such centre. The number of staff required should be worked out based on the number of AVES category voters who are voting in the centre. Each centre should have at least one gazetted officer for attesting the declaration of elector in Form-13A. The number may be increased depending on the number of electors in the particular centre.

9. Responsibilities of staff for Postal Voting Centre-Work and functions of Staff of postal voting

centre are as follows:—

9.1 Issuing postal ballot paper along with all connected envelopes, etc. (Form 13A, envelopes in Form-13B and 13C), after duly verifying the identity of the voter.

9.2 Form 13D (Instructions to voters) need not be given to individual electors. A copy of the same can be made available in the PVC for reference, if sought, by any elector. However, the electors should be briefed about the requirements on their part. A chart indicating the procedure for voting should be displayed at the PVC for the information of the electors.

9.3 Identity of the elector shall be verified before issuing postal ballot paper. Name of elector and the document produced for identification shall also be entered in a register to be maintained for the purpose, and signature/thumb impression of the elector obtained therein. A format for the register is annexed at Annexure-B. Further, a tick mark shall be placed against the name of the elector in the list of AVES to indicate that the person has voted. The counterfoil with the serial number and part number of elector duly filled up shall be got detached and kept in safe custody to be sent to the RO along with envelopes containing polled postal ballots.

9.4 The electors should be briefed about the procedure for voting and formalities to be observed on their part. They should be clearly briefed on the following points:

(i) making the declaration in Form 13A and getting it attested by the gazetted officer present in the PVC, (ii) entering the serial number of postal ballot paper, both on Form 13A and on the smaller envelope (Form 13B),

(iii) manner of marking vote, i.e. by placing either cross mark or tick mark against the name of the candidate of choice,

(iv) folding and placing the marked ballot in the smaller envelope and closing the envelope, (v) Placing the declaration in Form 13A, duly filled up, signed and attested alongwith closed envelope (Form 13B) containing the marked ballot paper inside the larger envelope (Form 13C),

(vi) Closing the larger envelope and dropping it in the box kept in the PVC.

10. Period and hours during which PVC shall be open

Postal Voting Centre (PVC) shall be open for upto three consecutive days in each of the constituencies. The three days period shall be so fixed that it is completed atleast three days before the date fixed for poll in the constituency.

On each of the three days, the PVC shall remain open from 9 AM to 5 PM.

11. Close of poll protocol on each day

11.1 After the day poll closes, the envelopes in Form 13C in the drop box shall be taken out, and sealed in a larger packet super scribed "Postal Ballots in PVC". On the outer packet, the following particulars should be clearly mentioned:

(i) Name and number of Constituency, (ii) Name of location of PVC, (iii) The date on which the votes were cast, (iv) The number of envelopes in Form 13C in the packet.

11.2 The counterfoils of postal ballots shall also be sealed in a separate packet superscribed "Counterfoils of PBs in PVC". Name and number of constituency and the dates on which it is sealed shall also be entered on such packet.

11.3 Both the packets containing the polled postal ballots and the counterfoils shall be sent to the Returning Officer in the same evening.

11.4 Signature of the agents of candidates present in the PVC should be obtained on each day of voting in the PVC. The format for this purpose is given at Annexure-C.

11.5 At the end of the three days voting period, all other material supplied to the PVC shall be collected by the ARO in charge of the PVC and retained at the headquarters as per standard protocol for the material concerned.

11.6 If an Absentee Voter does not turn up for voting in the PVC, there is no requirement of sending the postal ballot to him/her by post. The procedure prescribed for postal voting by them is voting in the PVC and in no other manner.

12. Material required in PVC

Each PVC should be provided with all necessary material for taking poll, in particular, the following:

(i) Sufficient number of postal ballot papers as per the number of Absentee Voters assigned to the PVC, with 10% surplus for the eventuality of some ballot papers getting damaged and requiring issuing of fresh ballot paper under rule 26(2);

(ii) Sufficient number of Form 13A envelopes in Forms 13B and 13 C; (iii) Pen for marking vote; (iv) Glue for closing the envelopes; (v) Ink-pad; (vi) Box in which the envelopes containing marked ballot paper is to be dropped; (vii) Register for obtaining signatures of electors on issue of ballot paper; (viii) List of Absentee Voters assigned for voting in the PVC with three extra copies (Annexure-A); (ix) Material for setting up voting compartment;

daily basis;

(xi) Other stationery items that would be required; (xii) Furniture for the polling staff, agents of candidates and for setting up voting compartment.
