No. Home-B-B(10)1/2014-Vol-II.—In compliance to order dated 28-07-2022 passed by the Hon'ble Supreme Court of India in Writ Petiton (Civil) No. 643/2015 titled as All India Judges Association Vs Union of India and Ors., the Governor, Himachal Pradesh is pleased to order 156—राजपत्र/2022-20-10-2022 (5961)5962 राजपत्र, हिमाचल प्रदेश, 20 अक्तूबर, 2022/28 आश्विन, 1944 revision of pay of Judicial Officers, in supersession of the pay revised vide this department notification No. Home. B (B)7-1/2009, dated 04-08-2010 as below:—

iv. Level J-1 to J-75963 राजपत्र, हिमाचल प्रदेश, 20 अक्तूबर, 2022/28 आश्विन, 1944 2. The above revision of pay structure is application of the multiplier of 2.81 for J-1 to J-5 and for J-6 to J-7 the increase is in the same proportion as that of High Court Judges.

3. The annual increment shall be @3% cumulative, meaning thereby that the increment @ 3% has to be calculated on the previous years basic pay instead of fixed amount increments recommended by FNJPC and JPC.

4. The pay level of the post of Judges will be as under:—

5. Fitment/migration from existing pay scale to the new pay matrix shall be as under:—

6. Fixation of pay in the pay matrix in regard to migration/fitment of the serving Judicial Officers on 01-01-2016 as indicated in Fitment Table-II above is broadly based on the following points:—

I. Multiply the existing pay by the factor of 2.81

II. The figure so arrived at is to be located in Table-I in relation to the Level applicable to the Officer (i.e. J1, J2 etc.).

III. Where there is an identical figure available in Table-I at the corresponding stage of the relevant, the new revised pay shall be fixed at that stage.

IV. Where there is no identical figure available, the new revised pay has to be fixed at the very next higher stage in that level in Table-I.

7. With the revised pay, DA as admissible to State Government employees shall be admissible from time to time. Other allowances admissible as on date of issue of this order, shall remain unchanged till final Judgment/Order of the Hon'ble Supreme court.

8. The revision of pay scale shall be effective from 01-01-2016.

9. Fixation of pay on promotion on or after 01-01-2016.

For those who are promoted from the previous level to the next level, or granted financial upgradation/ACP or Selection Grade or Super Time Scale, the procedure for fixing the pay in the new pay matrix on such promotion/financial upgradation, will be as follows:

I. Identify the level and the basic pay in Table-I on the date of promotion.

II. Add one increment in that level itself in terms of FR-22.

III. The figure so arrived at or the next closest figure in the level to which he/she is promoted will be the new pay on promotion.

IV. Arrear be paid as under after adjusting payment of Interim Relief already paid @30% of existing pay;

The Finance Department has given its sanction/concurrence vide its UO No. Fin(C)-B(15)- 10/2016-Loose, dated 28-09-2022 and the approval of competent authority has also been obtained.

Shimla-2, the 07th October, 2022

No. Home.B(B)7-5/2022.—In exercise of the powers conferred by sub-section (3-A) of Section 3 of the Himachal Pradesh Subordinate Courts' Employees (Pay, Allowances and Other Conditions of Service) Act, 2015, the Governor, Himachal Pradesh, is pleased to amend/substitute the Schedule appended to the Act, ibid as under:—

Pay Scales admissible to District Courts' Employees w.e.f. 01-01-2016

Note:— I. Matter qua revision of pay structure of the employees of the District Judiciary is sub-judice before the Apex Court in All India Judicial Employees Confederation Vs. Union of India and ors. in writ petition (Civil) No. 1040 of 2017. Therefore, the above pay revision is subject to the final outcome of the aforesaid writ petition and any other pending litigation.

II. Interim Relief at the rate of 8% as on 01-01-2016, 5% w.e.f. 01-08-2016, 4% w.e.f. 01-08-2017 and 4% w.e.f. 01-07-2018 total 21% has been granted by the State Government, which shall be adjusted during the Pay Fixation on account of revision of Pay Scales w.e.f. 01-01-2016. No other benefit except one additional increment w.e.f. 01-04-2003 as an incentive has been granted to some categories of posts in the District Judiciary as per recommendations of Hon'ble Justice Shetty Commission as well as by the order of Hon'ble Supreme Court of India vide order dated 07-10-2009, passed in I.A. No. 71A in Writ Petition (Civil) No. 1022 of 1989 and also as per the verdict of Hon'ble High Court of H.P., passed in CWP No. 10740/2011, dated 03-01-2014.

III. The pay will be fixed as per the formulation given in the Himachal Pradesh Civil Services (Revised Pay) Rules, 2022 notified on 3-1-2022.

IV. The revised pay shall be admissible from the month of September (Payable in the month of October, 2022) and the arrear from 1-1-2016 to 31-08-2022 shall be paid in such manner and at such time as may be approved by the Government from time to time.

Arbind Kumar aged 30 years s/o Sh. Ludan Ram, r/o Village Bagehra, P.O. Bir Bagehra, Tehsil Sujanpur, District Hamirpur (H.P.) and Nancy Robinson aged 34 years d/o Robinson Emmanval, r/o # 740, Sector 22A, Chandigarh (U.P.) 160022 and have filed an application alongwith affidavits in this court under section 16 of Special Marriage Act, 1954 (Central Act) as amended by the Marriage Laws (Amendment Act 01, 49 of 2001) that they have solemnized their marriage ceremony on 12-11-2017 at Grace Evangilical Ministry Ghurch, Village Bathol, P.O. Dharmpur, Tehsil Kasoli, District Solan (H.P.) 173209 as per Hindu Rites and Customs and they5975 राजपत्र, हिमाचल प्रदेश, 20 अक्तूबर, 2022/28 आश्विन, 1944 are living together as husband and wife since then. Hence their marriage may be registered under Special Marriage Act, 1954.

Therefore, the general public is hereby informed through this notice that any person who has any objections regarding this marriage can file the objections personally or in writing before this court on or before 12-11-2022. After that no objections will be entertained and marriage will be registered accordingly.
