No. Home-C (F) 4-1/2012-Loose.—In supersession of this department Notification No. Home C(F)4-1/2012-Loose, dated 13-07-2018, the Governor of Himachal Pradesh is pleased to re- constitute the State Haj Committee, as per the provisions made by the Government of India, 163—राजपत्र/2022-31-10-2022 (6891)6892 राजपत्र, हिमाचल प्रदेश, 31 अक्तूबर, 2022/09 कार्तिक, 1944 Ministry of External Affairs (Haj Cell), New Delhi the Haj Committee Act, 2002 (No. 35 of 2002). The composition and functions of the State Haj Committee is as under:—

TERMS:

The Member of the Committee will be honorary and will work without any remuneration from the Committee. An official member of Committee, when required to attend a meeting of the Committee in any capacity may claim his traveling expenses from the State Government. A non official member may claim traveling expenses in view of the terms and conditions annexed as Annexure A.

FUNCTIONS AND DUTIES:

The Committee will be advisory and consultative body and would act as a connecting link between the port Haj Committee, Mumbai and 'Hajji' friends. Its main duties will be:—

1. To collect and disseminate information useful to intending pilgrims;

2. To appoint 'Hajji's Friends' and Sub-Committee in District;

3. To advise and assist intending pilgrims in all matters including inoculation, vaccinations, medical inspection, issue of Pilgrim passes, depositing advance, and to co-operate with the local authorities concerned in such matter;

4. To negotiate and co-operate with railway authorities for the purpose traveling facilities for pilgrims;

5. To bring the grievances of the pilgrims to the notice of the authorities concerned and to suggest remedies, and;

6. To do such other things which they consider would help intending Haj Pilgrims in their pilgrimage to Haj.

MEETING:

The committee shall meet from time to time as the Chairperson or the Member Secretary may determine subject to the condition that as far as possible it will meet twice in a year before the Haj day and once after the Haj is over. The date of the meeting will be fixed by the Member Secretary in consultation with the Chairperson. The notice of the time and place of the meeting and agenda will be drawn-up by the Member Secretary and will be issued to such members at least 10 days in advance. The number of members required to make a quorum at any meeting of the State Committee shall be one-third of its members. If at any meeting it is deemed necessary to transact the business on the agenda, the meeting will not be postponed.

The term of the Committee will be three years

The Headquarters of the Committee shall be at Shimla

CHANGE OF RULES:

The Himachal Pradesh State Haj Committee has been constituted on the pattern of the Central Government 'The Haj Committee Act, 2002 (No. 35 of 2002)'. Therefore, in case, any doubt arises on any point, the proposal for clarification or change of rules of the aforesaid provision may be submitted for consideration to the State Government. ANNUAL REPORT:

A brief on the work of the Committee and of any organization that may be established under its control will be communicated annually, six months after the Haj day, for the information of the Government of India.

ANNEXURE-A T.A/D.A. of non-official delegates of the State Haj Committee

1. Travelling Allowance:—

(a) Journey by rail:

They will be treated at par with government servants of the first grade, and will beentitled to actual rail fare of the class of accommodation actually used but not exceeding the fare in which the Government servants of the first grade are normally entitled.

They will be entitled to actual fare traveling by taking single seat in a public bus, and if the journey is performed by Motorcycle/Scooter, within Himachal Pradesh and outside. Himachal Pradesh mileage allowance at @ Rs. 2.00/- per km., or if journey is performed by full taxi/ own Car, the Chairperson/Members will be entitled to mileage allowance at @ Rs. 8.00/- per km. within Himachal Pradesh and outside Himachal Pradesh as decided by Finance Department from time to time.

2. Daily allowance:—

(i) A member shall draw daily allowance for the entire absence from his permanent place of residence beginning with departure from the place and ending with return to that place at the rate applicable to Grade-I Officers of the State Government.

(ii) He shall draw allowance for each day of the meeting at the highest rates as admissible to Government servant of the first grade for the respective locality.

(iii) In addition to daily allowance for the day(s) of the meeting, a member shall also be entitled to daily allowance for halt on tour and out station in connection with the affairs of the Committee as under—

(a) If the absence from headquarters does not exceed 6 hours Nil (b) If the absence from headquarters exceeds 6 hours but not exceed 12 hours 70% (c) If the absence from headquarters exceeds 12 hours Full 3. Conveyance allowance:—

A member, who resides at a place where the meeting of the Committee is held, will not be entitled to traveling and daily allowance on the scales indicated above, but will be allowed only the actual cost of conveyance hire, subject to a maximum of Rs. 20/- per day. Before the claim as may be considered necessary Officer himself obtaining such details as may be considered necessary, that the actual expenditure was not less than the amount claimed.

If such a member uses his own car, he will be granted mileage allowance, at the rates admissible to Officers of the first grade subject to a maximum Rs. 20/- per day.

4. The member will be eligible for traveling allowance for the journey actually performed in connection with the meeting of the Committee, from and to the place of their permanent residence to attend a meeting of the Committee or return to the place than the place of his permanent residence after the conclusion of the meeting. Traveling allowance shall be worked out on the basis of the distance actually travelled or the distance between the place of permanent residence and the venue of the meeting whichever is less.

5. The provision of rules 4.17 and 6.17 and 6.1 of the Himachal Pradesh Treasury Rules will apply mutatis-mutandis in the case of over payment made on account of traveling allowance to non-official members.

6. Official Members:

The Official members shall be entitled to the traveling and daily allowance admissible to them according to the rules governing them.

ORDER

Dated, the 28th October, 2022

No. 3/4/ID/2022/SDR/VOL.-I.—1. Whereas, Section 61 of the Representation of the People Act, 1951 provides that with a view to preventing impersonation of electors, so as to make the right of genuine electors to vote under section 62 of that Act more effective, provisions may be made by rules under that Act for use of Electors Photo Identity Card for electors as the means of establishing their identity at the time of polling; and

2. Whereas, Rule 28 of the Registration of Electors Rules, 1960, empowers the Election Commission to direct, with a view to preventing impersonation of electors and facilitating their identification at the time of poll, the issue of Electors Photo Identity Card to electors bearing their photographs at State cost; and

3. Whereas, Rules 49H(3) and 49K (2) (b) of the Conduct of Elections Rules, 1961, stipulate that where the electors of a constituency have been supplied with Electors Photo Identity Card under the said provisions of Rule 28 of the Registration of Electors Rules, 1960, the electors shall produce their Electors Photo Identity Card at the polling station and failure or refusal on their part to produce those Electors Photo Identity Card may result in the denial of permission to vote; and

4. Whereas, a combined and harmonious reading of the aforesaid provisions of the said Act and the Rules, makes it clear that although the right to vote arises by the existence of the name in the electoral roll, it is also dependent upon the use of the Electors Photo Identity Card, where provided by the Election Commission at State cost, as the means of establishing their identity at the time of polling and that both are to be used together; and6896 राजपत्र, हिमाचल प्रदेश, 31 अक्तूबर, 2022/09 कार्तिक, 1944 5. Whereas, the Election Commission made an Order on the 28th August, 1993, directing the issue of Electors Photo Identity Card (EPIC) to all electors, according to a time bound programme; and

6. Whereas, Electors Photo Identity Card have been issued to approximate 100% electors in the State of Himachal Pradesh; and

7. Now, therefore, after taking into account all relevant factors and the legal and factual position, the Election Commission hereby directs that for current General Election to the Legislative Assembly of Himachal Pradesh, notified on 17-10-2022, all electors who have been issued EPIC shall produce the EPIC for their identification at the polling stations before casting their votes. Those electors who are not able to produce the EPIC shall produce one of the following alternative photo identity documents for establishing their identity : —

(i) Aadhaar Card,

(ii) MNREGA Job Card,

(iii) Passbooks with photograph issued by Bank/Post Office,

(iv) Health Insurance Smart Card issued under the scheme of Ministry of Labour, (v) Driving License,

(vi) PAN Card,

(vii) Smart Card issued by RGI under NPR,

(viii) Indian Passport,

(ix) Pension document with photograph,

(x) Service Identity Cards with photograph issued to employees by Central /State Govt./PSUs/Public Limited Companies and

(xi) Official identity cards issued to MPs/MLAs/MLCs

(xii) Unique Disability ID (UDID) Card, M/o Social Justice & Empowerment, Government of India

8. In the case of EPIC, clerical errors, spelling mistakes, etc. should be ignored provided the identity of the elector can be established by the EPIC. If an elector produces an EPIC, which has been issued by the Electoral Registration Officer of another Assembly Constituency, such EPIC shall also be accepted for identification provided the name of that elector finds place in the electoral roll pertaining to the polling station where the elector has turned up for voting. If it is not possible to establish the identity of the elector on account of mismatch of photograph, etc. the elector shall have to produce one of the alternative photo documents mentioned in Para 7 above.

9. Notwithstanding anything in Para 7 above, overseas electors who are registered in the electoral rolls under Section 20A of the Representation of the People Act, 1950, based on the particulars in their Indian Passport, shall be identified on the basis of their original passport only (and no other identity document) in the polling station.

सं. 3/4/आई.डी./2022/एसडीआर/खण्ड-I.--1. यतः, लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 61 में यह उपबंधित है कि निर्वाचकों के प्रतिरूपण का निवारण करने की दृष्टि से, ताकि उक्त अधिनियम की धारा 62 के अधीन वास्तविक निर्वाचकों का उनके मत देने के अधिकार को और अधिक प्रभावी बनाया जा सके, मतदान के समय निर्वाचकों की पहचान सुनिश्चित करने के साधन के रूप में निर्वाचकों के लिए निर्वाचक फोटो पहचान पत्र के उपयोग हेतु नियमों के द्‌वारा उपबंध किए जा सकते हैं, तथा

2. यतः, निर्वाचकों का रजिस्ट्रकरण नियम, 1960 का नियम 28 निर्वाचन आयोग को, इस दृष्टि से कि निर्वाचकों के प्रतिरूपण का निवारण हो सके तथा मतदान के समय उनकी पहचान को सरल बनाया जा सके, निर्वाचकों को राज्य की लागत पर फोटोयुक्त निर्वाचक फोटो-पहचान पत्र जारी करने के लिए निदेश देने की शक्ति प्रदान करता है; तथा

3. यतः, निर्वाचनों का संचालन नियम, 1961 के नियम 49 ज (3) और 49 ट (2) (ख) में यह उपबंधित है कि जहां किसी निर्वाचन क्षेत्र के निर्वाचकों को निर्वाचक रजिस्ट्रीकरण नियम, 1960 के नियम 28 के उक्त उपबंधों के अधीन निर्वाचक फोटो पहचान पत्र दिए गए हैं, वहां निर्वाचकों को मतदान केन्द्र में अपना निर्वाचक फोटो पहचान-पत्र दिखाना होगा तथा उनकी ओर से उन निर्वाचक फोटो पहचान पत्रों को नहीं दिखाए जाने या दिखाने में असमर्थ होने पर उन्हें मत डालने की अनुमति देने से इनकार किया जा सकता है; तथा

4. यतः, उक्त अधिनियम और नियमों के उपर्युक्त उपबंधों को मिलाकर एवं सामंजस्यपूर्ण ढंग से उनके अध्ययन से यह स्पष्ट होता है कि यद्‌यपि मत देने का अधिकार निर्वाचक नामावली में नाम के होने से ही होता है, यह निर्वाचन आयोग द्‌वारा राज्य की लागत पर, मतदान के समय उनकी पहचान सुनिश्चित करने के साधन के रूप में प्रदान करवाए गए निर्वाचक फोटो पहचान पत्र के प्रयोग पर भी निर्भर करता है, तथा दोनों का एक साथ प्रयोग करना होता है; तथा

5. यतः, निर्वाचन आयोग ने एक समयबद्ध कार्यक्रम के अनुसार सभी निर्वाचकों को निर्वाचक फोटो पहचान-पत्र ई0पी0आई0सी0 जारी करने का निदेश देते हुए 28 अगस्त, 1993 को एक आदेश जारी किया है; तथा

6. यतः, हिमाचल प्रदेश विधान सभा निर्वाचन क्षेत्रों के लिए निर्वाचकों को 100% निर्वाचक फोटो पहचान पत्र जारी किए जा चुके हैं; तथा

7. अतः, अब, सभी संबद्ध कारकों तथा विधिक एवं तथ्यात्मक स्थितियों को ध्यान में रखते हुए, निर्वाचन आयोग, एतद्‌द्वारा, यह निदेश देता है कि दिनांक 17-10-2022 को अधिसूचित किए गए हिमाचल प्रदेश के सभी विधानसभा निर्वाचन क्षेत्रों के चालू साधारण निर्वाचनों के लिए सभी निर्वाचक जिन्हें निर्वाचक फोटो पहचान पत्र जारी किए गए हैं, मतदान स्थल पर अपना मत डालने से पहले अपनी पहचान सुनिश्चित करने हेतु अपना निर्वाचक फोटो पहचान पत्र दिखाएंगे। ऐसे निर्वाचक जो अपना निर्वाचक फोटो पहचान पत्र प्रस्तुत नहीं कर पाते हैं, उन्हें अपनी पहचान स्थापित करने के लिए निम्नलिखित वैकल्पिक फोटो पहचान दस्तावेजों में से कोई एक प्रस्तुत करना होगा :-

(i) आधार कार्ड, (ii) मनरेगा जॉब कार्ड, (iii) बैंकों/डाकघरों द्‌्‌वारा जारी की गई फोटोयुक्त पासबुक, 6898 राजपत्र, हिमाचल प्रदेश, 31 अक्तूबर, 2022/09 कार्तिक, 1944 (iv) श्रम मंत्रालय की योजना के अन्तर्गत जारी स्वास्थ्य बीमा स्मार्ट कार्ड, (v) ड्राइविंग लाइसेन्स, (vi) पैन कार्ड, (vii) एनपीआर के अंतर्गत आरजीआई द्‌वारा जारी किए गए स्मार्ट कार्ड, (viii) भारतीय पासपोर्ट, (ix) फोटोयुक्त पेंशन दस्तावेज, (x) केन्द्र/राज्य सरकार/लोक उपक्रम/पब्लिक लिमिटेड कम्पनियों द्‌वारा अपने कर्मचारियों को जारी किए गए फोटोयुक्त सेवा पहचान-पत्र, और

(xi) सांसदों/विधायकों/विधान परिषद्‌ सदस्यों को जारी किए गए सरकारी पहचान पत्र, (xii) यूनिक डिसएबिलिटी आईडी (यूडीआईडी) कार्ड, सामाजिक न्याय एवं अधिकारिता मंत्रालय, भारत सरकार।

8. एपिक के संबंध में, लेखन अशुद्धि, वर्तनी की अशुद्धि इत्यादि को नजरअंदाज कर देना चाहिए बशर्ते निर्वाचक की पहचान ईपीआईसी से सुनिश्चित की जा सकेे। यदि कोई निर्वाचक फोटो पहचान-पत्र प्रदर्शित करता है, जो कि किसी अन्य सभा निर्वाचन-क्षेत्र के निर्वाचक रजिस्ट्रीकरण अधिकारी द्‌वारा जारी किया गया है, ऐसे एपिक भी पहचान स्थापित करने हेतु स्वीकृत किए जाएंगे बशर्ते उस निर्वाचक का नाम जहां वह मतदान करने आया है उस मतदान केन्द्र से संबंधित निर्वाचक नामावली में उपलब्ध हो। यदि फोटोग्राफ इत्यादि के बेमेल होने के कारण निर्वाचक की पहचान सुनिश्चित करना संभव न हो तब निर्वाचक को उपर्युक्त पैरा 7 में वर्णित किसी एक वैकल्पिक फोटो दस्तावेज को प्रस्तुत करना होगा।

9. उक्त पैरा 7 में किसी बात के होते हुए भी, प्रवासी निर्वाचकों कोे जो अपने पासपोर्ट में विवरणों के आधार पर लोक प्रतिनिधित्व अधिनियम, 1950 की धारा 20क के अधीन निर्वाचक नामावलियाें में पंजीकृत हैं, मतदान केन्द्र में केवल उनके मूल पासपोर्ट (तथा कोई अन्य पहचान दस्तावेज नहीं) के आधार पर ही पहचाना जाएगा।
