SCHEME FOR ENGAGEMENT OF SUPPORTING STAFF IN SPECIAL FAST TRACK

COURTS IN THE STATE OF H.P.

No. HHC/ADMN.6-7/74-CREATION-PART.—WHEREAS, pursuant to the Centrally Sponsored Scheme of the Government of India, the Government of Himachal Pradesh, has established six Fast Track Special Courts of Additional District & Sessions Judges with seven staff members (on contract basis) in the State of Himachal Pradesh, to try the cases, exclusively under the Protection of Children from Sexual Offences Act, 2012.

AND WHEREAS, on sanction of seven posts of staff members (on contract basis) in each Fast Track Special Court, established at Mandi, Solan, Kangra at Dharamshala, Shimla, Kinnaur at Rampur and Nahan at Sirmaur, vide Notification Nos. Home-B(B)15-4/2014 dated 24-9-2019, Home-B(B)15-4/2014 dated 27-9-2019 and Home. B.D(1)1/2018 dated 27-5-2020 read with Corrigendum No. Home-B(B) 15-4/2014-Vol-II dated 16-12-2020, such posts are required to be filled-up for proper and smooth functioning of these Courts.

Therefore, with a view to obtain the services of best incumbents and to keep transparency in the mode and modalities of the selection and engagement/appointment, Hon'ble the Chief Justice with the prior approval of the Governor of Himachal Pradesh, as conveyed vide Notifications referred to above and keeping in view the Scheme of the Govt. of India, is pleased to make the following Scheme, providing guidelines for regulating the recruitment and condition of service of he members of supporting staff for being engaged in the Fast Track Special Courts in the State of Himachal Pradesh:—

1. Title and Comeencement.—(i) The Scheme shall be called as "The Himachal

Pradesh Fast Track Special Courts (Method of Recruitment and Conditions of Service of the

Members of Staff) Scheme-2022."

(ii) The Scheme shall come into force from the date of its publication in the Official Gazette.

2. Definitions.—In this Scheme, unless the context otherwise requires;

(i) "Chief Justice" means Hon'ble the Chief Justice of the High Court of Himachal Pradesh.

(ii) "Judge" means Hon'ble Judge of the High Court of Himachal Pradesh.

(iii) "Registrar General" means the Registrar General of the High Court of Himachal Pradesh.

(iv) "District Judge" means a Judicial Officer in the Cadre of District & Sessions Judge.

(v) "Additional District Judge" means a Judicial Officer in the cadre of District/ Additional District & Sessions Judge/Presiding Officer of Special Fast Track Court.

(vi) "Fast Track Special Court" means, Court of District/Additional District & Sessions Judge, designated as such under Section 28 of the Protection of Children from Sexual Offences (POCSO) Act, 2012 to try cases, exclusively under POCSO Act.

(vii) "Supporting Staff" means

Reader, Stenographer, Judgment Writer, Clerk and Class-IV

3. Eligibility Conditions for Supporting Staff.—(i) The Ministerial Staff, i.e., Reader, Stenographer, Judgment Writer, Clerks and Class-IV, who have retired from service on attaining the age of superannuation having a clean service record shall only be eligible to be considered for such engagement, subject to fitness and suitability;

(ii) The Retired Ministerial Staff, including Class-IV employees, must not be above the age of 65 years as on the date of advertisement.

(iii) The Retired Ministerial Staff and Class-IV employees who have been dismissed, removed, compulsorily retired from service or had sought voluntary retirement after initiation of Departmental Inquiry against them, shall not be eligible to be considered for such ad- hoc/contractual engagement/ appointment.

4. Appointing Authority.—The District & Sessions Judge within whose Civil & Sessions Division Special Fast Track Court has been established, shall be the "Appointing Authority" for engagement of the Staff Members of the Special Fast Track Court. This, however, shall subject to the approval of the High Court.

5. Term and Tenure for Engagement.—Initially for a period of one year which may further be extended from time to time till the concerned retired staff attains the age of 68 years or till continuation of Scheme (FTSc) whichever is earlier and shall also be liable to be terminated at any time without notice7976 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर 2022/09 मार्गशीर्ष, 1944 6. Method of Selection.—(i) The District & Sessions Judge, within whose jurisdiction Special Fast Track Court has been established, being the Appointing Authority, shall advertise the posts for engagement, as per the proforma at Appendix-A", by publishing the same in a daily newspapers and/or the official website of the District Court, inviting applications, as per the proforma at "Appendix-B" from the desirous candidates.

(ii) The intending candidates may apply to the District & Sessions Judge for being considered against the applied post.

(iii) The applications so received, shall be scrutinized by the office of District & Sessions Judge. The detail of defect free applications of eligible candidates will be placed before the Appointing Authority and thereafter, the date, time and place of test/interview will be intimated to the eligible candidates in due course.

(iv) Preference will be given to those retired employees who have retired from the same Civil & Sessions Division, where Special Fast Track Court has been established.

(v) ACRs of last five years prior to retirement shall be considered and in case two or more officials have similar ACRs, senior in age shall be considered for selection.

(vi) The engagement will be subject to fitness and suitability to the satisfaction of Appointing Authority and final approval of the High Court.

(vii) The Appointing Authority, before assigning engagement, shall forward the list of selected candidates to the High Court for approval of the same.

7. Pay and other Allowances.—(i) Retired Ministerial Staff and Class-IV employees on engagement under the Scheme on ad-hoc/contractual basis shall be entitled to receive the pay and allowances at the rate he/she was drawing at the time of retirement minus total amount of pension being received by him/her after commutation under the Pension Rules applicable to him/her, as clarified vide Office Memorandum No. Fin(C)–B(7)-13/2009, Government of Himachal Pradesh, Finance (Regulations) Department, dated 23.3.2017. He/she shall also be entitled to all other regular allowances admissible to in-service staff of the respective cadres.

(ii) The Presiding Officer of the Special Fast Track Court shall be the DDO and Controlling Officer for the purpose of Salary, TA etc. in respect of class-II, III and IV staff members engaged and working in his/her Court, in terms of Notification No.HHC/Admn. 6(23)/74- XVII dated 2.12.2021.

(iii) The day-to-day expenditure of the Special Fast Track Courts shall be under the relevant head of account and the District & Sessions Judge, within whose Civil & Sessions Division Special Fast Track Court has been established, shall take all necessary steps to entrust the said work to the staff of his establishment.

8. Attendance & Leave.—(i) The Ministerial Staff and Class-IV employees engaged on ad-hoc/contractual basis under the Scheme shall be entitled to 12 days Casual Leave and 10 days Special Casual Leave in a calendar year;

(ii) They shall not be entitled to any other kind of leave during the period of appointment;

(iii) Proportionate reduction of pay and allowances shall be made for unauthorized absence from duty, so also from absence beyond permissible period of leave.

9. Disciplinary Authority.—The Appointing Authority shall be the Disciplinary Authority.

10. General.—(i) The intending retired ministerial staff and class-IV employees, in case of selection/engagement, shall be required to furnish attested copies of first and last page of the service book showing his/her service record and also attested PPO in support of superannuation/ voluntary retirement.

(ii) The retired staff members, including class-IV employees, must be physically fit and in case of selection/engagement, he/she shall also be required to furnish medical fitness certificate showing his/her fitness from the Govt. Hospital or Govt. Medical Practitioner, as may be prescribed by the Appointing Authority.

(iii) No TA/DA will be allowed to the candidates to appear in the interview.

(iv) Canvassing in any form will be disqualification.

11. Undertaking.—In case of engagement, the retired employee shall submit an undertaking to the effect that he/she has not been dismissed, removed, compulsorily retired from service and had sought voluntary retirement after initiation of Departmental Inquiry against him/her.

12. Residuary Provision & Relaxation Powers.—(1) Any other matter which is not specifically covered or provided under this Scheme, shall be dealt with by Hon'ble the Chief Justice as per his directions.

(2) Where Hon'ble the Chief Justice is of the opinion that the operation of any provision under this Scheme causes undue hardship in a particular case, he may, by order, relax the requirement of that provision to such extent and subject to such conditions, as he may deem it necessary.

(3) Hon'ble the Chief Justice shall have the power to notify criteria/ norms for selection in addition/substitution to criteria provided in this scheme and when it is deemed necessary." (4) The Decision of Hon'ble the Chief Justice as to result of the test/interview/examination shall be final and in no case shall be liable to be challenged in any manner whatsoever.

Interpretation.—If any question arises relating to the interpretation of any provision of this Scheme, the decision of Hon'ble the Chief Justice shall be final.

He/she shall also be entitled to all other regular allowances admissible to in-service staff of the respective cadres iv. Attendance & Leave:

1. The Supporting Staff engaged on ad-hoc basis under the Scheme shall be entitled to 10 days Casual Leave and 5 days Special Casual Leave in a calendar year;

2. They shall not be entitled to any other kind of leave during the period of appointment;

10. भर्ती की पद्धति-भर्ती सीधी होगी या प्रोन्नति/सैकेण्डमैंट/स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों)े की प्रतिशतता.--शतप्रतिशत प्रोन्नति द्वारा ऐसा न होने पर सैकेण्डमैंट आधार पर।

11. प्रोन्नति/सैकेण्डमैंट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति/सैकेण्डमैंट, स्थानान्तरण किया जाएगा.--वरिष्ठ सहायकों में से प्रोन्नति द्वारा, जिनका छह वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके छह वर्ष का नियमित सेवाकाल हो, ऐसा न होने पर हिमाचल प्रदेश सरकार के अन्य विभागों से समरूप वेतनमान में कार्यरत इस पद के पदधारियों में से सैकेन्डमैंट आधार परः

(I) परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगीः

परन्तु यह और कि उपर्युक्त परन्तुक (1) उन कर्मचारियों के मामले में लागू नहीं होगा, जिनकी अधिवर्षिता के लिए पांच वर्ष या उससे कम की सेवा शेष रही हो। तथापि, ऐसे पदधारियों को, उनकी प्रोन्नति पर, दूरस्थ/ग्रामीण क्षे़़त्रों में तैनात/स्थानान्तरित किया जा सकेगाः

परन्तु यह और कि उन अधिकारियों/कर्मचारियों को, जिन्होंनेे जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपनेे संवर्ग (काडर) में सर्वथा उसकी वरिष्ठता के अनुसार स्थानान्तरण किया जाएगा।

स्पष्टीकरण-I.--उपरोक्त परन्तुक (I) प्रयोजन के लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षे़त्रों में "कार्यकाल" से प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए, साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी।

स्पष्टीकरण-II.--उपर्युक्त परन्तुक (1) के प्रयोजन के लिए जनजातीय/दुर्गम क्षेत्र निम्न प्रकार से होंगे :- 1. जिला लाहौल एवं स्पीति

2. चम्बा जिला का पांगी और भरमौर उप-मण्डल

3. रोहड़ू उप-मण्डल का डोडरा क्वार क्षेत्र

(1) उप-मण्डल/तहसील मुख्यालय से 20 किलोमीटर की परिधि से परे के समस्त स्थान । (2) राज्य मुख्यालय और जिला मुख्यालय से 15 किलोमीटर की परिधि से परे के समस्त स्थान जहां के लिए बस सेवा उपलब्ध नहीं है और 3 (तीन) किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है।

(3) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना अपने गृह नगर या गृह नगर क्षेत्र के साथ लगती 20 किलोमीटर की परिधि के भीतर का क्षे़़त्र।

(II) प्रोन्नति के सभी मामलों में, पद पर नियमित नियुक्त से पूर्व सम्भरक (पोषक) पद में की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए इस शर्त के अधीन रहते हुए प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति, भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थी :

(i) परन्तु उन सभी मामलों में, जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गर्ई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.--अन्तिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जो आपातकाल के दौरान सशस्त्र बलों में भर्ती हुआ था और जिसे डिमोबिलाइज्ड आर्मड फोर्सिज परसोनल (रिजर्वेशन आफ7984 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर 2022/09 मार्गशीर्ष, 1944 वैकेन्सीज इन हिमाचल स्टेट नॉन-टैक्नीकल सर्विसिज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत्‌ भर्ती किया गया है और इसके अन्तर्गत्‌ वरीयता लाभ दिए गए हों या जिसे एक्स-सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसिज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और इनके अन्तर्गत वरीयता लाभ दिए हों।

(ii) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति, उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबंधों के अनुसार की गई थीः

परन्तु की गई उपर्युक्त निर्दिष्ट तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।

12. यदि विभागीय प्रोन्नति समिति/विभागीय स्थायीकरण समिति विद्यमान है तो उसकी संरचना.--(क) विभागीय प्रोन्नति समिति : जैसी सरकार द्वारा समय-समय पर गठित की जाए।

(ख) विभागीय स्थायीकरण समिति : लागू नहीं

13. भर्ती करने में जिन परिस्थितियाें मेेंं हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्तीं के लिए अनिवार्य अपेक्षाएं.--लागू नहीं

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--लागू नहीं

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/ अनुसूचित जनजातियों/अन्य पिछडे़ वर्गों और अन्य प्रवर्ग के व्यक्तियों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी ।

17. विभागीय परीक्षा.--लागू नहीं

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां यह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी ।

No. Home (Vig.)A(3)-3/2020-(Loka.)-Rules.—In exercise of the powers conferred by sub- section (3) and (4) of section 9 read with section 54 of the Himachal Pradesh Lokayukta Act, 20147985 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर 2022/09 मार्गशीर्ष, 1944 (Act No. 23 of 2015), the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the Recruitment & Promotion Rules for the post of Superintendent Grade-II, Class-II (Non-Gazetted) in the Office of Lokayukta, Home(Vigilance) Department, Himachal Pradesh as per Annexure-'A' attached to this notification, namely:—

1. Short title and commencement.—(1) These Rules may be called the Office of Lokayukta, Home (Vigilance) Department, Himachal Pradesh, Superintendent Grade-II, Class-II (Non-Gazetted) Recruitment and Promotion Rules, 2022.

(2) These rules shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Repeal & savings.—(1) The Office of Lokayukta, Home (Vigilance) Department Himachal Pradesh, Superintendent Grade-II, Class-II (Non-Gazetted) Recruitment and Promotion Rules, 2022, notified vide Notification No. Home(Vig.)A(3)-3/2020-(Loka.)-Rules dated 24-05-2022 are hereby repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the rules so repealed under rule 2(1) supra shall be deemed to have been validly made, done or taken under these rules.

ANNEXURE-'A' RECRUITMENT AND PROMOTION RULES FOR THE POST OF SUPERINTENDENT GRADE-II, CLASS-II (NON-GAZETTED) IN THE OFFICE OF LOKAYUKTA, HOME (VIGILANCE) DEPARTMENT, HIMACHAL PRADESH

1. Name of the Post.—Superintendent, Grade-II

2. Number of post(s).—01 (one)

3. Classification.—Class-II (Non-Gazetted) (Ministerial Services)

4. Scale of pay.—As per rules 3(j) of the H.P. Civil Services(Revised Pay) Rules, 2022 5. Whether "Selection" post or "Non- Selection" post.—Non-Selection

9. Period of probation, if any.—Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

10. Method(s) of recruitment, whether by direct recruitment or by promotion/ secondment/ transfer and the percentage of post(s) to be filled in by various methods.—100% by promotion failing which on secondment basis.

11. In case of recruitment by promotion/secondment/transfer, grade from which promotion/secondment/transfer is to be made.—By promotion from amongst the Senior Assistants possessing six years' regular service or regular combined with continuous adhoc service rendered, if any, in the grade failing which on secondment basis from amongst the incumbents of this post working in the identical pay scales from other H.P. Government Departments.

(I) Provided that for the purpose of promotion every employee shall have to serve atleast one term in the Tribal/Difficult/Hard areas and remote /rural areas subject to adequate number of post(s) available in such areas:

Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation. However, such incumbents may be posted/ transferred to remote/rural areas in their promotion:

Provided further that Officers/Officials who has not served atleast one tenure in Tribal/Difficult/Hard area and remote/rural area shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation-I.—For the purpose of proviso (I) supra the "term" in Tribal /Difficult /Hard areas/remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/convenience.

Explanation-II.—For the purpose of proviso (I) supra the Tribal/Difficult Areas shall be as under:—

1. District Lahaul & Spiti

2. Pangi and Bharmour Sub-Division of Chamba District

3. Dodra Kawar Area of Rohru Sub-Division

4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashapat, Gram Panchayats of Rampur Tehsil of District Shimla.

5. Pandrah Bis Pargana of Kullu District

6. Bara Bhangal Areas of Baijnath Sub-Division of Kangra District

7. District Kinnaur

8. Kathwar and Korga Patwar Circles of Kamrau Sub-Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil in Sirmaur District.

9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada-Gussaini, Mathyani, Ghanyar, Thachi, Baggi, Somgad and Kholanal of Bali-Chowki Sub Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa, Kathog, Silh-Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh, Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Batwara Patwar Circle of Sunder Nagar Tehsil in Mandi District.

Explanation-III.—For the purpose of proviso (I) supra the Remote/Rural Areas shall be as under:—

(i) All stations beyond the radius of 20 kms. from Sub Division /Tehsil headquarter.

(ii) All Stations beyond the radius of 15 Kms. From State Headquarter and District head quarters where bus service in not available and on foot journey is more than 3 (three) kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 kms. of the employee regardless of its category.

(II) In all cases of promotion, the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these Rules for promotion subject to the conditions that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules:

(i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/ appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible persons happened to be ex-servicemen who have joined armed forces during the period of emergency and recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non- Technical Services) Rules, 1972 and having been given the benefit of seniority there under or recruited under the provisions of Rule-3 of Ex-Servicemen (Reservation of Vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.

(ii) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post, if any, prior to the regular appointment against such posts shall be taken into account towards7988 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर 2022/09 मार्गशीर्ष, 1944 the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered as referred to above shall remain unchanged.

12. If a Departmental Promotion Committee/Departmental Confirmation Committee exists, what is its composition.—(a) Departmental Promotion Committee : As may be constituted by the Govt. from time to time.

(b) Departmental Confirmation Committee : Not applicable

13. Circumstances under which the Himachal Pradesh Public Service Commission

(H.P.P.S.C.) is to be consulted in making recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—Not applicable

15. Selection for appointment to post by direct recruitment.—Not applicable

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for scheduled Castes/Scheduled Tribes /Other Backward Classes/other categories of persons issued by the Himachal Pradesh Government from time to time

विषय : प्रार्थना-पत्र अधीन धारा 8(4) विवाह पंजीकरण अधिनियम, 1996.

श्री अमित कुमार पुत्र श्री मुकेश कुमार, निवासी गांव व डा0 दौलतपुर, तहसील घनारी, जिला ऊना (हि0 प्र0) ने इस न्यायालय में प्रार्थना-पत्र मय शपथ पत्र पेश किया है कि उसकी शादी श्रीमती सुमन कुमारी पुत्री श्री राम सिंह, निवासी गांव व डा0 सदुवां, तहसील नूरपुर, जिला कांगड़ा (हि0प्र0) के साथ दिनांक 12-10-2021 को मुताबिक हिन्दू रीति-रिवाज हुई थी परन्तु अज्ञानतावश शादी का पंजीकरण नगर पंचायत दौलतपुर के अभिलेख में नहीं करवाया है। प्रार्थी ने अपनी शादी की पुष्टि बारे शपथ पत्र व दोनों के आधार कार्ड व प्रधान/सचिव नगर पंचायत दौलतपुर द्वारा जारी प्रमाण-पत्र प्रार्थना-पत्र के साथ दायर किए हैं। रिपोर्ट सम्बन्धित स्थानीय पंजीकार विवाह iathdj.k@lfpo ग्राम पंचायत/सचिव नगर पंचायत के अनुसार उक्त शादी सम्बन्धित ग्राम/नगर पंचायत में दर्ज न है। अब प्रार्थी अपनी शादी पंजीकृत करवाना चाहता है। अतः आम जनता को इस इश्तहार/मुश्त्री मुनादी द्वारा सूचित किया जाता है कि यदि किसी भी व्यक्ति को उक्त शादी दर्ज करने बारे कोई उजर या एतराज हो तो वह दिनांक 20-12-2022 को दोपहर 2.00 बजे या इससे पूर्व असालतन या वकालतन हाजर अदालत होकर पेश करें। गैर हाजिरी की सूरत में एक तरफा कार्यवाही करके नियमानुसार सम्बन्धित ग्राम/नगर पंचायत को शादी दर्ज करने का आदेश जारी कर दिया जाएगा।7993 राजपत्र, हिमाचल प्रदेश, 30 नवम्बर 2022/09 मार्गशीर्ष, 1944 आज दिनांक 14-11-2022 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी हुआ।

श्री देवेन्द्र पुत्र श्री के0सी0 शर्मा, वासी उप्पर वसाल, तहसील व जिला ऊना (हि0प्र0) ने शादी पंजीकरण के लिए रजिस्ट्रार मैरिज ग्राम पंचायत उप्पर वसाल, तहसील व जिला ऊना (हि0प्र0) को आदेश जारी करने हेतु इस अदालत में एक प्रार्थना-पत्र दायर किया है जिसमें उन्होंने अवगत करवाया है कि उसकी शादी हिन्दु रिति-रिवाज के अनुसार दिनांक 24-04-2021 को श्रीमती निधि शर्मा पुत्री श्री राज कुमार, वासी धरुई, डाकघर नहरी नौरंगा, तहसील अम्ब से हुई है। परन्तु यह शादी सहवन गलती के कारण ग्राम पंचायत उप्पर वसाल के रजिस्टर में दर्ज न करवाई गई है। इसलिए उन्होंने इस शादी को ग्राम पंचायत उप्पर वसाल में दर्ज करने के लिए आदेश पारित करने का अनुरोध किया है। प्रार्थी ने अपनी शादी की पुष्टि में आधार कार्ड, शपथ-पत्र, स्कूल प्रमाण-पत्र तथा अन्य दस्तावेज प्रार्थना-पत्र के साथ दायर करके आवेदन किया है। अतः इश्तहार राजपत्र, हिमाचल प्रदेश व मुस्त्री मुनादी व चस्पांगी के माध्यम से आम जनता तथा सम्बन्धित रिश्तेदारों को सूचित किय जाता है कि अगर किसी को उपरोक्त विवाह पंजीकरण बारे कोई उजर व एतराज हो तो दिनांक तारीख पेशी 19-12-2022 को सुबह 10 बजे इस न्यायालय में असालतन या वकालतन अपना एतराज अधोहस्ताक्षरी के न्यायालय में उपस्थित होकर पेश कर सकता है अन्यथा एकतरफा कार्यवाही अमल में लाई जाएगी तथा उपरोक्त विवाह पंजीकरण करने के आदेश दे दिए जाएंगे। उसके उपरान्त कोई उजर/एतराज काबिले समायत न होगा।
