संख्याः ई.डी.एन.-सी-एफ(4)1/2015.--सेवाआें या प्रसुविधाओं या सहायिकियों के परिदान के लिए आधार का एक पहचान दस्तावेज के रूप में उपयोग, सरकार की परिदान प्रक्रिया को सुगम बनाता है, 203—राजपत्र/2022-20-12-2022 (8269) 8270 राजपत्र, हिमाचल प्रदेश, 20 दिसम्बर 2022/29 मार्गशीर्ष, 1944 पारदर्शिता और दक्षता लाता है और लाभार्थियों को सुविधाजनक और निर्बाध रीति में अपनी पहचान साबित करने के बहुविध दस्तावेज प्रस्तुत करने की आवश्यकता हटाकर प्रत्यक्षतः उन्हें हकदारियां प्राप्त करने हेतु समर्थ बनाता है;

प्रारम्भिक शिक्षा विभाग, (जिसे इसके पश्चात्‌्‌ विभाग कहा गया है) जिला किन्नौर, लाहौल स्पीति और जिला चम्बा में भरमौर, पांगी और गरोला शिक्षा खण्डों सहित राज्य के जनजातीय क्षेत्रों में अध्ययनरत छात्रों को छात्रवृति प्रदान करने के लिए लाहौल-स्पीति पैटर्न (जिसे इसमें इसके पश्चात्‌्‌ 'स्कीम' कहा गया है) के आधार पर छात्रवृत्ति प्रशासित कर रहा है, जिसे निदेशालय, प्रारम्भिक शिक्षा हिमाचल प्रदेश, शिमला (जिसे इसमें इसके पश्चात्‌्‌ कार्यान्वयन अभिकरण कहा गया है) के माध्यम से कार्यान्वित किया जा रहा है;

स्कीम (जिसे इसमें इसके पश्चात्‌ प्रसुविधा कहा गया है) जिला किन्नौर, लाहौल-स्पीति और जिला चम्बा में भरमौर, पांगी और गरोला शिक्षा खण्डों सहित राज्य के जनजातीय क्षेत्रों में अध्ययनरत छात्रों को कार्यान्वयन अभिकरण द्वारा विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार `80 (अस्सी रुपये केवल) (जिसे इसमें इसके पश्चात्‌्‌ प्रसुविधा कहा गया है) की रकम प्रतिवर्ष प्रदान की जाती है;

और पूर्वोक्त स्कीम में हिमाचल प्रदेश राज्य की संचित निधि से आवर्ती व्यय अन्तर्वलित है। अतः हिमाचल प्रदेश के राज्यपाल, आधार (वित्तीय और अन्य सहायिकियों, प्रसुविधाओं और सेवाओं का लक्ष्यित परिदान) अधिनियम, 2016 (2016 का 18) (जिसे इसमें इसके पश्चात्‌्‌ उक्त अधिनियम कहा गया है) की धारा 7 के अनुसरण में निम्नलिखित अधिसूचित करते हैं, अर्थात्‌ः-

1. (1) स्कीम के अधीन प्रसुविधा प्राप्त करने की वांछा रखने वाले बालक को एतद्‌द्वारा आधार संख्या धारण करने का सबूत प्रस्तुत करना होगा या आधार अधिप्रमाणन करना होगा।

(2) स्कीम के अन्तर्गत प्रसुविधाएं प्राप्त करने की वांछा रखने वाला बालक, जिसके पास आधार संख्या नहीं है या जो अभी तक आधार के लिए नामांकित नहीं है, को स्कीम के लिए रजिस्ट्रीकरण से पूर्व अपने माता-पिता या संरक्षक की सहमति के अध्यधीन आवेदन करना अपेक्षित होगा यदि वह उक्त नियम की धारा 3 के अनुसार आधार अभिप्राप्त करने के लिए हकदार है और ऐसे बालक आधार का अभ्यावेशन करवाने के लिए किसी आधार अभ्यावेशन केन्द्र {सूची भारतीय विशिष्ट पहचान प्राधिकरण (यू0 आई0 डी0 ए0 आई0) वैबसाइट www.uidai.gov. in पर उपलब्ध है} पर जाएंगे।

परन्तु जब तक कि बालक को आधार समनुदेशित नहीं किया जाता है, तब तक ऐसे बालकों को निम्नलिखित दस्तावेज प्रस्तुत करने के अध्यधीन स्कीम के अधीन प्रसुविधा प्रदान की जाएगी, अर्थात्‌्‌ः-

(क) यदि किसी बालक को पांच वर्ष की आयु पूर्ण करने के पश्चात्‌ अभ्यावेशित (बायोमैट्रिक के संग्रहण के साथ) उसकी आधार अभ्यावेशन पहचान पर्ची, या अद्यतन बायोमैट्रिक पहचान पर्ची के साथ किया गया है; और

(ख) निम्नलिखित में से कोई दस्तावेज है, अर्थात्‌्‌ः

(i) जन्म का प्रमाण-पत्र; या समुचित प्राधिकरण द्वारा जारी किया गया जन्म का अभिलेख; या8271 राजपत्र, हिमाचल प्रदेश, 20 दिसम्बर 2022/29 मार्गशीर्ष, 1944 (ii) माता-पिता के नाम सहित स्कूल के प्रधानाचार्य द्वारा सम्यक्‌ रुप से हस्ताक्षरित स्कूल का पहचान-पत्र; या

(ग) स्कीम के विद्यमान मार्गदर्शक सिद्धान्तों के अनुसार लाभार्थी को माता-पिता या विधिक संरक्षक के साथ सम्बन्ध के सबूत का निम्नलिखित में से दस्तावेज, अर्थात्‌्‌ः-

(i) जन्म का प्रमाण-पत्र; या समुचित प्राधिकरण द्वारा जारी किया गया जन्म का अभिलेख; या

(ii) राशन कार्ड; या

(iii) भूतपूर्व सैनिक अंशदायी स्वास्थ्य स्कीम (ई0सी0एच0एस0) कार्ड; या कर्मचारी राज्य बीमा निगम (ई0एस0आई0सी0) कार्ड; या केन्द्रीय सरकार स्वास्थ्य स्कीम (डी0जी0एच0एस0)कार्ड; या

(iv) पेंशन कार्ड; या

(v) सेना की केन्टीन का कार्ड; या

(vi) कुटुम्ब हकदारी का कोई कार्ड; या

(vii) विभाग द्वारा यथाविनिर्दिष्ट कोई अन्य दस्तावेजः

परन्तु यह कि उपरोक्त दस्तावेजों की प्रयोजन की जाँच विभाग द्वारा उस प्रयोजन के लिए विनिर्दिष्ट रूप से नामनिर्दिष्ट किसी अधिकारी द्वारा की जाएगी।

2. स्कीम के अधीन सुविधापूर्वक लाभार्थियों को प्रसुविधाएं उपलब्ध करवाने के आश्य से विभाग अपने कार्यान्वयन अभिकरण के माध्यम से यह सुनिश्चित करने के लिए समस्त अपेक्षित व्यवस्थाएं करेगा कि उक्त अपेक्षाओं हेतु, उन्हें जागरूक करने के लिए, लाभार्थियों हेतु मीडिया के माध्यम से, व्यापक प्रचार किया गया है।

3. उन समस्त मामलों में जहाँ लाभार्थियों के अपकृष्ट (अस्पष्ट) बायोेमैट्रिक के कारण या किसी, अन्य कारण से, आधार प्रमाणन असफल रहता है, वहां निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृृत की जाएगी, अर्थात्‌्‌ः-

(क) अस्पष्ट उंगली छाप क्वालिटी की दशा में, अधिप्रमाणन हेतु आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन सुविधा अंगीकृत की जाएगी, तद्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाओं के परिदान हेतु विभाग उंगली-छाप अधिप्रमाणन सहित आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन के लिए व्यवस्थाएं करेगा;

(ख) उंगली छाप या आंख की पुतली का स्कैन या चेहरा अधिप्रमाणन के माध्यम से बायोमैट्रिक अधिप्रमाणन की असफलता की दशा में, जहां कहीं भी साध्य और ग्राहय है, सीमित समय वैधता सहित, यथास्थिति, एक मुश्त आधार पासवर्ड या समयाधारित एक मुश्त पासवर्ड प्रदान किया जाएगा;

(ग) उन समस्त अन्य मामलों में, जहां बायोमैट्रिक या एक मुश्त आधार पासवर्ड या समय आधारित एक मुश्त पासवर्ड अधिप्रमाणन सम्भव नहीं है, वहां स्कीम के अधीन प्रसुविधाएं, आधार वर्ण (अक्षर), जिसकी अधिप्रमाणिकता आधार पर मुद्रित तुरन्त प्रत्युत्तर (क्यू.आर.) कोड के माध्यम से सत्यापित की जाएगी और तुरन्त प्रत्युत्तर कोड का अर्थ लगाने (पढ़ने के लिए) के लिए विभाग द्वारा अपने कार्यान्वयन अभिकरण के माध्यम से सुविधाजनक स्थानों पर आवश्यक व्यवस्था की जाएगी। 8272 राजपत्र, हिमाचल प्रदेश, 20 दिसम्बर 2022/29 मार्गशीर्ष, 1944 4. उपरोक्त अन्तर्विष्ट किसी बात के होते हुए भी, स्कीम के अन्तर्गत यदि वह अधिप्रमाणन द्वारा अपनी पहचान सिद्ध करने में असफल रहता है, या आधार नम्बर धारण करने के सबूत प्रस्तुत न करने या यदि किसी बालक, जिसे कोई आधार नम्बर समनुदेशित नहीं किया गया है, अभ्यावेशन के लिए आवेदन प्रस्तुत न करने पर, उसे प्रसुविधा देने से इनकार नहीं किया जाएगा। उसे प्रसुविधा, पैरा 1 के उप-पैरा (3) के परन्तुक के खण्ड (ख) और (ग) में यथावर्णित अन्य दस्तावेजों के आधार पर, उसकी पहचान के सत्यापन करके प्रदान की जाएगी और जब प्रसुविधा ऐसे अन्य दस्तावेजों के आधार पर प्रदान की गई है तो उसको रिकार्ड करने के लिए एक पृथक्‌ रजिस्टर अनुरक्षित किया जाएगा जिसे विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से कालिकतः पुनर्विलोकित और संपरीक्षित किया जाएगा।

NOTIFICATION

No. EDN-C-F(4)1/2015.—Whereas the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Department of Elementary Education (hereinafter referred to as the Department), is administering the Scholarship on Lahaul-Spiti Pattern (hereinafter referred to as the Scheme) to provide scholarship to the students studying in the Tribal Areas of the State including Distt. Kinnaur, Lahaul-Spiti and Education Blocks, Bharmour, Pangi and Garola in Distt. Chamba, which is being implemented through the Directorate of Elementary Education, Himachal Pradesh, Shimla (hereinafter referred to as the Implementing Agency);

And whereas, under the Scheme, an amount of `80/- (Eighty only), (hereinafter referred to as the benefit) is given to the students studying in the Tribal Areas of the State including Distt. Kinnaur, Lahaul-Spiti and Education Blocks, Bharmour, Pangi and Garola in Distt. Chamba, (hereinafter referred to as the beneficiaries), per annum by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh;

Now, therefore, in pursuance of Section 7 of the Aadhaar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the government of Himachal Pradesh hereby notifies the following, namely:—

1. (1) A child desirous of availing the benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

(2) Any child desirous of availing the benefit under the Scheme, who does not possess the Aadhaar number or, has not yet enrolled for Aadhaar, shall be required to make application for Aadhaar enrolment subject to the consent of his parents or guardians, before registering for the Scheme provided that he is entitled to obtain Aadhaar as per Section 3 of the said Act and such children shall visit any Aadhaar enrolment centre (list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhaar.

(3) As per regulation 12 of the Aadhaar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhaar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhaar and in case there is no Aadhaar enrolment centre located in the respective Block or Tehsil, the Department through its Implementing Agency shall provide Aadhaar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhaar is assigned to the child, the benefit under the Scheme shall be given to such children subject to production of the following documents, namely:—

(a) if the child has been enrolled after attaining the age of five years (with biometrics collection), his Aadhaar Enrolment Identification slip, or of bio-metric update identification slip; and

(b) any one of the following documents, namely:—

i. Birth Certificate; or Record of birth issued by the appropriate authority;

ii. School identity card, duly signed by the Principal of the school, containing parent's names; and

(c) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely:—

i. Birth Certificate; or Record of birth issued by the appropriate authority;

ii. Ration Card; or

iii. Ex-Servicemen Contributory Health Scheme (ECHS) Card; or Employee's State Insurance Corporation (ESIC) Card; or Central Government Health Scheme (CGHS) Card; or

iv. Pension Card; or

v. Army Canteen Card; or

vi. Any Government Family Entitlement Card; or

vii. Any other document as specified by the Department:

Provided further that the above documents shall be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through media shall be given to the beneficiaries to make them aware of the said requirement.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication alongwith finger-print authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by Aadhaar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhaar One Time Password or Time-based One- Time Password authentication is not possible, benefits under the scheme may be given on the basis of physical Aadhaar letter whose authenticity can be verified through the Quick Response code printed on the Aadhaar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. The benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses (b) and (c) of the proviso of sub-paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.

5. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

प्रारम्भिक शिक्षा विभाग, (जिसे इसके पश्चात्‌्‌ 'विभाग' कहा गया है) सरकारी स्कूलोेें के छठी, सातवीं और आठवीं कक्षा में तीन क्रमवर्ती वर्ष हेतु एक सौ प्रतिभाशाली छात्रों को छात्रवृत्ति प्रदान करने के लिए हिमाचल प्रदेश स्वर्ण जयंती मध्य छात्रवृत्ति योजना (जिसे इसमें इसके पश्चात्‌्‌ 'स्कीम' कहा गया है) को प्रशासित कर रहा है, जिसे निदेशालय, प्रारम्भिक शिक्षा हिमाचल प्रदेश, शिमला (जिसे इसमें इसके पश्चात्‌्‌ कार्यान्वयन अभिकरण कहा गया है) के माध्यम से कार्यान्वित किया जा रहा है;

स्कीम के अन्तर्गत राज्य शिक्षा अनुसंधान और प्रशिक्षण परिषद्‌ (एस0सी0ई0आर0टी0) सोलन के माध्यम से राज्य स्तरीय चयन परीक्षा संचालन करके राज्यव्यापी चयनित एक सौ प्रतिभाशाली छात्रों (जिसे इसमें इसके पश्चात्‌्‌ लाभार्थी कहा गया है) को कार्यान्वयन अभिकरण द्वारा, विद्यमान स्कीम के मार्गदर्शक सिद्धान्तों के अनुसार छठी कक्षा में `4000/- (केवल चार हजार रुपए ), सातवीं कक्षा में `5000/- (केवल पांच हजार रुपए), आठवीं कक्षा में `6000/- (केवल छह हजार रुपए ), की रकम (जिसे इसमें इसके पश्चात्‌्‌ प्रसुविधा कहा गया है) प्रतिमास प्रदान की जाएगी;

(3) आधार (नामांकन और अद्यतन) विनियम, 2016 के विनियम 12 के अनुसार, विभाग को अपने कार्यान्वयन अभिकरण के माध्यम से उन लाभार्थियों के लिए आधार नामांकन सुविधाएं प्रदान करने की आवश्यकता है जो अभी तक आधार के लिए नामांकित नहीं है और यदि सम्बन्धित खण्ड या तहसील में कोई आधार नामांकन केन्द्र अवस्थित नहीं है, तो विभाग अपनी कार्यान्वयन अभिकरण के माध्यम से यू0 आई0 डी0 ए0 आई0 के विद्यमान रजिस्ट्रार के समन्वय से सुविधाजनक स्थानों पर या स्वयं ही यू0 आई0 डी0 ए0 आई0 रजिस्ट्रार बनकर नामांकन प्रसुविधाएं प्रदान करेगाः 8276 राजपत्र, हिमाचल प्रदेश, 20 दिसम्बर 2022/29 मार्गशीर्ष, 1944 परन्तु जब तक कि बालक को आधार समनुदेशित नहीं किया जाता है, तब तक ऐसे बालकों को निम्नलिखित दस्तावेज प्रस्तुत करने के अध्यधीन स्कीम के अधीन प्रसुविधा प्रदान की जाएंगी, अर्थात्‌्‌ः-

(ख) निम्नलिखित में से कोई दस्तावेज है, अर्थात्‌्‌ः--

(i) जन्म का प्रमाण-पत्र; या समुचित प्राधिकरण द्वारा जारी किया गया जन्म का अभिलेख;

या

(ii) माता-पिता के नाम सहित स्कूल के प्रधानाचार्य द्वारा सम्यक्‌ रुप से हस्ताक्षरित स्कूल का पहचान-पत्र; या

(ग) स्कीम के विद्यमान मार्गदर्शक सिद्धान्तों के अनुसार लाभार्थी को माता-पिता या विधिक संरक्षक के साथ सम्बन्ध के सबूत का निम्नलिखित में से दस्तावेज, अर्थात्‌्‌ः- (i) जन्म का प्रमाण-पत्र; या समुचित प्राधिकरण द्वारा जारी किया गया जन्म का अभिलेख;

या

(ii) राशन कार्ड; या

(iv) पेंशन कार्ड; या

(v) सेना की केन्टीन का कार्ड; या

(vi) कुटुम्ब हकदारी का कोई कार्ड; या

(vii) विभाग द्वारा यथाविनिर्दिष्ट कोई अन्य दस्तावेजः

3. उन समस्त मामलों में जहाँ लाभार्थियों के अपकृष्ट (अस्पष्ट) बायोेमैट्रिक के कारण या किसी अन्य कारण से, आधार प्रमाणन असफल रहता है, वहां निम्नलिखित उपचारात्मक क्रियाविधि अंगीकृृत की जाएगी, अर्थात्‌्‌ः-8277 राजपत्र, हिमाचल प्रदेश, 20 दिसम्बर 2022/29 मार्गशीर्ष, 1944 (क) अस्पष्ट उंगली छाप क्वालिटी की दशा में, अधिप्रमाणन हेतु आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन सुविधा अंगीकृत की जाएगी, तद्‌द्वारा विभाग अपने कार्यान्वयन अभिकरण के माध्यम से प्रमाणन के लिए निर्बाध रीति में प्रसुविधाओं के परिदान हेतु उंगली-छाप अधिप्रमाणन सहित आंख की पुतली के स्कैन या चेहरा अधिप्रमाणन के लिए व्यवस्थाएं करेगा;

4. उपरोक्त अन्तर्विष्ट किसी बात के होते हुए भी, स्कीम के अन्तर्गत यदि वह अधिप्रमाणन द्वारा अपनी पहचान सिद्ध करने में असफल रहता है, या आधार नम्बर धारण करने के सबूत प्रस्तुत न करने या यदि किसी बालक, जिसे कोई आधार नम्बर समनुदेशित नहीं किया गया है, अभ्यावेशन के लिए आवेदन प्रस्तुत न करने पर, उसे प्रसुविधा देने से इनकार नहीं किया जाएगा। उसे प्रसुविधा, पैरा 1 के उप-पैरा (3) के परन्तुक के खण्ड (ख) और (ग) में यथावर्णित अन्य दस्तावेजों के आधार पर, उसकी पहचान के सत्यापन करके प्रदान की जाएगी और जब प्रसुविधा ऐसे अन्य दस्तावेजों के आधार पर प्रदान की गई है तो उसको रिकार्ड करने के लिए एक पृथक्‌ रजिस्टर अनुरक्षित किया जाएगा जिसे विभाग द्वारा इसके कार्यान्वयन अभिकरण के माध्यम से कालिकतः पुनर्विलोकित और संपरीक्षित किया जाएगा।

आदेश द्वारा,

No. EDN-C-F(4)1/2015.—Whereas, the use of Aadhaar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Department of Elementary Education (hereinafter referred to as the Department), is administering the Himachal Pradesh Swaran Jayanti Middle Merit Scholarship for Government Schools (hereinafter referred to as the Scheme) to provide scholarship to one hundred meritorious students for three consecutive years in class 6th, 7th and 8th, which is being implemented through the Directorate of Elementary Education, Himachal Pradesh, Shimla (hereinafter referred to as the Implementing Agency);

And whereas, under the Scheme, an amount of `4000/- (Four thousand only) in class 6th, ` 5000/- (Five thousand only) in class 7th, ` 6000/- (Six thousand only) in class 8th, (hereinafter referred to as the benefit) is given to one hundred meritorious students selected statewide by way of conducting a state level selection test through State Council of Education Research and Training, Solan, (hereinafter referred to as the beneficiaries), per month by the Implementing Agency as per the extant Scheme guidelines;

And whereas, the aforesaid Scheme involves recurring expenditure incurred from the Consolidated Fund of Himachal Pradesh;

1. (1) A child desirous of availing the benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhaar authentication.

Provided that till the time Aadhaar is assigned to the child, the benefit under the Scheme shall be given to such children subject to production of the following documents, namely:—

(a) If the child has been enrolled after attaining the age of five years (with biometrics collection), his Aadhaar Enrolment Identification slip, or of bio-metric update identification slip; and

(b) Any one of the following documents, namely:—

i. Birth Certificate; or Record of birth issued by the appropriate authority; or ii. School identity card, duly signed by the Principal of the school, containing parent's names; and8279 राजपत्र, हिमाचल प्रदेश, 20 दिसम्बर 2022/29 मार्गशीर्ष, 1944 (c) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely:—

i. Birth Certificate; or Record of birth issued by the appropriate authority; or ii. Ration Card; or

iii. Ex-Servicemen Contributory Health Scheme (ECHS) Card; or Employee's State Insurance Corporation (ESIC) Card; or Central Government Health Scheme (CGHS) Card; or

iv. Pension Card; or

v. Army Canteen Card; or

vi. Any Government Family Entitlement Card; or

vii. Any other document as specified by the Department:

Provided further that the above documents shall be checked by an officer specifically designated by the Department for that purpose.

3. In all cases, where Aadhaar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or8280 राजपत्र, हिमाचल प्रदेश, 20 दिसम्बर 2022/29 मार्गशीर्ष, 1944 furnishing proof of possession of Aadhaar number, or in the case of a child to whom no Aadhaar number has been assigned, producing an application for enrolment. The benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses (b) and (c) of the proviso of sub-paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.

5. This notification shall come into effect from the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.

संख्याः एल0एल0आर0-ई(9)-33/2005-लेज.--श्री अमरजीत सिंह पशरीचा, अधिवक्ता को इस विभाग की अधिसूचना संख्याः एल0 एल0 आर0-ई(9)16/2007-लेज दिनांक 27-06-2017 द्वारा नोटरी के रूप में नियुक्त किया गया था और उनको उप-मण्डल गोहर, जिला मण्डी की क्षेत्रीय सीमाओं के भीतर व्यवसाय करने के लिए प्राधि—त किया गया था और उनका नाम नोटरी के रजिस्टर में क्रम संख्या 466 पर दर्ज किया गया था;

और श्री अमरजीत सिंह पशरीचा को जारी व्यवसाय प्रमाण-पत्र दिनांक 31-07-2022 तक विधिमान्य था। नोटरी नियम 1952 (केन्द्रीय अधिनियम संख्यांक 53 का 1952) की धारा 5 कीे उप-धारा (2) के अंतर्गत पठित नोटरी नियम, 1956 के नियम, 8बी के प्रावधानों के तहत व्यवसाय प्रमाण-पत्र को उसकी वैधता अवधि की समाप्ति से छह महीने पहले नवीनीकरण के लिए आवेदन करना आवश्यक था। तथापि उनके द्वारा इस तरह का कोई आवेदन नहीं किया गया था और उपरोक्त व्यवसाय प्रमाण-पत्र 01-08-2022 को समाप्त हो गया था;

और श्री अमरजीत सिंह पशरीचा को इस विभाग के ज्ञापन सम संख्या दिनांक 21 सितम्बर, 2022 के माध्यम से इस मामले में अपना पक्ष रखने का अवसर प्रदान किया गया था। चूंकि, इस ज्ञापन के संदर्भ में उन्होंने जबाव दिया है, जिसे संतोषजनक नहीं पाया गया, इसलिए इस विभाग के आदेश दिनांक 13-12-2022 द्वारा इसे अस्वी—त कर दिया था।

अतः हिमाचल प्रदेश के राज्यपाल, नोटरी नियम, 1956 के नियम 13 (13) और नोटरी अधिनियम, 1952 की धारा 10(च) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए श्री अमरजीत सिंह पशरीचा, नोटरी, उप-मण्डल गोहर, जिला मण्डी का नाम नोटरी के रजिस्टर से तुरन्त प्रभाव से हटाए जाने का आदेश करते हैं ।

No. LLR-E(9)-33/2005-Leg.—WHEREAS, Shri Amarjeet Singh Pasreecha, Advocate was appointed as Notary vide Notification No. LLR-E (9)-16/2007-Leg. dated 27-06-2017 and authorized to practice as such within the territorial limits of Sub-Division Gohar of District Mandi and his name was entered at serial No. 466 in the Register of Notaries;

AND WHEREAS, the Certificate of Practice issued in favour of Shri Amarjeet Singh Pasreecha was valid up to 31-07-2022. As per the provisions under sub-section (2) of Section 5 of the Notaries Act, 1952 (Central Act No. 53 of 1952) read with rule 8B of the Notaries Rules, 1956, an application for renewal of Certificate of Practice was required to be submitted six months before the date of expiry of its period of validity. However, no such application was submitted and the said Certificate of Practice expired on 01-08-2022;

AND WHEREAS, Sh. Amarjeet Singh Pasreecha was afforded an opportunity to make submissions, if any, in the matter vide Memorandum of even number dated 21st September, 2022. Since, the reply submitted by him to the said Memorandum was not found satisfactory, therefore, the same was rejected vide Order dated 13-12-2022.

NOW THEREFORE, the Governor, Himachal Pradesh in exercise of the powers conferred by Section 10(f) of the Notaries Act, 1952 and rule 13(13) of the Notaries Rules, 1956, hereby orders the removal of the name of Shri Amarjeet Singh Pasreecha, Notary, Sub-Division Gohar of District Mandi from the Register of Notaries with immediate effect.

No. HFW-B(F)4-9/2017-VOL-V.—In continuation of this department notification No. HFW-B(F)4-9/2017-II dated 27-02-2019 vide which the Post Graduation/ Super Speciality Policy,8284 राजपत्र, हिमाचल प्रदेश, 20 दिसम्बर 2022/29 मार्गशीर्ष, 1944 2019 was notified, the Governor, Himachal Pradesh is pleased to amend/ replace/ delete the following provisions of PG/SS Policy, with immediate effect, in the public interest from the academic Session 2022-23 as under:—

Clause 4.1.1 of PG/SS Policy dated 27-02-2019 shall be replaced as under:

4.1.1 GDOs appointed to the service through route other than HPPSC will be appointed on contract basis; initially for a period of one year extendable on year to year basis in accordance with the provisions of the R&P Rules and prevailing policy of the Government.

Clause 4.1.2 and 4.1.3 of PG/SS Policy dated 27-02-2019 are deleted:

Clause 6.1 of PG/SS Policy dated 27-02-2019 shall be replaced as under:

6.1 As the Government incurs substantive expenditure on each candidate for doing Post Graduation and also pays them full pay along with all allowances and seniority during the course, every GDO (regular/ contract) who have been sponsored to pursue Post Graduation within the State in Government Medical/ Dental Colleges shall have to furnish a bond to serve the State for atleast four years including mandatory first year of field posting after completion of their respective courses. Similarly, in case of GDOs sponsored for Post Graduation outside the State on sponsored quota seats of autonomous Institutions, as the Government pays them full pay alongwith increments during the course and they are not even serving the state during the course, every such GDO (regular) shall have to furnish a bond to serve the State for atleast five years including mandatory first year of field posting after completion of their respective courses. Since the direct candidate who pursues Post Graduation within the State in Government Medical/Dental Colleges on State/All India Quota stand on a different footing as they are not entitled to service benefits including full pay (with allowances and increments) and chances of regularisation to which their GDO counterparts are entitled; however, keeping in view the resources expended in their education by the government including payment of stipend, every such direct candidate shall have to furnish a bond to serve the State for atleast two years including mandatory first year of field posting after completion of their respective courses;

Provided further that such GDOs who get selected as per Clause 6.5, for doing Super speciality before completion of the bond period of Post Graduation i.e. after mandatory completion of one year of field posting as such in that event the candidate already being bonded to serve the State as per the provisions of this policy for doing Post Graduation for 4/5 years alongwith bond amount of 40 Lakhs on such selection for the Super speciality course will have to furnish an undertaking on judicial paper to serve the balance bond period for doing Post Graduation alongwith the bond period applicable after doing Super Speciality course for serving the State as the case may be. For this purpose both the bond periods shall be clubbed together for serving the State for a period equal to balance bond period of PG course + mandatory period of bond in respect of Superspeciality course apart from the mandatory one year of field posting and the candidates shall furnish a fresh bond in the form of legal undertaking to serve the State for the clubbed period failing which the candidate shall have to pay Rs. 90 Lakhs to the State Government. The candidate shall also furnish an undated cheque from a scheduled bank amounting to Rs. 90 Lakhs in the name of DHS/DME. The DHS/DME shall be at liberty to get the cheque encashed in event of violation of the bond conditions.

6.5 In no case, NOC will be granted for second Post Graduation course to any candidate during the mandatory period of service of the State after first Post Graduation except for doing the super speciality course, in which case the candidate will be considered for the grant of NOC after completing one year compulsory field posting subject to 'balance' bond period as per Clause No. 6.1.
