संख्याः गृह-सी(बी) 2-7/2016-I.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कार्मिक विभाग के पत्र संख्या पर (ए पी)-सी-ए(3)-5/2013-II तारीख 12-08-2022 एवं 16-08-2022 द्वारा जारी अनुदेशों के अनुसरण में, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से इस विभाग की अधिसूचना संख्या गृह-सी (बी) 2-7/2016-जेलस तारीख 27-01-2021 द्वारा अधिसूचित हिमाचल प्रदेश कारागार एवं सुधारात्मक सेवाएं विभाग, वार्डर, वर्ग–III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2021 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(i) इन नियमों का संक्षिप्त नाम, हिमाचल प्रदेश कारागार एवं सुधारात्मक सेवाएं विभाग, वार्डर, वर्ग–III (अराजपत्रित) भर्ती और प्रोन्नति (प्रथम संशोधन) नियम, 2022 है। (ii) ये नियम राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. उपाबन्ध ''क'' का संशोधन.--हिमाचल प्रदेश कारागार एवं सुधारात्मक सेवाएं विभाग, वार्डर, वर्ग–III (अराजपत्रित) भर्ती और प्रोन्नति नियम, 2021 (जिसे इसमें इसके पश्चात्‌ 'उक्त नियम' कहा गया है) से संलग्न उपाबन्ध-क में,-

स्तम्भ संख्या 4 का संशोधनः

(क) स्तम्भ संख्या 4 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः- ''(i) नियमित पदधारी (पदधारियों) के लिए वेतनमानः ` 20,200/-(20,200-64,000 रुपए) हि0 प्र0 सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार पद के टाइम स्केल से संलग्न पे-मैट्रिक्स का लेवल (स्तर)-03''।

(ii) संविदा पर नियुक्त कर्मचारी (कर्मचारियों) के लिए उपलब्धियांः

स्तम्भ संख्या 15-क में दिए गए ब्यौरे के अनुसार 12,120/- रुपए प्रतिमास। 8358 राजपत्र, हिमाचल प्रदेश, 24 दिसम्बर 2022/03 पौष, 1944 हि0 प्र0 सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ठ का 60 प्रतिशत।

स्तम्भ संख्या 15 का संशोधनः

(ख) स्तम्भ संख्या 15 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- ''सीधी भर्ती के मामले में पद पर नियुक्ति के लिए, चयन, लिखित परीक्षा के गुणागुण और/या व्यवहारिक परीक्षा, या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/हिमाचल प्रदेश कर्मचारी चयन आयोग हमीरपुर/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा''। स्तम्भ संख्या 15-क का संशोधनः

(ग) स्तम्भ संख्या 15-क में,-

(i) क्रम संख्या II के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"(II) संविदात्मक उपलब्धियांः-

संविदा के आधार पर नियुक्त वार्डर को 12,120/- रुपए की दर से समेकित नियत संविदात्मक रकम (जो तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ठ का 60 प्रतिशत होगी) प्रतिमास संदत्त की जाएगी।

(घ) स्तम्भ संख्या 15-(IV) के सामने विद्यमान उपबन्ध क्रम संख्या (IV) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"(IV) चयन प्रक्रियाः

''संविदा नियुक्ति/भर्ती के मामले में पद पर नियुक्ति के लिए, चयन, लिखित परीक्षा के गुणागुण या व्यवाहारिक परीक्षा, या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/हिमाचल प्रदेश कर्मचारी चयन आयोग हमीरपुर/अन्य भर्ती अभिकरण/ प्राधिकरण द्वारा अवधारित किया जाएगा।''

(ङ) क्रम संख्या (VII) के खण्ड (क) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''(क) संविदा के आधार पर नियुक्त वार्डर को ` 12,120/- की दर से समेकित नियत संविदात्मक रकम (जो तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू स्तर के प्रथम कोष्ठ का 60 प्रतिशत होगी) प्रतिमास संदत्त की जाएगी।''

3. परिशिष्ट-II का संशोधन.--उक्त नियमों से संलग्न परिशिष्ट-II के क्रम संख्या 2 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''2. प्रथम पक्षकार की संविदात्मक रकम ` 12,120/- रुपए [जो तत्स्थानी संवर्ग (काडर) के पे मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ठ का 60 प्रतिशत होगा] प्रतिमास होगी।''

भरत खेड़ा, प्रधान सचिव (गृह)।8359 राजपत्र, हिमाचल प्रदेश, 24 दिसम्बर 2022/03 पौष, 1944 उपाबन्ध-''ख'' हिमाचल प्रदेश कारागार एवं सुधारात्मक सेवाएं विभाग में वार्डर (पुरुष और महिला) की भर्ती के लिए प्रक्रिया :-

7.3 लिखित परीक्षा (अधिकतम 100 अंक).--लिखित परीक्षा, भर्ती बोर्ड/समिति द्वारा निर्धारित स्थान पर, आयोजित की जाएगी, जो 100 मिनट की अवधि की और वस्तुनिष्ठ प्रकार के 100 अंकों की होगी। इसमें निम्नलिखित उप-समूह सम्मिलित होंगेः-

उपरोक्त लिखित परीक्षा के लिए पाठ्‌यक्रम 102 स्तर का होगा और गणित के लिए पाठ्‌यक्रम मैट्रिक स्तर का होगा।

सामान्य/अन्य पिछड़ा वर्ग के प्रवर्ग से सम्बधित ऐसे अभ्यर्थियों, जिन्होने लिखित परीक्षा में पचास प्रतिशत अंक और अनुसूचित जाति/अनुसूचित जनजाति के प्रवर्गों से सम्बधित अभ्यर्थियों की दशा में उन अभ्यर्थियों जिन्होंने चालीस प्रतिशत अंक प्राप्त किए हों, अर्हित समझा जाएगा।

8. अन्तिम परिणाम लिखित परीक्षा में अभिप्राप्त कुल अंकों (100 अंकों) में से होगा।

Shimla-2, the 22nd December, 2022

No. Home-C(B)2-7/2016-I.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in pursuance to the Department of Personnel's instructions issued vide letter No. PER(AP)-C-A(3)-5-2013-II dated 12-08-2022 and 16-08-2022, issued in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following Rules further to amend the Himachal Pradesh Prisons and Correctional Services Department, Warder, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2021 notified vide this Department Notification No. Home-C(B)2-7/2016-Jails dated 27-01-2021, namely:—

1. Short title and commencement.—(i) These Rules may be called the Himachal Pradesh Prisons and Correctional Services Department, Warder, Class-III (Non-Gazetted), Recruitment and Promotion Rules (1st amendment), 2022.

(ii) These rules shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Annexure—''A''.—In Annexure-"A" appended to the Himachal Pradesh Prisons and Correctional Services Department, Warder, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2021 (hereinafter referred as the said Rules),—

Amendment in Column No. 4.

(a) For the existing provision against Column No.4, the following shall be substituted, namely:—

(i) Pay Scale for regular incumbent(s) : Rs. 20,200/- (Pay Scale Rs. 20,200-64,000):

"Level 03 of the pay matrix attached with time scale of the post, as per H.P. Civil Services (Revised Pay) Rules, 2022".

(ii) Emoluments for contract employee(s) : Rs.12,120/- P.M. as per details given in Column No.15-A:

"60% of the first cell of the applicable level of pay matrix of the corresponding cadre, as per H.P. Civil Services (Revised Pay) Rules, 2022."

Amendment in Column No. 15:

(b) For the existing provision against Column No.15, the following shall be substituted, namely:—

"Selection for appointment to the post in the case of direct recruitment shall be made on the basis of merit of written examination and/or practical test or skill test or physical test, the standard/syllabus etc. will be determined by the Himachal Pradesh Public Service Commission/Himachal Pradesh Staff Selection Commission Hamirpur/ other recruiting agency/ authority, as the case may be."

Amendment in Column No. 15 –A:

(c) In Column No.15-A:—

(i) For serial No. II, the following shall be substituted, namely:—

"(II) CONTRACTUAL EMOLUMENTS:

The Warder appointed on contract basis will be paid consolidated fixed contractual amount @ ` 12,120/- P.M. (which shall be 60% of the first cell of the applicable level of pay matrix of the corresponding cadre)".

(d) For serial No. (IV), the following shall be substituted, namely:—

"(IV) SELECTION PROCESS:

Selection for appointment to the post in the case of contract appointment/ recruitment shall be made on the basis of merit of written examination and/or practical test or skill test or physical test, the standard/ syllabus etc. will be determined by the Himachal Pradesh Public Service Commission/Himachal Pradesh Staff Selection Commission Hamirpur/other recruiting agency/authority, as the case may be".

(e) In serial No. (VII) for the clause(a), the following shall be substituted, namely:—

"(a) The Warder appointed on contract basis will be paid consolidated fixed contractual amount @ ` 12,120/- P.M. (which shall be 60% of the first cell of the applicable level of pay matrix of the corresponding cadre)".

3. Amendment of Appendix-II.—In Appendix-II appended to the said Rules, for serial No. 2, the following shall be substituted, namely:—

"2. The contractual amount of the FIRST PARTY will be `12,120/- per month (which shall be 60% of the first cell of the applicable level of pay matrix of the corresponding cadre)".

ANNEXURE- "B" Procedure for recruitment of Warder (Male and Female) in the Department of Prisons & Correctional Services, Himachal Pradesh:—

7.3 Written Test (Maximum 100 Marks).—Written test will be held at a place fixed by the Recruitment Board/ Committee, which will be of 100 marks of objective type of 100 minutes duration. It will include the following sub-groups:—

The syllabus for the above written examination shall be of 10+2 standard except Mathematics for which syllabus shall be of Matriculation standard.

Only such candidates shall be deemed to have qualified who secure 50% marks in the written test in case of those belonging to General/OBC categories and 40% marks in the case of those belonging to Scheduled Castes and Scheduled Tribes categories.

8. The final result will be the sum total of marks obtained in the Written Test (100 marks).

हि0 प्र0 सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ठ का 60 प्रतिशत।

स्तम्भ संख्या 15 का संशोधनः

(i) क्रम संख्या II के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"(II) संविदात्मक उपलब्धियां-

(ii) क्रम संख्या (IV) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"(IV) चयन प्रक्रियाः

''संविदा नियुक्ति/भर्ती के मामले में पद पर नियुक्ति के लिए, चयन, लिखित परीक्षा के गुणागुण या व्यवहारिक परीक्षा, या दक्षता परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर /पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/ हिमाचल प्रदेश कर्मचारी चयन आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा।''

(iii) क्रम संख्या (VII) के खण्ड (क) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

No. Home-C(B)2-7/2016-Loose.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in pursuance to the Department of Personnel's instructions issued vide letter No. PER(AP)-C-A(3)-5-2013-II dated 12-08-2022 and 16-08-2022, issued in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following Rules further to amend the Himachal Pradesh Prisons and Correctional Services Department, Assistant Superintendent Jail/Welfare Officer-cum- Assistant Superintendent Jail, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 20208364 राजपत्र, हिमाचल प्रदेश, 24 दिसम्बर 2022/03 पौष, 1944 notified vide this Department Notification No. Home-C (B) 2-6/2016-Jails dated 29-12-2020, namely:—

1. Short title and commencement.—(i) These Rules may be called the Himachal Pradesh Department of Prisons and Correctional Services, Assistant Superintendent Jail/Welfare Officer-cum-Assistant Superintendent Jail, Class-III (Non-Gazetted), Recruitment and Promotion Rules (1st amendment), 2022. (ii) These rules shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Annexure-''A''.—In Annexure-"A" appended to the Himachal Pradesh Prisons and Correctional Services Department, Assistant Superintendent Jail/Welfare Officer-cum-Assistant Superintendent Jail, Class-III (Non-Gazetted) Recruitment and Promotion Rules, 2020 (herein after referred as the said Rules),—

Amendment in Column No. 4.

(a) For the existing provision against Column No.4, the following shall be substituted, namely:—

(i) Pay Scale for regular incumbent(s) :

Rs. 38,100—1,20,400/-

"Level 10 of the pay matrix attached with time scale of the post, as per H.P. Civil Services (Revised Pay) Rules, 2022".

(ii) Emoluments for contract employee(s) :

Rs. 22,860/- P.M. as per details given in Column No.15-A:

"60% of the first cell of the applicable level of pay matrix of the corresponding cadre, as per H.P. Civil Services (Revised Pay) Rules, 2022."

Amendment in Column No. 15:

(b) For the existing provision against Column No.15, the following shall be substituted, namely:—

"Selection for appointment to the post in the case of direct recruitment shall be made on the basis of merit of written examination and/or practical test or skill test or physical test, the standard/syllabus etc. will be determined by the Himachal Pradesh Public Service Commission/Himachal Pradesh Staff Selection Commission Hamirpur/other recruiting agency/ authority, as the case may be."

2. Amendment in Column No. 15 –A:

(c) In Column No.15-A:—

(i) For serial No. II, the following shall be substituted, namely:—

"(II) CONTRACTUAL EMOLUMENTS:

The Assistant Superintendent Jail/Welfare Officer-cum-Assistant Superintendent Jail appointed on contract basis will be paid consolidated fixed contractual amount @ ` 22,860/- P.M. (which shall be 60% of the first cell of the applicable level of pay matrix of the corresponding cadre)".

(d) For serial No. (IV), the following shall be substituted, namely:—

" (IV) SELECTION PROCESS:

Selection for appointment to the post in the case of contract appointment/recruitment shall be made on the basis of merit of written examination and/or practical test or skill test or physical test, the standard/ syllabus etc. will be determined by the Himachal Pradesh Public Service Commission/Himachal Pradesh Staff Selection Commission Hamirpur/other recruiting agency/ authority, as the case may be".

(e) In serial No. (VII) for the clause (a), the following shall be substituted, namely:—

"(a) The Assistant Superintendent Jail/Welfare Officer-cum-Assistant Superinten-dent Jail appointed on contract basis will be paid consolidated fixed contractual amount @ ` 22,860/- P.M. (which shall be 60% of the first cell of the applicable level of pay matrix of the corresponding cadre)".

3. Amendment of Appendix-II.—In Appendix-II appended to the said Rules, for serial No. 2, the following shall be substituted, namely:—

"2. The contractual amount of the FIRST PARTY will be ` 22,860/- per month (which shall be 60% of the first cell of the applicable level of pay matrix of the corresponding cadre)".

(ii) These rules shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

स्तम्भ संख्या 15 का संशोधनः-

(ख) स्तम्भ संख्या 15 के सामने विद्यमान उपबन्ध के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- ''सीधी भर्ती के मामले में पद पर नियुक्ति के लिए, चयन, लिखित परीक्षा के गुणागुण और/या व्यवहारिक परीक्षा, या दक्षता परीक्षा या शारीरिक परीक्षा या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/ हिमाचल प्रदेश कर्मचारी चयन आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा।'' स्तम्भ संख्या 15-क का संशोधनः

(ग) स्तम्भ संख्या 15-क में,-

(i) क्रम संख्या II के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-
