संख्याः श्रम (ए)3-9/2021.--हिमाचल प्रदेश के राज्यपाल, भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्तें विनियमन) अधिनियम, 1996 की धारा 18 के साथ पठित धारा 40 तथा 62 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, उक्त अधिनियम की धारा 5 के अधीन गठित विशेषज्ञ समिति के परामर्श से इस विभाग की अधिसूचना संख्याः श्रम (ए) 4-6/2007-बी.ओ.सी.डब्ल्यू, तारीख 4 दिसम्बर, 2008 को अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 8 दिसम्बर, 2008 को प्रकाशित हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्तें विनियमन) नियम, 2008 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थातः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्तें विनियमन) प्रथम संशोधन, नियम, 2023 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 266 का संशोधन.--हिमाचल प्रदेश भवन और अन्य सन्निर्माण कर्मकार (नियोजन तथा सेवा-शर्तें विनियमन) नियम, 2008 के नियम 266 के उप-नियम (3) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''(3) रजिस्ट्रीकरण के लिए आवेदन निम्नलिखित किन्हीं दस्तावेजों के साथ किया जाएगा; परंतु आवेदक ने पूर्ववर्ती बारह मास में कम से कम 90 दिनों के लिए कार्य किया होः-10043 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 (i) नियोजक/संविदाकार से उस आशय का प्रमाण-पत्र या मजदूरी पर्ची या मस्टर रोल या उपस्थिति रजिस्टर की प्रति कि आवेदक एक सन्निर्माण कर्मकार है। इसमें निम्नलिखित सूचना अंतर्विष्ट होनी चाहिएः-

(क) नियोजन की अवधि को स्पष्ट रूप से उल्लिखित करते हुए सन्निर्माण कर्मकार की विशिष्टियां;

(ख) नियोजक/संविदाकार के नाम के बारे में पूर्ण सूचना;

(ग) कार्य का नाम/कार्य का अभिधान और लागत आदि; और

(घ) क्या नियोजक/संविदाकार ने निष्पादित कार्य के लिए उपकर का संदाय किया हैः परन्तु ऐसे समस्त प्रमाण-पत्रों/दस्तावेजों का संबंधित क्षेत्र के बोर्ड के प्राधिकृत अधिकारी द्वारा सत्यापन करवाया जाएगा।

(ii) यदि उपरोक्त खंड (i) के अनुसार प्रमाण-पत्र या दस्तावेज उपलब्ध नहीं है, तो या तो शहरी स्थानीय निकायों के कार्यकारी अधिकारी या नगर पंचायत के सचिव या नगर निगम क्षेत्र में सम्बन्धित पार्षद/वार्ड सभा के सदस्य या ग्राम पंचायत के पंचायत सचिव द्वारा जारी किया गया प्रमाण-पत्र, जिसमें कर्मकार के नियोजन की अवधि, सन्निर्माण कार्य के नाम आदि से सम्बन्धित सूचना अंतर्विष्ट है, पर भी विचार किया जा सकेगा।

(iii) उपरोक्त खंड (i) और (ii) के अधीन पूर्ववर्ती बारह मास के दौरान 90 दिन की कार्य अवधि को कर्मकार के रजिस्ट्रीकरण पर विचार करने के लिए जोड़ा जाएगा।"।

NOTIFICATION

Shimla-171 002, the 8th February, 2023

No. Shram(A)3-9/2021.—In exercise of powers conferred by Section 40 and 62 read with section 18 of the Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996, the Governor, Himachal Pradesh, in consultation with the expert committee, constituted under section 5 of the said Act is pleased to make the following rules further to amend the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008, notified vide this Department's notification No. Shram(A)4-6/2007-BOCW, dated 4th December, 2008 and published in the Rajpatra, Himachal Pradesh, dated 8th December, 2008, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) First Amendment Rules, 2023.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule 266.—For sub-rule (3) of rule 266 of the Himachal Pradesh Building and Other Construction Workers (Regulation of Employment and Conditions of Service) Rules, 2008, the following shall be substituted, namely:—

"(3) The application for registration shall be accompanied with any of the following documents, provided that the applicant has worked for atleast 90 days in the preceding twelve months:—

(i) A certificate or wage slip or copy of Muster Roll or Attendance Register from the employer/ contractor to the effect that the applicant is a construction worker. It must contain the following information:—

(a) Particulars of the Construction Worker clearly mentioning period of employment;

(b) Full information about the employer's/ contractor's name;

(c) Name of work/ title of the work and cost etc.; and

(d) Whether employer/ contractor has paid cess for the work executed:

Provided that all such certificates/ documents shall be got verified by the Authorized Officer of the Board for the area concerned.

(ii) If certificate or documents as per clause (i) above are not available, a certificate issued either by Executive Officer of the Urban Local Bodies or Secretary of the Nagar Panchayat or respective Councillor/ Member of Ward Sabha in Municipal Corporation area or Panchayat Secretary of the Gram Panchayat, containing information regarding period of employment of Worker, Name of the Construction Work etc., may also be considered.

(iii) The work period of 90 days under clauses (i) and (ii) above during the preceding twelve months shall be clubbed for considering registration of the worker.".

संख्याः एल0एल0आर0-डी0(6)-4/2023-लेज.--हिमाचल प्रदेश के राज्यपाल ने भारत के संविधान के अनुच्छेद 213 (1) के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए हिमाचल प्रदेश जल-विद्युत उत्पादन पर जल उपकर अध्यादेश, 2023 को दिनांक 15-02-2023 को प्रख्यापित कर दिया है तथा अनुच्छेद 348 के खण्ड (3) के अधीन, अध्यादेश के अंग्रेजी पाठ को राजपत्र, हिमाचल प्रदेश में प्रकाशित करने के लिए प्राधिकृत कर दिया है। अतः उपरोक्त अध्यादेश को वर्ष 2023 के अध्यादेश संख्यांक 2 के रूप में अंग्रेजी प्राधिकृत पाठ सहित राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित किया जाता है।

2023 का हिमाचल प्रदेश अध्यादेश संख्यांक 2 हिमाचल प्रदेश जल-विद्युत उत्पादन पर जल उपकर अध्यादेश, 2023

भारत गणराज्य के चौहत्तरवें वर्ष में हिमाचल प्रदेश के राज्यपाल द्वारा प्रख्यापित।

हिमाचल प्रदेश राज्य में जल-विद्युत उत्पादन पर जल उपकर अधिरोपित करने और हिमाचल प्रदेश राज्य में राजस्व उत्पत्ति के लिए अध्यादेश।

हिमाचल प्रदेश विधान सभा सत्र में नहीं है और हिमाचल प्रदेश के राज्यपाल का यह समाधान हो गया है कि ऐसी परिस्थितियां विद्यमान हैं जिनके कारण उनके लिए तुरन्त कार्रवाई करना आवश्यक हो गया है;

अतः हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 213 के खण्ड (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित अध्यादेश प्रख्यापित करते हैंः-

अध्याय-1 प्रारम्भिक

1. संक्षिप्त नाम, विस्तार और प्रारम्भ.--(1) इस अध्यादेश का संक्षिप्त नाम हिमाचल प्रदेश जल-विद्युत उत्पादन पर जल उपकर अध्यादेश, 2023 है।

(2) इसका विस्तार सम्पूर्ण हिमाचल प्रदेश राज्य पर होगा।

(3) यह उस तारीख को प्रवृत्त होगा, जो राज्य सरकार, राजपत्र (ई-गजट), हिमाचल प्रदेश में अधिसूचना द्वारा नियत करे।

(4) तत्समय प्रवृत्त किसी अन्य विधि में अन्तर्विष्ट किसी बात के असंगत होते हुए भी इस अध्यादेश के उपबन्ध प्रभावी होंगे।

2. परिभाषाएं.--इस अध्यादेश में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,- 10046 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 (क) "आयोग" से इस अध्यादेश की धारा 20 के अधीन जल-विद्युत उत्पादन पर जल उपकर हेतु स्थापित हिमाचल प्रदेश राज्य आयोग अभिप्रेत है;

(ख) "सरकार" या "राज्य सरकार" से हिमाचल प्रदेश सरकार अभिप्रेत है; (ग) "जल-विद्युत" या "जल-विद्युत ऊर्जा" से, ऊर्जा के नवीकरणीय स्रोत अभिप्रेत है जो राज्य के राज्यक्षेत्र के भीतर किसी जल स्रोत से निकाले गए जल के उपयोग से विद्युत उत्पादन करते हैं; (घ) "अधिसूचना" से राजपत्र ई-गजट, हिमाचल प्रदेश में, प्रकाशित अधिसूचना अभिप्रेत है और पद "अधिसूचित करना" तद्‌नुसार अर्थान्वित किया जाएगा;

(ङ) "उपयोगकर्ता" से विद्युत के उत्पादन के लिए किसी स्रोत से जल निकालने की प्रसुविधा के उपभोग हेतु इस अध्यादेश के अध्याय-2 के अधीन प्राधिकृत जल निकालने वाला कोई व्यक्ति, व्यक्तियों के समूह, स्थानीय निकाय, सरकारी विभाग, कम्पनी, निगम, सोसाइटी इत्यादि या कोई अन्य प्राधिकारी अभिप्रेत है;

(च) "जल" से किसी नदी, झरने, सहायक नदी, नहर, नाले, में बहने वाला प्राकृतिक स्रोत या किसी अन्य जल का प्राकृतिक स्रोत या किसी भूमि की सतह पर बना जैसे तालाब, झील, दलदल, झरना अभिप्रेत है;

(छ) "जल स्त्रोत" से कोई नदी और इसकी सहायक नदियां, जलधारा, नाला, नहर, झरना, तालाब, झील, जल स्त्रोत या कोई अन्य स्त्रोत अभिप्रेत है, जिनसे विद्युत उत्पादन हेतु जल निकाला जाता है; और

(ज) "जल उपकर" से विद्युत उत्पादन के लिए निकाले गए जल हेतु इस अध्यादेश के अधीन नियत और अधिरोपित या प्रभारित दर अभिप्रेत है।

अध्याय-2 प्रस्तावना

3. सामान्य.--(1) इस अध्यादेश के प्रयोजन के लिए राज्य में अवस्थित प्रत्येक जल स्रोत राज्य की सम्पत्ति है और रहेगी तथा किसी व्यक्ति, व्यक्तियों के समूह या अन्य निकाय, निगम, कंपनी, सोसाइटी या समुदाय में निहित ऐसे जल संसाधनों पर कोई साम्पत्तिक स्वामित्व या तटीय या उपयोग का अधिकार, अध्यादेश के प्रारम्भ होने की तारीख से पर्यवसित हुआ और सरकार में निहित समझा जाएगा। तथापि, अन्तर्राज्यीय प्रकृति की नदियों और अन्तर्राष्ट्रीय संधियों के दायरे में आने वाली नदियों के संबंध में हिमाचल प्रदेश सरकार का अधिकार जल के गैर-क्षयकारी उपयोग तक सीमित रहेगा।

(2) कोई भी व्यक्ति, व्यक्तियों का समूह, सरकारी विभाग, स्थानीय प्राधिकारी, निगम, कंपनी, सोसाइटी या अन्य निकाय इस अध्यादेश के उपबंधों के अनुसार के सिवाय किसी अन्य स्रोत से जल-विद्युत उत्पादन हेतु जल का उपयोग नहीं करेगा।

अध्याय-3

जल-विद्युत उत्पादन इकाई के प्रतिष्ठापन द्वारा जल का उपयोग

4. जल के उपयोग हेतु योजना का प्रतिष्ठापन.--कोई व्यक्ति, व्यक्तियों का समूह, सरकारी विभाग, स्थानीय प्राधिकारी, निगम, कंपनी, सोसाइटी या अन्य निकाय, चाहे वह किसी भी नाम से ज्ञात हो, इस अध्याय में इसके पश्चात्‌ उपबंधित उपबन्धों के अनुसरण में आयोग के अधीन रजिस्ट्रीकृत होने के सिवाय जल-विद्युत उत्पादन हेतु किसी अन्य जल स्रोत के जल के उपयोग (गैर-क्षयकारी उपयोग) के लिए अपेक्षित योजना प्रतिष्ठापित नहीं करेगा।

5. उपयोगकर्ता द्वारा जल के उपयोग हेतु स्वीकृत योजना का प्रस्तुतीकरण.--कोई उपयोगकर्ता, जो जल-विद्युत के उत्पादन के प्रयोजन हेतु जल के उपयोग (गैर-क्षयकारी उपयोग) की आवश्यकता के लिए योजना प्रतिष्ठापित करना चाहता हो वह सक्षम प्राधिकारी द्वारा सम्यक्‌ रूप से स्वीकृत योजना की विस्तृत परियोजना रिपार्ट ऐसी फीस और प्रभार सहित आयोग को प्रस्तुत करेगा आयोग द्वारा जैसी रजिस्ट्रीकरण हेतु नियत की जाए।10047 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 6. योजना की स्वीकृति.--किसी उपयोगकर्ता से योजना प्राप्त करने के पश्चात्‌ आयोग अध्यादेश के अधीन योजना को स्वीकार किए जाने के लिए विचार करेगा।

7. उपयोगकर्ता को सूचना.--धारा 6 के अधीन रजिस्ट्रीकृत आयोग द्वारा योजना स्वीकार कर लेने के पश्चात्‌ आयोग योजना को रजिस्ट्रीकृत करेगा और उपयोगकर्ता को सूचित करेगा कि वह-

(क) ऐसे प्ररूप और ऐसी रीति में जैसी विहित की जाए, आयोग के साथ करार निष्पादित करे; और (ख) अध्यादेश के अध्याय-4 के अधीन ऐसी फीस और जल उपकर का संदाय करना, जैसा इस अध्यादेश के अध्याय-4 के अधीन नियत किया जाए।

8. योजना के प्रतिष्ठापन पर प्रतिषेध.--धारा 10 की अपेक्षाओं का पालन किए बिना, कोई उपयोगकर्ता जल के उपयोग आवश्यकता वाली कोई योजना प्रतिष्ठापित नहीं करेगा।

9. जल के उपयोग हेतु रजिस्ट्रीकरण.--कोई व्यक्ति जल का अपेक्षित उपयोग या जल का किसी अन्य रीति से उपयोग तब तक नहीं करेगा जब तक कि वह धारा 10 के अधीन जारी रजिस्ट्रीकरण प्रमाण-पत्र द्वारा ऐसा करने के लिए प्राधिकृत न हो।

10. रजिस्ट्रीकरण प्रमाण पत्र जारी करना.--जल विद्युत उत्पादन हेतु जल के उपयोग (गैर-क्षयकारी उपयोग) के इच्छुक व्यक्ति को अध्यादेश के अधीन उपयोगकर्ता और आयोग के मध्य करार निष्पादित किए जाने के पश्चात्‌ एक रजिस्ट्रीकरण प्रमाण पत्र जारी किया जाएगा।

11. रजिस्ट्रीकृत उपयोगकर्ता द्वारा निषिद्ध कतिपय बातें.--कोई भी रजिस्ट्रीकृत उपयोगकर्ता आयोग के पूर्व अनुमोदन के बिनाः-

(क) किसी अन्य उपयोगकर्ता की उपयोगिता को क्रय या अधिगृहीत करने या अन्यथा द्वारा अर्जित करने के लिए कोई संव्यवहार नहीं करेगा; या

(ख) अपनी उपयोगिता का किसी अन्य उपयोगकता की उपयोगिता के साथ विलयन नहीं करेगा। (ग) आयोग के पूर्व अनुमोदन के बिना बिक्री, पट्टे, विनिमय या अन्यथा द्वारा उसकी रजिस्ट्रीकरण या उपयोगिता को या इसके किसी भाग को समनुदेशित या अंतरित नहीं करेगा।

12. रजिस्ट्रीकृत उपयोगकर्ता के कर्त्तव्य, बाध्यताएं और उत्तरदायित्व.--(1) रजिस्ट्रीकृत उपयोगकर्ता अध्यादेश के उपबंधों के अनुसार जलविद्युत उत्पादन के लिए निकाले गए जल के हेतु जल उपकर का संदाय करने का दायी होगा ।

(2) जहां अध्यादेश के प्रारम्भ होने से पूर्व जल-विद्युत उत्पादन के उद्‌देश्य से किसी उपयोगकर्ता ने जल-विद्युत योजना का निर्माण किया है वहां ऐसा उपयोगकर्ता, अध्यादेश के प्रारम्भ होने की तारीख से छः मास के भीतर, अध्यादेश के अधीन रजिस्ट्रीकरण हेतु आवेदन करेगा तथा आयोग, अध्यादेश के उपबन्धों के अनुसार, आवेदन प्राप्ति की तारीख से छः मास की अवधि के भीतर उपयोगकर्ता को रजिस्ट्रीकरण करने के लिए आदेश पारित करेगा।

(3) यदि उपयोगकर्ता, उपधारा (2) में उल्लिखित आवेदन करने में या इसमें नियत समय में रजिस्ट्रीकरण करने में असफल रहता है तो आयोग तत्काल उपयुक्त शास्ति अधिरोपित करेगा जिसे निरन्तर चूक होने पर बढ़ाया जा सकेगा।

(4) प्रत्येक रजिस्ट्रीकृत उपयोगकर्ता, योजना के प्रचालन के अधीन क्षेत्र के निवासियों के जीवन और सुरक्षा को सुनिश्चित करने के दायित्व के अधीन होगा। 10048 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 (5) प्रत्येक रजिस्ट्रीकृत उपयोगकर्ता किसी प्राधिकारी को या प्राधिकारी द्वारा प्राधिकृत किसी अन्य अधिकारी को उसके समाधान के लिए किसी भी समय योजना क्षेत्र में प्रवेश हेतु अनुमति देने के लिए आबद्धकर होगा।

13. नियंत्रण और सुरक्षा व्यवस्थाएं.--(1) आयोग, उपयोगकर्ता को लिखित नोटिस देकर अपेक्षा कर सकेगा कि वह आयोग के समाधान हेतु और प्रक्रिया के अनुसार तथा ऐसे अन्तराल पर जैसे आयोग योजना हेतु विनिर्दिष्ट कर,ें किसी विशेषज्ञ द्वारा आवधिक निरीक्षण करवाये।

(2) उपयोगकर्ता निम्नलिखित कार्यकलापों के संचालन हेतु राज्य आयोग को ऐसी फीस और ऐसे अन्य प्रभारों का संदाय करेगा जैसे राज्य आयोग द्वारा इस निमित्त नियत किया जाएः-

(क) आयोग या इस निमित्त सशक्त किसी अधिकारी या विशेषज्ञ द्वारा योजना का आवधिक निरीक्षण;

और

करवाए जाने के लिए कोई अन्य क्रियाकलाप।

अध्याय-4

उपयोगकर्ता द्वारा निकाले गए जल का निर्धारण

14. उपयोगकर्ता द्वारा निकाले गए जल का निर्धारण.--(1) आयोग योजना के परिसर के भीतर या ऐसे अन्य स्थान पर जहां आयोग उचित समझे, जल-विद्युत उत्पादन हेतु निकाले गए जल के मापन के प्रयोजनों से प्रवाह मापन उपकरण प्रतिष्ठापित करेगा या कराएगा या उपयोगकर्ता द्वारा निकाले गए जल के निर्धारण हेतु कोई अप्रत्यक्ष तरीका अपना सकेगा।

(2) आयोग, उपयोगकर्ता के परिसर में या उसके स्थल पर या आयोग द्वारा निर्देशित स्थान पर आयोग द्वारा अनुमोदित विशिष्टिताओं के अनुरूप प्रवाह मापन उपकरण लगाएगा या उपयोगकर्ता से लगवाने की अपेक्षा कर सकेगा तथा इसके पश्चात्‌ उस उपयोगकर्ता द्वारा इसके लिए किए गए व्यय को उपयोगकर्ता द्वारा संदेय जल उपकर में समायोजन किए जाने का निर्देश दे सकेगा।

15. प्रवाह मापन उपकरण या किसी फिटिंग को क्षतिग्रस्त करना.--कोई भी व्यक्ति किसी उपकरण या उपकरण की किसी फिटिंग को जानबूझकर क्षतिग्रस्त नहीं करेगा या कराएगा।

16. प्रवाह मापन उपकरणों में धोखेबाजी (कपट).--कोई भी व्यक्ति कपट पूर्वक या बेईमानी से- (क) प्रवाह मापन उपकरण के सूचकांक में परिवर्तन नहीं करेगा या आपूर्ति किए गए जल की वास्तविक मात्रा को रिकार्ड करने से नहीं रोकेगा; या

(ख) रिकार्ड करने के प्रयोजन से लगाए गए मापन उपकरण द्वारा रिकार्ड किए जाने से पहले जल नहीं निकालेगा; या

(ग) मापन उपकरण से छेड़छाड़ नहीं करेगा या छेड़छाड़ किए गए उपकरण को प्रतिष्ठापित या उसका उपयोग नहीं करेगा; या

(घ) किसी ऐसे अन्य उपकरण या पद्धति का उपयोग नहीं करेगा जो आपूर्ति किए गए जल के सही या उचित रजिस्ट्रीकरण अंशशोधन या मीटरिंग में व्यवधान डालता हो।

अध्याय -5

जल उपकर

17. जल उपकर का नियतन.--(1) उपयोगकर्ता ऐसी दर से जैसा सरकार इस निमित्त अध्यादेश द्वारा नियत करे, जल उपकर का संदाय किए जाने हेतु दायी होगा।10049 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 (2) इस धारा के अधीन नियत जल उपकर की दरें राज्य सरकार समय-समय पर ऐसी रीति में पुनरीक्षित, परिवर्धित, कम या अन्तरित कर सकेगी, जैसी यह उचित समझे।

18. जल उपकर की वसूली.--आयोग, जल-विद्युत उत्पादन के लिए उपयोगकर्ता द्वारा जब कभी जल निकाला जाएगा तब प्रत्येक उपयोगकर्ता से राज्य सरकार द्वारा नियत दरों के अनुसार जल उपकर वसूल करेगा।

19. निर्धारण हेतु प्रक्रिया.--(1) जल-विद्युत उत्पादन के लिए उपयोगकर्ता द्वारा निकाले गए जल का निर्धारण और उसके जल उपकर की संगणना आयोग द्वारा की जाएगी।

(2) उपयोगकर्ता आयोग द्वारा विनिर्दिष्ट समय के भीतर उपधारा (1) के अधीन यथा निर्धारित जल उपकर का संदाय करेगा।

(3) यदि कोई उपयोगकर्ता, उस पर देय जल उपकर का संदाय नहीं कर पाता है तो उस पर आयोग द्वारा यथा अवधारित अधिरोपित शास्ति की जाएगी। उपयोगकर्ता को जल उपकर का विस्तारित अवधि के भीतर शास्ति सहित जल उपकर का संदाय करना होगा, जैसा आयोग द्वारा विनिर्दिष्ट किया जाए। यदि उपयोगकर्ता विस्तारित अवधि के भीतर शास्ति सहित जल उपकर का संदाय करने में पुनः विफल रहता है तो देयों की वसूली भू-राजस्व के बकाया के रूप में की जाएगी।

अध्याय-6

जल-विद्युत उत्पादन पर जल उपकर के लिए राज्य आयोग

20. आयोग की स्थापना.--(1) सरकार, अध्यादेश के प्रारम्भ होने की तारीख से छः मास के भीतर, अधिसूचना द्वारा अध्यादेश के अधीन प्रदत्त शक्तियों का प्रयोग और कृत्यों का निष्पादन करने के लिए जल-विद्युत उत्पादन पर जल उपकर के लिए राज्य आयोग के नाम से ज्ञात आयोग की स्थापना कर सकेगीः परन्तु यह कि इस धारा के अधीन आयोग की स्थापना होने तक सचिव, जल शक्ति विभाग, हिमाचल प्रदेश सरकार, अध्यादेश के अधीन आयोग की शक्तियों का प्रयोग और कृत्यों का निर्वहन कर सकेगा।

(2) उपधारा (1) के अधीन स्थापित आयोग पूर्वाेक्त नाम से एक निगमित निकाय होगा। जिसका शाश्वत उत्तराधिकार होगा और एक सामान्य मुद्रा होगी, इसके पास चल और अचल संपत्ति दोनों के प्राप्त करने, धारण और व्ययन करने की तथा संविदा करने की शक्ति होगी तथा यह उक्त नाम से वाद ला सकेगा या उसके विरुद्ध लाया जा सकेगा।

(3) आयोग का मुख्यालय शिमला में होगा।

(4) आयोग में एक अध्यक्ष और दो से अनधिक सदस्य होंगे।

(5) आयोग के अध्यक्ष और सदस्यों की नियुक्ति धारा 22 की उपधारा (1) में संदर्भित खोज समिति की सिफारिशों पर राज्य सरकार द्वारा की जाएगी।

21. आयोग के अध्यक्ष और सदस्यों की नियुक्ति के लिए अर्हताएं.--(1) अध्यक्ष की नियुक्ति उन व्यक्तियों में से की जाएगी जो या तो राज्य सरकार के सचिव की पंक्ति से अन्यून पद धारण कर रहा हो या जिन्होंने धारण किया हो तथा जिनके पास इंजीनियरिंग, वित्त, वाणिज्य, अर्थशास्त्र, विधि प्रशासन या प्रबंधन से संबंधित समस्याओं का पर्याप्त ज्ञान या अनुभव है या जिन्होंने संबन्धित विषयों के निपटान में क्षमता दर्शायी हो। 10050 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 (2) आयोग के सदस्य योग्य, सत्यनिष्ठ और अनुभवी होंगे जिन्हें इंजीनियरिंग, वित्त, वाणिज्य, अर्थशास्त्र, विधि या प्रबन्धन से संबन्धित कठिनाई का पर्याप्त ज्ञान या अनुभव है या जिन्होंने संबन्धित विषयों के निपटान में क्षमता दर्शायी होः

परन्तु यह कि इन व्यक्तियों में से न्यूनतम एक सदस्य जो मुख्य अभियन्ता की पंक्ति से अन्यून या इसके समतुल्य पद धारण कर रहा हो या जिन्होंने धारण किया हो और जो जल-विद्युत इन्जीनियरिंग के क्षेत्र में अर्हता और अनुभव रखता हो, नियुक्त किया जाएगा;

(3) आयोग का अध्यक्ष या इसके सदस्य कोई अन्य लाभ का पद धारण नहीं करेंगे।

(4) अध्यक्ष, आयोग का मुख्य कार्यकारी अधिकारी होगा।

(5) आयोग के पास उसके अधीन सहायता हेतु समुचित संरचना होगी, जैसी सरकार द्वारा परिभाषित की जाए।

22. खोज समिति का गठन.--(1) सरकार, आयोग के अध्यक्ष और सदस्यों के चयन के प्रयोजनों के लिए एक खोज समिति का गठन करेगी, जो निम्नलिखित से मिलकर बनेगीः

(क) मुख्य सचिव .. अध्यक्ष; (ख) सचिव (वित्त), हिमाचल प्रदेश सरकार .. सदस्य; (ग) सचिव, बहुउद्देशीय परियोजनाएं एवं ऊर्जा विभाग, हिमाचल प्रदेश सरकार .. सदस्य; (घ) सचिव (जल शक्ति), हिमाचल प्रदेश सरकार .. सदस्य; (ङ) सचिव (विधि), हिमाचल प्रदेश सरकार .. सदस्य;

(2) सरकार, अध्यक्ष या किसी सदस्य की मृत्यु, त्यागपत्र या हटाए जाने के कारण रिक्ति होने की तारीख से एक मास के भीतर तथा अध्यक्ष या किसी सदस्य की अधिवर्षिता या कार्यकाल समाप्त होने से छः मास पूर्व रिक्ति भरने के लिए खोज समिति को संदर्भित करेगी।

(3) खोज समिति, संदर्भ प्राप्त करने की तारीख से दो मास के भीतर अध्यक्ष या सदस्यों के चयन को अन्तिम रूप देगी।

(4) अध्यक्ष या सदस्य के रूप में नियुिक्त हेतु किसी व्यक्ति की सिफारिश करने से पूर्व खोज समिति अपना समाधान करेगी कि उस व्यक्ति का कोई ऐसा वित्तीय या अन्य हित नहीं है, जिसका अध्यक्ष या सदस्य के रूप में उसके कार्य पर प्रतिकूल प्रभाव पड़ने की संभावना हो।

23. पद की अवधि और सेवा की शर्तें.--(1) अध्यक्ष और अन्य सदस्य कार्यभार ग्रहण करने की तारीख से तीन वर्ष की अवधि हेतु पद धारण करेंगेः

परन्तु यह कि अध्यक्ष या कोई सदस्य पैंसठ वर्ष की आयु पूर्ण कर लेने के पश्चात्‌ पद धारण नहीं करेंगेः परन्तु यह और कि सरकार किसी भी समय लिखित में कारणों को अभिलिखित करके और सुनवाई का युक्तियुक्त अवसर देने के पश्चात्‌ अध्यक्ष या सदस्य को यथास्थिति, तीन वर्ष अथवा पैंसठ वर्ष की आयु पूर्ण होने से पूर्व कार्यावधि निर्धारित कर सकेगीः

परन्तु यह भी कि सरकार आयोग के अध्यक्ष या किसी सदस्य को जिनकी बाबत कार्यावधि अवधारित करने वाला कोई आदेश पारित किए जाने हेतु प्रस्तावित है या सरकार की राय में अध्यक्ष या सदस्य को निलम्बित करने के लिए न्यायोचित और पर्याप्त कारण हैं, को निलम्बित कर सकेगी।10051 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 (2) अध्यक्ष और सदस्यों के वेतन, भत्ते तथा सेवा के अन्य निबंधन एवं शर्ते ऐसी होंगी जैसी विहित की जाएः

परन्तु यह कि अध्यक्ष और सदस्यों के वेतन, भत्ते तथा सेवा की अन्य निबंधन और शर्तें नियुक्ति के पश्चात्‌ उनके लिए कोई अलाभकारी परिवर्तन नहीं किए जाएंगेे।

(3) अध्यक्ष और सदस्य अपना पद धारण करने से पूर्व ऐसे प्ररूप पर तथा ऐसी रीति में, ऐसे प्राधिकारी के समक्ष पद एवं गोपनीयता की शपथ लेंगे, जैसी विहित की जाए।

(4) उपधारा (1) में किसी बात के होते हुए भी अध्यक्ष या कोई सदस्य सरकार को कम से कम तीन मास का नोटिस लिखित में देकर अपना पद त्याग कर सकेंगे।

(5) इस पद पर न बने रहने वाला अध्यक्ष या कोई सदस्य-

(क) उस पद को धारण करने से वंचित होने की तारीख से दो वर्ष की अवधि तक सरकार के अधीन किसी और नियुक्ति के लिए प्रात्र नहीं होगाः और

(ख) ऐसे पद को धारण करने से वंचित होने की तारीख से दो वर्ष की अवधि हेतु कोई वाणिज्यिक नियोजन स्वीकार नहीं करेगा।

24. अध्यक्ष या सदस्य को हटाया जाना.--(1) अध्यक्ष या सदस्य अपने पद पर नहीं बना रहेगा, यदि वहः

(क) सक्षम न्यायालय द्वारा दिवालिया न्यायनिर्णित कर दिया गया हो; या

(ख) किसी सक्षम न्यायालय द्वारा अपराध सिद्धदोष हो; या

(ग) इस रूप में कार्य करने के लिए शारीरिक या मानसिक रूप से अक्षम हो गया हो; या (घ) ऐसे वित्तीय या अन्य हित प्राप्त कर लिए हों जोकि आयोग में उसके कृत्य पर प्रतिकूल प्रभाव डालने की संभावना रखते हाें।

(2) जहां यह प्रश्न उठता हो कि यदि अध्यक्ष या सदस्य इस प्रकार कृत्य करने में शारीरिक या मानसिक रूप से अक्षम हो गये हों या उसने ऐसा वित्तीय या अन्य हित, जो आयोग में उसके कृत्य पर संभाव्य प्रतिकूल प्रभाव डाल सकेगा, तो इस विषय में सरकार द्वारा निर्णय लिया जाएगा और उसका आदेश अन्तिम होगा। 25. आयोग के अधिकारी और अन्य कर्मचारी.--(1) आयोग का एक सचिव होगा, जो अध्यक्ष के नियंत्रण के अधीन उन शक्तियों का प्रयोग करेगा और उन कत्र्तव्यों का निर्वहन करेगा जो इस हेतु विहित किए जाएं।

(2) सचिव की नियुक्ति सरकार द्वारा की जाएगी।

(3) अपने कृत्यों के निष्पादन में आयोग को सहायता करने के लिए आवश्यक अन्य अधिकारियों और कर्मचारियों की संख्या, प्रकृति और श्रेणियां निर्धारित ऐसी होंगी जैसी विहित की जाएं।

(4) सचिव, अधिकारियों और अन्य कर्मचारियों को देय वेतन भत्ते तथा सेवा के अन्य निबंधनों और शर्तेें ऐसी होंगी जैसी विहित की जाएं।

(5) आयोग को विहित की गई शर्तों और निबंधनों पर अपने कृत्यों के निष्पादन में सहायता करने के लिए उपयोगकर्ताओं द्वारा निकाले गए जल के निर्धारण और अन्य तकनीकी क्रियाकलापों के लिए इंजीनियरज़ और राज्य सरकार के अन्य कर्मचारीवृन्द होंगे।10052 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 26. आयोग के कृत्य.--आयोग निम्नलिखित कृत्यों का निष्पादन करेगा, अर्थात्‌ः- (क) अध्यादेश के अधीन जारी निर्णयों और आदेशों का प्रवर्तन करना;

(ख) जल उपकर से संबंधित विवादों का न्यायनिर्णय करना;

(ग) शक्तियों का प्रयोग और कत्र्तव्यों का निर्वाह करते समय पारदर्शिता सुनिश्चित करना;

(घ) जल विद्युत उत्पादन हेतु उपयोग में लाए गए जल के प्रवर्तन, मॉनिटरिंग और मापन हेतु प्रणाली की स्थापना करना; और

(ङ) ऐसे अन्य कृत्य जो विहित किए जाएं।

27. आयोग की शक्तियां.--(1) अध्यादेश के अधीन कोई जांच करने या कोई कार्यवाही आरम्भ करने के प्रायोजन हेतु आयोग के पास वे ही शक्तियां होंगी जो कि निम्नलिखित मामलों के संबंध में सिविल प्रकिया संहिता, 1908 के अधीन सिविल न्यायालय में निहित है, अर्थात्‌ः-

(क) किसी साक्षी को समन करना और हाजिर करना और शपथ पर उसकी परीक्षा करना;

(ख) साक्ष्य के रूप में प्रस्तुत किए जाने योग्य किसी दस्तावेज या अन्य तात्विक वस्तु का प्रकटीकरण की खोज और प्रस्तुतीकरण;

(ग) शपथ पत्रों पर साक्ष्य प्राप्त करना;

(घ) किसी सार्वजनिक अभिलेख की अध्यपेक्षा;

(ङ) साक्षियों के परीक्षण हेतु कमीशन जारी करना;

(च) अपने निर्णयों, निर्देशों और आदेशों की समीक्षा करना; और

(छ) अन्य कोई मामला, जो विहित किया जाए।

(2) आयोग के पास, उसके समक्ष किसी कार्यवाही, सुनवाई या मामले में जैसा वह उचित समझे वैसा अंतरिम आदेश पारित करने की शक्ति होगी।

(3) आयोग अपने समक्ष कार्यवाहियों में किसी व्यक्ति का जिसे यह उचित समझे रजिस्ट्रीकृत उपयोगकर्ताओं के हित का प्रतिनिधित्व करने के लिए प्राधिकृत कर सकेगा।

28. आयोग के समक्ष कार्यवाहियां.--आयोग के समक्ष समस्त कार्यवाहियाें को भारतीय दण्ड संहिता, 1860 की धारा 193, 214 और 228 के अर्थातंर्गत न्यायिक -कल्प कार्यवाहियां माना जाएगा तथा आयोग सिविल प्रक्रिया संहिता, 1973 की धारा 195 और अध्याय-26 के प्रयोजनों के लिए सिविल न्यायालय माना जाएगा।

29. प्रवेश और जब्त करने की शक्ति.--आयोग या कोई अधिकारी जो राजपत्रित अधिकारी की पंक्ति से नीचे का न हो तथा जिसे आयोग द्वारा विशेष रूप से इस निमित प्राधिकृत किया गया हो, ऐसे किसी स्थान पर भवन में प्रवेश कर सकेगा, जहां आयोग के पास यह विश्वास करने का कारण हो कि जांच के मामले के विषय से संबंधित दस्तावेज पाया जा सकता है तथा ऐसे किसी दस्तावेज को वह अभिग्रहित कर सकेगा या भारतीय दंड संहिता उपबन्धों के अध्यधीन उसकी प्रतियां निकाल सकेगा।10053 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 30. शक्तियों का प्रत्यायोजन.--आयोग, अध्यक्ष, किसी सदस्य, सचिव आयोग के किसी अधिकारी या किसी अन्य व्यक्ति को अध्यादेश के अधीन इसकी ऐसी शक्तियों और कृत्यों को लिखित में सामान्य या विशेष आदेश द्वारा ऐसी शर्तें, यदि कोई हैं, जो आदेश में विनिर्दिष्ट की जाएं के अध्यधीन और धारा 26 की उप-धारा (1) के खण्ड (च) के अधीन विवादों के न्याय-निर्णय की शक्तियों के सिवाय और धारा 48 के अधीन विनियम बनाने की शक्तियों जैसा वह आवश्यक समझे को प्रत्यायोजित कर सकेगा।

31. अपील.--(1) आयोग के किसी निर्णय या आदेश से व्यथित कोई व्यक्ति हिमाचल प्रदेश उच्च न्यायालय में अपील दायर कर सकेगा।

(2) ऐसे निर्णय या आदेश से व्यथित किसी व्यक्ति को आयोग के निर्णय या आदेश के संप्रेषण की तारीख से नब्बे दिन के भीतर उपधारा (1) के अधीन अपील करनी होगी।

32. आयोग के निर्देशों के अननुपालना के लिए शास्ति.--यदि आयोग के समक्ष कोई शिकायत प्रस्तुत होती है कि किसी उपयोगकर्ता ने इस अध्यादेश के उपबन्धों का उल्लंघन किया है या यदि आयोग का समाधान हो जाता है कि किसी उपयोगकर्ता ने अध्यादेश या नियमों या विनियमों या आयोग द्वारा जारी किसी निर्देश के किन्हीं उपबन्धों का उल्लंघन किया है या आयोग द्वारा जारी किसी निर्देश का पालन नहीं किया है तो आयोग ऐसे उपयोगकर्ता को मामले में सुनवाई का अवसर देने के पश्चात्‌ किसी अन्य शास्ति पर प्रतिकूल प्रभाव डाले बिना लिखित में आदेश दे सकेगा कि वह इस अध्यादेश के अधीन शास्ति के लिए दायी होगा और ऐसा उपयोगकर्ता शास्ति के रूप में ऐसी राशि को जैसा आयोग द्वारा प्रत्येक उल्लंघन के लिए विहित की जाए, संदाय के लिए दायी होगा और ऐसी शास्ति के संदाय में निरन्तर असफलता की दशा में अतिरिक्त शास्ति, जो आयोग द्वारा प्रत्येक दिन हेतु ऐसी असफलता के प्रारम्भ होने के दिन से जब तक वह शास्ति का संदाय नहीं करता तब तक उद्‌गृहित कर सकेगा, जैसा वह उचित समझे।

33. न्याय निर्णयन की शक्ति.--(1) अध्यादेश के अधीन न्याय निर्णय के प्रयोजन के लिए आयोग कोई शास्ति के अधिरोपित करने के प्रयोजन हेतु सम्बद्ध व्यक्ति को सुनवाई का युक्तियुक्त अवसर प्रदान करने के पश्चात्‌ अपने किसी सदस्य को ऐसी रीति, विहित की जाए, कोई जांच करने हेतु न्याय-निर्णयन अधिकारी के रूप में नियुक्त करेगा।

(2) जांच करते समय न्याय-निर्णायक अधिकारी के पास साक्ष्य देने या दस्तावेज प्रस्तुत करने के लिए उस मामले के तथ्यों और परिस्थितियों से परिचित किसी व्यक्ति को बुलाने और हाजिर करने की शक्ति होगी जो साक्ष्य न्याय निर्णायक अधिकारी की राय में जांच के मामले में उपयोगी या सुसंगत हो सकेंगे तथा यदि ऐसी जांच मेेंं वह इस बात से संतुष्ट हो कि वह व्यक्ति अध्यादेश के किसी उपबंध के अनुपालन में असफल रहा है तो वह ऐसी शास्ति अधिरोपित कर सकेगा जैसी वह अध्यादेश के उपबंधों के अनुसार वह उचित समझे।

(3) उपधारा (2) के अधीन किसी आदेश से व्यथित कोई व्यक्ति, आदेश के तीस दिन के भीतर आयोग के समक्ष अपील कर सकेगाः

परन्तु यह कि आयोग, यथास्थिति, अन्य पक्ष या पक्षों को युक्तियुक्त अवसर प्रदान किए बिना कोई आदेश पारित नहीं करेगा।

34. न्याय निर्णायक अधिकारी द्वारा ध्यान में रखने योग्य कारक.--धारा 35 के अधीन शास्ति की मात्रा अधिनिर्णीत करते समय निर्णायक अधिकारी निम्नलिखित कारकों का उचित रूप से ध्यान रखेगाः- (क) चूक के परिणाम स्वरूप जहां कहीं मात्रात्मक हो वहां गैर- आनुपातिक प्राप्ति या अनुचित लाभ की राशि,

(ख) चूक का पुनरावृति स्वभाव। 10054 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 35. अन्य दायित्वों पर शास्ति प्रभावहीन.--अध्यादेश के अधीन अधिरोपित शास्ति प्रतिपूर्ति के संदाय या उपयोगकर्ता के मामले में उसके रजिस्ट्रीकरण का प्रतिसंहरण जो कि अपराधी को हुआ हो, के संबंध में कोई अल्पीकरण न हो कर दायित्व के अतिरिक्त होंगे।

36. सरकार द्वारा अनुदान और ऋण.--सरकार, इस निमित राज्य विधान मंडल द्वारा सम्यक किए गए उचित विनियोग के पश्चात्‌ आयोग को ऐसी राशि के अनुदान और ऋण प्रदान कर सकेगी जैसी सरकार उचित समझे।

37. सरकार द्वारा निधि की स्थापना.--(1) एक निधि की स्थापना की जाएगी, जिसका नाम आयोग निधि होगा और इसमें निम्नलिखित राशियों को जमा किया जाएगाः-

(क) सरकार द्वारा आयोग को दिये गये कोई अनुदान और ऋृण;

(ख) अध्यादेश के अधीन आयोग द्वारा प्राप्त सभी फीस;

(ग) सरकार द्वारा विनिश्चित ऐसे अन्य स्रोतों से आयोग द्वारा प्राप्त सभी राशियां।

(2) इस निधि का उपयोग निम्नलिखित बैठक के लिए किया जाएगाः-

(क) आयोग के अध्यक्ष, सदस्यों, अधिकारियों और कर्मचारियों के वेतन, भत्ते और अन्य पारिश्रमिक;

(ख) अध्यादेश के अधीन अपने कृत्य के निर्वहन हेतु आयोग के व्यय;

(ग) अध्यादेश द्वारा प्राधिकृत उद्‌देश्यों और प्रयोजनों के लिए व्यय।

(3) सरकार, उपधारा (2) के खण्ड (ख) या खण्ड (ग) में विनिर्दिष्ट व्ययों को पूरा करने के लिए निधि के अनुप्रयोग की रीति विहित कर सकेगी।

38. आयोग के लेखे.--(1) आयोग समुचित लेखा और अन्य सम्बन्धित अभिलेख अनुरक्षित करेगा तथा लेखे के वार्षिक विवरण ऐसे प्ररूप में तैयार करेगा जैसे विहित किए जाए।

(2) आयोग के वार्षिक लेखे तथा तुलन पत्र सरकार को अग्रेषित किए जाएंगे और सरकार इसे प्राप्त करने के पश्चात्‌ यथाशीघ्र राज्य विधानमण्डल के समक्ष रखेगी।

39. आयोग की वार्षिक रिपोर्ट.--(1) आयोग वर्ष में एक बार ऐसे प्ररूप और ऐसे समय पर, जैसी विहित की जाए, पिछले वर्ष के दौरान अपने कार्यकलापों का संक्षिप्त विवरण देते हुए एक रिपोर्ट तैयार करेगा तथा रिपोर्ट की प्रतियां सरकार को अग्रेषित की जाएंगी।

(2) उपधारा (1) के अधीन प्राप्त रिपोर्ट की एक प्रति इस की प्राप्ति के पश्चात्‌ यथाशीघ्र संभव हो, राज्य विधान मण्डल के समक्ष रखी जाएगी।

40. आयोग का बजट.--आयोग प्रत्येक वित्त वर्ष में अगले वित्त वर्ष के लिए अपना बजट ऐसे प्ररूप और ऐसे समय पर तैयार करेगा जैसा विहित किया जाए जिसमें आयोग को अनुमानित प्राप्तियां और व्यय दिखाए जाएंगे तथा इसे सरकार को अग्रेषित किया जाएगा।

41. सरकार द्वारा निर्देश.--(1) अपने कृत्यों के निर्वहन हेतु आयोग को जनहित की नीति संबंधी मामलों पर समय-समय पर राज्य सरकार द्वारा लिखित में दिशा-निर्देश दिए जाएंगे।

(2) यदि कोई ऐसा प्रश्न उठता है कि क्या किसी दिशा-निर्देश में जनहित से संबंधित मामला है या नहीं तो इस पर राज्य सरकार का निर्णय अंतिम होगा।10055 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 42. सद्‌भाव में की गई कार्रवाई के लिए संरक्षण.--अध्यादेश या नियमों या विनियमों के अधीन तात्पार्यित सदभाव पूर्वक की गई या किए जाने के किए किसी बात के विरूद्ध सरकार या आयोग या सरकार के किसी अधिकारी या आयोग के किसी सदस्य या अधिकारी या अन्य कर्मचारी या लोक सेवक पर कोई वाद, अभियोजन या कार्यवाही प्रारम्भ नहीं की जाएगी।

43. सदस्य, अधिकारी इत्यादि का लोक सेवक होना.--आयोग का अध्यक्ष, सदस्य, अधिकारी और अन्य कर्मचारी, जब वे इस अध्यादेश के किन्हीं उपबन्धों के अनुसरण में कार्य कर रहे हों या जब उनका ऐसे कार्य करना तात्पार्यित हो, भारतीय दंड संहिता, 1860 के अर्थ में लोक सेवक समझे जाएंगे।

44. अध्यादेश के उपबन्ध का अन्य विधियों के अतिरिक्त न की उनके अल्पीकरण में होना.--इस अध्यादेश के उपबंध का राज्य में तत्समय प्रवृत्त किसी अन्य विधि के अतिरिक्त न कि उसके अल्पीकरण में। 45. सरकार की नियम बनाने की शक्ति.--(1) अध्यादेश के उपबंधों को कार्यान्वित करने के लिए सरकार, अधिसूचना द्वारा नियम बना सकेगी।

(2) विशिष्टतया और पूर्वगामी शक्ति की व्यापकता पर प्रतिकूल प्रभाव डाले बिना, ऐसे नियमों में या सभी या किन्हीं निम्नलिखित मामले के लिए उपबंध किया जा सकेगा, अर्थातः-

(क) ऐसे प्ररूप और रीति जिसमें धारा 7 के खण्ड (ख) के अधीन करार निष्पादित किया जाना है;

(ख) आवेदन के प्ररूप और रीति और धारा 10 के अधीन रजिस्ट्रीकरण प्रमाण-पत्र प्रदान किए जाने के लिए संदाह किए जाने वाली फीस;

(ग) धारा 23 के अधीन आयोग के अध्यक्ष, सदस्यों के वेतन, भत्ते और सेवा के अन्य निर्बंधन और शर्तें;

(घ) धारा 23 की उपधारा (3) के अधीन ऐसे प्ररूप और रीति तथा प्राधिकारी जिसके समक्ष अध्यक्ष और सदस्य शपथ ग्रहण करेंगे;

(ङ) धारा 25 की उपधारा (1) के अधीन आयोग के सचिव द्वारा प्रयोग की जाने वाली शक्तियां और निष्पादित किए जाने वाले कत्र्तव्य;

(च) धारा 25 की उपधारा (2) के अधीन आयोग के अधिकारियों और कर्मचारियों की संख्या, प्रकृति और श्रेणियां;

(छ) धारा 25 की उपधारा (4) के अधीन आयोग के सचिव अधिकारियों और कर्मचारियों के वेतन, भत्ते तथा अन्य निर्बंधन और शर्तें;

(ज) धारा 40 की उपधारा (3) के अधीन आयोग निधि के अनुप्रयोग की रीति; और

(झ) कोई अन्य मामला, जिसे विहित किया जाना या किया जाए अपेक्षित है।

46. आयोग की विनियम बनाने की शक्तियां.--(1)आयोग सरकार के पूर्व अनुमोदन से अध्यादेश के उपबन्धों को साधारणतया कार्यान्वित करने के लिए अध्यादेश और तद्‌धीन बनाए गए नियमों से संगत विनियम बना सकेगा।

(2) अध्यादेश के अध्यधीन आयोग द्वारा बनाए गए सभी विनियम पूर्व प्रकाशन के अधीन होंगे। 10056 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 47. नियमों और विनियमों का विधान मंडल के समक्ष रखा जाना.--सरकार द्वारा बनाया गया प्रत्येक नियम और आयोग द्वारा बनाया गया प्रत्येक विनियम इसके बनने के पश्चात्‌ यथाशीघ्र राज्य विधान सभा के समक्ष रखा जाएगा।

48. कठिनाईयां दूर करने की शक्ति.--(1) यदि अध्यादेश के किसी उपबंध को प्रभावी बनाने में कोई कठिनाई उत्पन्न होती है तो सरकार राजपत्र (ई-गजट) हिमाचल प्रदेश अध्यादेश में प्रकाशित आदेश द्वारा ऐसे उपबन्ध कर सकेगी जो अध्यादेश के उपबंधों से असंगत न हों, और जो कठिनाई को दूर करने के लिए आवश्यक प्रतीत होंः

परन्तु इस धारा के अधीन ऐसा कोई आदेश इस अध्यादेश के प्रारम्भ से दो वर्ष की अवधि की समाप्ति के पश्चात्‌ नहीं किया जाएगा।

(2) इस धारा के अधीन किया गया प्रत्येक आदेश इसके किए जाने के पश्चात्‌ यथाशीघ्र राज्य विधान सभा के समक्ष रखा जाएगा।

THE HIMACHAL PRADESH WATER CESS ON HYDRO POWER GENERATION

ORDINANCE, 2023

Promulgated by the Governor of Himachal Pradesh in the Seventy fourth Year of the

Republic of India.

AN ORDINANCE to impose Water Cess on Hydro Power Generation in the State of Himachal Pradesh and for revenue generation in the State of Himachal Pradesh.

WHEREAS, the Legislative Assembly of Himachal Pradesh is not in session and the Governor of Himachal Pradesh is satisfied that circumstances exist which render it necessary for him to take immediate action.

NOW, THEREFORE, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution of India, the Governor of Himachal Pradesh is pleased to promulgate the following Ordinance:—

1. Short title, extent and commencement.—(1) This Ordinance may be called the Himachal Pradesh Water Cess on Hydro Power Generation Ordinance, 2023.

(2) It extends to the whole State of Himachal Pradesh.

(3) It shall come into force on such date as the State Government may by notification in the Rajpatra (e-Gazette), Himachal Pradesh, appoint.

(4) The provisions of this Ordinance shall have effect notwithstanding anything inconsistent contained in any other law for the time being in force.

2. Definitions.—In this Ordinance, unless the context otherwise requires,—

(a) "Commission" means the Himachal Pradesh State Commission for Water Cess on Hydro Power Generation Established under section 20 of this Ordinance;

(b) "Government" or "State Government" means the Government of Himachal Pradesh;

(c) "hydropower" or "hydroelectric power" is a renewable source of energy that generates power by using water drawn from any water source flowing within the territory of the State;

(d) "notification" means a notification published in the (e-Gazette), Himachal Pradesh, and the term "notify" shall be construed accordingly;

(e) "user" means any person, group of persons, local body, Government Department, company, corporation, society etc. drawing water or any other authority authorized under Chapter-2 of the Ordinance to avail the facility to draw water from any source for generation of electricity;

(f) "water" means natural resource flowing in any river, stream, tributary, canal, nallah or any other natural course of water or stipulated upon the surface of any land like, pond, lagoon, swamp, spring;

(g) "water source" means a river and its tributaries, stream, nallah, canal, spring, pond, lake, water course or any other source from which water is drawn to generate electricity; and

(h) "water cess" means the rate levied or charged for water drawn for generation of electricity and fixed under this Ordinance.

CHAPTER-2

INTRODUCTION

3. General.—(1) For the purpose of this Ordinance, every water source in the State is, and shall remain, the property of the Government and any proprietary ownership, or any riparian or usage right, on such water resources vested in any individual, group of individuals or any other body, corporation, company, society or community shall, from the date of commencement of the Ordinance, be deemed to have been terminated and vested with the Government. However, for rivers of interstate nature and rivers under the ambit of international treaties, the ownership right of Himachal Pradesh Government shall be limited to non-consumptive use of water.

(2) No person, group of persons, Government Department, local authority, corporation, company, society or any other body shall draw water from any source for hydropower generation except in accordance with the provisions of this Ordinance.

CHAPTER-3

USAGE OF WATER BY INSTALLATION OF HYDROELECTRIC

GENERATING UNIT

4. Installation of scheme for usage of water.—No person, group of persons, Government Department, local authority, corporation, company, society or any other body, by whatever name called, shall install a scheme requiring usage of water (non consumptive use) of any water source for generating hydro power except without being registered under the Commission in accordance with the provisions provided hereinafter in this Chapter.

5. Submission of sanctioned scheme for usage of water by the user.—Any user intending to install a scheme requiring usage of water (non consumptive use) for the purpose of generation of hydro power shall submit detailed Project Report of the scheme, duly sanctioned by authority competent to do so in this behalf to the Commission accompanied by such fee and charges as may be fixed by the Commission for registration.

6. Acceptance of the scheme.—After receipt of the scheme from a user, the Commission shall consider the acceptance of the scheme under this Ordinance.

7. Information to the user.—After the scheme is accepted by the Commission under section 6, the Commission shall register the scheme and inform the user to:—

(a) execute an agreement in such a form and manner with the Commission as may be prescribed; and

(b) pay such fee and water cess as fixed under Chapter-4 of this Ordinance.

8. Prohibition on installation of a scheme.—No user shall install a scheme requiring usage of water without adhering to the requirements of section 10.

9. Registration for usage of water.—No person shall install a scheme, requiring usage of water or in any other way use the water, unless he is authorized to do so by a registration certificate, issued under section 10.

10. Grant of registration certificate.—An user intending to use water (non consumptive use) for generation of hydro power shall be issued a registration certificate after the execution of an agreement between the user and the Commission under the Ordinance.

11. Registered user not to do certain things.—No registered user shall without prior approval of Commission:—

(a) undertake any transaction to acquire by purchase or takeover or otherwise, the utility of any other user; or

(b) merge his utility with the utility of any other user; (c) no user shall at any time assign his registration or transfer his utility or any part thereof by sale, lease, exchange or otherwise without the prior approval of the Commission.

12. Duties, obligations and responsibilities of the registered user.—(1) The registered user shall be liable to pay water cess for the water drawn for hydropower generation as per the provisions of the Ordinance.

(2) Where any user has constructed a hydropower scheme, for purpose of generation of10059 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 hydro power, prior to the commencement of the Ordinance, such user shall, within a period of six month from the date of commencement of the Ordinance, apply for registration under the Ordinance and the Commission shall pass an order to register the user within a period of six months from the date of receipt of application in accordance with the provisions of the Ordinance.

(3) If the user as mentioned in sub-section (2) fails to apply or register within time stipulated therein, the Commission shall forthwith impose suitable penalty which may be enhanced in case of prolonged default.

(4) Every registered user shall be under an obligation to ensure the safety of the life and property of inhabitants of the area by the operation of the scheme.

(5) Every registered user shall be bound to allow the authority or any other officer authorized by authority to have access at any time to the scheme for their satisfaction.

13. Control and safety provisions.—(1) The Commission may, by notice in writing given to the user require him to cause periodic inspection carried out by an expert, to the satisfaction of the Commission and in accordance with the procedure and at such intervals, as the Commission may specify, for the scheme.

(2) The user shall pay such fee and such other charges as the Commission may fix in this behalf, to the Commission for undertaking the following activities,—

(a) periodical inspection of the scheme by the Commission or any other officer or expert empowered in the behalf; and

(b) any other activity performed or caused to be performed by the Commission under this section in relation to the scheme of the user.

CHAPTER-4

ASSESSMENT OF WATER DRAWN BY USER

14. Assessment of water drawn by user.—(1) The Commission shall install or cause to be installed flow measuring device within the premises of scheme or at such other place where the Commission deems fit for purposes of measuring the water drawn for hydropower generation or may adopt any indirect method for assessment of water drawn by the user.

(2) The Commission may either install or, require a user to install a flow measuring device as per the specifications approved by the Commission at his premises or at his location or at such other place as the Commission may direct and thereafter adjust the expenditure incurred by such user on such installation towards the water cess payable by the user.

15. Injuring the flow measuring device or any fitting.—No person shall willfully injure or cause to be injured, any device or any of the fittings of the device.

16. Fraud in respect of flow measuring devices.—No person shall fraudulently or dishonestly,—

(a) alter the index of any flow measuring device or prevent any device from recording the actual quantity of water supplied; or10060 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 (b) extract or draw water before it has been recorded by the measuring device set up for the purpose of recording the same; or

(c) tamper the measuring device, install or use a tampered device; or

(d) use any other device or method which interferes with accurate or proper registration, calibration or metering of water supplied.

CHAPTER-5

WATER CESS

17. Fixation of water cess.—(1) The user shall be liable to pay the water cess under the Ordinance at such rates as the Government may by notification fix in this behalf.

(2) The State Government may review, increase, decrease or vary the rates of the Water Cess fixed under this section from time to time in the manner it deems fit.

18. Recovery of water cess.—The Commission shall recover water cess as per the rates fixed by the State Government from every user whenever water is drawn by a user for generation of hydropower.

19. Procedure for assessment.—(1) The assessment of water drawn by the user for hydropower generation and computation of water cess thereof, shall be carried out by the commission.

(2) The user shall pay the water cess as assessed under sub-section (1) within such time as may be specified by the Commission.

(3) If any user fails to pay water cess due on him, penalty shall be imposed on the user as determined by the Commission. The user has to pay Water Cess along with penalty within extended time as may be specified by the Commission. If the user again fails to pay Water Cess along with penalty within the extended time, the dues shall be recovered as arrears of land revenue.

CHAPTER-6

STATE COMMISSION FOR WATER CESS ON HYDRO POWER GENERATION

20. Establishment of Commission.—(1) The Government may, within six months from the date commencement of the Ordinance, by notification, establish Commission to be known as the State Commission for Water Cess on Hydropower Generation to exercise the powers conferred on, and to discharge the functions under this Ordinance:

Provided that till the Commission is established under the section, Secretary, Jal Shakti Vibhag to the Government of Himachal Pradesh may exercise the powers and discharge the functions of the Commission under the Ordinance.

(2) The Commission established under sub-section (1) shall be a body corporate by the name aforesaid, having perpetual succession and a common seal, with power to acquire, hold and dispose of property, both movable and immovable, and to contract and shall, by the the said name, sue or be sued.

(4) The Commission shall consist of a Chairperson and not more than two members.

(5) The Chairperson and members of the Commission shall be appointed by the State Government on the recommendations of a search committee referred to in sub-section (1) of section 22.

21. Qualifications for appointment of Chairperson and members of the Commission.—(1) The Chairperson shall be appointed from amongst persons who are either holding or have held a post not below the rank of Secretary to State Government and have adequate knowledge of, or experience in, or have shown capacity in dealing with, problems relating to engineering, finance, commerce, economics, law, administration or management.

(2) The members of the Commission shall be persons of ability, integrity and standing who have adequate knowledge of, or experience in, or have shown capacity in dealing with, problems relating to engineering, finance, commerce, economics, law or management:

Provided that atleast one member shall be from amongst the persons who are either holding or have held a post not below the rank of Chief Engineer or equivalent and having qualification and experience in the field of Hydropower Engineering.

(3) The Chairperson or any Member of the Commission shall not hold any other office of the profit.

(4) The Chairperson shall be the Chief Executive Officer of the Commission.

(5) The Commission will have appropriate structure underneath for support as shall be defined by Government.

22. Constitution of a search committee.—(1) The Government shall, for the purposes of selecting the Chairperson and members of the Commission, constitute a search committee consisting of—

Chairperson;

(a) Chief Secretary (b) Secretary (Finance) to the Government of Himachal Pradesh Member; (c) Secretary (MPP and Power) to the Government of Himachal Pradesh Member; (d) Secretary (Jal Shakti) to the Government of Himachal Pradesh Member; (e) Secretary (Law)to the Government of Himachal Pradesh Member.

(2) The Government shall, within one month from the date of occurrence of any vacancy by reason of death, resignation, or removal of the Chairperson or member and six month before the superannuation or end of the tenure of the Chairperson or a member make a reference to the search committee for filling up of the vacancy.

(3) The search committee shall finalize the selection of Chairperson or the members within two months from the date on which the reference is made to it.

(4) Before recommending any person for appointment as Chairperson or member, the search committee shall satisfy itself that such person does not have any financial or other interest which is likely to affect prejudicially his function as such Chairperson or member.

23. Term of office and conditions of service.—(1) The Chairperson and other members shall hold office for a term of three years from the date they enter upon their office:

Provided that no Chairperson or member shall hold office after he has attained the age of sixty five years:

Provided further that the Government may, at any time for the reasons recorded in writing and after giving a reasonable opportunity of being heard, determine term of the Chairperson or member before he completes three years term or attain age of sixty five years, as the case may be :

Provided further that the Government may suspend the Chairperson or any member of the Commission in respect of whom an order determining the term is proposed to be passed or in the opinion of the Government there are just and sufficient reasons to suspend the Chairperson or the member.

(2) The salary, allowances and other terms and conditions of service of the Chairperson and the members shall be such as may be prescribed:

Provided that the salary, allowances and other terms and conditions of service of the Chairperson and the members shall not be varied to their disadvantage after appointment.

(3) The Chairperson and members shall, before entering upon their office, make and subscribe to an oath of office and secrecy in such form and manner and before such authority as may be prescribed.

(4) Notwithstanding anything contained in sub-section (1), the Chairperson or a member may relinquish his office by giving in writing to the Government a notice of not less than three months.

(5) The Chairperson or any member ceasing to hold office as such shall,—

(a) not be eligible for further appointment under the Government for a period of two years from the date he ceases to hold such office; and

(b) not accept any commercial employment for a period of two years from the date he ceases to hold such office.

24. Removal of Chairperson or member.—(1) The Chairperson or the member shall cease to hold his office as such if he,—

(a) has been adjudged as insolvent by the competent Court; or

(b) has been convicted of an offence by the competent Court;

(c) has become physically or mentally incapable of acting as such; or

(d) has acquired such financial or other interest as is likely to affect prejudicially his function in the Commission.

(2) Where a question arises as to if the Chairman or the member has become physically or mentally incapable of acting as such or has acquired such financial or other interest as is likely to affect prejudicially his function in the Commission, the decision in this regard shall be taken by the Government and shall be final.

25. Officers and other employees of the Commission.—(1) The Commission shall have a Secretary to exercise such powers and perform such duties under the control of the Chairperson, as may be prescribed.

(2) The Secretary shall be appointed by the Government.

(3) The number, nature and categories of other officers and employees required to assist the Commission, to discharge its functions, shall be such as may be prescribed.

(4) The salaries and allowances payable to, and other terms and conditions of the service of the Secretary, officers and other employees shall be such as may be prescribed.

(5) The Commission shall engage the engineers and other staff of State Government to assess the water drawn by users and other technical activities to assist the Commission to discharge its functions on the terms and conditions as may be prescribed.

26. Functions of the Commission.—The Commission shall discharge the following functions, namely:—

(a) enforce the decisions and orders issued under the ordinance; (b) adjudicate upon the disputes regarding Water Cess; (c) ensure transparency while exercising the powers and discharging its functions; (d) establish a system of enforcement, monitoring and measurement of water drawn for hydropower generation; and

(e) such other functions as may be prescribed.

27. Powers of the Commission.—(1) The Commission shall for the purpose of making any inquiry or initiating any proceedings under the Ordinance, have the same powers as are vested in a Civil Court, under the Code of Civil Procedure, 1908 in respect of the following matters, namely:-

(a) summoning and enforcing the attendance of any witness and examining him on oath; (b) discovery and production of any document or other material object capable of being produced as evidence;

(c) receiving of evidence on affidavits; (d) requisition of any public record; (e) issuing commission for examination of witnesses; (f) reviewing its decisions, directions and orders; and (g) any other matter which may be prescribed.

(2) The Commission shall have the powers to pass such interim order in any proceeding, hearing or matter before it, as it may consider appropriate.

(3) The Commission may authorize any person, as it may deem fit, to represent the interest of the registered users in the proceedings before it.

28. Proceedings before Commission.—All proceedings before the Commission shall deemed to be judicial proceedings within the meaning of sections 193, 214, 228 of the Indian Penal Code and the Commission shall deem to be a Civil Court for the purposes of Section 195 and Chapter XXVI of the Code of Criminal Procedure, 1973.

29. Power of entry and seizure.—The Commission or any officer, not below the rank of Gazetted Officer specially authorized in this behalf by the Commission, may enter any building or10064 राजपत्र, हिमाचल प्रदेश, 15 फरवरी, 2023/26 माघ, 1944 place where the Commission has reason to believe that any document relating to the subject matter of the inquiry may be found, and may seize any such document or take extracts of copies there from subject to the provisions of Indian Penal Code.

30. Delegation of power.—The Commission may, by general or special order in writing, delegate to the Chairperson, any member, Secretary, officer of the Commission or any other person subject to such conditions, if any, as may be specified in the order, such of its powers and functions under the Ordinance, (except the powers to adjudicate disputes under clause (1) of sub-section (1) of Section 26 and the powers to make regulations under section 48 as it may deem necessary.

31. Appeal.—(1) Any person aggrieved by any decision or order of the Commission may file an appeal before the High Court of Himachal Pradesh.

(2) An appeal under sub-section (1) shall be preferred within ninety days from the date of communication of the decision or order of the Commission to the person aggrieved by such decision or order.

32. Penalty for non-compliance of directions of Commission.—If any complaint is filed before the Commission that any user has contravened any provisions of the Ordinance, or if the Commission is satisfied that any user has contravened any of the provisions of the Ordinance or the rules or regulations or any direction issued by the Commission has not been complied with, the Commission may after giving such user an opportunity of being heard in the matter, by order in writing, direct that, without prejudice to any other penalty to which he may be liable under the Ordinance, such user shall pay, by way of penalty, such amount which shall be prescribed by the Commission for each contravention and in case of a continuing failure to pay such penalty, with an additional penalty which may be levied as deemed fit by the Commission for everyday from the day such failure commences until he pays such penalty.

33. Power to adjudicate.—(1) For the purpose of adjudicating under the Ordinance, the Commission shall appoint any of its members to be an adjudicating officer for holding an inquiry in such manner as may be prescribed after giving the person concerned a "reasonable opportunity of being heard for the purpose of imposing any penalty.

(2) While holding an inquiry, the adjudicating officer shall have power to summon and enforce the attendance of any person acquainted with the facts and circumstances of the case to give evidence or produce any document which, in the opinion of the adjudicating officer, may be useful for, or relevant to, the subject matter of the inquiry, and if, on such inquiry, he is satisfied that the person has failed to comply with any provision of the Ordinance, he may impose such penalty as he thinks fit in accordance with the provisions of the Ordinance.

(3) Any person aggrieved by an order under sub-section (2) may, within thirty days of the order, prefer an appeal before the Commission:

Provided that the Commission shall not pass any order without affording reasonable opportunity to the other party or parties, as the case may be.

34. Factors to be taken in to account by adjudicating officer.—While adjudicating the quantum of penalty under section 35, the adjudicating officer shall have due regard to the following factors namely:—

(a) the amount of disproportionate gain or unfair advantage, wherever quantifiable, made as a result of the default;

35. Penalty not to effect other liabilities.—The penalties imposed under the Ordinance shall be in addition to, and not in derogation of, any liability in respect of payment of compensation or, in the case of a user; the revocation of his registration which the offender may have incurred.

36. Grants and loans by the Government.—The Government may, after due appropriation made by State Legislature in this behalf, make to the Commission grants and loans of such sums of money as the Government may consider necessary.

37. Establishment of fund by the Government.—(1) There shall be a fund constituted to be called the Commission fund and that shall be credited thereto:—

(a) any grants and loans made to the Commission by the Government; (b) all fees received by the Commission under the Act; (c) all sums received by the Commission from such other sources as may be decided upon by the Government.

(2) The fund shall be applied for meeting:-

(a) the salary, allowances and other remuneration of Chairperson, members, officers and other employees of the Commission;

(b) the expenses of the Commission to discharge its function under the Ordinance; (c) the expenses on objects and for purposes authorized by the Ordinance.

(3) The Government may prescribe the manner of applying the fund for meeting the expenses specified in clause (b) or clause (c) of sub Section (2).

38. Accounts of Commission.—(1) The Commission shall maintain proper accounts and other relevant records and prepare an annual statement of accounts in such form as may be prescribed.

(2) The annual accounts and balance sheet of the Commission shall be forwarded to the Government and the Government shall cause the same to be laid, as soon as may be after it is received, before the State Legislature.

39. Annual Report of the Commission.—(1) The Commission shall prepare once every year, in such form and at such time as may be prescribed, an annual report giving a summary of its activities during the previous year and copies of the report shall be forwarded to the Government. (2) A copy of the report received under sub-section (1) shall be laid, as soon as may be after it is received, before the State Legislature.

40. Budget of the Commission.—The Commission shall prepare, in such form and at such time in each financial year as may be prescribed, its budget for the next financial year, showing the estimate receipts and expenditure of the Commission and forward the same to the Government.

41. Directions by the Government.—(1) To discharge its functions, the Commission shall be guided by such direction in matters of policy involving public interest as the State Government may from time to time give to it in writing.

(2) If any question arises as to whether any such direction relates to a matter of policy involving public interest, the decision of the State Government thereon shall be final.

42. Protection of action taken in good faith.—No suit, prosecution or other proceeding shall lie against the Government or the Commission or any officer of the Government, or any member, officer or other employee of the Commission or any public servant for anything done or in good faith purporting to be done under the Ordinance or the rules or regulations.

43. Members, officers, etc. to be public servants.—The Chairperson, Members, officers and other employees of the Commission when acting or purporting to act in pursuance of any of the provisions of the Ordinance, shall be deemed to be public servant within the meaning of the Indian Penal Code, 1860.

44. Provisions of the act to be in addition to and not in derogation of other laws.—The provisions of the Ordinance are in addition to and not in derogation of any other law for the time being in force in the State.

45. Power of Government to make rules.—(1) The Government may, by notification, make rules for carrying out the provisions of the Ordinance.

(2) In particular and without prejudice to the generality of foregoing power, such rules may provide for all or any of the following matters, namely:—

(a) the form and manner in which the agreement is to be executed under clause (b) of section 7;

(b) the form and manner of application and the fee to be paid for grant of registration certificate under section 10;

(c) the salary, allowances and other terms and conditions of service of the Chairperson and Members of the Commission under section 23;

(d) the form and manner in which and the authority before whom the Chairperson and Members shall make and subscribe oath under sub-section (3) of section 23;

(e) the powers to be exercised and duties to be performed by the Secretary of the Commission under sub-section (1) of section 25.

(f) the number, nature and categories of officers and employees of the Commission under sub-section (2) of section 25;

(g) the salaries, allowances and other terms and conditions of Secretary, officers and other employees of the Commission under sub-section (4) of section 25;

(h) the manner of applying the Commission Fund under sub-section (3) of section 40; and (i) any other matter which is required to be, or may be prescribed.

46. Powers of Commission to make regulations.—(1) The Commission may, with the prior approval of the Government, make regulations consistent with the Ordinance and the rules made thereunder generally to carry out the provisions of the Ordinance.

(2) All regulations made by the Commission under the Ordinance shall be subject to the condition of previous publication.

47. Rules and regulations to be laid before the State legislature.—Every rule made by the Government and every regulation made by the Commission shall be laid, as soon as may be after it is made, before the State Legislative Assembly.

48. Power to remove difficulties.—(1) If any difficulty arises in giving effect to the provisions of the Ordinance, the Government may, by order published in the Rajpatra (e-Gazette), Himachal Pradesh, make such provisions not inconsistent with the provisions of the Ordinance, as, may appear to be necessary for removing the difficulties; Provided that no order shall be made under this section after the expiry of two years from the date of commencement of the Ordinance, (2) Every order made under this section shall be laid, as soon as may be after it is made, before the State Legislative Assembly.

No. SEC (F) 2-3/2020-I-193.—Whereas the Government of Himachal Pradesh vide Ordinance No. 1 of 2023 dated 24-01-2023 has amended Section 6 (a) of the Himachal Pradesh Municipal Corporation Act, 1994 and reduced the maximum number of Wards of Municipal Corporation (s) in Himachal Pradesh from 41 to 34 wards;

And whereas for the conduct of general elections in 2017 the State Election Commission had notified the composition of 34 Wards of Municipal Corporation Shimla and published the same in Official Gazette vide Notification No. SEC-(13)-8/2016-10531, dated 06-12-2016;

And whereas territorial limits of the Municipal Corporation Shimla have not been altered, as no areas have been included or excluded therein since final Notification of wards of Municipal Corporation Shimla issued by the State Election Commission in 2016;

And whereas population figure of census operation 2011 is still in force as required under Section 2(38) of the Act ibid and the said figures shall be used for the purpose of reservation in respect of ensuing general elections to Municipal Corporation Shimla;

And whereas general election to Municipal Corporation Shimla was due before 18th June, 2022 but the same could not be conducted due to repeated litigation and status quo orders thereupon;

And whereas the State Election Commission had filed two SLPs No. 20999 of 2022 and 21010 of 2022 in the Hon'ble Supreme Court, which were pending adjudication in the Hon'ble Court. The Commission was of considered view that the SLPs had become infructuous in view of the changed circumstances due to the issuance of Ordinance No. 1 of 2023 and pendency of the SLP's may further delay the conduct of elections to Municipal Corporation Shimla. Therefore, the State Election Commission prayed before the Hon'ble Apex Court to allow to withdraw the SLPs and Hon'ble Apex Court has disposed off the SLP's mentioned hereinabove vide its orders dated 13-02-2023;

And whereas the Hon'ble Supreme Court of India in catena of cases in general and particularly in Suresh Mahajan vs State of Madhya Pradesh has held that the elections which are already due need not and cannot be delayed on the ground of delimitation in view of constitutional mandate;

Keeping in view the facts stated hereinabove, the Commission has decided that delimitation of 34 wards of M.C. Shimla as notified and published in the official gazette in 2016 is available and there is no need to undertake fresh delimitation of wards within territorial jurisdiction of Municipal Corporation Shimla in order to constitute the Municipal Corporation Shimla;

Therefore, the State Election Commission in exercise of the powers vested in it under Article 243ZA of the Constitution of India, Section 9 (1) of the Himachal Pradesh Municipal Corporation Act, 1994 read with Rule 9(2) of the Himachal Pradesh Municipal Corporation Election Rules, 2012, hereby directs that delimitation of Wards in respect of Municipal Corporation Shimla as finally notified vide Notification No. SEC-(13)-8/2016-1053, dated 06-12-2016 shall be treated as final delimitation of Wards for ensuing General Election to Municipal Corporation Shimla and the same is hereby re-published in the Official Gazette as Annexure-I earlier.

This is issued in supersession of the previous Notification issued vide Notification No. SEC(F) 2-3/2020-I-717-30, dated 10-03-2022.
