अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (वर्ष 1994 का अधिनियम संख्यांक 4) की धारा 3 (2) (ग) में प्रदत्त शक्तियों के अधिन जिला सिरमौर के विकास खण्ड पांवटा साहिब की ग्राम सभा खोदरी का मुख्यावास बदलकर ''खोदरी स्थित माजरी पहाडूवाला'' करने के सहर्ष आदेश प्रदान करते हैं।

इस अदालत में उप-मण्डलाधिकारी (ना0) महोदय चम्बा के कार्यालय पृष्ठांकन संख्या 819 दिनांक 02-03-2023 के माध्यम से प्राप्त दस्तावेज क्रमशः (1) जिला पंजीकरण (जन्म एवं मृत्यु) मुख्य चिकित्सा अधिकारी चम्बा के कार्यालय पत्र संख्या HFW-B&D/CMO-CBA/2022/2842, दिनांक 23-02-2023, (2) शपथ पत्र आवेदिका, (3) शपथ-पत्र वाशिन्दगान देह, (4) मृत्यु रिपोर्ट, (5) अप्राप्यता प्रमाण-पत्र, (6) आधार कार्ड जिसमें श्रीमती इन्दू देवी पत्नी श्री संदीप कुमार, गांव तिमण, डाकघर पुखरी, उप-तहसील पुखरी, जिला चम्बा, हिमाचल प्रदेश की सास श्रीमती लाम्बो देवी पत्नी श्री निहाल चन्द, ग्राम पंचायत पुखरी की मृत्यु तिथि किन्हीं कारणों से पंचायत अभिलेख में दर्ज करने से रह गई है। परिणामतयः पंचायत मृत्यु पंजीकरण रजिस्टर में आवेदिका की सास श्रीमती लाम्बो देवी पत्नी श्री निहाल चन्द, ग्राम पंचायत पुखरी की मृत्यु तिथि दर्ज न हुई है जो नियमानुसार अनिवार्य है। इस विषय की पुष्टि प्रधान रिपोर्ट व जारी मृत्यु रिपोर्ट जो जिला पंजीकरण जन्म एवं मृत्यु अधिकारी चम्बा ने अपने प्रमाण-पत्र जो दिनांक 23-02-2023 को जारी हुआ है उसमें की है।11285 राजपत्र, हिमाचल प्रदेश, 22 मार्च 2023/01 चैत्र, 1945 अतः सर्वसाधारण को इस नोटिस के माध्यम से सूचित किया जाता है कि श्रीमती लाम्बो देवी पत्नी श्री निहाल चन्द, ग्राम पंचायत पुखरी, परगना त्रयोदी, उप-तहसील पुखरी, जिला चम्बा की मृत्यु तिथि 24-12-2022 जन्म एवं मृत्यु पंजीकरण अधिनियम, 1969 की धारा 13(3) के प्रावधानों के अन्तर्गत पंचायत के सम्बन्धित अभिलेख अथवा जिला पंजीकरण (जन्म एवं मृत्यु) द्वारा अभिलेख में दर्ज करने के आदेश पारित किये जाने हैं। अगर किसी को किसी प्रकार की कोई आपत्ति हो तो वह इस अदालत में नोटिस (इश्तहार) के एक माह के भीतर सुबह 10.00 से सायं 5.00 बजे तक अपनी आपत्ति दर्ज करवा सकता है। निर्धारित अवधि में आपत्ति न आने की सूरत में आवेदिका की सास श्रीमती लाम्बो देवी पत्नी श्री निहाल चन्द, ग्राम पंचायत पुखरी, परगना त्रयोदी की मृत्यु तिथि सम्बन्धित अभिलेख में दर्ज करने के आदेश पारित कर दिये जाएंगे। आज दिनांक 04-03-2023 को मेरे हस्ताक्षर व मोहर अदालत सहित जारी हुआ।

No. SEC(F)1-35/2022-1009.—In exercise of the powers vested in it under Article 243K of the Constitution of India, Section 160 of the Himachal Pradesh Panchayati Raj Act, 1994 read with Rule 22 of the Himachal Pradesh Panchayati Raj (Elections) Rules, 1994, the State Election Commission Himachal Pradesh hereby directs a special revision of electoral rolls of Gram Panchayat Koidi Development Block Nalagarh, District Solan wherein casual vacancy has occurred on the post of Up-Pradhan. The date of determining the eligibility of a person for inclusion of the name in the electoral rolls shall be 01-01-2023 as required under Rule 14 (e) of the Rules ibid. The programme is as under:—

The District Election Officer (P) will appoint Revising Authority as required under Rule 17 of the Rules ibid and ensure that wide publicity of the said appointment and of the special revision programme is made.

After the disposal of claims, objections and appeals, if any, District Election Officer (P) shall prepare a supplementary list 2023 through ERMS Software and shall issue a notice of final publication of electoral rolls on Form-15 as per schedule fixed by the Commission. The finally published electoral rolls shall be uploaded on the official website of the State Election Commission.

As soon as the notice of final publication is issued by the District Election Officer (P) the intimation of the same be sent to the Commission immediately through E-mail followed by confirmation by post. Thereafter adequate copies of the Supplementary List, 2023 shall be printed locally after completing all the codal formalities. These Supplementary List shall be added to the main electoral rolls. The last finally published electoral rolls alongwith Supplementary List, 2022, if any, and Supplementary list-2023 shall be used in the ensuing by-elections to fill the casual vacancy.

The copies of the electoral rolls be made available for sale at the cost of Rs. 5/- per page to be paid in cash against receipt.

The relevant provisions and procedure of ibid Rules enshrined under Chapter-III shall be adhered to strictly for the preparation of electoral rolls through special revision. Needless to say that the aforesaid programme should be implemented in letter and spirit. If any violation of this programme is noticed, it will be in contravention of the mandate of the Constitution of India and relevant statutory provisions which may lead to serious consequences in view of Section 160-E of the Act ibid.
