संख्या ः एफ0एफ0ई0-बी0-एफ0(14)-30/2021.--भारतीय वन अधिनियम, 1927 (1927 का अधिनियम संख्यांक 16) की धारा 29 की उप-धारा (3) के अधीन यथा अपेक्षित के अनुसार इस अधिसूचना से 282—राजपत्र/2023-29-03-2023 (11955) 11956 राजपत्र, हिमाचल प्रदेश, 29 मार्च 2023/08 चैत्र, 1945 संलग्न अनुसूची में यथा विनिर्दिष्ट वन भूमि या प्रतिपूरक वनरोपण भूमि में या उस पर सरकार तथा प्राइवेट व्यक्तियों के अधिकारों के स्वरूप और विस्तार की जांच कर ली गई है और उन्हें तदनुसार अभिलिखित कर लिया गया है;

और उक्त अनुसूची में दर्शित वन भूमि या प्रतिपूरक वनरोपण भूमि, सरकार की सम्पत्ति है, या जिस पर सरकार के सांपत्तिक अधिकार हैं या सरकार उसकी वन उपज के सम्पूर्ण या किसी भाग की हकदार है;

अतः हिमाचल प्रदेश के राज्यपाल, पूर्वाेक्त अधिनियम की धारा 29 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, घोषणा करते हैं कि उक्त अधिनियम के अध्याय-4 के उपबन्ध उक्त वन भूमि या प्रतिपूरकर वनरोपण भूमि को लागू होंगे और जो इसके पश्चात्‌ पूर्वोक्त अधिनियम की धारा 29 की उप-धारा (2) के उपबन्धों के अधीन ''संरक्षित वन'' कहलाएगी।

NOTIFICATION

Shimla-2, the 24th March, 2023

No. FFE-B-F(14)-30/2021.—WHEREAS, the nature and extent of the rights of the Government and of the Private Persons in or over the forest land or CA (Compensatory Afforestation) land as specified in the SCHEDULE appended to this Notification have been enquired into and accordingly recorded, as required under sub-section (3) of Section-29 of the Indian Forest Act, 1927 (Act No. 16 of 1927);

AND WHEREAS, the forest land or CA land as shown in the said SCHEDULE is the property of the Government or over which the Government has proprietary rights or the Government is entitled to the whole or any part of the forest produce therein;

NOW THEREFORE, in exercise of the powers conferred by sub-section (1) of Section 29 of the Act ibid, the Governor, Himachal Pradesh is pleased to declare that the provisions of Chapter- IV of the said Act shall apply to the said forest land or CA land and shall hereafter be called as "protected forests" under the provisions of sub-section (2) of Section-29 of the Act ibid.

NOTIFICATION

Shimla-2, the 21st March, 2023

No.FFE-B-A(4)-2/2015-L.—WHEREAS, the Government of Himachal Pradesh has fixed the price of private forest produce under section-7 of the Himachal Pradesh Forest Produce (Regulation of Trade) Act, 1982 from time to time. The rates were revised from time to time in subsequent years, though, the terms & conditions remained the same as laid down in the Govt. H.P. Notification No. FFE-B-A(4)-3/2005-Vol-I, dated 31st March, 2011.

NOW THEREFORE, in exercise of the powers conferred by first proviso of Section 7 of the Himachal Pradesh Forest Produce (Regulation of Trade) Act, 1982, the Governor, Himachal Pradesh is pleased to fix the price of private forest produce for the Financial Year 2023-24 by enhancing 15% in the existing rates fixed for the Financial Year 2022-23 notified vide Notification of even number dated 30th March, 2022. The list of revised rates is enclosed as Annexure-I.

The Governor of Himachal Pradesh is further pleased to enhance the handling charges on sale realization in respect of private timber lots from 12% to 15% for the Financial Year 2023-24.

All other "terms and conditions" as prescribed in this Department's notification referred to above shall remain unchanged.

State Industrial Development Corporation Ltd., H.P. State Electricity Board & H.P. सं0 पीसीएच (4) 1/94-लूज-6530-6685.--राज्य निर्वाचन आयुक्त (सेवा शर्तंे) नियम, 2022 के प्रारूप को इस विभाग की समसंख्यक अधिसूचना तारीख 30-08-2022 द्वारा, हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 186 के उपबन्धों के अधीन यथा अपेक्षित के अनुसार जनसाधारण से आक्षेप(पों) या सुझाव(वों) आमन्त्रित करने के लिए राजपत्र, हिमाचल प्रदेश में तारीख 07-09- 2022 को प्रकाशित किया गया था;

और नियत अवधि के दौरान इस निमित कोई भी आक्षेप/सुझाव प्राप्त नहीं हुआ है;

अतः हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 243ट के खण्ड (2) के साथ पठित हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 (1994 का अधिनियम संख्यांक 4) की धारा 160 और 186 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित संशोधित नियम बनाते हैं, अर्थातः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम राज्य निर्वाचन आयुक्त (सेवा शर्तें) प्रथम संशोधन नियम, 2023 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित की तारीख से प्रवित्त होंगे। 2. नियम 7 का संशोधन.--राज्य निर्वाचन आयुक्त (सेवा शर्तंें) नियम, 2016 के नियम के पश्चात्‌ निम्नलिखित परंतुक अंतःस्थापित किया जाएगा, अर्थातः--11961 राजपत्र, हिमाचल प्रदेश, 29 मार्च 2023/08 चैत्र, 1945 ''परन्तु सरकार का सेवारत अधिकारी, जिसे राज्य निर्वाचन आयुक्त के रूप में नियुक्त किया जाता है, अपने भविष्य निधि खाते में अतिशेष को नये भविष्य निधि खाते में अग्रनीत किए जाने के लिए हकदार होगा।''

Now, therefore, in exercise of the powers conferred by Section 160 and 186 of the Himachal Pradesh Panchayati Raj Act, 1994 (Act No. 4 of 1994) read with clause (2) of article 243K of the constitution of India, the Governor of Himachal Pradesh is pleased to make the following amendment rules, namely:—

1. Short title.—(1) These rules may be called the State Election Commissioner (Conditions of Service) First Amendment Rules, 2023.

(2) These rules shall come into force from the date of publication in Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule 7.—After rule 7 of State Election Commissioner (Conditions of Service) Rules, 2016, the following provisio shall be inserted, namely:—

" Provided that the in service officer of the Government who is appointed as State Election Commissioner shall be entitled to carry forward balance in his Provident Fund Account to the New Provident Account".

श्री रतन लाल पुत्र स्व0 श्री चेत राम, निवासी गांव व डाकघर कोठूवा, तहसील सन्धोल, जिला मण्डी (हि0प्र0) द्वारा समस्त औपचारिकताओं सहित इस न्यायालय में प्रस्तुत आवेदन-पत्र में उल्लेख किया है कि उसकी पत्नी का वास्तविक नाम श्रीमती विमला देवी है जबकि राजस्व अभिलेख महाल सोहर में उसका नाम लीला देवी दर्ज है जो कि गलत है। इसलिये प्रार्थी ने निवेदन किया हैैैैै कि राजस्व अभिलेख महाल सोहर में दुरुस्ती की जाकर उसका नाम श्रीमती लीला देवी उर्फ विमला देवी दर्ज किया जाये।

अतः इससे पूर्व कि मामला में अधीन धारा 37(2) भू-राजस्व अधिनियम, 1954 के तहत आगामी आवश्यक कार्रवाई अमल में लाई जाए, इस नोटिस द्वारा जनसाधारण को सूचित किया जाता है कि यदि किसी को उपरोक्त मामला में कोई उजर/एतराज हो तो वह इस न्यायालय में दिनांक 12-04-2023 को प्रातः 10.00 बजे असालतन या वकालतन हाजिर आकर अपना उजर/एतराज पेश कर सकता है अन्यथा गैर-हाजिरी की सूरत में एकतरफा कार्यवाही अमल में लाई जाएगी एवं प्रार्थी के आवेदन-पत्र का नियमानुसार निपटारा कर दिया जाएगा।
