वित्तीय वर्ष 2023-2024 के लिए हिमाचल प्रदेश राज्य की संचित निधि में से सेवाओं के लिए कतिपय धनराशियों के संदाय को प्राधि—त करने और उनका विनियोग करने के लिए विधेयक।

भारत गणराज्य के चौहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विनियोग (संख्यांक 2) अधिनियम, 2023 है।

(2) यह प्रथम अप्रैल, 2023 को लागू होगा।

3. विनियोग.--इस अधिनियम द्वारा हिमाचल प्रदेश राज्य की संचित निधि में से संदत्त और उपयोजित करने के लिए प्राधि—त धनराशियों का उक्त वर्ष के सम्बन्ध में अनुसूची में अभिव्यक्त सेवाओं और प्रयोजनों के लिए विनियोग किया जाएगा।

4. निरसन और व्यावृत्तियां.-- निम्नलिखित विनिर्दिष्ट विनियोग अधिनियमों का एतद्‌द्वारा निरसन किया जाता है, अर्थात्‌ः-

(i) हिमाचल प्रदेश विनियोग अधिनियम, 2022 (2022 का अधिनियम संख्यांक 7);

(ii) हिमाचल प्रदेश विनियोग (संख्यांक 2) अधिनियम, 2022 (2022 का अधिनियम संख्यांक 8);

और

(iii) हिमाचल प्रदेश विनियोग (संख्यांक 3) अधिनियम, 2022 (2022 का अधिनियम संख्यांक 12)ः परन्तु ऐसा निरसन निम्नलिखित को प्रभावित नहीं करेगाः-

(क) किसी अन्य ऐसी अधिनियमितियों को प्रभावित नहीं करेगा जिसमें निरसित अधिनियमिति को लागू, सम्मिलित या निर्दिष्ट किया गया है; या

(ख) पहले की गई या हुई किसी बात या पहले से अर्जित या उपगत किसी अधिकार, हक, बाध्यता या दायित्व अथवा उसके विषय में किसी उपचार या कार्यवाही या किसी ऋण, शास्ति, बाध्यता, दायित्व, दावे या मांग से कोई निर्माेचन या उन्मोचन या पहले ही अनुदत्त किसी क्षतिपूर्ति या किसी पूर्व कार्य या बात के सबूत की विधिमान्यता, अविधिमान्यता, उसके प्रभाव या परिणामों पर प्रभाव नहीं डालेगा; या

(ग) विधि के किसी सिद्धान्त या नियम या स्थापित अधिकारिता, अभिवचन के प्ररूप या अनुक्रम, पद्धति या प्रक्रिया या विद्यमान विशेषाधिकार, निर्बन्धन, छूट, पद या नियुक्ति पर नहीं पड़ेगा चाहे वह, इसके द्वारा निरसित किसी अधिनियमिति द्वारा उसमें या उससे किसी रीति से पुष्ट, मान्य या व्युतपन्न क्यों न हो; या

(घ) संपरीक्षा, परीक्षण, लेखा, अन्वेषण, जांच या उससे सम्बन्धित किसी प्राधिकारी द्वारा की गई या की जाने वाली किसी अन्य कार्रवाई पर नहीं पड़ेगा और ऐसी संपरीक्षा, परीक्षण, लेखा, अन्वेषण, जांच या कार्रवाई की जा सकती है, और, या जारी रखी जा सकती है, मानो उक्त अधिनियमितियां इस अधिनियम द्वारा निरसित ही न की गई हों।11989 राजपत्र, हिमाचल प्रदेश, 31 मार्च 2023/10 चैत्र, 1945 अनुसूची

उद्देश्यों और कारणों का कथन

यह विधेयक, भारत के संविधान के अनुच्छेद 204 के खण्ड (1) के अनुसरण में हिमाचल प्रदेश राज्य की संचित निधि में से वित्तीय वर्ष 2023-2024 के लिए हिमाचल प्रदेश सरकार के अनुमानित व्ययों के सम्बन्ध में संचित निधि पर प्रभारित व्ययों और विधान सभा द्वारा दत्तमत अन्य व्ययों को पूरा करने के लिए अपेक्षित धन के विनियोजन का उपबन्ध करने के लिए पुरःस्थापित है।

Fund of the State of Himachal Pradesh for the services for the financial year 2023-2024.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-fourth Year of the Republic of India as follows:—

1. Short title and commencement.— (1) This Act may be called the Himachal Pradesh Appropriation (Number 2) Act, 2023.

(2) It shall come into force on the first day of April, 2023.

2. Issue of a sum of `5,66,83,69,82,000 out of the Consolidated fund of the State of Himachal Pradesh for the financial year 2023-2024.— From and out of the Consolidated Fund of the State of Himachal Pradesh, there may be paid and applied sums not exceeding those specified in column (3) of THE SCHEDULE amounting in the aggregate to a sum of ` 5,66,83,69,82,000 (Rupees fifty six thousand six hundred eighty three crore, sixty nine lakh, eighty two thousand) only towards defraying the several charges which will come in course of payment during the financial year 2023-2024 in respect of the services and purposes specified in column (2) of THE SCHEDULE.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be appropriated for the services and purposes expressed in the THE SCHEDULE in relation to the said year.

4. Repeal and savings.—The Appropriation Acts specified below are hereby repealed, namely:—

(i) The Himachal Pradesh Appropriation Act, 2022 ( Act No. 7 of 2022);

(ii) The Himachal Pradesh Appropriation (Number 2) Act, 2022 ( Act No. 8 of 2022);

and

(iii) The Himachal Pradesh Appropriation (Number 3) Act, 2022 ( Act No. 12 of 2022):

Provided that such repeal shall not,—

(a) affect, any other enactment in which the repealed enactment has been applied, incorporated or referred to; or

(b) affect the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired or incurred, or any remedy or proceeding in respect thereof, or any release or discharge of or from any debt, penalty, obligation, liability, claim or demand, or indemnity already granted, or the proof of any past act or thing; or

(c) affect any principle or rule of law, or established jurisdiction, form or course of pleading, practice or procedure, or existing privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed or recognized or derived by, in or from any enactment thereby repealed; or

(d) affect the audit, examination, accounting, investigation, inquiry or any other action taken or to be taken in relation thereto by any authority and such audit, examination,11993 राजपत्र, हिमाचल प्रदेश, 31 मार्च 2023/10 चैत्र, 1945 accounting, investigation, inquiry or action could be taken, and, or continued as if the said enactments are not repealed by this Act.

STATEMENT OF OBJECTS AND REASONS

This Bill is introduced in pursuance of clause (1) of Article 204 of the Constitution of India to provide for the appropriation from and out of the Consolidated Fund of the State of Himachal Pradesh of the moneys required to meet the expenditure charged on the Consolidated Fund and other expenditure as voted by the Legislative Assembly in respect of the estimated expenditure of the Government of Himachal Pradesh for the financial year 2023-2024.

2023 का विधेयक संख्यांक 8 हिमाचल प्रदेश भू-जोत अधिकतम सीमा (संशोधन) विधेयक, 2023

हिमाचल प्रदेश भू-जोत अधिकतम सीमा अधिनियम, 1972 (1973 का अधिनियम संख्यांक 19) का और संशोधन करने के लिए विधेयक।

भारत गणराज्य के चौहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित होः-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश भू-जोत अधिकतम सीमा (संशोधन) अधिनियम, 2023 है।11997 राजपत्र, हिमाचल प्रदेश, 31 मार्च 2023/10 चैत्र, 1945 2. धारा 3 का संशोधन.--हिमाचल प्रदेश भू-जोत अधिकतम सीमा अधिनियम, 1972 (जिसे इसमें इसके पश्चात्‌ "मूल अधिनियम" कहा गया है) की धारा 3 के खण्ड (थ) में "यदि कोई हो" शब्दों के पश्चात्‌ "और वयस्क पुत्री" शब्द रखे जाएंगे।

3. धारा 4 का संशोधन.--मूल अधिनियम की धारा 4 की उप-धारा (4) मेंः-

(क) "व्यक्ति का प्रत्येक वयस्क पुत्र" शब्दों के पश्चात्‌ "या वयस्क पुत्री" शब्द रखे जाएंगे; और (ख) परन्तुक के पश्चात्‌ निम्नलिखित स्पष्टीकरण अन्तःस्थापित किया जाएगा, अर्थात्‌ः- "स्पष्टीकरणः-पुत्री शब्द के अन्तर्गत दोनों अविवाहित और विवाहित पुत्रियां सम्मिलित होंगी"।

4. धारा 5 का संशोधन.--मूल अधिनियम की धारा 5 के खण्ड (ज) में "वास्तविक परियोजना के उपयोग" शब्दों के पश्चात्‌ "या केन्द्र सरकार या राज्य सरकार पब्लिक सेक्टर उपक्रम द्वारा सौर ऊर्जा परियोजना उपयोग" शब्द अन्तःस्थापित किए जाएंगे।

उद्देश्यों और कारणों का कथन

हिमाचल प्रदेश भू-जोत अधिकतम सीमा अधिनियम, 1972 की धारा 4 की उपधारा (4) में, उक्त अधिनियम की धारा 4 की उप-धारा (1) के उपबन्ध के अधीन किसी व्यक्ति या कुटुम्ब के अनुज्ञेय क्षेत्र की गणना करने के लिए "पुत्री" को एक पृथक इकाई मानने से अपवर्जित किया गया है। इस अपवर्जन को समाज में विभिन्न मंचों पर उठाया गया है और इसे पुत्रियों के विरुद्ध लिंग विभेद माना गया है। अधिनियम की धारा 4(1) के अधीन अधिकथित सिद्धांतों को लागू करते समय अधिनियम के अधीन अनुज्ञेय सीमा की गणना के लिए पुत्री का एक पृथक इकाई के रूप में मानने से अपवर्जन, उसके माता-पिता के पक्ष में भूमि की अनुज्ञेय मात्रा में कमी कर सकेगा। इस प्रकार यह विधान में असंगति है और प्रस्तावित संशोधन इसमें सुधार हेतु आशयित है।

जीवाश्म ईंधन पर निर्भरता कम करते हुए और ऊर्जा के नवीकरणीय स्त्रोतों को अपनाते हुए हरित और स्वच्छ ऊर्जा की ओर परिवर्तन समय की मांग है। जल-विद्युत उत्पादन की अनुपूर्ति करने हेतु, राज्य बड़े सौर ऊर्जा संयंत्रों को स्थापित करने का प्रयास कर रहा है। तथापि, हिमाचल प्रदेश भू-जोत अधिकतम सीमा अधिनियम, 1972 के अधीन सौर ऊर्जा परियोजनाओं के लिए कोई छूट नहीं है। प्रस्तावित संशोधन केन्द्रीय और राज्य सरकार पब्लिक सेक्टर उपक्रमों को सौर ऊर्जा परियोजनाओं के निष्पादन करने के लिए अधिकतम सीमाओं से छूट देने के लिए उपबंध करता है। इसलिए, पूर्वोक्त अधिनियम में संशोधन करना आवश्यक हो गया है।

यह विधेयक उपर्युक्त उद्देश्यों की पूर्ति के लिए है।

further to amend the Himachal Pradesh Ceiling on Land Holdings Act,1972 (Act No.19 of

1973).

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-fourth Year of the Republic of India as follows:—

1. Short title.— This Act may be called the Himachal Pradesh Ceiling on Land Holdings (Amendment) Act, 2023.

2. Amendment of section 3.—In section 3 of the Himachal Pradesh Ceiling on Land Holdings Act, 1972 (hereinafter referred to as the "principal Act"), in clause (q), after the words "if any", the sign and words "; and an adult daughter" shall be substituted.

3. Amendment of section 4.—In section 4 of the principal Act, in sub-section(4),—

(a) for the words, "of a person", the words "or adult daughter of a person" shall be substituted; and

(b) after the proviso, the following explanation shall be inserted, namely:—

"Explanation.—the word daughter shall include both unmarried and married daughters.".

4. Amendment of section 5.— In section 5 of the principal Act, in clause (h), after the words "bonafide project use", the sign and words "; or by a Central Government or State Government public sector undertaking for solar power project use" shall be inserted.

STATEMENT OF OBJECTS AND REASONS

In sub-section (4) of section 4 of the Himachal Pradesh Ceiling on Land Holdings Act, 1972, the "daughter" has been excluded for considering as a separate unit for calculating the permissible area of a person or family under the provision of sub-section (1) of section 4 of the said Act. This exclusion has been pointed out at various platforms in the society and it has been considered as a gender discrimination against the daughters. The exclusion of daughter from considering her as a separate unit for calculating the permissible limit under the Act, may reduce the permissible quantum of land in favour of her parents, while applying the principles as laid down under section 4(1) of the Act. As such this is an anomaly in the legislation and the proposed amendment intends to rectify the same.

The need of the hour is to shift on to green and clean energy by reducing the reliance on the fossil fuels and adopting renewal sources of energy. In order to supplement the hydropower generation the State endeavors to set up large solar power plants. However, there is no exemption for the solar power projects under the Himachal Pradesh Ceiling on Land Holdings Act, 1972. The proposed amendment seeks to make provision for exempting the Central and State Government public sector undertakings from ceiling limits for executing solar power projects. This has necessitated amendments in the Act ibid.

This Bill seeks to achieve the aforesaid objectives.

REGULATIONS

1. Short title and commencement.—(1) These Regulations may be called the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) (Thirteenth Amendment) Regulations, 2023.

(2) These Regulations shall come into force from the date of their publication in the Rajpatra, Himachal Pradesh.

2. Amendment of the Schedule.—In the Schedule i.e "Fee Structure" annexed to the Himachal Pradesh Electricity Regulatory Commission (Conduct of Business) Regulations, 2005, the following shall be substituted, namely—

(1) in column 4, against serial No. 1 for the figure and word "1 lakh", the figure and word "3 lakh shall be substituted.

(2) in column 4, against serial No. 2—

(a) in item (i) for the figure and word "125 lakh", the figure and word"150 lakh" shall be substituted;

(b) in item (ii) for the figure and sign "0.035 %", figure and sign "0.045%" shall be substituted; and

(c) in item (iii) for the figure and word "2 lakh", the figure and word "3 lakh" shall be substituted;

(3) in column 4, against serial No.3—

(a) for item (a)(i) , the following shall be substituted, namely:—

"50 lakh plus 5 0,000/- for every additional 1.00MW or part thereof in excess of 25MW, subject to the maximum 150 lakh under this item" ;

(b) for item (b) (i), the following shall be substituted, namely:— "(i) 60,000/- per 100kW or part thereof subject to a maximum of 10 lakh" ;

(c) in item (b) (ii), for the figure and word "15 lakh", the figure and word "18 lakh" shall be substituted; and

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगर निगम निर्वाचन (तृतीय संशोधन) नियम, 2023 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 10 का संशोधन.--हिमाचल प्रदेश नगर निगम (निर्वाचन) नियम, 2012 के नियम 10 मेें,- (क) उप-नियम (3) में "न्यूनतम" शब्द के स्थान पर "अधिकतम" शब्द रखा जाएगा; और (ख) उप-नियम (5) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"(5) जनसंख्या की प्रतिशतता के आधार पर अनुसूचित जाति और अनुसूचित जनजाति तथा अनुसूचित जाति और अनुसूचित जनजाति से सम्बन्धित महिलाओं के लिए आरक्षित स्थान आगामी निर्वाचन में प्रवर्तित किए जाएंगे और आने वाले निर्वाचन के समय अगली अधिकतम12004 राजपत्र, हिमाचल प्रदेश, 31 मार्च 2023/10 चैत्र, 1945 प्रतिशतता की जनसंख्या वाले वार्ड/वार्डों के स्थान अनुसूचित जाति और अनुसूचित जनजाति के सदस्यों के लिए आरक्षित होंगे और पहले ही आरक्षित वार्ड का स्थान, सामान्य श्रेणी के सदस्यों के लिए अनारक्षित रखा जाएगा और पश्चात्‌वर्ती निर्वाचन के लिए यही क्रम चलता रहेगा और अनुसूचित जाति या अनुसूचित जनजाति प्रवर्ग से सम्बन्धित महिलाओं के लिए आरक्षित स्थान को जनसंख्या की प्रतिशतता के आधार पर अधिकतम से अगली अधिकतम प्रतिशतता के आधार पर चक्रानुक्रमित किया जाएगा और सामान्य प्रवर्ग से सम्बन्धित महिलाओं के लिए आरक्षित स्थान को जनसंख्या की न्यूनतम से अगली अधिकतम प्रतिशतता के आधार चक्रानुक्रमित किया जाएगा।"

स्पष्टीकरण .- सामान्य श्रेणी के अन्तर्गत इस श्रेणी से सम्बन्धित पुरूष या महिलाएं दोनों हैं।

No. UD-A(3)-2/2020.—In exercise of powers conferred by Section 31 of the Himachal Pradesh Municipal Corporation Act, 1994 (Act No. 12 of 1994), the Governor, Himachal Pradesh, makes the following rules further to amend the Himachal Pradesh Municipal Corporation Election Rules, 2012 notified vide this Department Notification No. UD-A(3)-7/2011, dated 23-03-2012 and published in Rajpatra, Himachal Pradesh on 24-03-2012, namely:—

1. Short title and commencement.—These rules may be called the Himachal Pradesh Municipal Corporation Election (3rd Amendment) Rules, 2023.

(2) These rules shall come into force from the date of publication in Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule 10.— In rule 10 of the Himachal Pradesh Municipal Corporation Election Rules, 2012,—

(a) in sub-rule (3), for the word "lowest", the word "highest" shall be substituted; and (b) for sub-rule(5), the following shall be substituted, namely:—

"5 The seats reserved for Scheduled Castes and Scheduled Tribes and Women belonging to Scheduled Castes and Scheduled Tribes on the basis of percentage of population shall be changed in the next election and at the time of following elections, the seats of the ward/wards, containing the next highest percentage of population shall be reserved for member of Scheduled Castes and Scheduled Tribes and the seat of the12005 राजपत्र, हिमाचल प्रदेश, 31 मार्च 2023/10 चैत्र, 1945 ward earlier reserved shall be kept open to the members of the General Category and so on for subsequent elections and the seats reserved for women belonging to Scheduled Castes or Scheduled Tribes Category shall be rotated from highest to next highest on the basis of percentage of population and seat reserved for women belonging to general category shall be rotated from lowest to next higher percentage of population.

Explanation.—General Category includes men or women or both belonging to this Category.".

वित्तीय वर्ष 2023-2024 के लिए हिमाचल प्रदेश राज्य की संचित निधि में से सेवाओं के लिए कतिपय धनराशियों के संदाय को प्राधि—त करने और उनका विनियोग करने के लिए अधिनियम।

भारत गणराज्य के चौहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विनियोग (संख्यांक 2) अधिनियम, 2023 है।

(2) यह प्रथम अप्रैल, 2023 को लागू होगा। 12022 राजपत्र, हिमाचल प्रदेश, 31 मार्च 2023/10 चैत्र, 1945 2023-2024 की अवधि में अनुसूची के द्वितीय स्तम्भ में विनिर्दिष्ट सेवाओं और प्रयोजनों से सम्बन्धित विभिन्न प्रभारों के संदाय को चुकाने के लिए उपयोग किया जाएगा।

3. विनियोग.--इस अधिनियम द्वारा हिमाचल प्रदेश राज्य की संचित निधि में से संदत्त और उपयोजित करने के लिए प्राधि—त धनराशियों का उक्त वर्ष के सम्बन्ध में अनुसूची में अभिव्यक्त सेवाओं और प्रयोजनों के लिए विनियोग किया जाएगा।

4. निरसन और व्यावृत्ति.-- निम्नलिखित विनिर्दिष्ट विनियोग अधिनियमों का एतद्‌द्वारा निरसन किया जाता है, अर्थात्‌ः-

(i) हिमाचल प्रदेश विनियोग अधिनियम, 2022 (2022 का अधिनियम संख्यांक 7);

(ii) हिमाचल प्रदेश विनियोग (संख्यांक 2) अधिनियम, 2022 (2022 का अधिनियम संख्यांक 8);

और

(iii) हिमाचल प्रदेश विनियोग (संख्यांक 3) अधिनियम, 2022 (2022 का अधिनियम संख्यांक 12)ः परन्तु ऐसा निरसन निम्नलिखित को प्रभावित नहीं करेगाः-

(क) किसी अन्य ऐसी अधिनियमितियों को प्रभावित नहीं करेगा जिसमें निरसित अधिनियमिति को लागू, सम्मिलित या निर्दिष्ट किया गया है; या

(ख) पहले की गई या हुई किसी बात या पहले से अर्जित या उपगत किसी अधिकार, हक, बाध्यता या दायित्व अथवा उसके विषय में किसी उपचार या कार्यवाही या किसी ऋण, शास्ति, बाध्यता, दायित्व, दावे या मांग से कोई निर्माेचन या उन्मोचन या पहले ही अनुदत्त किसी क्षतिपूर्ति या किसी पूर्व कार्य या बात के सबूत की विधिमान्यता, अविधिमान्यता, उसके प्रभाव या परिणामों पर प्रभाव नहीं डालेगा; या

(ग) विधि के किसी सिद्धान्त या नियम या स्थापित अधिकारिता, अभिवचन के प्ररूप या अनुक्रम, पद्धति या प्रक्रिया या विद्यमान विशेषाधिकार, निर्बन्धन, छूट, पद या नियुक्ति पर नहीं पड़ेगा चाहे वह, इसके द्वारा निरसित किसी अधिनियमिति द्वारा उसमें या उससे किसी रीति से पुष्ट, मान्य या व्युतपन्न क्यों न हो; या

(घ) संपरीक्षा, परीक्षण, लेखा, अन्वेषण, जांच या उससे सम्बन्धित किसी प्राधिकारी द्वारा की गई या की जाने वाली किसी अन्य कार्रवाई पर नहीं पड़ेगा और ऐसी संपरीक्षा, परीक्षण, लेखा, अन्वेषण, जांच या कार्रवाई की जा सकती है, और, या जारी रखी जा सकती है, मानो उक्त अधिनियमितियां इस अधिनियम द्वारा निरसित ही न की गई हों।

THE HIMACHAL PRADESH APPROPRIATION (NUMBER 2) ACT, 2023

(AS ASSENTED TO BY THE GOVERNOR ON 31ST MARCH, 2023)

AN

ACT

to authorise payment and appropriation of certain sums from and out of the Consolidated

Fund of the State of Himachal Pradesh for the services for the financial year 2023-2024.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-fourth Year of the Republic of India as follows:—

1. Short title and commencement.— (1) This Act may be called the Himachal Pradesh Appropriation (Number 2) Act, 2023.

(2) It shall come into force on the first day of April, 2023.

2. Issue of a sum of `5,66,83,69,82,000 out of the Consolidated fund of the State of Himachal Pradesh for the financial year 2023-2024.— From and out of the Consolidated Fund of the State of Himachal Pradesh, there may be paid and applied sums not exceeding those specified in column (3) of THE SCHEDULE amounting in the aggregate to a sum of ` 5,66,83,69,82,000 (Rupees fifty six thousand six hundred eighty three crore, sixty nine lakh, eighty two thousand) only towards defraying the several charges which will come in course of payment during the financial year 2023-2024 in respect of the services and purposes specified in column (2) of THE SCHEDULE.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be appropriated for the services and purposes expressed in the THE SCHEDULE in relation to the said year.

4. Repeal and savings.—The Appropriation Acts specified below are hereby repealed, namely:—

(i) The Himachal Pradesh Appropriation Act, 2022 ( Act No. 7 of 2022);

(ii) The Himachal Pradesh Appropriation (Number 2) Act, 2022 ( Act No. 8 of 2022);

and

(iii) The Himachal Pradesh Appropriation (Number 3) Act, 2022 ( Act No. 12 of 2022):

Provided that such repeal shall not,—

(a) affect, any other enactment in which the repealed enactment has been applied, incorporated or referred to; or

(b) affect the validity, invalidity, effect or consequences of anything already done or suffered, or any right, title, obligation or liability already acquired or incurred, or any remedy or proceeding in respect thereof, or any release or discharge of or from any12026 राजपत्र, हिमाचल प्रदेश, 31 मार्च 2023/10 चैत्र, 1945 debt, penalty, obligation, liability, claim or demand, or indemnity already granted, or the proof of any past act or thing; or

(c) affect any principle or rule of law, or established jurisdiction, form or course of pleading, practice or procedure, or existing privilege, restriction, exemption, office or appointment, notwithstanding that the same respectively may have been in any manner affirmed or recognized or derived by, in or from any enactment thereby repealed; or

(d) affect the audit, examination, accounting, investigation, inquiry or any other action taken or to be taken in relation thereto by any authority and such audit, examination, accounting, investigation, inquiry or action could be taken, and, or continued as if the said enactments are not repealed by this Act.

संख्याः एल0एल0आर0-डी0(6)-6/2023-लेज.--हिमाचल प्रदेश के राज्यपाल ने भारत के संविधान के अनुच्छेद 200 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए हिमाचल प्रदेश विनियोग विधेयक, 2023 (2023 का विधेयक संख्यांक 3) को दिनांक 31-03-2023 को अनुमोदित कर दिया है तथा अनुच्छेद 348 के खण्ड (3) के अधीन, विधयेक के अंगे्रजी पाठ को राजपत्र, हिमाचल प्रदेश में प्रकाशित करने के लिए प्राधि—त कर दिया है। अतः उपरोक्त विधेयक को वर्ष 2023 के अधिनियम संख्यांक 6 के रूप में अंगे्रजी प्राधि—त पाठ सहित राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित किया जाता है।

31 मार्च, 2023 को समाप्त होने वाले वित्तीय वर्ष के लिए हिमाचल प्रदेश राज्य की संचित निधि में से सेवाओं के लिए कतिपय और धनराशियों के संदाय को प्राधिकृत करने और उनका विनियोग करने के लिए अधिनियम।

भारत गणराज्य के चौहारवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम.--इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश विनियोग अधिनियम, 2023 है। 2. हिमाचल प्रदेश राज्य की संचित निधि में से वित्तीय वर्ष 2022-2023 के लिए `1,31,41,07,22,697 की और राशि जारी करना.--हिमाचल प्रदेश राज्य की संचित निधि में से अनुसूची के तृतीय स्तम्भ में विनिर्दिष्ट से अनधिक धनराशियां, जिनका योग केवल ` 1,31,41,07,22,697 (तेरह हजार एक सौ इकतालीस करोड़, सात लाख, बाईस हजार, छः सौ सत्तानवे रुपए) हैं, संदत्त और उपयोजित की जाएं, जिनका वित्तीय वर्ष 2022-2023 की अवधि में अनुसूची के द्वितीय स्तम्भ में विनिर्दिष्ट सेवाओं और प्रयोजनों से सम्बन्धित विभिन्न प्रभारों को चुकाने के लिए उपयोग किया जाएगा।

3. विनियोग.--इस अधिनियम द्वारा हिमाचल प्रदेश राज्य की संचित निधि में से संदत्त और उपयोजित किए जाने के लिए प्राधि—त धनराशियों का इस अधिनियम की धारा 2 के अधीन विनिर्दिष्ट अवधि से सम्बन्धित अनुसूची में अभिव्यक्त सेवाओं और प्रयोजनों के लिए विनियोजन किया जाएगा।

ACT

to authorise payment and appropriation of certain further sums from and out of the

Consolidated Fund of the State of Himachal Pradesh for the services for the financial year ending

on 31st day of March, 2023.

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-fourth Year of the Republic of India as follows:—

1. Short title.—This Act may be called the Himachal Pradesh Appropriation Act, 2023.

2. Issue of a further sum of ` 1,31,41,07,22,697 out of the Consolidated Fund of the State of Himachal Pradesh for the financial year 2022-23.—From and out of the Consolidated Fund of the State of Himachal Pradesh, there may be paid and applied sums not exceeding those specified in column (3) of THE SCHEDULE amounting in the aggregate to a sum of ` 1,31,41,07,22,697 (Rupees thirteen thousand one hundred forty one crore, seven lakh, twenty two thousand, six hundred ninety seven) only towards defraying the several charges which will come in course of payment during the financial year 2022-23 in respect of the services and purposes specified in column (2) of THE SCHEDULE.

3. Appropriation.—The sums authorized to be paid and applied from and out of the Consolidated Fund of the State of Himachal Pradesh by this Act shall be further appropriated for the services and purposes expressed in THE SCHEDULE in relation to the period specified under section 2 of this Act.
