संख्याः फिन (पेन)ए(3)-1/2023.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदा शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश सिविल सेवा अंशदायी पेंशन नियम, 24—राजपत्र/2023-06-05-2023 (905)906 राजपत्र, हिमाचल प्रदेश, 06 मई 2023/16 वैशाख, 1945 2006 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः- 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सिविल सेवा अंशदायी पेंशन रूल्ज (द्वितीय संशोधन) नियम, 2023 है।

(2) ये नियम तारीख 01-04-2023 से प्रवृत्त होंगे।

2. नियम 2 का प्रतिस्थापन.--हिमाचल प्रदेश सिविल सेवा अंशदायी पेंशन नियम, 2006 (जिसे इसमें इसके पश्चात्‌ उक्त नियम कहा गया है) के नियम 2 के स्थान पर निम्नलिखित रखा जायेगा, अर्थात्‌ः- ''ये नियम हिमाचल प्रदेश सरकार के केवल उन सरकारी कर्मचारियों को लागू हाेंगे। जो तारीख 15-05-2003 से तारीख 31-03-2023 की अवधि के दौरान नियुक्त किये गये थे और जिन्होंने अंशदायी पेंशन योजना (राष्ट्रीय पेंशन प्रणाली) के अधीन जारी रखे जाने का विकल्प दिया है।'' 3. नियम 4 का संशोधन.--(1) उक्त नियमों के नियम 4 में,-

(i) उप-नियम 1 के स्थान पर निम्नलिखित रखा जायेगा, अर्थात्‌ :-

''15-05-2003 से 31-03-2023 तक की अवधि के दौरान नियुक्त सरकारी कर्मचारी जिन्होंने इन नियमों के अधीन जारी रखे जाने का विकल्प दिया है, से मासिक अंशदान संदा करना अपेक्षित होगा, जो इन नियमों के अधीन अंशदायी पेंशन योजना के मूल वेतन, महंगाई भो और प्रैक्टिसबंदी भो (NPA) (जहां कहीं लागू है) का 10% होगा; और

(ii) ''15-05-2003 को या उसके पश्चात्‌'' अंक और शब्द जहां कहीं आते हाें, के स्थान पर ''15-05-2003 से 31-03-2023 तक की अवधि के दौरान नियुक्त हुए और जिन्होंने अंशदायी पेंशन योजना (राष्ट्रीय पेंशन प्रणाली) के अधीन जारी रखे जाने हेतु विकल्प दिया है'' शब्द और अंक रखे जाएगें।''

NOTIFICATION

Shimla-2, the 4th May, 2023

No. Fin (Pen)A(3)-1/2023.— In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the following Rules, to further amend the H.P. Civil Services Contributory Pension Rules, 2006, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Civil Services Contributory Pension (Second Amendment) Rules, 2023.

(2) They shall come into force with effect from 01-04-2023.

2. Substitution of rule 2.—For rule 2 of the Himachal Pradesh Civil Services Contributory Pension Rules, 2006 (hereinafter referred to the said rules), the following shall be substituted, namely: —

"These rules shall be applicable only to those Government servants of the Government of Himachal Pradesh who were appointed during the period w.e.f. 15-05-2003 to 31-03-2023 and have opted to continue to be covered under the Contributory Pension Scheme (National Pension System)."

3. Amendment of rule 4.— (1) In rule 4 of the said rules,—

(i) for sub-rule (1), the following shall be substituted, namely:—

"The Government servants appointed during the period w.e.f. 15-05-2003 to 31-03-2023 and opted to continue to be covered under these rules shall be required to pay a monthly contribution which would be 10% of the Basic Pay, Dearness Allowance and Non-Practicing Allowance (where applicable) to the Contributory Pension Scheme (National Pension System) under these rules; and

(ii) for the words and figure 'on or after 15-05-2003', wherever occur, the words and figure 'appointed during the period 15-05-2003 to 31-03-2023 and opted to continue under Contributory Pension Scheme (National Pension System)' shall be substituted".

2. नियम 2 का प्रतिस्थापन.--(1) सैन्ट्रल सिविल सर्विसिज (पेंशन) रूल्ज, 1972 के नियम 2 के स्थान पर निम्नलिखित रखा जायेगा, अर्थात्‌ः-

"Save as otherwise provided in these rules, these rules shall apply to the Government servants appointed substantively to the civil services and posts in connection with the affairs of the State Government of Himachal Pradesh which are borne on pensionable establishments, but shall not apply to—

(a) persons in casual and daily employment;

(b) persons paid from contingencies;

(d) members of the All India Services;

(e) persons employed on contract except when the contract provides otherwise;

(f) persons whose terms and conditions of service are regulated by or under the provisions of the Constitution or any other law for the time being in force; and

(g) those Government servants appointed during the period w.e.f. 15-05-2003 to 31-03-2023 and opted to continue to be regulated under the Contributory Pension Scheme (National Pension System):

Provided that these rules shall also apply to those Government servants appointed substantively to the civil services and posts in connection with affairs of the State Government of Himachal Pradesh during the period w.e.f. 15-05-2003 to 31-03-2023 covered under Contributory Pension Scheme (National Pension System) and opted to shift to the Central Civil Services (Pension) Rules, 1972. They shall get the pensionary benefits under these rules subject to deposit of the Government contribution and dividend/return earned thereon, under the National Pension System to the State Government:

Provided further that these rules shall also apply to the Government servants who have already retired or died in harness during the period w.e.f. 15-05-2003 to 31-03-2023, if such retired Government servants or eligible family members exercise their option to get the pensionary benefits under these rules from prospective date i.e. w.e.f. 01-04-2023, subject to deposit of Government contribution and dividend/ return earned thereon under the National Pension System to the State Government."

OFFICE MEMORANDUM

Shimla-2, the 4th May, 2023

No. Fin (Pen)A(3)-1/2023.—The undersigned is directed to say that in terms of amendments made in the Central Civil Services (Pension) Rules, 1972 vide notifications No. Fin (Pen)A(3)-1/2023, dated 4th May, 2023 and the Himachal Pradesh Civil Services Contributory Pension Rules, 2006, vide notifications No. Fin (Pen)A(3)-1/2023, dated 4th May, 2023 as applicable in the Himachal Pradesh, the Government has decided to issue the following Instructions/Standard Operating Procedures, to implement the Old Pension Scheme also known as the Central Civil Services (Pension) Rules, 1972, for the existing/retired employees who are/were covered under the National Pension System:—

(i) An employee, who wishes to remain under the National Pension System, shall exercise an option, within sixty days from the date of issuance of these instructions, at Annexure-I, which shall be duly notarized and submitted to the Head of Office. Such employee(s), shall continue to be covered under the National Pension System (also known as Contributory Pension Scheme). The contributions (both employer's and employee's share) under the National Pension System, shall be deposited as per the Pension Fund Regulatory and Development Authority Regulations, till the retirement of employee(s).

(ii) The Government employees who wishes to be covered under the Central Civil Services (Pension) Rules, 1972, also known as Old Pension Scheme, shall exercise an option, within sixty days from the date of issuance of these instructions, on the prescribed format at Annexure-II. An undertaking shall also be furnished by such employees on the prescribed format at Annexure-III. The 'option' and 'undertaking' as per the Annexure-II and Annexure-III, shall be duly notarized and same will be submitted to the Head of Office.

(iii) An Option once exercised by the Government employees, either opting for the Central Civil Services (Pension) Rules, 1972 or the National Pension System shall be final and irrevocable. If an employee fails to exercise an option within the stipulated period, it shall be deemed that he/ she wishes to be continued under the National Pension System.

(iv) The employees covered under the National Pension System and opting for the Central Civil Services (Pension) Rules, 1972, also known as the Old Pension Scheme, shall also be covered under the General Provident Fund (Central Service) Rules, 1960.

(v) The State Government vide Office Memorandum No. Fin (Pen)A(3)-1/2023, dated 17-04-2023, has decided that contributions of the State Government employees (i.e. employee's and employer's share) covered under National Pension System shall be stopped w.e.f. 1st April, 2023. Now, in partial modification of the Office Memorandum dated 17-04-2023 above, it has been decided that the contributions of the State Government employees (i.e. employee's and employer's share) who opt for National Pension System (NPS) as per para-1 above, shall continue to be deposited under National Pension System (NPS). In any case, if the contribution for the month of April, 2023 of an employee, who has now opted for National Pension System (NPS), was stopped in view of OM dated 17-04-2023 above, he/she may be at liberty to deposit his/ her contribution under National Pension System(NPS). In such cases, Government share will also be deposited.

(vi) The Government Servants, who have opted for the Central Civil Services (Pension) Rules, 1972, i.e. Old Pension Scheme, shall be paid pensionary benefits under these Rules subject to deposit of Government contribution and dividend/ return earned thereon, to the State Government. The amount of the Government contribution shall be deposited under the Receipt Head "0071-Contribution & Recoveries towards pension and other retirement benefit, 01-Civil, 101-Subscriptions and Contributions, 03-Accumulated Pension Wealth in respect of National Pension System subscribers" and the amount of dividend/return earned on the Government contribution, till the date of withdrawal, shall be deposited under Receipt Head "0071-Contribution & Recoveries towards pension and other retirement benefit, 01-Civil, 101-Subscriptions and Contributions, 04-Accumulated dividend on Government Contribution of National Pension System employees converted into Old Pension Scheme."

(vii) Employees, who were covered under the National Pension System (NPS) and have already retired/died, between the period 15-05-2003 to 31-03-2023 and who fulfil the eligibility criteria under the Central Civil Services (Pension) Rules, 1972, such retired employee and eligible family member of deceased employee, shall be entitled to pension from prospective date i.e. with effect from 01-04-2023, on exercising an option for the same on the prescribed format at Annexure-II and submission of an undertaking at Annexure-III, subject to deposit of the Government contribution and dividend/return, till the date of withdrawal, to the State Government. The amount of Government contribution and dividend/return shall be deposited under the Receipt Head "0071-Contribution & Recoveries towards pension and other retirement benefit, 01-Civil, 101-Subscriptions and Contributions, 03-Accumulated Pension Wealth in respect of National Pension System Subscribers and 04-Accumulated dividend on Government Contribution of National Pension System employees converted into Old Pension Scheme."

(viii) Employees' own contribution alongwith dividend/return earned thereon, shall be retained by such employees who have opted for the Central Civil Services (Pension) Rules, 1972.

(ix) The employees covered under National Pension System and opting for the Central Civil Services (Pension) Rules, 1972 i.e. Old Pension Scheme, shall also furnish an912 राजपत्र, हिमाचल प्रदेश, 06 मई 2023/16 वैशाख, 1945 undertaking for adjustment of the Government contribution and dividend earned thereon, from the gratuity/leave encashment/GIS, if they fail to deposit such amount to the Government Account.

(x) If an employee, who has opted for Central Civil Services (Pension) Rules, 1972 i.e. Old Pension Scheme, fails to deposit Government contribution and dividend earned thereon, to the Government Account, and said amount is also not possible to be adjusted completely against the payment of gratuity/ leave encashment/GIS, then such an employee shall not be entitled to any pension under the Central Civil Services (Pension) Rules, 1972.

(xi) The Head of Department/Head of Office shall take up the pension cases of Government employees, who opted for the Old Pension System, with the Principal Accountant General (A&E), Himachal Pradesh, for authorisation after following due procedure and codal formalitiesunder the CCS (Pension) Rules, 1972.

(xii) The procedure to regulate the benefits under the CCS (Pension) Rules, 1972, and the General Provident Fund (Central Service) Rules, 1960, shall be same as applicable to the employees appointed on or before 14-05-2003 and these rules will be followed mutatis-mutandis for the employees appointed on or after 15-05-2003 and have opted for the CCS (Pension) Rules, 1972 i.e. Old Pension Scheme, with the conditions as mentioned above.

(xiii) Before sending the pension cases to the Principal Accountant General (A&E) Himachal Pradesh for authorisation, the Head of Department/Head of Office, shall ensure that the amount of the Government contribution and dividend/return earned thereon, under the National Pension System, till the date of withdrawal, are deposited in the Government account. A Certificate to this effect shall be recorded in the service book of the Government servant by the concerned authority as under:

"It is certified that the amount of Government contribution and dividend earned

thereon, under the National Pension System, till the date of withdrawal, has been

deposited in the Government Receipt Head "0071- Contribution & Recoveries towards

Pension and other Retirement Benefit 01-Civil, 101-Subscriptions and Contributions,

03-Accumulated Pension Wealth in respect of National Pension System Subscribers

and 04-Accumulated dividend on Government Contribution of National Pension

System employees converted into Old Pension Scheme, as on the date of submission of

pension case to the Pr.AG(A&E) H.P."

That I will be entitled for the benefit under CCS (Pension) Rules, 1972 (OPS) only after depositing the Government Contribution alongwith dividend/return earned till the date of withdrawal on such contribution, in the Government Treasury. And whereas all the results have been declared by the concerned Returning Officers and election process has been completed.

Therefore, the State Election Commission in exercise of the powers vested in it under Article 243K & 243ZA of the Constitution of India read with Section 9 of the Himachal Pradesh Municipal Corporation Act, 1994, Section 281 of Himachal Pradesh Municipal Act, 1994 and Section 160 of the Himachal Pradesh Panchayati Raj Act, 1994, hereby lifts the Model Code of Conduct.

Zomkyi d/o Late Thapkay, r/o Home No. 18, Upper TCV School Dharamshala Cant, Dal Lake, Tehsil Dharamshala, District Kangra (H.P.) ने इस अदालत में शपथ-पत्र सहित मुकद्दमा दायर किया है कि उसका Zomkyi d/o Late Thapkay का जन्म दिनांक 21-08-1998 को हुआ है परन्तु एम0 सी0 धर्मशाला/ग्राम पंचायत में जन्म पंजीकृत न है। अतः इसे पंजीकृत किये जाने के आदेश दिये जायें। इस इश्तहार राजपत्र के द्वारा समस्त जनता को तथा सम्बन्धित सम्बन्धियों को सूचित किया जाता है कि यदि किसी को उपरोक्त Zomkyi के जन्म पंजीकृत किये जाने बारे कोई एतराज हो तो वह हमारी अदालत में दिनांक 23-05-2023 को असालतन या वकालतन हाजिर होकर अपना एतराज पेश कर सकता है अन्यथा मुताबिक शपथ-पत्र जन्म तिथि पंजीकृत किये जाने बारे आदेश पारित कर दिये जायेंगे। उसके बाद कोई भी उजर/एतराज काबिले समायत न होगा।
