संख्याः फिन(सी)बी(7)1/2017.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश राज्य को लागू सेंट्रल सिविल सर्विसिज (लीव) रूल्ज, 1972 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैंं, अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम सेंट्रल सिविल सर्विसिज (लीव) हिमाचल प्रदेश संशोधित नियम, 2022 है।

(2) ये नियम राजपत्र (ई-गज़ट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. रूल 43-बी का अन्तःस्थापन.--हिमाचल प्रदेश राज्य को लागू सेंट्रल सिविल सर्विसिज (लीव) रूल्स, 1972, में रूल 43-एए के पश्चात्‌ निम्नलिखित रूल 43-बी का अन्तःस्थापन किया जाएगा, अर्थात्‌ :--1353 राजपत्र, हिमाचल प्रदेश, 26 मई 2023/05 ज्येष्ठ, 1945 "(1) A female Government servant, with fewer than two surviving children, on valid adoption of a child below the age of one year may be granted child adoption leave, by an authority competent to grant leave, for a period of 180 days immediately after the date of valid adoption.

(2) During the period of child adoption leave, she shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.

(3) (a) Child adoption leave may be combined with leave of any other kind.

(b) In continuation of the child adoption leave granted under sub-rule (1), a female Government servant on valid adoption of a child may also be granted, if applied for, leave of the kind due and admissible (including leave not due and commuted leave not exceeding 60 days without production of medical certificate) for a period up to one year reduced by the age of the adopted child on the date of valid adoption, without taking into account child adoption leave:

Provided that this facility shall not be admissible in case she is already having two surviving children at the time of adoption.

(4) Child adoption leave shall not be debited against the leave account.

Note.—"Child" for the purpose of this rule will include a child taken as ward by the Government servant, under the Guardians and Wards Act, 1890 or the personal law applicable to that Government servant, provided such a ward lives with the Government servant and is treated as a member of the family and provided such Government servant has, through a special will, conferred upon that ward the same status as that of a natural born child.".

FINANCE (REGULATIONS) DEPARTMENT

NOTIFICATION

Shimla-2, the 10th Oct., 2022

No. Fin (C) B (7)1/2017.—In exercise of powers conferred by proviso to Article 309 of the Constitution of India, the Governor of Himachal Pradesh is pleased to make the following rules further to amend the Central Civil Services (Leave) Rules, 1972, in their application to the State of Himachal Pradesh, namely :—

1. Short title and commencement.—(1) These rules may be called the Central Civil Services (Leave) Himachal Pradesh Amendment Rules, 2022.

(2) They shall come into force from the date of their publication in Rajpatra (e-Gazette), Himachal Pradesh.

2. Insertion of rule 43-B.—In the Central Civil Services (Leave) Rules, 1972, in their application to State of Himachal Pradesh, after rule 43-AA rule 43-B shall be inserted, namely:—

"(1) A female Government servant, with fewer than two surviving children, on valid adoption of a child below the age of one year may be granted child adoption leave, by an authority competent to grant leave, for a period of 180 days immediately after the date of valid adoption.

(2) During the period of child adoption leave, she shall be paid leave salary equal to the pay drawn immediately before proceeding on leave.

(3) (a) Child adoption leave may be combined with leave of any other kind.

2. नियम 71 का प्रतिस्थापन.--सप्लिमेंटरी रूल्ज (जिन्हें इसमें इसके पश्चात्‌ ''उक्त नियम'' कहा गया है) में जहां "eight kilometers" शब्द आते हैं के स्थान पर "thirty kilometers" शब्द रखे जाएंगे। 3. नियम 89 का प्रतिस्थापन.--उक्त नियमों के नियम 89 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

"A competent Authority may, by general or special order, permit any Government servant or class of Government servants to draw the actual cost of hiring a conveyance on a journey for which no travelling allowance is admissible under these rules.

Note.—Reimbursement to Government servants of the cost of hiring conveyance on journey within a radius of 30 kilometers, for which no travelling allowance is admissible under these rules, is regulated as per the instructions issued by the Government from time to time".

4. नियम 114 का प्रतिस्थापन.--उक्त नियमों के नियम 114 में निम्नलिखित परन्तुक अन्तः स्थापित किया जाएगा, अर्थात्‌ :--

"Provided further that Travelling allowance may also not be drawn under this section by a Government servant if he is transferred in the public interest but within the radius of thirty kilometers from the duty point (i.e. the place/ office of employment) at his headquarters or return to it from a similar point".

1. Short title and commencement.—(1) These rules may be called the Supplementary Himachal Pradesh Amendment Rules, 2023.

(2) They shall come into force from the date of their publication in Rajpatra (e-Gazette), Himachal Pradesh.

2. Substitution of rule 71.—For rule 71 of the Supplementary Rules (hereinafter referred to as "said rules"), for the words "eight kilometers", wherever occurring the word "thirty kilometers", shall be substituted.

3. Substitution of rule 89.—For rule 89 of the said Rules, the following shall be substituted, namely:—

"A competent Authority may, by general or special order, permit any Government servant or class of Government servants to draw the actual cost of hiring a conveyance on a journey for which no travelling allowance is admissible under these rules.

2. नियम 5 का संशोधन.--सैंट्रल सिविल सर्विसिज (ज्वाइनिंग टाइम) रूल्ज, 1979 में उप-नियम (4) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

"In cases involving transfer from one station to another and also change of residence, the Government servant shall be allowed joining time with reference to the distance between the old and the new headquarters by direct route and ordinary mode (s) of travel as indicated1357 राजपत्र, हिमाचल प्रदेश, 26 मई 2023/05 ज्येष्ठ, 1945 in the following schedule. When holiday (s) follow(s) joining time, the normal time may be deemed to have been extended to cover such holiday (s).

And whereas, they have also stated that they were not aware of the laws for the registration of marriage with the registrar of marriage and now, therefore, necessary order for the registration of their marriage be passed, so that their marriage could be registered by the concerned authority.

Now, therefore, objections are invited from the general public that if, anyone has may objection regarding the registration of marriage of above named applicants, they should appear before the undersigned in my court on or before 31-05-2023 at 2.00 P.M. either personally or through their authorised agent/pleader.

In the event of their failure to do so, orders shall be passed ex-parte for the registration of marriage without affording any further opportunity of being heard.

श्रीमती कौशल्या देवी सुपुत्री टिटलु पुत्र लाभा विधवा धनी राम, निवासी वार्ड नं0 7, गांव कडारल भरवाना, तहसील बैजनाथ, जिला कांगड़ा (हि0प्र0) ने एक आवेदन-पत्र मय शपथ-पत्र दिनांक 16-03-2022 को इस आशय के साथ गुजारा है कि उसका नाम ग्राम पंचायत व अन्य दस्तावेजों में कौशल्या देवी पुत्री टिटलु दर्ज है जो उसका सही नाम है। परन्तु राजस्व रिकार्ड में गलती से कौशल्या देवी के स्थान पर लक्ष्मी देवी सुपुत्री टिटलु ही दर्ज हुआ है। अब राजस्व रिकार्ड में कौशल्या देवी सुपुत्री टिटुू दर्ज करवाना चाहती हैं। अतः इस इश्तहार द्वारा सर्वसाधारण जनता व हितबद्ध व्यक्तियों को सूचित किया जाता है कि उक्त नाम को दुरुस्त करने बारे किसी भी व्यक्ति को कोई भी आपाि हो तो वह दिनांक 31-05-2023 या इससे पूर्व अधेहस्ताक्षरी के समक्ष असालतन या वकालतन उपस्थित होकर अपनी आपाि दर्ज कर सकता है। इसके पश्चात्‌ कोई भी एतराज काबिले समायत नहीं होगा तथा आवेदन-पत्र पर नियामनुसार कार्यवाही अमल में लाई जाएगी।
