संख्याः टी0सी0पी0-ए (3)-5/2019-लूज.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 87 द्वारा प्रदत्त शक्तियों का प्रयोग 46—राजपत्र/2023-03-06-2023 (1969) 1970 राजपत्र, हिमाचल प्रदेश, 03 जून 2023/13 ज्येष्ठ, 1945 करते हुए, इस विभाग की अधिसूचना संख्याः टी0सी0पी0-ए (3)-1/2014, तारीख 1 दिसम्बर, 2014 द्वारा अधिसूचित और तारीख 1 दिसम्बर, 2014 को राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 का और संशोधन करने का प्रस्ताव करते हैं, और इन्हें जनसाधारण की जानकारी के लिए राजपत्र (ई-गजट) हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

इन प्रारूप नियमों से संभाव्य प्रभावित होने वाले यदि हितबद्ध व्यक्ति को इन प्रारुप नियमों की बाबत, कोई आक्षेप या सुझाव है/हैं तो वह उक्त प्रारूप नियमों के राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर प्रधान सचिव (नगर एवं ग्राम योजना) हिमाचल प्रदेश सरकार, शिमला को लिखित आक्षेप या सुझाव भेज सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप या सुझाव, यदि कोई हो/हों, पर राज्य सरकार द्वारा इन प्रारुप नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ः-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगर और ग्राम योजना (नौवां संशोधन) नियम, 2023 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 16 का संशोधन.--हिमाचल प्रदेश नगर एवं ग्राम योजना नियम 2014 (जिसे इसमें इसके पश्चात्‌ ''उक्त नियम'' कहा गया है) के नियम 16 के उप-नियम (2) के पश्चात्‌ उप-नियम (3) जोड़ा जाएगा, अर्थातः--

''(3) (क) आवासीय एटिक की दशा में 16(2) के अधीन उन मामलों, जिनका प्रीमियम एफ.ए.आर. 0.25 तक अन्तर्वलित है, हेतु संदेय फीस के अतिरिक्त निम्नलिखित फीस भी उद्‌गृहीत की जाएगी :-

(ख) संपदा परियोजनाओं सहित, आवासीय उपयोग से अन्यथा उपयोग के लिए दरें उपरोक्त दरों से 1.6 गुणा अधिक होंगी।

3. परिशिष्ट-1 का संशोधन.--''उक्त नियमों'' से संलग्न परिशिष्ट-1 की क्रम संख्या III के साधारण विनियमों में, विनियम 22 के स्थान पर निम्नलिखित रखा जाएगा, अर्थातः-

"22. एटिक और आधारकः

(i) हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 के वैधानिक उपबन्धों के अधीन अधिसूचित किसी योजना या विशेष क्षेत्र की बाबत यथा लागू तत्‌समय प्रवृत किसी विकास योजना/अन्तरिम विकास योजना के साधारण विनियमों के अधीन किसी बात के अंतर्विष्ट होते हुए भी, आवासीय उपयोग के लिए एटिक अनुज्ञेय होगा। आवासीय एटिक हेतु प्रीमियम एफ.ए़.आर. 0.25 अनुज्ञेय होगा जिसके लिए नियम 16(3) के अधीन यथानिहित अतिरिक्त फीस संदेय होगी। तथापि, एटिक, यथा स्थिति, विकास योजना/अन्तरिम विकास योजना के ऐसे विनियमों के अधीन यथा उपबन्धित भवन की अधिकतम अनुज्ञेय ऊंचाई के अन्तर्गत होगा।1971 राजपत्र, हिमाचल प्रदेश, 03 जून 2023/13 ज्येष्ठ, 1944 (ii) जहां कहीं आवासीय एटिक प्रस्तावित किया गया है ढलान वाली छत की ऊंचाई किनारों से 0 से 0.75 मीटर तक भिन्न हो सकेगी और केन्द्र में रिज की ऊंचाई भवन की अधिकतम अनुज्ञेय ऊंचाई के अध्यधीन सुनम्य (फ्लैक्सिबल) होगी।

(iii) आवासीय एटिक की दशा में केवल 2.1 मीटर की स्पष्ट ऊंचाई वाला क्षेत्र ही एफ.ए.आर.

के हेतु गिना जाएगा।

(iv) आवासीय एटीक का विकल्प निवासिया और अन्य उपयोगों के लिए उपलब्ध होगा। प्रत्येक ब्लॉक में आवासीय एटीक हेतु पृथक फीस प्रभार्य होगी।

(v) आवासीय आधारक को एक स्वतंत्र मंजिल के रूप में गिना जाएगा।''

4. परिशिष्ट-8 का संशोधन.--उक्त नियमों से संलग्न परिशिष्ट-8 की क्रम संख्या 5 'अन्य अनिवार्यताएं' में, विनियमन (ii) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात :-

''(ii) एटीक और आधारकः

(क) हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 के वैधानिक उपबन्धों के अधीन अधिसूचित किसी योजना या विशेष क्षेत्र की बाबत यथा लागू तत्‌समय प्रवृत किसी विकास योजना/अन्तरिम विकास योजना के साधारण विनियमों के अधीन किसी बात के अंतर्विष्ट होते हुए भी, आवासीय उपयोग के लिए एटिक अनुज्ञेय होगा। आवासीय एटिक हेतु प्रीमियम एफ.ए़.आऱ. 0.25 अनुज्ञेय होगा जिसके लिए नियम 16(3) के अधीन यथानिहित अतिरिक्त फीस संदेय होगी। तथापि, एटिक, यथा स्थिति, विकास योजना/अन्तरिम विकास योजना के ऐसे विनियमों के अधीन यथा उपबन्धित भवन की अधिकतम अनुज्ञेय उंचाई के अन्र्तगत होगा।

(ख) जहां कहीं आवासीय एटिक प्रस्तावित किया गया है ढलान वाली छत की ऊंचाई किनारों से 0 से 0.75 मीटर तक भिन्न हो सकेगी ओर केन्द्र में रिज की ऊंचाई भवन की अधिकतम अनुज्ञेय ऊंचाई के अध्यधीन सुनम्य (फ्लैक्सिबल) होगी।

(ग) आवासीय एटिक की दशा में केवल 2.1 मीटर की स्पष्ट ऊंचाई वाला क्षेत्र ही एफ.ए.आर.

के हेतु गिना जाएगा।

(घ) आवासीय एटिक का विकल्प निवासिया और अन्य उपयोगों के लिए उपलब्ध होगा। प्रत्येक ब्लॉक में आवासीय एटिक हेतु पृथक फीस प्रभार्य होगी।

NOTIFICATION

Shimla, the 31st May, 2023

No. TCP-A(3)-5/2019-loose.—In exercise of the powers conferred by section 87 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Town and Country Planning Rules, 2014 notified vide this Department Notification No. TCP-A(3)- 1/2014, dated 1st December, 2014 and published in Rajpatra (e-Gazette) Himachal Pradesh on 1st December, 2014 and the same are hereby published in the Rajpatra (e-Gazette) Himachal Pradesh for the information of the general public;

If any person, likely to be affected by these draft rules has any objection(s) or suggestion(s) against these draft rules, he/she may send the written objections or suggestions to the Principal Secretary (TCP) to the Government of Himachal Pradesh, Shimla within a period of thirty days from the date of publication of the said draft rules in the Rajpatra (e- Gazette), Himachal Pradesh;

Objections or suggestions, if any, received within the above stipulated period shall be taken into consideration by the State Government, before finalizing these draft rules, namely :—

1. Short title and Commencement.—(1) These rules may be called the Himachal Pradesh Town and Country Planning (Ninth Amendment) Rules, 2023.

(2) They shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of rule 16.—In rule 16 of the Himachal Pradesh Town and Country Planning Rules, 2014 (hereinafter referred to as the 'said rules') after sub-rule (2), sub-rule (3), shall be added namely:—

"(3) (a) In case of habitable attic, the following fee shall also be levied apart from fees payable under rule 16(2) for cases which involve premium F.A.R. upto 0.25 :—

(b) The rates for uses other than Residential Use including Real Estate Projects will be 1.6 times of above rates."

3. Amendment of Appendix-1.—In Appendix-1 appended to the 'said rules', in serial number III, General Regulations, for regulation 22 the following shall be substituted, namely :—

(i) Notwithstanding anything contained under the general regulations of any Development Plan/Interim Development Plan for the time being in force, as applicable in respect of any planning or special area notified under the statutory provisions of the Himachal Pradesh Town & Country Planning Act, 1977, the attic shall be permissible for habitable use. Premium F.A.R. of 0.25 shall be permissible for habitable attic for which additional fee as prescribed under rule 16(3) shall be payable. However, the attic shall be within the maximum permissible height of the building as provided under such regulations of Development Plan/Interim Development Plan as the case may be.

(ii) Wherever habitable attic is proposed, height of sloping roof at eaves may vary from 0 to 0.75 M and maximum height of ridge at centre shall be flexible subject to maximum permissible height of the building.

(iii) In case of habitable attic only the area with clear height of 2.1 meters shall be counted towards F.A.R.

(iv) The option of habitable attic shall be available for Residential and all other uses.

Separate fee will be chargeable for habitable attic in each block.

(v) The habitable basement shall be counted as independent storey."

4. Amendment of Appendix-8.—In Appendix-8 appended to the 'said rules', in serial number 5 Other Imperatives, for regulation (ii), the following shall be substituted, namely :—

"(ii) Attic and Basement:

(a) Notwithstanding anything contained under the general regulations of any Development Plan/Interim Development Plan for the time being in force, as applicable in respect of any planning or special area notified under the statutory provisions of the Himachal Pradesh Town & Country Planning Act, 1977, the attic shall be permissible for habitable use. No. EXN-F(10)-5/2023.—In exercise of the powers conferred by sub-rule (4) of rule 48 of the Himachal Pradesh Goods and Services Tax Rules, 2017, the Governor of Himachal Pradesh, on the recommendation of the GST Council, is pleased to make the following further amendment in the notification No. 13/2020-State Tax, dated the 23rd June, 2020, published in the Gazette of Himachal Pradesh, vide number EXN-F(10)-4/2017-Loose dated the 24th June, 2020, namely:– In the said notification, in the first paragraph, with effect from the 1st day of August, 2023, for the words "ten crore rupees", the words "five crore rupees" shall be substituted.

ई.एक्स.एन.-एफ.(10)-5/2023.--हिमाचल प्रदेश माल और सेवा कर अधिनियम, 2017 (2017 का 10), की धारा 9 की उप धारा (1), उप धारा (3) और उप धारा (4), धारा 11 की उप धारा (1), धारा 15 की उप धारा (5), धारा 16 की उप धारा (1) और धारा 148 के तहत प्रदत्त शक्तियों का प्रयोग करते हुए, राज्यपाल, हिमाचल प्रदेश, इस बात से संतुष्ट होते हुए कि ऐसा करना जनहित में आवश्यक है और जीएसटी परिषद्‌ की सिफारिशों के आधार पर, एतद्‌द्वारा, हिमाचल प्रदेश सरकार, की अधिसूचना संख्या 11/2017- राज्य कर (दर), दिनांक 30 जून, 2017, जिसे ई-राजपत्र, हिमाचल प्रदेश में संख्या ई.एक्स.एन.-एफ. (10)-14/2017-लूज दिनांक 30 जून, 2017, के तहत प्रकाशित की गई थी, में और आगे भी निम्नलिखित संशोधन करते हैं, यथाः-

उक्त अधिसूचना में, सारणी में, क्रम संख्या 9 के समक्ष, मद (iii), उप मद (ख) में, कॉलम (5) की प्रविष्टि के अंतर्गत, शर्त (2) में, दूसरे परन्तुक के पश्चात्‌, निम्नलिखित परन्तुकों को अंतःस्थापित किया जाएगा, यथाः-

''बशर्तें और भी कि वित्तीय वर्ष 2023-2024 के लिए यह विकल्प 31 मई, 2023 को या उसके पहले तक अपनाया जा सकेगाः

बशर्तें और भी कि यदि कोई जीटीए, किसी वित्तीय वर्ष के दौरान नया व्यापार शुरू करता है या उस वर्ष में निर्धारित पंजीकरण की थ्रेशोल्ड सीमा को पार करता है तो वह उस वित्तीय वर्ष के दौरान1979 राजपत्र, हिमाचल प्रदेश, 03 जून 2023/13 ज्येष्ठ, 1944 आपूर्ति की गई सेवाआें पर जीएसटी का स्वयं भुगतान करने के विकल्प का प्रयोग जीएसटी पंजीकरण के आवेदन किए जाने की तारीख से पैंतालीस दिन पूरे हो जाने के पहले या ऐसे पंजीकरण के हो जाने की तारीख से एक माह की अवधि पूर्ण हो जाने के पहले, दोनों में जो भी बाद में हो, अनुबंध V में इस प्रकार की घोषणा करके कर सकता है।''।

NOTIFICATION No. 5/2023-State Tax (Rate)

Shimla-2, the 2nd June, 2023

No. EXN-F(10)-5/2023.—In exercise of the powers conferred by sub-section (1), sub- section (3) and sub-section (4) of section 9, sub-section (1) of section 11, sub-section (5) of section 15, sub-section (1) of section 16 and section 148 of the Himachal Pradesh Goods and Services Tax Act, 2017 (10 of 2017), the Governor of Himachal Pradesh, being satisfied that it is necessary in the public interest so to do, on the recommendations of the GST Council, is pleased to make the following further amendments in the notification of the Government of Himachal Pradesh No. 11/2017-State Tax (Rate), dated the 30th June, 2017, published in the e-Gazette of Himachal Pradesh, vide number EXN-F(10)-14/2017-Loose dated the 30th June, 2017, namely:—

In the said notification, in the Table, against serial number 9, in item (iii), in sub- item (b), in the entries under column (5), in condition (2), after the second proviso, the following provisos shall be inserted, namely:—

"Provided also that the option for the Financial Year 2023-2024 shall be exercised on or before the 31st May, 2023:

Provided also that a GTA who commences new business or crosses threshold for registration during any Financial Year, may exercise the option to itself pay GST on the services supplied by it during that Financial Year by making a declaration in Annexure V before the expiry of forty-five days from the date of applying for GST registration or one month from the date of obtaining registration whichever is later.".

संख्याः फिन(सी)ए(3)-3/2023.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, जनरल प्रोविडैंट फंड (सेन्ट्रल सर्विसिज) रूल्ज, 1960 का हिमाचल प्रदेश राज्य में इनके लागू होने पर, और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम जनरल प्रोविडैंट फण्ड (सैन्ट्रल सर्विसिज) हिमाचल प्रदेश अमैंडमेंट रूल्स, 2023 है।

(2) ये नियम राजपत्र (ई-गज़ट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 4 का अन्तःस्थापन.--जनरल प्रोविडेंट फंड (सैन्ट्रल सर्विसिज) रूल्ज, 1960 के रूल 4 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :--

"4. Conditions of eligibility.—All temporary Government servants after a continuous service of one year and all permanent Government servants shall subscribe to the Fund:

Provided that a Government servant appointed during the period between 15-05-2003 and 31-03-2023 and who has opted to continue under the contributory Pension Scheme (National Pension System), shall not be eligible to subscribe to the Fund:

Provided further that a temporary Government servant, who is born on an establishment or factory to which the provisions of Employees' Provident Funds Scheme, 1952, framed under the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952), would apply or would have applied but for the exemption granted under Section 17 of the said Act, shall subscribe to the General Provident Fund if he has completed six months' continuous service or has actually worked for not less than 120 days during a period of six months or less in such establishment or factory or in any other establishment or factory to which the said Act applies, under the same employer or partly in one and partly in the other.

EXPLANATION.—For the purposes of this rule "continuous service" shall have the same meaning assigned to it in the Employees' Provident Funds Scheme, 1952, and the period of work for 120 days shall be computed in the manner specified in the said scheme and shall be certified by the employer.

NOTE-1.—Apprentices and Probationers shall be treated as temporary Government servants for the purpose of this rule.

NOTE-2.—A temporary Government servant who completes one year of continuous service during the middle of a month shall subscribe to the Fund from the subsequent month.

NOTE-3.—Temporary Government Servants (including Apprentices and Probationers) who have been appointed against regular vacancies and are likely to continue for more than a year may subscribe to the General Provident Fund any time before completion of one year's service.".

Shimla-2, the 2nd June, 2023

No. Fin(C)A(3)-3/2023.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, is pleased to make the following rules further to amend the General Provident Fund (Central services) Rules, 1960, in their application to the State of Himachal Pradesh, namely:—

1. Short title and Commencement.—(1) These rules may be called the General Provident Fund (Central services), Himachal Pradesh Amendment Rules, 2023.

(2) These rules shall come into force from the date of their publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Substitution of rule 4.—For rule 4 of the General Provident Fund (Central services) Rules, 1960, the following rule shall be substituted, namely:-

"4. Conditions of eligibility- All temporary Government servants after a continuous service of one year and all permanent Government servants shall subscribe to the Fund:

No. IT-(F)010/19/2021-IT-BRANCH HP Sectt.—Whereas, the use of Aadhar as an identity document for delivery of services or benefits or subsidies simplifies the Government delivery processes, brings in transparency and efficiency, and enables beneficiaries to get their entitlements directly in a convenient and seamless manner by obviating the need to produce multiple documents to prove one's identity;

And whereas, the Department of Information Technology (hereinafter referred to as the Department), is administering the various services mentioned in 'Annexure- I' (hereinafter referred to as the service) to provide various services of different departments to citizens through online mode, which is being implemented by the relevant department through the Department of Information Technology (hereinafter referred to as the Implementing Agency);

And whereas, the different services (hereinafter referred to as the benefit) are given to the citizens of the State (hereinafter referred to as the beneficiaries), by the Implementing Agency as per the guideline of the Services;

And whereas multifaceted benefits under various social welfare schemes implemented by different departments of the State, such as Women and Child Development Department, Empowerment of SC's, OBC's Minorities and Specially Abled (ESOMSA), Agriculture and Horticulture Departments, etc are being provided through the portal along with provision of essential certificates used for determining the eligibility for various social welfare schemes, the list of services is attached herewith as 'Annexure- I';

And whereas, the schemes involves recurring expenditure incurred from the Consolidated Fund of State of Himachal Pradesh;

Now, therefore, in pursuance of section 7 of the Aadhar (Targeted Delivery of Financial and Other Subsidies, Benefits and Services) Act, 2016 (18 of 2016) (hereinafter referred to as the said Act), the Government of Himachal Pradesh hereby notifies the following, namely:—

1. (1) An individual desirous of availing the benefit under the Scheme shall hereby be required to furnish proof of possession of the Aadhaar number or undergo Aadhar authentication.

(2) Any individual desirous of availing the benefit under the Scheme, who does not possess the Aadhar number or, has not yet enrolled for Aadhar, shall be required to make application for Aadhar enrolment subject to the consent of his parents or guardians (in case of child beneficiaries), before registering for the scheme, provided that he is entitled to obtain Aadhar as per section 3 of the said Act and such children shall visit any Aadhar enrolment centre (list available at the Unique Identification Authority of India (UIDAI) website www.uidai.gov.in) to get enrolled for Aadhar.

(3) As per regulation 12 of the Aadhar (Enrolment and Update) Regulations, 2016, the Department through its Implementing Agency, is required to offer Aadhar enrolment facilities for the beneficiaries who are not yet enrolled for Aadhar and in case there is no Aadhar enrolment centre located in the respective Block or Taluka or Tehsil, the Department through its Implementing Agency shall provide Aadhar enrolment facilities at convenient locations in coordination with the existing Registrars of UIDAI or by becoming a UIDAI Registrar themselves:

Provided that till the time Aadhar is assigned to the individual, the benefit under the Scheme shall be given to such individuals subject to production of the following documents, namely:—

I. For children below 18 years of age

(a) if the child has been enrolled after attaining the age of five years (with biometrics collection), his Aadhar Enrolment Identification slip, or bio-metric update identification slip; and

(b) any one of the following documents, namely:—

(i) Birth Certificate; or Record of birth issued by the appropriate authority; or (ii) School identity card, duly signed by the Principal of the school, containing parents' names; and

(c) any one of the following documents as proof of relationship of the beneficiary with the parent or legal guardian as per the extant Scheme guidelines, namely:–

(i) Birth Certificate; or Record of birth issued by the appropriate authority; or (ii) Ration Card; or

(iii) Ex-Servicemen Contributory Health Scheme (ECHS) Card; or Employees' State Insurance Corporation (ESIC) Card; or Central Government Health Scheme (CGHS) Card; or

(iv) Pension Card; or1984 राजपत्र, हिमाचल प्रदेश, 03 जून 2023/13 ज्येष्ठ, 1945 (v) Army Canteen Card; or (vi) any Government Family Entitlement Card; or

(vii) any other document as specified by the Department:

II. For beneficiaries above 18 years of age:

(a) if he has enrolled, his Aadhar Enrolment Identification slip; and

(b) any one of the following documents, namely :—

(i) Bank or Post Office Passbook with Photo; or

(ii) Permanent Account Number (PAN) Card; or

(iii) Passport; or

(iv) Ration Card; or

(v) Voter Identity Card; or

(vi) MGNREGA Card; or

(vii) Kisan Photo Passbook; or

(viii) Driving license issued by the Licensing Authority under the Motor Vehicles Act, 1988 (59 of 1988); or

(ix) Certificate of identity having photo of such person issued by a Gazetted Officer or a Tehsildar on an official letter head; or

(x) any other document as specified by the Department:

Provided further that the above documents shall be checked by an officer specifically designated by the Department for that purpose.

2. In order to provide benefits to the beneficiaries under the Scheme conveniently, the Department through its Implementing Agency shall make all the required arrangements to ensure that wide publicity through media is given to the beneficiaries to make them aware of the requirement of Aadhar under the Scheme.

3. In all cases, where Aadhar authentication fails due to poor biometrics of the beneficiaries or due to any other reason, the following remedial mechanisms shall be adopted, namely:—

(a) in case of poor fingerprint quality, iris scan or face authentication facility shall be adopted for authentication, thereby the Department through its Implementing Agency shall make provisions for iris scanners or face authentication along with finger-print authentication for delivery of benefits in seamless manner;

(b) in case the biometric authentication through fingerprints or iris scan or face authentication is not successful, wherever feasible and admissible authentication by1985 राजपत्र, हिमाचल प्रदेश, 03 जून 2023/13 ज्येष्ठ, 1944 Aadhar One Time Password or Time-based One-Time Password with limited time validity, as the case may be, shall be offered;

(c) in all other cases where biometric or Aadhar One Time Password or Time-based One- Time Password authentication is not possible, benefits under the scheme may be given on the basis of physical Aadhar letter whose authenticity can be verified through the Quick Response code printed on the Aadhar letter and the necessary arrangement of Quick Response code reader shall be provided at the convenient locations by the Department through its Implementing Agency.

4. Notwithstanding anything contained herein above, no child shall be denied benefit under the Scheme in case of failure to establish his identity by undergoing authentication, or furnishing proof of possession of Aadhar number, or in the case of a child to whom no Aadhar number has been assigned, producing an application for enrolment. The benefit shall be given to him by verifying his identity on the basis of other documents as mentioned in clauses I.(b) and I.(c) of the proviso of sub-paragraph (3) of paragraph 1, and where benefit is given on the basis of such other documents, a separate register shall be maintained to record the same, which shall be reviewed and audited periodically by the Department through its Implementing Agency.

5. In order to ensure that no bonafide beneficiary (other than children) under the Scheme is deprived of his due benefits, the concerned Department in the State Governments and Union Territory Administrations shall follow the exception handling mechanism as specified in the Office Memorandum of Direct Benefit Transfer Mission, Cabinet Secretariat, Government of India no. D- 26011/04/2017-DBT, dated the 19th December, 2017 (available on https://dbtbharat.gov.in/).

6. This notification shall come into effect on the date of its publication in the Rajpatra (e-Gazette), Himachal Pradesh.
