अधिसूचना

नस्ति संख्याः एएचवाई-डी(4)-3/2021.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश गौवंश संरक्षण और संवर्धन अधिनियम, 2018 (2019 का अधिनियम संख्यांक 2) की धारा 24 द्वारा प्रदत्त शक्तियों का 56—राजपत्र/2023-16-06-2023 (2205) 2206 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1945 प्रयोग करते हुए, उक्त अधिनियम के प्रयोजनों को कार्यान्वित करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(i) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश गौवंश संरक्षण और संवर्धन नियम, 2023 है।

(ii) ये नियम राजपत्र, ई-गजट हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगें। 2. परिभाषाएं.--(1) इन नियमों में, जब तक कि संदर्भ में अन्यथा अपेक्षित न हो,--

(क) ''अधिनियम'' से, हिमाचल प्रदेश गौवंश संरक्षण और संवर्धन अधिनियम, 2018 (2019 का अधिनियम संख्यांक 2) अभिप्रेत है;

(ख) ''भत्ते'' से, राज्य सरकार द्वारा यथाविहित चिकित्सा भत्ता, यात्रा भत्ता, दैनिक भत्ता और कोई अन्य भत्ता अभिप्रेत है;

(ग) ''निदेशक'' से, निदेशक पशुपालन, हिमाचल प्रदेश अभिपे्रत है;

(घ) ''फीस'' से, अधिनियम की धारा 13 की उप-धारा (1) के अधीन संस्था के रजिस्ट्रीकरण के लिए रजिस्ट्रीकरण फीस या इन नियमों के नियम 7 के अधीन वसूल फीस अभिप्रेत है;

(ङ) ''प्ररूप'' से, इन नियमों से संलग्न प्ररूप अभिप्रेत है;

(च) ''नोडल अधिकारी'' से, पशुपालन विभाग का सहायक निदेशक से अन्यून का अधिकारी जो सदस्य सचिव के निमित्त कार्य करने को नियुक्त किया गया हो और जो आयोग के आहरण और संवितरण अधिकारी के कर्त्तव्यों का भी पालन करेगा अभिप्रेत है;

(छ) ''विशेष आमंत्रिति'' से, आयोग के क्रियाकलापों तथा बैठकों में भाग लेने हेतु हकदार विशेष नामनिर्देशिती अभिप्रेत है;

2. उन शब्दों और पदों के, जो इन नियमों में प्रयुक्त हैं, किन्तु परिभाषित नहीं हैं, के वही अर्थ होंगे जो क्रमशः उनके अधिनियम में हैं।

3. अर्हता और प्रक्रिया.--गैर-सरकारी सदस्य हिमाचल प्रदेश के निवासी, जो आवारा पशुओं के पुनर्वास और पशुओं की भारतीय नस्ल के जर्म प्लास्म के संरक्षण के लिए असाधारण कार्य कर रहे हैं, होंगे। सदस्यों को सरकार द्वारा अधिसूचना के माध्यम से नामनिर्दिष्ट किया जाएगा।

4. गैर-सरकारी सदस्यों के निबन्धन और शर्तें.--गैर-सरकारी सदस्यों को कोई वेतन या मानदेय संदाय नहीं किया जाएगा, तथापि, राज्य सरकार के वर्ग-I अधिकारियों को यथा लागू भत्ते का संदाय किया जाएगा।

5. उपाध्यक्ष और सदस्यों का वेतन, मानदेय और भत्ते.--आयोग के उपाध्यक्ष को अन्य प्रसुविधाओं जैसे आवास, व्यक्तिगत कर्मचारीवृन्द (स्टाफ) और यान के अलावा, जैसा राज्य सरकार के वित्त विभाग द्वारा समय-समय पर शासित है, के अतिरिक्त आयोग की निधि से वेतन और भत्ता संदत्त किया जाएगा। 6. अधिकारियों और कर्मचारियों की सेवा के निबन्धन और शर्तें.--(1) पशुपालन विभाग से आंतरीकरण के माध्यम से आयोग में प्रतिनियुक्त अधिकारियों और कर्मचारियों का वेतन विभाग में रिक्त पदों के विरूद्ध, यदि संभव हो लगातार आहरित किया जा सकेगा, अन्यथा उसे आयोग की निधि से आहरित किया जा सकेगा यदि ऐसी रिक्तियां और पद विभाग में विद्यमान नहीं है।2207 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1944 (2) आयोग में प्रतिनियुक्त अधिकारियों और कर्मचारियों का वेतन आयोग की निधि से आहरित किया जाएगा। ऐसे पदों की दशा में जिनकी हिमाचल प्रदेश सरकार के विभिन्न विभागों, आयोगों, बोर्डों, निगमों, संघों आदि में कोई अन्य नाम पद्धति हो सकेगी और समरूप पदों का समतुल्य वेतनमान होगा।

(3) चिकित्सा, यात्रा और दैनिक भत्ते या कोई अन्य भत्ता सरकार के मानदण्डों के अनुसार संदत्त किया जाएगा।

7. संस्था का रजिस्टी्रकरण और उनके लेखों की संपरीक्षा.--(1) आयोग गौवंश के संरक्षण, संवर्धन और कल्याण में अन्तर्वलित निम्नलिखित संस्थानों को फीस के रूप में आयोग को 500 रुपये को संदाय करके रजिस्टर करेगा, अर्थात्‌ः--

(i) गौसदन.--परित्यक्त, आवारा और दुर्बल पशुओं को सहारा प्रदान करने, चारा देने और उपचार प्रदान करने वाली संस्थाओं को गौसदन के रूप में रजिस्ट्री—त किया जाएगा।

(ii) गौ शरणालय और गौ अभ्यारण्य.--तारबन्धित बड़ा क्षेत्र, इस तरह से विकसित किया गया हो कि जिसमें पशुओं को सहारास्थलों के साथ कुछ खुला चरने की जगह भी उपलब्ध हो, को ही गौ शरणालय या गौ अभ्यारण्य के रूप में रजिस्ट्री—त किया जाएगा;

(iii) गौशालाएं.--गाय की स्वदेशी नस्लों के विकास एवं संरक्षण के लिए कार्यरत संस्थाओं को गौशालाओं के रूप में रजिस्ट्री—त किया जाएगा;

(iv) गौ विज्ञान केन्द्र.--संस्था, जो गौ उत्पादों एवं पर अनुसंधान करती है या गाय से सम्बन्धित उत्पादों का विनिर्माण करती है, को गौ विज्ञान केन्द्रों के रूप में रजिस्ट्री—त किया जाएगा;

(v) कोई अन्य ऐसी संस्था, किसी भी नाम से जानी जाने वाली जिसे आयोग अधिनियम के प्रयोजन को कार्यान्वित करने के उद्देश्य से अनुकरणीय कार्य करने के रूप में मानता है;

(vi) संस्थान इन नियमों से संलग्न उपाबन्ध I, II, III और IV के अनुसार रजिस्ट्रीकरण के लिए आयोग को आवेदन करेगा;

(vii) हिमाचल प्रदेश गौवंश संवर्धन बोर्ड के साथ रजिस्ट्रीकरण समस्त संस्थान स्वतः हिमाचल प्रदेश गौसेवा आयोग के साथ रजिस्ट्री—त होंगे। उनका रजिस्ट्रीकरण साधारणतः आयोग को अंतरित किया जाएगा :--

(1) आयोग रजिस्ट्री—त संस्था को एक प्रमाण-पत्र जारी करेगा। आयोग पहले से विद्यमान ऐसे गौसदनों/गौशालाओं या गौ विज्ञान केन्द्रों आदि को अनंतिम रजिस्ट्रीकरण प्रमाण-पत्र जारी करेगा जिनकी भूमि की प्रास्थिति स्पष्ट नहीं है इस प्रकार की संस्थाओं को उक्त भूमि के पशुपालन विभाग के नाम पर अंतरित होने के पश्चात्‌ ही रजिस्ट्रीकरण प्रमाण-पत्र जारी किया जाएगा।

(2) आयोग रजिस्ट्री—त संस्थाओं को उपाबन्ध-V के अनुसार प्रमाण-पत्र जारी करेगा (3) आयोग उपाबन्ध-VI के अनुसार संस्थाओं का एक रजिस्टर अनुरक्षित करेगा

(4) आयोग संबंधित जिला कार्यालयों को रजिस्ट्री—त संस्थाओं, जो किसी सक्षम प्राधिकारी के माध्यम से आयोग से वित्तीय सहायता प्राप्त करती है के लेखों की संपरीक्षा करवाने के लिए निर्देश जारी करेगा।

8. आयोग की शक्तियां और —त्य.--(1) उपाबन्ध, VII और VIII पर संस्था द्वारा यथा आवेदित संस्थानों का, जब कभी समय-समय पर अनुमोदित स्कीम के अनुसार अपेक्षित हो, रजिस्ट्रीकरण करने, निरीक्षण करने और सहायता उपलब्ध करवाएगा। 2208 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1945 (2) आयोग सरकार की सहमति से ऐसे अधिकारियों जैसे यह आवश्यक समझे, को अपने कर्मचारियों के रूप में या तो सेंकडमेंट के आधार पर या भर्ती द्वारा नियुक्त कर सकेगा।

(3) यह अधिनियम के प्रयोजनों को पूरा करने के लिए विभिन्न विभागों द्वारा प्रत्याशित कार्यों की सिफारिश करेगा।

(4) यह गुणागण के आधार पर प्राप्त वित्तीय सहायता के प्रस्तावों का परीक्षण करेगा तथा उस पर अनुमोदन प्रदान करेगा जिसमें गाय की देशी नस्लों के संरक्षण के लिए परियोजनाओं के अतिरिक्त गौसदनों, गौशालाओं, गौ शरणालयों, नंदीशालाओं गौ विज्ञान केन्द्र तथा गौ उत्पाद इकाइयों की स्थापना करने तथा उनको चलाने के लिए प्रस्ताव भी सम्मिलित होंगे।

(5) यह सरकार के वित्तीय नियमों के अनुसार अधिनियम के उपबन्धों के अनुसार गाय के कल्याण के प्रयोजनों हेतु अनुदान प्राप्त करेगा तथा दान (चैरिटी) आबंटित करेगा। यह अधिनियम के प्रयोजनों को कार्यान्वित करने हेतु ऐसे व्यय करने हेतु ऐसे व्यय जैसे यह आवश्यक समझे, भी उपगत करेगा।

(6) यह समय-समय पर ऐसी स्कीम जैसी यह आवश्यक समझे विरचित और अधिसूचित करेगा 9. आयोग का बजट.--आयोग प्रत्येक वर्ष 20 मार्च से पूर्व आगामी वित्तीय वर्ष का बजट तैयार करेगा।

NOTIFICATION

Shimla-2, the 6th May, 2023

File No. AHY-D(4)-3/2021.—In exercise of the powers conferred by Section 24 of the Himachal Pradesh Gauvansh Sanrakshan and Samvardhan Act, 2018 (Act No. 2 of 2019), the Governor, Himachal Pradesh is pleased to make the following rules for carrying out the purposes of the said Act, namely:—

1. Short title and commencement.—(i) These rules may be called "the Himachal Pradesh Gauvansh Sanrakshan and Samvardhan Rules, 2023".

(ii) These rules shall come into force from the date of its publication in the Rajpatra (e- Gazette) Himachal Pradesh.

(a) "Act" means the Himachal Pradesh Gauvansh Sanrakshan and Samvardhan Act, 2018 (Act No. 2 of 2019);

(b) "Allowances" means medical allowance, travelling allowance, daily allowance and any other allowance as prescribed by the state Government;

(c) "Director" means Director of Animal Husbandry, Himachal Pradesh;

(d) "fees" means registration fee for registration of Institution under sub-section (1) of Section 13 of the Act or fee realized under rule 7 of these rules;

(e) "Form" means the forms appended to these rules;

(f) "Nodal Officer" means an officer from the Department of Animal Husbandry, not below the rank of Assistant Director, appointed to function on behalf of Member Secretary and shall perform the duties of DDO of the Aayog ;

(g) "Special Invitee" means a special nominee entitled to participate in the activities and meetings of the Aayog.

(2) The words and expressions used in these rules, but not defined, shall have the same meaning as respectively assigned to them in the Act.

3. Qualification and Procedure.—The non-official members will be a resident of Himachal Pradesh who is doing extra ordinary work for rehabilitation of stray cattle and conservation of Germ Plasm of Indian breeds of cattle. The members will be nominated by the Government through notification.

4. Terms and Conditions of Non-official Members.—The non-official members shall not be paid any salary or honorarium, however allowances shall be paid as applicable to Class-I officers of the State Government.

5. Salary, honorarium and allowances of the Vice-Chairperson.—The Vice- Chairperson of the Aayog shall be paid salary and allowances besides other facilities like residence, personal staff and vehicle, as governed by the norms notified by the Finance Department of the State Government, from time to time, from the funds of the Aayog.

6. Terms and conditions of service of officers and employees.—(1) The salaries of the officers and employees deputed to the Aayog through internalization from the Department of Animal Husbandry may continue to be drawn against vacant posts in the Department if possible; otherwise they may be drawn from the funds of the Aayog, if such vacancies and posts do not exist within the Department.

(2) The salaries of the officers and employees deputed to the Aayog shall be drawn from the funds of the Aayog. In case of posts which may be called by any other nomenclature in various Departments, Commissions, Boards, Corporations, Federations, etc. in the Government of Himachal Pradesh and are similarly situated posts shall draw equivalent salary.

(3) Allowances like medical, travelling and daily allowances or any other allowance shall be paid as per the Government norms.

7. Registration of Institution and audit of their accounts.—(1). The Aayog shall register the following institutions involved in protection, conservation and welfare of the Gauvansh by paying Rs. 500/- to the Aayog as fees, namely:—

(i) Gausadans.—Institutions providing shelter, food and treatment to the abandoned, stray and infirm cattle shall be registered as Gausadans.

(ii) Cow Sanctuaries and Gau Abhyaranaya.—A large fenced area developed in such a manner that the cattle have ample open grazing spaces with few shelters, shall be registered as cow sanctuary or Gau Abhyaranya.

(iii) Gaushalas.—Institutions working for the development and conservation of indigenous breeds of cow shall be registered as Gaushalas.

(iv) Gau Vigyan Kendras.—An institute that conducts research on cow products or manufactures cow related products shall be registered as GauVigyan Kendra.

(v) Any other such institution by whatever name it may be called, that the Aayog considers as doing exemplary work towards the objectives to carry out the purpose of the Act.

(vi) The institutions shall apply to the Aayog for registration as per Annexure-I, II, III and IV annexed to these rules.

(vii) All institutions registered with the Himachal Pradesh Govansh Samvardhan Board shall automatically be registered with the Himachal Pradesh Gauseva Aayog. Their registration shall simply be transferred to the Aayog.

(2) The Aayog shall issue a Certificate to the registered Institution. The Aayog shall issue the Provisional Registration Certificate to already existing Gosadans/ Gaushalas, Cow sanctuaries and GauVigyan Kendras etc. whose land status is not clear. These types of institutions will be issued Registration Certificate once the said land is transferred in the name of Animal Husbandry Department.

(3) The Aayog shall issue registered institutions a Certificate as per Annexure-V.

(4) The Aayog shall maintain a Register of Institutions as per Annexure-VI.

(5) The Aayog shall issue directions to the respective Districts offices to get the audit done of the accounts of registered institutions that gets the financial assistance from the Aayog through any competent authority.

(6) It shall register, inspect and provide assistance to the Institutions as and when required as per the schemes approved from time to time, as applied by the institution on Annexure-VII & VIII. 8. Powers and Functions of the Aayog.—(1) It shall register, inspect and provide assistance to the Institutions as and when required as per the schemes approved from time to time, as applied by the institutions on Annexure- VII & VIII.

(2) The Aayog with the concurrence of the Government may appoint such officers as its employees as it deems necessary either on secondment or on recruitment basis.

(3) It shall recommend anticipated actions by various departments to fulfill the purpose of the Act.

(4) It shall examine and grant approval to the proposals for financial assistance received on the basis of the merit. This shall include proposals for establishing and running of Gausadans, Gaushalas, Cow Sanctuaries, Nandi Shalas, Gau Vigyan Kendras and Cow product units, besides projects for the conservation of indigenous breeds of cow.

(5) It shall receive and allocate grants and charitie for the purpose of welfare of cow as per the provisions of the Act in accordance with the financial rules of the Government. It shall also incur such expenditure as is deemed necessary to carry out the purposes of the Act.

(6) It shall formulate and notified schemes from time to time, as is deemed necessary.

9. Budget of the Aayog.—The Aayog shall prepare the budget of the next financial year before 20th of March every year.

(II) संविदा पर नियुक्त कर्मचारी (कर्मचारियों) के लिए उपलब्धियाँः स्तम्भ संख्याः 15-क में दिए गए ब्यौरे के अनुसार रु0 25,800/-प्रतिमाह

5. चयन पद अथवा अचयन पद.--अचयन 2232 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1945 6. सीधी भर्ती के लिए आयु.--18 से 45 वर्ष :

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित, पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगीः परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो तो वह उसकी ऐसी तदर्थ या संविदा पर की गई नियुक्ति के कारण विहित आयु में शिथिलीकरण का पात्र नहीं होगाः

परन्तु यह और कि ऊपरी आयु सीमा में, अनुसूचित जातियों/अनुसूचित जन जातियों/अन्य पिछड़ा वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिए, उस विस्तार तक शिथिलीकरण किया जायगा जितना कि हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों) के अधीन अनुज्ञेय हैः

परन्तु यह और भी कि समस्त पब्लिक सैक्टर, निगमों तथा स्वायत निकायों के कर्मचारियों को, जो ऐसे पब्लिक सैक्टर निगमों/स्वायत निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सैक्टर, निगमों/स्वायत निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती के लिए आयु सीमा में ऐसी ही रियायत अनुज्ञात की जाएगी जैसी सरकारी कर्मचारियों को अनुज्ञेय है, ऐसी रियासत, तथापि पब्लिक सेक्टर, निगमों/स्वायत निकायों के ऐसे कर्मचारिवृन्द को अनुज्ञेय नहीं होगी जो तत्पश्चात्‌ ऐसे निगमों/स्वायत निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर निगमों/स्वायत निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमों/स्वायत निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/किए गए थे।

टिप्पण.--सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी जिसमें कि पद (पदों) को आवेदन आमन्त्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

7. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएं.-- (क) अनिवार्य अर्हता(एं).-- (i) किसी मान्यता प्राप्त विश्वविद्यालय से समाजशास्त्र या मनोविज्ञान या अपराधिकी या समाजिक कार्य में से एक विषयों में स्नातक।

(ख) वांछनीय अर्हता(एं)ः हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता।

8. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्ति (व्यक्तियों) की दशा में लागू होगी या नहीं.-- आयु : लागू नहीं।

शैक्षिक अर्हता(एं) : जैसी स्तम्भ संख्या 11 के नीचे विहित है।

9. परिवीक्षा की अवधि, यदि कोई हो.--(क) सीधी भर्ती। दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणों को लिखित में अभिलिखित करके आदेश दें।

(ख) संविदा के आधार पर नियुक्ति पर, कोई परिवीक्षा नहीं होगी।

10. भर्ती की पद्धति-भर्ती सीधी होगी या प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--(I) पचास प्रतिशत प्रोन्नति द्वारा।

(II) पचास प्रतिशत महिला अभ्यर्थियों में से सीधी भर्तीे द्वारा, यथास्थिति, नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा।

11. प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति/ सैकण्डमैण्ट/स्थानान्तरण किया जाएगा.--सहायक अधीक्षक (गृह) में से प्रोन्नति द्वारा जो मान्यता प्राप्त 1022233 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1944 की अर्हता रखता हो और जिनका तीन वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके तीन वर्ष का नियमित सेवाकाल होः

अधीक्षक (गृह) के पदों को भरने के लिए निम्नलिखित दो बिन्दु पद आधारित रोस्टर का अनुसरण किया जाएगाः-

टिप्पण.--रोस्टर, प्रत्येक दूसरे बिन्दू के पश्चात्‌ तब तक दोहराया जाता रहेगा जब तक की समस्त प्रवर्गों को दी गई प्रतिशतता तक प्रतिनिधित्व प्राप्त नहीं हो जाता। तत्पश्चात्‌ रिक्ति को उसी प्रवर्ग में से भरा जाएगा, जिससे पद रिक्त हुआ होः

(1) परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/कठिन/दुर्गम क्षे़त्र्ाों और दूरस्थ/ग्रामीण क्षे़त्र्ाों में पद (पदों) की ऐसे क्षे़त्र्ाों में पर्याप्त संख्या की उपलब्धता के अध्यधीन कम से कम एक कार्यकाल तक सेवा करनी होगीः

परन्तु उपर्युक्त परन्तुक (1) उन कर्मचारियों के मामले में लागू नहीं होगा जिनकी अधिवर्षिता के लिए पांच वर्ष या उससे कम की सेवा शेष रही हो तथापि ऐसे पदधारियों को उनकी प्रोन्नति में दूरस्थ/ग्रामीण क्षेत्र्ा में तैनात/स्थानांतरित किया जा सकता है।

परन्तु यह और भी कि उन अधिकारियों/कर्मचारियों को, जिन्होंने जनजातीय/कठिन/दुर्गम क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके अपने संवर्ग (काडर) में सर्वथा वरिष्ठता के अनुसार स्थानान्तरण किया जाएगा।

स्पष्टीकरण-(I).--उपरोक्त परन्तुक (1) के लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रो में "कार्यकाल"ं से प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी।

स्पष्टीकरण-(II).--उपरोक्त परन्तुक (I) के प्रयोजन के लिए जनजातीय/कठिन क्षेत्र निम्न प्रकार से होंगेः--

1. जिला लाहौल एवं स्पीति

2. चम्बा जिला का पांगी और भरमौर उप-मण्डल

3. रोहडू उप-मण्डल का डोडरा क्वार क्षेत्र

4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनिश दरकाली और काशापाट 5. कुल्लू जिला का पन्द्रह बीस परगना

6. कांगड़ा जिला के बैजनाथ उप-मण्डल का बड़ा भंगाल क्षेत्र

7. जिला किन्नौर

8. सिरमौर जिला में उप-तहसील कमरउ के काठवाड़ और कोरगा पटवार वृत्त, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृत्त और शिलाई तहसील का कोटा पाब पटवार वृत्त। 2234 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1945 9. मण्डी जिला में करसोग तहसील का खन्योल-बगड़ा पटवार वृत्त, बाली चौकी उप-तहसील के गाडा गोसाईं, मठयानी, घनयाड़, थाची, बागी, सोमगाड़ और खोलानाल पटवार वृत्त, पद्धर तहसील के झारवाड़, कुटगढ़, ग्रामन, देवगढ़ टै्रला, रोपा, कथोग, सिल्ह-भड़वानी, हस्तपुर, घमरेड़ और भटेढ़ पटवार वृत्त, थुनाग तहसील के चियूणी, कालीपार, मानगढ़, थाच-बगड़ा उत्तरी मगरू और दक्षिणी मगरू पटवार वृत्त और सुन्दरनगर, तहसील का बटवाड़ा वृत्त।

स्पष्टीकरण-III.--उपरोक्त परन्तुक (1) के प्रयोजन के लिए दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगेः-

(i) उप-मण्डल/तहसील मुख्यालय से बीस किलोमीटर की परिधि से परे के समस्त स्थान (ii) राज्य मुख्यालय और जिला मुख्यालय से पन्द्रह किलोमीटर की परिधि से अधिक की पैदल यात्रा करनी पड़ती है।

(iii) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना, अपने गृहनगर या गृहनगर क्षेत्र के साथ लगता बीस किलोमीटर की परिधि के भीतर का क्षेत्र।

(2) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व, सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्न्ति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्न्ति नियमों के उपबन्धों के अनुसार चयन की स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः

(i) परन्तु उन सभी मामलों में जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहां उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः परन्तु यह और भी कि जहां कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहां उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जांएगे।

स्पष्टीकरण.--अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जो आपातकाल की अवधि के दौरान सशस्त्र बलों में भर्ती हुए हैं और जिसे डिमोबिलाइज्ड आमर्ड फोर्सिज परसोनल (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(ii) इसी प्रकार स्थायीकरण के सभी मामलों में ऐसे पद पर नियमित नियुक्ति से पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः परन्तु की गई तदर्थ सेवा को गणना में लेने के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरूप पारस्परिक वरीयता अपरिवर्तित रहेगी।2235 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1944 12. यदि विभागीय प्रोन्नति समिति विद्यमान हो तो उसकी संरचना.--विभागीय प्रोन्नति समितिः जैसी सरकार द्वारा समय-समय पर गठित की जाए।

13. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

14. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन, साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग या भर्ती अभिकरण/प्राधिकरण ऐसा करना आवश्यक या समीचीन समझे तो साक्षात्कार/ व्यक्तित्व परीक्षण से पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या व्यवहारिक परीक्षण या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा।

इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएंगीः-

15-क संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन :

(I) संकल्पना.--(क) इस पॉलिसी के अधीन हिमाचल प्रदेश सामाजिक न्याय एवं अधिकारिता विभाग में अधीक्षक (गृह) को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण उस वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी। (ख) पद का हिमाचल प्रदेश कर्मचारी चयन आयोग के कार्यक्षेत्र में आनाः निदेशक महिला एवं बाल विकास रिक्त पदों को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ अध्यपेक्षा को सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग, के समक्ष रखेगा।

(ग) चयन इन नियमों में विहित पात्रता शर्तों के अनुसार किया जाएगा।

(II) संविदात्मक उपलब्धियां.--संविदा के आधार पर नियुक्त अधीक्षक (गृह) को रु0 25,800/- की दर से समेकित नियत संविदात्मक रकम जो हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के पे मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ठ का साठ प्रतिशत के बराबर प्रतिमाह संदत की जाएगी। (III) नियुक्ति/अनुशासन प्राधिकारी.--निदेशक, महिला एवं बाल विकास विभाग, हिमाचल प्रदेश नियुक्ति और अनुशासन प्राधिकारी होगा।

(IV) चयन प्रक्रिया.--संविदा नियुक्ति के मामले में पद पर नियुक्ति के लिए चयन, साक्षात्कार/व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि ऐसा करना आवश्यक या समीचीन समझे तो साक्षात्कार/व्यक्तित्व परीक्षण से पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या लिखित परीक्षा या व्यवहारिक परीक्षण या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा अवधारित किया जाएगा।

(V) संविदात्मक नियुक्तियों के लिए चयन समिति.--जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा समय-समय पर गठित की जाए। 2236 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1945 (VI) करार.--अभ्यर्थी को चयन के पश्चात्‌ इन नियमों से संलग्न उपाबन्ध-"ख" के अनुसार करार हस्ताक्षरित करना होगा।

(VII) निबन्धन और शर्ते.--(क) स्ांविदा पर नियुक्त व्यक्ति को रु0 25,800/- की दर से नियत संविदात्मक रकम जो हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के पे मैट्रिक के लागू लेवल (स्तर) के प्रथम कोष्ठ का साठ प्रतिशत के बराबर (होगा) प्रतिमाह संदन्त्त की जाएगी।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से संतुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत्त की गई है, से पैंतालीस दिन के भीतर अपील प्राधिकारी, जो नियुक्ति प्राधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सकेगा। (ग) स्ांविदा पर नियुक्त व्यक्ति, एक कलैण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत सरकारी चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीें होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगा। अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कत्र्तव्य से अनधि—त अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों तो उसके नियमितिकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, किन्तु पदधारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा

(ङ) संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

(च) चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। उन महिला अभ्यर्थियों की दशा में, जिन्हें परिसंकटमय स्वरूप के कर्त्तव्यों को कार्यान्वित करने वाले पदों के विरुद्ध नियुक्त किया जाना है और यदि उन्हें प्रशिक्षण की अवधि, को सेवा-शर्त के रूप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थायी रूप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रस्स्वावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थीे का प्रस्वावस्था की तारीख से छह सप्ताह के पश्चात्‌ चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा, और यदि वह उपरोक्त यथा विनिर्दिष्ट प्राधिकारी से चिकित्सा आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।2237 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1944 (छ) संविदा पर नियुक्त व्यक्ति का, यदि अपने पदीय कत्र्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों जैसे एफ0आर0-एस0आर0, छुट्‌टी नियम आदि के उपबन्ध संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा स्कीम के साथ-साथ ई.पी.एफ./जी.पी.एफ. भी लागू नहीं होगा।

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्गों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.--लागू नहीं।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (ंउपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद(पदों) की बाबत, शिथिल कर सकेगी।

2. प्रथम पक्षकार की संविदात्मक रकमाें 25,800/- की दर से समेकित किश्त संविदात्मक रकम प्रतिमाह होगी जो हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के पे मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ट का साठ प्रतिशत के बराबर होगा।

3. संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए2238 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1945 जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति नियुक्ति प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से सन्तुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत्त की गई है, से पैंतालीस दिन के भीतर अपील प्राधिकारी, जो नियुक्ति प्राधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सकेगा।

4. संविदा पर नियुक्त व्यक्ति एक कलैण्डर वर्ष में एक मास की सेवा पूरी करने के पश्चात एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में प्राधिकृत चिकित्सा अधिकारी द्वारा जारी प्रमाण-पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा। अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

5. नियन्त्रक प्राधिकारी के अनुमोदन के बिना कत्र्तव्य (डयूटी) से अनधि—त अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) को जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कर्त्तव्य से अनधि—त अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, परन्तु पदधारी को इस बाबत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

6. संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा/होगी, जहां भी प्रशासनिक आधारों पर अपेक्षित हो।

NOTIFICATION

Shimla-2, the 17th March, 2023

No. SJE-A- (3)11/2005-I.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh in consultation with the Himachal Pradesh Public Service Commission is pleased to make the Recruitment and Promotion Rules for the post of Superintendent (Home), Class-II (Non-Gazetted) in the Department of Social Justice and Empowerment, Himachal Pradesh as per Annexure-A attached to this notification, namely:—

1. Short title, commencement and application.—(1) These rules may be called the Himachal Pradesh, Social Justice & Empowerment Department, Superintendent (Home), Class-II (Non-Gazetted), Recruitment and Promotion, Rules, 2023.

(2) These rules shall come into force from the date of their publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Repeal and Savings.—(1) The Himachal Pradesh, Social Justice & Empowerment, Department Superintendent (Home) Class-II (Non-Gazetted) Recruitment and Promotion Rules, 2007 notified vide notification No. SJE-A-(3)11/2005 dated 04-03-2008 and published in the Rajpatra, Himachal Pradesh hereby repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the relevant rules, so repealed under sub-rule (1) supra shall be deemed to have been validly made or done or taken under these rules.

ANNEXURE-"A" RECRUITMENT AND PROMOTION RULES FOR THE POST OF SUPERINTENDENT (HOME) Class-II (NON-GAZETTED) IN THE DEPARTMENT OF SOCIAL JUSTICE & EMPOWERMENT, HIMACHAL PRADESH

1. Name of the post.—Superintendent (Home)

2. Number of Post(s).—06 (Six) - Out of which, at least 03 posts shall be reserved for females.

3. Classification.—Class-II (Non Gazetted)

4. Scale of Pay.—(I) Pay Scale for regular incumbents:

Pay matrix Level-12 (Rs. 43,000—1,36,000) of Himachal Pradesh Civil Services (Revised Pay) Rules, 2022.

(II) Emoluments for Contract employee(s).— ` 25,800/- as per details given in Column. No.15-A.

5. Whether Selection Post or Non-Selection Post.—Non -Selection

6. Age for direct recruitment.—18 to 45 years :

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis:

Provided further that if a candidate appointed on ad-hoc or on contract basis had become over-age on the date he was appointed as such, he shall not be eligible for any relaxation in the prescribed age-limit by virtue of his such adhoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/Other Backward Classes and Other categories of persons to the extent permissible under the general or special order(s) of the Himachal Pradesh Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to the Government Servant before absorption in Public Sector Corporations / Autonomous Bodies at the time of initial constitution of such Corporations /Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This2241 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1944 concession will not, however, be admissible to such staff of the Public Sector Corporations/ Autonomous Bodies who were/are subsequently appointed by such Corporation/Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

Note.—Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting applications or notified to the Employment Exchanges or as the case may be.

7. Minimum educational and other qualifications required for direct recruit(s).— (a) Essential Qualification(s): (i) Graduate from a recognized University with Sociology or Psychology or Criminology or Social Work as one of the subjects.

(b) Desirable Qualification(s).— Knowledge of customs, manner and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh 8. Whether age and educational qualification(s) prescribed for direct recruit(s) will apply in the case of the promotee(s).—Age : Not applicable

Educational Qualification(s): As prescribed against Column No.11 below.

9. Period of Probation, if any.—(a) Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

(b) No probation in case of appointment on contract basis.

10. Method(s) of recruitment, whether by direct recruitment or by promotion/

secondment/ transfer and the percentage of post(s) to be filled in by various methods.—(i)

50% by promotion.

(ii) 50 % by direct recruitment on a regular basis or on contract basis as per case may be, from amongst female candidates.

11. In case of recruitment by promotion/secondment/transfer, grade(s) from which promotion/ secondment/ transfer is to be made.—By promotion from amongst the Assistant Superintendents (Home) who possess recognized 10+2 qualification with 03 (three) years regular service or regular combined with continuous adhoc service, if any in the grade pay will be paid consolidate fixed amount @ ` 25,800/-PM which shall be equal to 60% (sixty percent) of the first cell of the applicable level of the Pay Matrix of H.P. Civil Services (Revised Pay) Rules, 2022, for filling up the post of Superintendent (Home) the following 2 points "Post" based rostor shall be followed:

Note.—The roster shall be rotated after every 2nd point till the representation to all categories is achieved upto the prescribed percentage. Thereafter, the vacancy will be filled up from the Category which vacates the post:

(I) Provided that for the purpose of promotion every employee shall have to serve at least one term in the Tribal/Difficult/ Hard areas and remote/rural areas subject to adequate number of post(s) available in such areas:

Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation. However, such implements may be posted/transferred to remote/rural areas in their promotion:

Provided further that Officers/Officials who have not served atleast one tenure in Tribal/ Difficult/Hard areas and remote/rural areas shall be transferred to such area strictly in accordance with his/her seniority in the respective cadre.

Explanation I.—For the purpose of proviso (I) supra the "term" in Tribal/Difficult/Hard areas/remote/rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/ convenience.

Explanation-II.—For the purpose of proviso (I) supra the Tribal/Difficult Areas shall be as under:—

2. Pangi and Bharmour Sub-Division of Chamba District

3. Dodra Kawar Area of Rohru Sub-Division

4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashapat of Rampur Tehsil of District Shimla.

6. Bara Bhangal Areas of Baijnath Sub-Division of Kangra District

7. District Kinnaur

8. Kathwar and Korga Patwar Circles of Kamrau Sub-Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil, in Sirmaur District.

9. Khanyol-Bagra Patwar Circle of Karsog Tehsil, Gada-Gussaini, Mathyani, Ghanyar, Baggi, Somgad and Kholanal of Bali-Chowki Sub-Tehsil, Jharwar, Kutgarh, Graman, Devgarh, Trailla, Ropa, Kathog, Silh-Badhwani, Hastpur, Ghamrehar and Bhatehar Patwar Circle of Padhar Tehsil, Chiuni, Kalipar, Mangarh, Thach-Bagra, North Magru and South Magru Patwar Circles of Thunag Tehsil and Batwara Patwar Circle of Sunder Nagar Tehsil in Mandi District.

Explanation-III.—For the purpose of proviso (I) supra the Remote/ Rural Areas shall be as under:

(i) All stations beyond the radius of 20 Kms. from Sub Division/Tehsil headquarter (ii) All stations beyond the radius of 15 Kms. from State Headquarter and District head quarters where bus service is not available and on foot journey is more than 3 (three) Kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the employee regardless of its category.

(II) In all cases of promotion, the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the conditions that the adhoc appointment/promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules:

(i) Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents is eligible for consideration for promotion if the senior ineligible persons happened to be Ex-servicemen who have joined Armed forces during the period of emergency and recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non- Technical Services) Rules, 1972 and having been given the benefit of seniority thereunder or recruited under the provisions of rule-3 of the Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority thereunder.

(ii) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post if any, prior to the regular appointment against such posts shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered shall remain unchanged.

12. If a Departmental Promotion Committee exists, what is its composition.—(a) Departmental Promotion Committee: "As may be constituted by the Government from time to time".

13. Circumstances under which the Himachal Pradesh Public Service Commission

(HPPSC) is to be consulted in making recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to the post by direct recruitment.—Selection for appointment to the post in the case of direct recruitment shall be made on the basis of Interview/ Personality test or if the Himachal Pradesh Public Service Commission or other recruiting agency / authority as the case may be, so consider necessary or expedient on the basis of interview/ personality test preceded by a screening test (Objective Type)/ written test, or practical test or2244 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1945 physical test the standard/ syllabus etc. of which will be determined by the Commission/ other recruiting agency/ authority as the case may be.

15-A. Selection for appointment to the post by contract appointment.— Notwithstanding anything contained in these Rules, contract appointment to the post will be made subject to the terms and conditions given below:—

(I) CONCEPT:

(a) Under this policy the Superintendent (Home) in the Department of Social Justice & Empowerment, Himachal Pradesh will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension /renewal of contract period on year to year basis the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then the period of contract is to be renewed /extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPPSC:

The, Director, Women and Child Development after obtaining the approval of the Government to fill up the vacant posts on contract basis will place the requisition with the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these rules.

(II) CONTRACTUAL EMOLUMENTS

The Superintendent (Home) appointed on contractual posts will be paid consolidate fixed amount @ `25,800/-PM which shall be equal to 60% (sixty percent) of the first cell of the applicable level of the Pay Matrix of H.P. Civil Services(Revised Pay) Rules, 2022.

(III) APPOINTING / DISCIPLINARY AUTHORITY

The Director, Women and Child Development will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS:

Selection for appointment to the post in the case of Contract appointment will be made on the basis of interview/personality test or if considered necessary or expedient on the basis of Interview/Personality test preceded by a screening test (objective type)/ written test or practical test or physical test, the standard/ syllabus etc. of which will be determined by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS:

As may be constituted by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission from time to time.

(VI) AGREEMENT:

After selection of a candidate, he/she shall sign an agreement as per Annexure-"B" appended to these rules.

(VII) TERMS AND CONDITIONS:

(a) The Conractual appointee will be paid fixed contractual amount ` 25,800/-P.M which shall be equal to 60% (sixty percent) of the first cell of the applicable level of the Pay Matrix of H.P.Civil Servics (Revised Pay) Rules, 2022.

(b) The service of contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance/ conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with the termination orders issued by the Appointing Authority, he/ she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, within a period of 45 days, from the date on which a copy of termination orders is delivered to him/ her.

(c) The contract appointee will be entitled for one day's casual leave after putting one month's service, 10 days' medical leave and 5 days special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days'. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days' (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Un-availed casual leave, medical leave and special leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year.

(d) Unauthorized absence from duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty:

Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his/her fitness issued by a Medical Board in the case of a Gazetted Government servant and by Government Medical Officer in the case of a Non-Gazetted Government servant. In case of women candidates who are to be appointed against posts carrying hazardous nature of duties, and in case they have to complete a period of training as a condition of service, such women candidate, who as a result of tests is found to be pregnant of twelve weeks'2246 राजपत्र, हिमाचल प्रदेश, 16 जून 2023/26 ज्येष्ठ, 1945 standing or more shall be declared temporarily unfit and her appointment shall be held in abeyance until the confinement is over. Such women candidate be re-examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness certificate from the authority as specified above, she may be appointed to the post kept reserved for her.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counterpart official at the minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. The Employees Group Insurance Scheme as well as EPF/GPF will also not be applicable to contract appointee(s)

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes / Other Backward Classes / Other categories of persons issued by the Himachal Pradesh Government from time to time

17. Departmental Examination.—Not applicable

18. Powers to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may by order for reasons to be recorded in writing in consultation with the Himachal Pradesh Public Service Commission relax any of provisions of these rules with respect to any class or category of persons or posts.

Mandi (H.P.) have filed an application alongwith affidavits in this court under section 16 of Special Marriage Act, 1954 (Central Act) as amended by the Marriage Laws (Amendment Act 01, 49 of 2001) that they have solemnized their marriage ceremony on 25-05-2023 at village Badehar as per Hindu Rites and Customs and they are living together as husband and wife since then. Hence their marriage may be registered under Special Marriage Act, 1954.
