No. HHC/Rules/Vol.V/97-II.—In exercise of the powers conferred by Section 23 of the State of Himachal Pradesh Act, 1970 read with Section 129 of the Code of Civil Procedure, 1908, 59—राजपत्र/2023-20-06-2023 (2307)2308 राजपत्र, हिमाचल प्रदेश, 20 जून 2023/30 ज्येष्ठ, 1945 Article 225 of the Constitution of India and all other powers enabling in this behalf, the High Court of Himachal Pradesh is pleased to make the following amendments in the "High Court of Himachal Pradesh (Appellate Side) Rules, 1997", as under:—
| S HORT TITLE | 1 | These Rules shall be called the High Court of Himachal Pradesh (Appellate Side) 13th Amendment Rules-2023. |
| COMMENCEMENT | 2 | These Rules shall come into force with immediate effect |
| AMENDMENT(S) | 3 | In the existing CHAPTER-5 "INSTITUTION OF PROCEEDINGS" after point H. "MISCELLANEOUS" of High Court of Himachal Pradesh (Appellate Side) Rules, 1997, point I. Index shall be inserted as under:— " (I) INDEX: E ach paper, as it is filed, in all Civil Appeals/Civil Revisions/Main Miscellaneous applications/Tax Appeals/Criminal Cases/Other Criminal Matters shall be page-marked and indexed as per format at Annexure-A and shall be entered in a general index and marked with the letter A or B according to the part to which it belongs. |

योगिन्दर चन्द खन्ना व देविन्दर खन्ना बनाम आम जनता सर्वसाधारण को सूचित किया जाता है कि अधोहस्ताक्षरी के समक्ष श्री देविन्दर खन्ना पुत्र श्री मगज राम, निवासी महाल चिलाला, डा0 चिलाला, तहसील चड़गांव, जिला शिमला (हि0प्र0) ने एक वसीयतनामा जो घरेलू तौर पर तैयार किया गया है बराये इन्तकाल तस्दीक हेतु प्रस्तुत किया है। वसीयतनामा के अवलोकन से पाया कि प्रार्थी के सगे भाई श्री योगेन्दर चन्द खन्ना ने अपने जीते जी दो गवाहों क्रमशः श्री महेन्दर सिंह पुत्र श्री धर्मसैन, निवासी गांव चिलाला व श्री अशोक कुमार पुत्र श्री जयलाल, निवासी गांव व डा0 चिलाला की मौजूदगी में घर में ही वसीयतनामा तैयार कर मोहाल चिलाला में इस्तादा भूमि की वसीयत प्रार्थी के पक्ष में 2326 राजपत्र, हिमाचल प्रदेश, 20 जून 2023/30 ज्येष्ठ, 1945 करने की इच्छा प्रकट की है। चूंकि अब वसीयतकर्ता फौत हो चुका है लिहाजा प्रार्थी ने नियमानुसार सम्पत्ति के इन्तकाल तस्दीक बाबत वसीयतनामा को अधोहस्ताक्षरी के समक्ष प्रस्तुत किया है। वसीयतनामा व प्रार्थी के मौखिक ब्यान से पता चला है कि वसीयतकर्ता श्री योगेन्दर चन्द खन्ना आजीवन अविवाहित रहे थे तथा उन्होंने अपने जीते जी कोई सन्तान भी गोद नहीं ली थी।
इसलिए इस इश्तहार के माध्यम से सूचित किया जाता है कि यदि किसी व्यक्ति/व्यक्तियों को उक्त वसीयत के इन्तकाल तस्दीक बारे कोई एतराज हो तो वह असालतन व वकालतन मिति 12-07-2023 को इस अदालत में आकर प्रस्तुत कर सकता है। तत्पश्चात् किसी भी व्यक्ति व व्यक्तियों का कोई एतराज स्वीकार नहीं किया जाएगा तथा वसीयतकर्ता की इच्छानुसार मोहाल चिलाला में इस्तादा भूमि व अन्य सम्पत्ति का इन्तकाल प्रार्थी श्री देविन्दर खन्ना के पक्ष में कर दिया जावेगा।

विपत राम पुत्र दुनी चन्द, निवासी गांव सनारसा, तहसील रामपुर ने जिला अदालत में अपना मकफूद-उल-खबरी पंजीकरण बारे आवेदन-पत्र गुजारा है। प्रार्थी के पुत्र राकेश जो सात आठ वर्षों से लापता है तब से लेकर आज दिन तक वापिस नहीं आया उसके पश्चात् प्रार्थी ने बहुत तलाश की परन्तु आज दिन तक कोई पता न चला है न ही उसकी कोई चिट्ठी पत्र आई है। इलाके में उनको किसी भी आदमी ने 2334 राजपत्र, हिमाचल प्रदेश, 20 जून 2023/30 ज्येष्ठ, 1945 नहीं देखा है इस सम्बन्ध में थाना रामपुर, जिला शिमला में दिनांक 08-06-2022 को जानकारी दी गई है। राकेश पिछले 8 वर्षों से लापता है व आज तक राकेश कुमार के जीवित होने की कोई सूचना नहीं मिली है। प्रार्थी का बेटा अराजी खाता खतौनी नं0 86/189, खसरा नं0 173, रकबा 0-19-50 है वाका चक सनारसा के खाना मालिक में दर्ज कागजात माल है। वादी के बेटे को लापता हुए लगभग 8 वर्ष का समय हो गया है। इसलिए वादी प्रतिवादी राकेश पुत्र विपत राम के जायज वारसान के हक में मकफूद-उल-खबरी का इन्तकाल तस्दीक करवाना चाहता है।
अतः इस इश्तहार द्वारा सर्वसाधारण को सूचित किया जाता है कि यदि श्री राकेश पुत्र विपत राम जीवित है तो अदालत हजा में दिनांक 22-06-2023 तक पेश हो तथा उपस्थित न होने की सूरत में यह माना जाएगा कि श्री राकेश पुत्र विपत राम की मृत्यु हो चुकी है। किसी व्यक्ति को राकेश प्रतिवादी मकफूद-उल-खबरी इन्तकाल जायज वारसान के हक में हाजिर आकर अपनी आपत्ति दर्ज करवा सकता है। बाद गुजरने मियाद कोई भी उजर/एतराज काबिले समायत न होगा तथा नियमानुसार मकफूद-उल-खबरी इन्तकाल जायज वारसान के हक में तस्दीक करने के आदेश पारित किए जाएंगे।

श्री हरवन्स लाल पुत्र गोहला, वासी रोड़ा, डा0 सेंसोवाल, तहसील हरोली, जिला ऊना (हि0प्र0) ने इस न्यायालय में आवेदन पत्र दुरुस्ती नाम प्रस्तुत किया है कि राजस्व रिकार्ड में प्रार्थी का नाम वौन्सा पुत्र गोहला पुत्र गुलावा गलत दर्ज किया गया है। अतः प्रार्थी का नाम वौन्सा पुत्र गोहला पुत्र गुलावा की वजाये हरवन्स लाल पुत्र गोहला, वासी रोड़ा, डा0 सैंसोवाल सही दर्ज किया जावे।
अतः सर्वसाधारण को इस इश्तहार अखवार/नोटिस मुश्त्री मुनादी के माध्यम से सूचित किया जाता है कि यदि इस बारे किसी व्यक्ति को कोई उजर/एतराज हो तो वह दिनांक 26-06-2023 को प्रातः 10.00 बजे से पहले अपना उजर लिखित या मौखिक तौर पर इस न्यायालय में निर्धारित तारीख पर पेश कर सकता है।
यदि उपरोक्त वर्णित तिथि को किसी भी व्यक्ति का कोई उजर/एतराज इस न्यायालय में प्राप्त न हुआ तो यक तरफ कार्यवाही अमल में लाई जाकर नाम दुरुस्ती बारे आदेश पारित कर दिये जाएंगे निर्धारित2335 राजपत्र, हिमाचल प्रदेश, 20 जून 2023/30 ज्येष्ठ, 1945 तारीख पेशी के उपरान्त कोई भी उजर काबिले समायत न होगा व न्यायालय द्वारा एकतरफा कार्यवाही अमल में लाई जाकर इस सन्दर्भ में फैसला सुना जाएगा।

उपरोक्त मुकद्दमा उनवान वाला में प्रार्थी हरवंस सिंह पुत्र रभल पुत्र नत्थू, वासी वालीवाल, तहसील हरोली, जिला ऊना ने प्रार्थना-पत्र प्रस्तुत करके निवेदन किया है कि उसका नाम खेबट नं0 535, 536, जमाबन्दी साल 2017-2018 वाक्या महाल रोडावालीवाल में हरवंस पुत्र रभल पुत्र नत्थू गलत चल रहा है। जबकि उसका सही नाम हरवंस सिंह पुत्र रभल पुत्र नत्थू है।
अतः सर्वसाधारण को इस इश्तहार द्वारा सूचित किया जाता है कि अगर किसी भी व्यक्ति को उक्त नाम की दुरुस्ती बारे कोई उजर/एतराज हो तो वह मुकद्दमा की पैरवी हेतु असालतन या वकालतन इस न्यायालय में दिनांक 30-06-2023 को प्रातः 10.00 बजे हाजिर आकर उजर/एतराज प्रस्तुत कर सकता है। निर्धारित तारीख पेशी तक कोई उजर/एतराज प्राप्त न होने की सूरत में एकतरफा कार्यवाही अमल में लाई जाकर मुकद्दमा का निपटारा/फैसला कर दिया जायेगा ।
