संख्या स्वास्थ्य-सी-ए(3)6/2020.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, 69—राजपत्र/2023-03-07-2023 (2601) 2602 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 हिमाचल प्रदेश स्वास्थ्य एवं परिवार कल्याण विभाग के निदेशालय, स्वास्थ्य सुरक्षा एंव विनियमन में उप-जन विश्लेषक, ग्रुप-बी के पद के लिए इस अधिसूचना से संलग्न उपाबन्ध-"क" के अनुसार भर्ती और प्रोन्नति नियम बनाती हैं, अर्थात्‌ :--

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश स्वास्थ्य एवं परिवार कल्याण विभाग के निदेशालय, स्वास्थ्य सुरक्षा एवं विनियमन, उप जन विश्लेषक, ग्रुप-बी, भर्ती और प्रोन्नति नियम, 2023 है।

(2) ये नियम राजपत्र, (ई-गजट), हिमाचल प्रदेश मेेंे प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे।

उपाबन्ध-"क" हिमाचल प्रदेश स्वास्थ्य एवं परिवार कल्याण विभाग के निदेशालय, स्वास्थ्य सुरक्षा एंव विनियम में उप-जन विश्लेषक, ग्रुप-बी के पद के लिए भर्ती और प्रोन्नति नियम

1. पद का नाम.--उप जन विश्लेषक

2. पद (पदों की संख्या).--01 (एक)

3. वर्गीकरण.--ग्रुप-बी

4. वेतनमान.--(i) नियमित पदधारी (पदधारियों) के लिए वेतनमान : हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार पद के टाइम स्केल से संलग्न पे मैट्रिक्स का लेवल (स्तर)-12.

(ii) संविदा पर नियुक्त कर्मचारी (कर्मचारियों) के लिए उपलब्धियां : हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार तत्स्थानी संवर्ग के पे मैट्रिक्स के लागू स्तर के प्रथम कोष्ठ का 60% (साठ) प्रतिशत।

5. ''चयन'' पद अथवा ''अचयन'' पद.--अचयन

6. सीधी भर्ती के लिए आयु.--18 से 45 वर्षः

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित, पहले से ही सरकार की सेवा मे रत अभ्यर्थियों को लागू नहीं होगीः परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो तो वह उसकी ऐसी तदर्थ या संविदा पर की गई नियुक्ति के कारण विहित आयु में शिथिलीकरण का पात्र नहीं होगा :

परन्तु यह और कि ऊपरी आयु सीमा में, अनुसूचित जातियों/अनुसूचित जन जातियाें/अन्य पिछड़ा वर्गों और व्यक्तियों के अन्य प्रवर्गाेंं के लिए, उस विस्तार तक शिथिलीकरण किया जाएगा जितना की हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशों )के अधीन अनुज्ञेय है :

परन्तु यह और भी कि समस्त पब्लिक सेक्टर, निगमों तथा स्वायत निकायों के कर्मचारियों को, जो ऐसे पब्लिक सेक्टर, निगमों/स्वायत निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सेक्टर, निगमों/स्वायत2603 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती के लिए आयु सीमा में ऐसी ही रियायत अनुज्ञात की जाएगी जैसी सरकारी कर्मचारियों को अनुज्ञेय है, ऐसी रियायत, तथापि पब्लिक सेक्टर, निगमों/स्वायत निकायों के ऐसे कर्मचारिवृन्द्‌ को अनुज्ञेय नहीें होगी जो तत्पश्चात्‌ ऐसे निगमों/स्वायत निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर, निगमों/स्वायत निकायों के प्रारम्भिक गठन के पश्चात्‌ ऐसे निगमों/स्वायत निकायों की सेवा में अन्तिम रूप से आमेलित किए गए हैं/ किए गए थे।

टिप्पण.--सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी, जिसमें कि पद (पदों) को आवेदन आमंत्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

7. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियो)ं के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएं ः (क) शैक्षिक अर्हता (एं) : (i) रसायन विज्ञान या जैव रसायन या डेयरी रसायन विज्ञान या खाद्य प्रौद्योगिकी या सूक्ष्म जीव विज्ञान या खाद्य और दवाओं में खाद्य विश्लेषण एक विषय के साथ विधि द्वारा भारत में स्थापित विश्वविद्यालय से स्नातकोत्तर उपाधि या रसायनज्ञ संस्थान (भारत) के सहयुक्त सम्बद्ध हो।

(ii) केन्द्रीय/राज्य सरकार द्वारा मान्यता प्राप्त किसी प्रयोगशाला/संस्थान/संगठन से खाद्य के विश्लेषण में न्यूनतम तीन वर्ष का अनुभव।

(ख) वांछनीय अर्हता : हिमाचल प्रदेश की रूढ़ियो, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता ।

8. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियो) के लिए विहित आयु और शैक्षिक अर्हता प्रोन्नत व्यक्ति (व्यक्तियाें) की दशा में लागू होंगी या नहीं.--(क) आयु : लागू नहीं।

(ख) शैक्षिक अर्हता : हां, जैसा उपरोक्त स्तम्भ संख्या 7(क) में विहित किया गया है।

9. परिवीक्षा की अवधि, यदि कोई हो.--सीधी भर्ती : (क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणो को लिखित में अभिलिखित करके आदेश दे ।

(ख) संविदा के आधार पर नियुक्ति की दशा में कोई परिवीक्षा नहीं होगी ।

2. प्रोन्नति.--लागू नहीं।

10. भर्ती की पद्धतिः भर्ती सीधी होगी या प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--शत प्रतिशत प्रोन्नति द्वारा ऐसा न होने पर सीधी भर्ती द्वारा यथास्थिति, नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा।

11. प्रोन्नति/सैकण्डमैण्ट/स्थानान्तरण द्वारा भर्ती की दशा में वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति/ सैकण्डमैण्ट/स्थानान्तरण किया जाएगा.--उपरोक्त स्तम्भ संख्या 7 (क) के सामने दिए गए सीधी भर्ती के लिए विहित शैक्षिक अर्हता रखने के अध्यधीन वरिष्ठ वैज्ञानिक (खाद्य) में से प्रोन्नति द्वारा, जिनका 3 (तीन) वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके 3 (तीन) वर्ष का नियमित सेवाकाल होः

(I) परन्तु प्रोन्नति के प्रयोजन के लिए प्रत्येक कर्मचारी को, जनजातीय/ कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में पद (पदों) की ऐसे क्षेत्रों में पर्याप्त संख्या की उपलब्धता के अध्यधीन, कम से कम एक कार्यकाल तक सेवा करनी होगीः

परन्तु उपर्युक्त परन्तुक (1) उन कर्मचारियों के मामले में लागू नहीं होगा जिनकी अधिवर्षिता के लिए पाँच वर्ष या उससे कम की सेवा शेष रही हो। तथापि ऐसे पदधारियों को, उनकी प्रोन्नति पर, दूरस्थ/ग्रामीण क्षेत्रों में तैनात/ स्थानान्तरित किया जा सकेगाः 2604 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 परन्तु यह और भी कि उन अधिकारियों/कर्मचारियों को, जिन्होंने जन जातीय/कठिन/दुर्गम क्षे़त्रों और दूरस्थ/ग्रामीण क्षेत्रों में कम से कम एक कार्यकाल तक सेवा नहीं की है, ऐसे क्षेत्र में उसके/उसकी अपने संवर्ग (काडर) में सर्वथा वरिष्ठता के अनुसार स्थानान्तरण किया जाएगा/की जाएगी।

स्पष्टीकरण-I.—उपरोक्त परन्तुक (1) के प्रयोजन के लिए जनजातीय/कठिन/दुर्गम क्षेत्रों और दूरस्थ/ग्रामीण क्षेत्रों में ''कार्यकाल'' से प्रशासनिक अत्यावश्यकताओं/सुविधा को ध्यान में रखते हुए साधारणतया तीन वर्ष की अवधि या ऐसे क्षेत्रों में तैनाती की इससे कम अवधि अभिप्रेत होगी।

स्पष्टीकरण-II.—उपरोक्त परन्तुक (I) के प्रयोजन के लिए जनजातीय/कठिन क्षेत्र निम्न प्रकार से होंगेः-

1. जिला लाहौल एवं स्पिति

2. चम्बा जिला का पाँगी और भरमौर उप-मण्डल

3. रोहडू़ उप-मण्डल का डोडरा क्वार क्षेत्र

4. जिला शिमला की रामपुर तहसील का पन्द्रह बीस परगना, मुनिश दरकाली और ग्राम पंचायत काशापाट।

5. कुल्लू जिला का पन्द्रह बीस परगना

6. कांगड़ा जिला के बैजनाथ उप मण्डल का बड़ा भंगाल क्षेत्र

7. जिला किन्नौर।

8. सिरमौर जिला में उप तहसील कमरउ के काठवाड़ और कोरगा पटवार वृत्त, रेणुकाजी तहसील के भलाड़-भलौना और सांगना पटवार वृत्त और शिलाई तहसील का कोटा पाब पटवार वृत्त। 9. मण्डी जिला में करसोग तहसील का खन्योल-बगड़ा पटवार वृत्त, बाली चौकी उप तहसील के गाडा गोसाईं, मठयानी, घनयाड़, थाची, बागी, सोमगाड़ और खोलानाल पटवार वृत्त, पद्धर तहसील के झारवाड़, कुटगढ़, ग्रामन, देवगढ़, ट्रैला, रोपा, कथोग, सिल्ह-भड़वानी, हस्तपुर, घमरेड़ और भटेढ़ पटवार वृत्त, थुनाग तहसील के चियूणी, कालीपार, मानगढ़, थाच-बगड़ा उत्तरी मगरू और दक्षिणी मगरू पटवार वृत्त और सुन्दरनगर तहसील का बटवाड़ा पटवार वृत्त। स्पष्टीकरण-III.—उपरोक्त परन्तुक (1) के प्रयोजन के लिए दूरस्थ/ग्रामीण क्षेत्र निम्न प्रकार से होंगेः-

(i) उप-मण्डल/तहसील मुख्यालय से 20 (बीस) किलोमीटर की परिधि से परे के समस्त स्थान। (ii) राज्य मुख्यालय और जिला मुख्यालय से 15 (पन्द्रह) किलोमीटर की परिधि से परे के समस्त स्थान जहाँ के लिए बस सेवा उपलब्ध नहीं है और 3 (तीन) किलोमीटर से अधिक की पैदल यात्रा करनी पड़ती है।

(iii) कर्मचारी का, उसके प्रवर्ग को ध्यान में लाए बिना, अपने गृहनगर या गृहनगर क्षेत्र के साथ लगता 20 (बीस) किलोमीटर की परिधि के भीतर का क्षेत्र।

(II) प्रोन्नति के सभी मामलों में पद पर नियमित नियुक्ति से पूर्व, सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, इन नियमों में यथाविहित सेवाकाल के लिए, इस शर्त के अध्यधीन प्रोन्नति के लिए गणना में ली जाएगी, कि सम्भरक (पोषक) प्रवर्ग में तदर्थ नियुक्ति/प्रोन्नति भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार चयन की उचित स्वीकार्य प्रक्रिया को अपनाने के पश्चात्‌ की गई थीः2605 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 परन्तु उन सभी मामलों में, जिनमें कोई कनिष्ठ व्यक्ति सम्भरक (पोषक) पद में अपने कुल सेवाकाल (तदर्थ आधार पर की गई सेवा सहित, जो नियमित सेवा/नियुक्ति के अनुसरण में हो) के आधार पर उपर्युक्त निर्दिष्ट उपबन्धों के कारण विचार किए जाने का पात्र हो जाता है, वहाँ उससे वरिष्ठ सभी व्यक्ति अपने-अपने प्रवर्ग/पद/काडर में विचार किए जाने के पात्र समझे जाएंगे और विचार करते समय कनिष्ठ व्यक्ति से ऊपर रखे जाएंगेः

परन्तु यह और कि उन सभी पदधारियों की, जिन पर प्रोन्नति के लिए विचार किया जाना है, की कम से कम तीन वर्ष की न्यूनतम अर्हता सेवा या पद के भर्ती और प्रोन्नति नियमों में विहित सेवा, जो भी कम हो, होगीः

परन्तु यह और भी कि जहाँ कोई व्यक्ति पूर्वगामी परन्तुक की अपेक्षाओं के कारण प्रोन्नति किए जाने सम्बन्धी विचार के लिए अपात्र हो जाता है, वहाँ उससे कनिष्ठ व्यक्ति भी ऐसी प्रोन्नति के विचार के लिए अपात्र समझा जाएगा/समझे जाएंगे।

स्पष्टीकरण.--अंतिम परन्तुक के अन्तर्गत कनिष्ठ पदधारी प्रोन्नति के लिए अपात्र नहीं समझा जाएगा यदि वरिष्ठ अपात्र व्यक्ति भूतपूर्व सैनिक है जो आपातकाल की अवधि के दौरान सशस्त्र बलों में भर्ती हुआ था और जिसे डिमोबीलाइज्ड आमर्ड फोर्सिज परसोेनल (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल स्टेट नॉन टैक्नीकल सर्विसीज) रूल्ज, 1972 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया है और तद्‌धीन वरीयता लाभ दिए गए हों या जिसे एक्स सर्विसमैन (रिजर्वेशन ऑफ वैकेन्सीज इन दी हिमाचल प्रदेश टैक्नीकल सर्विसीज) रूल्ज, 1985 के नियम-3 के उपबन्धों के अन्तर्गत भर्ती किया गया हो और तद्‌धीन वरीयता लाभ दिए गए हों।

(ii) इसी प्रकार स्थायीकरण के सभी मामलों मेे ऐसे पद पर नियमित नियुक्ति सें पूर्व सम्भरक (पोषक) पद पर की गई लगातार तदर्थ सेवा, यदि कोई हो, सेवाकाल के लिए गणना में ली जाएगी, यदि तदर्थ नियुक्ति/प्रोन्नति उचित चयन के पश्चात्‌ और भर्ती और प्रोन्नति नियमों के उपबन्धों के अनुसार की गई थीः

परन्तु की गई तदर्थ सेवा को गणना में लेनें के पश्चात्‌ जो स्थायीकरण होगा उसके फलस्वरुप पारस्परिक वरीयता अपरिवर्तित रहेगी ।

12. यदि विभागीय प्रोन्नति समिति/ विभागीय स्थायीकरण समिति विद्यमान हो तो उसकी संरचना.--विभागीय प्रोन्नति समिति/विभागीय स्थायीकरण समिति : जैसी सरकार द्वारा समय-समय पर गठित की जाए।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो ।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है ।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--सीधी भर्ती के मामले में पद पर नियुक्ति के लिए चयन, साक्षात्कार/व्यक्तित्व परिक्षण के आधार पर किया जाएगा या यदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग या अन्य भर्ती अभिकरण ऐसा करना आवश्यक या समीचीन समझे तो साक्षात्कार/व्यक्तित्व परीक्षण से पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या लिखित परीक्षा या व्यावहारिक परीक्षण या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/ पाठ्‌यक्रम आदि, यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा ।

15क. संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियां नीचे दिए गए निबन्धनों और शर्ताे के अध्यधीन की जाएंगी :-

2606 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 (I) संकल्पना.--(क) इस पॉलिसी के अधीन हिमाचल प्रदेश स्वास्थ्य एवं परिवार कल्याण विभाग के निदेशालय, स्वास्थ्य सुरक्षा एंव विनियमन, में उप जन विश्लेषक, को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा, जिसे वर्षानुवर्ष आधार पर आगे बढा़या जा सकेगा :

परन्तु संविदा अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा और आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी सविंदा की अवधि में नवीकृत/विस्तारित की जाएगी।

(ख) पद का हिमाचल प्रदेश लोक सेवा आयोग के कार्यक्षेत्र में आना : प्रशासनिक सचिव (स्वास्थ्य), हिमाचल प्रदेश सरकार पद को संविदा के आधार पर भरने के लिए सरकार का अनुमोदन प्राप्त करने के पश्चात्‌ अध्यपेक्षा को सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग के समक्ष रखेगा। (ग) चयन इन भर्ती और प्रोन्नति नियमों में विहित पात्रता शर्ताें के अनुसार किया जाएगा। (II) संविदात्मक उपलब्धियां.--संविदा के आधार पर नियुक्त उप जन विश्लेषक, को (cid:31)25800/- की समेकित नियत संविदात्मक रकम जो हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार जो तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू लेवल के प्रथम कोष्ठ का 60% (साठ) प्रतिशत होगी। प्रतिमास संदत्त की जाएगी।

(III) नियुक्ति/अनुशासन प्राधिकारी.--प्रशासनिक सचिव (स्वास्थ्य), हिमाचल प्रदेश सरकार नियुक्ति और अनुशासन प्राधिकारी होगा ।

(IV) चयन प्रक्रिया.--संविदा नियुक्ति के मामले में पद पर नियुक्ति के लिए चयन, साक्षात्कार/ व्यक्तित्व परीक्षण के आधार पर किया जाएगा या यदि ऐसा करना आवश्यक या समीचीन समझे तो साक्षात्कार/व्यक्तित्व परीक्षण से पूर्व में ली गई छंटनी परीक्षा (वस्तुनिष्ठ प्रकार की) या लिखित परीक्षा या व्यावहारिक परीक्षण या शारीरिक परीक्षण के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा अवधारित किया जाएगा।

(V) संविदात्मक नियुक्तियों के लिए चयन समिति.--जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा समय समय पर गठित की जाए ।

(VI) करार.--अभ्यर्थी को चयन के पश्चात्‌ इन नियमाें से संलग्न उपाबन्ध-'ख' के अनुसार करार हस्ताक्षरित करना होगा।

(VII) निबन्धन और शर्तें.--(क) संविदा के आधार पर नियुक्त व्यक्ति को `25800/- की समेकित नियत संविदात्मक रकम जो हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार जो तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू लेवल के प्रथम कोष्ठ का 60% (साठ) प्रतिशत होगी प्रतिमास संदत्त की जाएगी।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थाई आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति/नियुक्ति प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से संतुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत्त की गई है, से पैंतालीस दिन के भीतर अपील प्राधिकारी, जो नियुक्ति प्राधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सकेगा।

(ग) स्ांविदा पर नियुक्त व्यक्ति, एक कलैण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश2607 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 दिया जा सकेगा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत सरकारी चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर पैंतालीस दिन से अनधिक प्रसूति अवकाश (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय किसी अन्य प्रकार का कोई अवकाश अनुज्ञात नहीं होगा।

अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कलैण्डर वर्ष तक संचित किया जा सकेगा और आगामी कलैण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) नियंत्रक अधिकारी के अनुमोदन के बिना कत्र्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यावसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कत्र्तव्य से अनधिकृत अनुपस्थिति के हालात संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों तो उसके नियमितीकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, किन्तु पदधारी को इस बाबत समय पर नियन्त्रक प्राधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कत्र्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होंगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार, चिकित्सा अधिकारी द्वारा जारी किए गए बीमारी/ आरोग्य प्रमाण-पत्र को प्रस्तुत करना होगा।

(ङ) संविदा के आधार पर नियुक्त पदधारी जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधार पर ऐसा करना अपेक्षित हो।

(च) चयनित अभ्यर्थी को, राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित सरकारी कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। उन महिला अभ्यर्थियों की दशा मे, जिन्हें परिसंकटमय स्वरूप के कत्र्तव्यों को कार्यान्वित करने वाले पदों के विरूद्व नियुक्त किया जाना है और यदि उन्हें प्रशिक्षण की अवधि को सेवा-शर्त के रूप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परिक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थाई रूप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवावस्था की तारीख से छह सप्ताह के पश्चात चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा, और यदि वह उपरोक्त यथा विनिर्दिष्ट प्राधिकारी से चिकित्सा आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।

(छ) संविदा पर नियुक्त व्यक्ति का, यदि अपने पदीय कत्र्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी कि नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में यथा लागू सेवा नियमों जैसे एफ0आर0-एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम आदि के उपबन्ध संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा स्कीम के साथ-साथ ई.पी.एफ./जी.पी.एफ. भी लागू नहीं होगा।

16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा, समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/ अन्य पिछडे़ वर्गों और व्यक्तियाें के अन्य प्रवर्गों के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेेशों के अधीन होगी।

17. विभागीय परीक्षा.--लागू नहीं । 2608 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके और हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों के किसी/किन्ही उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी ।

9. संविदा पर नियुक्त व्यक्ति (व्यक्तियों) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0एफ0/जी0पी0एफ0 भी लागू नहीे होगा।

Shimla-2, the 27th June, 2023

No. Health-C-A(3)6/2020.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with Himachal Pradesh Public Service Commission, is pleased to make the Recruitment & Promotion Rules for the post of Deputy Public Analyst, Group-B in the Directorate of Health Safety and Regulation, Department of Health & Family Welfare, Himachal Pradesh, as per Annexure-"A" attached to this notification, namely :—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh, Department of Health & Family Welfare, Directorate of Health Safety and Regulation, Deputy Public Analyst, Group-B, Recruitment and Promotion Rules, 2023.

(2) These rules shall come into force from the date of their publication in Rajpatra (e-Gazette), Himachal Pradesh.

ANNEXURE-A RECRUITMENT AND PROMOTION RULES FOR THE POST OF DEPUTY PUBLIC ANALYST, GROUP-B IN THE DIRECTORATE OF HEALTH SAFETY AND REGULATION, DEPARTMENT OF HEALTH & FAMILY WELFARE, HIMACHAL PRADESH

1. Name of Post.—Deputy Public Analyst

2. Number of Post.—01 (One)

3. Classification.— Group-B

4. Scale of Pay.—(I) Pay scale for regular incumbents: Level-12 of the pay matrix attached with the time scale of the post as per HP Civil Services (Revised Pay) Rules, 2022.

(II) Emoluments for contract employee(s) : 60% of the first cell of the applicable level of Pay Matrix of the corresponding cadre, as per HP Civil Services (Revised Pay) Rules, 2022.

5. Whether "Selection" post or "Non-Selection" Post.—Non-Selection

6. Age for direct recruitment.— Between 18 to 45 years: Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis:

Provided further that if a candidate appointed on adhoc or on contract basis had become over-age on the date when he was appointed as such, he shall not be eligible for any relaxation in the prescribed age-limit by virtue of his such adhoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes /Scheduled Tribes/ Other Backward Classes and Other categories of persons to the extent permissible under the general or special order(s) of the Himachal Pradesh Government:

Provided further that the employees of all the Public Sector, Corporations and Autonomous Bodies who happened to be Government servant before absorption in Public Sector Corporations/ Autonomous Bodies at the time of initial constitution of such Corporations/ Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/ Autonomous bodies who were/are subsequently appointed by such Corporation/Autonomous Bodies and who are/were finally absorbed in the service of such Corporations/Autonomous Bodies after initial constitution of the Public Sector Corporations/ Autonomous Bodies.

Note.—Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting applications or notified to the Employment Exchanges or as the case may be.

7. Minimum Educational and other qualifications required for direct recruit(s).— Essential Qualification(s) : (i) Post Graduate Degree in Chemistry or Biochemistry or Dairy Chemistry or Food Technology or Microbiology or Food and Drugs with the Analysis of food as one of the subject from a University established in India by law or an Associate of the Institution of Chemist (India).

(ii) Minimum three years experience in the analysis of food from a Laboratory/ Institution/Organization recognized by the Central/ State Government.

(b) Desirable Qualification: Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

8. Whether age and educational qualification(s) prescribed for direct recruit(s) will

apply in the case of promotee(s).—Age : Not applicable.

Educational qualification : Yes, as prescribed against Column No.7(a) above.

9. Period of probation, if any.—1. Direct Recruitment : (a) Two years subject to such further extension for a period not exceeding one year as may be ordered by the competent authority in special circumstances and reasons to be recorded in writing.

(b) No probation in case of appointment on contract basis.

10. Method(s) of recruitment, whether by direct recruitment or by promotion/ secondment/transfer and the percentage of post(s) to be filled in by various methods.—100% by promotion failing which by direct recruitment on regular basis or by recruitment on contract basis, as the case may be.

11. In case of recruitment by promotion/secondment/transfe, grade from which promotion/ secondment/transfer is to be made.—By promotion from amongst the Sr. Scientist (Food) subject to possessing of educational qualification prescribed for direct recruitment against Column No. 7 (a) above with 03 (three) years regular service or regular combined with continuous adhoc service rendered, if any, in the grade:

Provided that for the purpose of promotion every employee shall have to serve atleast one term in the Tribal/Difficult/Hard areas and remote/rural areas subject to adequate number of post(s) available in such areas:

Provided further that the proviso (I) supra shall not be applicable in the case of those employees who have five years or less service, left for superannuation. However, such incumbent may be posted / transferred to remote/rural areas in their promotion:

Provided further that Officers/Official who has not served atleast one tenure in Tribal/ Difficult/Hard areas and remote/rural areas shall be transferred to such area strictly in accordance with his / her seniority in the respective cadre.

Explanation-I.—For the purpose of proviso (I) supra the "term" in Tribal/Difficult / Hard areas / remote / rural areas shall mean normally three years or less period of posting in such areas keeping in view the administrative exigencies/convenience.

Explanation-II.—For the purpose of proviso (I) supra the Tribal / Difficult Areas shall be as under:—

1. District Lahaul & Spiti.

2. Pangi and Bharmour Sub Division of Chamba District.

3. Dodra Kawar Area of Rohru Sub-Division.

4. Pandrah Bis Pargana, Munish Darkali and Gram Panchayat Kashapat, Gram Panchayats of Rampur Tehsil of District Shimla.

5. Pandrah Bis Pargana of Kullu District.

6. Bara Bhangal Areas of Baijnath Sub Division of Kangra District.

7. District Kinnaur.

8. Kathwar and Korga Patwar Circles of Kamrau Sub Tehsil, Bhaladh Bhalona and Sangna Patwar Circles of Renukaji Tehsil and Kota Pab Patwar Circle of Shillai Tehsil, in Sirmour District.

9. Explanation-III.—For the purpose of proviso (I) supra the Remote /Rural Areas shall be as under:

(i) All stations beyond the radius of 20 Kms. from Sub Division/Tehsil headquarter.

(ii) All stations beyond the radius of 15 Kms. from State Headquarter and District head quarters where bus service is not available and on foot journey is more than 3 (three) Kms.

(iii) Home town or area adjoining to area of home town within the radius of 20 Kms. of the employee regardless of its category.

In all cases of promotion, the continuous adhoc service rendered in the feeder post if any, prior to regular appointment to the post shall be taken into account towards the length of service as prescribed in these rules for promotion subject to the condition that the adhoc appointment / promotion in the feeder category had been made after following proper acceptable process of selection in accordance with the provisions of R & P Rules:

Provided that in all cases where a junior person becomes eligible for consideration by virtue of his total length of service (including the service rendered on adhoc basis followed by regular service/appointment) in the feeder post in view of the provisions referred to above, all persons senior to him in the respective category/post/cadre shall be deemed to be eligible for consideration and placed above the junior person in the field of consideration:

Provided that all incumbents to be considered for promotion shall possess the minimum qualifying service of at least three years or that prescribed in the Recruitment & Promotion Rules for the post, whichever is less:

Provided further that where a person becomes ineligible to be considered for promotion on account of the requirements of the preceding proviso, the person(s) junior to him shall also be deemed to be ineligible for consideration for such promotion.

Explanation.—The last proviso shall not render the junior incumbents ineligible for consideration for promotion if the senior ineligible persons happened to be Ex-servicemen who have joined armed forces during the period of emergency and recruited under the provisions of Rule-3 of Demobilized Armed Forces Personnel (Reservation of Vacancies in Himachal State Non- Technical Services) Rules, 1972 and having been given the benefit of seniority there under or recruited under the provisions of Rule-3 of the Ex-Servicemen (Reservation of vacancies in the Himachal Pradesh Technical Service) Rules, 1985 and having been given the benefit of seniority there under.

(ii) Similarly, in all cases of confirmation, continuous adhoc service rendered on the feeder post if any, prior to the regular appointment against such posts shall be taken into account towards the length of service, if the adhoc appointment/promotion had been made after proper selection and in accordance with the provision of the Recruitment & Promotion Rules:

Provided that inter-se-seniority as a result of confirmation after taking into account, adhoc service rendered shall remain unchanged.

12. If a Departmental Promotion Committee / Departmental Committee exists, what is its composition.—Departmental Promotion Committee/Departmental Confirmation Committee : As may be constituted by the Government from time to time.

13 Circumstances under which the Himachal Pradesh Public Service Commission

(H.P.P.S.C.) is to be consulted in making recruitment.—As required under the law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to the post by direct recruitment.—Selection for appointment to the post in the case of direct recruitment shall be made on the basis of Interview / Personality test or if the Himachal Pradesh Public Service Commission/other recruiting authority, as the case may be, so consider necessary or expedient on the basis of Interview / Personality test preceded by a Screening test (objective type) / Written test or Practical test or Physical Test, the standard / syllabus, etc. of which, will be determined by the Himachal Pradesh Public Service Commission / other recruiting agency / authority, as the case may be.

15-A Selection for appointment to the post by contract appointment.— Notwithstanding anything contained in these rules, contract appointment(s) to the post will be made subject to the terms and conditions given below:—

(I) CONCEPT.—(a) Under this policy the Deputy Public Analyst, in Directorate of Health & Safety Regulation, Department of Health & Family Welfare, Himachal Pradesh, will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for further extension/renewal of contract period on year to year basis the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed /extended.

(b) POST FALLS WITHIN THE PURVIEW OF HPPSC: The Administrative Secretary (Health) to the Government of H.P. after obtaining the approval of the Government to fill up the vacant post(s) on contract basis will place the requisition with the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission.

(c) The selection will be made in accordance with the eligibility conditions prescribed in these rules.

(II) CONTRACTUAL EMOLUMENTS.—The Deputy Public Analyst appointed on contract basis will be paid consolidated fixed amount @ 25,800/- P.M [which shall be equal to 60% of the first cell of the applicable level of Pay Matrix of the corresponding cadre, as per HP Civil Services (Revised Pay) Rules, 2022].

(III) APPOINTING/DISCIPLINARY AUTHORITY.—The Administrative Secretary (Health) will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS.—Selection for appointment to the post in the case of Contract Appointment will be made on the basis of Interview / Personality test or if considered necessary or expedient on the basis of Interview / Personality test preceded by a Screening test (objective type) / Written test or Practical test or Physical test, the standard / syllabus, etc. of which, will be determined by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS.— As may be constituted by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission from time to time.

(VI) AGREEMENT.—After selection of a candidate, he / she shall sign an agreement as per Annexure "B" appended to these Rules.

(VII) TERMS AND CONDITIONS.—(a) The contractual appointee will be paid consolidated fixed contractual amount @ Rs. 25,800/- P.M. [which shall be equal to 60% of the first cell of the applicable level of Pay Matrix of the corresponding cadre, as per HP Civil Services (Revised Pay) Rules, 2022].

(b) The service of the Contract Appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance / conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, with in a period of 45 days, from the date on which a copy of termination orders is delivered to him / her.

(c) The contract appointee will be entitled for one- day`s casual leave after putting one- month`s service, 10 days` medical leave and 5 days` special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Un-availed Casual Leave, Medical Leave and Special Leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year.

(d) Unauthorized absence from the duty without the approval of the controlling officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his / her control on medical grounds, such period shall not be excluded while considering his / her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty:

Provided that he / she shall submit the certificate of illness / fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his / her fitness issued by a Medical Board in the case of a Gazetted Government servant and by Government Medical Officer in the case of a Non-Gazetted Government Servant. In case of women candidates who are to be appointed against posts carrying hazardous nature duties, and in case they have to complete a period of training as a condition of service, such woman candidate, who as a result of tests is found to be pregnant of twelve weeks' standing or more shall be declared temporarily unfit and her2616 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 appointment shall be held in abeyance until the confinement is over. Such woman candidate be re- examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness certificate from the authority as specified above, she may be appointed to the post kept reserved for her.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his / her official duties at the same rate as applicable to regular counter part official at the minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. The Employees Group Insurance Scheme as well as EPF / GPF will also not be applicable to contract appointee(s).

16. Reservation.—The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes / Scheduled Tribal / Other Backward Classes / Other Categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Not applicable

18. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission relax any of the provision(s) of these Rules with respect to any class or category of person(s) or post(s).

संख्याः टी0पी0टी0-ई(3)-4/2013-I.--हिमाचल प्रदेश के राज्यपाल, मोटर यान अधिनियम, 1988 (1988 का अधिनियम संख्यांक 59) की धारा 212 की उप-धारा (1) के साथ पठित धारा 211 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्या 5-24/88 टी0पी0टी0-III, तारीख 12 जुलाई, 1999 द्वारा अधिसूचित और राजपत्र (असाधारण) हिमाचल प्रदेश में 27 जुलाई, 1999 को प्रकाशित हिमाचल प्रदेश मोटर यान नियम, 1999 का और संशोधन करते हुए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और इन्हें उसके द्वारा संभाव्य प्रभावित होने वाले जन साधारण की सूचना के लिए राजपत्र (ई-गजट), हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

मोटर यान अधिनियम, 1988 (1988 का अधिनियम संख्यांक 59) की धारा 212 की उप-धारा (1) के अधीन यथा अपेक्षित, यदि इन प्रारूप नियमों से संभाव्य प्रभावित होने वाले किसी व्यक्ति के इन प्रारूप नियमों की बाबत कोई आक्षेप या सुझाव हैं, तो वह उक्त प्रारूप नियमों के राजपत्र (ई-गजट), हिमाचल प्रदेश के2619 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 प्रकाशन की तारीख से सात दिन की अवधि के भीतर, प्रधान सचिव (परिवहन), हिमाचल प्रदेश सरकार को लिखित में आक्षेप या सुझाव भेज सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप या सुझाव, यदि कोई है/हैं; पर उक्त प्रारूप नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मोटर यान (द्वितीय संशोधन) नियम, 2023 है ।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे । 2. नियम 69-ख का प्रतिस्थापन.--हिमाचल प्रदेश मोटर यान नियम, 1999 के नियम 69-ख के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ :-

"69-ख रजिस्ट्रीकरण चिन्हों के आबंटन के लिए विशेष रजिस्ट्रीकरण फीस.--(1) विशेष रजिस्ट्रीकरण चिन्ह का आबंटन और उसकी फीसः

(क) रजिस्ट्रीकरण प्राधिकारी राज्य में किसी यान को विशेष रजिस्ट्रीकरण चिन्ह (एस आर एम) के आबंटन के लिए, केंद्रीय मोटर यान नियम, 1989 के नियम 81 के अधीन विहित रजिस्ट्रीकरण फीस के अतिरिक्त, एकमुश्त विशेष रजिस्ट्रीकरण फीस (एस आर एम) प्रभारित करेगा। प्रत्येक रजिस्ट्रीकरण शृंखला में विशेष रजिस्ट्रीकरण चिन्ह (एस आर एम) के आबंटन और विशेष रजिस्ट्रीकरण फीस (एस आर एफ) की दर की पद्धति निम्न यथा सारणीबद्ध विशेष रजिस्ट्रीकरण चिन्ह के प्रवर्ग के अनुसार विनिश्चित होगी :--

(ख) खण्ड (क) के अधीन यथाउल्लिखित के सिवाय, 0100 से आगे के रजिस्ट्रीकरण चिन्हों का आबंटन, यदि रजिस्ट्रीकरण चिन्ह विद्यमान प्राथमिक शृंखला के दस रजिस्ट्रीकरण संख्या के अनियमित क्रम को लांघकर आबंटित किया जाता है (दस रजिस्ट्रीकरण चिन्हों के अनियमित क्रम में एक रजिस्ट्रीकरण चिन्ह आबंटित किया जा रहा है) या सम्बद्ध रजिस्ट्रीकरण प्राधिकारी द्वारा किसी भी अतिरिक्त रजिस्ट्रीकरण शृंखला से आबंटित किए जा रहे हैं, केवल 5000/- रुपए (पांच हजार) के विशेष रजिस्ट्रीकरण फीस प्रभारित करने के पश्चात्‌ ही किया जाएगा :

परन्तु यह कि,--

(i) सामान्य प्रशासन विभाग के यानों के आबंटन हेतु किसी भी समय एच0पी0 07 शृंखला में 0001 के अधिकतम दस रजिस्ट्रीकरण चिन्ह आरक्षित रखे जाएंगे ।

(ii) सामान्य प्रशासन विभाग को विशेष रजिस्ट्रीकरण फीस के संदेय से छूट होगी ।

(iii) इस उप-नियम का तत्स्थानी विद्यमान नियमों के अधीन विशेष रजिस्ट्रीकरण फीस के संदाय पर आबंटित किसी भी रजिस्ट्रीकरण चिन्ह को विशेष रजिस्ट्रीकरण चिन्ह (एस आर एम) कहा जाएगा।

(iv) खण्ड (ख) के अधीन विनिर्दिष्ट रजिस्ट्रीकरण चिन्ह (एस आर एम) पूर्णतया संदत्त चिन्ह होंगे और पहले आओ पहले पाओ के आधार पर आबंटित किए जाएंगे। तथापि, पहले आओ, पहले पाओ की दशा में, जहां किसी विशेष चिन्ह के लिए एक से अधिक आवेदन प्राप्त होते हैं, वहां लॉटरी द्वारा चिन्ह आबंटित किए जाएंगे ।

(v) खण्ड (ख) के अधीन विनिर्दिष्ट विशेष रजिस्ट्रीकरण चिन्हों के प्रयोजन के लिए, अनियमित क्रम रजिस्ट्रीकरण चिन्ह 0101 के बाद आरम्भ होगा; और किसी मोटर यान के दुर्घटनाग्रस्त होने की दशा में और बीमा कम्पनी द्वारा सम्यक रूप से प्रामाणित यान के पूर्णतया क्षतिग्रस्त होने पर,2621 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 उक्त यान के स्वामी को उसी नाम से, जिसके नाम पर पूर्ववर्ती यान रजिस्ट्री—त था, नए यान के रजिस्ट्रीकरण के लिए उसे रजिस्ट्रीकरण नंबर के लिए विशेष रजिस्ट्रीकरण फीस संदत्त करना अपेक्षित नहीं होगा ।

2. रजिस्ट्रीकरण चिन्ह का प्रतिधारण.--(क) यान के स्वामी, जिस यान पर रजिस्ट्रीकरण आबंटित किया आया है, उक्त चिन्ह को प्रतिधारित करने और उसके स्वामित्व वाले पुराने यान की बिक्री या स्क्रैपिंग पर, इस नए यान पर लगाए जाने का हकदार होगा । वह पहले रजिस्ट्रीकरण अधिकारी को उसके द्वारा खरीदे गए नए यान को उक्त रजिस्ट्रीकरण चिन्ह आबंटित करने के लिए आवेदन करेगा । ऐसे आबंटन के दौरान, पुराने यान को इन नियमों के उपबन्धों के अनुसार एक नया नम्बर आबंटित किया जाएगा और रजिस्ट्रीकरण प्राधिकरण यह भी सुनिश्चित करेगा कि कोई भी यान या उसका रिकॉर्ड किसी भी समय रजिस्ट्रीकरण चिन्ह के बिना नहीं रहे ।

(ख) यान का स्वामी, यान की बिक्री/अनुपयोगी होने/स्क्रैपिंग की दशा में रजिस्ट्रीकरण चिन्ह के अभ्यर्पण/खाली रहने की तारीख से 180 दिन की अवधि के लिए उक्त चिन्ह को प्रतिधारित करने का हकदार होगा । यान के पूर्व स्वामी के लिखित अनुरोध पर पहले 90 दिन के लिए 2500/- रुपए और इसके पश्चात आगामी 90 दिन के लिए 3000/- रुपए की फीस के संदाय के पश्चात्‌ ही अवधि को 180 दिन तक और आगे बढ़ाया जा सकता है।

परन्तु यह कि,--

(i) इस उप-नियम के उपबन्ध सरकार के स्वामित्व वाले किसी भी यान पर लागू नहीं होंगे । (ii) रजिस्ट्रीकरण प्राधिकारी, पूर्व यान के स्वामी को उक्त रजिस्ट्रीकरण चिन्ह आबंटित करने के पश्चात्‌, यह सुनिश्चित करेगा कि विद्यमान प्राथमिक श्रेणी से अनियमित क्रम में एक नया रजिस्ट्रीकरण चिन्ह उस वाहन को आबंटित किया जाए जिससे रजिस्ट्रीकरण चिन्ह लिया जा रहा है, या उप-नियम (1) के अधीन विनिर्दिष्ट विशेष रजिस्ट्रीकरण फीस के संदाय के पश्चात्‌ यान को विशेष रजिस्ट्रीकरण चिन्ह (एस आर एम) आबंटित किया जाए और यह भी सुनिश्चित करेगा कि कोई भी यान या उसका रिकॉर्ड किसी भी समय रजिस्ट्रीकरण चिन्ह के बिना नहीं रहे; और

(iii) यदि कोई विशेष रजिस्ट्रीकरण चिन्ह (एस आर एम) या अन्यथा किसी सरकारी स्वामित्व वाले यान का है, जिसे सरकारी एजेंसी द्वारा प्रवणित किया जाता है तो उक्त रजिस्ट्रीकरण चिन्ह को कोई फीस प्रभारित किए बिना उसी सरकारी एजेंसी को पुनः आबंटित करने के लिए रजिस्ट्रीकरण प्राधिकरण द्वारा अनिश्चित काल के लिए प्रतिधारित किया जाएगा और नए रजिस्ट्रीकरण चिन्ह, विद्यमान प्राथमिक शृंखला से दस रजिस्ट्रीकरण चिन्हों के अनियमित क्रम में आबंटित किया जाएगा या उप-नियम (1) के खण्ड (क) और (ख) में अधीन उस यान को, जिससे विशेष रजिस्ट्रीकरण चिन्ह हटाया जा रहा है, विनिर्दिष्ट विशेष रजिस्ट्रीकरण फीस के संदाय के पश्चात्‌ यान को विशेष रजिस्ट्रीकरण चिन्ह आबंटित किया जाएगा ।

(iv) यदि कोई विशेष रजिस्ट्रीकरण चिन्ह (एस आर एम) किसी व्यक्ति या संगठन (ई-नीलामी के माध्यम से अभिप्राप्त एस आर एम) के स्वामित्वाधीन यान से सम्बंधित है, जो प्रवणित है, तो उक्त रजिस्ट्रीकरण चिन्ह केवल बोली लगाने वाले द्वारा इस उप-नियम में यथा उल्लिखित अवधि के लिए प्रतिधारित किया जाएगा, अन्यथा वह रजिस्ट्रीकरण प्राधिकारी के पास पुनः आबंटन हेतु उपलब्ध रहेगा तथा नया रजिस्ट्रीकरण चिन्ह खंड (iii) में उल्लिखित प्रक्रिया के अनुसार आबंटित किया जाएगा । बोली लगाने वाले ही मृत्यु की दशा में, उक्त रजिस्ट्रीकरण चिन्ह विधिक उत्तराधिकारी द्वारा इस उप नियम में यथा उल्लिखित अवधि के लिए प्रतिधारित किया जाएगा ।

3. राज्य के भीतर रजिस्ट्री—त यानों को विशेष रजिस्ट्रीकरण चिन्ह (एस आर एम) का पुनः अभिहस्तांकन.--यान का स्वामी, जिसे हिमाचल प्रदेश रजिस्ट्रीकरण चिन्ह आबंटित हुआ है नियम 69-(क) में 2622 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 यथा उपबन्धित ई-नीलामी/बोली प्रक्रिया के माध्यम से अभिप्राप्त एस आर एम द्वारा उक्त चिन्ह को बदले जाने का हकदार होगा, परन्तु यह किः--

(i) यान अवक्रय/पट्टा/आडमान (हाईपोथीकेशन) के करार के अध्यधीन नहीं है;

(ii) यान, राष्ट्रीय अपराध रिकॉर्ड ब्यूरो/राज्य अपराध रिकॉर्ड ब्यूरो की रिपोर्ट द्वारा यथा प्रमाणित किसी भी आपराधिक कार्यवाहियों के अंतर्वलित नहीं है;

(iii) यान समस्त देय और करों के समाशोधन के अध्यधीन है;

(iv) विद्यमान संख्या जिसके स्थान पर ई-नीलामी बोली प्रक्रिया के माध्यम से नया नम्बर अभिप्राप्त किया गया है, को नियम 69-ख के उप-नियम (2) में यथावर्णित अवधि के लिए स्वामी द्वारा प्रतिधारित किया जा सकेगा और इसे उसके स्वामित्व वाले नए यान पर लगाया जा सकेगा या सम्बद्ध रजिस्ट्रीकरण और अनुज्ञप्ति प्राधिकारी द्वारा रोका जा सकेगा"।

NOTIFICATION

Shimla-02, the 27th June, 2023

No. TPT-A(3)-4/2013-I.—In exercise of the powers conferred by section 211 read with section 212 of the Motor Vehicles Act, 1988 (Act. No 59 of 1988), the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Motor Vehicles Rules,1999, notified vide this department's Notification No. 5-24/88-TPT-III dated 12th July, 1999 and published in the Rajpatra (Extra Ordinary), Himachal Pradesh dated 27th of July, 1999 and the same are hereby published in the Rajpatra (e-Gazette), Himachal Pradesh for the information of general public likely to be affected thereby;

If any person, likely to be affected by these draft rules, has any objection(s) or suggestion(s) with regard to these rules, he/she may send the written objection(s) or suggestion(s) to the Principal Secretary (Transport) to the Government of Himachal Pradesh, Shimla-2 within a period of seven days from the date of publication of said draft rules in the Rajpatra (e-Gazette), Himachal Pradesh as required under sub-section (1) of section 212 of the Motor vehicles Act, 1988 (Act No.59 of 1988);

The objection(s) or suggestion(s), if any, received within the above stipulated period, shall be taken into consideration by the Government of Himachal Pradesh before finalizing the said draft rules, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Motor Vehicles (Second Amendment) Rules, 2023. (2) These rules shall come into force from the date of publication in Rajpatra (e- Gazette), Himachal Pradesh.

2. Substitution of rule 69-B.—For rule 69-B of the Himachal Pradesh Motor Motor Vehicles Rules, 1999, the following shall be substituted, namely:—

"69-B Special Registration Fee for allotment of registration marks.—(1) Allotment of Special Registration Marks and Fee thereof.

(a) The Registering Authority shall charge one-time Special Registration Fee (SRF) for allotment of a Special Registration Mark (SRM) to a motor vehicle, in addition to the registration fee, prescribed under rule-81 of the Central Motor Vehicles Rules, 1989, in the State. In each registration series, the mode of allotment of Special Registration Mark (SRM) and rate of Special Registration Fee (SRF) shall be governed by the category of special registration mark as tabulated below:—

(b) Allotment of registration marks above 0100 other than those as mentioned under clause (a) shall be after charging the Special Registration Fee (SRF) of Rs. 5000/- (Five Thousand) only if registration mark is allotted by jumping the random order of ten registration numbers of existing primary series (one from which registration marks are being allotted in random order of ten registration numbers) or from any of the additional registration series by the concerned registering authority:

Provided that,—

(i) Maximum Ten Registration Marks of 0001 shall be kept reserved for the allotment of General Administration Department vehicles in HP 07 series at any given point of time.

(ii) the General Administration Department shall be exempted from the payment of Special Registration Fee (SRF).

(iii) any registration mark allotted under this sub-rule or corresponding extant rules on payment of Special Registration Fee, shall be termed as Special Registration Mark (SRM);

(iv) the registration marks specified under clause (b) shall be totally paid marks and allotted on first come first serve basis. However, in case of first come first serve basis where more than one application is received for a particular number, the same shall be allotted by draw of lots;

(v) for the purpose of special registration marks specified under clause (b), the random order shall start from registration marks 0101 onwards; and

(vi) in case any motor vehicle meets with an accident and is a total loss duly certified by the insurance company, the owner of the said vehicle shall not be required to pay the Special Registration Fee (SRF) for the same registration number for a new vehicle in the same name in whose name the earlier vehicle was registered.

(2) Retention of Registration Mark.—(a) The owner of the vehicle on which Registration Mark has been allotted shall be entitled to retain the said mark and get it affixed on new vehicle owned by him upon sale or scrapping of the old vehicle. He shall first apply to the2625 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 Registering Authority to allot the said Registration Mark to the new vehicle purchased by him. During such allotment, the old vehicle shall be allotted a new number in accordance with the provisions of these rules and registering authority shall also ensure that no vehicle or its record remains without a registration mark at any time.

(b) In case of sale/condemnation/scrapping of vehicle, the owner shall be entitled to retain the said mark for a period of 180 days from the date of surrender/ vacation of the registration number. The period can be further extended upto 180 days on written request of previous owner after payment of fee of Rs. 2500/- for first 90 days and Rs.3000/- for next 90 days:

Provided that,—

(i) the provisions of this sub-rule shall not apply to any vehicle owned by Government; (ii) the Registering Authority shall, after allotting the said registration mark to the previous owner, ensure that a new registration mark, in the random order, from the existing primary series is allotted to the vehicle from which the registration mark is being taken off or allot the Special Registration Mark (SRM) to vehicle after payment of Specified Special Registration Fee under sub-rule (1) and shall also ensure that no vehicle or its record remains without a registration mark at any time; and

(iii) if a particular registration mark (SRM or otherwise) belongs to a Government owned vehicle which is disposed of by the Government agency, the said registration mark shall be retained for indefinite period by the Registration Authority for re-allotment to the same Government agency without charging any fee and new registration mark shall be allotted in random order of ten registration numbers from the existing primary series or allot the Special Registration Marks to vehicle after payment of specified Special Registration Fee under clauses (a) and (b) of sub-rule (1) of this rule to the vehicle from which the particular registration mark is being taken off".

(iv) In case a Special registration mark (SRM) belongs to an individual or organization (SRM obtained through e-auction) owned vehicle which is disposed off, the said registration mark shall be retained only by the bidder for a period as mentioned in this sub-rule, otherwise the same shall be available with the Registration Authority for re- allotment and new registration mark shall be allotted as per procedure mentioned in clause (iii). In case of death of the bidder, the said registration mark shall be retained by legal heir for a period as mentioned in this sub-rule.

(3) Re-assignment of Special registration mark (SRM) to vehicles registered within State.— The vehicle of the owner on which Himachal Pradesh registration mark has been allotted shall be entitled to get the said mark replaced by SRM as provided in rule 69-(A) obtained through e-auction/bidding process provided that—

(i) the vehicle is not subject to an agreement of hire-purchase/ lease/hypothecation;

(ii) the vehicle is not involved in any criminal proceedings as certified by National Crime Records Bureau/State Crime Records Bureau report;

(iii) the vehicle is subject to clearance of all dues and taxes;

(iv) the existing number against which the new number has been obtained through e-auction/bidding process can be retained by the owner for the period as mentioned in2626 राजपत्र, हिमाचल प्रदेश, 03 जुलाई 2023/12 आषाढ़, 1945 sub-rule (2) of rule 69-B and get it affixed on new vehicle owned by him or frozen by the concerned Registering and Licensing Authority."
