स्ांख्याः एस.टी.ई-सी(17)-2/2016.-- हिमाचल प्रदेश सरकार ने जैवविविधता अधिनियम, 2002 की धारा 22 के अनुसार अधिसूचना संख्याः एस.टी.ई-ए(3)-1/2004, तारीख 14-02-2005 द्वारा हिमाचल प्रदेश राज्य जैवविविधता बोर्ड की स्थापना की है;

5782 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 उक्त अधिनियम की धारा 31 में यह अपेक्षा की गई है कि राज्य सरकार, इस निमिा राज्य विधान मण्डल द्वारा सम्यक्‌ रूप से विनियोग के पश्चात्‌, ऐसे अनुदान या ऋणों के द्वारा, राज्य जैवविविधता बोर्ड को ऐसी राशियों का संदाय कर सकेगी, जो राज्य सरकार, इस अधिनियम के प्रयोजन के लिए उपयोग किए जाने के लिए, आवश्यक समझे;

और अतः राज्य विधान मण्डल ने राज्य जैवविविधता के प्रयोजन के लिए राशियों का विनियोजन किया है;

अतः हिमाचल प्रदेश के राज्यपाल, जैवविविधता अधिनियम, 2002 की धारा 32 के अधीन हिमाचल प्रदेश जैवविविधता निधि का गठन करने का आदेश करते हैं।

हिमाचल प्रदेश जैवविविधता नियम, 2019 के नियम 15 के साथ पठित अधिनियम की धारा 32 के अनुसार निधि का प्रचालन होगा। अधिनियम की धारा 31 के अधीन बजट आबंटन गैर-व्यपगत होगा। राज्य सरकार से अभिप्राप्त निधियां, हिमाचल प्रदेश सरकार जैवविविधता बोर्ड के बचत बैंक खाता में जमा की जाएगी और हिमाचल प्रदेश सरकार जैवविविधता 2019 के नियम 15 के उप-नियम (3) के अनुसार गणना में लिया जाएगा।

ENVIRONMENT, SCI. TECH. & CLIMATE CHANGE DEPARTMENT

NOTIFICATION

Shimla-2, the 7th August, 2023

No. STE-C(17)-2/2016.—WHEREAS as per Section 22 of the Biological Diversity Act, 2002, the Government of Himachal Pradesh has constituted the Himachal Pradesh State Biodiversity Board vide Notification No. STE-A(3)-1/2004, dated 14-02-2005;

AND WHEREAS Section 31 of the said Act require that the State Government may after due appropriation made by the State Legislature by law in this behalf, pay to the State Biodiversity Board by way of grants or loans such sums of money as the State Government may think fit for being utilized for the purpose of the Act;

AND WHEREAS the State Legislature has appropriated amounts for the purpose of the State Biodiversity Fund;

NOW THEREFORE the Governor of Himachal Pradesh is pleased to order the constitution of the Himachal Pradesh Biodiversity Fund under section 32 of the Biological Diversity Act, 2002.

The operation of the fund will be as per Section 32 of the Act read with rule 15 of the Himachal Pradesh Biological Diversity Rules, 2019. The budgetary allocation under section 31 of the Act shall be non-lapsable.

The funds received from the State Government shall be credited to the Savings Bank Account of the Himachal Pradesh State Biodiversity Board and shall be accounted as per sub-rule (3) of rule 15 of the Himachal Pradesh Biological Diversity Rules, 2019.

1. संक्षिप्त नाम.--इन उप-विधियों का संक्षिप्त नाम शिमला नगर निगम महापौर, उप-महापौर और पार्षदों के लिए सुविधाऐं (संशोधन) उप-विधियां 2023 है।

2. उप-विधियां 3 में संशोधन.--उप-विधि 3 में, "राशि रु0 15000 और 10000" शब्दों और अंकों के स्थान पर "राशि रु0 20000 और 15000" शब्द और अंक रखे जाएंगे।

No. MCS/MA/393/Govt./2023-1922.—The following amendment in the Shimla Municipal Corporation (Facilities to Mayor, Deputy Mayor and Councillors) Bye-Laws, 1996 made by the5784 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 Municipal Corporation, Shimla in exercise of the powers conferred by sub clause (6) of clause (I) of Section 395, read with Section 35 and sub-section (3) of Section 36 of the Himachal Pradesh Municipal Corporation Act, 1994 (Act No. 12 of 1994) are hereby published for general information as required under section 397 of the said Act and shall come into force within the area of Municipal Corporation Shimla from the date of publication of this notification in the Rajpatra (extra ordinary) Himachal Pradesh, namely:—

1. Short title.—These Bye-Laws may be called the Shimla Municipal Corporation (Facilities to Mayor, Deputy Mayor and Councillors) (Amendment) Bye-Laws, 2023.

2. Amendment of Bye-Laws 3.—In Bye-Laws 3 for the figure " 15000" and "10000" the figure "20000" and "15000" shall respectively be substituted.

3. Amendment of Bye-Laws 9.—In Bye-Laws 9 for the figure "6500" the figure "7000" shall be substituted.

उपाबन्ध-''क'' हिमाचल प्रदेश लोक सेवा आयोग के कार्यालय में सहायक प्रोग्रामर, ग्रुप-सी (अराजपत्रित), के पद के लिए भर्ती और प्रोन्नति नियम

1. पद का नाम.--सहायक प्रोग्रामर

2. पद (पदों) की संख्या.--1 (एक)

3. वर्गीकरण.--ग्रुप-सी

4. वेतनमान.--(i) नियमित पदधारी (पदधारियों) के लिए पे बैण्ड : हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार, पद के टाइम स्केल से संलग्न पे-मैट्रिक्स का लेवल (स्तर)-9.

(ii) संविदा कर्मचारी (कर्मचारियों) के लिए उपलब्धियां.--हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ठ का 60 % (साठ प्रतिशत)। 5. "चयन" पद अथवा "अचयन" पद.--अचयन

6. सीधी भर्ती के लिए आयु.--18 से 45 वर्ष :

परन्तु सीधे भर्ती किए जाने वाले व्यक्तियों के लिए ऊपरी आयु सीमा, तदर्थ या संविदा के आधार पर नियुक्त किए गए व्यक्तियों सहित, पहले से ही सरकार की सेवा में रत अभ्यर्थियों को लागू नहीं होगीः

परन्तु यह और कि यदि तदर्थ या संविदा के आधार पर नियुक्त किया गया अभ्यर्थी इस रूप में नियुक्ति की तारीख को अधिक आयु का हो गया हो, तो वह तदर्थ या संविदा के आधार पर नियुक्ति के कारण विहित आयु में शिथिलीकरण का पात्र नहीं होगाः

परन्तु यह और कि अनुसूचित जातियों/अनुसूचित जनजातियों तथा अन्य वर्गों के व्यक्तियों के लिए ऊपरी आयु सीमा में उतना ही शिथिलीकरण किया जाएगा जितना कि हिमाचल प्रदेश सरकार के साधारण या विशेष (आदेशों) के अधीन अनुज्ञेय हैः 5786 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 परन्तु यह और भी कि समस्त पब्लिक सेक्टर, निगमों तथा स्वायत्त निकायों के कर्मचारियों को जो ऐसे पब्लिक सेक्टर, निगमों तथा स्वायत्त निकायों के प्रारम्भिक गठन के समय ऐसे पब्लिक सेक्टर, निगमों/स्वायत्त निकायों में आमेलन से पूर्व सरकारी कर्मचारी थे, सीधी भर्ती के लिए आयु सीमा में ऐसी ही रियायत अनुज्ञात जैसी सरकारी कर्मचारियों को अनुज्ञेय है, ऐसी रियायत, तथापि पब्लिक सेक्टर, निगमों तथा स्वायत्त निकायों के ऐसे कर्मचारिवृन्द को अनुज्ञेय नहीं होगी जो पश्चात्‌वर्ती ऐसे निगमों/स्वायत्त निकायों द्वारा नियुक्त किए गए थे/किए गए हैं और उन पब्लिक सेक्टर, निगमों/स्वायत्त निकायों के प्रारम्भिक गठन के पश्चात्‌ निगमों/स्वायत्त निकायों की सेवा में अन्तिम रूप से किए गए हैं/किए गए थे।

टिप्पण.--सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी, जिसमें कि पद (पदों) को आवेदन आमंत्रित करने के लिए, यथास्थिति, विज्ञापित किया गया है या नियोजनालयों को अधिसूचित किया गया है।

7. सीधी भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए अपेक्षित न्यूनतम शैक्षिक और अन्य अर्हताएं.--(क) अनिवार्य अर्हता(एं) : किसी राज्य सरकार/केन्द्रीय सरकार द्वारा सम्यक्‌ रूप से मान्यता प्राप्त किसी विश्वविद्यालय/संस्थान से विद्या की निम्नलिखित शाखा में नियमित पाठ्‌यक्रमः

प्रथम श्रेणी या कुल मिलाकर कम से कम साठ प्रतिशत अंक के साथ बी0ई0/बी0 टैक (कम्प्यूटर विज्ञान/इंजीनियरिंग या सूचना प्रौद्योगिकी)/एम0सी0ए0/नीलिट से "बी0" या "सी0" स्तर।

या (i) अन्य शिक्षा शाखाओं में प्रथम श्रेणी या कुल मिलाकर कम से कम साठ प्रतिशत अंक या इसके समतुल्य ग्रेड के साथ बी0ई0/बी0टैक के साथ-साथ डोएक (नीलिट) से एक वर्षीय "ए" स्तर कम्प्यूटर विज्ञान/एप्लीकेशनज़/सूचना प्रौद्योगिकी में प्रथम श्रेणी या कुल मिलाकर साठ प्रतिशत अंक के साथ स्नातकोतर डिप्लोमा।

(ii) सहायक प्रोग्रामर/प्रोग्रामर/सॉफ्टवेयर डिवेलपर के रूप में सरकारी/निगमित सेक्टर में कम से कम एक वर्ष का अनुभव।

या (i) कम्प्यूटर विज्ञान/सूचना प्रौद्योगिकी (जिसमें स्नातक में गणित एक विषय के रूप में हो) में प्रथम श्रेणी या कुल मिलाकर कम से कम साठ प्रतिशत अंक के साथ मिस्णात विज्ञान।

(ii) सहायक प्रोग्रामर/प्रोग्रामर/सॉफ्टवेयर डिवेलपर के रूप में सरकारी/निगमित सेक्टर में कम से कम दो वर्ष का अनुभव।

या (i) प्रथम श्रेणी या कुल मिलाकर कम से कम साठ प्रतिशत अंक के साथ बी0एस0सी0 (कम्प्यूटर विज्ञान या सूचना प्रौद्योगिकी)/बी0सी0ए0।

(ii) सहायक प्रोग्रामर/प्रोग्रामर/सॉफ्टवेयर डिवेल्पर के रूप में सरकारी/निगमित सेक्टर में कम से कम तीन वर्ष का अनुभवः

परन्तु अभ्यर्थी ने हिमाचल प्रदेश में अवस्थित किसी स्कूल/संस्थान से दसवीं और दस जमा दो पास की होः

परन्तु यह और कि यह शर्त हिमाचल प्रदेश के स्थायी निवासियों के लिए लागू नहीं होगी। (ख) वांछनीय अर्हता (अर्हताएं).--हिमाचल प्रदेश की रूढ़ियों, रीतियों और बोलियों का ज्ञान और प्रदेश में विद्यमान विशिष्ट दशाओं में नियुक्ति के लिए उपयुक्तता।

8. सीधे भर्ती किए जाने वाले व्यक्ति (व्यक्तियों) के लिए विहित आयु और शैक्षिक अर्हताएं प्रोन्नत व्यक्ति (व्यक्तियों) की दशा में लागू होंगी या नहीं.--(i) आयु : लागू नहीं5787 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 (ii) शैक्षिक अर्हता : लागू नहीं

9. परिविक्षा की अवधि, यदि कोई हो.--(क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विस्तार किया जा सकेगा, जैसा सक्षम प्राधिकारी विशेष परिस्थितियों में और कारणों को लिखित में अभिलिखित करके आदेश दें।

(ख) संविदा के आधार पर/ सेवाधृति के आधार पर नियुक्ति पर, अधिवर्षिता के पश्चात्‌ पुनर्नियोजन पर और आमेलन पर कोई परिवीक्षा नहीं होगी।

10. भर्ती की पद्धति, भर्ती सीधी होगी या प्रोन्नति, सैकेंण्डमैंट/स्थानान्तरण द्वारा और विभिन्न पद्धतियों द्वारा भरे जाने वाले पद (पदों) की प्रतिशतता.--शतप्रतिशत सीधी भर्ती द्वारा, यथास्थिति, नियमित आधार पर या संविदा के आधार पर भर्ती द्वारा।

11. प्रोन्नति, सैकण्डमैन्ट, स्थानान्तरण की दशा में वे श्रेणियां (ग्रेड) जिनसे प्रोन्नति, सैकण्डमैन्ट, स्थानान्तरण किया जाएगा.--लागू नहीं।

12. यदि विभागीय प्रोन्नति समिति विद्यमान हो तो उसकी संरचना.--(क) विभागीय प्रोन्नति समितिः लागू नहीं।

(ख) विभागीय स्थायीकरण समिति.--जैसे कि सरकार द्वारा समय-समय पर गठित।

13. भर्ती करने में जिन परिस्थितियों में हिमाचल प्रदेश लोक सेवा आयोग से परामर्श किया जाएगा.--जैसा विधि द्वारा अपेक्षित हो।

14. सीधी भर्ती के लिए अनिवार्य अपेक्षा.--किसी सेवा या पद पर नियुक्ति के लिए अभ्यर्थी का भारत का नागरिक होना अनिवार्य है।

15. सीधी भर्ती द्वारा पद पर नियुक्ति के लिए चयन.--सीधी भर्ती के मामले में, पद पर नियुक्ति के लिए चयन, लिखित परीक्षा और/या व्यावहारिक परीक्षा या शारीरिक परीक्षा के आधार पर किया जाएगा, जिसका स्तर/पाठ्‌यक्रम आदि यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती प्राधिकरण द्वारा अवधारित किया जाएगा।

15-क संविदा नियुक्ति द्वारा पद पर नियुक्ति के लिए चयन.--इन नियमों में किसी बात के होते हुए भी पद पर संविदा नियुक्तियाँ नीचे दिए गए निबन्धनों और शर्तों के अध्यधीन की जाएगीः

(I) संकल्पनाः

(क) इस पॉलिसी के अधीन हिमाचल प्रदेश लोक सेवा आयोग में सहायक प्रोग्रामर को संविदा के आधार पर प्रारम्भ में एक वर्ष के लिए लगाया जाएगा जिसे वर्षानुवर्ष आधार पर बढ़ाया जा सकेगाः

परन्तु संविदा की अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण करने हेतु सम्बद्ध विभागाध्यक्ष यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा तथा आचरण वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/ विस्तारित की जानी है।

(ख) पद का हिमाचल प्रदेश लोक सेवा आयोग के कार्यक्षेत्र में आनाः सचिव, हिमाचल प्रदेश लोक सेवा आयोग रिक्त पदों को संविदा के आधार पर भरने के लिए, अध्यक्ष, हिमाचल प्रदेश लोक सेवा आयोग का अनुमोदन प्राप्त करने के पश्चात्‌, रिक्त पद (पदों) के ब्यौरे दो5788 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 अग्रणी समाचार पत्रों में विज्ञापित करवाएगा और इन नियमों में यथाविहित पात्रता शर्तों को पूरा करने वाले अभ्यर्थियों से आवेदन आमन्त्रित करेगा।

(ग) चयन इन भर्ती और प्रोन्नति नियमों में विहित पात्रता शर्तों के अनुसार किया जाएगा। (II) संविदात्मक उपलब्धियांः

संविदा के आधार पर नियुक्त सहायक प्रोग्रामर को ...... रूपए की समेकित नियत संविदात्मक रकम प्रतिमास संदत्त की जाएगी [जो तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ठ का साठ प्रतिशत होगा]।

(III) नियुक्ति/अनुशासन प्राधिकारीः

सचिव, हिमाचल प्रदेश लोक सेवा आयोग, नियुक्ति और अनुशासन प्राधिकारी होगा। (IV) चयन प्रक्रियाः

संविदा नियुक्ति के मामले में, पद पर नियुक्ति के लिए चयन, लिखित परीक्षा और/या व्यावहारिक परीक्षा या दक्षता परीक्षा या शारीरिक परीक्षा के आधार पर किया जाएगा। जिसका स्तर/पाठ्‌यक्रम आदि यथास्थिति, हिमाचल प्रदेश लोक सेवा आयोग/अन्य भर्ती अभिकरण/प्राधिकरण द्वारा अवधारित किया जाएगा।

(V) संविदात्मक नियुक्तियों के लिए चयन समितिः

जैसी सम्बद्ध भर्ती अभिकरण अर्थात्‌ हिमाचल प्रदेश लोक सेवा आयोग द्वारा समय-समय पर गठित की जाए।

(VI) करारः

अभ्यर्थी को, चयन के पश्चात्‌ इन नियमों से संलग्न उपाबन्ध "ख" के अनुसार करार हस्ताक्षरित करना होगा।

(VII) निबन्धन और शर्तेंः

(क) संविदा के आधार पर नियुक्त सहायक प्रोग्रामर को ...... रूपए की समेकित नियत संविदात्मक रकम प्रतिमास संदत्त की जाएगी (जो तत्स्थानी संवर्ग के पे-मैट्रिक्स के लागू लेवल (स्तर) के प्रथम कोष्ठ का साठ प्रतिशत होगा)।

(ख) संविदा पर नियुक्त व्यक्ति की सेवा पूर्णतया अस्थायी आधार पर होगी। यदि संविदा पर नियुक्त व्यक्ति का कार्य/आचरण ठीक नहीं पाया जाता है, तो नियुक्ति पर्यवसित (समाप्त) किए जाने के लिए दायी होगी। यदि संविदा पर नियुक्त व्यक्ति, नियुक्ति प्राधिकारी द्वारा जारी पर्यवसान (समापन) आदेश से संतुष्ट नहीं है तो वह उस तारीख, जिसको पर्यवसान (समापन) आदेश की प्रति उसे परिदत की गई हैं, से 45 (पैंतालीस) दिन के भीतर अपील प्राधिकारी, जो नियुक्ति प्राधिकारी से उच्चतर पंक्ति का होगा, को अपील कर सकेगा। (ग) संविदा पर नियुक्त व्यक्ति, एक कैलेण्डर वर्ष में, एक मास की सेवा पूरी करने के पश्चात्‌ एक दिन के आकस्मिक अवकाश, दस दिन के चिकित्सा अवकाश और पांच दिन के विशेष अवकाश का हकदार होगा/होगी। संविदा पर नियुक्त महिला कर्मचारी को दो जीवित बच्चों तक एक सौ अस्सी दिन का प्रसूति अवकाश दिया जा सकेगा। संविदा पर नियुक्त5789 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा में, प्राधिकृत चिकित्सा अधिकारी द्वारा जारी चिकित्सा प्रमाण-पत्र प्रस्तुत करने पर 45 (पैंतालीस) दिन से अनधिक प्रसूति अवकाश; (जीवित बच्चों की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकित्सा प्रतिपूर्ति और एल0टी0सी0 आदि के लिए भी हकदार नहीं होगा/होगी। संविदा पर नियुक्त व्यक्ति को उपरोक्त के सिवाय अन्य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा। अनुपभुक्त आकस्मिक अवकाश, चिकित्सा अवकाश और विशेष अवकाश एक कैलेण्डर वर्ष तक संचित किया जा सकेगा और आगामी कैलेण्डर वर्ष के लिए अग्रनीत नहीं किया जाएगा।

(घ) नियन्त्रक अधिकारी के अनुमोदन के बिना कर्त्तव्य (ड्‌यूटी) से अनधिकृत अनुपस्थिति से स्वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामलों में जहां पर चिकित्सा आधार पर कर्त्तव्य से अनधिकृत अनुपस्थिति के हालात, संविदा पर नियुक्त व्यक्ति के नियन्त्रण से बाहर हों, तो वहाँ उसके नियमितिकरण के मामले में विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, किन्तु, पदधारी को इस बाबत समय पर नियन्त्रण अधिकारी को सूचित करना होगा। तथापि संविदा पर नियुक्त व्यक्ति कर्त्तव्य से अनुपस्थिति की ऐसी अवधि के लिए संविदात्मक रकम का हकदार नहीं होगाः

परन्तु उसे सरकार के प्रचलित अनुदेशों के अनुसार चिकित्सा अधिकारी द्वारा जारी बीमारी/आरोग्यता प्रमाण-पत्र प्रस्तुत करना होगा।

(ङ) संविदा के आधार पर नियुक्त कर्मचारी, जिसने तैनाती के एक स्थान पर तीन वर्ष का कार्यकाल पूर्ण कर लिया हो, आवश्यकता के आधार पर स्थानान्तरण हेतु पात्र होगा, जहां भी प्रशासनिक आधारों पर ऐसा करना अपेक्षित हो।

(च) चयनित अभ्यर्थी को राजपत्रित सरकारी कर्मचारी की दशा में, चिकित्सा बोर्ड द्वारा और अराजपत्रित कर्मचारी की दशा में सरकारी चिकित्सा अधिकारी द्वारा जारी, अपना आरोग्य प्रमाण-पत्र प्रस्तुत करना होगा। उन महिला अभ्यर्थियों की दशा में, जिन्हें परिसंकटमय स्वरूप के कर्त्तव्यों को कार्यान्वित करने वाले पदों के विरूद्ध नियुक्त किया जाना है और यदि उन्हें प्रशिक्षण की अवधि को सेवा-शर्त के रूप में पूर्ण करना है तो ऐसी महिला अभ्यर्थी, जो परीक्षण के परिणामस्वरूप बारह सप्ताह या इससे अधिक समय से गर्भवती पाई जाती है, को अस्थाई रूप से अनुपयुक्त घोषित किया जाएगा और उसकी नियुक्ति को तब तक आस्थगित रखा जाएगा जब तक कि प्रसवावस्था समाप्त नहीं हो जाती है। ऐसी महिला अभ्यर्थी का प्रसवावस्था की तारीख से छः सप्ताह के पश्चात्‌ चिकित्सा उपयुक्तता के लिए पुनः परीक्षण किया जाएगा, और यदि वह उपरोक्त यथा विनिर्दिष्ट प्राधिकारी से चिकित्सा आरोग्य प्रमाण-पत्र प्रस्तुत करने पर उपयुक्त पाई जाती है तो वह उसके लिए आरक्षित रखे गए पद पर नियुक्त की जा सकेगी।

(छ) संविदा पर नियुक्त व्यक्ति का यदि अपने पदीय कर्त्तव्यों के सम्बन्ध में दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी नियमित प्रतिस्थानी पदधारी को वेतनमान के न्यूनतम पर लागू है, यात्रा भत्ते/दैनिक भत्ते का हकदार होगा/होगी।

(ज) नियमित कर्मचारियों की दशा में, यथा लागू सेवा नियमों जैसे कि एफ0आर0-एस0आर0, छुट्‌टी नियम, साधारण भविष्य निधि नियम, पेंशन नियम तथा आचरण नियम, आदि के उपबन्ध संविदा पर नियुक्त व्यक्तियों की दशा में लागू नहीं होंगे। वे इस स्तम्भ में यथावर्णित उपलब्धियों, आदि के लिए हकदार होंगे। संविदा पर नियुक्त व्यक्तियों को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई0पी0एफ0/जी0पी0एफ0 भी लागू नहीं होगा। 5790 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 16. आरक्षण.--सेवा में नियुक्ति, हिमाचल प्रदेश सरकार द्वारा समय-समय पर अनुसूचित जातियों/अनुसूचित जनजातियों/अन्य पिछड़े वर्गों और व्यक्तियों के अन्य प्रवर्ग के लिए सेवा में आरक्षण की बाबत जारी किए गए आदेशों के अधीन होगी।

17. विभागीय परीक्षा.--लागू नहीं

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है, वहां वह, कारणों को लिखित में अभिलिखित करके, हिमाचल प्रदेश लोक सेवा आयोग के परामर्श से, आदेश द्वारा, इन नियमों, के किन्हीं उपबन्ध (उपबन्धों) को किसी वर्ग या व्यक्ति (व्यक्तियों) के प्रवर्ग या पद (पदों) की बाबत, शिथिल कर सकेगी।

उपाबन्ध-"ख" सहायक प्रोग्रामर और हिमाचल प्रदेश सरकार के मध्य, सचिव, हिमाचल प्रदेश लोक सेवा आयोग के माध्यम से निष्पादित की जाने वाली संविदा/करार का प्रारूप

यह करार श्री/श्रीमती ....................... पुत्र/पुत्री श्री..........................निवासी......................, संविदा पर नियुक्त व्यक्ति (जिसे इसमें इसके पश्चात्‌ प्रथम पक्षकार कहा गया है), और हिमाचल प्रदेश के राज्यपाल, के मध्य, सचिव, हिमाचल प्रदेश लोक सेवा आयोग (जिसे इसमें इसके पश्चात्‌ द्वितीय पक्षकार कहा गया है) के माध्यम से आज तारीख....................... को किया गया।

द्वितीय पक्षकार ने उपरोक्त प्रथम पक्षकार को लगाया है और प्रथम पक्षकार ने सहायक प्रोग्रामर, के रूप में संविदा के आधार पर निम्नलिखित निबन्धन और शर्तों पर सेवा करने के लिए सहमति दी हैः-- 1. यह कि प्रथम पक्षकार सहायक प्रोग्रामर के रूप में ............. से प्रारम्भ होने और ................. को समाप्त होने वाले दिन तक, एक वर्ष की अवधि के लिए द्वितीय पक्षकार की सेवा में रहेगा। यह विनिर्दिष्ट रूप से उल्लिखित किया गया है और दोनों पक्षकारों द्वारा करार पाया गया है कि प्रथम पक्षकार की द्वितीय पक्षकार के साथ संविदा, आखिरी कार्य दिवस अर्थात्‌ .................... दिन को स्वयंमेव ही पर्यवसित (समाप्त) समझी जाएगी और सूचना नोटिस आवश्यक नहीं होगाः परन्तु संविदा की अवधि में वर्षानुवर्ष आधार पर विस्तारण/नवीकरण के लिए सम्बद्ध सचिव, हिमाचल प्रदेश लोक सेवा आयोग यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त व्यक्ति की सेवा तथा आचरण उस वर्ष के दौरान संतोषजनक रहा है और केवल तभी उसकी संविदा की अवधि नवीकृत/विस्तारित की जाएगी।

No. Per (AP-B)B(2)-4/2021.—In exercise of the powers conferred by proviso to Article 309 read with Article 318 of the Constitution of India, the Governor, Himachal Pradesh in consultation with the Himachal Pradesh Public Service Commission is pleased to make the Recruitment and Promotion Rules for the post of Assistant Programmer, Group-C (Non-Gazetted) in the Himachal Pradesh Public Service Commission as per Annexure "A" attached to this Notification, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Public Service Commission Assistant Programmer, Group-C (Non-Gazetted) Recruitment and Promotion Rules, 2023.

(2) These rules shall come into force form the date of publication in the Rajpatra (e-Gazette) Himachal Pradesh.

ANNEXURE-"A" RECRUITMENT AND PROMOTION RULES FOR THE POST OF ASSISTANT PROGRAMMER, GROUP-C (NON-GAZETTED) IN THE OFFICE OF HIMACHAL PRADESH PUBLIC SERVICE COMMISSION

1. Name of the Post.—Assistant Programmer

2. Number of post(s).—01 (one)5793 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 3. Classification.—Group-C 4. Scale of Pay.—(i) Pay Band for regular incumbents : Level 9 of the pay matrix attached with time scale of the post, as per H.P. Civil Services (Revised Pay) Rules, 2022.

(ii) Emoluments for contract employees : 60 percent of the first cell of the applicable level of pay matrix of the corresponding cadre, as per the H.P. Civil Services (Revised Pay) Rules, 2022.

6. Age for direct recruitment.—Between 18 to 45 years:

Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government including those who have been appointed on adhoc or on contract basis:

Provided further that if a candidate appointed on adhoc basis or on contract basis had become over- age on the date he/she was appointed as such he/ she shall not be eligible for any relaxation in the prescribed age limit by virtue of his/ her such adhoc or contract appointment:

Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes/Other Backward Classes and Other categories of persons to the extent permissible under the general or special order(s) of the Himachal Pradesh Government:

Provided further that the employees of all the Public Sector Corporations and Autonomous Bodies who happened to be Government servants before absorption in Public Sector Corporations/ Autonomous Bodies at the time of initial constitution of such Corporation/Autonomous Bodies shall be allowed age concession in direct recruitment as admissible to Government servants. This concession will not, however, be admissible to such staff of the Public Sector Corporations/ Corporations/ Autonomous Bodies who are/ were subsequently appointed by such Corporations/ Autonomous Bodies and who are/ were finally absorbed in the service of such Corporations/ Autonomous Bodies after initial constitution of the Public Sector Corporations/Autonomous Bodies.

Note.—Age limit for direct recruitment will be reckoned on the first day of the year in which the post(s) is/are advertised for inviting application or notified to the employment Exchanges, as the case may be.

7. Minimum Educational and other qualifications required for direct recruit(s).—(a) ESSENTIAL QUALIFICATION(S) : Regular Course(s) in the following streams from any University/Institution duly recognized by any State/Centre Government:—

B.E/ B.Tech. (Computer Science/Engineering or Information Technology) MCA/ 'B' or 'C' Level of NIELIT with first Class or atleast 60% marks in aggregate.

OR

(i) B.E./B.Tech. in other disciplines with first class or atleast 60% marks in aggregate or equivalent grade with one year 'A' level of DOEACC (NIELIT)/ Post Graduate Diploma in Computer Science/ Applications/ Information Technology with first class or atleast 60% marks in aggregate.

Programmer/Programmer/Software Developer.

OR

(i) M.Sc. in Computer Science/Information Technology (having Mathematics as a subject in Graduation) with first class or atleast 60% marks in aggregate.

(ii) Experience of atleast two years in Government/ Corporate Sector as Assistant Programmer/Programmer/Software Developer.

OR

(i) B.Sc. (Computer Science or Information Technology)/BCA with first class or atleast 60% marks in aggregate.

(ii) Experience of atleast three years in Government/Corporate/Private Sector as Assistant Programmer/Programmer/Software Developer.

Provided that a candidate must have passed Matriculation and 10+2 from any School/ Institution situated within Himachal Pradesh:

Provided further that this condition shall not apply to Bonafide Himachalis.

(b) DESIRABLE QUALIFICATION(S): Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the Pradesh.

13. Circumstances under which the Himachal Pradesh Public Service

Commission(HPPSC) is to be consulted in making recruitment.—As required under the Law.

14. Essential requirement for a direct recruitment.—A candidate for appointment to any service or post must be a citizen of India.

15. Selection for appointment to the post by direct recruitment.—Selection for appointment to the post in the case of direct recruitment shall be made on the basis of merit of written examination and/or practical test or physical test, the standard/syllabus etc. will be determined by the Himachal Pradesh Public Service Commission/other recruiting agency/ authority, as the case may be.

15-A Selection for appointment to the post by contract appointment.—Notwithstanding anything contained in these rules, contract appointments to the post will be made subject to the terms and conditions given below:

(I) CONCEPT:

(a) Under this policy the Assistant Programmer in the office of Himachal Pradesh Public Service Commission will be engaged on contract basis initially for one year, which may be extendable on year to year basis:

Provided that for extension/renewal of contract period on year to year basis, the concerned HOD shall issue a certificate that the service and conduct of the contract appointee is satisfactory during the year and only then his period of contract is to be renewed/extended.

(b) POST FALLS WITHIN THE PURVIEW OF Himachal Pradesh Public Service Commission : The Secretary, Himachal Pradesh Public Service Commission after the approval of Chairman, Himachal Pradesh Public Service Commission will advertise the detail of the vacant post(s) in two leading newspapers and invite applications from candidates having the prescribed qualifications and fulfilling the other eligibility condition as prescribed in these Rules.

I The selection will be made in accordance with the eligibility conditions prescribed in these R & P Rules.

(II) CONTRACTUAL EMOLUMENTS:

The Assistant Programmer appointed on contract basis will be paid consolidated fixed contractual amount @ ` ------ per month (which shall be 60% of the first cell of the applicable level of pay matrix of the corresponding cadre).

(III) APPOINTING/ DISCIPLINARY AUTHORITY:

The Secretary, Himachal Pradesh Public Service Commission will be the appointing and disciplinary authority.

(IV) SELECTION PROCESS :

Selection for appointment to the post in the case of contract appointment shall be made on the basis of merit of Written examination and/or practical test or Skill test or5796 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 physical test, the standard/syllabus, etc. will be determined by the Himachal Pradesh Public Service Commission/other recruiting agency/authority, as the case may be.

(V) COMMITTEE FOR SELECTION OF CONTRACTUAL APPOINTMENTS:

As may be constituted by the concerned recruiting agency i.e. Himachal Pradesh Public Service Commission, from time to time.

(VI) AGREEMENT:

After selection of a candidate, he/she shall sign an agreement as per Annexure ''B'' appended to these Rules.

(VII) TERMS AND CONDITIONS:

(a) The Assistant Programmer appointed on contract basis will be paid fixed contractual amount @ ` -------per month (which shall be 60% of the first cell of the applicable level of pay matrix of the corresponding cadre).

(b) The service of the contract appointee will be purely on temporary basis. The appointment is liable to be terminated in case the performance / conduct of the contract appointee is not found satisfactory. In case the contract appointee is not satisfied with termination orders issued by the Appointing Authority, he/she may prefer an appeal before the Appellate Authority who shall be higher in rank to the Appointing Authority, within a period of 45 days, from the date on which a copy of termination orders is delivered to him/her.

I The contract appointee will be entitled for one day casual leave after putting one month service, 10 days' medical leave and 5 days' special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 180 days. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days (irrespective of the number of the surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.

Un-availed Casual Leave, Medical Leave and Special Leave can be accumulated upto the Calendar Year and will not be carried forward for the next Calendar Year.

(d) Un-authorized absence from the duty without approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his /her control on medical grounds, such period shall not be excluded while considering his / her case for regularization but the incumbent shall have to intimate the Controlling Authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty:

Provided that he /she shall submit the certificate of illness /fitness issued by the Medical Officer, as per prevailing instructions of the Government.

(e) An official appointed on contract basis who has completed three years tenure at one place of posting will be eligible for transfer on need based basis wherever required on administrative grounds.

(f) Selected candidate will have to submit a certificate of his / her fitness issued by a Medical Board in the case of a Gazetted Government Servant and by Government Medical Officer in the case of a Non-Gazetted Government Servant. In case of women candidate who are to be appointed against post carrying hazardous nature of duties, and in case they have to complete a period of training as a condition of service, such women candidate, who as a result of test is found to be pregnant of twelve weeks standing or more shall be declared temporarily unfit and her appointment shall be held in abeyance until the confinement is over. Such women candidate be re-examined for medical fitness six weeks after the date of confinement, and if she is found fit on production of medical fitness certificate from the authority as specified above, she may be appointed to the post kept reserved for her.

(g) Contract appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular counter-part official at the minimum of pay scale.

(h) Provisions of service rules like FR SR, Leave Rules, GPF Rules, Pension Rules & Conduct Rules etc. as are applicable in case of regular employees will not be applicable in case of contract appointees. They will be entitled for emoluments etc. as details in this column. The employees group insurance scheme as well as EPF/GPF will also not be applicable to the contract appointee(s).

16. Reservation.— The appointment to the service shall be subject to orders regarding reservation in the service for Scheduled Castes/Scheduled Tribes/Other Backward Classes/other categories of persons issued by the Himachal Pradesh Government from time to time.

17. Departmental Examination.—Not Applicable

18. Power to relax.— Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the Himachal Pradesh Public Service Commission, relax any of the provision(s) of these Rules with respect to any Class or Category of person(s) or post(s).

Form of contract/agreement to be executed between the Assistant Programmer and the Government of Himachal Pradesh through Secretary, Himachal Pradesh Public Service Commission.

This agreement is made on this day of in the year _______________ between Sh./ Smt./ Miss s/o/ d/o Shri_____________ r/o __________________________________________________contract appointee (hereinafter called5798 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 the FIRST PARTY), and The Governor, Himachal Pradesh through Secretary, Himachal Pradesh Public Service Commission(here in after called the SECOND PARTY)

WHEREAS the Second Party has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as Assistant Programmer on contract basis on the following terms & conditions:—

1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as Assistant Programmer for a period of one year commencing on day of................and ending on the day of.........It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on ________________ information notice shall not be necessary; and

संख्याः वि0स0-विधायन-नियम समिति/1-15/2023.--हिमाचल प्रदेश विधान सभा की प्रक्रिया एवं कार्य संचालन नियमावली, 1973 के नियम, 235 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए अध्यक्ष, हिमाचल प्रदेश विधान सभा द्वारा सदन की स्थानीय निधि लेखा समिति के आंतरिक कार्यप्रणाली नियम सहर्ष स्वीकार करते हुए निम्न प्रकार से बनाये गए हैं :--

1. समिति का नाम और प्रारम्भ

इस समिति का नाम स्थानीय निधि लेखा समिति होगा जो राजपत्र हि0 प्र0 में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. समिति का गठन

हिमाचल प्रदेश विधान सभा की प्रक्रिया एवं कार्य संचालन नियमावली, 1973 के नियम 209 और 211 के अन्तर्गत अध्यक्ष द्वारा हर वर्ष सभा की एक स्थानीय निधि लेखा समिति नाम निर्देशित की जाएगी जिसमें 11 से अधिक सदस्य नहीं होंगे।

3. समिति की बैठकें

समिति की बैठकें ऐसे समय और ऐसे दिन होंगी जो अध्यक्ष द्वारा निश्चित हों, परन्तु विशेष परिस्थितियों में समिति के सभापति भी बैठकों की तिथि और समय निश्चित कर सकेंगे।

4. समिति के —त्य-

1. समिति विधान सभा द्वारा राज्य के स्थानीय निकायों/प्राधिकरणों के लिए विनियोजित धनराशि और स्थानीय निकायों के ऐसे अन्य लेखे जो विधान सभा के समक्ष रखे जाएं, जिनकी समिति जांच करना आवश्यक समझे, की जांच करेगी।

2. स्थानीय निकायों एवं प्राधिकरणों के विनियोग लेखों और उन पर हिमाचल प्रदेश राज्य लेखा परीक्षा विभाग के समेकित प्रतिवेदन की जांच करते समय समिति का यह कर्त्तव्य होगा कि वह अपना समाधान कर ले :--

(क) कि लेखों में व्यय के रूप में दिखाया गया धन उस सेवा या प्रयोजन के लिए विधिवत उपलब्ध और लगाए जाने योग्य था, जिसमें वह लगाया गया है या प्रभारित किया गया है;

(ख) कि व्यय उस प्राधिकार के अनुसार है जिसके वह अधीन है।

3. समिति के ये भी कर्त्तव्य होंगे कि :--

(क) सभी नगर निगमों, नगरपालिकाओं, पंचायतों, विश्वविद्यालयों, विकास प्राधिकरणों और सरकार के किसी भी कानून या आदेश के तहत स्थापित किसी अन्य प्राधिकरण/निकाय या संस्थान जो स्थानीय निधि के प्रशासन के लिए उत्तरदायी हो, की आय तथा व्यय दिखाने वाले विवरण की जांच करना;

(ख) स्वायत्तशासी, अर्ध-स्वायत्तशासी निकायों एवं सरकार के किसी भी कानून अथवा आदेश द्वारा स्थापित किसी अन्य प्राधिकरण/निकाय या संस्थान की आय तथा व्यय दिखाने वाले5801 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 विवरण की जांच करना जिसकी लेखा परीक्षा विधायिका की किसी संविधि द्वारा हिमाचल प्रदेश राज्य लेखा परीक्षा विभाग द्वारा की जाती है;

(ग) हिमाचल प्रदेश राज्य लेखा परीक्षा विभाग द्वारा परीक्षित लेखों के समेकित प्रतिवेदन की जांच करना, जिसे प्रतिवर्ष विधान सभा के समक्ष रखा जाता है। समिति हिमाचल प्रदेश राज्य लेखा परीक्षा विभाग द्वारा लेखा परीक्षित स्थानीय निकायों, स्वायत्तशासी निकायों और अर्ध-स्वायत्तशासी निकायों आदि की लेखा परीक्षा प्रतिवेदनों के संबंध में ऐसे कार्य करेगी जो समय-समय पर अध्यक्ष द्वारा उसे सौंपे जाएं;

(घ) भारत के नियंत्रक एवं महालेखापरीक्षक की स्थानीय स्वायत्तशासी संस्थानों के लेखों से संबंधित प्रतिवेदनों की जांच करना, जो विधान सभा के समक्ष प्रतिवर्ष रखे जाएं। समिति भारत के नियंत्रक एवं महालेखा परीक्षक द्वारा लेखापरीक्षित स्थानीय निकायों की लेखापरीक्षा प्रतिवेदनों के संबंध में ऐसे कार्य करेगी जो अध्यक्ष द्वारा उसे समय-समय पर सौंपे जाएं; और

(ङ) किसी शहरी स्थानीय निकाय या पंचायती राज संस्थानों, स्वायत्तशासी निकायों/ अर्ध-स्वायत्तशासी निकायों और विकास प्राधिकरणों आदि के कामकाज के किसी अन्य पहलू की जांच करना, जो अध्यक्ष द्वारा निर्दिष्ट किए हों।

5. प्रतिवेदन की प्रस्तुति

स्थानीय निधि लेखा समिति का प्रतिवेदन समिति के सभापति द्वारा सदन में प्रस्तुत किया जाएगा या कोई सदस्य जो अध्यक्ष द्वारा इस कार्य हेतु प्राधि—त किया गया हो।

6. अन्य प्रावधान

अन्य बातों के लिए सामान्य नियम जो हिमाचल प्रदेश विधान सभा के प्रक्रिया एवं कार्य संचालन नियमावली के अध्याय-18, सामान्य समितियों के लिए प्रक्रिया तथा अध्यक्ष द्वारा जारी निर्देश के अध्याय-11, समितियों पर लागू होने वाले सामान्य निर्देश में निहित है, वही रहेंगे या संशोधनों के साथ जो अध्यक्ष आवश्यक तथा नियमानुसार सही समझे लागू होंगे।

7. स्थानीय निधि लेखा समिति की संरचनाः-

1. समिति यह निर्णय लेगी कि किसी अन्य प्रावधान के अनुसरण में सदन के समक्ष रखे गए प्रतिवेदनों में से कौन से मदों की जांच की जानी है।

2. प्रधान महालेखाकार/महालेखाकार एवं वित्त सचिव को समिति की बैठकों में सहयोगार्थ आमंत्रित किया जायेगा।

3. प्रधान महालेखाकार/महालेखाकार लेखा में महत्वपूर्ण मदों को इंगित करके समिति की सहायता करेंगे जिनकी समिति द्वारा जांच की जानी चाहिए। समिति को दूसरे बिंदुओं पर भी जांच करने से कोई नहीं रोक सकता।

4. सरकार के प्रतिनिधि साक्ष्य देने हेतु समिति के समक्ष व्यक्तिगत रूप से उपस्थित होंगे। यदि वे आवश्यक समझें तो स्थानीय शहरी निकायों, पंचायती राज संस्थाओं और स्वायत्तशासी संस्थानों के मुख्य अधिकारियों तथा अन्य अधिकारियों को भी सहायता के लिए ला सकते हैं। सामान्यतः सभी उत्तर विभागीय सचिवों द्वारा दिए जाने चाहिए।

5. हिमाचल प्रदेश विधान सभा की स्थानीय निधि लेखा संबंधी समिति द्वारा जारी प्रश्नावली के उत्तर, यदि कोई हो, का विवरण भी प्रस्तुत किया जाना चाहिए। 5802 राजपत्र, हिमाचल प्रदेश, 10 अगस्त 2023/19 श्रावण, 1945 (i) हिमाचल प्रदेश विधान सभा सचिवालय की स्थानीय निधि लेखा समिति द्वारा चर्चा के समय ऑडिट रिपोर्ट में तथ्य और आंकड़े की सटीकता के संबंध में विवादों से बचने के लिए, वित्त विभाग और महालेखाकार द्वारा विधान सभा सचिवालय को प्रेषित करने से पूर्व जांच की जानी चाहिए।

(ii) प्रश्नावली के नोट्‌स और सुओ-मोटो उत्तर टुकड़ों में प्रेषित नहीं किये जाने चाहिए बल्कि प्रत्येक लेखापरीक्षा रिपोर्ट के संबंध में विभाग से संबंधित सभी पैराज को शामिल करते हुए समेकित रूप में प्रेषित किये जाने चाहिए, हालांकि पैराज उसी में अलग-अलग विभाग के अनुभागों से संबंधित हो सकते हैं।

6. विभाग द्वारा वित्तीय अनियमितताओं के मामले में विस्तृत व्याख्यात्मक टिप्पणी समिति को प्रस्तुत करते समय विभाग पूर्ण जानकारी उपलब्ध करवायेगा। इसमें अनुबंध में उल्लिखित सभी बिंदु शामिल होने चाहिए।

7. समिति द्वारा साक्ष्य के दौरान मांगी गई कोई भी जानकारी तुरंत उपलब्ध करवाई जाएगी, बशर्ते कि जब समिति द्वारा वांछित जानकारी तुरंत उपलब्ध न हो, तो विभागीय प्रतिनिधि इसे नोट कर लेंगे और बाद में जानकारी प्रस्तुत करने के लिए अध्यक्ष से अनुमति मांगेंगे। आमतौर पर यह जानकारी अगले दिन या एक सप्ताह के भीतर प्रस्तुत की जाएगी। मामले में, यदि एक सप्ताह के भीतर जानकारी देना संभव नहीं है, तो सम्बन्धित सचिव अध्यक्ष से समय विस्तार हेतु आग्रह कर सकते हैं।

8. सदस्य बैठक की तारीख से दो दिन पहले अपने सुझाव, यदि कोई हों, समिति के विचारार्थ भेज सकते हैं।

9. सचिव द्वारा कार्यक्रम/कार्यसूची तैयार की जाएगी और अध्यक्ष द्वारा अनुमोदित की जाएगी और इसकी प्रतियां सदस्यों को भी परिचालित की जाएंगी।

10. विभागीय सचिवों आदि के परीक्षण के फलस्वरूप समिति को जिस बिंदु पर और जानकारी की आवश्यकता है, विभागीय सचिव उन बिंदुओं को नोट करेंगे और सभापति के निर्देशानुसार आवश्यक कार्रवाई करेंगे।

11. समिति की प्रत्येक बैठक की कार्यवाही का अभिलेख सचिव द्वारा रखा जायेगा। सबूतों की शब्दशः रिपोर्ट रखी जाएगी।

12. समिति के सभापति की यदि राय है कि समिति या उप-समिति की कार्यवाही में शब्द, वाक्यांश और अभिव्यक्ति में ऐसी जानकारी है जो सार्वजनिक हित में प्रकाशित नहीं होगी या विशुद्ध रूप से व्यक्तिगत प्र—ति की टिप्पणियां शामिल हैं, तो वह कार्यवाही से ऐसे शब्दों, वाक्यांशों या अभिव्यक्तियों को निकालने का आदेश दे सकता है।

13. समिति की बैठकों के दौरान प्रैस/मीडिया को मनाही होगी।

14. शब्दशः कार्यवाही समिति के उपयोग के लिए होगी। केवल वही कागज सार्वजनिक किए जाएंगे जो सदन के पटल पर रखे गए हैं। जहां स्थानीय शहरी निकायों, पंचायती राज संस्थाओं और स्वायत्तशासी संस्थानों की समितियों ने पूरे साक्ष्य या उसके किसी भाग को मुद्रित करने का निर्णय लिया है, उसे अलग खंड के रूप में मुद्रित किया जाएगा और उस पर संबंधित खाते लेखापरीक्षा प्रतिवेदनों का हिस्सा होंगे।

17. (1) समिति के प्रतिवेदन की प्रतियां सदन में प्रस्तुत किए जाने के बाद यथाशीघ्र सरकार को प्रेषित की जाएंगी।

(2) संबंधित सरकारी विभाग को समिति द्वारा निर्धारित रिपोर्ट में निहित सिफारिशों पर की गई कार्रवाई को दर्शाने वाला एक विवरण प्रस्तुत करना होगा। इस बयान के साथ ज्ञापन, परिपत्रों और सिफारिशों पर की गई कार्रवाई से संबंधित अन्य साहित्य की प्रतियां संलग्न होंगी।

(3) सरकार द्वारा की गई कार्रवाई को दर्शाने वाला विवरण समिति के समक्ष उनके विचारार्थ रखा जाएगा।

18. समिति को प्रस्तुत कोई भी दस्तावेज समिति की जानकारी और अनुमोदन के बिना वापस या परिवर्तित नहीं किया जाएगा।

19. प्रक्रिया के कोई अतिरिक्त बिंदु जो समय-समय पर तैयार किए जाते हैं, इन नियमों में शामिल किए जाएंगे।

20. समिति के समक्ष पेश होने वाले साक्षी आचरण और शिष्टाचार के निम्नलिखित बिंदुओं का पालन करेंगे :—

(क) सरकारी प्रतिनिधियों द्वारा साक्ष्य के दौरान समिति के अध्यक्ष और सदस्य को उचित सम्मान दिया जाएगा।

(ख) विभागीय प्रतिनिधि द्वारा साक्ष्य के दौरान किसी अन्य पदाधिकारी को समिति के सहयोगार्थ उपस्थित होने हेतु समिति के सभापति से अनुमति लेना आवश्यक होगी तथा समिति में बैठने का स्थान हिमाचल प्रदेश विधान सभा के प्रक्रिया एवं कार्य-संचालन नियमों में निहित प्रावधानों के अनुसार होगा।

(ग) विभागीय प्रतिनिधि को सभापति या समिति के किसी सदस्य और सभापति द्वारा अधि—त किसी अन्य व्यक्ति द्वारा उससे पूछे गए विशिष्ट प्रश्नों का उत्तर देना होगा।

(घ) अध्यक्ष और समिति को सभी प्रस्तुतियां विनम्र भाषा में दी जाएंगी।

(ङ) समिति के साक्ष्य के दौरान समिति का कोई भी सदस्य सभापति को सम्बोधन करते हुए समिति के —त्य के अन्तर्गत ही प्रश्न पूछेगा, न की उससे हटकर।

(च) साक्षी को सभापति की अनुमति के बिना समिति के समक्ष कोई भी कार्य करने की अनुमति नहीं होगी।

(छ) साक्ष्य के दौरान ग्वाह/साक्षी के —त्य विधान सभा के प्रक्रिया एवं कार्य-संचालन के नियमों में निहित प्रावधानों के अधीन निम्न कार्य विशेषाधिकार का उल्लंघन और समिति की अवमानना के होंगे :--

No. V.S.-Legn.-Rule Comtt./1-15/2023.— In pursuance of the power conferred under rule- 235 of the Rules of Procedure and Conduct of Business of Himachal Pradesh Legislative Assembly, 1973, Hon'ble Speaker Himachal Pradesh Vidhan Sabha has accepted to pleasure, the Internal Working Rules of Local Fund Account Committee of the House have been made as follows:—

1. Name and Commencement of Committee

The name of this Committee will be Local Fund Accounts Committee, which will come into force from the date of publication in the Gazette of Himachal Pradesh.

2. Constitution of the Committee

Under Rule 209 and 211 of the Rules of Procedure and Conduct of Business of Himachal Pradesh Legislative Assembly, 1973, there shall be a Local Fund Accounts Committee which shall consist of not more than 11 members, nominated by the Speaker every year.

3. Sittings of Committee

The sitting of the Committee shall be held on such days and at such time as the Speaker may fix, provided that in exceptional circumstances, the Chairman of the Committee may also fix the date and time of the sitting.

4. Functions of the Committee

(1) The Committee shall examine the accounts showing the appropriation of sums granted by the Legislative Assembly for local bodies/authorities in the State and such other accounts relating to local bodies laid before the Assembly as the Committee may think fit.

(2) In scrutinizing the Appropriation accounts of local bodies and authorities and the Consolidated Report of the Himachal Pradesh State Audit Department thereon, it shall be the duty of the Committee to satisfy itself,—

(a) that the money shown in the accounts as having been disbursed were legally available for, and applicable to the service or purpose for which they have been applied or charged;

(b) that the expenditure conforms to the authority which governs it.

(3) It shall also be the duty of the Committee: —

(a) to examine the statement of accounts showing the Universities, Development Authorities and any other authority/body or institution established by or under any law or orders of the Govt., which is responsible for the administration of Local Fund;

(b) to examine the statement of accounts showing the income and expenditure of autonomous/semi-autonomous bodies, any other authority/body or institution established by or under any law or orders of the Govt. the audit of which are conducted by the Himachal Pradesh State Audit Department by a statute of the Legislature;

(c) to examine the Consolidated Report of the accounts audited by the Himachal Pradesh State Audit Department, which is laid annually before the Legislative Assembly. The Committee shall perform such other functions in respect of the Audit Reports of the Local Bodies, Autonomous Bodies and Semi Autonomous Bodies etc. audited by the Himachal Pradesh State Audit Department as may be assigned to it by the Speaker from time to time;

(d) to examine the Reports of the Comptroller and Auditor General of India, relating to the accounts of the Local Self Government Institutions, which are laid annually before the Legislative Assembly. The Committee shall perform such other functions in respect of the Audit Reports of the Local Bodies audited by the Comptroller and Auditor General of India as may be assigned to it by the Speaker from time to time; and

(e) to examine any other aspect of the working of any Urban Local Bodies or the Panchayati Raj Institutions, Autonomous Bodies/Semi Autonomous Bodies and Development authorities etc. as may be referred to it by the Speaker.

5. Presentation of Report

The report of the Local Fund Accounts Committee shall be laid on the Table of the House by the Chairman of the said Committee or by any member who may be authorized by the Chairman for this purpose.

6. Other Provisions

For all other matters, the General rules inherent in Chapter-18 of the Rules of Procedure and Conduct of Business of Himachal Pradesh Legislative Assembly, "Procedure for General Committees" and Chapter-11 of the Instructions issued by the Speaker, "General Instructions applicable to Committees" shall remain the same or shall be applicable with such amendments as the Speaker may consider necessary and accurate in accordance with the rules.

1. The Committee shall decide which items are to be examined in the Reports laid on the Table of the House, pursuant to any other provision.

2. Principal Accountant General/Accountant General and Finance Secretary will be invited for assistance in the sitting of the Committee.

3. The Principal Accountant General/Accountant General will assist the Committee by pointing out important items in the accounts which should be examined by the Committee. The Committee will be fully empowered to examine other points as well.

4. The representative of the Government shall appear in person before the Committee to give evidence. If they consider it necessary, they can also call senior officers and other officers of Local Urban Bodies, Panchayati Raj Institutions and Autonomous Institutions for assistance. Normally all answers should be given by the departmental Secretaries.

5. The replies to the questionnaire, if any, issued by the Local Fund Accounts Committee of the Himachal Pradesh Legislative Assembly should also be furnished.

(i) To avoid disputes regarding the correctness of facts and figures in the audit report at the time of discussion by the Local Fund Accounts Committee of the Himachal Pradesh Legislative Assembly Secretariat; the report should be examined by the Finance Department and the Accountant General before sending it to the Vidhan Sabha Secretariat.

(ii) Questionnaire notes and suo-moto replies should not be sent in parts but should be sent in a consolidated form covering all the paragraphs relating to the department in each audit report. However, paras may be related to sections of different departments.

6. In the case of financial irregularities while submitting the detailed explanatory note to the Committee, the department will provide complete information. It should include all the points mentioned in the Annexure.

7. Any information required by the Committee during the course of evidence shall be made available immediately. Provided that when the information desired by the Committee is not immediately available, the departmental representative shall note the same and subsequently seek permission from the Chairman to furnish the information. Usually such information will be presented the next day or within a week. In case, if it is not possible to furnish the information within a week, the Secretary concerned may request the Chairman for extension of time.

8. Members may send their suggestions, if any, for the consideration of the Committee two days prior to the date of the sitting.

9. The programme/agenda shall be prepared by the Secretary and approved by the Speaker and copies thereof shall also be circulated to the members.

10. Upon the examination of departmental Secretaries etc., the points on which further information is desired by the Committee, Secretaries will note all such points and take necessary action as per the direction of the Chairman.

11. The record of the proceedings of each sitting of the Committee shall be kept by the Secretary. A verbatim report of the evidence shall be kept.

12. If in the Opinion of the Chairman, proceedings of the Committee or Sub-Committee contain such information in words, phrases and expressions which cannot be published in the public interest or contain remarks of a purely personal nature; he may order to expunge all such words, phrases or expressions.

13. During the sittings of the Committee entry of Press/media will be prohibited.

14. The verbatim proceedings shall be for the use of the Committee. Only those papers will be made public which are laid on the Table of the House. Where the Committees of Urban Local Bodies, Panchayati Raj Institutions and Autonomous Institutions have decided to print the whole or any part of the evidence, the same shall be printed as a separate volume and the accounts concerned thereon shall form part of the report of the Committee dealing with the audit reports.

15. The audit paras will be examined by the Committee and when the irregularities are fully recovered or there are any pending cases, the Committee will make recommendations.

16. Every report or its segment shall be considered in the sitting of the Committee and the decisions of the Committee shall be finalised.

17. (1) Copies of report of the Committee shall be forwarded to the Government as soon as it laid on the Table of the House.

(2) The concerned Government Department shall submit a detailed statement showing the action taken on the recommendations contained in the report prescribed by the Committee. Copies of the other literature relating to the action taken on the memorandum, circulars and recommendations shall be attached to this statement.

(3) A statement showing the action taken by the Government shall be placed before the Committee for their consideration.

18. Documents submitted to the Committee shall not be returned or amended without the knowledge and approval of the Committee.

19. Any additional points of the procedure that may be framed from time to time shall be incorporated in these rules.

20. Following points of conduct and courtesy shall be followed by the witnesses appearing before the committee:—

(a) During the evidence, the government representatives shall accord, due respect and honour to the Chairman and Members of the Committee.

(b) It will be necessary for the departmental representative to take permission from the Chairman of the Committee to call any other officers for the assistance of the Committee during the evidence. The order of sitting in the Committee will be according to the provisions contained in the Rules of Procedure and Conduct of Business of Himachal Pradesh Legislative Assembly.

(c) The departmental representative shall answer specific questions put to him by the Chairman or any member of the Committee and any other person authorized by the Chairman.

(d) All submissions to the Chairman and the Committee shall be made in courteous language.

(e) During the evidence of the Committee, any member of the Committee shall ask questions addressing the Chairman, within the functions of the Committee, not apart from it.

(f) Without the permission of the Chairman witness will not be permitted to do any work, before the Committee.

(g) Subject to the provisions contained in the Rules of Procedure and Conduct of Business of Himachal Pradesh Legislative Assembly, the following acts of the witness during the evidence will be considered as breach of privilege and contempt of the Committee:—

(i) Refusal to answer any question, unless the disclosure of the information sought for would be prejudicial to the security or interest of the State.

(ii) Giving defamatory answers to the Committee, cheating or knowingly giving false evidence or suppressing the truth in order to mislead the Committee.

(iii) Information made available to the Committee by the department is not completely clear and legible.

(iv) Destroying or damaging important documents relating to the enquiry.
