संख्याःयू0डी0-ए0(3)-5/2022.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 (1994 का अधिनियम संख्या 13) की धारा 48 क (फ) के साथ पठित धारा 308-क द्वारा 105—राजपत्र/2023-22-08-2023 (5969) 5970 राजपत्र, हिमाचल प्रदेश, 22 अगस्त 2023/31 श्रावण, 1945 प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम, विस्तार और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगरपालिका परिषद्‌/नगर पंचायत परिवार रजिस्टर अनुरक्षण नियम, 2023 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. परिभाषाएं.-- (1) इन नियमोें में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 अभिप्रेत है;

(ख) ''स्थायी निवासी'' से ऐसा व्यक्ति अभिप्रेत है जिसका हिमाचल प्रदेश में स्थायी आवास है और इसके अन्तर्गत वह व्यक्ति, जो कम से कम 20 वर्ष की अवधि से हिमाचल प्रदेश में रह रहा है या वह व्यक्ति, जिसका हिमाचल प्रदेश में स्थायी आवास है किन्तु उसके व्यवसाय के कारण वह हिमाचल प्रदेश से बाहर रह रहा है; भी सम्मिलित है,

(ग) ''कार्यकारी अधिकारी'' से नगर परिषद्‌ का कार्यकारी अधिकारी अभिप्रेत है;

(घ) ''प्ररूप'' से, इन नियमों से संलग्न प्ररूप अभिप्रेत है;

(ङ) ''सचिव'' से नगर पंचायत का सचिव अभिप्रेत है;

(च) ''वार्ड समिति के सचिव'' से अधिनियम की धारा 51-ख की उप-धारा (2) के अधीन, यथास्थिति, कार्यकारी अधिकारी या सचिव द्वारा नामित अधिकारी अभिप्रेत है;

(छ) ''धारा'' से अधिनियम की धारा अभिप्रेत है; और

(ज) ''प्रवासन'' से एक शहरी स्थानीय निकाय से दूसरे में और पंचायती राज संस्थानों से शहरी स्थानीय निकायों में या विपर्ययेन स्थानान्तरण, अभिप्रेत है।

(2) उन शब्दों और पदों के, जो इन नियमों में प्रयुक्त है, किन्तु परिभाषित नहीं है, के वही अर्थ होंगे, जो हिमाचल प्रदेश नगरपालिका अधिनियम, 1994 में क्रमशः उनके है।

3. परिवार रजिस्टर का अभिलेख बनाना और उसका पुनरीक्षण.--(1) (क) अधिनियम की धारा 51-क के अनुसार वार्ड सभा के अस्तित्व में आने के पश्चात्‌, प्रत्येक नगरपालिका परिषद्‌/नगर पंचायत के लिए इन नियमों से संलग्न प्रारूप-1 में वार्डवार एक रजिस्टर तैयार किया जाएगा। इसमें कुटुम्बवार सभी व्यक्तियों जो भारत के नागरिक हैं के नाम और विवरण सम्मिलित होंगे और वार्ड सभा क्षेत्र का भाग बनने वाले स्थायी निवासी हैं। रजिस्टर वार्ड समिति के सचिव द्वारा तैयार किया जाएगा और यथास्थिति, नगर परिषद्‌ के कार्यकारी अधिकारी या नगर पंचायत के सचिव द्वारा सत्यापित किया जाएगा।

(ख) वार्ड समिति के सचिव प्ररूप-2 पर वार्ड के स्थायी निवासियों के परिवारों की गणना के लिए घर-घर जाकर सर्वेक्षण संचालित करवाएंगे।

(ग) यथास्थिति, नगर परिषद्‌ के कार्यकारी अधिकारी या नगर पंचायत के सचिव, कम से कम दो स्थानीय समाचार पत्रों में घर-घर सर्वेक्षण आरंभ करने की तारीखें और क्षेत्र को अधिसूचित करेगा और व्यापक रूप से प्रचालित करेगा और वार्ड और शहरी स्थानीय निकायों के कार्यालय में सहज दृश्य स्थानों पर नोटिस चिपकाएगा। ऐसे सर्वेक्षण संचालित किए जाने के तौर-तरीके निदेशक द्वारा विनिश्चित किए जाएंगे।5971 राजपत्र, हिमाचल प्रदेश, 22 अगस्त 2023/31 श्रावण, 1945 (घ) घर-घर किए गए सर्वेक्षण द्वारा प्राप्त सूचना को सचिव, वार्ड समिति द्वारा हस्ताक्षरित किया जाएगा और यथास्थिति, नगर परिषद्‌ के कार्यकारी अधिकारी अथवा नगर पंचायत के सचिव द्वारा सत्यापित किया जाएगा।

(ङ) नगर परिषद्‌/नगर पंचायत के प्रत्येक वार्ड का प्रारूप परिवार रजिस्टर नगर परिषद्‌/नगर पंचायत के समक्ष रखा जाएगा तथा सदन के समक्ष अनुमोदन के पश्चात्‌ वार्ड परिवार रजिस्टर का संकलन करके इसे राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किया जाएगा और उसकी एक प्रति जनसाधारण के निरीक्षण हेतु शहरी स्थानीय निकायों के कार्यालय में रखी जाएगी।

(च) प्रारूप परिवार रजिस्टर के प्रकाशन के एक मास के भीतर शहरी स्थानीय निकायों के कार्यालय में प्रारूप-3 में प्राप्त लिखित आक्षेपों को वार्ड समिति के सचिव द्वारा आपत्तियां प्राप्त करने की तारीख समाप्त होने के सात दिन के भीतर संक्षिप्त जांच करवा कर और समस्त सम्बद्ध पक्षकारों को सुनवाई का अवसर प्रदान कर पुनः सत्यापित करवाया जाएगा। संशोधन, यदि कोई हो, प्रारूप परिवार रजिस्टर में निगमित किए जाएंगे तथा उस पर वार्ड समिति के सचिव द्वारा, प्रतिहस्ताक्षरित किया जाएगा।

(छ) प्रारूप परिवार रजिस्टर में किए गए किसी भी उपांतरण का संबंधित द्वारा विरोध किया जा सकता है। वार्ड समिति के सचिव के निर्णय के 07 दिन के भीतर इस संबंध मेें लिखित रूप में की गई अपील निदेशक द्वारा 01 मास के भीतर सुनी जाएगी और उस पर उसका विनिश्चय अंतिम होगा।

(ज) सत्यापित वार्ड परिवार रजिस्टर के संकलन के पश्चात्‌ इस प्रकार तैयार किया गया अंतिम परिवार रजिस्टर नगरपालिका परिषद्‌/नगर पंचायत के सदन में रखा जाएगा और अनुमोदन के पश्चात्‌ (ई-गजट), हिमाचल प्रदेश में प्रकाशित किया जाएगा।

(झ) नाम और जन्म तिथि की बाबत कोई सुधार/उपान्तरण करने के लिए आवेदक को दस्तावेज प्रमाण जैसे स्कूल प्रमाण-पत्र सक्षम प्राधिकारी द्वारा सम्यक्‌ रूप से जारी गजट (अभिलेख) या इस संबंध में शपत-पत्र प्रस्तुत करना होगा। शहरी स्थानीय निकायों में 20 वर्षाें से अधिक वर्ष से निवास कर रहे शहरी स्थानीय निकायों के सामान्य निवासियों और नेपाली निवासियों को सक्षम प्राधिकारी द्वारा सम्यक्‌ रूप से जारी किए गए दस्तावेजी प्रमाण-पत्र प्रस्तुत करने होंगे। नगरपालिका परिषद्‌/नगर पंचायत के अधिकारी/सचिव जिस को कार्यकारी अधिकारी/सचिव द्वारा यह कार्यभार सौंपा गया है, वह स्वयं का समाधान होने के पश्चात्‌ अभिलेख में आवश्यक सुधार/उपान्तरण करेगा।

() जब, परिवार रजिस्टर राजपत्र (ई-गजट), हिमाचल प्रदेश में अंतिम रूप से प्रकाशित हो जाता है, तो सम्बद्ध कार्यकारी अधिकारी/सचिव ऑनलाइन पद्धति के माध्यम से जनसाधारण को यह सुविधा प्रदान कर सकेंगे।

(2) प्रत्येक कैलेन्डर वर्ष की समाप्ति पर, उप-नियम (1) के अधीन तैयार की जाने वाले परिवार रजिस्टर में प्रविष्टियों को सम्बद्ध अधिकारी द्वारा पुनरीक्षित किया जाएगा और जन्म, मृत्यु और विवाह से संबंधित समस्त प्रविष्टियों जो पूर्ववर्त्ती वर्ष के दौरान अर्थात दिसम्बर के 31 (इकतीसवें) दिन तक हुई हैं को परिवार रजिस्टर में अद्यतन किया जाएगा।

यह पुनरीक्षण सदैव क्रमशः जन्म और मृत्यु रजिस्ट्रीकरण अधिनियम, 1969 और हिमाचल प्रदेश विवाह रजिस्ट्रीकरण अधिनियम, 1969 के उपबंधों के अनुसार नगरपालिका परिषद्‌/नगर पंचायत द्वारा अनुरक्षित ''जन्म और मृत्यु रजिस्टर'' और ''विवाह रजिस्ट्रीकरण रजिस्टर'' में दर्ज प्रविष्टियों के अनुसार किया जाएगा। बिना किसी प्रमाणित साक्ष्य के कोई अन्य परिवर्तन नहीं किया जा सकेगा। कुटुम्ब के बंटवारे की स्थिति में सम्बद्ध कुटुम्ब के मुखिया के आवेदन पर बहुमत से प्रस्ताव पारित कर संबंधित वार्ड समिति के विनिश्चय पर परिवार रजिस्टर में परिवार के अलग होने की प्रविष्टि की जा सकेगी। वार्ड समिति परिवार के विभाजन के संबंध में मामले का विनिश्चय करते समय धारा 2 के खंड (19-क) में उपबंधित कुटुम्ब की परिभाषा को ध्यान में रखेगी। यह सत्यापन अधिकारी अर्थात्‌ वार्ड समिति के सचिव जिसे इस प्रयोजन के लिए विशेष रूप से नगरपालिका परिषद्‌/नगर पंचायत के कार्यकारी अधिकारी/सचिव द्वारा नामित किया गया है, का कर्त्तव्य 5972 राजपत्र, हिमाचल प्रदेश, 22 अगस्त 2023/31 श्रावण, 1945 होगा कि वह इन प्रविष्टियों को सम्बद्ध सचिव, वार्ड समिति द्वारा रिकार्ड किए गए कारणों के बारे में स्वयं का समाधान हो जाने के पश्चात्‌ सत्यापित करे। वह वार्ड समिति के सचिव द्वारा प्रारूप-4 पर तैयार की गई सारांश-पत्र पर भी अपना हस्ताक्षर करेगा। शहरी स्थानीय निकाय से अन्य निकाय और पंचायती राज संस्थान से शहरी स्थानीय निकाय या विपर्ययेन प्रवास की दशा में आवेदक शहरी स्थानीय निकाय के स्तर पर परिवार रजिस्टर में आवश्यक प्रविष्टि करने के लिए सम्बद्ध अधिकारी/(अधिकृत) प्रभारी से प्ररूप-5 पर रिपोर्ट प्राप्त करेगाः

परन्तु परिवार के विभाजन की बाबत परिवार रजिस्टर में कोई प्रविष्टि तब तक नहीं की जाएगी जब तक कि उक्त कुटुम्ब के पास अलग रसोई और शौचालय की सुविधा न हो।

(3) सम्बद्ध अधिकारी द्वारा प्रत्येक वर्ष 31 जनवरी तक उप-नियम (2) के अधीन रजिस्टर का पुनरीक्षण और अद्यतन किया जाएगा और इस आशय की सार्वजनिक सूचना जारी की जाएगी कि- (क) उप-नियम (2) के अधीन रजिस्टर का पुनरीक्षण और अद्यतन किया गया है

(ख) यथा पुनरीक्षित रजिस्टर सार्वजनिक निरीक्षण के लिए सम्बद्ध वार्ड समिति के कार्यालय में और नगरपालिका परिषद्‌/नगर पंचायत क्षेत्र में अन्य सहदृश्य स्थानों पर पंद्रह दिन की अवधि (सार्वजनिक अवकाश के सिवाए) प्रातः 10 बजे से सायं 5 बजे के मध्य उपलब्ध होगा।

(ग) यदि किसी व्यक्ति को रजिस्टर में किसी प्रविष्टि या किसी चूक की बाबत कोई आक्षेप करना हो तो वह पन्द्रह दिन की अवधि के भीतर सम्बद्ध वार्ड समिति के सचिव को इस आशय का आक्षेप कर सकेगा। नोटिस वार्ड समिति के कार्यालय/नगर पालिका परिषद्‌/नगर पंचायत क्षेत्र के उक्त वार्ड की क्षेत्रीय अधिकारिता भीतर सहजदृश्य स्थानों पर चस्पा किया जाएगा।

(4) उप-नियम (2) के अधीन रजिस्टर में की गई पुनरीक्षित प्रविष्टियां और उप-नियम (3) के अधीन प्राप्त आक्षेपों पर विचार किया जाएगा और नगर पालिका परिषद्‌/नगर पंचायत के कार्यकारी अधिकारी/सचिव या नगर पालिका परिषद्‌/नगर पंचायत के कार्यकारी अधिकारी/सचिव द्वारा नामित किसी अधिकारी/कर्मचारी द्वारा व्यक्ति को सुनवाई का अवसर देने के पश्चात्‌ निपटाया जाएगा और सत्यापित किया जाएगा।

4. परिवार रजिस्टर अभिलेख का निरीक्षण के लिए रहना.--(1) कोई भी व्यक्ति परिवार रजिस्टर की प्रविष्टियों की प्रतियों के लिए आवेदन कर सकेगा।

(2) परिवार रजिस्टर के अभिलेख की प्रति प्राप्त करने के लिए, प्रत्येक आवेदन नगर पालिका परिषद्‌/नगर पंचायत के कार्यकारी अधिकारी/सचिव द्वारा अभिलेख की प्रमाणित प्रतियों की आपूर्ति के प्रयोजन के लिए पदाविहित पदधारी/अधिकारी को किया जाएगा तथा उसमें उस प्रयोजन जिसके लिए प्रति की आवश्यकता है, स्पष्ट किया जाएगा जो 50/- रुपये की फीस के साथ होगा। अपेक्षित अभिलेख आवेदक को डाक/दस्ती से या ऑनलाइन के माध्यम से 07 दिन के भीतर निश्चित रूप से प्रदान किया जाएगा। (3) प्रति प्रष्ठया उसके भाग के लिए प्रति तीन रुपए की जाएगी, जो (प्रतिलिपि) आवेदन करने से पूर्व अग्रिम रूप से वसूल की जाएगीः

परन्तु सार्वजनिक प्राधिकरणों से अभिलेख की प्रतिलिपि के लिए कोई फीस प्रमाणित नहीं की जाएगी यदि उन्हें शासकीय उपयोग के लिए अभिलेख की आवश्यकता है।

(4) कोई भी व्यक्ति परिवार रजिस्टर के अभिलेख के निरीक्षण के लिए सम्बद्ध वार्ड समिति के सचिव को आवेदन कर सकेगा। प्रति एक घंटे के लिए निरीक्षण शुल्क बीस रुपए होगा। निरीक्षण के दौरान कलम5973 राजपत्र, हिमाचल प्रदेश, 22 अगस्त 2023/31 श्रावण, 1945 और स्याही का प्रयोग वर्जित है। अभिलेख का निरीक्षण नगर पालिका परिषद्‌/नगर पंचायत के अधिकारी/पदधारी की उपस्थिति में किया जाएगा।

(5) इस नियम के अधीन प्रभार्य शुल्क का भुगतान कार्यकारी अधिकारी/सचिव, नगरपालिका परिषद्‌/नगर पंचायत द्वारा अभिलेख की प्रमाणित प्रति उपलब्ध करवाने कि प्रयोजनार्थ पदाविहित पदधारी/अधिकारी को आवेदन के साथ नगद या किसी अन्य माध्यम से किया जाएगा, जो इसे नगरपालिका के कोष में जमा करवाएगा और तत्काल अपने हस्ताक्षर से रसीद देगा।

(6) निदेशक समय-समय पर अधिसूचना द्वारा नकल एवं निरीक्षण फीस की दरों में पुनरीक्षण कर सकेगा।

5. निदेश जारी करने की शक्ति.--निदेशक, इन नियमों के सहज कार्यान्वयन के लिए समय-समय पर निदेश/स्पष्टीकरण जारी कर सकेगा।

NOTIFICATION

Shimla-2, the 10th August, 2023

No. UD-A(3)-5/2022.— In exercise of the powers conferred by Section 308-A read with Section 48A (v) of the Himachal Pradesh Municipal Act 1994 (Act, 13 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules, namely:—

1. Short title, extent and commencement.—(1) These rules may be called the Himachal Pradesh Municipal Council /Nagar Panchayat Maintenance of Parivar Register Rules, 2023.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette) Himachal Pradesh.

2. Definitions.—(1) In these rules, unless the context otherwise requires:—

(a) "Act" means the Himachal Pradesh Municipal Act, 1994;

(b) "Bonafide Resident" means a person who has a permanent home in Himachal Pradesh and includes a person who has been residing in Himachal Pradesh for a period of not less than 20 years or a person who has permanent home in Himachal Pradesh but on account of his occupation he is living outside Himachal Pradesh.

(c) "EO" means Executive Officer of Municipal Council;

(d) "Form" means a Form appended to these rules;

(e) "Secretary" means the Secretary of Nagar Panchayat;

(f) "Secretary of Ward Committee" means the officer nominated by the Executive Officer or Secretary , as the case may be under sub-section (2) of Section 57-B of the Act;

(g) "Section" means a section of the Act; and

(h) "Migration" means shifting from one Urban Local Bodies to other and Panchayati Raj Institution to Urban Local Bodies or vice–versa.

(2) Words and expressions used but not defined in the rules, shall have the same meaning as assigned to them under the Himachal Pradesh Municipal Act, 1994.

3. Making of Parivar Register Record and its Revision.—(1) (a) After Ward Sabha has come into existence in accordance with Section 51-A of the Act, a Parivar Register shall be prepared Ward wise for every Municipal Council/Nagar Panchayat in Form-1 appended to these rules. It shall contain the names and particulars of all persons, family-wise, who are citizen of India and bonafide residents which form part of the Ward Sabha area. The register shall be prepared by the Secretary of the Ward Committee and shall be verified by the Executive Officer of the Municipal Council or Secretary of the Nagar Panchayat, as the case may be.

(b) The Secretary of Ward committee shall cause to conduct door to door survey for enumeration of families of bonafide residents of the ward on Form-II.

(c) The Executive Officer of the Municipal Council /Secretary of Nagar Panchayat, as the case may be shall notify and widely publicize the dates and area of starting of door to door survey in atleast two local newspapers and paste the notice at conspicuous places in the ward and office of Urban Local Bodies. The modalities of conducting such surveys shall be decided by the Director.

(d) The information gathered by door to door survey shall be signed by Secretary, Ward Committee and verified by the Executive Officer of the Municipal Council or Secretary of the Nagar Panchayat, as the case may be.

(e) The draft Parivar Register of each ward of Municipal Council/Nagar Panchayat shall be placed before the House of Municipal Council/Nagar Panchayat. After due approval of the House, the draft Parivar Register of Municipal Council/Nagar Panchayat made after compilation of ward Parivar Registers shall be published in the Rajpatra(e- Gazette) of Himachal Pradesh for objections and suggestions of general public and copy thereof shall also be kept in office of Urban Local Bodies for inspection by general public.

(f) The written objections in Form-III received in office of Urban Local Bodies within one month of publication of Draft Parivar Register shall be caused to be re-verified by Secretary of Ward Committee within 07 days of closing of date of receiving objections by conducting summary inquiry and giving an opportunity of being heard for all the parties concerned. The amendments, if any, shall be incorporated in draft Parivar Register and the same shall be signed by Secretary of Ward Committee and countersigned by the Executive Officer of the Municipal Council or Secretary of the Nagar Panchayat, as the case may be.

(g) Any modification made in draft Parivar Register may be contested by the parties concerned. The appeal in this regard made in writing, within 07 days of the decision of Secretary of Ward Committee shall be heard by Director latest within 01 month and his decision thereof shall be final.

(h) The final Parivar Register so prepared after compilation of verified ward Parivar Register shall be placed in House of Municipal Council/Nagar Panchayat and after approval published in the Rajpatra (e-Gazette), Himachal Pradesh.

(i) For making any correction / modification in respect of Name and Date of Birth, the applicant shall produce documentary proof such as school certificate, gazette record duly issued by the competent authority or affidavit in this regard. Bonafide residents in general and Nepali inhabitants of Urban Local Bodies residing for more than 20 years in the Urban Local Bodies, shall produce documentary proof duly issued by the competent authority. The officer/ official of the Municipal Council/ Nagar Panchayat, to whom this assignment is given by the Executive Officer/ Secretary, after satisfying himself, shall make necessary correction / modification in the record.

(j) When, Parivar Register is finally published in the Rajpatra (e-Gazette), Himachal Pradesh the concerned Executive Officer/ Secretary may provide this facility to general public through online mode.

(2) At the close of each calendar year, the entries in the Parivar Register, required to be prepared under sub-rule (1) shall be revised by the concerned officer and all entries pertaining to births, deaths and marriages shall be updated in the Parivar Register which had taken place during the preceding year i.e. upto 31st day of December. This revision shall be carried out strictly in accordance with the entries recorded in the "Birth and Death Register" and "Marriage Registration Register" maintained by the Municipal Council/ Nagar Panchayat as per the provisions of Registration of Birth and Deaths Act, 1969 and Himachal Pradesh Registration of Marriage Act, 1996, respectively. No other addition or alternation may be made without any authenticated evidence. In the event of division of the family, separation of family may only be entered in the Parivar Register on the decision of the concerned Ward Committee by passing a resolution by majority in its meeting on an application made by the head of family concerned. The Ward Committee shall take into consideration the definition of the family as provided in clause (19-a) of Section 2 while deciding the matter regarding division of family. Verifying Officer, i.e. Secretary of Ward Committee specially designated as such for this purpose by the Executive Officer/Secretary of Municipal Council/Nagar Panchayat to verify these entries after satisfying himself about the reasons recorded by the Secretary of concerned Ward Committee. He shall also put his initials on the Summary Sheet prepared by Secretary of Ward Committee on Form IV. In case of migration from one Urban Local Body to other, and Panchayati Raj Institution to Urban Local Body or vice–versa, the applicant shall obtain report on Form-V from the concerned officer /official Incharge, for making necessary entries in the Parivar Register at the level of ULB:

Provided that no entry with regard to separation of family shall be made in the Parivar Register unless the said family has a separate kitchen and access to the toilet.

(3) The register shall be revised and updated under sub-rule (2) by 31st January of each year by the concerned officer and public notice will be issued to the effect that—

(a) the register has been revised and updated under sub-rule (2);

(b) the register, as revised, is available for public inspection for a period of fifteen days (excepting the public holidays) between 10 AM to 5 PM in the office of the concerned Ward Committee and other conspicuous places in a Municipal Council / Nagar Panchayat area;

(c) if any person has to make any objection with regard to any entry or any omission in the register, he may make the objection to that effect to the Secretary of the concerned Ward Committee within the period of fifteen days. The notice shall be pasted in the office of the Ward Committee /conspicuous places within the territorial jurisdiction of the said Ward of Municipal Council/ Nagar Panchayat area.

(4) The revised entries made in the register under sub-rule (2) and the objections received under sub-rule (3), shall be taken into consideration and disposed of and verified by the Executive Officer/ecretary of Municipal Council /Nagar Panchayat or any official/ officer designated by the Executive Officer/Secretary of Municipal Council/ Nagar Panchayat after having given an opportunity of being heard to the person(s) concerned.

4. Parivar Register Record open to inspection.—(1) Any person may apply for the copies of the entries of the Parivar Register.

(2) Every application for obtaining the copy of the records of the Parivar Register shall be made to the official /officer designated as such for the purpose of supply of certified copies of the record by the Executive Officer /Secretary of Municipal Council /Nagar Panchayat, stating therein the purpose for which the copy is required and shall be accompanied with a fee of Rs.50/-. The requisite record shall be provided to applicant either by post/hand or through online within 07 days positively;

(3) Copying fee shall be charged at the rate of rupee three for every page or fraction thereof which shall be recovered in advance before making the copy applied for:

Provided that no fee shall be charged for the copy of the record from Public Authorities, in case they require the record for official use.

(4) Any person may apply for inspection of the record of the Parivar Register to the Secretary of the Ward Committee concerned. The inspection fee shall be rupees twenty for an hour. The inspection shall be made during the office hour in the office of the Municipal Council/ Nagar Panchayat. The use of pen and ink during inspection is prohibited. The inspection of the record shall be made in the presence of officer/official of the Municipal Council / Nagar Panchayat.

(5) The fee chargeable under this rule shall be paid in cash or any other mode alongwith the application to the official/officer designated as such for the purpose of supply of the certified copy of the record by the Executive Officer/Secretary of Municipal Council/Nagar Panchayat, who shall further get it deposited in the Municipal Fund and forthwith give a receipt under his signature.

(6) The Director may from time to time revise the rates of copying and inspection fee by notification.

5. Power to issue instructions.—The Director may from time to time issue instructions/ clarifications for the smooth implementation of these Rules.

संख्या ः यू0डी0-ए0(3)-4/2022.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर निगम अधिनियम, 1994 (1994 का अधिनियम संख्या 12) की धारा 43 के (फ) के साथ पठित धारा 393 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखित नियम बनाते हैं, अर्थात्‌ः--

1. संक्षिप्त नाम, विस्तार और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगर निगम परिवार रजिस्टर का अनुरक्षण नियम, 2023 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे।

2. परिभाषाएं.--(1) इन नियमोें में, जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से हिमाचल प्रदेश नगर निगम अधिनियम, 1994 अभिप्रेत है;

(ख) ''स्थायी निवासी'' से ऐसा व्यक्ति अभिप्रेत है जिसका हिमाचल प्रदेश में स्थायी आवास है और इसके अन्तर्गत वह व्यक्ति, जो कम से कम 20 वर्ष की अवधि से हिमाचल प्रदेश में रह रहा है या वह व्यक्ति, जिसका हिमाचल प्रदेश में स्थायी आवास है, किन्तु उसके व्यवसाय के कारण वह हिमाचल प्रदेश से बाहर रह रहा है; भी सम्मिलित है;

(ग) ''प्ररूप'' से, इन नियमों से संलग्न प्ररूप अभिप्रेत है;

(घ़) ''सचिव वार्ड समिति'', से आयुक्त द्वारा धारा 44-ख की उप-धारा (2) के अधीन नामनिर्दिष्टि अधिकारी अभिप्रेत है;

(ङ) ''धारा'' से अधिनियम की धारा अभिप्रेत है; और

(च) ''प्रवासन'' से एक शहरी स्थानीय निकाय से दूसरी में और पंचायती राज संस्थानों से शहरी स्थानीय निकायों या विपर्ययेन स्थानान्तरण अभिप्रेत है।

(2) उन शब्दों और पदाें के, जो इन नियमों में प्रयुक्त है, किन्तु परिभाषित नहीं है, के वही अर्थ होंगे, जो हिमाचल प्रदेश नगर निगम अधिनियम, 1994 में क्रमशः उनके हैं।

3. परिवार रजिस्टर का अभिलेख बनाना और उसका पुनरीक्षण.--(1)(क) अधिनियम की धारा 44-क के अनुसार, वार्ड सभा के अस्तित्व में आने के पश्चात्‌, प्रत्येक नगर निगम के लिए प्ररूप-1 में वार्डवार एक रजिस्टर तैयार किया जाएगा। इसमें कुटुम्बवार सभी व्यक्तियों जो भारत के नागरिक हैं के नाम और विवरण सम्मिलित होंगे और वार्ड सभा क्षेत्र का भाग बनने वाले स्थायी निवासी हैं। रजिस्टर वार्ड समिति के सचिव द्वारा तैयार किया जाएगा और आयुक्त द्वारा इस प्रयोजन हेतु विशेष रूप से पदविहित वार्ड समिति के सचिव की पंक्ति में किसी वरिष्ठ अधिकारी द्वारा सत्यापित किया जाएगा।

(ख) वार्ड समिति के सचिव प्ररूप-2 पर वार्ड के स्थायी निवासियों के परिवारों की गणना के लिए घर-घर जाकर सर्वेक्षण संचालित करवाएंगे।

(ग) सत्यापन अधिकारी कम से कम दो स्थानीय समाचार पत्रों में घर-घर सर्वेक्षण आरंभ करने की तारीखें और क्षेत्र को अधिसूचित करेगा और व्यापक रूप से प्रचालित करेगा और वार्ड और निगम के कार्यालय5983 राजपत्र, हिमाचल प्रदेश, 22 अगस्त 2023/31 श्रावण, 1945 में सहज दृश्य स्थानों पर नोटिस चिपकाएगा। ऐसे सर्वेक्षण संचालित किए जाने के तौर-तरीके निदेशक द्वारा विनिश्चित किए जाएंगे।

(घ) घर-घर किए गए सर्वेक्षण द्वारा प्राप्त सूचना को सचिव, वार्ड समिति द्वारा हस्ताक्षरित किया जाएगा और सत्यापन अधिकारी द्वारा सत्यापित किया जाएगा।

(ङ) निगम के प्रत्येक वार्ड का प्रारूप परिवार रजिस्टर निगम सदन के समक्ष रखा जाएगा। सदन के सम्यक्‌ अनुमोदन के पश्चात्‌ वार्ड परिवार रजिस्टर का संकलन करके इसे जनसाधारण के आक्षेपों और सुझावों हेतु, राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किया जाएगा और उसकी एक प्रति जनसाधारण के निरीक्षण हेतु निगम के कार्यालय में रखी जाएगी।

(च) प्रारूप परिवार रजिस्टर के प्रकाशन के एक मास के भीतर निगम के कार्यालय में प्रारूप-3 में प्राप्त लिखित आक्षेपों को वार्ड समिति के सचिव द्वारा आक्षेप प्राप्त करने की तारीख समाप्त होने के 07 दिवस के भीतर संक्षिप्त जांच करवाकर और समस्त सम्बद्ध पक्षकारों को सुनवाई का अवसर प्रदान कर पुनः सत्यापित करवाया जाएगा। संशोधन, यदि कोई हो, प्रारूप परिवार रजिस्टर में निगमित किए जाएंगे तथा उस पर वार्ड समिति के सचिव द्वारा हस्ताक्षर किए जाएंगे और उन्हें सत्यापन अधिकारी द्वारा, प्रतिहस्ताक्षरित किया जाएगा। (छ) प्रारूप परिवार रजिस्टर में किए गए किसी भी उपांतरण का सम्बद्ध पक्षकारों द्वारा विरोध किया जा सकेगा। वार्ड समिति के सचिव के निर्णय के 07 दिन के भीतर इस संबंध मेें लिखित रूप में की गई अपील निदेशक द्वारा विलंबनतम 01 मास के भीतर सुनी जाएगी और उस पर उसका विनिश्चय अंतिम होगा। (छ) सत्यापित वार्ड परिवार रजिस्टर के संकलन के पश्चात्‌ इस प्रकार तैयार किया गया अंतिम परिवार रजिस्टर निगम के सदन में रखा जाएगा और अनुमोदन के पश्चात (इ-गजट), हिमाचल प्रदेश में प्रकाशित किया जाएगा।

(झ) नाम और जन्म तिथि की बाबत कोई सुधार/उपान्तरण करने के लिए आवेदक को दस्तावेज प्रमाण जैसे स्कूल प्रमाण-पत्र, सक्षम प्राधिकारी द्वारा सम्यक्‌ रूप से जारी राजपत्र अभिलेख या इस बाबत शपथ-पत्र प्रस्तुत करना होगा। शहरी स्थानीय निकायों में 20 वर्षाें से अधिक वर्ष से निवास कर रहे शहरी स्थानीय निकायों के स्थायी निवासियों और नेपाली निवासियों को सक्षम प्राधिकारी द्वारा सम्यक्‌ रूप से जारी किए गए दस्तावेजी प्रमाण पत्र प्रस्तुत करने होंगे। नगरपालिका परिषद/नगर पंचायत के अधिकारी/सचिव जिसको आयुक्त द्वारा यह कार्यभार सौंपा गया है, वह स्वयं का समाधान होने के पश्चात्‌ अभिलेख में आवश्यक सुधार/उपान्तरण करेगा।

() जब, परिवार रजिस्टर राजपत्र (ई-गजट), हिमाचल प्रदेश में अंतिम रूप से प्रकाशित हो जाता है, तो आयुक्त ऑनलाइन पद्धति के माध्यम से जन साधारण को यह सुविधा प्रदान कर सकेंगे।

(2) प्रत्येक कलैन्डर वर्ष की समाप्ति पर, उप-नियम (1) के अधीन तैयार किए जाने वाले परिवार रजिस्टर में प्रविष्टियों को सम्बद्ध अधिकारी द्वारा पुनरीक्षित किया जाएगा और जन्म, मृत्यु और विवाह से संबंधित समस्त प्रविष्टियों जो पूर्ववर्त्ती वर्ष के दौरान अर्थात दिसंबर के 31 (इकतीसवें) दिन तक हुई हैं को परिवार रजिस्टर मे अद्यतन किया जाएगा।

यह पुनरीक्षण सदैव क्रमशः जन्म और मृत्यु रजिस्ट्रीकरण अधिनियम, 1969 और हिमाचल प्रदेश विवाह रजिस्ट्रीकरण अधिनियम 1996 कें उपबंधों के अनुसार निगम द्वारा अनुरक्षित ''जन्म और मृत्यु रजिस्टर'' और ''विवाह रजिस्ट्रीकरण रजिस्टर'' में दर्ज प्रविष्टियों के अनुसार किया जाएगा। बिना किसी प्रमाणित साक्ष्य के परिवार रजिस्टर में कोई अन्य परिवर्तन नहीं किया जा सकेगा। कुटुम्ब के बंटवारे की स्थिति में सम्बद्ध कुटुम्ब के मुखिया के आवेदन पर बहुमत से प्रस्ताव पारित कर सम्बद्ध वार्ड समिति के विनिश्चय पर परिवार रजिस्टर में परिवार के अलग होने की प्रविष्टि की जा सकेगी। वार्ड समिति परिवार के विभाजन के संबंध में मामले का विनिश्चय करते समय धारा 2 के खंड (18-क) में उपबंधित कुटुम्ब (परिवार) की परिभाषा को ध्यान में रखेगी। यह सत्यापन अधिकारी अर्थात्‌ वार्ड समिति के सचिव जिसे इस प्रयोजन के लिए विशेष रूप से आयुक्त द्वारा 5984 राजपत्र, हिमाचल प्रदेश, 22 अगस्त 2023/31 श्रावण, 1945 नामित किया गया है, का कर्त्तव्य होगा कि वह इन प्रविष्टियों को सम्बद्ध सचिव, वार्ड समिति द्वारा रिकार्ड किए गए कारणों के बारे में स्वयं का समाधान हो जाने के पश्चात्‌ सत्यापित करे। वह वार्ड समिति के सचिव द्वारा प्रारूप-4 पर तैयार किए गए सारांश-पत्र पर भी अपना हस्ताक्षर करेगा। शहरी स्थानीय निकाय से अन्य निकाय और पंचायती राज संस्थान से शहरी स्थानीय निकाय या विपर्ययेन प्रवास की दशा में आवेदक शहरी स्थानीय निकाय के स्तर पर परिवार रजिस्टर मे आवश्यक प्रविष्टि करने के लिए सम्बद्ध अधिकारी/ शासकीय (अधिकृत) प्रभारी से प्ररूप-5 पर रिपोर्ट प्राप्त करेगाः

परन्तु परिवार के विभाजन की बाबत परिवार रजिस्टर में कोई प्रविष्टि तब तक नहीं की जाएगी जब तक कि उक्त कुटुम्ब के पास अलग रसोई और शौचालय की सुविधा न हो।

(3) सम्बद्ध अधिकारी द्वारा प्रत्येक वर्ष 31 जनवरी तक उप-नियम (2) के अधीन रजिस्टर का पुनरीक्षण और अद्यतन किया जाएगा और इस आशय की सार्वजनिक सूचना जारी की जाएगी कि-- (क) उप-नियम (2) के अधीन रजिस्टर का पुनरीक्षण और अद्यतन किया गया है

(ख) यथा पुनरीक्षित रजिस्टर सार्वजनिक निरीक्षण के लिए सम्बद्ध वार्ड समिति के कार्यालय में और नगर निगम में अन्य सहजदृश्य स्थानों पर पंद्रह दिन की अवधि (सार्वजनिक अवकाश के सिवाए) प्रातः 10 बजे से सायं 5 बजे के मध्य उपलब्ध होगा,

(ग) यदि किसी व्यक्ति को रजिस्टर में किसी प्रविष्टि या किसी लोप की बाबत कोई आक्षेप करना हो तो वह पन्द्रह दिन की अवधि के भीतर सम्बद्ध वार्ड समिति के सचिव को इस आशय का आक्षेप कर सकेगा। नोटिस वार्ड समिति के कार्यालय/नगर निगम क्षेत्र के उक्त वार्ड की क्षेत्रीय अधिकारिता भीतर सहजदृश्य स्थानों पर चस्पां किया जाएगा।

(4) उप नियम (2) के अधीन रजिस्टर में की गई पुनरीक्षित प्रविष्टियां और उप-नियम (3) के अधीन प्राप्त आक्षेपों पर विचार किया जाएगा और नगर निगम के सचिव या आयुक्त द्वारा किसी पदाविहित अधिकारी/कर्मचारी द्वारा सम्बद्ध व्यक्ति को सुनवाई का अवसर देने के पश्चात्‌ निपटाया जाएगा और सत्यापित किया जाएगा।

4. परिवार रजिस्टर अभिलेख का निरीक्षण के लिए खुला रहना.--(1) कोई भी व्यक्ति परिवार रजिस्टर की प्रविष्टियों की प्रतियों के लिए आवेदन कर सकेगा।

(2) परिवार रजिस्टर के अभिलेख की प्रति प्राप्त करने के लिए, प्रत्येक आवेदन आयुक्त द्वारा अभिलेख की प्रमाणित प्रतियों की आपूर्ति के प्रयोजन के लिए पदाविहित कर्मचारी/अधिकारी को किया जाएगा तथा उसमें उस प्रयोजन जिसके लिए प्रति की आवश्यकता है, को स्पष्ट किया जाएगा और जिसके साथ 50/- रुपये की फीस सलंग्न की जाएगी। अपेक्षित अभिलेख आवेदक को डाक/दस्ती से या ऑनलाइन के माध्यम से 07 दिन के भीतर निश्चित रूप से प्रदान किया जाएगा।

(3) प्रति प्रष्ठया उसके भाग(अंश) के लिए प्रति तीन रुपए की जाएगी, जो प्रतिलिपि आवेदन करने से पूर्व अग्रिम रूप से वसूल की जाएगीः

परन्तु सार्वजनिक प्राधिकरणों से अभिलेख की प्रतिलिपि के लिए कोई फीस प्रभारित नहीं की जाएगी, यदि उन्हें शायकीय उपयोग के लिए अभिलेख की आवश्यकता है।

NOTIFICATION

Shimla-2, the 10th August, 2023

No. UD-A(3)-4/2022.—In exercise of the powers conferred by Section 393 read with Section 43 (v) of the Himachal Pradesh Municipal Corporation Act, 1994 (Act. No. 12 of 1994), the Governor of Himachal Pradesh is pleased to make the following rules, namely:—

1. Short title, extent and commencement.—(1) These rules may be called the Himachal Pradesh Municipal Corporation Maintenance of Parivar Register Rules, 2023.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette) Himachal Pradesh.

2. Definitions.—(1) In these rules, unless the context otherwise requires,—

(a) "Act" means the Himachal Pradesh Municipal Corporation Act, 1994;

(b) "Bonafide resident" means a person who has a permanent home in Himachal Pradesh and includes a person who has been residing in Himachal Pradesh for a period of not less than 20 years or a person who has permanent home in Himachal Pradesh but on account of his occupation he is living outside Himachal Pradesh;

(c) "Form" means a Form appended to these rules;

(d) "Secretary of Ward Committee" means the Officer nominated by the Commissioner under sub-section (2) of section 44-B;

(e) "Section" means a section of the Act; and

(f) "Migration" means shifting from one Urban Local Bodies to other and Panchayati Raj Institution to Urban Local Bodies or vice–versa.

(2) Words and expressions used but not defined in the rules, shall have the same meaning as assigned to them under the Himachal Pradesh Municipal Corporation Act, 1994.

3. Making of Parivar Register Record and its Revision.—(1) (a) After a Ward Sabha has come into existence in accordance with section 44-A of the Act, a Parivar Register shall be prepared Ward wise for every Municipal Corporation in Form-I. It shall contain the names and particulars of all persons, family-wise, who are citizens of India and bonafide residents which forms part of the Ward Sabha area. The register shall be prepared by the Secretary of the Ward Committee and shall be verified by a Verifying Officer senior in rank to the Secretary of Ward Committee specially designated as such for this purpose by the Commissioner.

(b) The Secretary of Ward Committee shall cause to conduct door to door survey for enumeration of families of bonafide residents of the ward on Form-II.

(c) The Verifying Officer shall notify and widely publicize the dates and area of starting of such door to door survey in atleast two local newspapers and paste the notice at conspicuous places in the ward and office of Corporation. The modalities of conducting such surveys shall be decided by the Director.

(d) The information gathered by door to door survey shall be signed by Secretary, Ward Committee and verified by Verifying Officer.

(e) The draft Parivar Register of each ward of Corporation shall be placed before the House of Corporation. After due approval of the House, the draft Parivar Register of Corporation made after compilation of ward Parivar Registers shall be published in the Rajpatra(e-Gazette), Himachal Pradesh for objections and suggestions of the general public ,and a copy thereof shall also be kept in office of Corporations for inspection by general public.

(f) The written objections in Form-III received in office of Corporation within one month of publication of Draft Parivar Register shall be caused to be re-verified by Secretary of Ward Committee within 07 days of closing of date of receiving objections by conducting summary inquiry and giving an opportunity of being heard for all the parties concerned. The amendments, if any, shall be incorporated in draft Parivar Register and the same shall be signed by Secretary, Ward Committee and countersigned by Verifying Officer.

(g) Any modification made in draft Parivar Register may be contested by parties concerned. The appeal in this regard made in writing within 7 days of the decision of Secretary, Ward Committee shall be heard by Director latest within 01 month and his decision thereon shall be final.

(h) The final Parivar Register so prepared after compilation of verified ward Parivar Registers shall be placed in House of Corporation and after approval published in Rajpatra (e-Gazette).

(i) For making any correction / modification in respect of Name and Date of Birth, the applicant shall produce documentary proof such as school certificate, gazette record duly issued by the competent authority or affidavit in this regard. Bonafide residents and Nepali inhabitants of Urban Local Bodies residing for more than 20 years in the Urban Local Bodies, shall produce documentary proof duly issued by the competent authority. The officer/ official of the Corporation, to whom this assignment is given by the Commissioner, after satisfying himself, shall make necessary correction / modification in the record.

(j) When, Parivar Register is finally published in the Rajpatra (e-gazette), Himachal Pradesh, the Commissioner may provide this facility to general public through online mode.

(2) At the close of each calendar year, the entries in the Parivar Register, prepared under sub-rule (1) shall be revised by the concerned officer and all entries pertaining to births, deaths and marriages shall be updated in the Parivar Register which had taken place during the preceding year i.e. upto 31st day of December. This revision shall be carried out strictly in accordance with the entries recorded in the Birth and Death Register and Marriage Registration Register maintained by the Corporation as per the provisions of Registration of Births and Deaths Act, 1969 and Himachal Pradesh Registration of Marriages Act, 1996 respectively. No other alternation may be made in the Parivar Register without any authenticated evidence. In the event of division of the family, separation of family may only be entered in the Parivar Register on the decision of the concerned Ward Committee by passing a resolution by majority in its meeting on an application made by the head of family concerned. The Ward Committee shall take into consideration the definition of the family as provided in clause (18-a) of section 2 while deciding the matter regarding division of family. It shall be the duty of the Verifying Officer senior in rank to the Secretary of Ward Committee specially designated as such for this purpose by the Commissioner, to verify these entries after satisfying himself about the reasons recorded by the Secretary of concerned Ward Committee. He shall also put his initials on the Summary Sheet prepared by Secretary of Ward Committee on Form-IV. In case of migration from one Urban Local Body to other and Panchayati Raj Institution to Urban Local Body or vice–versa, the applicant shall obtain report on Form-V from the concerned officer /official Incharge, for making necessary entries in the Parivar Register at the level of Urban Local Bodies:

Provided that no entry with regard to separation of family shall be made in the Parivar Register unless the said family has a separate kitchen and access to the toilet.

(3) The register shall be revised and updated under sub- rule (2) by 31st January of each year by the concerned officer and public notice will be issued to the effect that–

(a) the register has been revised and updated under sub-rule (2);

(b) the register, as revised, is available for public inspection for a period of fifteen days (excepting the public holidays) between 10 AM to 5 PM in the office of the concerned Ward Committee and other conspicuous places in a Municipal Corporation area;

(c) if any person has to make any objection with regard to any entry or any omission in the register, he may make the same to the Secretary of the concerned Ward Committee within the period of fifteen days. The notice shall be pasted in the office of the Ward Committee /conspicuous places within the territorial jurisdiction of the said Ward of Municipal Corporation area.

(4) The revised entries made in the register under sub-rule (2) and the objections received under sub-rule (3), shall be taken into consideration and disposed of and verified by the Secretary 5990 राजपत्र, हिमाचल प्रदेश, 22 अगस्त 2023/31 श्रावण, 1945

of the Corporation or any official /officer designated by the Commissioner after having given an opportunity of being heard to the person(s) concerned.

4. Parivar Register Record open to inspection.—(1) Any person may apply for the copies of the entries of the Parivar Register.

(2) Every application for obtaining the copy of the records of the Parivar Register shall be made to the official/officer designated as such for the purpose of supply of the certified copies of the record by the Commissioner, stating therein the purpose for which the copy is required and shall be accompanied with a fee of Rs.50/-.The requisite record shall be provided to applicant either by post /hand or through online within 07 days positively.

(3) Copying fee shall be charged at the rate of rupees three for every page or fraction thereof which shall be recovered in advance before making the copy applied for:

Provided that no fee shall be charged for the copy of the record from public authorities, in case they require the record for official use.

(4) Any person may apply for inspection of the record of the Parivar Register to the Secretary of the Ward Committee concerned. The inspection fee shall be rupees twenty for an hour. The inspection shall be made during the office hour in the office of the Corporation. The use of pen and ink during inspection is prohibited. The inspection of the record shall be made in the presence of officer /official of the Corporation.

(5) The fee chargeable under this rule shall be paid in cash or by any other mode alongwith the application to the official /officer designated as such for the purpose of supply of the certified copies of the record by the Commissioner, who shall further get it deposited in the Corporation Fund forthwith and give a receipt under his signature.

(6) The Director may from time to time revise the rates of copying and inspection fee by notification.

5. Power to issue instructions.—The Director may from time to time issue instructions/ clarifications for the smooth implementation of these rules.

विषय.--दुरुस्ती नाम हि0 प्र0 रा0 अधिनियम, 1954 की जेर धारा 37 के तहत महाल रैत में नाम दुरुस्ती बारे।

उपरोक्त मुकद्दमा बारे प्रार्थिया ने इस न्यायालय में प्रार्थना-पत्र गुजारा है जिसमें लिखा है कि उसके पिता का सही नाम सुरेन्द्र कुमार पुत्र चुनी लाल है लेकिन राजस्व रिकार्ड महाल रैत में रविन्द्र कुमार पुत्र चुनी लाल चला हुआ है जोकि गलत इन्द्राज हुआ है। प्रार्थिया उक्त नाम को दुरुस्त करवाकर महाल रैत में रविन्द्र कुमार उर्फ सुरेन्द्र कुमार पुत्र चुनी लाल करवाना चाहती है।

अतः उक्त प्रार्थना-पत्र के सन्दर्भ में उपरोक्त नाम की दुरुस्ती बारे किसी को कोई एतराज हो तो वह असालतन या वकालतन इस अदालत में दिनांक 24-08-2023 को दोपहर बाद 2.00 बजे हाजिर आ सकता है। हाजिर न आने की स्थिति में एकतरफा कार्यवाही अमल में लाई जाकर आगामी आदेश पारित कर दिए जाएंगे और बाद में कोई भी उजर या एतराज जेरे समायत न होगा।
