No. SJE-A-(F)1/1/2016.—In Supersession of all previous notifications of this department No. SJE-A-F(1)3/2011, dated 29-02-2016, No. SJE-A(F)1/1/2016, dated 10-03-2017, and 8-06-2019, the Governor, Himachal Pradesh is pleased to issue the revised guidelines for the appointment of Anganwadi Workers/Mini Anganwadi Workers/Helpers under ICDS Programme in Himachal Pradesh as per Annexure-A.

The above guidelines shall come into force from the date of issue of this Notification.

Annexure-A Scheme/Guidelines for the engagement of the Anganwadi Workers/Mini Anganwadi Workers/Helpers on honorary basis under ICDS scheme run by Social Justice & Empowerment Department.

(I) Selection procedure

1. Objectives

(a) To fulfill the objective of delivery Anganwadi Services Scheme and to ensure regular integrated delivery of package of services to all eligible beneficiaries (\[Children upto the age of 6 Years, Pregnant Women and Lactating Mothers and adolescent girls (14-18 Years) in Aspirational District] through the platform of Anganwadi Centres by Anganwadi workers and Anganwadi Helpers under the scheme.

(b) Under the scheme Anganwadi Workers and Anganwadi Helpers considers as "Honorary Worker" from the local community who come forward to render their services on part-time basis in the area of child care and development on fixed monthly honorarium as decided by the Centre /State Govt. from time to time.

2. Screening Committee

The engagement of Anganwadi Workers, Mini Anganwadi worker and Helpers shall be made by the following Screening committee:—

1. Sub-Divisional Officer (Civil) Chairman 2. Child Dev. Project Officer, Member (concerned project) (custodian of all records).

3. Tehsil Welfare Officer/Statistical Assistant Member 3. Honorarium

The Anganwadi Workers, Mini Anganwadi Workers and Helpers will be paid monthly honorarium on the rates given below and rate of honorarium will be subject to change from time to time by Centre and State Govt.:—

(a) Anganwadi Worker = Rs. 9500/P.M.

(b) Mini Anganwadi Worker = Rs. 6600/ P.M.

(c) Anganwadi Helper = Rs. 5200/ P.M.

4. Eligibility Criteria Only such female candidates are eligible to apply for the

post of Anganwadi Worker/Mini Anganwadi Worker or Helper who are:

(a) Normal residents of the feeding area of the concerned Anganwadi Centre.

If the candidates are not available within the feeder area of Anganwadi Centre, applications can be invited from the desirous candidates residing within the area of the concerned Gram Panchayats of feeder area of the particular Anganwadi Center and if the candidates are not available in the Gram Panchayat concerned of Anganwadi Centre, then applications can be invited from the desirous candidates residing within the adjoining Gram Panchayts which are located in the concerned project.

` (b) Minimum prescribed qualification for Anganwadi Worker, Mini Anganwadi worker and Anganwadi Helper shall be 10+2.

(c) Age between 18-35 years as on the last date of advertisement.

(d) The annual income of the family of candidate does not exceed Rs. 50,000/- Per annum to be certified/countersigned by an officer not below the rank of Naib Tehsildar/ Tehsildar/ Executive Magistrate.

(Exemption of honorarium of Anganwadi Helper from the income criteria if she applies for the post of Anganwadi helper).

5. Advertisement of Vacancies

The vacancies of Anganwadi Workers/Mini Anganwadi Workers and Helpers shall not be notified through the Employment Exchange. The Child Development Project Officer will call applications for engagement of Anganwadi Workers/ Mini Anganwadi Workers /Helpers by formally advertising the vacancies through News Papers and Akashwani. Publicity of vacancies shall also be made through ICDS Supervisors/Chairman Panchayat Samiti/Members Panchayat Samiti/Pradhan Gram Panchayat/Secretary Notified Area Committee /Municipal Committee (in case of Urban Anganwadi Centres)/Mahila Mandal members residing in the Anganwadi area/feeder area. Notice of vacancy shall also be notified in writing to all members of Panchayat Samiti and Panchayat/ Municipality and on the notice board of Deputy Commissioner office/local Sub- divisional Magistrate office and Child Development Project Office. Minimum 20 days shall be given to submit the application by the candidate and screening shall be done within the 10 days from the last date of receiving applications.

List of feeder area (Sub villages) of concerned AWCwill be displayed on the Notice Boards of Panchayat Samiti/Gram Panchayat/Secretary Notified Area Committee/Municipal Committee (in case of Urban Anganwadi Centres)offices to enable the eligible candidate to apply for posts/vacancies. Procedure for appointment and distribution of marks shall also be published in the same letter/notice.

Provided, where the post of Anganwadi Worker has fallen vacant due to any reason and the matter is not subjudice then Anganwadi Helper of that AWC with 5 years of experience shall be promoted as Anganwadi worker subject to6149 राजपत्र, हिमाचल प्रदेश, 28 अगस्त 2023/06 भाद्रपद, 1945 fulfilment of educational qualifications, track record of service, additional qualification and age criteria., with the prior approval of screening committee and subject to the condition that overall no. of posts of Anganwadi Workers being filled by way of promotion from amongst Anganwadi Helpers at any point of time shall not be more than 50%.

The Child Development Project Officer shall maintain the separate record of such Anganwadi Workers.

6. Applications

The desirous candidates will have to apply on plain paper to the Child Development Project Officer concerned and receipt will be given to all the applicants by the O/O CDPO. The applicants will be required to bring the testimonials/certificates on the day of screening, which will be screened by the Screening Committee and the applicants having the requisite documents/ testimonials will be eligible to appear for the screening. However, the Screening Committee will give speaking remarks about non eligibility of the candidates to be recorded on the merit list in remarks column.

7. Marks

Selection shall be based on merit out of the total marks of 16. Marks will be awarded as follows:—

1. Anganwadi Workers /Mini Anganwadi Workers and Helpers

(A) Maximum 9 Marks for educational qualification will be given in the following manner.—(i) Percentage of Marks in 10+2 subject to the Maximum of 7 marks on pro rata basis.

(ii) Additional Two Marks for graduation.

(Graduation degree in any discipline from a recognised university. If Graduation degree has been acquired through Open Distance Learning Mode(ODL), their Graduation degree should be strictly as per the norms of UGC- Distance Education).

(B) Maximum 2 Marks for experience as Anganwadi Worker/Mini Anganwadi Worker/Anganwadi Helper (One mark for each complete year of service subject to maximum of 2 marks).

(C) 1 mark for disabled women having 40% and above disability subject to the condition that the type of disability is not such as to hamper the discharge of her job responsibility.

(D) 1 mark for SC/ST/ OBC candidates.

(E) 3 marks for State Home Inmates/ Balika Ashram Inmates/ Orphans/ Widows/ Destitute/Divorcees/Married women whose husband are untraceable for the last 7 years/Women deserted by their husbands and who are living with their parents/ Ekal Nari.

Total 16 mark6150 राजपत्र, हिमाचल प्रदेश, 28 अगस्त 2023/06 भाद्रपद, 1945 In case of tie date of birth shall be taken into consideration and eldest will be selected and same procedure will be adopted for maintaining waiting list.

8. Finalization & Declaration of result

The result will be declared by the Screening Committee within one day of the completion of all screening. The copy of Declaration of result will be pasted on the notice board of the all Committee members/ concerned Panchayats /Wards.

9. Orders

On the basis of result, engagement of the selected Anganwadi Worker/Mini Anganwadi Workers and Helper will be done by the concerned Child Development Project Officer within a week of the declaration of result.

10. Panel

For every selected/engaged candidate, one candidate who is next in merit will be kept in waiting. This waiting list will be valid for 6 months after the selection process is over. Candidate kept in waiting may be engaged if the selected candidate does not join or leaves the job within 6 months of engagement. In the eventuality of Court cases this waiting list will be valid for a period of 45 days after final order is passed by the Hon'ble Court in the matter.

11. Relaxation of eligibility

No exemption will be given.

12. Appeal against selection

12.1 First and final appeal by any aggrieved candidate can be made to the concerned Deputy Commissioner within 45 days from the date of appointment provided that the Deputy Commissioner may delegate the power to ADM/ADC.

12.2 However, Deputy Commissioner/ADM/ADC shall be the competent Authority for condonation of delay up to 15 days only in filing appeal.

12.3 A separate register of appeals relating to the appointment of Anganwadi Workers/Mini Anganwadi Workers/helpers shall be maintained by the Child Development Project Officers in which event wise entry will be done.

II Terms and Conditions of Services

1. Duties

The Anganwadi Workers/Mini Anganwadi Workers and Helpers will be responsible to perform all duties/responsibilities related to ICDS and Women Empowerment Programme, as per ICDS manual and instructions issued by the Centre and State Govt. from time to time.

2. Training

The engaged Anganwadi Worker/ Mini Anganwadi Workers and Helper will have to undergo prescribed job training/orientation and refresher courses from time to6151 राजपत्र, हिमाचल प्रदेश, 28 अगस्त 2023/06 भाद्रपद, 1945 time. The worker will have to undergo job training within one year from the date of joining as worker. If she fails to under go job training within the stipulated period, her engagement will be cancelled. If any worker fails twice in job training she will have to undergo job training from her own expenses.

3. Leave

The Workers /Helpers shall be entitled for leave as per guidelines issued by the Government of India from time to time.

4. Transfer/Adjustment of the Anganwadi Workers/ Helpers

Under Anganwadi Service Scheme there is no provision of transfer of Anganwadi Workers/Helpers as these are honorary workers. However, only in case of Marriage/Divorce of AWW or AWH some adjustments/Transfer can be done as follows only once in a life time, subject to the condition that a vacancy exists/ arises at the place of her husband's normal place of residence/place of marriage or within the Panchayat area concerned, she can be adjusted on her request made within 30 days from date of vacancy arising or date of marriage as the case may be. Divorce/ destitute women living with their parents in Anganwadi area, but working at the place of marriage can be transferred to the place of Anganwadi falling in the parental area or within the Panchayat area in a similar manner subject to the availability of vacancy.District Programme Officer will be the competent authority to order transfer/adjustment of Anganwadi Worker/Helpers within the District. Outside district transfers will be done with the approval of Director WCD.

5. Resignation

(a) In case of permanent shifting of the Anganwadi Worker/Mini Anganwadi Workers or Helper from Anganwadi Area due to her marriage or otherwise, if there is disruption in the delivery of services she will have to resign within a month. In case she does not resign, services will be terminated as per rule 7 of part II of the guidelines.

(b) The Anganwadi Worker/Mini Anganwadi Worker/Helper will submit her resignation to the Child Development Project Officer and an opportunity of 156152 राजपत्र, हिमाचल प्रदेश, 28 अगस्त 2023/06 भाद्रपद, 1945 days be given to the Anganwadi Worker/Mini Anganwadi Worker/ Helper for her final decision about her resignation. CDPO concerned shall be the competent authority to accept the resignation under intimation to concerned District Programme Officer.

Once the resignation is accepted by the concerned CDPO will not be revocable.

6. Age of retirement

All the Anganwadi Workers/Mini Anganwadi Workers/ Helpers will be retired uniformly on 30th April of each year, after attaining the age of 60 years. The retirement orders will be issued by the concerned Child Development Project Officer.

7. Removal

Anganwadi Worker/Mini Anganwadi Worker and Helper are honorary workers. For any act of misconduct, misbehaviour, more than 30 days disruption of services and for non-performance of her duties, the services of an Anganwadi Worker/Mini Anganwadi Worker or Helper can be terminated after serving three notices in the interval of 15 days citing reasons to be recorded in writing. The termination order will be issued by the concerned Child Development Project Officer with the prior approval of Director (WCD).

(List of misconduct is attached as Annexure "B")

8. Rights to claim Regular Appointment

The candidate engaged as Anganwadi Worker or Helper shall have no right to claim regularization/absorption /appointment as regular Govt. employee of the State Govt.

9. Right of amendments

The Govt. of Himachal Pradesh shall have the right to amend any of the provisions mentioned in the above scheme in public interest.

10. Repeal

All previous instructions/guidlines issued regarding appointment of Anganwadi Workers /Helpers will stand repealed from the date of publication of above scheme.

11. Cancellation of Appointment:

If the appointed Anganwadi Worker/Mini Anganwadi worker/Helper found ineligible as per para 4 of Part I of the scheme at the time of Screening at any stage, her appointment shall be cancelled by the concerned CDPO after the review of the selection by the screening committee. .

The following acts, conduct and commissions of an Anganwadi worker/Mini

Anganwadi worker and Anganwadi Helper amount to misconduct:

1. If the act of conduct is prejudicial or likely to be prejudicial to the interests of her superior or to the reputation of the superior/higher authorities.

2. If the act or conduct is inconsistent or incompatible with due or peaceful discharge of her duty to her superior.

3. If the act or conduct makes it unsafe for employer to retain her in service.

4. If the act or conduct is so grossly immoral that all reasonable persons will say that the Anganwadi worker/Mini Anganwadi worker and Anganwadi Helper cannot be trusted.

5. If the act or conduct is such that superior cannot rely on the faithfulness of her.

6. If the act or conduct is such as to open before her temptations for not discharging her duty properly.

7. If she is abusive or if she disturbs the peace at the place of her employment.

8. If she is insulting and insubordinate to such a degree as to be incompatible with the continuance of superior and subordinate.

9. If she is habitually negligent in respect of the duties for which she is engaged.

10. If the neglect of her, though isolated, tends to cause serious consequences.

11. Wilful insubordination or disobedience, whether alone or in combination with others, to any lawful and reasonable order of a superior.

12. Infidelity, unfaithfulness, dishonesty, untrustworthiness, theft and fraud, or dishonesty in connection with the government business or property.

13. Strike, picketing, gherao, striking work or inciting others to strike work in contravention of the previsions of any law, or rule having the force of law.

14. Gross moral misconduct, acts subversive of discipline, riotous or disorderly behaviour during working hours at the establishment or any act subversive of discipline.

15. Riotous and disorderly behaviour during and after the Anganwadi Center hours or in Anganwadi premises.

16. Habitual late attendance.

17. Negligence or neglect of work or duty amounting to misconduct- habitual negligence or neglect of work.

18. Habitual absence without permission and overstaying leave.

19. Conviction by a Criminal Court.

प्रार्थना-पत्र नाम दुरुस्ती प्रार्थिया कृष्णा ठाकुर पुत्री श्री तारा चन्द, निवासी महाल चताड़ा, तहसील व जिला ऊना (हि0प्र0) ने इस अदालत में प्रार्थना-पत्र दायर किया है कि उसका नाम महाल चताड़ा की जमाबन्दी साल 1978-79 के खाता/खतौनी नं0 66/87 के खसरा नं0 1142 में कृष्णा देवी पुत्री तारा सिंह दर्ज है जबकि उसका नाम कृष्णा ठाकुर पुत्री श्री तारा चन्द है। लिहाजा इसे दुरुस्त करके कृष्णा देवी उर्फ कृष्णा ठाकुर पुत्री श्री तारा सिंह उपनाम तारा चन्द किया जाये। प्रार्थिया का शपथ-पत्र, नकल आधार कार्ड, नकल राशन कार्ड, नकल बचत खाता पास बुक, नकल चुनाव पहचान पत्र मिसल साथ सलंग्न हैं।6171 राजपत्र, हिमाचल प्रदेश, 28 अगस्त 2023/06 भाद्रपद, 1945 अतः इस नोटिस इश्तहार राजपत्र हि0प्र0 मुश्त्री मुनादी व चस्पांगी के माध्यम से आम जनता तथा सम्बन्धिज रिश्तेदारों को सूचित किया जाता है कि अगर किसी को उपरोक्त नाम दुरुस्ती बारे कोई उजर/एतराज हो तो अधोहस्ताक्षरी के न्यायालय में असालतन या वकालतन हाजिर होकर एक माह के अन्दर पेश कर सकता है अन्यथा उपरोक्त नाम दुरुस्त करने के आदेश जारी कर दिऐ जायेंगे। उसके उपरान्त कोई एतराज न सुना जायेगा।
