संख्याः टी.पी.टी.-ए(3)8/2003.--हिमाचल प्रदेश के राज्यपाल, मोटर यान अधिनियम, 1988 (1988 का 59) की धारा 138 के साथ पठित धारा 212 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, इस विभाग की अधिसूचना संख्याः 5-24/88-टी.पी.टी-III, तारीख 12 जुलाई, 1999 द्वारा अधिसूचित और राजपत्र (असाधारण), हिमाचल प्रदेश में तारीख 27 जुलाई, 1999 को प्रकाशित हिमाचल प्रदेश मोटर यान नियम, 1999 का और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और इन्हें एतद्‌द्वारा तद्‌द्वारा सम्भाव्य प्रभावित होने वाले जनसाधारण की सूचना के लिए राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किया जाता है;

यदि इन नियमों से संभाव्य प्रभावित होने वाले किसी हितबद्ध व्यक्ति को, इन नियमों की बाबत, कोई आक्षेप या सुझाव है/हैं, तो वह लिखित आक्षेप(पों) या सुझाव (वों) को उक्त प्रारूप नियमों के राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर, प्रधान सचिव (परिवहन), हिमाचल प्रदेश सरकार, आम्र्जडेल भवन, शिमला-2 को भेज सकेगा;

नियत अवधि के भीतर प्राप्त हुए आक्षेप या सुझाव, यदि कोई हों, पर हिमाचल प्रदेश सरकार द्वारा उक्त प्रारूप नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा।

प्रारूप नियम

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश मोटर यान (संशोधन), नियम, 2023 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. नियम 193 का प्रतिस्थापन.--हिमाचल प्रदेश मोटर यान नियम, 1999 के नियम 193 के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"193 सुरक्षात्मक हेड गियर का उपयोग.--

(1) अधिनियम की धारा 2 के खण्ड (27) के अधीन यथा परिभाषित किसी भी वर्ग या विवरण की मोटर साइकिल को चलाने वाला या सवार या उस पर ले जाया जा रहा चार वर्ष की आयु के ऊपर का प्रत्येक व्यक्ति सार्वजनिक स्थान पर भारतीय मानक ब्यूरो अधिनियम, 1986 के अधीन भारतीय मानक ब्यूरो द्वारा विहित/उपबंधित विनिर्देशनों के अनुरूप सुरक्षात्मक हेड गियर पहनेगा।

(2) राज्य में कोई भी भारतीय मानक ब्यूरो अधिनियम, 1986 के अधीन भारतीय मानक ब्यूरो द्वारा विहित विनिर्देशनों के अनुरूप दो हैड गियर की खरीद हेतु प्राधिकृत रसीद प्रस्तुत किये बिना मोटर साइकिल रजिस्ट्रीकृत नहीं होगा।"

NOTIFICATION

Shimla-2, the 30th August, 2023

No. TPT-A(3)8/2003.—In exercise of the powers conferred by Section 212 read with Section 138 of the Motor Vehicles Act,1988 (59 of 1988), the Governor of Himachal Pradesh proposes to make the following rules further to amend Himachal Pradesh Motor Vehicles Rules, 1999, notified vide this department Notification No. 5-24/88-Tpt-III, dated 12th July, 1999 and published in Rajpatra, Himachal Pradesh (Extra- Ordinary) dated 27th July, 1999 and the same are hereby published in Rajpatra (e-Gazette), Himachal Pradesh for information of the general public likely to be affected thereby;

If any person likely to be affected by these rules, has any objection(s) or suggestion(s) to make with regard to these rules, he may send the written objection (s) or suggestion(s) to the Principal Secretary (Transport) to the Government of Himachal Pradesh, Armsdale Building, Shimla-2 within a period of thirty days from the date of publication of the said draft rules in the Rajpatra (e-Gazette), Himachal Pradesh;

Objection(s) or suggestion(s), if any, received within the stipulated period, shall be considered by the Government of Himachal Pradesh, before finalizing the draft rules, namely:—

Draft Rules

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Motor vehicle (Amendment) Rules, 2023.

(2) These rules shall come into force from the date of publication in Rajpatra (e-Gazette), Himachal Pradesh.

2. Substitution of rule 193.—For rule 193 of the Himachal Pradesh Motor Vehicles Rules, 1999, the following shall be substituted, namely:—

" 193-Use of Protective head gear.—

(1) Every person, above four years of age, driving or riding or being carried on a motor cycle of any class or description as defined under Clause (27) of Section 2 of the Act shall, while in a public place, wear protective headgear conforming/provided to specifications prescribed by the Bureau of Indian Standards under the Bureau of Indian Standards Act, 1986.

(2) No Motor cycle shall be registered in the State without the production of authorized receipt for purchase of two numbers of headgears conforming to specifications6358 राजपत्र, हिमाचल प्रदेश, 08 सितम्बर 2023/17 भाद्रपद, 1945 prescribed by the Bureau of Indian Standards under the Bureau of Indian Standards Act, 1986".
