संख्याः एएचवाई-ए(3)-3/2018-पी-I.—हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश गौजातीय प्रजनन अधिनियम, 2019 की धारा 30 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाते है, अर्थातः--8973 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश गौजातीय प्रजनन (गोजातीय वीर्य के उत्पादन, विक्रय और —त्रिम गर्भाधान सेवाओं का विनियमन) नियम, 2023 है। (2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से लागू होंगे। 2. परिभाषाएं.--(1) इन नियमों में, जब तक कि सन्दर्भ में अन्यथा अपेक्षित न हो,-

(क) ''अधिनियम'' से हिमाचल प्रदेश गौजातीय प्रजनन अधिनियम, 2019 (2019 का अधिनियम संख्यांक 7) अभिप्रेत है;

(ख) ''बोर्ड'' से हिमाचल प्रदेश पशुधन और कुक्कट विकास बोर्ड अभिप्रेत है;

(ग) ''सदस्य'' से सरकार द्वारा अधिसूचित गौजातीय प्रजनन प्राधिकरण का सदस्य अभिप्रेत है;

(घ) ''न्यूनतम मानक प्रोटोकॉल (एम एस पी)'' से प्राधिकरण द्वारा विहित और सरकार द्वारा किसी वीर्य स्टेशन के समस्त प्रचालनों के लिए समय-समय पर अधिसूचित न्यूनतम मानक अभिप्रेत है;

(ङ) ''नियम'' से हिमाचल प्रदेश गौजातीय प्रजनन (गौजातीय वीर्य के उत्पादन विक्रय और —त्रिम गर्भाधान सेवाओं का विनियमन) नियम, 2023 अभिप्रेत है; और

(च) ''—त्रिम गर्भाधान (वीर्यरोपण) के लिए मानक प्रचालन प्रक्रिया'' से प्राधिकरण द्वारा विहित और —त्रिम गर्भाधान (वीर्यरोपण) संचालन के लिए समय-समय पर सरकार द्वारा अधिसूचित मानक अभिप्रेत है।

(2) उन समस्त अन्य शब्दों और पदों के, जो इन नियमों में प्रयुक्त हैं किन्तु परिभाषित नहीं हैं, वही अर्थ होंगे जो अधिनियम में क्रमशः उनके हैं;

3. प्राधिकरण के मनोनीत सदस्यों की अर्हता और अनुभव.--अधिनियम की धारा 3 की उप-धारा (2) के खण्ड (ङ) और (च) के अधीन कोई भी व्यक्ति सरकार द्वारा तब तक मनोनीत नहीं किया जाएगा, जब तक कि उसके पास निम्नलिखित अर्हता और अनुभव न होः--

(i) प्रख्यात पशु चिकित्सक, कोई ख्याति प्राप्त पशु प्रजनन वैज्ञानिक होगा, जो पशु चिकित्सा विज्ञान में स्नातकोत्तर हो या पशु प्रजनन और आनुवंशिक या पशु पुनरूत्पत्ति में पी. एच. डी. की उपाधि रखता हो और जिसने —षि विश्वविद्यालय या पशु चिकित्सा विश्वविद्यालय या पशु पालन विभाग में कम से कम पन्द्रह वर्ष की सेवा की हो।

(ii) प्रख्यात गौजातीय प्रजनक एक ख्याति प्राप्त प्रजनक होगा, जो गौजातीय प्रजनन क्रिया-कलाप में संलिप्त हो और जिसके पास गौजातीय प्रजनन के क्षेत्र में 15 वर्ष का अनुभव हो।

4. सदस्यता नामावली.--प्राधिकरण का सदस्य सचिव सदस्यों की नामावली रखेगा और प्राधिकरण का प्रत्येक सदस्य नामावली पर हस्ताक्षर करेगा तथा उसमें पद, व्यवसाय और पते का उल्लेख करेगा। सम्बद्ध सदस्य अपने पते में किसी भी परिवर्तन की सूचना देगा और इसे सदस्य सचिव द्वारा सदस्यों की नामावली में अभिलिखित किया जाएगा।

5. प्राधिकरण की बैठकें.--

(i) प्राधिकरण की प्रत्येक बैठक की अध्यक्षता अध्यक्ष द्वारा की जाएगी और उसकी अनुपस्थिति में सदस्य सचिव द्वारा की जाएगी। 8974 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 (ii) प्राधिकरण का सदस्य-सचिव बैठक की कार्य सूची परिचालित करेगा और प्राधिकरण की कार्यवाही का अभिलेख रखेगा।

(iii) प्राधिकरण प्रत्येक चार मास में कम-से-कम एक बैठक करेगा

(iv) सदस्यों को साधारण बैठक आयोजित करने के लिए कम-से-कम पन्द्रह दिन पूर्व सूचना और विशेष बैठक आयोजित करने के लिए कम-से-कम तीन दिन पूर्व सूचना दी जाएगी जिसमें उस प्रयोजन, समय तथा स्थान को निर्दिष्ट किया जाएगा, जहां ऐसी बैठक आयोजित की जाएगी।

(v) अध्यक्ष कम-से-कम पांच सदस्यों के लिखित अनुरोध पर या सरकार के निर्देश पर प्राधिकरण की कोई विशेष बैठक बुलाएगा।

(vi) किसी बैठक में कारबार के समव्य्वहार हेतु आवश्यक गणपूर्ति (कोरम) चार सदस्यों से होगी।

6. सदस्यों के मानदेय और भत्ते.--अधिनियम की धारा 3 की उप-धारा (4) के संबंध में विशेषज्ञों के पैनल से प्राधिकरण द्वारा गठित समितियों के सदस्य प्राधिकरण द्वारा समय-समय पर संशोधित निम्नलिखित रीति में मानदेय या भत्तों के पात्र होंगेः--

(i) वीर्य स्टेशनों के प्रमाणन या मूल्यांकन या तकनीकी निरीक्षण के लिए गठित समिति के सदस्यों का मानदेय प्रत्येक प्रमाणन या मूल्यांकन या तकनीकी निरीक्षण के लिए रुपए 2000/- होगा।

(ii) वीर्य बैंकों के प्रमाणन या मूल्यांकन या तकनीकी निरीक्षण के लिए गठित समिति के सदस्यों के लिए संचालित किए गए प्रत्येक प्रमाणन या मूल्यांकन या तकनीकी निरीक्षण हेतु 1000/- (एक हजार रुपये) मानदेय होगा।

(iii) सांडों की सु–ढ़ता परीक्षण या सांडों के प्रमाणीकरण के लिए गठित समिति के सदस्यों का मानदेय प्रत्येक प्रजनन बैल के प्रमाणन हेतु पांच सौ रुपये होगा।

(iv) समितियों के सदस्य, जो सेवारत है, राज्य सिविल सेवा को लागू नियमों के अधीन यथा अनुज्ञेय यात्रा भत्ता और दैनिक भत्ते के हकदार होंगे।

(v) उपरोक्त खण्ड (i), (ii), और (iii) के अधीन यथा विनिर्दिष्ट अन्य सदस्यों के मामले में यात्रा भत्ता और दैनिक भत्ता ऐसा होगा, जैसा राज्य के वर्ग-I अधिकारियों को अनुज्ञेय है। 7. प्राधिकरण विशेषज्ञ और अन्य कार्मिक.--(1) अधिनियम के कार्यान्वयन के प्रयोजन के लिए प्राधिकरण पशुपालन विभाग, हिमाचल प्रदेश से आउटसोर्स या प्रतिनियुक्ति पर पशु चिकित्सा विज्ञान में अर्हता के साथ निम्नलिखित अधिकारियों तथा विशेषज्ञों को ले सकेगाः--

(क) उप-निदेशक, गौजातीय प्रजनन प्राधिकरण, जिस का पशुपालन विभाग में पच्चीस वर्ष की सेवा और समकक्ष पद पर कार्य करने वाला व्यक्ति, अधिमानतः पशु प्रजनन और आनुवंशिकी या पशु पुनरूत्पत्ति में स्नातकोत्तर उपाधि रखता हो।

(ख) वरिष्ठ पशु चिकित्सा अधिकारी, गौजातीय प्रजनन प्राधिकरण, जिसके पास कम से कम पन्द्रह वर्ष का अनुभव और पशुपालन विभाग हिमाचल प्रदेश में समकक्ष पद पर कार्य करने सहित पशु चिकित्सा विज्ञान में स्नातकोत्तर की उपाधि हो। वह परियोजना के कार्यान्वयन के प्रयोजन के लिए उप निदेशक, गौजातीय प्रजनन प्राधिकरण की सहायता करेगा।8975 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 (ग) पशु चिकित्सा अधिकारी, गोजातीय प्रजनन प्राधिकरण जिसके पास कम से कम पांच वर्ष की सेवा और पशुपालन विभाग, हिमाचल प्रदेश में समकक्ष पद पर कार्य करने सहित पशु चिकित्सा विज्ञान की उपाधि हो। वह परियोजना के कार्यान्वयन के प्रयोजन के लिए वरिष्ठ पशु चिकित्सा अधिकारी (गोजातीय प्रजनन प्राधिकरण) की सहायता करेगा।

(2) पशुपालन विभाग में कर्मचारिवृन्द की कमी के मामले में, प्राधिकरण उसकी बैठक में प्राधिकरण की गणपूर्ति द्वारा पारित प्रस्ताव से उप-नियम (1) में विनिर्दिष्ट अधिकारियों की सेवाओं को आउटसोर्स कर सकेगा।

(3) प्राधिकरण अधिनियम के कार्यान्वयन के प्रयोजनार्थ पशु पालन विभाग से लेखा अधिकारी/अनुभाग अधिकारी (एफ एण्ड ए) की सेवाएं सैकण्डमैंट आधार पर प्राप्त कर सकेगा।

(4) निदेशक, पशुपालन विभाग हिमाचल प्रदेश द्वारा प्राधिकरण के कार्यालय के —त्यों के कार्यान्वयन हेतु एक लिपिक और एक कार्यालय सहायक, चतुर्थ श्रेणी कर्मचारी को प्रतिनियुक्त/तैनात किया जाएगा। कर्मचारियों की संख्या को जब कभी अपेक्षित हो, बढ़ाया जा सकेगा।

8. निधियों और जरीम आबंटन से सम्बन्धित नियम और प्राधिकरण के कार्यालय की स्थापना.-- (1) प्राधिकरण के नए खोले गए खाते का उपयोग प्राधिकरण के —त्यों को कार्यान्वित करने हेतु किया जाएगा।

(2) प्राधिकरण द्वारा प्राप्त समस्त आय/शुल्कध्शास्तियां/अनुदान, उसी खाते में जमा किए जाएंगे। खाते के ब्याज का उपयोग प्राधिकरण की आय के रूप में किया जा सकेगा और इस प्रकार की आय और जमा की गई राशि को प्राधिकरण के —त्यों को कार्यान्वित करने तथा प्राधिकरण सलाहकार पैनल या समितियों से सम्बन्धित किसी भी प्रकार के खर्चों और अधिनियम के प्रयोजनों को पूरा करने से सम्बन्धित बकाया राशि पर खर्च किया जा सकेगा। समस्त व्ययों को प्राधिकरण के सदस्य-सचिव की अन्तिम सहमति के पश्चात्‌ ही उपगत किया जाएगा।

(3) प्राधिकरण समस्त आय और व्यय का लेखा-जोखा रखने के लिए उत्तरदायी होगा और समस्त समव्य्वहारों, आय और व्यय इत्यादि से सम्बन्धित विवरण का लेखा-जोखा रखेगा। प्राधिकरण के अध्यक्ष द्वारा प्राधिकरण के कार्यालय और कार्यों को चलाने हेतु उप-निदेशक, गौजातीय प्रजनन प्राधिकरण की नियुक्ति प्रभारी या समन्वयक के रूप में तत्काल की जाएगी। पशु चिकित्सा अधिकारी और वरिष्ठ पशु चिकित्सा अधिकारी को प्राधिकरण की गणपूर्ति द्वारा पारित प्रस्ताव से, जब कभी अपेक्षित हो नियुक्त किया जा सकेगा। 9. शुक्राणु केन्द्रों का रजिस्ट्रीकरण.--(1) विद्यमान शुक्राणु केन्द्रों का रजिस्ट्रीकरण निम्नलिखित रीति में किया जाएगाः--

(क) किसी विद्यमान शुक्राणु केन्द्र का प्रभारी इस नियम के उप-नियम (3) में विनिर्दिष्ट शुल्क सहित ''प्रारूप-I'' में रजिस्ट्रीकरण प्रमाण-पत्र प्रदान करने हेतु प्राधिकरण को आवेदन करेगा।

(ख) शुक्राणु केन्द्र का प्रभारी यदि प्रमाणित नहीं है तो अन्तर्राष्ट्रीय मानक संगठन (आई.एस.ओ.) या संकट विश्लेषण और संवेदनशील नियन्त्रक बिन्दू (एच.ए.सी.सी.पी.) प्रमाणीकरण के लिए आवेदन करेंगे, और अनंतिम रजिस्ट्रीकरण प्रमाण-पत्र के जारी होने से छः मास के भीतर इसको प्रमाणित करवाएगा।

(ग) इस निमित्त लिखित अनुरोध प्राप्त होने के पश्चात्‌ शुक्राणु केन्द्रों के रजिस्ट्रीकरण के लिए समिति द्वारा एक महीने के भीतर शुक्राणु केन्द्र का निरीक्षण किया जाएगा।

(घ) प्राधिकरण तत्पश्चात्‌ अधिनियम की धारा 9 की उप-धारा (4) के संबंध में एक अनंतिम प्रमाण पत्र जारी करेगा। 8976 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 (ङ ) इस प्रयोजन के लिए गठित समिति द्वारा वार्षिक आधार पर शुक्राणु केन्द्र का निरीक्षण किया जाएगा।

(च) रजिस्ट्रीकरण के नवीनीकरण हेतु वार्षिक निरीक्षण का किया जाना आज्ञापक है (छ) शुक्राणु केन्द्र को चलाने हेतु शुक्राणु केन्द्र न्यूनतम मानक प्रोटोकॉल (एम.एस.पी.) के दिशा निर्देशों का सख्ती से पालन करेगा।

(ज) शुक्राणु केन्द्र उन बैलों का ब्यौरा तैयार करेगा, जिनके वीर्य की मात्रा (डोसिज) से —त्रिम गर्भाधान के लिए वह समिति द्वारा विनिर्दिष्ट प्रारूप में उत्पादन, भंडारण, विक्रय और वितरण करना चाहेगा।

(झ) शुक्राणु केन्द्रों के श्रेणीकरण हेतु भारत सरकार द्वारा केन्द्रीय निगरानी इकाई के निरीक्षण में शुक्राणु केन्द्र यदि असफल हो जाता है तो रजिस्ट्रीकरण प्रमाण पत्र स्वतः रद्द हो जाएगा। (ञ) यदि शुक्राणु केन्द्र का रजिस्ट्रीकरण प्रमाण-पत्र रद्द कर दिया जाता है, तो शुक्राणु केन्द्र उप-नियम (3) के अधीन यथा विनिर्दिष्ट शुल्क सहित नए रजिस्ट्रीकरण हेतु नए सिरे से आवेदन कर सकेगा।

(2) नए शुक्राणु केन्द्र का रजिस्ट्रीकरण निम्नलिखित रीति में किया जाएगाः--

(क) कोई व्यक्ति जो कोई नया शुक्राणु केन्द्र आरम्भ करने की वांछा रखता है, प्राधिकरण से अनापत्ति प्रमाण-पत्र की मांग करेगा तथा इसे स्थापित करने से पूर्व तकनीकी विधीक्षा हेतु प्राधिकरण को विस्तृत परियोजना रिपोर्ट (डी.पी.आर.) प्रस्तुत करेगा।

(ख) प्राधिकरण, सरकार के पूर्व अनुमोदन से शुक्राणु केन्द्र की स्थापना हेतु 'अनापत्ति प्रमाण-पत्र' प्रदान कर सकेगा।

(ग) नए शुक्राणु केन्द्र की स्थापना हेतु अपेक्षाओं के पूर्ण होने पर, आवेदक इस नियम के उप-नियम (3) के अधीन यथा विनिर्दिष्ट शुल्क सहित 'प्रारूप-I' में आवेदन प्रस्तुत करेगा। (घ) तत्पश्चात्‌, विद्यमान, शुक्राणु केन्द्रों को समस्त प्रक्रियाएं, शर्तें, फीस आदि नए शुक्राणु केन्द्रों को यथावश्यक परिवर्तन सहित लागू हाेंगे, तथापि, नए शुक्राणु केन्द्र को इसकी स्थापना के छः मास के भीतर भारत सरकार द्वारा केन्द्रीय निगरानी इकाई के निरीक्षण के लिए प्राधिकरण को अनुरोध भेजना होगा। ऐसा न होने पर शुक्राणु केन्द्र अपने समस्त प्रचालनों को बन्द कर देगा तथा रजिस्ट्रीकरण प्रमाण-पत्र रद्द कर दिया जाएगा।

(ङ) शुक्राणु केन्द्र उन बैलों के ब्यौरे तैयार करेगा, जिनके वीर्य की मात्रा (डोसिज) समिति द्वारा विनिर्दिष्ट किए जाने वाले प्रारूप में —त्रिम गर्भाधान हेतु उत्पादन, भंडारण, विक्रय, वितरण करना चाहेगा।

(3) उप-नियम (1) तथा (2) के अधीन प्रत्येक आवेदन, सदस्य सचिव, हिमाचल प्रदेश गौजातीय प्रजनन प्राधिकरण के पक्ष में डिमांड ड्राफ्ट या चैक या बैंक अन्तरण के रूप में पच्चीस हजार रुपये की रकम की फीस के साथ किया जाएगा।

(4) प्राधिकरण उप-नियम (1) और (2) के अधीन आवेदन प्राप्त होने पर और समाधान होने के पश्चात्‌ कि अधिनियम की धारा 9 की उप-धारा (6) के अधीन निर्धारित शर्तों का अनुपालन किया गया है ''प्रारूप-2'' में दो वर्ष की अवधि हेतु रजिस्ट्रीकरण प्रमाण-पत्र जारी कर सकेगा।

(5) शुक्राणु केन्द्र का प्रभारी रजिस्ट्रीकरण प्रमाण-पत्र की समाप्ति से कम-से-कम तीन मास पूर्व उसके नवीनीकरण हेतु प्राधिकरण को सदस्य-सचिव के पक्ष में डिमांड ड्राफ्ट या चैक या बैंक अंतरण के रूप में पांच हजार रुपये की फीस के साथ आवेदन करेगा।8977 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 10. वीर्य बैंकों का रजिस्ट्रीकरण.--(1) राज्य में समस्त विद्यमान और नए वीर्य बैंक, प्राधिकरण के सदस्य सचिव के पक्ष में डिमांड ड्राफ्ट, चैक, बैंक अंतरण के रूप में पाँच हजार रुपये की फीस सहित प्रारूप 3 में आवेदन प्रस्तुत करके प्राधिकरण के पास स्वयं को रजिस्ट्री—त करवाएंगे।

(2) प्राधिकरण वीर्य बैंक को अनंतिम रजिस्ट्रीकरण प्रमाण-पत्र प्रदान करेगा जो केवल छः मास की अवधि के लिए विधिमान्य होगा।

(3) आवेदन प्राप्त होने के पश्चात्‌ प्राधिकरण, अनुरोध-प्राप्ति के दो मास के भीतर अधिनियम की धारा 3 की उप-धारा (4) के उपबन्धों के अनुसार इस प्रयोजन के लिए गठित समिति द्वारा वीर्य बैंक के तकनीकी निरीक्षण की व्यवस्था करेगा।

(4) तकनीकी निरीक्षण के पश्चात्‌ नए निरीक्षण रिपोर्ट में किए गए अननुपालन या प्रेक्षण, यदि कोई हो, को पूर्ण करने के लिए वीर्य बैंक को दो मास की छूट अवधि प्रदान की जाएगी।

(5) प्रारूप-4 पर रजिस्ट्रीकरण प्रमाण-पत्र वीर्य बैंक को दो ऐसे निरीक्षणों के सफल समापन के पश्चात्‌ पाँच मास की अवधि के भीतर प्रदान करवाया जाएगा।

(6) यदि वीर्य बैंक तकनीकी निरीक्षण में असफल रहता है या यदि किसी अन्य कारण से अनंतिम रजिस्ट्रीकरण प्रमाण-पत्र की विधिमान्यता रजिस्ट्रीकरण प्रमाण-पत्र प्रदान किए बिना समाप्त हो जाती है तो वीर्य बैंक तत्काल अपने प्रचालनों को बन्द कर देगा और अननुपालन को ठीक करेगा तथा साथ ही नए सिरे से वीर्य बैंक के रजिस्ट्रीकरण हेतु लागू फीस सहित आवेदन करेगा।

(7) रजिस्ट्रीकरण प्रमाण-पत्र दो वर्ष हेतु विधिमान्य होगा और वीर्य बैंक के प्रभारी द्वारा दो वर्ष के समापन के तीन मास पूर्व प्राधिकरण के सदस्य सचिव के पक्ष में डिमांड ड्राफ्ट, चैक, बैंक अंतरण के रूप में एक हजार रुपये की फीस सहित अनुरोध भेज कर नवीनीकरण किया जा सकेगा। रजिस्ट्रीकरण प्रमाण-पत्र के नवीनीकरण से पूर्व वीर्य बैंक का पुनः तकनीकी निरीक्षण किया जाएगा।

11. सांडों का प्रमाणीकरण.--(1) सांडों को प्राधिकरण द्वारा, न्यूनतम मानक प्रोटोकाल मे यथा विनिर्दिष्ट शर्तों के अध्यधीन तथा राज्य प्रजनन नीति के अनुरूप प्रमाणित किया जाएगा।

(2) प्राधिकरण, पशु उत्पादकता और स्वास्थ्य पोर्टल (आई.एन.ए.पी.एच. पोर्टल) हेतु सूचना नेटवर्क पर प्रत्येक प्रमाणित सांड हेतु विशिष्ट पहचान संख्या जनित करने और समनुदेशित करने हेतु राष्ट्रीय डेयरी विकास बोर्ड को अनुरोध करेगा ताकि देश में कोई अन्य सांड समान संख्या धारित न करता हो। शुक्राणु केन्द्रों हेतु यह आज्ञापक होगा कि वे प्रमाणित सांडों को विशिष्ट पहचान संख्या टैग सहित सुरक्षित रूप से टैग करें तथा इस प्रकार आई.एन.ए.पी.एच. मानदंडों का अनुपालन करें।

(3) वीर्य उत्पादन या प्रा—तिक सेवा हेतु उपयोग की जाने वाली विभिन्न नस्लों के सांडो का चयन न्यूनतम मानक प्रोटोकॉल में उल्लिखित विनिर्देशों या मानकों के अनुसार और राज्य प्रजनन नीति के करार पर किया जाएगा। ''सांड आरोग्य परीक्षण'' (वी.एस.सी.) हेतु अधिनियम की धारा 3 की उप-धारा (4) के अधीन प्राधिकरण द्वारा यथा गठित सांडों के प्रमाणीकरण हेतु समिति द्वारा इन सांडों का परीक्षण किया जाएगा। (4) वीर्य उत्पादन के लिए सांड सरकार द्वारा अनुमोदित प्रमाणित सांड उत्पादन कार्यक्रम से उपाप्त किए जाएंगे जैसे राष्ट्रीय डेयरी विकास बोर्ड (एन.डी.डी.बी.) या भारत सरकार या राज्य सरकारों के सहयोग से देश में चल रहे वंश परीक्षण या वंशावली चयन कार्यक्रम या वंशावली रिकॉर्ड के आधार पर राज्य या केन्द्र सरकार के प्रतिष्ठित गौजातीय प्रजनन फार्म या वीर्य केन्द्रों से उच्च आनुवंशिक योग्यता वाले बैल या भारत सरकार पशुपालन विभाग और इसके द्वारा गठित केन्द्रीय निगरानी इकाई (सी.एम.यू.) द्वारा बनाए गए न्यूनतम मानक प्रोटोकॉल तथा मानक संचालन प्रक्रियाओं में विनिर्दिष्ट मानकों के अनुसार और राज्य की प्रजनन नीति के अनुरूप भ्रूण स्थानांतरण तकनीकी या इन-विट्रो फर्टिलाइजेशन तकनीक द्वारा उत्पादित आनुवंशिक अर्हता वाले बैल। 8978 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 (5) —त्रिम गर्भाधान बैल या प्रा—तिक सेवा वाले बैलों का परीक्षण न्यूनतम मानक प्रोटोकॉल तथा मानक संचालन प्रक्रियाओं में उल्लिखित मानकों तथा परीक्षण के अनुसार पशुपालन विभाग, भारत सरकार और इसके द्वारा, यथास्थिति वार्षिक आधार पर या छः मास के आधार पर गठित केन्द्र अनुश्रवण इकाई (सी.एम.यू.) द्वारा प्राधिकरण द्वारा इस प्रयोजन के लिए चयनित विशेषज्ञों की टीम यथा विराचित जिसके अंतर्गत क्षेत्रीय रोग निवारण प्रयोगशाला जालंधर या प्राधिकरण द्वारा समय-समय पर अधिसूचित किए एवं किसी अन्य अभिकरण से विशेषज्ञ भी शामिल हो सकेंगे, द्वारा कार्यान्वित किया जाएगा।

(6) वीर्य केन्द्र या किसी अन्य प्रजनन कार्यक्रम में सम्मिलित करने से पूर्व बैलों को कार्योटाइप परीक्षण कराना आज्ञपक होगा।

(7) प्रजनन-बैलों का पशु पालन विभाग, भारत सरकार और वीर्य उत्पादन के लिए इसके द्वारा गठित केन्द्र अनुश्रवण इकाई (सी.एम.यू.) द्वारा यथा विराचित न्यूनतम मानक प्रोटोकॉल और मानक संचालन प्रक्रियाओं में यथा विनिर्दिष्ट आनुवंशिक रोगों (प्रतिसारी वंश दशा आदि) के विरूद्ध केन्द्रीय या राज्य सरकार अथवा राष्ट्रीय डेयरी विकास बोर्ड की प्रख्यात प्रयोगशालाओं से परीक्षण करवाया जाएगा।

(8) बैलों का बीना जाना (कलिंग), पशु पालन विभाग, भारत सरकार और इसके द्वारा गठित केन्द्र अनुश्रवण इकाई (सी.एम.यू.) द्वारा यथा विराचित न्यूनतम मानक प्रोटोकॉल और मानक संचालन प्रक्रियाओं में उल्लिखित उपबन्धों के अनुसार और बैलों के प्रमाणीकरण हेतु गठित समिति द्वारा विधीक्षा किए जाने के पश्चात्‌ कार्यान्वित किया जाएगा।

(9) बोर्ड प्राधिकरण को समुचित औचित्य के साथ अनुरोध भेजेगा। प्राधिकरण, यदि बैल, पशु पालन विभाग, भारत सरकार और इसके द्वारा गठित केन्द्र अनुश्रवण इकाई (सी.एम.यू.) द्वारा यथा विराचित न्यूनतम मानक प्रोटोकॉल और मानक संचालन प्रक्रियाओं के अनुसार पात्रता नहीं रखता है तो ऐसे अनुरोध को प्राप्ति के पश्चात्‌ पन्द्रह दिन के भीतर और यदि कोई बैल किसी यौन संक्रमित रोग (एस.टी.डी.) या संक्रमित रोग जैसा पशु पालन विभाग भारत सरकार और इसके द्वारा गठित केन्द्र अनुश्रवण इकाई (सी. एम. यू.) द्वारा यथा विराचित न्यूनतम मानक प्रोटोकॉल और मानक संचालन प्रक्रियाओं में विहित किया जाए, परीक्षण में पॉजिटिव पाया जाता है तो दो दिन के भीतर बैल के बीने जाने (कलिंग) को अनुमोदित करेगा।

(10) बैल के बीने जाने (कलिंग) को कार्यान्वित किए जाने हेतु बोर्ड प्रत्येक वर्ष के अप्रैल मास में अग्रिम रूप से एक बीनन समिति (कलिंग कमेटी) का गठन करेगा, जिसमें पशु पालन निदेशालय से एक अधिकारी जो उप-निदेशक की पंक्ति से नीचे का न हो और पशु पालन निदेशालय का लेखा अधिकारी सदस्य के रूप में होंगे और संयुक्त निदेशक (एस.एल.बी.पी.) इसका अध्यक्ष होगा। इस प्रकार गठित ''बीनन समिति'' (कलिंग कमेटी) एक वर्ष के लिए विधिमान्य होगी और यह प्राधिकरण द्वारा बीनने के अनुमोदन (कलिंग) के पश्चात्‌ पन्द्रह दिन के भीतर या यदि बैल को किसी यौन संक्रमित रोग या संक्रमित रोग के लिए परीक्षण में पॉजिटिव पाया गया है तो प्राधिकरण के बीनने के अनुमोदन (कलिंग) के तत्काल पश्चात्‌ बीने जाने (कलिंग) को कार्यान्वित करेगी।

12. —त्रिम गर्भाधान कर्मकारों का प्रमाणीकरण.--(1) केन्द्रीय प्रायोजित योजना (सी.एस.एस.) जैसे पशु और भैंस प्रजनन के लिए राष्ट्रीय कार्यक्रम या गौजातीय प्रजनन पर राष्ट्रीय परियोजना (एन.पी.बी.बी.) या राष्ट्रीय गोकुल मिशन (आर.जी.एम.) या राज्य या केन्द्र को किसी अन्य योजना के अधीन बोर्ड या पशुपालन विभाग हिमाचल प्रदेश द्वारा चयनित तथा प्रशिक्षित और आबंटित क्षेत्रों में —त्रिम गर्भाधान कार्य कार्यान्वित करने वाले —त्रिम गर्भाधान कर्मकार प्राधिकरण के सदस्य सचिव के पक्ष में डिमांड ड्राफ्ट या चैक या बैंक अंतरण के रूप में एक हजार रुपये फीस सहित प्रारूप 5 पर प्रस्तुत करके प्राधिकरण के पास स्वयं को रजिस्ट्री—त करवाएंगे।

(2) केन्द्र प्रायोजित योजनाओं (सी.एस.एस.) जैसे राष्ट्रीय मवेशी और भैंस प्रजनन कार्यक्रम ध्गोजातीय प्रजनन पर राष्ट्रीय परियोजना (एन.पी.बी.बी.) या राष्ट्रीय गोकुल मिशन (आर.जी.एम.) के अधीन कर्मकारों के प्रशिक्षण के लिए पाठ्यक्रमध्मॉडयूल ऐसा होगा जैसे कि इन केन्द्रीय प्रायोजित योजनाओं (सी.एस. एस.) के मार्गदर्शक सिद्धान्तों में विनिर्दिष्ट है, जिसे प्राधिकरण द्वारा राज्य की अपेक्षाओं के अनुसार उपांतरित किया जा सकेगा। —त्रिम गर्भाधान कर्मकार की न्यूनतम शैक्षणिक अर्हता ऐसी होगी जैसे कि राज्य सरकार/केन्द्रीय सरकार द्वारा समय-समय पर विनिर्दिष्ट की जाए।8979 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 (3) नए —त्रिम गर्भाधान कर्मकार, जिन्होंने राज्य सरकार द्वारा मान्यता प्राप्त बोर्ड या संस्थान से सफलतापूर्वक प्रशिक्षण प्राप्त किया है, आबंटित क्षेत्र में —त्रिम गर्भाधान कार्य आरम्भ करने से पूर्व स्वयं को प्राधिकरण के पास रजिस्ट्री—त करेंगे।

(4) बोर्ड प्राधिकरण के उन समस्त प्रशिक्षित —त्रिम गर्भाधान कर्मकारों की सूची उपलब्ध करवाएगा, जिन्हें क्रायोकेन प्रदान किए गए हैं और पश्चात्वर्ती में प्रत्येक वर्ष की प्रथम अप्रैल को अद्यतन सूची प्रस्तुत करेगा।

(5) —त्रिम गर्भाधान कर्मकार जो प्रशिक्षित हैं, जिन्होंने गत दो वर्षों से —त्रिम गर्भाधान कार्य को कार्यान्वित नहीं किया है, पुनश्चर्या प्रशिक्षण हेतु प्राधिकरण को अनुरोध प्रेषित करेंगे तथा फिर प्राधिकरण के पास स्वयं को रजिस्ट्री—त करवाएंगे।

(6) हिमाचल प्रदेश सरकार द्वारा मान्यता प्राप्त संस्थानों से उनकी नियमित सेवा के दौरान प्रशिक्षित सेवानिवृत पैरा पशु चिकित्सक और प्राइवेट —त्रिम गर्भाधान कर्मकार के रूप में कार्यरत या —त्रिम गर्भाधान कर्मकारों के रूप में कार्य करने के इच्छुकय सेवानिवृत पशु चिकित्सक या बेरोजगार पशु चिकित्सक जो —त्रिम गर्भाधान के माध्यम से प्रजनन सेवाएं उपलब्ध करवाते हैं या जो —त्रिम गर्भाधान सेवाएं उपलब्ध करवाने के इच्छुक हैं; तथा ग्रामीण भारत में एम.ए.आई.टी.आर.आई. योजना के अन्तर्गत प्रशिक्षित बहुद्देशीय —त्रिम गर्भाधान तकनीशियन जो —त्रिम गर्भाधान कर्मकार के रूप में कार्य करने के इच्छुक हैं स्वयं को प्राधिकरण के पास प्राधिकरण के सदस्य सचिव के पक्ष में डिमांड ड्राफ्ट, चैक या बैंक अंतरण के रूप में एक हजार रुपये की फीस प्रारूप-5 में आवेदन सहित जमा करके रजिस्ट्री—त करवाएंगे।

(7) समस्त —त्रिम गर्भाधान कर्मकार प्रारूप-9 में या प्राधिकरण द्वारा इस प्रकार वांछित किसी अन्य प्रारूप में माहवार —त्रिम गर्भाधान के ब्यौरे किसी पशु चिकित्सक द्वारा संचालित निकटतम पशु चिकित्सा संस्थान को उपलब्ध करवाएगा जो बदले में सम्बद्ध जिला के वीर्य बैंक अधिकारी को ब्यौरे प्रस्तुत करेगा। वीर्य बैंक, बोर्ड को ऐसे किए गए —त्रिम गर्भाधान की समेकित सूचना उपलब्ध करवाएगा।

(8) यदि —त्रिम गर्भाधान कर्मकार दो मास हेतु क्रमवर्ती रूप से सम्बंद्ध पशु चिकित्सा संस्थान को —त्रिम गर्भाधान के ब्यौरे माहवार उपलब्ध करवाने में असफल रहता है तो उसका रजिस्ट्रीकरण रद्द कर दिया जाएगा।

(9) समस्त —त्रिम गर्भाधान कर्मकार, चाहे सरकारी हो या प्राइवेट, सरकार द्वारा समय-समय पर यथा अधिसूचित —त्रिम गर्भाधान हेतु राज्य प्रजनन नीति और मानक संचालन प्रोटोकॉल का कड़ाई से पालन करेंगे। भ्रूण अन्तरन/इन-विट्रो निषेचन केवल अर्हित पशु चिकित्सक द्वारा किया जाएगा। ऐसे अनुदेशों का अनुपालन नहीं करने वाले कर्मकारों का रजिस्ट्रीकरण रद्द कर दिया जाएगा।

(10) —त्रिम गर्भाधान कर्मकारों का रजिस्ट्रीकरण प्रमाण-पत्र प्रारूप 6 या 7 या 8 (जैसे भी लागू हो) पर जारी किया जाएगा, जो जारी करने की तारीख से एक वर्ष के लिए विधिमान्य होगा।

(11) —त्रिम गर्भाधान कर्मकार रजिस्ट्रीकरण की समाप्ति की तारीख से एक मास पूर्व रजिस्ट्रीकरण के नवीनीकरण हेतु प्राधिकरण के सदस्य-सचिव के पक्ष में डिमांड ड्राफ्ट या चैक या बैंक अंतरण के रूप में एक सौ रुपये की फीस सहित लिखित अनुरोध करेगा।

(12) बोर्ड से अनापत्ति प्रमाण-पत्र अभिप्राप्त करने के पश्चात्‌ ही रजिस्ट्रीकरण प्रमाण-पत्र का नवीनीकरण किया जाएगा।

(13) —त्रिम गर्भाधान कर्मकार किसी ऐसे शुक्राणु केन्द्र से अभिप्राप्त या क्रय किए गए वीर्य की मात्रा (डोसिज) का उपयोग नहीं करेगा जो प्राधिकरण द्वारा रजिस्ट्री—त या प्रमाणित नहीं है। वीर्य के अवैध उपयोग की ऐसी गतिविधि के साक्ष्य मिलने की दशा में प्राधिकरण ऐसे —त्रिम गर्भाधान कर्मकारों का रजिस्ट्रीकरण रद्द कर सकेगा।

(14) —त्रिम गर्भाधान कर्मकार हिमाचल प्रदेश के बाहर से वीर्य उपाप्त नहीं करेगा, सिवाय उन मामलों के जहां प्राधिकरण द्वारा विशेष अनुज्ञा प्रदान की जाती है। 8980 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 (15) पशुओं की उचित पहचान के लिए, —त्रिम गर्भाधान कर्मकार, पशु को गर्भाधान से पूर्व प्लास्टिक ईयर टैग सहित 12-अंकीय विशिष्ट पहचान संख्या सहित बारकोड किया जाएगा और अपने स्वंय के उपयोगकर्ता विशिष्टताओं के माध्यम से या समय-समय पर सरकार के निर्देशों के अनुसार पशु उत्पादकता और स्वास्थ्य (आई.एन.ए.पी.एच.) पोर्टल के लिए सूचना नेटवर्क पर रजिस्ट्रीकरण विवरण (ब्यौरे) अपलोड करेगा। वह प्रारूप-5 में यथाविदिष्ट विभिन्न अवसरों पर यथाअपेक्षित समस्त प्रजनन सम्बन्धी डेटा पोर्टल पर अपलोड करेगा, और पशु उत्पादकता और स्वास्थ्य (आई.एन.ए.पी.एच.) पोर्टल के लिए सूचना नेटवर्क पर उसके काम की निगरानी संचालन के क्षेत्र के अनुसार निकटतम पशु चिकित्सा अधिकारी/वरिष्ठ पशु चिकित्सा अधिकारी द्वारा की जाएगी।

(16) इन नियमों के अधीन रजिस्ट्रीकरण के लिए आवेदन करने वाले किसी भी —त्रिम गर्भाधान कर्मकार को हिमाचल प्रदेश पशु चिकित्सा परिषद्‌ के पास रजिस्ट्री—त होना आवश्यक है, यदि आवेदक रजिस्ट्री—त पशु चिकित्सा व्यवसायी है, या हिमाचल प्रदेश पैरा पशु चिकित्सा परिषद्‌ के पास यदि पैरा पशु चिकित्सक हो या बोर्ड के पास यदि आवेदक को एम.ए.आई.टी.आर.आई. ग्रामीण भारत में बहुउद्देशीय —त्रिम गर्भाधान तकनीशियन स्कीम के अधीन प्रशिक्षित किया जा रहा है।

13. वीर्य के विक्रय का विनियमन.--(1) बोर्ड राज्य के क्षेत्रीय —त्रिम गर्भाधान केन्द्रों या प्राधिकरण के पास रजिस्ट्री—त या किसी अन्य अभिकरण में से गौजातीयों के प्रजनन/उन्नयन हेतु गोजातीय वीर्य या भ्रूण को विक्रय या वितरित या उपहार स्वरूप देगा या अंतरित करेगा। प्राधिकरण के पास रजिस्ट्री—त कोई अन्य अभिकरण, जो गोजातीयों के प्रजनन/उन्नयन हेतु प्राधिकरण के पास रजिस्ट्री—त व्यक्ति या किसी अन्य अभिकरण को गौजातीय वीर्य या भ्रूण को विक्रय या वितरित करने या उपहार देने या अंतरित करने की वांछा रखता है, वीर्य या भ्रूण के ब्यौरे सहित प्रयोजनार्थ औचित्य के साथ अनुरोध भेजकर प्राधिकरण से अनापत्ति प्रमाण-पत्र मांगेगा। वीर्य या भ्रूण के ब्यौरे सहित प्राधिकरण केवल यह सुनिश्चित करने के पश्चात्‌ ही अनापत्ति प्रमाण-पत्र प्रदान करेगा कि गौजातीय वीर्य/भ्रूण का विक्रय या वितरण या उपहार या अंतरण राज्य प्रजनन नीति के अनुसार है और प्रत्यक्ष या अप्रत्यक्ष रूप से राज्य के गौजातीय उन्नयन में योगदान करेगा। (2) बोर्ड किसी अन्य राज्य या अभिकरण या देश से राज्य में गौजातीय वीर्य या भ्रूण के आयात के लिए किसी नोडल अभिकरण के रूप में कार्य करेगा। ऐसे समस्त आयात प्रत्येक प्रेषण के लिए प्राधिकरण के पूर्वानुमोदन से किए जाएंगे। आयातित वीर्य तथाध्या भ्रूण की नस्ल या अन्य मानदंड राज्य प्रजनन नीति के अनुसार होंगे।

14. प्रतिलिपि रजिस्ट्री—त प्रमाण-पत्र जारी करना.--यदि इन नियमों के अधीन जारी किया गया रजिस्ट्रीकरण प्रमाण पत्र या नवीकरण प्रमाण-पत्र विरूपित, गुम या नष्ट हो जाता है, तो प्राधिकरण, समाधान होने पर, प्राधिकरण के सदस्य सचिव के पक्ष में, निम्नानुसार

(i) शुक्राणु केन्द्र के लिएः पाँच सौ रुपये

(ii) वीर्य बैंक के लिएः पाँच सौ रूपये

(iii) —त्रिम गर्भाधान कर्मकार के लिएः एक सौ रुपये डिमांड ड्राफ्ट या चैक या बैंक अंतरण के माध्यम से शुल्क के संदाय पर आवेदक को एक प्रतिलिपि प्रमाण-पत्र प्रदान कर सकेगा। 15. स्थानीय प्राधिकरण की सहायता करना.--समय-समय पर, प्राधिकरण के पास समस्त सम्बद्ध व्यक्तियों को अनुदेश देने, निर्देश देने की समस्त शक्तियां होंगी, चाहे वे सार्वजनिक हों या प्राइवेटः पुलिस, राजस्व, जल शक्ति विभाग हिमाचल प्रदेश, हिमाचल प्रदेश राज्य विद्युत बोर्ड, पशु पालन विभाग हिमाचल प्रदेश पशुधन एवं कुक्कट विकास बोर्ड के प्राधिकारी हों। समस्त सम्बद्ध व्यक्ति प्राधिकरण के आदेशों का अनुपालन करने के लिए बाध्य होंगे।

16. अभिलेख का अनुरक्षण तथा प्रस्तुतीकरण.--शुक्राणु केन्द्र और वीर्य बैंक, प्राधिकरण द्वारा समय-समय पर विनिर्दिष्ट प्रारूप पर वार्षिक रिपोर्ट प्रस्तुत करेंगे। प्राधिकरण समय-समय पर आवेदन प्रपत्रों,8981 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 सूचना इत्यादि के प्रारूप में परिवर्तन कर सकेगा। प्राधिकरण समय-समय पर राज्य की प्रजनन नीति तथा गौजातीय प्रजनन नियमों का पुनर्विलोकन करने का प्रस्ताव कर सकेगा ताकि पशुपालन सेक्टर में बदलती आवश्यकता और प्रौद्योगिकियों के साथ तालमेल बिठाया जा सके। प्राधिकरण के अध्यक्ष अपनी बैठक में प्राधिकरण की आम सहमति से राज्य के किसानों को लाभ के लिए किसी आवेदक को आपातकालीन या समय की अपेक्षा तत्काल आवश्यकताओं की दशा में छूट प्रदान कर सकेगा।

ANIMAL HUSBANDRY DEPARTMENT

NOTIFICATION

Shimla, the 30th October, 2023

No. AHY-A (3)/3 -32018-P-I-Bov. Br.— In exercise of the powers conferred by section 30 of the Himachal Pradesh Bovine Breeding Act, 2019, the Governor, Himachal Pradesh is pleased to make the following rules, namely:— 1. Short title and commencement.—(1) These rules may be called Himachal Pradesh Bovine Breeding (Regulation of Production, Sale of Bovine Semen and Artificial Insemination Services) Rules, 2023.

2. Definitions.—In these rules, unless the context otherwise requires:—

(a) "Act" means the Himachal Pradesh Bovine Breeding Act, 2019 (Act No. 7 of 2019);

(b) "Board" means Himachal Pradesh Livestock and Poultry Development Board;

(c) "Member" means the member of the Bovine Breeding Authority notified by the Government;

(d) "Minimum Standard Protocol (MSP)" means Minimum Standards prescribed by the authority and notified by the Government from time to time for all operations of a Sperm Station;

(e) "Rules" means the Himachal Pradesh Bovine Breeding (Regulation of Production, Sale of Bovine Semen and Artificial Insemination Services) Rules, 2023; and

(f) "Standard Operating Procedures for Artificial Insemination" means the standards prescribed by the authority and notified by the Government from time to time for conducting Artificial Insemination;

(2) Words and expressions used in these rules but not defined, shall have the same meaning as have respectively been assigned to them in the Act.

3. Qualification and experience of nominated members of Authority.—No person shall be nominated by the Government under clauses (e) and (f) of sub-section (2) of section 3 of the Act, unless he possesses the following qualification and experience:—

(i) The Eminent Veterinarian shall be a reputed Animal Breeding Scientist with Master of Veterinary Science or Ph.D. in Animal Breeding and Genetics or Animal Reproduction and has served for not less than 15 years in any Agricultural University or Veterinary University or Animal Husbandry Department. (ii) The Eminent Bovine Breeder shall be a reputed bovine breeder engaged in bovine breeding activity having experience of 15 years in the field of bovine breeding.

4. Membership roll.—The Member Secretary of the Authority shall keep a roll of members and every member of the authority shall sign the roll and shall state therein his rank, occupation and address. The member concerned will notify any change in his address and the same shall be recorded by the Member Secretary in the roll of members.

5. Meetings of the Authority:—

(i) Every meeting of the Authority shall be presided over by the Chairperson and in his absence, by Member Secretary of the Authority.

(ii) The Member Secretary of the Authority shall circulate the agenda of the meeting and shall keep a record of the proceedings of the Authority.

(iv) The members shall be given atleast fifteen days prior notice for holding an ordinary meeting and at least three days prior notice for holding a special meeting specifying the purpose, time and place at which such meeting shall be held.

(v) The Chairperson shall upon, a written request from not less than five members or upon a direction from Government, call a special meeting of the Authority.

(vi) The quorum necessary for the transaction of business at any meeting shall be four members.

6. Honorarium and allowances of Members.—The members of committees constituted by the Authority from the panel of experts in terms of sub-section (4) of section 3 of the Act shall be entitled to Honorarium or Allowances subject to the revision by the authority from time to time in the following manner:—

(i) The Honorarium for members of the committee constituted for Certification or Evaluation or Technical inspection of Sperm Stations, shall be Rs. 2000/- each for every Certification or Evaluation or Technical inspection.

(ii) The Honorarium for members of the committee constituted for Certification or Evaluation or Technical Inspection of Semen Banks, shall be Rs. 1000/- each for every Certification or Evaluation/Technical Inspection conducted.

(iii) The Honorarium for members of the committee constituted for Bull Soundness Examination or certification of bulls shall be Rs. 500/- each for certification of each breeding bull.

(i) The members of the committees, who are in service shall be entitled to Travelling Allowance and Daily Allowance as admissible under the rules applicable to the State Civil Service.

(v) In case of other members, as specified under clauses (i), (ii) and (iii) above the Travelling Allowance and Daily Allowance shall be such as is admissible to Class-I Officers of the State.

7. Expert and other personnel of the Authority.—(1) The Authority for purpose of implementation of the Act may outsource or get on deputation from the Animal Husbandry Department, Himachal Pradesh, the following officers and experts with the following qualification in Veterinary Science:—

(a) Deputy Director, Bovine Breeding Authority, a person having 25 years of service in Animal Husbandry Department and working on equivalent post, preferably having Master's Degree in Animal Breeding and Genetics or Animal Reproduction.

(b) Senior Veterinary Officer, Bovine Breeding Authority having Master's Degree in Veterinary Science with at least 15 years of Service and working on equivalent post in Animal Husbandry Department H.P. He will assist Deputy Director, Bovine Breeding Authority for the purpose of implementation of the project.

(c) Veterinary Officer, Bovine Breeding Authority having Degree in Veterinary Science with atleast 5 years of Service and working on equivalent post in Animal9002 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 Husbandry Department, H.P. He will assist Senior Veterinary Officer (Bovine Breeding Authority) for the purpose of implementation of the project.

(2) In case of the shortage of staff with Animal Husbandry Department, the Authority may outsource the services of the officers specified in sub-rule (i) with the proposal passed by the quorum of the authority in its meeting.

(3) The Authority may get the services of Accounts Officer/Section Officer (F&A) on secondment basis from Animal Husbandry Department for the purpose of implementation of the Act.

(4) One Clerk and One Office Assistant/Class-IV employee shall be deputed/posted by the Director, Animal Husbandry, Himachal Pradesh for carrying out the functioning of the office of the Authority. The number of employees may be increased as and when required.

8. Rules regarding the funds and budgetary allocation and set up of office of authority.—(1) A newly opened account of the Authority will be used to run the functions of the Authority.

(2) All incomes/fees/penalties/grants received by the Authority will be credited to the same account. The interest of the account may be used as the income of the Authority and such incomes and credited money may be spent in carrying out the functions of the Authority and on any kind of expense related to the Authority, consultative panel or committees and on dues of any kind related to carry out the purposes of the Act. All the expenditures will be incurred after the final consent of Member Secretary of the Authority.

(3) The Authority shall be responsible for keeping the account of all income and expenditure and will keep account of detail pertaining to all the transactions, incomes and expenditures etc. There shall be immediate appointment of the Deputy Director, Bovine Breeding Authority as incharge or co-ordinator for running the office and functions of the Authority by the Chairperson of the Authority. The Veterinary Officer and Senior Veterinary Officer may be appointed as and when required with the proposal passed by the quorum of the Authority.

9. Registration of Sperm Stations.—(1) The registration of the existing Sperm Stations shall be done in the following manner:—

(a) The incharge of an existing sperm station shall apply to the Authority for grant of certificate of registration in Form-1 along with fee specified in sub-rule (3) of this rule.

(b) The incharge of sperm station shall apply for International Standard Organisation (ISO) or Hazard Analysis and Critical Control Point (HACCP) Certification, if not certified and get itself certified within 6 months of issuance of provisional registration certificate.

(c) The sperm station shall be inspected within one month by the committee for registration of sperm stations after receipt of written request in this behalf.

(d) The Authority shall thereafter issue a provisional certificate in terms of sub- section (4) of section 9 of the Act.

(e) Sperm station shall be inspected on yearly basis by the committee constituted for the purpose.

(g) The sperm station shall strictly follow the guidelines of Minimum Standard Protocol (MSP) for running the sperm station.

(h) The sperm station shall make account details of bulls whose semen doses it would like to produce, store, sell, distribute for Artificial Insemination in a format to be specified by the committee.

(i) The Registration Certificate shall get automatically cancelled if the sperm station fails Central Monitoring Unit's Inspection by Government of India for grading of sperm stations.

(j) If the registration certificate of the sperm station is cancelled, the sperm station may apply afresh for new registration along with the fee as specified under sub- rule (3)

(2) The registration of new Sperm Stations shall be done in the following manner:—

(a) Any person who desires to start a new sperm station shall seek No Objection Certificate from the Authority and submit Detailed Project Report (DPR) to the Authority for technical vetting before establishing it.

(b) The Authority with prior approval of the Government may grant 'No Objection Certificate' for establishment of sperm station.

(c) On fulfilment of requirements for the establishment of new sperm station, the applicant shall submit an application in Form-1 along with fee as specified under sub-rule (3) of this rule.

(d) Thereafter, all the procedures, conditions, fees etc. applicable on existing sperm stations shall mutandis-mutandi apply to new sperm stations, however the new sperm station has to send request to Authority for Central Monitoring Unit's inspection by Government of India within six months of its establishment, failing which the sperm station shall stop all its operations and registration certificate shall be cancelled.

(e) The sperm station shall make account details of bulls whose semen doses it would like to produce, store, sell, distribute for Artificial Insemination in a format to be specified by the committee.

(3) Every application under sub-rules (1) and (2) shall be accompanied by fee amounting to Rs. 25000/- in the form of Demand Draft or Cheques or Bank transfer in favour of the Member Secretary, Himachal Pradesh Bovine Breeding Authority.

(4) The Authority on receipt of applications under sub-rules (1) and (2) and after satisfying that the conditions laid under sub-section (6) of section 9 of the Act have been complied with, may issue a Certificate of Registration for a period of two years in Form-2.

(5) The Incharge of the sperm station shall make a request to the Authority alongwith a fee of Rs. 5000/- by way of Demand Draft or Cheques or Bank transfer in favour of the Member Secretary, of the Authority at least three months prior to the expiry of the registration certificate, for renewal of the same.

Registration of Semen Banks.—(1) All the existing and new Semen Banks in the State shall register themselves with the Authority by submitting an application in Form-3 along with a fee of Rs. 5000/- by way of Demand Draft or Cheque or Bank transfer in favour of the Member Secretary, of the Authority.

(2) The Authority shall provide Provisional Registration Certificate to the Semen Bank which shall be valid for a period of six months only.

(3) After receipt of the application, the Authority shall arrange Technical Inspection of the semen bank by the committee constituted for the purpose as per provisions of sub-section (4) of section (3) of the Act within two months of receipt of the request.

(4) After Technical Inspection, grace period of two months shall be provided to the Semen Bank for meeting the non-compliances or observations made in the inspection report, if any.

(5) THE REGISTRATION CERTIFICATE IN FORM-4 SHALL BE PROVIDED TO THE SEMEN BANK after successful completion of two such inspections within a period of five months.

(6) If Semen Bank fails in the Technical Inspection or if for any other reason the validity of Provisional Registration Certificate expires without grant of Registration Certificate, the Semen BANK shall stop its operations immediately and rectify the non-compliances and shall apply afresh along with the fee applicable for registration of Semen Banks.

(7) The Registration Certificate shall be valid for two years and may be renewed by sending a request for renewal, by the incharge of the Semen Bank, three months prior to the expiry of two years alongwith a fee of Rs. 1000/- by way of Demand Draft or cheque or Bank transfer in favour of the Member Secretary of the Authority. The Semen Bank shall again be Technically inspected before renewal of Registration Certificate.

11. Certification of Bulls.— (1) The bulls shall be certified by the Authority, subject to conditions, as specified in the Minimum Standard Protocol and in consonance with the State Breeding Policy.

(2) The Authority shall request National Dairy Development Board to generate and assign Unique Identification Number for each certified bull over Information Network for Animal Productivity and Health Portal (INAPH Portal) so that no other bull in the country bears same number. It shall be mandatory for the semen stations to securely tag the certified bulls with Unique Identification Number tag thus generated and abide by INAPH norms.

(3) The bulls of different breeds used for semen production or natural service shall be selected for induction as per the specifications or standards mentioned in Minimum Standard Protocol and in agreement with state breeding policy. These bulls shall be examined by the committee for certification of bulls as constituted by the Authority under sub-section (4) of section 3 of the Act, for "Bull Soundness Examination" (BSE).

(4) The Bulls for Semen Production shall be procured from certified bull production programmes approved by the Government, such as Progeny Testing or Pedigree Selection Programmes running in the country in collaboration with National Dairy Development Board (NDDB) or Government of India or State Governments or High Genetic Merit Bulls from reputed Bovine Breeding Farms or Semen Stations of the State or Central Government based on Pedigree records or the High Genetic Merit Bulls produced by Embryo Transfer Technology or by In Vitro9005 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 Fertilization Technique, in accordance to standards specified in Minimum Standard Protocols and Standard Operating Procedures as formulated by the Department of Animal Husbandry, Government of India and Central Monitoring Unit (CMU) constituted by it and in agreement to the breeding policy of the State.

(5) The testing of the Artificial Insemination bulls or natural service bulls shall be carried out by the Sperm Station or Government or Private Agency as per the standards and tests mentioned in Minimum Standard Protocols and Standard Operating Procedures as formulated by the Department of Animal Husbandry, Government of India and Central Monitoring Unit (CMU) constituted by it on yearly basis or six-monthly basis, as the case may be, by the team of experts selected by the Authority for the purpose, which may include experts from Regional Disease Diagnostic Laboratory Jalandhar or any such agency notified by the Authority from time to time.

(6) It will be mandatory to karyotype the bulls before induction in sperm station or any other breeding programme.

(7) The breeding Bulls shall be tested against genetic diseases (recessive gene condition etc.) as specified in Minimum Standard Protocols and Standard Operating Procedures as formulated by the Department of Animal Husbandry, Government of India and Central Monitoring Unit (CMU) constituted by it for semen production, from the reputed Labs of Central or State Government or National Dairy Development Board.

(8) The culling of bulls shall be carried as per the provisions mentioned in Minimum Standard Protocols and Standard Operating Procedures as formulated by the Department of Animal Husbandry, Government of India and Central Monitoring Unit (CMU) constituted by it and after vetting by the committee constituted for Certification of Bulls.

(9) The Board shall send a request to the Authority with proper justification. The Authority shall approve the culling within fifteen days after receipt of the request if the bull does not qualify as per Minimum Standard Protocols and Standard Operating Procedures as formulated by the Department of Animal Husbandry, Government of India and Central Monitoring Unit (CMU) constituted by it and within two days if any bull tests positive for any of Sexually Transmitted Disease (STD) or Communicable Disease as may be specified in Minimum Standard Protocols and Standard Operating Procedures as formulated by the Department of Animal Husbandry, Government of India and Central Monitoring Unit (CMU) constituted by it.

(10) To carry out culling of bulls, the Board shall frame a Culling Committee in advance in the month of April every year, with officer from Directorate of Animal Husbandry not below the rank of Deputy Director and Accounts Officer of Directorate of Animal Husbandry as its members and Joint Director (SLBP) as its Chairman. The 'Culling Committee' thus constituted shall be valid for one year and it shall carry out the culling within 15 days after the approval of culling by the Authority or immediately after the approval of culling by the Authority in case the bull is tested positive for any Sexually Transmitted Disease or Communicable Disease.

12. Certification of Artificial Insemination Workers.— (1) The Artificial Insemination workers selected and trained by the Board or Department of Animal Husbandry, Himachal Pradesh under Centrally Sponsored Schemes (CSS) like National Programme for Cattle and Buffalo Breeding or National Project on Bovine Breeding (NPBB) or Rashtriya Gokul Mission (RGM) or any other scheme of the state or centre and carrying out the Artificial Insemination work in the allotted areas shall register themselves with the Authority by submitting an application in Form-5 alongwith fee of Rs. 1000/- by way of Demand Draft or Cheque or Bank-transfer in favour of the Member Secretary of the Authority.

9006 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 (2) The syllabus/ module for training of workers under Centrally Sponsored Schemes (CSS) like National Programme for Cattle and Buffalo Breeding/or National Project on Bovine Breeding (NPBB) or Rashtriya Gokul Mission (RGM) shall be same as specified in the guidelines of these Centrally Sponsored Schemes (CSS), which may be modified by the Authority as per the requirements of the State. The minimum academic qualification of Artificial Insemination worker shall be as may be specified by the State Government/Central Government from time to time.

(3) The new Artificial Insemination Workers who have successfully received training from the Board or Institution recognized by State Government, shall register themselves with the Authority before starting Artificial Insemination work in allotted areas.

(4) The Board shall provide list of all trained Artificial Insemination Workers who have been provided cryocans, to the Authority and subsequently shall submit updated list on 1st April of every year.

(5) The Artificial Insemination workers who are trained but have not carried out the Artificial Insemination work for last two years shall send a request to the Authority for refresher training and then shall register themselves with the Authority.

(6) The retired Para-Veterinarians, trained in Institutes recognized by the Himachal Pradesh Government during their regular service and working as private Artificial Insemination Workers or desire to work as Artificial Insemination Workers; retired Veterinarians or unemployed Veterinarians who provide breeding services through Artificial Insemination or desire to provide Artificial Insemination Services; the trained Multipurpose Artificial Insemination Technicians in Rural India (MAITIRS) who desire to work as Artificial Insemination workers shall register themselves with the Authority by submitting an application in Form 5 along with fee of Rs. 1000/- by way of Demand Draft or Cheque or Bank Transfer in favour of the Member Secretary of the Authority.

(7) All the Artificial Insemination workers shall provide the month-wise Artificial Insemination details in "Form-9" or any other format as so desired by the Authority to the nearest Veterinary Institution manned by a veterinarian who in-turn will submit the details through concerned reporting officer to Semen Bank of the concerned district. The Semen Bank shall provide consolidated information of Such Artificial Inseminations performed to the Board.

(8) If any Artificial Insemination worker fails to provide month-wise details of Artificial Insemination to concerned Veterinary Institution consecutively for two months, his registration shall be cancelled.

(9) All the Artificial Insemination Workers whether Government or Private, shall strictly follow the State Breeding Policy and the Standard Operating Protocols for Artificial Insemination as notified by the Government from time to time. Embryo transfer/In Vitro Fertilization will only be performed by a qualified Veterinarian. The registration of the workers not complying with such instructions shall be cancelled.

(10) The Registration certificate of Artificial Insemination workers will be issued in Forms 6 or 7 or 8 (as may be applicable) and shall be valid for one year from date of issuance.

(11) The Artificial Insemination worker shall make a written request for renewal of registration one month prior to date of expiry of registration, alongwith fee of Rs. 100/- as Demand draft or Cheque or Bank Transfer in favour of Member Secretary of the Authority.

(12) The registration certificate shall be renewed only after getting No Objection Certificate from the Board.

(13) Artificial Insemination Worker shall not use the semen doses received or purchased from any sperm station which is not registered with or certified by the Authority. In case of finding evidence of such activity of illegal use of semen, the Authority may cancel the registration of such Artificial Insemination Workers.

(14) Artificial Insemination Worker shall not procure semen from outside of Himachal Pradesh except in cases where special permission is granted by the Authority.

(15) For the proper Identification of Animals, the Artificial Insemination worker shall Tag the animal with Plastic Ear-tag barcoded with 12-digit Unique Identification Number before Insemination and upload the registration details on Information Network for Animal Productivity and Health (INAPH) portal through his own user credentials or in accordance with the directions of Government from time to time. He shall upload all breeding related data on the portal as required on various occasions, as specified in "Form-5" and his/her work on Information Network for Animal Productivity and Health (INAPH) portal will be supervised by the nearest Veterinary Officer / Senior Veterinary Officer as per area of operation.

(16) Any Artificial Insemination Worker applying for registration under these rules must be registered with the Himachal Pradesh Veterinary Council in case applicant being a Registered Veterinary Practitioner, or Himachal Pradesh Para Veterinary Council in case of being a Para Veterinarian or Board in case of applicant being trained under MAITRI (Multipurpose Artificial Insemination Technicians in Rural India) Scheme

13. Regulation of Sale of Semen.—(1) The Board shall sell or distribute or gift or transfer bovine semen or embryo among the field Artificial Insemination Centers of the State or any other agency registered with the Authority for crossbreeding/up-gradation of bovines. Any other agency registered with the authority which intends to sell or distribute or gift or transfer bovine semen or embryos to the individuals or any other agency registered with the Authority for crossbreeding/up- gradation shall seek No Objection Certificate from the Authority by sending a request along with justification for the purpose alongwith the details of semen or embryos. The Authority shall grant No Objection Certificate only after ascertaining that the sale or distribution or gift or transfer of bovine semen / Embryos is in accordance with the State Breeding Policy and directly or indirectly shall contribute to the bovine up-gradation of the State.

(2) The Board shall act as a nodal agency for import of bovine semen or embryos into the State from any other State or agency or Country. All such imports shall take place with prior approval of the Authority for each consignment. The breed or other parameters of imported semen and/or embryos shall be in accordance with the State Breeding Policy.

14. Issue of Duplicate Registration Certificate.—In case a certificate of registration or a certificate of renewal issued under these rules is defaced, lost or destroyed, the Authority, may upon satisfaction, grant a duplicate certificate to the applicant on payment of fee by way of Demand Draft or Cheque or Bank Transfer, in favour of Member Secretary of the Authority, as under:

(i) For sperm station: Rs. 500/-

(ii) For Semen Bank; Rs 500/-

(iii) For Artificial Insemination Worker: Rs. 100/-

15. Local Authorities to Assist.—Authority shall have all the powers to instruct, direct all concerned persons, whether public or private; authorities from Police, Revenue, Jal Shakti Vibhag, Himachal Pradesh, Himachal Pradesh State Electricity Board, Department of Animal Husbandry, 9008 राजपत्र, हिमाचल प्रदेश, 06 नवम्बर 2023/15 कार्तिक, 1945 Himachal Pradesh and Himachal Pradesh Livestock & Poultry Development Board from time to time. All concerned persons shall be bound to comply with the orders of the Authority.

16. Maintenance and submission of records.—The sperm stations and semen banks shall submit Annual Reports on proforma as may be specified by the Authority from time to time. The Authority may change the formats of application forms, information etc. from time to time. The Authority may propose to review the Breeding Policy of the State and Bovine Breeding Rules from time to time so as to keep in pace with the changing needs and technologies in Animal Husbandry sector. Chairperson of the Authority may provide the leeway to any applicant in case of emergency or requirement of the moment for the benefit of the farmers of the State with the consensus of the Authority in its meeting."
