संख्याः एल0एल0आर0-डी0(6)-21/2023-लेज.--हिमाचल प्रदेश के राज्यपाल ने भारत के संविधान के अनुच्छेद 200 के अधीन प्रदत्त शक्तियों का प्रयोग करते हुए हिमाचल प्रदेश नगरपालिका सेवा (संशोधन) 180—राजपत्र/2023-01-12-2023 (10277) 10278 राजपत्र, हिमाचल प्रदेश, 01 दिसम्बर 2023/10 मार्गशीर्ष, 1945 विधेयक, 2023 (2023 का विधेयक संख्यांक 15) को दिनांक 22-11-2023 को अनुमोदित कर दिया है तथा अनुच्छेद 348 के खण्ड (3) के अधीन, विधेयक के अंग्रेजी पाठ को राजपत्र, हिमाचल प्रदेश में प्रकाशित करने के लिए प्राधि—त कर दिया है। अतः उपरोक्त विधेयक को वर्ष 2023 के अधिनियम संख्यांक 14 के रूप में अंगे्रजी प्राधि—त पाठ सहित राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित किया जाता है।

2023 का अधिनियम संख्यांक 14 हिमाचल प्रदेश नगरपालिका सेवा (संशोधन) अधिनियम, 2023

(माननीय राज्यपाल महोदय द्वारा तारीख 22 नवम्बर, 2023 को यथा अनुमोदित)

हिमाचल प्रदेश नगरपालिका सेवा अधिनियम, 1994 (1994 का अधिनियम संख्यांक 11) का और संशोधन करने के लिए अधिनियम

भारत गणराज्य के चौहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इस अधिनियम का संक्षिप्त नाम हिमाचल प्रदेश नगरपालिका सेवा (संशोधन) अधिनियम, 2023 है।

(2) यह 23 अगस्त, 2023 सेे प्रवृत्त हुआ समझा जाएगा।

2. धारा 3 का संशोधन.--हिमाचल प्रदेश नगरपालिका सेवा अधिनियम, 1994 (1994 का अधिनियम संख्यांक 11) (जिसे इसमें इसके पश्चात्‌ ''मूल अधिनियम'' कहा गया है) की धारा 3 में,-

(क) उप-धारा (1) के पश्चात्‌, निम्नलिखित उप-धारा अन्तःस्थापित की जाएगी, अर्थात्‌ः-10279 राजपत्र, हिमाचल प्रदेश, 01 दिसम्बर 2023/10 मार्गशीर्ष, 1945 ''(1-क) हिमाचल प्रदेश नगर निगम अधिनियम, 1994 (1994 का 12) के अधीन स्थापित नगर निगमों में और इस अधिनियम की अनुसूची-III में यथा दर्शाए गए पद राज्य स्तरीय नगर निगम सेवा में समाविष्ट होंगे।''; और

(ख) उप-धारा (2) में ''अनुसूची-I'' शब्द, चिन्ह और संख्या के पश्चात्‌ ''यथास्थिति, या अनुसूची-III'' शब्द, चिन्ह और संख्या अन्तःस्थापित की जाएगी।

3. धारा 4 का संशोधन.--मूल अधिनियम की धारा 4 की उप-धारा (3) में '' अनुसूची-I'' शब्द, चिन्ह और संख्या के पश्चात्‌ '' अनुसूची-III'' शब्द, चिन्ह और संख्या अन्तःस्थापित की जाएगी।

4. धारा 5 का संशोधन.--मूल अधिनियम की धारा 5 की उप-धारा (1) में, ''अनुसूची-II'' शब्द, चिन्ह और संख्या के पश्चात्‌ '',यथास्थिति, या अनुसूची-IV ''शब्द, चिन्ह और संख्या अन्तःस्थापित की जाएगी। 5. धारा 20 का संशोधन.--मूल अधिनियम की धारा 20 में, ''अनुसूची-I और II'' शब्द, चिन्ह और संख्या के स्थान पर ''अनुसूची-I, II, III और IV'' शब्द, चिन्ह और संख्या रखी जाएगी।

6. अनुसूची-III और अनुसूची-IV का अन्तःस्थापन.--मूल अधिनियम में अनुसूची-II के पश्चात्‌ निम्नलिखित अनुसूचियां अन्तःस्थापित की जाएंगी, अर्थात्‌ः-

THE HIMACHAL PRADESH MUNICIPAL SERVICES (AMENDMENT) ACT, 2023

(As ASSENTED TO BY THE HON'BLE GOVERNOR ON 22ND NOVEMBER, 2023)

ACT

further to amend the Himachal Pradesh Municipal Services Act, 1994 (Act No. 11 of 1994).

BE it enacted by the Legislative Assembly of Himachal Pradesh in Seventy-fourth Year of the Republic of India as follows:—

1. Short title and commencement.— (1) This Act may be called the Himachal Pradesh Municipal Services (Amendment) Act, 2023.

(2) It shall be deemed to have come into force on 23rd day of August, 2023.

2. Amendment of Section 3.—In section 3 of the Himachal Pradesh Municipal Services Act, 1994 (hereinafter referred to as the "principal Act"),—

(a) after sub-section (1), the following sub-section shall be inserted, namely:—

"(1-a) There shall be State Level Municipal Corporation Services comprising of the posts in Municipal Corporations, established under the Himachal Pradesh Municipal Corporation Act, 1994 (12 of 1994) and as shown in the Schedule-III of this Act."; and (b) in sub-section (2), after the word, sign and number "Schedule-I", the words, signs and number "or Schedule-III, as the case may be" shall be inserted.

3. Amendment of Section 4.—In section 4 of the principal Act, in sub-section (3), after the word, sign and number "Schedule-I", the word, sign and number "Schedule-III" shall be inserted.

4. Amendment of Section 5.—In section 5 of the principal Act, in sub section (1), after the word sign and number, "Schedule-II", the words, signs and number "or Schedule-IV, as the case may be" shall be inserted.

5. Amendment of Section 20.—In section 20 of the principal Act, for the words, sign and numbers "Schedule-I and II" the words, signs and numbers "Schedule-I, II, III and IV" shall be substituted.

6. Insertion of SCHEDULE-III and SCHEDULE-IV.—In the principal Act, after the SCHEDULE-II, the following SCHEDULES shall be inserted, namely:—

7. Repeal and savings.—(1) The Himachal Pradesh Municipal Services (Amendment) Ordinance, 2023 (3 of 2023) is hereby repealed.

(2) Notwithstanding such repeal any action taken or anything done under the Ordinance so repealed, shall be deemed to have been done or taken under the corresponding provisions of this Act.

भारत गणराज्य के चौहत्तरवें वर्ष में हिमाचल प्रदेश विधान सभा द्वारा निम्नलिखित रूप में यह अधिनियमित हो :-

''(1) इस अधिनियम के उपबन्धों के अधीन रहते हुए यांत्रिक यान या छकड़ा के माध्यम से सड़क द्वारा वहन किए गए अनुसूची-1 के स्तंभ (2) में विनिर्दिष्ट प्रत्येक प्रकार के माल पर अनुसूची-1 के स्तंभ (3) में यथाविनिर्दिष्ट दरों पर कर उद्‌गृहीत किया जाएगा और राज्य सरकार को संदत्त किया जाएगा।''।

BE it enacted by the Legislative Assembly of Himachal Pradesh in the Seventy-fourth Year of the Republic of India as follows:—

1. Short title.— This Act may be called the Himachal Pradesh Taxation (on Certain Goods Carried by Road) Amendment Act, 2023.

2. Amendment of Section 3.—In Section 3 of the Himachal Pradesh Taxation (on Certain Goods Carried by Road) Act,1999;

(i) in sub-section (1), for the words "except railways and airways", the words "at the rates as specified in column (3) of Schedule-I" shall be substituted; and (ii) sub-section (2) shall be omitted.

If there be any objection or suggestion with respect to the Existing Land Use Map so prepared, it should be sent in writing to the Director, Town and Country Planning Department, Nagar Yojana Bhawan, Block No. 32-A, Vikas Nagar, Kasumpati, Shimla, Himachal Pradesh- 171009 or to the Assistant Town Planner, Sub-Divisional Town Planning Office, Bilaspur, District Bilaspur, Himachal Pradesh or to the Executive Officer, Municipal Council, Sh. Naina Devi Ji, District Bilaspur, Himachal Pradesh, within a period of thirty days from the date of publication of this Notice in the Official Gazette of Himachal Pradesh.

Any objection or suggestion which may be received from any person with respect to the said Existing Land Use Map before the period specified above will be considered by the Director.

अतः इससे पूर्व कि मामला में अधीन धारा 37(2) भू-राजस्व अधिनियम, 1954 के तहत आगामी आवश्यक कार्यवाई अमल में लाई जाए इस नोटिस द्वारा जनसाधारण को सूचित किया जाता है कि यदि किसी को उपरोक्त मामला में कोई उजर/एतराज हो तो वह इस न्यायालय में दिनांक 12-12-2023 को प्रातः 10.00 बजे असालतन या वकालतन हाजिर आकर अपना उजर पेश कर सकता है। अन्यथा गैरहाजिरी की सूरत में एकतरफा कार्यवाही अमल में लाई जाएगी एवं प्रार्थी के आवेदन-पत्र का नियमानुसार निपटारा कर दिया जाएगा।

श्री राजवीर सिंह पुत्र श्री जगदीश सिंह, निवासी गांव व डा0 बड़ोह, उप-तहसील गगरेट स्थित कलोह, जिला ऊना (हि0प्र0) व श्रीमती दैन्ती जसवाल पुत्री श्री एगस्टीन जोसेफ, वासी गांव व डा0 मारंगतुपिल्ली, केरला वर्तमान में पत्नी श्री राजवीर सिंह पुत्र श्री जगदीश सिंह, निवासी गांव व डा0 बड़ोह,10297 राजपत्र, हिमाचल प्रदेश, 01 दिसम्बर 2023/10 मार्गशीर्ष, 1945 उप-तहसील गगरेट स्थित कलोह, जिला ऊना (हि0प्र0) ने इस न्यायालय में प्रार्थना-पत्र मय शपथ-पत्र पेश किया है कि उनकी शादी दिनांक 10-11-1988 को मुताबिक हिन्दु रीति-रिवाज से हुई थी परन्तु अज्ञानतावश शादी का पंजीकरण ग्राम पंचायत बड़ोह के अभिलेख में नहीं करवाया है। प्रार्थी व प्राथिया ने अपनी शादी की पुष्टि बारे अपनी विवाह की फोटो, शपथ-पत्र, आधार कार्ड आदि दस्तावेज प्रार्थना-पत्र के साथ संलग्न किए हैं। रिपोर्ट सम्बन्धित स्थानीय पंजीकार विवाह पंजीकरण ग्राम नगर पंचायत बड़ोह के अनुसार उक्त शादी सम्बन्धित ग्राम पंचायत बड़ोह में दर्ज न है। अब प्रार्थीगण अपनी शादी पंजीकृत करवाना चाहता है। अतः आम जनता को इस इश्तहार/मुश्त्री मुनादी द्वारा सूचित किया जाता है कि यदि किसी भी व्यक्ति को उक्त शादी दर्ज करने बारे कोई उजर या एतराज हो तो वह दिनांक 07-12-2023 को दोपहर 2.00 बजे या इससे पूर्व असालतन या वकालतन हाजिर अदालत होकर पेश करें। गैर हाजिरी की सूरत में एक तरफा कार्यवाही करके नियमानुसार सम्बन्धित ग्राम पंचायत को शादी दर्ज करने का आदेश जारी कर दिया जाएगा।

उपरोक्त मुकद्दमा में प्रार्थी ने एक प्रार्थना-पत्र बराए नाम दुरुस्ती इस न्यायालय में दायर किया है जिसमें उसने अपना नाम राजेश कुमार शर्मा पुत्र मस्त राम, वासी महाल हरीनगर, जिला ऊना (हि0प्र0) बताया है जबकि उसका नाम राजस्व अभिलेख महाल हरीनगर, खेवट नं0 102, जमाबन्दी वर्ष 2019-2020 के अनुसार राजेश कुमार पुत्र मस्त राम दर्ज है। प्रार्थी राजेश कुमार के बजाए राजेश कुमार उपनाम राजेश कुमार शर्मा पुत्र मस्त राम, वासी महाल हरीनगर, जिला ऊना (हि0प्र0) करवाना चाहता है।

अतः सर्वसाधारण को इस इश्तहार द्वारा सूचित किया जाता है कि यदि किसी व्यक्ति को राजस्व अभिलेख महाल हरीनगर, उप-तहसील वीहडू कलां, जिला ऊना (हि0प्र0) में इस नाम दुरुस्ती बारे कोई आपत्ति/एतराज हो तो वह निर्धारित पेशी दिनांक 21-12-2023 या इससे पूर्व असालतन या वकालतन अदालत हजा में हाजिर आकर अपना एतराज प्रस्तुत कर सकता है। एतराज न प्राप्त होने की सूरत में हस्ब जाबता कार्यवाही अमल में लाई जाकर मुकद्दमा का निर्णय कर दिया जाएगा। 10298 राजपत्र, हिमाचल प्रदेश, 01 दिसम्बर 2023/10 मार्गशीर्ष, 1945 आज दिनांक 18-11-2023 को मेरे हस्ताक्षर व मोहर अदालत द्वारा जारी किया गया।
