संख्या : एल0सी0डी0 ए0-(3)-2/2019-लूज.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास अधिनियम, 1984 (1984 का अधिनियम संख्याक 18) की धारा 34 183—राजपत्र/2023-05-12-2023 (10361) 10362 राजपत्र, हिमाचल प्रदेश, 05 दिसम्बर 2023/14 मार्गशीर्ष, 1945 की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास नियम बनाने का प्रस्ताव करते हैं और इन्हें उसके द्वारा संभाव्य प्रभावित होने वाले जनसाधारण की सूचना के लिए राजपत्र (ई-गजट), हिमाचल प्रदेश में एतद्‌द्वारा प्रकाशित किया जाता है;

यदि इन प्रारुप नियमों से संभाव्य प्रभावित होने वाले किसी व्यक्ति के इन नियमों की बाबत कोई आक्षेप या सुझाव है/हैं; तो वह प्रारुप नियमों के राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर लिखित आक्षेप या सुझाव सचिव (भाषा, कला एवं संस्कृति) हिमाचल प्रदेश आम्र्सडेल बिल्डिंग, शिमला-2 को भेज सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप या सुझाव, यदि कोई है/हैं, पर इन नियमों को अंतिम रूप देने से पूर्व राज्य सरकार द्वारा विचार किया जाएगा, अर्थातः-

प्रारुप नियम

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश सार्वजनिक धार्मिक संस्था और पूर्त विन्यास नियम, 2023 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से प्रवृत्त होंगे। 2. परिभाषाएं.--(1) इन नियमों में जब तक कि सन्दर्भ से अन्यथा अपेक्षित न हो,--

(क) ''अधिनियम'' से, समय-समय पर यथासंशोधित हिमाचल प्रदेश सार्वजनिक धार्मिक संस्था और पूर्त विन्यास अधिनियम, 1984 (1984 का अधिनियम संख्यांक 18) अभिप्रेत है;

(ख) ''प्ररुप'' से, इन नियमाें से संलग्न प्ररुप अभिप्रेत है;

(ग) ''नियम'' से, अधिनियम के अधीन बनाया गया नियम अभिप्रेत है; और

(घ) ''धारा'' से, इस अधिनियम की धारा अभिप्रेत है।

(2) ऐसे अन्य सभी शब्दों और पदों के जो इसमें प्रयुक्त हैं किन्तु परिभाषित नहीं हैं और अधिनियम में परिभाषित हैं के क्रमशः वे ही अर्थ होंगे जो उस अधिनियम में उनके हैं।

(3) धारा 3 के अधीन नियुक्त अधिकारियों और कर्मचारिवृन्द की सेवा की शर्तें.-(1) अतिरिक्त मुख्य आयुक्त (मंदिर) निम्नलिखित शक्तियों का प्रयोग और कृत्यों का पालन करेगा, अर्थात्‌ः--

(क) मुख्य आयुक्त (मंदिर) और मंदिर न्यासों के मध्य सम्पर्क अधिकारी के रूप में कार्य करना (ख) न्यासों का सामान्य निरीक्षण संचालित करना और मुख्य आयुक्त (मंदिर) को रिपोर्ट करना (ग) ऐसे प्रयोजनों के लिए, जैसा वह उचित समझे या जैसा मुख्य आयुक्त (मंदिर) द्वारा अनुसूचित मंदिरों की प्रसुविधा हेतु वांछित हो मार्गदर्शक सिद्धान्त तैयार करना और ये मार्गदर्शक सिद्धान्त समस्त आयुक्त (मंदिर) पर आबद्धकर होंगे।

(2) संयुक्त आयुक्त (मंदिर) निम्नलिखित शक्तियों का प्रयोग और कृत्यों का पालन करेगा, अर्थात्‌ः-- (क) आयुक्त (मंदिर) द्वारा यथा प्रत्यायोजित शक्तियों का प्रयोग और कृत्यों का पालन करना (ख) न्यासों से संबंधित मामलों में आयुक्त (मंदिर) की सहायता करना10363 राजपत्र, हिमाचल प्रदेश, 05 दिसम्बर 2023/14 मार्गशीर्ष, 1945 (ग) प्रत्येक मामले में आयुक्त (मंदिर) के अनुमोदन से भवनों, मार्गाें, रास्तों, अग्नि- हाइड्रेंट आदि के रख-रखाव हेतु ऐसी वित्तीय शक्तियों का प्रयोग करना, जैसी सरकार समय-समय पर विनिर्दिष्ट करें।

(3) सहायक आयुक्त (मंदिर) निम्नलिखित शक्तियों का प्रयोग और कृत्यों का पालन करेगा, अर्थात्‌ः- (क) अतिरिक्त मुख्य आयुक्त (मंदिर) और आयुक्त (मंदिर)/संयुक्त आयुक्त (मंदिर)/मंदिर अधिकारियों/मंदिर न्यासों के मध्य सम्पर्क अधिकारी के रूप में कार्य करना।

(ख) मंदिर न्यासों के समस्त धार्मिक और सांस्कृतिक पहलुओं की देखभाल करना

(ग) मंदिर न्यास से संबंधित विधिक मामलों मेें सहायता करना

(घ) समस्त संसदीय और विधान सभा प्रश्नों/मामलों, चाहे किसी भी स्वरूप के हों, में सहायता करना।

(4) धारा 6 (1) के अधीन अनुरक्षित किए जाने वाले रजिस्टरों और धारा 6 (2) के अधीन तामील किए जाने वाले नोटिस का प्ररुप और रीति.--(1) प्रत्येेेक अनुसूचित मंदिर न्यास प्ररुप 'क' (भाग क से ज) में रजिस्टर तैयार और अनुरक्षित करेगा।

(2) आयुक्त (मंदिर) रजिस्टरों में प्ररुप 'क' (भाग क से ब) में समस्त प्रविष्टियों को सिद्ध करवाने और सत्यापित करवाने के लिए प्ररुप 'ख' में धारा 6 की उप-धारा के अधीन नोटिस जारी करेगा। (5) धारा 7 के अधीन रजिस्टरों में प्रविष्टियों की समीक्षा और सत्यापन.--(1) धारा 7 (1) के अधीन आयुक्त (मंदिर) को प्रस्तुत सत्यापित विवरण के साथ निम्नलिखित संलग्न किए जाएंगे,--

(i) न्यासी या उसके प्राधिकृत अभिकर्ता का उस प्रभाव का शपथ पत्र कि उसने उक्त दस्तावेज में यथा वर्णित मदों की भौतिकतः जांच और सत्यापन कर दिया है;

(ii) उस प्रभाव की घोषणा कि नियम 4 के साथ पठित धारा 6 के अधीन अनुरक्षित रजिस्टर में यथावर्णित स्थावर संपत्ति के समस्त हक-विलेख और दस्तावेज सही हैं; और

(iii) मूर्तियों के रंगीन फोटो और चित्र, प्राचीन या ऐतिहासिक अभिलेखों की विशिष्टियां या उसकी अभिरक्षा में कोई अन्य बहुमूल्य मदें।

(2) भौतिक सत्यापन के समय रजिस्टर में यथादर्शित अन्तर्वस्तुओं में किसी फेर-फार की दशा में, न्यासी या उसका प्राधिकृत अभिकर्त्ता आयुक्त (मंदिर) को विधि के अधीन यथा अपेक्षित उसके द्वारा कृत्त कार्रवाई के बारे में सूचित करेगा।

(3) सत्यापन प्रतिवर्ष प्रथम अप्रैल से प्रारंभ होगा और 30 जून तक पूर्ण किया जाएगा। सत्यापन के दौरान न्यासी या उसका प्राधिकृत अभिकर्ता यह सुनिश्चित करेगा कि रजिस्टर में समस्त नवीनतम अधिग्रहण निगमित किए गए हैं।

(6) स्थावर सम्पत्ति पर अतिक्रमण या उसको क्षति की दशा में धारा 9 (1) के अधीन अपेक्षित कार्रवाई.--स्थावर सम्पत्ति पर अतिक्रमण या उसको किसी क्षति की दशा में, न्यासी या उसका प्राधिकृत अभिकर्ता विधि के अधीन अपेक्षित समस्त आवश्यक कदम उठाएगा तथा मामले की आयुक्त (मंदिर) को भी रिपोर्ट करेगा। 10364 राजपत्र, हिमाचल प्रदेश, 05 दिसम्बर 2023/14 मार्गशीर्ष, 1945 (7) धारा 12 के अधीन भूमि के अंतरण हेतु आवेदन.--विनिमय, विक्रय, बंधक या किसी भी अन्य रीति में द्वारा किसी हिन्दू लोक धार्मिक संस्था और पूर्त विन्यासों के प्रयोजनार्थ संबंधित या दी गई या दान की गई स्थावर सम्पत्ति के अंतरण हेतु या ऐसी किसी सम्पत्ति के पट्‌टे के लिए अनुज्ञा के लिए आवेदन प्ररुप 'ग' में होगा।

(8) धारा 12 (3) के अधीन आयुक्त (मंदिर) के आदेश के प्रकाशन की रीति.--धारा 12 (3) के अधीन आयुक्त (मंदिर) द्वारा जारी आदेश की एक प्रति संबंधित न्यासी और प्रस्तावित अन्य संक्रामण को रजिस्ट्रीकृत डाक द्वारा भेजी जाएगी। इसे निम्नानुसार भी प्रकाशित किया जाएगा,-

(क) आदेश की प्रति को संबद्ध धार्मिक संस्था के सहजदृश्य नोटिस बोर्ड में या प्रवेश द्वार पर चिपकाना;

(ख) आदेश की प्रति को उस गांव या नगर के किसी सहजदृश्य स्थान पर चिपकाया जाएगा, जहां संपत्ति स्थित है। यदि वहां पर पंचायत घर है तो पंचायत-घर पर आदेश की प्रति चिपकाकर नियम की अपेक्षाएं पूर्ण की जाएंगी; और

(ग) प्रश्नगत संपत्ति पर आदेश की प्रति चिपकाना और यदि उक्त संपत्ति भूमि है, तो आदेश की उद्‌घोषणा डोंडी पिटवाकर की जाएगी।

(9) धारा 12-क के अधीन सोना और चांदी का हस्तांतरण.--प्रत्येक हिन्दू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास में सोना और चांदी की विभिन्न किस्मों के आकार में भक्तों की भेंट, जो कि अधिनियम की अनुसूची-1 में सम्मिलित है, को ऐसी रीति में जैसी सरकार की पूर्व अनुमोदन के अध्यधीन मन्दिर न्यास द्वारा संस्तुत की जाए, हस्तान्तरित की जाएगी।

(10) जिस रीति से धारा 14 (2) के अधीन संचालित की जाने वाली जांच.--मुख्य आयुक्त (मंदिर) न्यासी और उस व्यक्ति को जिसे सम्पत्ति हस्तांतरित की गई है सुनवाई का युक्तियुक्त अवसर प्रदान किया जाएगा। वह पक्षकारों को साक्ष्य प्रस्तुत करने का अवसर प्रदान करेगा और उन्हें सुनने के पश्चात्‌ आदेश करेगा। मुख्य आयुक्त (मंदिर) सिविल प्रक्रिया संहिता और भारतीय साक्ष्य अधिनियम में अधिकथित प्रक्रिया का पालन करने के लिए बाध्य नहीं हो सकेगा। मुख्य आयुक्त (मंदिर) की प्रत्येक आदेश की प्रति राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित की जाएगी।

(11) धारा 19 (2) के अधीन अपीलीय प्राधिकारी.--(1) मुख्य आयुक्त (मंदिर) अधिनियम की धारा 19 (2) के अधीन अपीलीय प्राधिकारी होगा।

(2) धारा 19 (1) के अधीन आयुक्त (मंदिर) के आदेश के विरुद्ध अपील मुख्य आयुक्त (मंदिर) को अपीलकर्ता या उसके अधिवक्ता द्वारा हस्ताक्षरित ज्ञापन के रूप में अधिमान दिया जाएगा। ज्ञापन में संक्षिप्त रूप से और अलग- अलग शीर्षकों के अधीन, अपील किए गए आदेश पर आपत्तियों का आधार बताया जाएगा और ऐसे आधार को क्रमांकित किया जाएगा। अपील मुख्य आयुक्त (मंदिर) को या तो पंजीकृत (रजिस्ट्रीकृत) डाक या व्यक्तिगत रूप से या अधिवक्ता द्वारा प्रस्तुत किया जाएगा और निम्नलिखित संलग्न किया जाएगा,- (क) आदेश की प्रमाणित प्रति जिसके विरुद्ध अपील दायर की गई ह;ै

(ख) अपील के ज्ञापन की उतनी प्रतियां जितनी पक्षकारों को दी जानी अपेक्षित है, जिनके अधिकार या हित ऐसी अपील में पारित किसी भी आदेश से प्रभावित होंगे।

(12) धारा 22 के अधीन तैयार किए जाने वाले बजट का प्ररुप.--7बजट को प्ररुप 'ई' में तैयार किया जाएगा और संपत्ति शेयर (हिस्सा), जमा, कर्मचारिवृन्द और कार्यों आदि के विवरण के साथ आय और व्यय का मदवार विवरण दिखाना होगा, जिससे आय प्राप्त होनी है और किस पर व्यय उपगत किया जाना है, संलग्न किया जाएगा ताकि यह स्पष्ट हो कि प्राक्कलन किस आधार पर तैयार किया गया है।10365 राजपत्र, हिमाचल प्रदेश, 05 दिसम्बर 2023/14 मार्गशीर्ष, 1945 (13) धारा 34 (2) (ज) के अधीन आय और व्यय की विवरणी.--आय और व्यय की विवरणी ट्रस्टियों (न्यासियों) द्वारा आयुक्त (मंदिर) को प्रत्येक तिमाही में प्ररूप 'ङ' में दाखिल की जाएगी।

(14) धारा 22(2) ('ङ') और 34 (2) ('झ') के अधीन मंदिर भवनाें की मुरम्मत.--(1) ऐसे समस्त मामलों में जहां मंदिर का भवन 100 वर्ष से अधिक पुराना है और इसे मुरम्मत की आवश्यकता है तो इसकी मरम्मत भाषा और संस्कृति विभाग हिमाचल प्रदेश केे परामर्श से की जाएगी।

(2) किसी भी हिंदू सार्वजनिक धार्मिक संस्थान और पूर्त विन्यास का न्यासी, भवन की मरम्मत और नवीकरण और हिन्दू सार्वजनिक धार्मिक संस्थान और पूर्त विन्यास की संपत्ति और परिसंपत्तियों के संरक्षण और परिरक्षण पर आयुक्त (मंदिर) द्वारा अनुमोदित बजट में आबंटित रकम व्यय करेगा।

(15) धारा 34(2) (ट) के अधीन मूर्तियों और प्रतिमाओं का संरक्षण और सुरक्षा.--किसी भी हिंदू सार्वजनिक धार्मिक संस्थानों और पूर्त विन्यास का न्यासी, मंदिरों में मूर्तियों और प्रतिमाओं के संरक्षण और सुरक्षा हेतु समय-समय पर आयुक्त (मन्दिर) द्वारा यथा निर्देशित समस्त आवश्यक उपाय करेगा।

(16) निरसन और व्यावृत्तियां.-- (1) अधिसूचना संख्या भाषा-ए(3)-3/85, तारीख 24-01-1986 द्वारा अधिसूचित और राजपत्र, हिमाचल प्रदेश में तारीख 15-10-1984 को प्रकाशित हिमाचल प्रदेश हिंदू सार्वजनिक धार्मिक संस्था और पूर्त विन्यास नियम, 1984 का एतद्‌द्वारा निरसन किया जाता है।

(2) ऐसे निरसन के होते हुए भी इस प्रकार निरसित नियमों के अधीन की गई कोई बात या कार्रवाई इन नियमों के तत्स्थानी उपबंधों के अधीन विधिमान्य रूप से की गई समझी जाएगी।

Shimla-2, the 22nd November, 2023

No. LCD-A(3)-2/2019-L.—In exercise of the powers conferred by sub-section (1) of Section 34 of the Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Act, 1984 (Act No. 18 of 1984), the Governor, Himachal Pradesh proposes to make the Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Rules and the same are hereby published in Rajpatra (e-Gazette), Himachal Pradesh for information of the general public likely to be affected, thereby;

Draft Rules

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Rules, 2023.

(2) These rules shall come into force from the date of publication in the Rajpatra (e- Gazette), Himachal Pradesh.

2. Definitions.–(1) In these rules, unless the context otherwise requires,—

(a) "Act" means Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Act, 1984 (Act No. 18 of 1984) as amended from time to time;

(b) " Form" means a Form appeared to these rules;

(c) "Rule" means a rule made under the Act; and

(d) "Section" means a section of the Act.

(2) All other words and expressions used herein but not defined and defined in the Act shall have meanings respectively assigned to them in the Act.

3. Conditions of service of Officers and Staff appointed under section 3.—(1) Additional Chief Commissioner (Temple) shall exercise the following powers and the functions, namely:—

(a) Act as a liaison officer between the Chief Commissioner (Temple) and the Temple Trusts.

(b) Conduct general inspection of the Trusts and report to the Chief Commissioner (Temple).

(c) Prepare guidelines for such purposes as he deems fit or as desired by the Chief Commissioner (Temple) for the benefit of Scheduled temples and these guidelines shall be binding on all Commissioners (Temple).

(2) The Joint Commissioner (Temple) shall exercise the following powers and perform the following functions namely:—

(a) Exercise powers and perform functions as delegated by the Commissioner (Temple).

(b) Assist the Commissioner (Temple) in matters relating to Trusts.

(c) Exercise financial powers as the Government may from time to time specify for maintenance of buildings, ways, paths, fire hydrants etc. in each case with the approval of Commissioner (Temple).

perform the following functions, namely:—

(a) Act as a liaison officer between the Addl. Chief Commissioner (Temple) and the Commissioner (Temple)/Joint Commissioner (Temple) /Temple Officers/ Temple Trusts.

(b) To look after all religious and cultural aspects of Temple Trust(s) (c) To assist in legal matters related to temple Trusts

(d) To assist in all Parliamentary and Assembly questions/matters of whatsoever nature.

4. Form and manner in which the registers are to be maintained under section 6(1)

and notice to be served under section 6(2):

(1) Every Scheduled temple Trust shall prepare and maintain registers in Form 'A'(Part –A to H).

(2) The Commissioner (Temple) shall issue the notice under sub-section (2) of Section 6 in Form 'B' to have all entries in the registers in Form 'A' (Part – A to H) substantiated and verified.

5. Scrutiny and verification of the entries in the registers under section 7.–(1) The verified statement submitted to the Commissioner (Temple) under section7(1) shall be accompanied by,—

(i) An affidavit of the Trustee or his authorized agent to the effect that he has physically checked and verified the items as mentioned in the said document;

(ii) A declaration to the effect that all the title deeds and documents of the immovable property as mentioned in the register maintained under section 6 read with rule 4 are correct; and

(iii) Colour photographs and images of idols, particulars of ancient or historical records, or any other valuable items in his custody.

(2) In case of any variation in the contents as shown in the register and at the time of physical verification, the Trustee or his authorized agent shall inform the Commissioner (Temple) about the action taken by him as required under law.

(3) The verification shall start from the 1st of April and completed by 30th June every year. During the verification the Trustee or his authorized agent shall ensure that all the latest acquisitions have been incorporated in the register.

6. Action required under section 9(1) in case of damage to or encroachment on the immovable property.—In case of any damage to or encroachment on the immovable property, the Trustee or his authorized agent shall take all necessary steps required under law and shall also report the matter to Commissioner (Temple).

7. Application under section 12 seeking transfer of land.—The application seeking permission for transfer of immovable property belonging to, or given or endowed for the purposes of any Hindu Public Religious Institution and Charitable Endowments by way of exchange, sale, mortgage or in any other manner whatsoever or for the lease of any such property shall be in Form 'C'.

8. Manner of the publication of the order of the Commissioner (Temple) under section 12(3).—A copy of the order issued by the Commissioner (Temple) under section 12(3) shall be sent to the Trustee concerned and the proposed alienation by registered post. It shall be also published by,—

(a) Affixture of the copy of the order in a conspicuous notice board or on the front door of the religious institution concerned,

(b) Affixture of the copy of the order in a conspicuous place of the village or town where the property is situated. In case there is a Panchayat-Ghar, the requirements of the rule will be met by affixture of the copy of the order on the Panchayat- Ghar; and

(c) Affixture of the copy of the order on the property in question and where the said property is land, then by proclamation of the order by beat of drum.

9. Alienation of Gold and Silver under section 12-A.—The offerings received from the devotees in the shape of various varieties of gold and silver in every Hindu Public Religious Institution and Charitable Endowments, as included in the Schedule-I of the Act, shall be alienated in the manner, as may be recommended by the Temple Trust subject to the prior approval of the Government.

10. Manner in which the enquiry is to be conducted under section 14(2).—The Chief Commissioner (Temple) shall give a reasonable opportunity of being heard to the Trustee and the person to whom the property has been alienated. He shall afford the parties an opportunity to adduce evidence and make an order after hearing them. The Chief Commissioner (Temple) may not be bound to follow the procedure laid down in the Code of Civil Procedure and Indian Evidence Act. A copy of every order of the Chief Commissioner (Temple) shall be published in the Rajpatra (e-Gazette), Himachal Pradesh.

11. Appellate authority under section 19 (2).—(1) The Chief Commissioner (Temple) shall be the Appellate Authority under section19(2) of the Act.

(2) Every appeal to the Chief Commissioner (Temple) against the order of the Commissioner (Temple) under section 19(1) shall be preferred in the form of a memorandum signed by the appellant or his pleader. The memorandum shall set forth, concisely and under distinct heads, the grounds of objections to the order appealed and such grounds shall be numbered consecutively. The appeal shall be sent to the Chief Commissioner(Temple) either by registered post or presented in person or by a pleader and shall be accompanied by,—

(a) Certified copy of the orders against which appeal is filed; and

(b) As many copies of the memorandum of appeal as are required for service upon the parties whose rights or interest shall be affected by any order that may be passed in such appeals.

12. Form of budget to be prepared under section 22.—The budget will be prepared in Form 'D' and the item wise details of income and expenditure with description of property, shares, deposits, staff and works etc. from which income is to be derived and on which expenditure is to be incurred should be attached so that it is clear as to the basis on which the estimates have been prepared.

13. Return of income and expenditure under section 34(2)(h).—The return of income and expenditure shall be filed by the Trustees in Form -'E' every quarter to the Commissioner (Temple).

14. Repairs of temple buildings under section 22(2)(e) and 34(2) (j).—(1) In all cases where the temple building is more than 100 years old and needs repair, it will be affected in consultation with the Department of Language and Culture, Himachal Pradesh.

(2) The Trustee of any Hindu Public Religious Institution and Charitable Endowments shall spend the allocated amount in the budget approved by the Commissioner (Temple) on the repairs and renovation of the building and preservation and protection of the property and assets of the Hindu Public Religious Institution and Charitable Endowments.

15. Preservation and security of idols and images under section 34(2)(k).—The Trustee of any Hindu Public Religious Institutions and Charitable Endowments shall take all necessary measures as directed by the Commissioner (Temple) from time to time, for the preservation and security of idols and images in temples.

16. Repeal and savings.—(1) The Himachal Pradesh Hindu Public Religious Institutions and Charitable Endowments Rules, 1984 notified under notification No. Bhasha-A (3)-3/85, dated 24-1-1986 and published in the Rajpatra Himachal Pradesh dated 15-10-1984 are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the rules so repealed shall be deemed to have been validity done, or taken under the corresponding provision of these rules.
