The eligible unit has to obtain verified Udyog Aadhar Memorandum (UAM)/ commencement of commercial production certificate from the authorized officers of the Department of Industries, Government of Himachal Pradesh. The eligible unit will obtain certificate from the Department of State Excise & Taxation clearly mentioning the amount of net SGST paid to the State of Himachal Pradesh. 4. Net SGST reimbursement would be available only after the date of Commencement of Commercial Production (CoP)/operation for new unit and from the date of Commercial production/operation after undertaking substantial expansion for existing enterprise(s). | ||||||||

The eligible enterprise(s) will submit reimbursement claim of the financial year to the Department of Industries on annual basis in the succeeding financial year before 31st August or within 3 months of assessment of net SGST by the Excise & Taxation Department H.P., whichever is later (also applicable for units as found eligible under this Policy). N ote.—The modified/amended rates would be applicable only to the enterprises set up in the State after the date of notification in this regard by the Government and till the date of implementation of this Policy. |

No. HFW-B(B)15-13/2019.—Subject : Regarding re-employment/extension in service to the faculty members of Government Medical/Dental Colleges of the State.
The Governor, Himachal Pradesh, in supersession of this department's Notification No. HFW-B (B)15-13/2019 dated, 25-06-2020 & notification No. HFW-B (B)15-13/2019, dated, 17-12-2021 is pleased to re-notify the policy as under:—
(i) The retirement/superannuation age of Medical faculty in the Medical Colleges of the State has been fixed 62 years vide Finance (Regulation), department, notification No. Fin-(C)B(15)2/2009, dated, 15th December, 2011 and the retirement/ superannuation age of Medical faculty at AIMSS Chamiana has been fixed as 65 years. The re-employment in case of IGMC, Dr. RPGMC Tanda, H.P. Government Dental College, Shimla & AIMSS Chamiana would be considered on the case to case basis depending upon the needs of specific department. Such re-employed faculty shall not hold any administrative position viz. Head of Department (HOD), Vice Principal, Principal, Dean and Director Medical Education etc.
(ii) Faculty members of Dr. YSPGMC Nahan/Dr. RKGMC Hamirpur/Pt. JLNGMC Chamba and SLBSGMC Mandi at Ner Chowk i.e. Professors, Associate Professors, before superannuation which is fixed 62 years would on case to case basis get an extension in service upto a maximum age of 68 years in their respective Medical Colleges. Such extension shall be given only if the following criteria is met:—
a. No regular faculty member in the feeder cadre shall gain eligibility for the post within one year of the date of retirement of the faculty member who is seeking extension in the concerned college in that department.

They will also be eligible to hold administrative positions i.e HOD, Vice- Principal and Principal etc. However, after superannuation, they would be considered for re-employment on a case to case basis. They would, however not be eligible for holding any administrative positions after 68 years.
(iii) Faculty members i.e. Professors, Associate Professors of Dr. YSPGMC Nahan/Dr. RKGMC Hamirpur/Pt. JLNGMC Chamba and SLBSGMC Mandi at Ner Chowk on superannuation who do not wish to opt for extension in their respective Medical Colleges after attaining the age of superannuation i.e. 62, may opt for re-employment in their respective Medical Colleges subject to fulfilment of conditions as laid down at Clause (ii) above. They shall be entitled to take their retirement dues and the admissible contractual emoluments shall be paid to them besides the pensionary benefits.
(iv) The extension/re-employment of a Professor as mentioned ibid shall also be considered against the vacancy of Associate Professor in new Medical Colleges of the State. However, in case there is a regular Professor in the Department, the faculty on extension against the vacancy of Associate Professor shall not hold administrative positions of HOD of that department.
(v) In case the faculty members from new Medical Colleges are not available for extension/re-employment in their respective Medical Colleges, then the Faculty Members of IGMC, Shimla, Dr. RPGMC, Tanda and H.P. Government Dental College, Shimla & AIMSS Chamiana i.e. Professors, Associate Professors, before superannuation opting for their posting to Dr. YSPGMC Nahan/Dr. RKGMC Hamirpur/Pt. JLNGMC Chamba and SLBSGMC Mandi at Ner Chowk would on case to case basis get an extension in service upto a maximum age of 68 years. Such extension shall be given only if the following criteria are met:—
a. Corresponding post of Professor/Associate Professor in Dr. YSPGMC Nahan and Dr. RKGMC Hamirpur/Pt. JLNGMC Chamba and SLBSGMC Mandi at Ner Chowk is not occupied by any regular /contractual faculty member.
b. No regular faculty member in the feeder cadre shall gain eligibility for the post within one year of the date of retirement of the faculty member who is seeking extension in the concerned college in that department.
c. They will also be eligible to hold administrative position i.e. HOD, Vice-Principal and Principal etc. However, after superannuation of age, they would also be considered for re-employment in new medical Colleges of the State on a case to case basis. They would, however not be eligible for holding any administrative position after 68 years.
(vi) Faculty members i.e Professor, Associate Professor including Dental faculty from IGMC, Dr. RPGMC Tanda and H.P. Govt. Dental College, Shimla & AIMSS Chamiana on superannuation who do not wish to opt for extension in Dr. YSPGMC Nahan/Dr. RKGMC Hamirpur/Pt. JLNGMC Chamba and SLBSGMC Mandi at Ner Chowk after attaining the age of superannuation may opt for re-employment at Dr. YSPGMC Nahan/Dr. RKGMC Hamirpur/Pt. JLNGMC Chamba and SLBSGMC Mandi at Ner Chowk subject to fulfilment of conditions as laid down at Clause (v) above. They shall be entitled to take their retirement dues and the admissible contractual emoluments shall be paid to them besides the pensionary benefits.

JLNGMC Chamba and SLBGMC Mandi at Ner Chowk. However, in case there is a regular Professor in the Department, the faculty on extension against the vacancy of Associate Professor shall not hold administrative position of HOD of that Department.
The notification shall come into force with immediate effect.

No. 132597.—The Governor, Himachal Pradesh is pleased to order to notify new policy for regulating appointment of faculty members and Resident Doctors (on contract basis) in all the new Government Medical Colleges of the State i.e. Dr. YSPGMC Nahan, SLBSGMC Ner Chowk (Mandi), Pt. JLNGMC Chamba & Dr. RKGMC Hamirpur as per 'ANNEXURE-Z'. This new policy will also apply to Dr. RPGMC Tanda and Atal Institute of Medical Super Specialties at Chamiana (AIMSS Chamiana) for appointment of Superspecialist Doctors/ faculty members (on contract basis), with immediate effect, in the public interest.
This contractual policy shall only apply for those posts in the Government Medical Colleges/Institutions of the State where regular eligible candidates are not available for appointment or the posts which cannot be filled up for the reasons as per the R&P rules and for the posts for which the R&P rules are being framed:
Provided that the contractual candidates should fulfil all essential qualifications as per the R&P rules/ proposed R&P rules:
Provided further that on appointment of regular faculties and Resident doctors, the contractual appointment made against the respective posts shall stand terminated automatically.
Thus, this Department's notification No. HFW-B(B)2-2/2016, dated 22-04-2016 and its
further amendments stands superseded, with immediate effect.

10851 राजपत्र, हिमाचल प्रदेश, 18 दिसम्बर 2023/27 मार्गशीर्ष, 1945 ANNEXURE-ZPOLICY FOR REGULATING APPOINTMENT OF FACULTY MEMBERS AND
RESIDENT DOCTORS (ON CONTRACT BASIS):—
1. The Professor/Associate Professor/Assistant Professor, Senior Resident/Tutor Specialist and Junior Resident/Tutor General in the Department of Medical Education & Research, Himachal Pradesh will be engaged on contract basis initially for a period of one year or till the post is filled up by regular channel/ appointment whichever is earlier. The contract period shall be extended on year to year basis as the case may be.
2. The Professor/Associate Professor/Assistant Professor, Senior Resident/Tutor Specialist and Junior Resident/Tutor General appointed on contract basis will be paid consolidated fixed contractual amount as mentioned in the ANNEXURE-A (which shall be a fixed amount of pay). An annual increase @ of 3% in contractual emoluments for the subsequent years will be allowed, if contract is extended beyond one year and no other allied benefits such as senior/ selection scales etc. shall be given.
3. The Addl. Chief Secretary/Pr. Secretary/Secretary (Health) to the Government of Himachal Pradesh will be appointing and disciplinary authority.
4. The contractual appointee will be governed in accordance with the provisions of this policy. The rules, regulations and orders in force from time to time as applicable to other Government servants such as CCS(CCA) Rules and CCS (Conduct) Rules, instructions/guidelines/ notifications issued by the Departments of Personnel/Finance shall not be applicable to the contractual appointee.
5. On being offered appointment (on contract basis), the contract appointee shall sign an agreement as per ANNEXURE-B and submit joining report to the Government through Principal concerned.
6. The appointment of the contract appointee shall be purely on temporary basis and shall not confer any right of regularization/continuation/promotion against the concerned post(s) in the Government Medical Colleges/ Institutions. The appointment of the contractual appointee is liable to be terminated in case, the work and conduct/ performance during the contractual period is not found satisfactory; and no further extension in contractual period shall be granted.

The contractual appointee i.e. Professor/ Associate Professor/ Assistant Professor, Senior Resident/ Tutor Specialist and Junior Resident/Tutor General will be entitled for one day Casual Leave after putting in one day's casual leave after putting in one month services. However, the contract employee will also be entitled for 180 days Maternity Leave under the Maternity Benefits Act, 1961 and 10 day's Medical Leave. He/ She shall not entitle for Medical Re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contractual appointee Professors/ Associate Professor/ Assistant Professor/ Tutor/ Senior Resident/ Junior Resident:

9. Unauthorized/wilful absence from the duty without the approval of the Controlling Authority shall automatically lead to the termination of the contract. During the period of unauthorized absence from the duty, the contractual amount shall not be paid for the said period to the concerned appointee.
10. The transfer of a contract appointee will not be permitted from one Government Medical College/institution to another in any circumstances.
11. The selected contractual candidate will have to submit a certificate of his/her fitness from the Medical Board of concerned district. Woman candidate pregnant beyond 12 weeks will stand temporarily unfit till the confinement is over. The woman candidate will be re-examined for the fitness.
12. The contractual appointee will be entitled to TA/DA if required to go on tour in connection with his/her official duties at the same rate as applicable to regular officials at the maximum of pay scale.
13. The contractual appointee(s) under this policy shall have no right to claim for regularization/ permanent absorption as Professor/ Associate Professor/Assistant Professor, Senior Resident/Tutor Specialist and Junior Resident/ Tutor General in the Department/institution at any stage.
14. The appointment is provisional and is subject to the educational qualification and other certificates being verified through the proper channels and if the verification reveals that the claim to belong to reserve categories, as the case may be is false, the services will be terminated forthwith without assigning any further reasons and without prejudice to such further action as may be taken under the provisions of the Indian Penal Code for production of false certificate.
15. He/she will have to give a declaration to the effect that he/she has only one living spouse, if married.
16. He/she will have to take an oath of allegiance/ faithfulness to the Constitution of India or marking a solemn affirmation.
17. He/she will have to produce all the certificates of the requisite qualifications to the concerned post in original at the time of appointment/joining.
18. The post of Tutor in non-clinical Departments of new Government Medical Colleges of the State shall be filled up as per the eligibility criteria laid down by the Medical Council of India (MCI)/National Medical Commission (NMC) in this regard or after specialization in the particular subject as prescribed by Senior Resident Policy.
19. The emoluments admissible to the tutors shall be as follows:—

20. Teaching experience shall not be admissible to Tutor General in the concerned specialty for purposes of eligibility to higher post.
21. The Tutor already appointed in various Government Medical Colleges of the State shall draw salary in accordance with this notification henceforth and all further appointments to the post of Tutors shall be made in consonance with this notification.
22. The contractual appointee shall not be eligible to hold the charge of the HOD of the concerned specialty/Superspecialty in the event of availability of regular faculty i.e. Professor/Associate Professor/Assistant Professor in the concerned Government Medical College. Accordingly, in case of non-availability of regular faculties in the concerned specialty/Superspecialty, the contractual appointee shall hold the charge of HOD.
23. The Principal concerned shall be competent authority under this policy to ensure that the contract agreement has been signed as strictly as per notified terms and conditions annexed at ANNEXURE-B.
24. The benefit of Employees Group Insurance Scheme as well as EPF/ GPF will not be applicable to contractual appointee(s).

Whereas, the SECOND PARTY has engaged the aforesaid FIRST PARTY and the FIRST PARTY has agreed to serve as Professor/Associate Professor/Assistant Professor, Senior Resident/ Tutor Specialist and Junior Resident/Tutor General on contract basis on the following terms and conditions:—
1. That the FIRST PARTY shall remain in the service of the SECOND PARTY as ………………......…….. (designation) on contract basis initially for a period of 01 year commencing on the day of ….........……………….. and ending on the day of ……………….……. OR till the post is filled up by regular channel/ appointment whichever is earlier. The contract period shall be extended on year to year basis as the case may be. It is specifically mentioned and agreed upon by both the parties that the contract of the FIRST PARTY with SECOND PARTY shall ipso-facto stand terminated on the last working day i.e. on ………….................………and information notice shall not be necessary:
Provided that for-further extension/renewal of contract period, the Head of Department of respective specialty/Principal concerned shall issue a certificate that the work and conduct/ performance during the contractual period is found satisfactory during the contract period and only then the period of contract is to be renewed/ extended.
2. The FIRST PARTY appointed on contract basis will be paid consolidated fixed contractual amount as mentioned in the ANNEXURE-A of new policy or as amended from time to time. An annual increase @ of 3% in contractual emoluments for the subsequent years will be allowed, if contract is extended beyond one year and no other allied benefits such as senior/ selection scales etc. shall be given.
3. The contractual amount of the FIRST PARTY will be as per ANNEXURE-A.
4. The service of FIRST PARTY will be purely on temporary basis. The appointment is liable to be terminated in case the work and conduct/ performance of the contract appointee is no found good or if a regular incumbent is appointed posted against the vacancy for which the FIRST PARTY was engaged on contract basis.
5. The services of FIRST PARTY will be governed in accordance with policy notified for appointment as Professor/ Associate Professor/Assistant Professor, Senior Resident/10855 राजपत्र, हिमाचल प्रदेश, 18 दिसम्बर 2023/27 मार्गशीर्ष, 1945 Tutor Specialist and Junior Resident/Tutor General appointed on contract basis by the Department of Medical Education & Research, Himachal Pradesh from time to time:
Provided that the instructions/ guidelines/ notifications issued by the Department of Personnel and Finance Departments, Himachal Pradesh will not be applicable to the FIRST PARTY who has joined the services as per the policy/terms and conditions notified by the Department of Medical Education & Research, Himachal Pradesh.
Further provided that the FIRST PARTY will be governed in accordance with the provisions of policy for appointment on contract basis by the Department of Medical Education & Research, Himachal Pradesh. The rules, regulations and orders in force from time to time as applicable to other Government servants such as CCS(CCA) Rules and CCS(Conduct) Rules, shall not be applicable upon the FIRST PARTY.
6. The service of the FIRST PARTY will be purely on temporary basis. The appointment is liable to the terminated in case, the work and conduct/performance of the contract appointee is not found satisfactory.

Yashwant Chhajta, r/o Chhajta Heights Sanjauli Chowk, Sanjauli, Shimla-6, Tehsil & District Shimla (H.P.) have filed an application alongwith affidavits in the court of the undersigned stating therein that they have solemnized their marriage on 21-10-2021 and are living together as husband and wife since then, but the marriage has not been found entered in the records of Gram Panchayat concerned/Municipal Corporation Shimla and marriage be registered under the Special Marriage Act, 1954.
Therefore, objections are hereby invited from the general public through this notice, that if anyone has any objection regarding registration of this marriage, they can file their objections personally or in writing before the court of undersigned on or before 15-01-2024, after that no objection shall be entertained and marriage will be registered accordingly.
