संख्या : MPP-F(5)-8/2018-III.—हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश भूमि अर्जन, पुनर्वासन एवं पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता अधिकार (सामाजिक समाघात निर्धारण एवं सहमति) 207—राजपत्र/2023-04-01-2024 (11547) 11548 राजपत्र, हिमाचल प्रदेश, 04 जनवरी 2024/14 पौष, 1945 नियम, 2015 के नियम 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ग्राम/मुहाल लुणसू, मुंगना, जैशी, भराड़ा तहसील सुन्नी व ग्राम/मुहाल मजरोग तहसील कुमारसैन, जिला शिमला ग्राम/मुहाल भौरा, जकलीन, मगाण, फफान, परलोग, बेलूढांक, खरयाली, तहसील करसोग, जिला मण्डी (हिमाचल प्रदेश) के प्रस्तावित भूमि अर्जन के प्रयोजन हेतु सामाजिक समाघात निर्धारण को कार्यान्वित करने के लिए सामाजिक समाघात निर्धारण अध्ययन के कार्यान्वयन हेतु निम्न प्रकार से अधिसूचित करते हैः--

ग्राम/मुहालवार खसरा नम्बर अनुलग्नक 'अ' में सलंग्न खसरा नम्बर में समाविष्ट, ग्राम/मुहाल लुणसू, मुंगणा, जैशी, भराडा, तहसील सुन्नी व ग्राम/मुहाल मजरोग, तहसील कुमारसैन, जिला शिमला ग्राम/मुहाल भौरा, जकलीन, मगाण, फफान, परलोग, बेलूढांक, खरयाली, तहसील करसोग, जिला मण्डी, (हिमाचल प्रदेश) के प्रस्तावित अतिरिक्त भूमि रकवा 9.1099 हैक्टेयर को एस.जे.वी.एन. लिमिटेड द्वारा सुन्नी बांध जल विद्युत परियोजना (382 मैगावाट) के निर्माण हेतु सतलुज नदी की अधिकतम जल विद्युत उत्पादन के उद्देश्य से अर्जित किया जाना है। यह रन ऑफ रिवर प्रकार की प्रस्तावित विकास योजना है।

जल विद्युत ऊर्जा संसाधन के दोहन के लिए हिमाचल प्रदेश की रणनीति के तहत न्यूनतम लागत के साथ और न्यूनतम पर्यावरणीय नकारात्मक प्रभावाें के साथ यथासंभव ऊर्जा उत्पादन करना है। जल विद्युत ऊर्जा क्षमता का तेजी से दोहन राज्य की आर्थिक स्थिति को निश्चित रूप से सुदृढ़ करने में सहायक होगा। परियोजना की आवश्यकता उचित मांग से लगातार वृद्धि और उत्तरी क्षेत्र में बढ़ती ऊर्जा की कमी को पूर्ण करने की आवश्यकता से उत्पन्न हुई है।

इसलिए यह स्पष्ट किया जाता है कि सामाजिक निर्धारण के दौरान किसी भी प्रकार के बल प्रयोग या धमकी का प्रयत्न इस कवायद को अकृत और शून्य बना देगा और सामाजिक समाघात निर्धारण को इसके प्रारम्भ से छः मास की अवधि के भीतर कार्यान्वित किया जाएगा। सामाजिक समाघात निर्धारण इकाई परामर्श, सर्वेक्षण और जन सुनवाई करेगी। सामाजिक समाघात निर्धारण इकाई यह भी निश्चित करेगी कि सामाजिक अध्ययन करते समय पंचायतों के प्रतिनिधियों तथा ग्राम सभा को उचित प्रतिनिधित्व दिया जाए।

सामाजिक समाघात निर्धारण इकाई, सामाजिक निर्धारण अध्ययन करते समय अन्य बातों पर विचार करेगी जोकि परियोजना से विभिन्न घटकों पर पड़ने वाले संभावित प्रभाव पर विचार करेंगे जैसे कि प्रभावित परिवारों को आजीविका, सार्वजनिक एवं सामुदायिक सम्पत्तियों, आस्तियों तथा अवसरंचनाएं विशिष्टतया सड़कों, लोक परिवहन, जल निकासी संकर्म, स्वच्छता, पेयजल स्त्रोतों, सामुदायिक जलाश्यों, चरागाह भूमि, बागानों, जनसुविधाएं जैसे कि डाकघर, उचित मूल्य की दुकानें, खाद्य भण्डारण गोदाम, विद्युत आपूर्ति, स्वास्थ्य देखभाल सुविधाएं, विद्यालय और शैक्षणिक तथा प्रशिक्षण सुविधाएं, आंगनबाड़ी, बाल उद्यान, पूजास्थल, पारम्परिक जनजातीय संस्थाएं, कब्रस्थान और शमशान घाट आदि। सामाजिक समाघात निर्धारण इकाई अधिनियम, 2013 के अनुच्छेद 4 (4) के अधीन सूचीबद्ध सभी मदों और उनके अधीन बने नियमों को सम्मिलित करेगी। सामाजिक समाघात निर्धारण इकाई, परामर्श सर्वेक्षण और जनसुनवाई पूरी होने पर सामाजिक समाघात अध्ययन रिपोर्ट नियम-3 के उप-नियम 3 के अनुसार प्रपत्र-II में तैयार करेंगे और सामाजिक समाघात प्रबन्ध योजना, सुधारात्मक उपायों की सूची जो कि विशिष्ट घटकों के प्रभाव निवारण हेतूु आवश्यक है को नियम 3 के उप-नियम 4 के अनुसार प्रपत्र-III में तैयार करेंगे।

एस.जे.वी.एन. लिमिटेड भारत सरकार और हिमाचल प्र्र्रदेश सरकार का संयुक्त सार्वजनिक क्षेत्र का उपक्रम है और भूमि अर्जन पुनर्वासन और पुनव्र्यवस्थापन में उचित प्रतिकर और पारदर्शिता का अधिकार अधिनियम, 2013 के अनुच्छेद 2 (1) (b) के अधीन एसजेवीएन के पक्ष में भूमि अर्जन प्रस्तावित है। इसलिए सहमति संबंधी प्रावधान जैसे कि अधिनियम, 2013 की धारा 2 (2) में कहा गया है, इस प्रकार के प्रावधान सरकारी उपक्रम पर लागू नहीं होता है।

No. MPP-F(5)-8/2018-III.—In exercise of powers conferred by Rule 3 of the Himachal Pradesh Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (Social Impact Assessment and Consent) Rules, 2015, the Governor of Himachal Pradesh is pleased to notify the Social Impact Assessment Unit as under to carry out Social Impact Assessment for the purpose of proposed Additional land Acquisition at Village Lunsu, Mungna, Jaishi, Bharara, Tehsil Sunni, Village Majrog, Tehsil Kumarsain, Distt. Shimla and Village Bhaura, Jakleen, Magan, Fafan, Parlog, Beludhank and Kharyali, Tehsil Karsog, Distt. Mandi (H.P.).

The purposed additional Land at Village Lunsu, Mungna, Jaishi, Bharara, Tehsil Sunni, Village Majrog, Tehsil Kumarsain, Distt. Shimla and Village Bhaura, Jakleen, Magan, Fafan, Parlog, Beludhank and Kharyali, Tehsil Karsog, Distt. Mandi (H.P.) measuring 9.1099 Hact. comprising of Khasra Nos. attached at Annexure "A" is to be acquired by the SJVN Limited with the objectives for construction of Sunni Dam Hydro Electric Project (382 MW) in order to harness optimal hydel potential river of Satluj. This is run of river type development proposed scheme.

The strategy followed in Himachal Pradesh for exploitation of hydroelectric power resources is to produce as much energy as possible, as fact as possible, with minimum cost and with minimum environment negative impacts. The speedy exploitation of hydroelectric power potential will definitely improve the economic health of the state. The need for the project also arises from the need to fulfill a steady increase in peak electricity demand and the growing energy deficit in the Northern region.

It is made clear that any attempt at coercion or threat during Social Assessment will render this exercise as null and void and the Social Impact Assessment will be carried out within a period of six months from its commencement. The Social Impact Assessment Unit shall hold consultations, survey and public hearings. The Social Impact Assessment Unit shall also ensure that adequate representation be given to the representative of panchayats and Gram Sabha, at the stage of carrying out the Social Impact Assessment Study.

While undertaking a Social Impact Assessment Study, the Social Impact Assessment Unit shall amongst other things, take into consideration the impact that the project is likely to have on various components such as livelihood of affected families public and community properties, assets and infrastructure particularly roads, public transport, drainage, sanitation, sources of drinking water, sources of water for cattle, community ponds, grazing land, plantation, public utilities such as post-office, fair price shops, food storage godowns, electricity supply, health care facilities, school and educational, training facilities, anganwadis, children parks, places of worship, land for traditional tribal institutions and burial and cremation grounds. The Social Impact Assessment Unit shall cover all the items under section 4(4) of Act, 2013 and rules framed there under.

The Social Impact Assessment Unit after completion of consultations, survey and public hearing shall prepare a Social Impact Assessment Study report in Form-II under sub-rule 3 of Rule 3 and a Social Impact Management, listing the ameliorative measure, required to be undertaken for addressing the impact for a specific component in Form-III under sub-rule 4 of Rule 3.

SJVN Limited is a Public Sector Undertaking of Govt. of India and joint venture of Govt. of India and Govt. of Himachal Pradesh and the additional land is being proposed to acquire in favour of SJVN Ltd. under section 2(1) (b) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement, Act, 2013. Therefore, consent provision as laid down under section 2(2) of the Act,2013 shall not apply on such public sector undertaking.

The Himachal Pradesh Revenue Department vide notification No. Rev. D.A. (3)- 3 /2014-II, dated 27-11-2015 has already constituted the State Social Impact Assessment Unit, therefore the information of the general public contact information of Unit is as under:—

उपरोक्त मुकद्दमा उनवान वाला में श्री देश राज पुत्र श्री बुद्धि सिंह बहादुर, निवासी गांव डिग्गर, डा0 बेरी, तहसील सदर, जिला बिलासपुर (हि0प्र0) व श्रीमती आरती पुत्री श्री राजेन्द्र, निवासी गांव व डा0 बेरी रजांदिया, तहसील सदर, जिला बिलासपुर (हि0प्र0) ने इस अदालत में संयुक्त तौर पर प्रार्थना-पत्र प्रस्तुत किया है जिसके अनुसार उन्होंने व्यक्त किया है कि उन्होंने दिनांक 22-03-2023 को व्यवस्थित विवाह हिन्दू रीति-रिवाजों के अनुसार किया है तथा इसकी प्रविष्टि समयबद्ध ग्राम पंचायत बेरी रजांदिया, विकास खण्ड सदर, तहसील सदर, जिला बिलासपुर (हि0प्र0) के रिकार्ड में दर्ज नहीं है। अतः विलम्बित अवधि को मर्जित करके उक्त विवाह की प्रविष्टि हेतु सचिव, ग्राम पंचायत बेरी रजांदिया, तहसील सदर, जिला बिलासपुर (हि0प्र0) को निर्देश दिये जावें।

अतः आम जनता को इस नोटिस द्वारा सूचित किया जाता है कि यदि किसी व्यक्ति को उपरोक्त प्रार्थीगण के विवाह की प्रविष्टि दिनांक 22-03-2023 को दर्ज करने बारा कोई एतराज हो तो वह दिनांक 20-01-2024 तक या इससे पूर्व किसी भी कार्य दिवस पर असालतन या वकालतन इस कार्यालय में उपस्थित होवें अन्यथा श्री देश राज पुत्र श्री बुद्धि सिंह बहादुर, निवासी गांव डिग्गर, डा0 बेरी, तहसील सदर, जिला बिलासपुर (हि0प्र0) व श्रीमती आरती पुत्री श्री राजेन्द्र, निवासी गांव व डा0 बेरी रजांदिया, तहसील सदर, जिला बिलासपुर (हि0प्र0) के विवाह की प्रविष्टि करने हेतु सचिव, ग्राम पंचायत बेरी रजांदिया, तहसील सदर, जिला बिलासपुर (हि0प्र0) को आदेश जारी कर दिये जायेंगे।

उपरोक्त विषय के सन्दर्भ में राजिन्द्र कुमार पुत्र श्री थोहलो राम, निवासी महाल दावला, मौजा एवं तहसील जयसिंहपुर, जिला कांगड़ा (हि0प्र0) ने स्वयं हाजिर होकर अपने दादा के नाम की दुरुस्ती बारे प्रार्थना-पत्र पेश करके प्रार्थना की है कि उसके दादा का सही नाम निहाल चन्द है परन्तु महाल दावला के राजस्व रिकार्ड में उसके दादा का नाम घेन्दा गलत दर्ज हुआ है। प्रार्थी महाल हजा में अपने दादा के नाम की दुरुस्ती करवाना चाहता है।

अतः इस मुस्त्री मुनादी द्वारा आम जनता को सूचित किया जाता है कि यदि किसी व्यक्ति को महाल दावला के राजस्व रिकार्ड में प्रार्थी के दादा का नाम घेन्दा के बजाये निहाल चन्द उपनाम घेन्दा करने बारे कोई उजर/एतराज हो तो वह दिनांक 22-01-2024 को इस अदालत में असालतन या वकालतन हाजिर होकर अपना उजर या एतराज पेश कर सकता है। हाजिर न आने की सूरत में किसी भी किस्म का कोई उजर व एतराज नहीं सुना जाएगा।

Gopal Singh, r/o Prakash Bhawan, Kasumpti, Shimla-09, Tehsil Shimla Rural, District Shimla, Himachal Pradesh India have filed an application alongwith affidavits in the court of the undersigned stating therein that they have solemnized their marriage on 07-06-1987 at Hotel Himland Circular Road, Shimla, Tehsil & District Shimla and they are living as husband and wife since then, but the marriage has not been found entered in the records of Registrar of Marriages of Gram Panchayat concerned/Municipal Corporation Shimla and marriage be registered under the Special Marriage Act, 1954.

Therefore, objections are hereby invited from the General Public through this notice, that if anyone has any objection regarding registration of this marriage, they can file their objections personally or in writing before the court of undersigned on or before 25-01-2024. After that no objection shall be entertained and marriage will be registered accordingly.
