संख्याः टी.सी.पी.-(बी) 2-3/2014 (रूल्ज) पी ओ लूज.--हिमाचल प्रदेश के राज्यपाल, भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, हिमाचल प्रदेश लोक सेवा 217—राजपत्र/2023-17-01-2024 (11755) 11756 राजपत्र, हिमाचल प्रदेश, 17 जनवरी 2024/27 पौष, 1945 आयोग के परामर्श से, इस विभाग की अधिसूचना संख्या टी.सी.पी.-बी 2-3/2014 रूल्ज पी ओ, तारीख 29 मई, 2019 द्वारा अधिसूचित हिमाचल प्रदेश, नगर एवं ग्राम योजना विभाग, योजना अधिकारी, वर्ग-1 (राजपत्रित) भर्ती और प्रोन्नति नियम, 2019 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :-

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश, नगर एवं ग्राम योजना विभाग, योजना अधिकारी, ग्रुप -ए (राजपत्रित) भर्ती और प्रोन्नति (संशोधन) नियम, 2024 है। (2) ये नियम, राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत होंगे। 2. उपाबन्ध-"क" का संशोधन.--हिमाचल प्रदेश, नगर एवं ग्राम योजना विभाग, योजना अधिकारी, वर्ग-1 (राजपत्रित) भर्ती और प्रोन्नति नियम, 2019, जिसे इसमें इसके पश्चात्‌ ''उक्त नियम'' कहा गया है के उपाबन्ध-''क'' में :-

(क) स्तम्भ संख्या 3, के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- ''ग्रुप- ए'',

(ख) स्तम्भ संख्या 4 (i), के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''हिमाचल प्रदेश सिविल सेवाएं (संशोधित वेतन) नियम, 2022 के अनुसार पद के (समयमान) से सलंग्न पे मैट्रिक्स का स्तर (लेवल)- 16।'',

(ग) स्तम्भ संख्या 4 (ii) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''तत्स्थानी संवर्ग के पे मैट्रिक्स के लागू स्तर के प्रथम कोष्ठ का 60 प्रतिशत।'',

(घ) स्तम्भ संख्या 11 (ii) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"वरिष्ठ योजना प्रारूपकारों में से प्रोन्नति द्वारा, जो स्थापत्यकला इंजीनियरिंग में स्थापत्यकला असिसटैंटशिप/तकनीकी इंजीनियर में मान्यता प्राप्त तीन वर्षीय डिप्लोमा या प्रारूपकारिता के टे्रड में दो वर्ष के प्रमाण-पत्र कोर्स रखते हों और जिनका तीन वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करकेे, ऐसा न होने पर उपरोक्त वर्णित सम्भरक (पोषक) प्रवर्ग (i) में से प्रोन्नति द्वारा सत्रह प्रतिशत";

(ङ) स्तम्भ संख्या 11 (iv) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''(iv) कनिष्ठ अभियन्ता (सिविल) में से प्रोन्नति द्वारा, जो सिविल इंजीनियरिंग में तीन वर्ष का मान्यता प्राप्त डिप्लोमा रखते हों और जिनका 08 वर्ष का नियमित सेवाकाल या ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके, ऐसा न होने पर सम्भरक (पोषक) प्रवर्ग (iii) और (v) में से प्रोन्नति द्वारा छब्बीस प्रतिशत";

(च) स्तम्भ संख्या 11 (v) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

"(v) कनिष्ठ अभियन्ताओं में से प्रोन्नति द्वारा, जो सर्वेक्षक के ट्रेड (व्यवसाय) में 02 (दो) वर्ष का मान्यता प्राप्त प्रमाण-पत्र कोर्स रखते हों और जिनका 11 (ग्यारह) वर्ष का नियमित सेवाकाल या 11757 राजपत्र, हिमाचल प्रदेश, 17 जनवरी 2024/27 पौष, 1945 ग्रेड में की गई लगातार तदर्थ सेवा, यदि कोई हो, को सम्मिलित करके, ऐसा न होने पर उपरोक्त वर्णित सम्भरक (पोषक) प्रवर्ग (iii) और (iv) में से प्रोन्नति द्वारा चार प्रतिशत'';

(छ) स्तम्भ संख्या 15-क (ii) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''संविदा के आधार पर नियुक्त योजना अधिकारी को ` 29,220/- की दर से समेकित नियत संविदात्मक रकम (जो तत्स्थानी संवर्ग के पे मैट्रिक्स के लागू स्तर के प्रथम कोष्ठ का 60 प्रतिशत होगी) प्रतिमास संदत्त की जाएगी।'';

(ज) स्तम्भ संख्या 15-क (vii)(क) के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः-

''संविदा के आधार पर नियुक्त योजना अधिकारी को ` 29,220/- की दर से समेकित नियत संविदात्मक रकम (जो तत्स्थानी संवर्ग के पे मैट्रिक्स के लागू स्तर के प्रथम कोष्ठ का 60 प्रतिशत होगी) प्रतिमास संदत्त की जाएगी।"

उपाबन्ध-"ख" का संशोधन.--उक्त नियमों के उपाबन्ध-''ख'' में :-

(क) क्रम संख्या 2 के सामने विद्यमान उपबन्धों के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्‌ः- ''प्रथम पक्षकार की संविदात्मक रकम ` 29,220/- (जो तत्स्थानी संवर्ग के पे मैट्रिक्स के लागू स्तर के प्रथम कोष्ठ का 60 प्रतिशत होगी) प्रतिमास होगी। ''।

NOTIFICATION

Shimla-2, the 10th January, 2024

No. TCP-(B)2-3/2014(Rules)PO-Loose.—In exercise of the powers conferred by proviso to Article 309 of the Constitution of India, the Governor, Himachal Pradesh, in consultation with the Himachal Pradesh Public Service Commission, is pleased to make the following rules further to amend the Recruitment and Promotion Rules for the post of Planning Officer, Class-I (Gazetted) in the Department of Town & Country Planning, Himachal Pradesh, 2019, notified vide this Department Notification No. TCP-(B)2-3/2014(Rules)PO, dated 29-05-2019, namely:—

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Town & Country Planning Department, Planning Officer, Group-A (Gazetted), Recruitment and Promotion (Amendment) Rules, 2024.

(2) These rules shall come into force from the date of publication in the Rajpatra (e-Gazette), Himachal Pradesh.

2. Amendment of Annexure- "A".—In Annexure- "A" to the Himachal Pradesh, Town & County Planning Department, Planning Officer, Class-I (Gazetted), Recruitment and Promotion Rules, 2019 (hereinafter referred to as the 'said rules') :—

(a) For the existing provisions against Column No. 3, the following shall be substituted, namely:—

"Group- A"

(b) For the existing provisions against Column No. 4(i), the following shall be substituted, namely:—

"Level -16 of the pay Matrix attached with the time scale of the post, as per H.P. Civil Services (Revised Pay) Rules, 2022";

(c) For the existing provisions against Column No. 4(ii), the following shall be substituted, namely:—

"60% of the First Cell of the applicable level of pay matrix of the corresponding cadre";

(d) For the existing provisions against "Column No. 11(ii), the following shall be substituted, namely:—

"By promotion from amongst the Senior Planning Draughtsman possessing a recognized 03 (Three) years Diploma in Architectural Assistantship/Technician Engineers in Architectural Engineering or 02 years Certificates Course in the trade of Draughtsmanship with 03 years regular service or regular combined adhoc services, rendered if any in the grade failing which by promotion from the feeder category (i) . .17%"; mentioned above

(e) For the existing provisions against "Column No. 11(iv), the following shall be substituted, namely:—

"By promotion from amongst the Junior Engineer (Civil) possessing a recognized 03 (Three) years Diploma in Civil Engineering with 08 years regular service or regular combined with continuous adhoc service rendered, if any, in the grade failing which by .26%"; promotion from the feeder category (iii) & (V).

(f) For the existing provisions against "Column No. 11(v), the following shall be substituted, namely:—

"By promotion from amongst the Junior Engineer possessing a recognized 02 (Two) years Certificate Course in the trade of Surveyor with 11 years regular service or regular combined with continuous adhoc service rendered, if any, in the grade failing which by promotion from the feeder category (iii) & (iv) mentioned above";

(g) For the existing provisions against Column No. 15-A(II), the following shall be substituted, namely:—

"The Planning Officer appointed on Contract basis will be paid consolidated fixed contractual amount @ Rs. 29,220/- per month (which shall be 60 % of the First cell of the applicable level of the Pay Matrix of the Corresponding Cadre);

substituted, namely:—

"The Planning Officer appointed on contract basis will be paid consolidated fixed contractual amount @ Rs. 29,220/- per month (which shall be 60 % of the first cell of the applicable level of the Pay Matrix of the corresponding cadre)";

Amendment of Annexure-"B".—In Annexure- "B" of the 'said rules':—

(a) For the existing provisions against "Serial No. 2, the following shall be substituted, namely:—

"The Contractual amount of the First Party will be Rs. 29,220/- per month (which shall be 60% of the First cell of the applicable level of the Pay Matrix of the Corresponding Cadre)";

संख्याः टी0सी0पी0-एफ0 5/02/2022.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा-13 की उप-धारा (2) के खंड (घ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना संख्या टी0सी0पी0-एफ0 5/2/2022, तारीख 28-06-2023 द्वारा गठित ''अटल टनल योजना क्षेत्र'' को तत्काल प्रभाव से प्रविरत करते हैं।

इसके अतिरिक्त, हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 1 की उप-धारा (3) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तारीख 05-01-2024 को ऐसी तारीख नियत करते हैं, जिसको पूर्वोक्त अधिनियम के उपबंध अधिसूचना संख्या पी0बी0डब्ल्यू (बी एण्ड आर) (बी) 26 (162)/87, तारीख 16-10-1989 द्वारा अधिसूचित केलांग विशेष क्षेत्र में सम्मिलित जिला लाहौल एवं स्पीति, हिमाचल प्रदेश के कुछ क्षेत्रों (संलग्न मानचित्र के अनुसार) में प्रवृत्त होंगे।

पूर्वोक्त अधिनियम के उपबंधों के प्रवर्तन के परिणामस्वरूप जिला लाहौल एवं स्पीति के कुछ क्षेत्रों (संलग्न मानचित्र के अनुसार) में हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम सख्ंयांक 12) के उपबंध केलांग विशेष क्षेत्र की पुनः परिनिश्चित सीमाओं को लागू होंगे और कुल क्षेत्र जिन पर हिमाचल प्रदेश नगर एवं ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) के उपबंध प्रवर्तनशील हैं, अब निम्नानुसार हैं :-

विनिर्देश

उत्तर ः राष्ट्रीय उच्च मार्ग 03 से 500 मीटर की दूरी पर बिलिंग नाला से आरम्भ होकर शकस नाला तक अर्थात्‌ केलोंग विशेष क्षेत्र की विद्यमान उत्तरी सीमा तक। 11760 राजपत्र, हिमाचल प्रदेश, 17 जनवरी 2024/27 पौष, 1945 पूर्व ः विद्यमान केलोंग विशेष क्षेत्र की पूर्वी सीमा से प्रारम्भ होकर अर्थात्‌ राष्ट्रीय राजमार्ग 03 से 500 मीटर की दूरी पर शकस नाला से फिर शकस नाला के साथ-साथ भागा नदी के साथ इसके मिलन बिंदु तक, उसके पश्चात्‌ फिर भागा नदी के साथ-साथ तांदी पुल से भागा नदी के बाएं किनारे की ओर 200 मीटर तक, उसके बाद राष्ट्रीय राजमार्ग 03 पर 500 मीटर की बेल्ट के साथ खिनांग, शुगु और सिस्सू गांव के पश्चात्‌ तहत नाले तक के क्षेत्र को कवर करते हुए और उसके बाद फिर से राष्ट्रीय राजमार्ग 03 के साथ 1000 मीटर की बेल्ट के साथ तेलिंग गांव से पहले नाले तक और उसके बाद राष्ट्रीय राजमार्ग 03 के साथ आगे बढ़ते हुए और राष्ट्रीय राजमार्ग 03 से कुथ बिहाल से पुर्व नाले तक 500 मीटर की बेल्ट का अनुसरण करते हुए।

दक्षिण ः राष्ट्रीय राजमार्ग 03 से उत्तरी दिशा की ओर 500 मीटर की दूरी पर गांव कुथ बिहाल से पुर्व नाले से आरम्भ होकर नाले के साथ-साथ चंद्रा नदी के साथ इसके मिलन बिंदु तक और चंद्रा नदी के बाईं ओर 500 मीटर तक।

पश्चिम ः चंद्रा नदी के साथ कुठ बिहाल गांव से पहले नाले के मिलन बिंदु से चंद्रा नदी के दाईं ओर 500 मीटर की दूरी से आरम्भ होकर और फिर चंद्रा नदी से बाएं किनारे के साथ चंद्रा नदी से 500 मीटर की बेल्ट अनुसरण करते हुए, अटल सुरंग के उत्तरी पोर्टल के बाद 250 मीटर के नाले तक और फिर चंद्रा नदी के बाएं किनारे के साथ सिस्सू जलप्रपात से पहले नाले तक और फिर चंद्रा नदी से 500 मीटर की बेल्ट का अनुसरण करते हुए सिस्सू झरना नाले को कवर करते हुए सिस्सू झील के विपरीत बिंदु तक और उसके बाद फिर चंद्रा नदी के बाएं किनारे के साथ-साथ मुलिंग गांव से 800 मीटर पहले नाले तक और उसके बाद चंद्रा नदी से 1000 मीटर की बेल्ट के बाद मुलिंग, बरगुल और शिपतिंग नामक बस्तियों के तहत आने वाले क्षेत्र को कवर करते हुए गांव शिपिंग के बाद नाले तक और उसके बाद चंद्रा नदी के बाएं किनारे पर चलते हुए फिर गुशाल और क्रोजिंग बस्तियों के एक क्षेत्र को कवर करते हुए चिनाब नदी से 800 मीटर की बेल्ट के बाद चिनाब नदी के बाएं किनारे पर क्रोजिंग बस्ती के बाद नाले तक और फिर चिनाब नदी के नाले के साथ आगे बढ़ते हुए और फिर पार करत चिनाब नदी के दाहिने किनारे तक और राष्ट्रीय राजमार्ग 03 से 800 मीटर की दूरी तक वारी गांव के पास टोजिंग नाले के साथ बहती हुई गांव सुमनम तक और फिर राष्ट्रीय राजमार्ग-03 के साथ 500 मीटर की दूरी पर बिलिंग नाले के साथ 500 मीटर की दूरी पर राष्ट्रीय राजमार्ग 03 तक।

टिप्पण.-- विशेष क्षेत्र आकार और आकृति में अनियमित है, इस प्रकार अधिक ब्यौरे और स्पष्टता के लिए विशेष क्षेत्र के मानचित्र को निर्दिष्ट किया जाएगा (मानचित्र संलग्न)।

NOTIFICATION

Shimla-2, the 5th January, 2024

No. TCP-F05/2/2022.—In exercise of the powers conferred by clause (d) of sub-section (2) of section 13 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977),11761 राजपत्र, हिमाचल प्रदेश, 17 जनवरी 2024/27 पौष, 1945 the Governor, Himachal Pradesh is pleased to cease the Atal Tunnel Planning Area constituted vide Notification No. TCP-F05/2/2022, dated 28-06-2023, with immediate effect.

Further, in exercise of the powers conferred by sub-section (3) of section 1 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh is pleased to appoint 05-01-2024 as the date on which the provisions of the aforesaid Act shall come into force in some areas of District Lahaul and Spiti, Himachal Pradesh (as per map enclosed) included in the Keylong Special Area notified vide the Government Notification No. PBW (B & R) (B)26(162)/87, dated 16-10-1989.

Consequent upon the enforcement of the provisions of the Act ibid in the above some areas, of District Lahaul and Spiti (as per map enclosed) the provisions of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), shall be applicable to the re-defined limits of Keylong Special Area and total area over which provisions of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) are enforced shall, now be as follows:—

SPECIFICATIONS

North : Starting from Billing Nallah at a distance of 500 M from the NH-03 and continuing upto the Shakas Nallah i.e, existing Northern boundary of Keylong Special Area.

East : Starting from the Eastern boundary of existing Keylong Special Area i.e. Shakas Nallah at distance of 500 M from the NH 03 then following along Shakas Nallah upto its meeting point with River Bhaga then continuing along river Bhaga upto 200 M from Tandi bridge towards left bank of river Bhaga, thereafter continuing along National Highway 03 following a belt of 500 M covering the area under settlement Khinang, Shugu and Sissu upto nallah after village Sissu and thereafter again continuing along National Highway 03 following a belt of 1000 M upto nallah before Village Teling and thereafter continuing along the National Highway 03 and following a belt of 500 M from National Highway 03 upto Nallah before Kuth Bihal.

South : Starting from the Nallah before Village Kuth Bihal at distance of 500 M towards Northern direction from the National Highway 03 and continuing along with the Nallah upto its meeting point with River Chandra and 500 M towards left side of the river Chandra.

West : Starting from a distance of 500 M towards right side of river Chandra from the meeting point of Nallah before Village Kuth Bihal with river Chandra and then continuing along the left bank of river Chandra following a belt of 500 M from river Chandra upto the nallah 250 M after North Portal of Atal Tunnel and then again following along the left bank of river Chandra upto nallah before Sissu water fall and then following a belt of 500 M from river Chandra covering the Sissu waterfall nallah and upto the point opposite to the Sissu lake and thereafter again continuing along the left bank of river Chandra upto the nallah 800 M before Village Muling and thereafter covering the area under settlements namely Muling, Bargul and Shipting following a belt of 1000 M from river Chandra upto nallah after Villge Shipting and thereafter again following along the left bank of river Chandra and then covering an area of Gushal and Krozing settlements following a belt of 800 M from river Chenab upto Nallah after Krozing settlement on left bank of River Chenab and then following along the nallah utpo river Chenab and then crossing over to the right bank of River Chenab and flowing along the Tozing nallah near Village Wari upto a distance of 800 M from National Highway 03 and following upto Village Sumnam then following a belt of 500 M along National Highway-03 utpo Billing Nallah at a distance of 500 m the NH-03.

Note.—The Special Area is irregular in shape and size, as such, for more details and clarity map of Special Area shall be referred (map enclosed).

संख्याः टी0सी0पी0-एफ0 5/02/2022.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम नियोजन अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 66 की उप-धारा 3 के खण्ड (क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, अधिसूचना संख्या पी0बी0डब्ल्यू (बी एण्ड आर) (बी) 26 (162)/87, तारीख 16-10-1989 द्वारा पहले से अधिसूचित केलांग विशेष क्षेत्र में जिला लाहौल और स्पीति, हिमाचल प्रदेश के कुछ क्षेत्रों को (संलग्न मानचित्र के अनुसार) सम्मिलित करते हैं।

हिमाचल प्रदेश के राज्यपाल, जिला लाहौल और स्पीति के सम्मिलित कुछ क्षेत्रों के परिणामस्वरूप, नीचे दिए गए विनिर्देशों के अनुसार केलांग विशेष क्षेत्र की सीमाओं को पुनः परिनिश्चित करते हैं :-

विनिर्देश

उत्तर ः राष्ट्रीय उच्च मार्ग 03 से 500 मीटर की दूरी पर बिलिंग नाला से आरम्भ होकर शकस नाला तक अर्थात्‌ केलोंग विशेष क्षेत्र की विद्यमान उत्तरी सीमा तक।

पूर्व ः विद्यमान केलोंग विशेष क्षेत्र की पूर्वी सीमा से प्रारम्भ होकर अर्थात्‌ राष्ट्रीय राजमार्ग 03 से 500 मीटर की दूरी पर शकस नाला से फिर शकस नाला के साथ-साथ भागा नदी के साथ इसके मिलन बिंदु तक, उसके पश्चात्‌ फिर भागा नदी के साथ-साथ तांदी पुल से भागा नदी के बाएं किनारे की ओर 200 मीटर तक, उसके बाद राष्ट्रीय राजमार्ग 03 पर 500 मीटर की बेल्ट के साथ खिनांग, शुगु और सिस्सू गावं के पश्चात्‌ तहत नाले तक के क्षेत्र को कवर करते हुए और उसके बाद फिर से राष्ट्रीय राजमार्ग 03 के साथ 1000 मीटर की बेल्ट के साथ तेलिंग गांव से पहले नाले तक और उसके बाद राष्ट्रीय राजमार्ग 03 के साथ आगे बढ़ते हुए और राष्ट्रीय राजमार्ग 03 से कुथ बिहाल से पुर्व नाले तक 500 मीटर की बेल्ट का अनुसरण करते हुए।

दक्षिण ः राष्ट्रीय राजमार्ग 03 से उत्तरी दिशा की ओर 500 मीटर की दूरी पर गांव कुथ बिहाल से पुर्व नाले से आरम्भ होकर नाले के साथ-साथ चंद्रा नदी के साथ इसके मिलन बिंदु तक और चंद्रा नदी के बाईं ओर 500 मीटर तक।

पश्चिम ः चंद्रा नदी के साथ कुठ बिहाल गांव से पहले नाले के मिलन बिंदु से चंद्रा नदी के दाईं ओर 500 मीटर की दूरी से आरम्भ होकर और फिर चंद्रा नदी से बाएं किनारे के साथ चंद्रा नदी से 500 मीटर की बेल्ट अनुसरण करते हुए, अटल सुरंग के उत्तरी पोर्टल के बाद 250 मीटर के नाले तक और फिर चंद्रा नदी के बाएं किनारे के साथ सिस्सू जलप्रपात से पहले नाले तक और फिर चंद्रा नदी से 500 मीटर की बेल्ट का अनुसरण करते हुए सिस्सू झरना नाले को कवर करते हुए सिस्सू झील के विपरीत बिंदु तक और उसके बाद फिर चंद्रा नदी के बाएं किनारे के साथ-साथ मुलिंग गांव से 800 मीटर पहले नाले तक और उसके बाद चंद्रा नदी से 1000 मीटर की बेल्ट के बाद मुलिंग, बरगुल और शिपतिंग नामक बस्तियों के तहत आने वाले क्षेत्र को कवर करते हुए गांव शिपिंग के बाद नाले तक और उसके बाद चंद्रा नदी के बाएं किनारे पर चलते हुए फिर गुशाल और क्रोजिंग बस्तियों के एक क्षेत्र को कवर करते हुए चिनाब नदी से 800 मीटर की बेल्ट के बाद चिनाब नदी के बाएं किनारे पर क्रोजिंग बस्ती के बाद नाले तक और फिर चिनाब नदी के नाले के साथ आगे बढ़ते हुए और फिर पार करत चिनाब नदी के दाहिने किनारे तक और राष्ट्रीय राजमार्ग 03 से 800 मीटर की दूरी तक वारी गांव के पास टोजिंग नाले के साथ बहती हुई गांव सुमनम तक और फिर राष्ट्रीय राजमार्ग 03 के साथ 500 मीटर की दूरी पर बिलिंग नाले के साथ 500 मीटर की दूरी पर राष्ट्रीय राजमार्ग 03 तक। 11764 राजपत्र, हिमाचल प्रदेश, 17 जनवरी 2024/27 पौष, 1945 टिप्पण.--विशेष क्षेत्र आकार और आकृति में अनियमित है, इस प्रकार अधिक ब्यौरे और स्पष्टता के लिए विशेष क्षेत्र के मानचित्र को निर्दिष्ट किया जाएगा (मानचित्र संलग्न)।

NOTIFICATION

Shimla-2, the 5th January, 2024

No. TCP-F05/2/2022.—In exercise of the powers conferred by clause (a) of sub-section 3 of section 66 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh is pleased to include some areas of District Lahaul and Spiti, Himachal Pradesh (as per map enclosed) in the Keylong Special Area, already notified vide Notification No. PBW (B & R) (B)26(162)/87, dated 16-10-1989.

Consequent upon inclusion of some area of, District Lahaul and Spiti, the Governor, Himachal Pradesh, is further pleased to re-define the limits of Keylong Special Area as per the specifications given below:—

SPECIFICATIONS

North : Starting from Billing Nallah at a distance of 500 M from the NH-03 and continuing upto the Shakas Nallah i.e. existing Northern boundary of Keylong Special Area.

East : Starting from the Eastern boundary of existing Keylong Special Area i.e. Shakas Nallah at distance of 500 m from the NH 03 then following along Shakas Nallah upto its meeting point with River Bhaga then continuing along river Bhaga upto 200 M from Tandi bridge towards left bank of river Bhaga, thereafter continuing along National Highway 03 following a belt of 500 M covering the area under settlement Khinang, Shugu and Sissu upto nallah after village Sissu and thereafter again continuing along National Highway 03 following a belt of 1000 M upto nallah before Village Teling and thereafter continuing along the National Highway 03 and following a belt of 500 M from National Highway 03 upto Nallah before Kuth Bihal.

South : Starting from the Nallah before Village Kuth Bihal at distance of 500 M towards Northern direction from the National Highway 03 and continuing along with the Nallah upto its meeting point with River Chandra and 500 M towards left side of the river Chandra.

West : Starting from a distance of 500 M towards right side of river Chandra from the meeting point of Nallah before Village Kuth Bihal with river Chandra and then continuing along the left bank of river Chandra following a belt of 500 M from11765 राजपत्र, हिमाचल प्रदेश, 17 जनवरी 2024/27 पौष, 1945 river Chandra upto the nallah 250 M after North Portal of Atal Tunnel and then again following along the left bank of river Chandra upto nallah before Sissu water fall and then following a belt of 500 M from river Chandra covering the Sissu waterfall nallah and upto the point opposite to the Sissu lake and thereafter again continuing along the left bank of river Chandra upto the nallah 800 M before Village Muling and thereafter covering the area under settlements namely Muling, Bargul and Shipting following a belt of 1000 M from river Chandra upto nallah after villge Shipting and thereafter again following along the left bank of river Chandra and then covering an area of Gushal and Krozing settlements following a belt of 800 M from river Chenab upto Nallah after Krozing settlement on left bank of River Chenab and then following along the nallah utpo river Chenab and then crossing over to the right bank of River Chenab and flowing along the Tozing nallah near Village Wari upto a distance of 800 M from National Highway 03 and following upto Village Sumnam then following a belt of 500 M along National Highway-03 utpo Billing Nallah at a distance of 500 M the NH- 03.

Note.—The Special Area is irregular in shape and size, as such, for more details and clarity map of Special Area shall be referred (Map enclosed).

संख्याःटी0सी0पी0-एफ0 5/02/2022.--''केलांग विशेष क्षेत्र'' का गठन हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 66 की उप-धारा (1) के अधीन अधिसूचना संख्याः टी0सी0पी0-एफ/05/02/2022, तारीख 05-01-2024, द्वारा किया गया है;

उक्त विशेष क्षेत्र के विद्यमान भू-उपयोग मानचित्र को पूर्वोक्त अधिनियम की धारा 15 की उप-धारा (1) के अधीन अभी तक प्रकाशित नहीं किया गया है;

और हिमाचल प्रदेश के राज्यपाल का समाधान हो गया है, कि पूर्वोक्त विशेष क्षेत्र में, भूमि-उपयोग में परिवर्तन या उसमें किसी प्रकार के भवन निर्माण से किसी भूमि की सतह या मिट्‌टी पर हानिकारक विघ्न (बाधा) होने की सम्भावना है या इसे मिट्‌टी के परिरक्षण या भू-स्खलन को रोकने या भूमि कटाव के संरक्षण के लिए हानिकारक माना गया है और पूर्वोक्त अधिनियम के उपबन्धों के अनुसार उक्त क्षेत्र की योजना बनाने और उसका विकास करना कठिन होने की सम्भावना है।

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 15-क की उप-धारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, ''केलांग विशेष क्षेत्र'' के विद्यमान भूमि-उपयोग मानचित्र पर इस अधिसूचना के राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशन की तारीख से पांच वर्ष की अवधि के लिए रोक लगाते हैं।

No. TCP-F05/2/2022.—Whereas, "Keylong Special Area" has been constituted under sub-section (1) of Section 66 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977) vide Notification No. TCP-F05/2/2022, dated 5-01-2024;

And whereas, the existing land use map of the said Special Area has not yet been published under sub-section (1) of section 15 of the aforesaid Act;

And whereas, the Governor of Himachal Pradesh is satisfied that in the aforesaid Special Area, the change of land use or any building operation therein is likely to cause injurious disturbance of the surface or any land or soil, or is considered detrimental to the preservation of the soil, prevention of land slips or protection against erosion and is likely to make it difficult to plan and develop the said area in accordance with the provisions of the aforesaid Act;

Now, therefore, in exercise of the powers conferred by sub-section (1) of Section 15-A of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor of Himachal Pradesh is pleased to freeze the existing land use map of the "Keylong Special Area" for a period of Five years from the date of publication of this Notification in the Himachal Pradesh Official Gazette.
