संख्याः टी0 सी0 पी0-ए0 3/1/2023.--हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम सख्यांक 12) की धारा 87 द्वारा प्रदत्त शक्तियों का प्रयोग 225—राजपत्र/2023-30-01-2024 (11949) 11950 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 करते हुए, इस विभाग की अधिसूचना संख्याः टी0 सी0 पी-ए (3)-1/2014, तारीख 1 दिसम्बर, 2014 द्वारा अधिसूचित और राजपत्र (ई-गजट), हिमाचल प्रदेश में तारीख 1 दिसम्बर, 2014 को प्रकाशित हिमाचल प्रदेश नगर और ग्राम योजना नियम, 2014 का और संशोधन करने के लिए निम्नलिखित नियम बनाने का प्रस्ताव करते हैं और इन्हें जनसाधारण की सूचना के लिए एतदद्वारा राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किया जाता है;

इन प्रारूप नियमों से संभाव्य प्रभावित होने वाले यदि किसी व्यक्ति को इन की बाबत, कोई आक्षेप या सुझाव है/हैं तो वह उक्त प्रारूप नियमों के राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशन की तारीख से तीस दिन की अवधि के भीतर इन्हें लिखित में प्रधान सचिव (नगर एवं ग्राम योजना) हिमाचल प्रदेश सरकार, शिमला को आक्षेप या सुझाव भेज सकेगा;

उपरोक्त नियत अवधि के भीतर प्राप्त हुए आक्षेप या सुझाव, यदि कोई हो/हों, पर हिमाचल प्रदेश सरकार द्वारा उक्त प्रारूप नियमों को अन्तिम रूप देने से पूर्व विचार किया जाएगा, अर्थात्‌ः-

प्रारूप नियम

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश नगर और ग्राम योजना (ग्यारहवां संशोधन) नियम, 2024 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में इनके प्रकाशन की तारीख से प्रवृत्त होंगे। 2. नियम 21 का संशोधन.--हिमाचल प्रदेश नगर और ग्राम योजना नियम 2014 (जिसे इसमें इसके पश्चात्‌ ''उक्त नियम'' कहा गया है) के नियम 21 के उप-नियम (2) के पश्चात्‌ निम्नलिखित नए उप-नियम (3) और (4) जोड़े जाएंगे अर्थात्‌ :-

"(3) सरकार द्वारा अधिसूचित जोखिम आधारित वर्गीकरण के अनुसार समस्त उच्च जोखिम वाले भवनों के लिए संरचनात्मक डिजाइन रिपोर्ट और संरचनात्मक स्थिरता प्रमाण-पत्र के साथ भू-वैज्ञानिक अन्वेषण रिपोर्ट आवश्यक होगी।

(4) निदेशक किसी रजिस्ट्री—त संरचनात्मक इंजीनियर के रजिस्ट्रीकरण को निलंबित या रद्द कर सकेगा, यदि संबद्ध संरचनात्मक इंजीनियर द्वारा प्रस्तुत और अनुमोदित संरचनात्मक डिजाइन में कोई संरचनात्मक अस्थिरता पाई जाती है या भवन निर्माण के पूर्ण होने पर संरचनात्मक इंजीनियर द्वारा संरचनात्मक स्थिरता प्रमाण-पत्र जारी कर दिया जाता है और भवन संरचनात्मक रूप से स्थिर नहीं पाया जाता है।''

3. परिशिष्ट-1 का संशोधन.--'उक्त नियमों' से सलंग्न परिशिष्ट-1 में, सामान्य विनियम की क्रम संख्या III में :- (क) विनियम 16 के स्थान पर निम्नलिखित विनियम रखा जाएगा, अर्थात्‌ :- ''16. नाले और खडड से क्रमशः 5.00 मीटर और 7.00 मीटर की दूरी पर सन्निर्माण अनुज्ञात किया जाएगा।'', और

(ख) विनियम 31 के पश्चात्‌ निम्नलिखित विनियम जोड़ा जाएगा, अर्थात्‌ :-

"31. वेली व्यू-हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 के कानूनी उपबन्धाें के अधीन अधिसूचित किसी योजना या विशेष क्षेत्र के संबंध में यथा लागू किसी विकास योजना/अंतरिम विकास योजना के तत्समय प्रवृत्त किसी सामान्य विनियमों के अधीन किसी बात के होते हुए भी, सम्पूर्ण हिमाचल प्रदेश राज्य में फोर लेन/राष्ट्रीय राजमार्गों/राज्य राजमार्गों के चिन्हित खण्डों में घाटी की तरफ निर्मित होने वाले भवन सड़क के स्तर से 1.00 मीटर नीचे रहेंगे। तथापि अत्यधिक सुविधाजनक/–श्य-स्थलों और पर्यटन संभावनाओं वाले किन्ही सड़क11951 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 खण्डों पर वेली व्यू लागू करने से पूर्व राज्य सरकार द्वारा, वेली व्यू को पुर्वतः संरक्षित और सुरक्षित रखने के उद्धेश्य से इनकी पहचान (चिन्हित) की जाएगी।''

टिप्पण.--पूर्वोक्त अधिनियम की अधिकारिता से परे, फोर लेन/राष्ट्रीय राजमार्गों/राज्य राजमार्गों पर अत्यधिक सुविधाजनक/–श्य-स्थलों और पर्यटन संभावनाओं वाले सड़क खण्डों को राज्य सरकार द्वारा चिन्हित किया जाएगा और इसका कार्यान्वयन और अनुश्रवण हिमाचल प्रदेश पंचायती राज अधिनियम, 1994 की धारा 11 में अन्तर्विष्ट उपबंधों के अनुसार ग्रामीण विकास और पंचायती राज विभाग द्वारा सुनिश्चित किया जाएगा।''

NOTIFICATION

Shimla-2, 24th January, 2024

No. TCP-A03/1/2023.—In exercise of the powers conferred by Section 87 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh proposes to make the following rules further to amend the Himachal Pradesh Town and Country Planning Rules, 2014 notified vide this Department Notification No. TCP-A (3)-1/2014, dated 1-12-2014 and published in the Rajpatra (e-Gazette), Himachal Pradesh on Ist December, 2014, and the same are hereby published in the Rajpatra (e-Gazette), Himachal Pradesh for the information of the general public;

If any person, likely to be affected by these draft rules has any objection(s) or suggestion(s) with regards to the same, he/she may send the same in writing to the Principal Secretary (TCP) to the Government of Himachal Pradesh, Shimla within a period of thirty days from the date of publication of the said draft rules in Rajpatra (e-Gazette), Himachal Pradesh;

The objection(s) or suggestion(s), if any, received within the above stipulated period shall be taken into consideration by the Government of the Himachal Pradesh, before finalizing these draft rules, namely :—

Draft Rules

1. Short title and commencement.—(1) These rules may be called the Himachal Pradesh Town and Country Planning (Eleventh Amendment) Rules, 2024.

2. Amendment of rule 21.—In rule 21 of the Himachal Pradesh Town and Country Planning Rules, 2014 (hereinafter referred to as the 'said rules'), after sub-rule (2), the following new sub rules (3) & (4) shall be added, namely:—

"(3) For all High Risk Buildings as per Risk Based Classification notified by the Government, Geological Investigation Report along with Structural Design Report and Structural Stability Certificate shall be mandatory.

(4) The Director may suspend or cancel the registration of any registered structural engineer in case any structure infirmity is found in the structural design submitted and approved by the concerned Structural Engineer or in case the structural stability certificate is issued by a Structural Engineer upon completion of the building and the building is not found structurally stable."

3. Amendment of Appendix-1.—In Appendix-1 of the 'said rules', in serial number III of General Regulations –

(a) for regulation 16, the following regulation shall be substituted, namely:—

"16. The construction shall be allowed at distance of 5.00 Metre and 7.00 Metre

from Nallah and Khud respectively."; and

(b) after regulation 31, the following Regulation shall be added, namely:-

"32. Valley View –Notwithstanding anything contained under the general regulations of any Development Plan/ Interim Development Plan for the time being in force, as applicable in respect of any planning or special area notified under the statutory provisions of the Himachal Pradesh Town and Country Planning Act, 1977, any building to be constructed on the valley side of the identified stretches of the Four Lanes/National Highway/State Highway in whole of the State of Himachal Pradesh shall remain 1.00 M below the road level. However, before imposition of Valley View on any road stretches having great vantage/view points and tourism potentials, same shall be identified by the State Government in order to fully preserve and protect the valley view.

Note.—For imposition of Valley View regulations on Four Lanes/National Highway/State Highway falling beyond the jurisdiction of the act ibid, the road stretches having great vantage/view points and tourism potentials shall be identified by the State Government and the implementation and monitoring of same shall be ensured by the Rural Development and Panchayati Raj Departments as per the provisions contained in Section 11 of the Himachal Pradesh Panchayati Raj Act, 1994."

संख्याः टी0 सी0 पी0-एफ05/2/2023.--हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 19 की उप-धारा (1) के अधीन निदेशक, नगर एवं ग्राम योजना विभाग, हिमाचल प्रदेश, शिमला द्वारा चौपाल योजना क्षेत्र के लिए विकास योजना प्रारूप को, नोटिस संख्याः एच.आई.एम./टी.पी./पी.जे.टी./डी.पी.-चौपाल/2022/वॉल्यूम-I/3244-51, तारीख 21-08-2023 द्वारा जारी किया गया था और जिसे आक्षेप और सुझाव आमऩ्त्रित करने के लिए तारीख 24-08-2023 को राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किया गया था और नियत अवधि के भीतर कोई भी आक्षेप या सुझाव प्राप्त नहीं हुआ है तथा विकास योजना को अनुमोदन के लिए सरकार को भेजा गया था।

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश नगर और ग्राम योजना अधिनियम, 1977 (1977 का अधिनियम संख्यांक 12) की धारा 20 की उप-धारा (1) के अधीन निहित शक्तियों का प्रयोग करते हुए, चौपाल योजना क्षेत्र के लिए विकास योजना को, बिना किसी उपान्तरण के, अनुमोदित करते हैं। इसे नगर एवं ग्राम योजना विभाग, हिमाचल प्रदेश की आधिकारिक वैबसाइट www.tcp.hp.gov.in पर यू0आर0एल0 https://tcp.hp.gov.in/Application/upload Documents/devlopmentPlan/Plan Doc020240108_160640. pdf सहित डाल दिया गया है। इसे पूर्वोक्त अधिनियम की धारा 20 की उप-धारा (4) के अधीन यथा अपेक्षित पूर्व निर्दिष्ट यू0आर0एल0 सम्पर्क (लिंकेज) सहित राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किया गया समझा जाएगा। एतद्‌द्वारा नोटिस दिया जाता है कि उक्त विकास योजना की प्रति कार्यालय समय के दौरान निम्नलिखित कार्यालयों में निरीक्षण हेतु उपलब्ध रहेगी :-

No.TCP-F05/2/2023.—WHEREAS, the draft Development Plan for Chopal Planning Area was issued by the Director, Town and Country Planning Department, Himachal Pradesh, Shimla under sub-section (1) of Section 19 of the Town and Country Planning Act, 1977 (Act No. 12 of 1977) vide Notice No. HIM/TP/PJT/DP-Chopal/2022/Vol-I/3244-51, dated 21.08.2023 which was published in the Rajpatra on 24-08-2023 for inviting objection(s) and suggestion(s) and no objection or suggestion was received within the stipulated period and the Development Plan was submitted to the Government for approval.

NOW, THEREFORE, in exercise of the powers vested under sub-section (1) of Section 20 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), the Governor, Himachal Pradesh is pleased to approve the Development Plan for Chopal Planning Area, without modifications. It has been hosted at the official website of Department of Town and Country Planning, Himachal Pradesh www.tcp.hp.gov.in with URL:https://tcp.hp.gov.in/ Application/ upload Documents/ devlopment Plan/PlanDoc020240108_160640.pdf The same may be deemed to have been published in the e-Gazette of Himachal Pradesh with fore-referred URL linkage as required under sub-section (4) of Section 20 of the Act ibid. A Notice is hereby given that a copy of the said Development Plan is available for inspection during office hours in the following offices:-

No. Pub-A(1)-1/2018 .—The Governor, Himachal Pradesh is pleased to notify "The Himachal Pradesh Digital Media Policy-2024" as per Annexure appended to this Notification for information of all concerned.

The Himachal Pradesh Digital Media Policy-2024 shall come into force from the date of publication in Rajpatra, Himachal Pradesh/e-Gazette.

ANNEXURE Himachal Pradesh Digital Media Policy-2024

1. Background:

(a) The Department of Information and Public Relations is responsible for dissemination of information on government policies, programmes and welfare schemes through multiple media of mass communication such as print, radio, television, out of home publicity (OOH), traditional media and digital media including social media, news websites and news web channels.

(b) The main objective of the Department is to create a conducive environment for dissemination of information and awareness amongst masses by facilitating the media. In order to achieve this objective, the effective outreach of Government policies and programmes is ensured through various modes of media i.e. Print, Electronic, Outdoor, traditional and digital media etc.

2. Need for the Policy Guidelines:

(a) Over the last decade, News Web Channels, News Websites/Web Portals and Social Media have emerged as effective platforms for gathering and disseminating information. With the emergence of various social media platforms and easy availability of access tools, the people have become more dependent on prompt flow of information on these platforms.

(b) In today's globally interconnected world, the increasing ease of access of social media through hand-held devices and ubiquity of internet has further enhanced the reach of social media platforms.

(c) The growth of social media usage opens up new opportunities for mass communication and outreach. The social media platforms not only cater to an increasing number of11956 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 people but also facilitate targeted approach to receive or create and share public messages, which helps in reaching out to desired set of people in an efficient and cost effective manner.

(d) In order to draw the benefits of the social media, it is important for the Information and Public Relations Department to determine modalities for empanelling/engaging News Web Channels, News Websites/Web Portals and Social Media Influencers/Handlers for assured reach. Hence, there is a definite need for policy guidelines for empanelment/engagement of News Web Channels, News Websites/Web Portals and Social Media Influencers/Handlers for the Government advertising so that assured reach could be attained on payment basis to increase visibility of socially relevant messages.

3. Objectives of the Policy:

(a) To improve the outreach of welfare schemes and initiatives of the State Government. (b) To put in place a policy framework in order to enable the department to empanel/engage News Web Channels, News Websites/Web Portals, Social Media Influencers/Handlers on the basis of various criteria, terms & conditions and processes stipulated in these guidelines.

(c) To optimally utilize the News Web Channels, News Web Portals and Social Media Influencers/Handlers to publicize and promote the policies, programmes and development initiatives of the State Government.

(d) To empanel/engage News Web Channels, News Websites/Web Portals, Social Media Influencers/Handlers for publicizing policies, programmes and development initiatives of the State Government. The News Web Channels, News Websites/Web Portals and Social Media Influencers/Handlers would be issued government advertisements after empanelment/engagement with the Information and Public Relations Department.

4. Short title and extent of policy:

(a) This policy shall be called as Himachal Pradesh Digital Media Policy-2024 (b) This Policy shall be applicable in the State of Himachal Pradesh with effect from the date of its publication in the Official Gazette.

5. Definitions:

Unless there is something repugnant in the subject or content, the terms used in this Policy are in the sense explained hereunder:—

(a) "Advertisement" means advertisements of all the Departments, Public Sector Undertakings (PSUs) and Autonomous Bodies such as Boards and Corporations, Urban Local Bodies (ULBs), Universities, various Commissions, Authorities, Societies constituted by Government Departments, Trusts under Government, Apex Cooperative Institutions and other State Government Institutions (SGIs), Organizations etc., released through Director Information and Public Relations or Society/Agency constituted for the purpose by the DIPR;

Government from time to time for release of advertisements;

(c) "Audio-Visual Advertisements and Audio Advertisements" audio visual advertisement means a visual presentation, typically a moving picture which is accompanied by sound and Audio Advertisements means a sound based presentation of the content;

(d) "bankrupt or Insolvent" the term used in this policy shall have the same meaning as defined in clause (3) of Section 79 of the Insolvent and Bankruptcy Code 2016;

(e) "blacklist" means debarring a Digital Media from the privilege and advantages of entering into lawful relationship with the Government for purpose of gains;

(f) "Competent Authority" means the Director, Information and Public Relations, Himachal Pradesh, or any other officer authorized as such by him/her for this specific purpose;

(g) "Department" means the Department of Information and Public Relations, Himachal Pradesh;

(h) "DAVP (CBC) Rates" means the rates decided by the Directorate of Advertising and Visual Publicity (Central Bureau of Communication), Government of India, wherever applicable;

(i) "DI&PR" means the Director, Information and Public Relations Department, Himachal Pradesh;

(j) "Empanelment/Engagement" means to enlist news based digital media in a list maintained by the Director Information and Public Relations as per the prescribed procedure and criteria fixed for this purpose for the release of State Government advertisements;

(k) "Empanelment and Rate Advisory Committee" means a Committee of the officers of the Information and Public Relations Department constituted to examine the applications for empanelment and recommend the empanelment as per the provision of the policy;

(l) "Government/State Government" means the Government of the State of Himachal Pradesh in the Department of Information and Public Relations;

(m) "Government Advertisement" means any message conveyed and paid for by the government/department for placement in the media which includes both copy (written text/audio) and creative (visuals/video/multi-media);

(n) "News Web Channel" (herein referred to as the "Channel") shall include any internet based News Channel permanently engaged in disseminating news at regular intervals daily and verified by YouTube and Facebook platforms;

(o) "Pixels" means the basic unit of programmable colour on a computer display or in a computer image. The Pixel dimension is the horizontal and vertical measurements of an image expressed in pixels. The pixel dimensions may be determined by multiplying both the width and height by the DPI (dots per inch);

(p) "Social Media Platforms" means a web-based and mobile-based Internet Application that allows the creation, access and exchange of user-generated content. The content on the Social Media platform may be in the form of text, audio-visual, graphics, animation or any other form prescribed by the department from time to time; and

(q) "Social Media Influencers/Handlers" means user on Social Media who has established credibility in a specific industry. These content creators have access to a large audience and can share information to persuade others through their authenticity and reach.

(r) "The Digital media" means News Web Channels, News Websites/Web Portals and social media platforms like Facebook, YouTube, Instagram, Twitter etc.

(s) "Unique user/visitor count'' means counts of website's individual visitor/one visitor over a specific period. It does not matter how many times they visited the website during that period i.e. if one individual visits the site ten times, still count that person as one visit;

(t) "Websites/Web Portal" means a collection of various web pages linked to a particular web domain, which are operated through Internet. It should have URL (Uniform Resource Locator) to ensure that it is a part of World Wide Web (www);

(u) "Web Banner Advertisement" means a form of advertising on the World Wide Web (WWW) delivered by an ad-server. This form of online advertising entails embedding an advertisement into a web page. The web banner will be in the shape of animation, static or rotating;

6. The Digital Media Policy-2024 shall cover empanelment/ engagement/accreditation

and release of advertisements to following:

(A) News Web Channels (B) News websites/Portals (C) Social Media Influencers/Handlers

The above mentioned platforms of the Digital Media will be regulated through policy guidelines defined here under.

7. Nodal Agency:

The Department of Information and Public Relations, Himachal Pradesh shall be the nodal agency for release of advertisements of all State Government Departments, Boards and Corporations to the Web News Channels, News Websites/Web Portals and Social Media Influencers/Handlers empanelled/engaged by the Authority. Accordingly, all Government Departments/Boards/Corporations shall release Government advertisement after obtaining prior approval of the Authority subject to the condition that concerned Department/ Board / Corporation etc. shall be responsible for the correctness of the content of advertisement and that only approved photograph of the VIP will be used in the advertisement. The advertisement so designed shall be in conformity with the Guidelines/ instructions issued by the Government and the judgements passed by the Hon'ble Courts from time to time.

8. Eligibility criteria

A. Eligibility criteria for empanelment of News Web Channels:

be eligible for empanelment with the Department, namely:

(a) Only channels owned and operated by registered companies and firms with the State Government or Government of India other than individuals shall be considered for empanelment;

(b) the empanelment will be given to only one news web channel of a particular registered company giving maximum coverage to the state of Himachal Pradesh;

(c) the Channel should have a minimum annual turnover of ` 5 lakh in the last 2 years;

(d) the Channel or its owner or partners should not be bankrupt or insolvent;

(e) the Channel should not have been blacklisted or de-empanelled by any State Government or Government of India. The applicant shall upload a self declaration to this effect;

(f) the Channel should have continuously operated under the same name for a minimum period of two years in Himachal Pradesh and should be giving 80 percent coverage to the State;

(g) the Channel should have atleast Five lakh subscribers on the date of submission of application for empanelment, by way of—

i. Combined verified Facebook and YouTube official handles; or

ii. Verified Facebook official handle; or

iii. Verified YouTube official handle.

(h) the News Web Channel existent from last two years will have to submit the Facebook and YouTube analytics report for a period of six months before the date of application;

(i) the Channel should have uploaded atleast three hundred news videos or sound bytes or news items (VOs/News Capsules or interviews) with in the period of one month during the period of last three months from the date of application;

(j) the Channel should have dedicated staff and an office in Himachal Pradesh;

(k) the Channel applying for empanelment shall submit a certificate that the information submitted is correct. It shall also certify that it shall abide by the decision of the Competent Authority regarding empanelment, rates, telecast etc. In case the information submitted by the applicant is found to be false or11960 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 incorrect, in any manner at any stage, the empanelment shall be cancelled immediately;

(l) the empanelment will be non-transferable.

B. Eligibility Criteria for Empanelment of News Websites/News Web Portals:

(a) The Editor of the News Website/Web Portal shall be a bonafide resident of the State of Himachal Pradesh.

(b) The News Websites/Web portals must be exclusively dedicated for News. The Editor of the Website/Web portal will submit an undertaking/notarized certificate to this effect.

(c) The News Website/Web Portal should have continuously operated under the same name (Website Address) for minimum two years. The said period shall be calculated backward from the date of submission of application for empanelment. The Editor of the News Website/Web Portal must submit documents of domain registration of News Website/Web Portal.

(d) Unique User Counts, which decides the extent of coverage of a News Website/Web Portal, is an important parameter to gauge the reach of a particular News Website/Web Portal. The News Website/Web portal having average Unique User Counts of atleast 5001/per month for last six months (proceeding 6 months from the day of submitting application in the department) will be eligible for empanelment. The last six months' average Unique Users (UU) data will be cross-checked and verified with the Google Analytics that monitors website traffic in India. This condition aims at ensuring that the visibility of Government advertisements is increased by strategically placing the advertisements on News Websites/Web Portals having higher Unique Users per month. The Unique Users count of News Websites/Web Portals will be decided on the basis of Google Analytics data and the Editor of the News Website/Web portal will have to provide this data to the Authority with the application for empanelment and also monthly data in this respect on regular basis. If required, the Authority will cross- check the UU data submitted by the Editors of the News Websites/Web Portals through a credible third-party tool that monitors website traffic in India.

(e) The News Website/Web portal of only those editors will be considered for empanelment provided he/she:—

(i) holds a Diploma / Bachelor's Degree in Journalism/Mass Communication

Or

(ii) has minimum 10 years of experience in Web Journalism.

(f) Only those News Websites will be considered whose Editors are pursuing Web Journalism as their primary job.

(g) The Editor of the News Website should be a full time web journalist and should not be an employee (regular/contract/outsource or receiving any honorarium) of the Government/PSU/organization/Media House and will have to submit affidavit to this effect.

(h) Only one Editor of a News Website will be empanelled from a family (UHF/Joint Family).

The News Websites/Web Portals shall be categorised into following three classes on the basis of the average unique user count for the period of six months (proceeding 6 months from the day of submitting application in the department) prior to first date of application for empanelment and for the purpose of fixing of rates for the release of advertisements:

C. Eligibility Criteria for Engagement of Social Media Influencers/Handlers:

The social media Influencers/Handlers:—

(a) must fall under the definition given in clause 5 (q);

(b) must be under continuous operation under the same domain name/access address for minimum of one year; and

(c) the applicant platform will be segmented on the basis of Subscribers/ followers count as under:—

Category A - Minimum 5 lac subscribers/followers with atleast minimum

100 video or 150 posts in last six months.

Category B - Minimum 4 lac subscribers/followers with atleast minimum 60 video or 90 posts in last six months.

Category C - Minimum 2 lac subscribers/followers with atleast minimum 30 video or 45 posts in last six months.

Category D - Minimum 50 Thousand subscribers/followers with atleast minimum 15 video or 20 posts in last six months.

(d) Social Media Influencers/Handlers must have earned at least 50 percent of subscribers or followers at least six months prior to the date of application for enlistment. Social Media analytics/insight report in support of this claim is required to be submitted.

(e) Departmental committee will verify Analytics/ Insights during the engagement process or at any stage before issuing advertisement.

9. Procedure for Empanelment/Engagement:

(a) For empanelment/engagement with Department of Information and Public Relations, the News Web Channels, Websites/Web Portals and Social Media Influencers/Handlers, shall apply to the Competent Authority in a prescribed format in11962 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 Annexure A, B and C respectively alongwith relevant documents as specified. After the submissions of application by the applicant, the same shall be scrutinized by the Departmental Empanelment and Rate Advisory Committee (ERAC), which shall verify the documents submitted by the applicant, and after due satisfaction of the Competent Authority may empanel/engage the News Web Channels, Websites/Web Portals and Social Media Influencers/Handlers. The composition of Empanelment and Rate Advisory Committee will be as under:—

There shall be an Empanelment and Rate Advisory Committee (ERAC) consisting of the following officers:—

(i) Add./Joint Director (Administration) (ii) Officer in-charge (Technical) (iii) Asstt. Controller (Finance &Accounts) (iv) Officer In-charge (Advertisement)

Member (b) The Empanelment and Rate Advisory Committee (ERAC) shall meet after every three months to scrutinize the applications for empanelment received in the department. (c) The application for empanelment/engagement can be submitted to the Competent Authority subject to the condition that eligibility criteria are fulfilled. The applications received in the first quarter of calendar year will be processed in the month of April and applications received in second, third and fourth quarter will be processed in the month of July, October and January respectively.

10. Terms & Conditions:

(a) The Authority may demand reports from a third-party server engaged by the empanelled News Web Channels, News Websites/Web Portals for Google Analytics and Analytics/Insights whenever required. The entire expenditure on engagement of Third-Party Server etc. will be borne by the Editor of the News Web Channel, News Website/Web portal and Social Media Influencer/Handler concerned.

(b) The Editor of the News Web Channel, News Website/Web-portal and Social Media Influencers/Handlers shall comply with the provisions of the Information Technology (Intermediaries Guidelines and Digital Media Ethics Code) Rules, 2021, other relevant extant Acts, Rules, Regulations and instructions issued by the Government/Authority from time to time.

(c) The cost of all technical requirements, such as adapting the design format provided by the Authority to the News Website/Web Portal format, shall be borne by the concerned Digital Media platform subject to the condition that adaptation can be done with the prior approval of the Authority.

(d) The media planning for a campaign is done on the basis of publicity requirement and target audience for the campaign. The empanelment/engagement of a News Web Channel, News Website/Web Portal and Social Media Influencer/Handler would not guarantee assured business.

(e) The empanelled/engaged News Web Channels, News Websites/Web Portals and Social Media Influencers/Handlers may be debarred from Government advertisements by the Authority for the remaining period of its empanelment, if it refuses to carry11963 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 advertisements issued by the Authority or the Departments, PSUs and Autonomous Bodies of Government of Himachal Pradesh.

(f) Notwithstanding anything contained in these Guidelines, the decision of the Authority shall be final in case of any disagreement.

(g) The News Web Channels, News Website/Web Portal, Social Media Influencers/Handlers with record of publishing fake/distorted/incomplete/incorrect information, inciting communal passion, violence, undermining sovereignty and integrity of India or socially accepted norms of public decency and behaviour shall not be considered for empanelment and whenever it indulges into these activities after empanelment, shall be liable for cancellation of the empanelment and penal action.

(h) The e-edition of daily/weekly newspapers will not be considered for empanelment as the Editors of these daily/weekly newspapers are bound to include the advertisement issued by the Government Departments in e-edition of these daily/weekly newspapers as per the guidelines of RNI/DAVP.

(i) Notwithstanding anything contained in these Guidelines, the Government reserves the right to relax any of the condition and change, modify, revise and remove /repeal whole or any part of it.

(j) The Government reserves the right to change the rate and add, modify and delete any property of advertisement and fix rate of modified/added advertisement property.

(k) The rate fixed for a particular advertisement property for a particular category of news web channel, News Websites/News Web Portals and Social Media Influencers/Handlers shall be applicable for all the categories of Digital Media Platforms, irrespective of their subscribers/followers.

(l) All rates will be net rates. The applicable GST shall be paid extra.

11. Responsibilities the News Web Channels, Websites/Web Portals and Social Media

Influencers/Handlers:

(a) All the Government advertisements shall only be displayed on any or all of the following:—

(i) Political Interviews or News; (ii) Daily News Bulletins; (iii) Debates or Discussions; (iv) Special Editorial Interviews; and (v) Himachal Pradesh Specific News; (vi) Normal view area of the home page of the News Website/Web Portal; (vii) While Influencers video is running.

(b) The advertisements on the following categories can lead to penalties or cancellation of empanelment/engagement:—

(i) Hate Speech (ii) Violent Content (iii) Adult Nudity and Sexual Activity, Intoxicants (Liquor);

(iv) Cruel and Insensitive Content; (v) Personal Disputes; (vi) False/Fake news; (vii) Misrepresentation; (viii) Anti-State/ Anti-National Content sharing; (ix) Any other objectionable Material.

(c) The empanelled/engaged Digital Media platforms should be obliged to submit its bills (in hard copy), complete in all respects, within 30 days of completion of the campaign, along with certificates to the effect that the advertisement has been displayed or relayed on the Digital Media platforms. They shall also provide the entire schedule or log of the displayed or related advertisements alongwith YouTube Analytics and Facebook Analytics and PDF files of the daily screenshots;

(d) Online payments shall be made by the competent authority for only that period during which the advertisement was displayed at the DPR/DAVP rates, whichever applicable;

(e) The Empanelled/Engaged Digital Media platforms shall abide by all the instructions of the Government issued from time to time;

(f) They shall submit certified data regarding its views, after the interval of every three months.

(g) The Department may, from time to time, recheck or assign any agency to countercheck the data provided by the empanelled/engaged Digital Media platforms.

12. Validity of the empanelment:

The empanelment/engagement of the News Web Channels, Websites/Web Portals and Social Media Influencers/Handlers shall be valid for Two years. The competent Authority may extend the empanelment/engagement further for a period of one year at a time subject to the satisfaction.

13. Suspension of empanelment/engagement:

If any empanelled/engaged Digital Media telecast hate speech, violent content, adult nudity and sexual activity, intoxicants (liquor), cruel and insensitive content, personal disputes, false/fake news, misrepresentation or any other objectionable material, then it shall lead to:

(a) immediate suspension of empanelment/engagement by the Competent Authority for a period of six months, and

(b) blacklisting for a period as may be specified, but not less than six months, by the Competent Authority.

14. Cancellation of the empanelment/engagement:

The empanelment/engagement of the News Web Channels, News Websites/Web Portals and Social Media Influencers/Handlers shall be cancelled by the Competent Authority if:—

(a) They refuses to carry an advertisement issued by the department at any time; or11965 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 (b) News Web Channel, News Website/Web Portal and Social Media Influencer/Handler ceases to fulfil the eligibility criteria until they qualify again:

Provided that where the Competent Authority passes an order under sub-clause (a) and (b) it shall not empanel the Digital Media platform again until after the passage of six months from the date of passing such an order:

Provided further that where the Competent Authority passes an order under sub-clause (b) it may, on a fresh application moved by the social media platform, empanel it again on satisfactory compliance of the qualifications prescribed in this policy.

15. Government Advertisement Format:

(i) Aston Band Format: The advertisements shall be shared in animated aston band format to be used on videos exclusively for the Government;

(ii) Video advertisements: Video advertisements of duration of five seconds or more shall be embedded with particular videos as a part of the video with the given duration timing and it shall be the first advertisement inserted in such a video;

(iii) L-Band format: The advertisements in L-Band format shall be displayed alongwith other advertisements on videos exclusively for the Government;

(iv) Advertisement shall only be inserted in a verified Facebook or YouTube Channel.

16. Fixation of Government advertisement rates:

Advertisement Rates for News Web Channels/News Websites/Web portals and Social

Media Influencers/Handlers:

(i) The State Government will fix rate of Government advertisement for the different categories of News Web Channels/News Websites/Web portals and Social Media Influencers/Handlers on the basis of their category. The rate of advertisement so fixed will be applicable to all the State Government Departments/Boards/Corporations etc. for releasing the advertisements to the Empanelled News Websites/Web Portals and Social Media Influencers/Handlers.

(ii) The ERAC (Empanelment and Rate Advisory Committee) will recommend the rates of different advertisement properties to the Director Information and Public Relations who will submit these recommendations to the State Government for approval. The State Government will notify the approved rates.

(iii) The minimum base rate fixed in a category for the Video ads would be offered to all News Web Channels/News Websites/Web portals and Social Media Influencers/Handlers in the category found eligible on the basis of minimum subscriber/follower data.

(iv) The minimum base rate for the Aston Band Format ads would be offered to all applicant News Web Channels/ Social Media Influencers/Handlers in the category found eligible on the basis of minimum subscriber/follower data.

(v) The minimum base rate in category for the L-Band Format ads would be offered to all applicant News Web Channels/ Social Media Influencers/Handlers in that category found eligible on the basis of minimum subscriber data.

(vi) The Empanelment and Rate Advisory Committee (ERAC) will recommend the advertisement rates for different advertisement properties for News Web Channels/News Websites/Web portals and Social Media Influencers/Handlers on the basis of their category to the Authority who will get these rates approved and notified by the State Government.

(vii) The Department will issue Display Advertisement of different advertisement property from time to time as per the requirement. The advertisement rates for each Category of News Web Channels/News Website/Web portal and Social Media Influencers/Handlers will be fixed in Rupees for following advertisement properties:—

(a) News Web Channels:

(i) Aston Band and L – Band format

(ii) Video advertisement

(b) News Websites/Web portals:

The payment will be made for displaying the advertisement on the News Website/Web Portal for the entire month on 24x7 basis. The Daily display charges on account of displaying advertisement will be on Pro-Rata basis, whenever required.

(c) Advertisement Rates for Social Media Influencers/Handlers:

Social Media handle/page/Channel falling under different categories and fulfilling all codal formalities will be released advertisements for the advertisement properties detailed below:

17. Accreditation/Recognition to the Editors of News Web Channels/News Websites/Web

portals:

In order to provide access to the sources of information in Government and Semi- Government Departments/Organizations of the State Government, the Government may consider granting accreditation/recognition to the Editors of the News Web Channels/ News Websites/Web portals by making necessary provisions in the relevant rules, after notification of this policy.

Note:

(i) It will be obligatory for the empanelled social media Influencer/ Handle/ to complete one audio-video assignment of minimum three minutes duration every month as per directions of the Authority in the local dialect.

(ii) The Government reserves the right to change the rate and add, modify and delete any property of advertisement and fix rate of modified/added advertisement property.

(iii) The rate fixed for a particular advertisement property for a particular category of news web channel shall be applicable for all the news web channel falling in that category, irrespective of their subscribers/followers.

(iv) All rates will be net rates. The applicable GST shall be paid extra.

(v) The State Government in case intends to utilize other Digital Media Platforms such as Internet Websites, Mobile Applications, OTT Platforms, and Digital Audio Platforms etc., the Digital Advertisement Policy-2023 notified by the Ministry of Information and Broadcasting, Central Bureau of Communication, GoI will be followed.

But if any casual vacancies have been declared on or after 11-01-2024 in such cases the last finally published electoral rolls shall be used for the conduct of ensuing by- elections. Any eligible person can apply for inclusion of name under Rule 24(3) of the ibid Rules to the District Election Officers (Panchayats) after paying fee of rupees two in cash against receipt, or for correction under Rule 23 of the Rules ibid in the electoral roll not later than nine days before last date fixed for filing of nomination papers.

संख्याः गृह-ए-बी0 2/3/2023-गृह-ए-हिमाचल प्रदेश सचिवालय.--प्रारूप हिमाचल प्रदेश पुलिस विभाग (कांस्टेबल की भर्ती) नियम, 2024 को हिमाचल प्रदेश पुलिस अधिनियम, 2007 (2007 का अधिनियम संख्यांक 17) की धारा 23 के साथ पठित धारा 141 की उपधारा (1) के अधीन यथा अपेक्षानुसार तदद्वारा सम्भाव्य प्रभावित होने वाले व्यक्ति (व्यक्तियों) से आक्षेप (पों) और सुझाव(वों) को आमंत्रित करने के लिए, इस विभाग की समसंख्यक अधिसूचना, तारीख 06-0172024 द्वारा राजपत्र (ई-गजट) हिमाचल प्रदेश में प्रकाशित किया गया था;

और राज्य सरकार को इस निमित्त नियत अवधि के भीतर आक्षेप और सुझाव प्राप्त हुए हैं और उन पर सम्यक्‌ रूप से विचार किया गया है;

अतः हिमाचल प्रदेश के राज्यपाल, हिमाचल प्रदेश पुलिस अधिनियम, 2007 (2007 का अधिनियम संख्यांक 17) की धारा 23 के साथ पठित धारा 141 की उपधारा (1) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्‌ :-

भाग-I

1. संक्षिप्त नाम और प्रारम्भ.--(1) इन नियमों का संक्षिप्त नाम हिमाचल प्रदेश पुलिस विभाग (कांस्टेबल की भर्ती) नियम, 2024 है।

(2) ये नियम राजपत्र (ई-गजट), हिमाचल प्रदेश में प्रकाशित किए जाने की तारीख से प्रवृत्त होंगे। 2. निरसन और व्यावृत्तियां.--(1) इस विभाग की अधिसूचना संख्या गृह(ए)ए(3)-2/2020, तारीख 05-08-2021 द्वारा अधिसूचित और तारीख 09 अगस्त, 2021 को राजपत्र, हिमाचल प्रदेश में प्रकाशित हिमाचल प्रदेश पुलिस विभाग (कांस्टेबल की भर्ती) नियम, 2021 का एतद्‌द्वारा निरसन किया जाता है। (2) ऐसे निरसन के होते हुए भी उपर्युक्त उप-नियम (1) के अधीन इस प्रकार निरसित नियमों के अधीन की गई कोई नियुक्ति, बात या कार्रवाई इन नियमों के अधीन विधिमान्य रूप में की गई समझी जाएगी।

भाग-II

3. कांस्टेबल की भर्ती.--भर्ती वर्ष में एक बार या ऐसे अन्तराल जैसा रिक्तियों के आधार पर यथा अपेक्षित सुनिश्चित (निर्धारित) किया जाए, शत प्रतिशत नियमित आधार पर की जाएगी।

4. पदों की संख्या और प्रभाजन.--(1) पदों की संख्या ऐसी होगी, जैसी सरकार द्वारा समय-समय पर अवधारित/सृजित की जाए।

(2) कांस्टेबल के पद, जिले की जनसंख्या के अनुपात के आधार पर भरे जाएंगे। महिला अभ्यर्थियों को तीस प्रतिशत (30%) क्षैतिज (हॉरिजॉन्टल) आरक्षण प्रदान किया जाएगा और अन्य प्रवर्गों को उपलब्ध ऊध्र्वाधर आरक्षण सहित क्षैतिज आरक्षण के समस्त प्रवर्गों में पृथकतः भरा जाएगा।

(3) कांस्टेबल (चालक) की रिक्तियां केवल पुरुष अभ्यर्थियों में से भरी जाएंगी।

5. नियुक्ति प्राधिकारी.--बटालियन के कमांडेंट नियुक्ति प्राधिकारी होंगे।

6. वेतन और भत्ते.--कर्मचारी ऐसे वेतन और भत्ते आहरित करेगा जैसे राज्य सरकार द्वारा समय-समय पर इस निमित्त अवधारित किए जाएं।

7. आरक्षण.--(1) अनुसूचित जाति/अनुसूचित जनजाति/अन्य पिछड़ा वर्ग के मध्य ऊध्र्वाधर आरक्षण सरकार द्वारा समय-समय पर इस विषय पर जारी अनुदेशों के अनुसार किया जाएगा। इसके अतिरिक्त, आर्थिक रूप से कमजोर वर्ग (ई0डब्लू0एस0), जो अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों के लिए आरक्षण की स्कीम के अन्तर्गत नहीं आते हैं, को सीधी भर्ती में दस प्रतिशत ऊध्र्वाधर आरक्षण प्रदान किया जाएगा। महिलाओं, भूतपूर्व सैनिकों, स्वतन्त्रता सैनानियों के प्रतिपाल्यों (वार्डों), अन्त्योदय, बीपीएल, विशिष्ट खिलाड़ियों और गृह रक्षकों के लिए विशेष क्षैतिज (हॉरिजॉन्टल) आरक्षण सरकार द्वारा समय-समय पर जारी अनुदेशों के अनुसार प्रदान किया जाएगा।

(2) भूतपूर्व सैनिकों की रिक्तियों के लिए अध्यपेक्षा को पुलिस महानिदेशक, हिमाचल प्रदेश द्वारा सचिव, भूतपूर्व सैनिक सैल, हमीरपुर को नाम प्रेषित/प्रायोजित करने के लिए भेजा जाएगा। अध्यपेेक्षा में प्रत्येक जिला के लिए पदों की संख्या विनिर्दिष्ट की जाएगी और नामों को तद्‌नुसार प्रायोजित किया जाएगा। (3) भूतपूर्व सैनिकों के लिए आरक्षित रिक्ति के विरुद्ध उपयुक्त/पात्र अभ्यर्थी की अनुपलब्धता की दशा में, रिक्ति को आगामी दो कलेंडर वर्षों के लिए अग्रनीत किया जाएगा और तृतीय वर्ष में उक्त रिक्ति को भूतपूर्व-सैनिकों के आश्रित पुत्रों/पुत्रियों और पत्नियों में से भरा जाएगा। यदि तृतीय वर्ष में पात्र/उपयुक्त अभ्यर्थी, जिनके लिए रिक्त पद आरक्षित हैं, उपलब्ध नहीं हों तो उसे संबंधित अवशिष्ट प्रवर्ग, जिसके हेतुक उस वर्ष बिन्दु स्वतः सम्बन्धित है, में से भरा जाएगा। जब यह स्पष्ट हो कि भूतपूर्व-सैनिक के पदों के किसी 11982 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 प्रवर्ग की नियुक्ति हेतु किसी भी कारण से उपलब्ध नहीं होगा तो भूतपूर्व-सैनिकों के लिए इस प्रकार आरक्षित पदों को भूतपूर्व-सैनिक सैल, हिमाचल प्रदेश की पूर्व सहमति से भूतपूर्व-सैनिकों के आश्रित पुत्रों, पुत्रियों और पत्नियों में से भरा जा सकेगा। यदि भरे जाने वाले प्राधिकृत पदों हेतु भूतपूर्व-सैनिकों के पुत्र, पुत्रियां और पत्नियां उपलब्ध न हों तो आरक्षण को आगामी दो कैलेण्डर वर्षों के लिए अग्रनीत किया जाएगा, जिसके पश्चात्‌ रिक्ति को संबंधित अवशिष्ट प्रवर्ग, जिसके हेतुक बिन्दु सम्बन्धित है, में से भरा जाएगा।

8. पात्रता.--(1) शैक्षिक और अन्य अर्हताएं तथा शारीरिक मानदण्ड निम्न प्रकार से होंगेः-

(2) भूतपूर्व-सैनिकों की दशा में न्यूनतम अर्हता दसवीं पास होगी। तथापि, जब कभी भी रिक्तियां भूतपूर्व-सैनिकों के प्रतिपाल्यों को जाती हैं तो उनकी शैक्षिक अर्हता 10+2 होगी।

(3) अभ्यर्थी कांस्टेबल के पद की भर्ती के लिए पात्र होगा, यदि उसने हिमाचल प्रदेश में अवस्थित किसी संस्थान/स्कूल/बोर्ड से दसवीं और दस जमा दो की परीक्षा उत्तीर्ण की होः

परंतु यह शर्त हिमाचल के वास्तविक निवासी को लागू नहीं होगी।

9. शारीरिक मानपरीक्षण.--(1) समस्त माप चिकित्सा अधिकारी द्वारा लिए जाएंगे, जिन्हें अभ्यर्थी की शीट में अभिलिखित किया जाएगा और चिकित्सा अधिकारी द्वारा हस्ताक्षरित किया जाएगा तथा भर्ती अभिकरण के सदस्य द्वारा प्रतिहस्ताक्षरित किया जाएगा। इस प्रक्रिया की वीडियोग्राफी की जाएगी। समिति निम्नलिखित सारणी के अनुसार केवल लम्बाई के लिए ही अंक प्रदान करेगीः-

(2) अभ्यर्थी, जो नियम 8 के उप-नियम (1) मेें विनिर्दिष्ट मानदण्डों को पूरा नहीं करते हैं, को संक्षिप्ततः अनुपयुक्त घोषित कर दिया जाएगा और उन्हें तद्‌नुसार सूचित कर दिया जाएगा।

10. अभ्यर्थियों का शारीरिक दक्षता परीक्षण.--(1) शारीरिक दक्षता परीक्षण निम्नलिखित ब्यौरों के अनुसार केवल अर्हक प्रकृति का होगाः-

(2) भर्ती एजेंसी अभ्यर्थी की शीट में शारीरिक दक्षता परीक्षण का समय और दूरी का अभिलेख प्रविष्ट करवाएगी जिसे समिति के प्रत्येक सदस्य द्वारा सम्यक्‌ रूप से हस्ताक्षरित किया जाएगा।

(3) अभ्यर्थी, जो किसी प्रतिस्पर्धा को अर्हित करने में असफल रहते हैं, को तत्काल (तुरंत) निरर्हित कर दिया जाएगा और वे शेष प्रतिस्पर्धाओं में भाग नहीं ले सकेंगे।

(4) पारदर्शिता बनाए रखने के लिए बाहरी शारीरिक दक्षता परीक्षण और लिखित परीक्षा की वीडियोग्राफी की जाएगी।

(5) कांस्टेबलों की भर्ती के दौरान शारीरिक दक्षता परीक्षण के आरम्भ में मादक पदार्थों के सेवन का पता लगाने हेतु डोप टेस्ट (परीक्षण) किया जाएगा।

11. भर्ती अभिकरण.--हिमाचल प्रदेश राज्य लोक सेवा आयोग या सक्षम सरकार द्वारा समय-समय पर यथा-विनिश्चित कोई अन्य अभिकरण भर्ती अभिकरण होगा। लिखित परीक्षा आनलाईन पद्धति में भर्ती अभिकरण द्वारा संचालित की जाएगी। आनलाइन पद्धति में भर्ती अभिकरण द्वारा संचालित की जाएगी। लिखित परीक्षा के संचालन और मूल्यांकन के ब्यौरे पृथकता या भर्ती अभिकरण द्वारा अधिसूचित किए जाएंगे। लिखित परीक्षा का पाठ्यक्रम 102 स्तर का होगा । प्रश्न पत्र दोनों भाषाओं अर्थात्‌ अंग्रेजी और हिंदी पाठ में उपलब्ध कराया जाएगा।

12. मूल्यांकन.--कांस्टेबल वर्ग-III पदों के रैंक में कांस्टेबल के पद के लिए चयन लिखित परीक्षा के गुणागुण निम्नलिखित मापदण्डों पर आधारित मूल्यांकन के आधार पर किया जाएगाः-

13. अन्तिम परिणाम का प्रकाशन.--(1) भर्ती अभिकरण से इस प्रकार प्राप्त चयनित अभ्यर्थियों की सूची नोटिस बोर्ड में भी प्रदर्शित की जाएगी।

(2) प्रतीक्षा सूची को भी उसी समय और उसी रीति में तैयार किया जाएगा किन्तु उसे नोटिस बोर्ड पर प्रदर्शित नहीं किया जाएगा तथा यदि किसी अभ्यर्थी के या तो कार्यग्रहण करने में असफल रहने या नियुक्ति के लिए पश्चात्‌वर्ती उपयुक्त न पाए जाने की संभावित-परिस्थिति का ध्यान रखने के लिए सम्बद्ध पुलिस अधीक्षक के कार्यालय में रखा जाएगा।

14. चिकित्सा परीक्षण.--(1) चयनित अभ्यर्थियों को सरकार द्वारा समय-समय पर जारी निर्देशों के अनुसार चिकित्सा परीक्षण करवाना होगा।

(2) प्रतीक्षा सूची से उपयुक्त अभ्यर्थी को उन अभ्यर्थियों, जिन्हें अंतिम रूप से चिकित्सीय रूप से अयोग्य घोषित कर दिया गया है, के स्थान पर रखा जाएगा ।

15. चरित्र और पूर्ववृत्त.--(1) चयनित अभ्यर्थी जो अस्थायी रूप से चयनित किए गए हैं, के चरित्र और पूर्ववृत्तों का सत्यापन सम्बद्ध जिला पुलिस के माध्यम से किया जाएगा, किंतु ऐसे सत्यापन के लंबित होने के कारण नियुक्ति पत्रों के जारी किए जाने की प्रक्रिया को रोका नहीं जाएगा। नियुक्ति प्राधिकारी, अभ्यर्थी से सम्यक्‌ रूप से भरे गए और हस्ताक्षरित सत्यापित प्रपत्र अभिप्राप्त करने और स्व-घोषणा करने के पश्चात्‌ अस्थायी नियुक्ति पत्र जारी करेंगे। यदि कोई अभ्यर्थी किसी विधि के न्यायालय से दोषसिद्ध पाया जाता है तो ऐसे आवेदक/अभ्यर्थी को अपराध की प्रकृति और सजा की अवधि पर विचार किए बिना नियुक्ति प्रदान नहीं की जाएगी।

(2) किसी अभ्यर्थी की दशा में जिसके विरुद्ध अन्वेषण विचारण (ट्रायल) लंबित है, नियुक्ति का प्रस्ताव तब तक आस्थगित रखा जाएगा जब तक कि अभ्यर्थी/आवेदक अन्वेषण या विचारण के दौरान समाशोधन प्राप्त नहीं कर लेता है। ऐसा अभ्यर्थी केवल इस कारण से अधिक आयु का हुआ नहीं समझा जाएगा।

(3) पद को प्रतीक्षा सूची से भरा जा सकेगा और अभ्यर्थी को पश्चात्‌वर्ती होने वाली रिक्ति के विरुद्ध नियुक्ति का प्रस्ताव दिया जाएगा।

16. नियुक्ति और परिवीक्षा.--चिकित्सा उपयुक्तता (फिटनेस) की घोषणा और चरित्र और पूर्ववृत्तों का सत्यापन के पश्चात अंतिम गुणागुण सूची में उपस्थित होने वाले अभ्यर्थियों को सम्बद्ध नियुक्ति प्राधिकारी द्वारा नियुक्ति पत्र जारी किया जाएगा। प्रारंभिक भर्ती पर समस्त पुलिस कांस्टेबलों को पुलिस महानिदेशक, हिमाचल प्रदेश द्वारा यथा-अवधारित बैचों में प्रवेश प्रशिक्षण/भर्ती प्रशिक्षण कोर्स करना होगा। प्रशिक्षण की अवधि नौ मास की होगी। बुनियादी भर्ती प्रशिक्षण पाठ्यक्रम (आरटीसी) पूरा होने के बाद भर्ती कांस्टेबल पीटीसी डरोह में विशेष कमांडो प्रशिक्षण से गुजरेंगे । प्रिंसिपल पीटीसी डरोह नए रंगरूटों को विशेष कमांडो बनाने के लिए 04 सप्ताह का कमांडो कोर्स तैयार करेंगे। प्रशिक्षण का पाठ्यक्रम और उसका कार्यक्रम पुलिस महानिदेशक द्वारा स्थायी आदेशों के माध्यम से अधिसूचित किया जाएगा। भर्ती प्रशिक्षण कोर्स और स्पेशल कमांडो कोर्स के सफल समापन पर, उम्मीदवारों को स्पेशल कमांडो कांस्टेबल के रूप में बुलाया जाएगा। यदि कोई भर्ती किए जाने वाला व्यक्ति भर्ती प्रशिक्षण कोर्स और स्पेशल कमांडो कोर्स को उत्तीर्ण करने में असफल रहता है तो उसकी सेवा पर्यवसित किए जाने हेतु दायी होगी। भर्ती किए जाने वाले व्यक्तियों का भर्ती प्रशिक्षण कोर्स के और स्पेशल कमांडो कोर्स सफलतापूर्वक पूर्ण होने और भर्ती प्रशिक्षण कोर्स और स्पेशल कमांडो कोर्स सहित दो वर्ष की परिवीक्षा पूर्ण होने के पश्चात्‌ ही स्थायीकरण किया जाएगा।11985 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 17. रोस्टर और वरिष्ठता.--(1) कांस्टेबल के संवर्ग (काडर) की बाबत ऊध्र्वाधर और क्षैतिज आरक्षित रिक्तियों की संख्या को अवधारित करने हेतु जिलावार शतप्रतिशत बिन्दु रोस्टर, राज्य सरकार द्वारा समय-समय पर जारी नियमों और अनुदेशों, यदि लागू हैं, का अनुसरण किया जाएगा।

(2) चयनित कांस्टेबलों (अभ्यर्थियों) की वरिष्ठता सम्बन्धित नियुक्ति प्राधिकारी द्वारा इस विषय पर समय-समय पर राज्य सरकार द्वारा जारी नियमों/अनुदेशों के अनुसार काडर (संवर्ग) के स्तरानुसार अनुरक्षित की जाएगी।

18. शिथिल करने की शक्ति.--जहां राज्य सरकार की यह राय हो कि ऐसा करना अनिवार्य या समीचीन है वहां वह कारणों को लिखित में अभिलिखित करके आदेशों द्वारा, इन नियमों के किसी/किन्हीं उपबन्ध (उपबन्धों) को शिथिल कर सकेगी।

No. HOME-A-B02/3/2023-HOME-A-HIMACHAL PRADESH SECRETARIAT.— Whereas, the draft Himachal Pradesh Police Department (Recruitment of Constables) Rules, 2024 were published in Rajpatra (e-Gazette), Himachal Pradesh vide this department's notification of even number dated 06-01-2024 for inviting objection(s) and suggestion(s) from the person(s) likely to be affected thereby, as required under sub-section (1) of section 141 read with section 23 of the Himachal Pradesh Police Act, 2007 (Act No. 17 of 2007);

And whereas, objection(s) and suggestion(s) have been received within the stipulated period by the State Government in this behalf and the same have been duly considered;

Now, therefore, in exercise of the powers conferred by sub-section (1) of section 141 read with section 23 of the Himachal Pradesh Police Act, 2007 (Act No. 17 of 2007), the Governor of Himachal Pradesh, is pleased to make the following rules, namely;

PART-I

1. Short title and commencement.—(1) These rules may be called The Himachal Pradesh Police Department (Recruitment of Constables) Rules, 2024.

(2) These rules shall come into force from the date of their publication in the Rajpatra (e-gazette), Himachal Pradesh.

2. Repeal and savings.—(1) The Himachal Pradesh Police Department (Recruitment of Constables) Rules, 2021 notified vide this Department Notification No. Home (A) A(3)-2/2020, dated 05-08-2021 and published in Rajpatra, Himachal Pradesh dated 09th August, 2021 are, hereby, repealed.

(2) Notwithstanding such repeal, any appointment made or anything done or any action taken under the rules so repealed under sub-rule (1) supra, shall be deemed to have been validly made or done or taken under these rules.

PART–II

3. Recruitment of constables.—Recruitment shall be done 100 percent on regular basis once a year or at such frequency as may be required based on vacancies as may be determined.

4. Number and apportionment of posts.—(1) The number of posts shall be determined/ created by the Government, from time to time.

(2) Posts of Constables will be filled on the basis of the ratio of population of the district. Women shall be provided thirty percent (30%) horizontal reservation and will be filled up in all the categories of vertical reservation separately alongwith horizontal reservation being available to other categories.

(3) Vacancies of Constable (Driver) shall be filled from among male candidates only 5. Appointing authority.—Commandants of Battalions shall be the appointing authority.

6. Pay and allowances.— The official shall draw such pay and allowances as may be determined by the State Government in this regard, from time to time.

7. Reservation.—(1) Vertical Reservation amongst SC/ST/ OBC shall be as per Government instructions on the subject from time to time. Further, the persons belonging to Economically Weaker Sections (EWSs) who are not covered under the scheme of reservation for SCs, STs and OBCs shall be provided 10% vertical reservation in direct recruitment. Special horizontal reservation for women, ex-servicemen, wards of freedom fighters, Antyodaya/BPL, distinguished sports persons and Home Guards will be given as per Government instructions issued from time to time.

(2) The requisition for vacancies of Ex- servicemen shall be sent by the Director General of Police, HP to the Secretary, Ex- servicemen Cell, Hamirpur to sponsor names. The requisition shall specify the number of posts for each District and the names will be sponsored accordingly.

(3) In the event of non-availability of suitable/eligible candidate against the vacancy reserved for Ex-servicemen, the vacancy shall be carried forward for 2 calendar years and in the 3rd year the said vacancy shall be filled up from the dependent sons, daughters and wives of Ex-Servicemen. If in the 3rd year, the eligible/suitable candidate for whom the vacancy is reserved is not available, the same may be filled up from the respective residuary category to which the point belongs in that year itself. When it is obvious that Ex-servicemen would not at all be available for appointment to any category of posts, the posts so reserved for ex-servicemen may be filled-up by dependent sons, daughters and wives of ex-servicemen with the prior concurrence of the Ex- servicemen Cell, Himachal Pradesh. In case, sons, daughters and wives of Ex- servicemen for posts authorized to be filled are not available then reservation will be carried forward for 2 calendar years11987 राजपत्र, हिमाचल प्रदेश, 30 जनवरी 2024/10 माघ, 1945 where after the vacancy shall be filled up from the respective residuary category to which the point belongs.

8. Eligibility.—(1) Education and other qualifications and physical standards will be as follows:—

(2) In case of Ex-serviceman minimum qualification shall be matriculation. However, whenever the vacancies go to the wards of Ex-serviceman the education qualification will be 10+2.

(3) A candidate shall be eligible for recruitment to the post of Constable, if he/she has passed Matriculation and 10+2 from any Institution/School/Board situated within Himachal Pradesh:

Provided that this condition shall not apply to Bonafide Himachalis

9. Physical standard test.—(1) All measurements will be taken by a Medical Officer which shall be recorded in the Candidate Sheet and signed by the Medical Officer and countersigned by a Member of the Recruiting Agency. This process will be videographed. The Committee shall award marks only for height as per the following table:—

(2) Candidates who do not meet the standards specified in sub-rule (1) of rule 8 shall be summarily declared unfit and informed accordingly.

10. Physical efficiency of candidates.—(1) Physical Efficiency Test will be of qualifying nature alone as per the following details:—

(2) The Recruiting Agency shall cause to be entered the record of timing and distance of the Physical Efficiency Test in the Candidate's Sheet which will be duly signed by each Member of the Recruiting Agency.

(3) Candidates who fail to qualify in any event will be disqualified forthwith and willnot participate in the remaining events.

(4) Videography of the outdoor Physical Efficiency Test and Written Examination will be done for the sake of transparency.

(5) The dope test shall be carried out to detect narcotics opiates at the outset of Physical Efficiency Test during the recruitment of Constables.

11. Recruiting Agency.—The Recruiting Agency shall be H.P. Public Service Commission or any other agency as decided by the State Govt. from time to time. The written examination in online mode, shall be conducted by recruiting agency. The details of the conduct and evaluation of the written examination will separately notified by the recruiting agency.Written examination will be of 90 marks. The syllabus for the above written examination shall be of 10+2 standard. The questions papers will be provided in both languages i.e. English and the Hindi version.

12. Evaluation.—The merit list to the post of Constables in the rank of Constables Class-III posts shall be made on the basis of the merit of written examination and evaluation, based on the following parameters:—

13. Publication of final result.—The list of selected candidates so received from the Recruiting Agency shall also be published in the notice Board.

(2) Waiting List shall also be prepared at the same time in similar manner which shall not be displayed and shall be kept in the office of Recruiting Agency to take care of an eventuality when a suitable candidate either fails to join or is not found fit for appointment subsequently.

14. Medical examination.—(1) The selected candidates shall undergo a medical examination as per instructions of the State Government issued from time to time.

(2) Suitable candidates from the waiting list shall be substituted in the place of the candidates who have been finally declared medically unfit.

15. Character and antecedents.—(1) The verification of character and antecedents of the selected candidate who have been selected provisionally will be carried out through concerned district police but the process for issuance of appointment letters will not be withheld due to pendency of such verification. The appointing authorities will issue provisional appointment letters after obtaining the filled and duly signed attestation form and self declaration from the candidate. In case, a candidate is found to have been convicted in a court of law, the applicant/candidate shall not be offered appointment irrespective of the nature of the offense and the period of sentence.

(2) In case of a candidate against whom investigation trial is pending the offer of appointment may be held in abeyance until candidate/applicant get clearance during investigation or trial. Such a candidate shall not be deemed to have become overage on this account alone.

(3) The post may be filled up from the waiting list and the candidate will be offered a subsequently occurring vacancy.

16. Appointment and probation.—The candidates appearing in the final merit list after declaration of medical fitness and verification of character and antecedents shall be issued a letter of appointment by the concerned appointing authority. All Police Constables on initial recruitment shall undergo induction training/Recruits Training Course in batches as determined by the Director General of Police, H.P. The period of training shall be 9 months. After completion of basic Recruitment Training Course (RTC) the newly recruited Constables will undergo Special Commando Course at PTC Daroh. The Principal PTC Daroh will design a 04 weeks Commando Course for new recruits to make them Special Commandos. The syllabus of training and the schedule thereof shall be as may be notified by the Director General of Police, through Standing Orders. On successful completion of the RTC and Special Commando Course, the candidates will be called as Special Commando Constables. In case a recruit is unable to pass the recruitment training course and the special commando course, his/her service shall be liable to be terminated. Recruits will be confirmed only after successful completion of RTC & Special Commando Course and probation of 2 years including RTC & Special Commando Course.

17. Roster and seniority.—(1) A district-wise 100 point roster to determine the number of vertically and horizontally reserved vacancies in respect of Constable cadre shall be followed in terms of provisions of the rules and instructions issued by the State Government from time to time, if applicable.

(2) The seniority of the selected Constables shall be maintained by the respective Appointing Authority as per level of the cadre in accordance with the rules/ instructions issued by the State Government on the subject from time to time.

18. Power to relax.—Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing, relax any of the povision(s) of these rules.
