No. HHC/GAZ/10/89/2018.—Pursuant to the direction of the Hon'ble Supreme Court dated 04-01-2024, passed in W.P.(C) No-643 of 2015, titled All India Judges' Association Vs Union of India and Others, the Committee for Service Condition of the District Judiciary (in short CSCDJ) has been constituted by the Hon'ble Chief Justice of the HP High Court. The CSCDJ headed by the Hon'ble Mr Justice Ajay Mohan Goel, Judge, Chairman and comprising of Hon'ble Mr Justice Rakesh Kainthla, Judge, Registrar General, Secretary Law to the Govt. of H.P. and Nodal Officer for Pensioners, formulates the following Standard Operating Procedure (SOP),12608 राजपत्र, हिमाचल प्रदेश, 22 फरवरी 2024/03 फाल्गुन, 1945 for proper implementation of the recommendation of the Second National Judicial Pay Commission in respect of pay, pension and allowances, as approved by the Hon'ble Supreme Court, including payment of arrears thereof, to the Judicial Officers, pensioners and family pensioners etc. of the State of H.P.

STANDARD OPERATING PROCEDURE (SOP):

The Hon'ble Apex Court in para No. 86 of the judgment dated 04-01-2024,in W.P. (C) 643 of 2015, titled All India Judges Association Vs. Union of India & Ors., directed that a Standard Operating Procedure (SOP) is to be adopted with specified timeliness for claims and disbursal of allowances, as approved by the Apex Court, including the payment of arrears of salary and pension to the judicial officers, pensioners and family pensioners. The SOP shall also cover the following:

(a) The nodal agency for disbursement of allowances, arrears and other service and retiral benefits;

(b) Laying down a simplified and effective procedure for reimbursement and disbursement of claims;

(c) Providing contact details of the nodal agency at the district or State level;

(d) Publication of the SOP on the website of the High Court, together with the details of the nodal officer; and

(e) Maintenance of a database of retired Judges and family pensioners in the district judiciary with a process for periodical updating, at least on a quarterly basis.

In regard to the above, it is resolved by CSCDJ as follows:

A. Timeliness

(i) The Registrar General to send the communication to all the District & Sessions Judges forthwith, by devising a format, on which the District & Sessions Judges shall calculate the tentative amount of arrears on account of payment of various allowances to Judicial Officers, within a period of one week.

(ii) Nodal Officer for Pensioners, to calculate the tentative cost of arrears of pensioners/family pensioners, regarding Fixed Medical Allowance and Domestic Help Allowance, within a period of one week.

(iii) The Registrar (Accounts) to calculate the tentative cost of arrears of Judicial Officers posted in the Registry and shall collate the information received from all the District & Sessions Judges and Nodal Officer for Pensioners, immediately on its receipt.

(iv) The Registrar (Administration) shall then convey it to the State Govt. through the Secretary (Home & Finance) immediately.

(v) The Secretary (Home & Finance) shall take the follow up action immediately, so that the appropriate notification is issued by 15-02-2024 and arrears are paid before 29-02-2024, in compliance of the directions of the Hon'ble Apex Court.

and retiral benefits:

(i) Accountant General (A & E) HP, All District Treasury Officers / concerned Treasury Officers in the State of HP, already notified by the Govt. as per notification No. Home.B.B(10)1/2014-Vol-III-Loose, dated 1st December, 2023, will be Nodal Agency for the Judicial Officers who have retired after 01.01.2016;

(ii) All District Treasury Officers / concerned Treasury Officers in the State of HP, already notified by the Govt. as per notification No. Home.B.B(10)1/2014-Vol- III-Loose, dated 1st December, 2023, will be Nodal Agency for the Judicial Officers who have retired prior to 01.01.2016, including Family Pensioners;

(iii) For serving judicial officers of the Division, the District & Sessions Judges will be Nodal Agency. They shall ensure that all the concerned Drawing and Disbursing Officer (DDO) in their Divisions disburse the arrears of Pay and allowances in a timely manner;

(iv) For the Judicial Officers on deputation, the Heads of Offices of the Government Department where Judicial Officers are working/worked on deputation, will be Nodal Agency;

(v) For the Judicial Officers posted in the Registry of High Court, the Registrar (Accounts) will be Nodal Agency;

(vi) For the the retired Judicial Officers/Family Pensioners who have settled outside State and drawing Pension/Family Pension from Treasuries in that State, Registrar (Administration) of this court will be Nodal Agency.

The Registrar (Accounts) of the High Court shall be the Nodal Officer, for the purpose of coordinating the functioning of all the above Nodal Agencies. All the above Nodal Agencies shall ensure that the disbursement on account of arrears of salary, pension and allowances, due and payable to Judicial Officers, retired Judicial Officers and family pensioners, shall be computed and paid by or before 29-02-2024.

C. Laying down a simplified and effective procedure for reimbursement and

disbursement of claims.

All the District Judges shall report to the Registrar General about the seamless reimbursement and disbursement of claims. Where it is provided that the Officer / Pensioner will be allowed reimbursement of allowance, then on production of bill/certificate/self certification, the allowance shall be paid, without any further query.

If any difficulty is faced by the pensioners in this regard, they can bring that fact to the notice of the concerned District & Sessions Judge of the District where they are drawing the pension and they can also bring it to the notice of Nodal Officer for Pensioners, who shall communicate it to the Registrar General for immediate redressal.

All the District Judges and Heads of Office shall constitute a special team to prepare the bills for disbursement of the arrears and current amounts to comply with the direction of the Hon'ble Apex Court. The District Judges must also appoint a Judicial Officer who can make12610 राजपत्र, हिमाचल प्रदेश, 22 फरवरी 2024/03 फाल्गुन, 1945 necessary communication with the Nodal agencies/ Nodal Officer of this Committee for Pensioners, pertaining to implementation of the directions and settlement/reimbursement / disbursement of claims.

If the arrears of salary/retiral & pensionary benefits, of any serving Judicial officer/pensioner/family pensioner has not been disbursed by their respective Heads of Department /DDO as per previous orders of the Hon'ble Supreme Court, it shall be paid with immediate effect before 29-02-2024 and compliance reports be submitted to the Registrar General by 10th of March, 2024, for onward submission before the Hon'ble Supreme Court before 9th April, 2024.

Further, the judgments of Hon'ble Supreme Court dated 19-05-2023 and 04-01-2024, in W.P. (C) 643 of 2015, titled All India Judges Association Vs. Union of India & Ors., are clear on the aspects of Pay, Perks, Allowances and Pension. These judgments shall be sent to all the DDO's of the courts in the Divisions, Accountant General (A & E) HP, All District Treasury Officers/ concerned Treasury Officers in the State of H.P., Registrar (Administration), Registrar (Accounts) of this court, the Heads of Offices of the Government Department where Judicial Officers are working on deputation, through e-Mail, by the Registrar (Rules), so that the claims are disbursed in a effective and timely manner.

The SOP be also published on the website of the High Court, together with the details of the Nodal officers for the serving and retired officers, by the Office and Administration (O&A) Branch.

The database of retired Judges and family pensioners in the district judiciary with a process for periodical updating, at least on a quarterly basis be also maintained by the Office and Administration Branch, working under the Registrar (Administration) of this court.

The Committee will also have the final authority to approve the shelf of schemes/projects under various decentralized planning programmes including Backward Area Sub Plan. The meeting of the Committee will be held on quarterly basis as per date and venue fixed by the Chairman. The recommendations and suggestions of this committee will be sent to all the concerned Heads of Departments for taking appropriate action with a copy to Planning Department, H.P.

6. Conditions Governing TA/DA:

The Official Members/non-official members shall be entitled for TA/DA as admissible under the rules as notified by the Finance Department from time to time.

Yog Raj Sharma, Deputy Secretary (Class-I, Gazetted) of this Commission's Office to the post of Joint Secretary (Group-A) (Non-HPAS) in level-26 i.e. `1,15,000— `2,07,900/- in the pay matrix of the HPCS (Revised Pay) Rules, 2022 on regular basis against the newly upgraded post of Joint Secretary, in Himachal Pradesh Public Service Commission with immediate effect.

He is advised to exercise option for fixation of pay within one month from the date of his joining which his pay will be fixed under the normal rules.

अतिरिक्त जिला रजिस्ट्रार जन्म एवं मृत्यु पंजीकरण हमीरपुर के कार्यालय पत्र संख्या HFW-HMR (B&D) 2024-504, दिनांक 08-01-2024 के अनुसार श्रीमती सुंनो देवी पुत्री दुनी चन्द, निवासी टीका बराडा, तहसील बमसन स्थित टौणी देवी, जिला हमीरपुर (हि0प्र0) का आवेदन-पत्र समस्त रिकार्ड व शपथ-पत्र सहित इस कार्यालय में प्राप्त हुआ है जिसमें उल्लेख है कि उसका जन्म दिनांक 05-11-1979 को हुआ है परन्तु किसी कारणवश ग्राम पंचायत बराडा के रिकॉर्ड में उक्त जन्म का पंजीकरण दिनांक 05-11-1979 को दर्ज न हो सका। प्रार्थिया अब जन्म दिनांक उपरोक्त को ग्राम पंचायत बराडा में दर्ज करवाना चाहती है। अतः इस इश्तहार द्वारा आम जनता को सूचित किया जाता है कि सुंनो देवी पुत्री दुनी चन्द, निवासी टीका बराडा, तहसील बमसन स्थित टौणी देवी, जिला हमीरपुर (हि0प्र0) की जन्म तिथि 05-11-1979 को ग्राम पंचायत बराडा के रिकार्ड में दर्ज करवाने बारे किसी को कोई उजर/एतराज हो तो वह दिनांक 28-02-2024 तक असालतन /वकालतन हाजिर न्यायालय होकर अपना उजर/एतराज पेश कर सकता है। हाजिर न आने की सूरत मेें एकतरफा कार्यवाही अमल में लाई जाकर आगामी कार्यवाही की जाएगी। उसके बाद कोई उजर जेरे समायत न होगा।
