संख्या: एफ डी एस-ए(3)-2/2022.---हिमाचल प्रदेश के रा(cid:207)यपाल, उपभोक्ता सरंक्षण अधिनियम, 2019 (2019 का 35) की धारा 33 की उप-धारा (3) और धारा 46 की उप-धारा (3) के साथ पठित धारा 102 के ख(cid:214)ड (झ) 256—राजपत्र/2023-11-03-2024 (13061)13062 राजपत्र, हिमाचल प्रदेश, 11 मार्च 2024/21 फाल्गुन, 1945 और (ढ) (cid:622)वारा प्रदत शक्तिय(cid:585) का प्रयोग करते हु ए और ऐसे अधिक्रमण से पूर्व की गई या किए जाने से विलोपित बात(cid:585) से संबंधित के सिवाय, सभी नियम(cid:585), विनियम(cid:585) और आदेश(cid:585), जहाँ तक वे इन नियम(cid:585) के अधीन मामल(cid:585) से संबंधित ह(cid:583), के अधिक्रमण म(cid:581), हिमाचल प्रदेश रा(cid:207)य उपभोक्ता विवाद निवारण आयोग और जिला उपभोक्ता विवाद निवारण आयोग के अधिकारिय(cid:585) और अ(cid:219)य कर्मचारिय(cid:585) को देय वेतन और भ(cid:419)(cid:585) और सेवा के अ(cid:219)य निब(cid:219)धन(cid:585) और शत(cid:607) के संबंध म(cid:581) नि(cid:224)नलिखित नियम बनाते ह(cid:583), अर्थात :-

| संक्षिÜत नाम और प्रारàभ । | 1 | (1) | इन नियमɉ का संक्षिÜत नाम हिमाचल प्रदेश राÏय उपभोक्ता विवाद निवारण आयोग और जिला उपभोक्ता विवाद निवारण आयोग के अधिकारियɉ और अÛय कर्मचारियɉ को संदेय वेƣन और भƣे और सेवा के अÛय निबÛधन और शतɏ नियम, 2024 है। |
| (2) | ये नियम राजपत्र (ई - गजट), हिमाचल प्रदेश मɅ प्रकाशन की तारीख से प्रवृƣ हɉगे। | ||
| परिभाषाएँ। | 2 | इन नियमɉ मɅ, जब तक संदर्भ से अÛयथा अपेक्षित न हो,- | |
| (क) | "अधिनियम" से, उपभोक्ता सरंक्षण अधिनियम, 2019 अभिप्रेत है ; | ||
| (ख) | "राÏय आयोग" से हिमाचल प्रदेश राÏय उपभोक्ता विवाद निवारण आयोग, शिमला अभिप्रेत है ; | ||
| (ग) | "जिला आयोग" से हिमाचल प्रदेश राÏय मɅ èथापित जिला उपभोक्ता विवाद निवारण आयोग अभिप्रेत है ; | ||
| (घ) | "प्रशासनिक विभाग" से हिमाचल प्रदेश सरकार का खाɮय, नागरिक आपूर्ति एवं उपभोक्ता मामले विभाग अभिप्रेत है ; | ||
| (ङ) | "अÚयक्ष" से राÏय आयोग / जिला आयोग का अÚयक्ष अभिप्रेत है ; | ||
| (च) | "विƣ विभाग" से हिमाचल प्रदेश सरकार का विƣ विभाग अभिप्रेत है; | ||
| (छ) | "अनुशासनिक प्राधिकारी" से इन नियमɉ से संलग्न अनुसूची-III मɅ यथाविर्निदिçट राÏय/जिला आयोग के अधिकारियɉ और अÛय कर्मचारियɉ पर शाèित अधिरोपित करने के लिए सक्षम प्राधिकारी अभिप्रेत है ; | ||
| (ज) | "अÛय कर्मचारी" से राÏय / जिला आयोग के समूह - ख , ग और घ के अराजपत्रित कर्मचारी अभिप्रेत है ; | ||
| (झ) | "राÏयपाल" से हिमाचल प्रदेश का राÏयपाल अभिप्रेत है ; | ||
| (ञ) | "अधिकारी" से राÏय/जिला आयोगɉ मɅ नियुक्त या इनके राजपत्रित काॅडर/ सेवा क े अधिकारी और राÏय/जिला आयोगɉ के कर्मचारिवृ द के सदèयɉ मɅ से नियुक्त ं अधिकारी अभिप्रेत है ; | ||
| (ट) | "पद" से राÏय/जिला आयोग के èथापन मɅ कोई निæिचत वेतनमान वाला पद अभिप्रेत है और इसमɅ इन नियमɉ की अनुसूची-I मɅ विर्निदिçट पद सàिमलित हɇ; | ||
| (ठ) | "रजिèट्रार" से राÏय/जिला आयोग का रजिèट्रार अभिप्रेत है ;- | ||
| (ड) | "अनुसूची" से इन नियमɉ से संलग्न अनुसूची अभिप्रेत है ; | ||
| (ढ) | "सेवा" से राÏय/जिला आयोग मɅ नियमित/तदर्थ/संविदा/दैनिक मजदूरी आधार पर दी गई सेवा अभिप्रेत है ; | ||
| भाग - II | |||
| राÏय/जिला आयोग क े अधिकारियɉ और अÛय कर्मचारियɉ की संख्या। | 3 | राÏय/जिला आयोग के लिए राÏय सरकार ɮवारा सृजित समूह क, ख, ग और घ स ेवाओं के पदɉ से मिल कर बनने वाले अधिकारियɉ और कर्मचारियɉ के पद अनुसूची-I मɅ यथाविनिर्दिçट राÏय आयोग के èथापन मɅ सृजित किए गए समझे जाएंगे। | |
| राÏय आयोग प्रशासन और नियंत्रण। | 4 | राÏय आयोग के अÚयक्ष के अधीक्षण और नियÛत्रण के अÚयधीन, राÏय आयोग क े कार्यालय को रजिèट्रार/सयु ंक्त रजिèट्रार/सहायक रजिèट्रार प्रशासित करेगा और राÏय आयोग के èथापन मɅ सेवारत अधिकारियɉ और अÛय कर्मचारियɉ पर पूर्ण नियÛत्रण का प्रयोग करेगा। | |
| भर्ती की पɮधति। | 5 | किसी पद या पदɉ के समूह पर भर्ती अनुसूची-II मɅ दर्शाई गई नियुक्ति की रीति के अनुसार की जाएगी। | |
| राÏय/जिला आयोग क े समूह क, ख, ग और घ पदɉ के लिए भर्ती की पɮधति। | 6 | विभिÛन प्रवगɟ के रिक्त पदɉ को अनुसूची-II मɅ विर्निदिçट पात्रता और अÛय मानदंडɉ के अÚयधीन नियुक्ति/प्रोÛनति ɮवारा भरा जाएगा। | |
| नियुक्ति प्राधिकारी। | 7 | राÏय सरकार की विɮयमान पाॅलिसी/अनुदेशɉ और उनमɅ समय- समय पर किए गए पæचातवर्ती संशोधनɉ, यदि कोई हɉ, के अनुसार राÏय आयोग का अÚयक्ष, समèत पदɉ के लिए नियुक्ति प्राधिकारी होगा। | |
| भाग -III | |||
| वेतन और भƣे। | 8 | राÏय/जिला आयोग के èथापन पर धारित åयक्ति ऐसे वेतन और भƣे, जो की अनुसूची - I मɅ उपदर्शित हɇ, आıत करेगा। | |
| पात्रता। | 9 | कोई åयक्ति तब तक किसी पद पर नियुक्ति के लिए पात्र नहीं होगा जब तक वह ऐसी नियुक्ति के लिए शैक्षणिक या अÛय समèत अर्हताएं धारित न करता हो और वह अनुसूची -II मɅ विहित अपेक्षाओं को भी पूर्ण न करता हो: प रÛतु यह कि, किसी विशेष दशा मɅ जहाँ कोई अधिकारी या अÛय कर्मचारी उसकी वरिçठता के आधार पर उÍच पद पर प्रोÛनति/ चयन के लिए विचार-क्षेत्र के भीतर आता है, परÛतु वह ऐसे पद के लिए अपेक्षित शैक्षिक या अकादमिक या अÛय अर्हताएं धारित नहीं करता है तो यदि अÚयक्ष, राÏय आयोग की राय मɅ वह उ×कृ çट गुणागुण और योग्यता धारित करता है और उÍच पद के कर्ƣåयɉ के èवǾप को देखते हु ए वह ऐसे कर्ƣåयɉ के पालन के लिए पूर्णत: सक्षम है तो राÏय सरकार क े अनुमोदन से ऐसे अर्हता के मानदÖड शिथिल करने के पæचात ् उस पर ऐसी प्रोÛनति के लिए विचार किया जा सके गा। ऐसी राय बनाने के लिए प्रदƣ दशा मɅ राÏय आयोग का अÚयक्ष, ऐसे अधिकारी/कर्मचारी के गुणागुण और उसके ɮवारा उÍच पद पर कर्तåय पालन की क्षमता का निर्धारण करने के लिए, मामले को उसके ɮवारा गठित समिति को निर्दिçट करेगा। | |
| अèथायी नियुक्ति। | 10 | जहाँ किसी पद पर रिक्ति को भरना आवæयक है और सàयक Ǿप से अर्हित और अनुभवी åयक्ति की नियुक्ति मɅ असàयक विलंब प्र×याशित है तो राÏय सरकार प्रशासनिक असुविधा के परिवर्जन के लिए अèथायी åयवèथा के Ǿप मɅ इन नियमɉ के अनुसार किसी अधिकारी या कर्मचारी को नियुक्त कर सके गी। | |
| वरिçठता। | 11 | राÏय /जिला उपभोक्ता आयोग के अधिकारियɉ और अÛय कर्मचारियɉ की वरिçठता कार्मिक विभाग, हिमाचल प्रदेश सरकार ɮवारा समय-समय पर अंगीकृ त/जारी वरिçठता के सामाÛय सिɮधाÛतɉ के अनुसार अवधारित की जाएगी। | |
| स ेवा की अÛय शतɏ। | 12 | वेतन, भƣे, छु ɪटी, भविçय निधि, अधिवर्षिता की आयु, पɅशन और सेवानिवृति प्रसुविधाएं, चिकि×सा सुविधाएं और सेवा की अÛय शतɟ के मामले मɅ, जिनके लिए इन नियमɉ मɅ èपçटतः उपबंधित नहीं है या अपर्याÜत उपबंध किए गए हɇ, उस दशा म Ʌ राÏय/जिला आयोगɉ के अधिकारी और अÛय कर्मचारी, राÏय सरकार के अधीन, यथाèिथति, समूह - क , ख , ग या घ से संबंधित त×समान पदɉ या वेतनमानɉ पर उन èथानɉ पर नियुक्त अधिकारियɉ या अÛय कर्मचारियɉ को लागू नियमɉ, विनियमɉ और आदेशɉ से विनियमित हɉगे। | |
| सीधी भर्ती के लिए वांछनीय अर्हताएं। | 13 | हिमाचल प्रदेश की Ǿढ़ियɉ, रीतियɉ और बोलियɉ का ज्ञान और राÏय मɅ विɮयमान विशिçट दशाओं मɅ नियुक्ति के लिए उपयुक्तता वांछनीय अर्हताएं होगी। | |
| सीधी भर्ती के लिए आयु। | 14 | आयु : 18 और 45 के बीच: परÛतु यह कि सीधे भर्ती किए जाने वाले åयक्तियɉ के लिए ऊपरी आयु सीमा, पहले से ही सरकार की सेवा मɅ रत अßयर्थियɉ को लागू नहीं होगी: परÛतु यह और कि ऊपरी आयु सीमा मɅ, अनुसूचित जातियɉ/ अनुसूचित जनजातियɉ/ अÛय पिछड़ा वगɟ और åयक्तियɉ के अÛय प्रवगɟ के लिए, उस विèतार तक शिथिलीकरण किया जाएगा जितना कि हिमाचल प्रदेश सरकार के साधारण या विशेष आदेश (आदेशɉ) के अधीन अनुज्ञेय है। ि टÜपण:- सीधी भर्ती के लिए आयु सीमा की गणना उस वर्ष के प्रथम दिवस से की जाएगी जिसमɅ कि पदɉ को आवेदन आमंत्रित करने के लिए, यथाèिथति, विज्ञापित किया गया है या नियोजनालयɉ को अधिसूचित किया गया है। | |
| सीधी भर्ती के लिए अनिवार्य अपेक्षा। | 15 | किसी पद या सेवा के लिए अßयर्थी का भारत का नागरिक होना अनिवार्य है। | |
| आरक्षण। भाग - IV | 16 | किसी पद के लिए नियुक्ति, राÏय सरकार ɮवारा, समय-समय पर अनुसूचित जातियɉ/अनुसूचित जनजातियɉ/अÛय पिछड़े वगɟ और åयक्तियɉ के अÛय प्रवगɟ क े लिए सेवा मɅ आरक्षण की बाबत जारी किए गए आदेशɉ के अधीन होगी। | |
| तैनातियां और èथानांतरण। | 17 | किसी åयक्ति की किसी विशिçट पद या विशिçट समूह या प्रवर्ग मɅ आरंभिक नियुक्ति होते हु ए भी अÚयक्ष, राÏय आयोग सेवा की अ×यावæयकता के कारण या प्रशासनिक हित मɅ ऐसे किसी åयक्ति को राÏय/जिला आयोग मɅ किसी अÛय पद या किसी अÛय समूह या प्रवर्ग मɅ èथानांतरित कर सके गा। | |
| क Ʌ द्रीय सिविल स ेवाएं (वर्गीकरण, नियंत्रण और अपील) नियम, 1965 का लागू होना। | 18 | अनुशासना×मक मामलɉ मɅ के Ûद्रीय सिविल सेवाएं (वर्गीकरण, नियंत्रण और अपील) नियम , 1965 के उपबंध लागू हɉगे और अपीलीय प्राधिकारी अनुसूची-III म Ʌ यथाविर्निदिçट के अनुसार हɉगे: परÛतु यह कि इन नियमɉ के अधीन अÚयक्ष ɮवारा पारित आदेश के विǽɮध कोई अपील नहीं की जाएगी। | |
| भाग - V | |||
| परिवीक्षा | 19 | (1) राÏय आयोग के èथापन मɅ सीधी भर्ती ɮवारा या प्रोÛनति ɮवारा नियुक्त åयक्ति उनकी आरंभिक नियुक्ति की तारीख से दो वर्ष की अवधि तक निàनानुसार परिवीक्षा पर हɉगे:- ( i) सीधी भर्ती:- (क) दो वर्ष, जिसका एक वर्ष से अनधिक ऐसी और अवधि के लिए विèतार किया जा सके गा, जैसा सक्षम प्राधिकारी विशेष परिèिथतियɉ मɅ और कारणɉ को लिखित मɅ अभिलिखित करके आदेश दɅ। ( ख) संविदा, सेवाधृति के आधार पर नियुक्ति पर, अधिवर्षिता के पæचात ् पुनर्नियोजन पर और आमेलन पर कोई परिवीक्षा लागू नहीं होगी। ( ii) प्रोÛनति:- एक समूह से दूसरे समूह, यथा समूह-ख से समूह-क, को प्रोÛनति की दशा मɅ दो वर्ष। अÚयक्ष, राÏय आयोग विशेष परिèिथतियɉ मɅ कारणɉ को लिखित मɅ अभिलिखित करके परिवीक्षा की अवधि को बढ़ा सके गा । | |
| (2) किसी वैयक्तिक अधिकारी/अÛय कर्मचारी या ऐसे अधिकारियɉ / अÛय कर्मचारियɉ के समूह की बाबत परिवीक्षा अवधि पूर्ण करने के लिए पुरोभाåय शर्त के Ǿप मɅ किसी/किÛही विशेष परीक्षा (परिक्षाओं) मɅ उƣीर्ण होना उपबंधित करना अनुज्ञेय होगा। | |||
| पुçिटकरण। | 20 | परिवीक्षा की अवधि के दौरान यदि परिवीक्षार्थी का कार्य और आचरण संतोषप्रद पाया जाता है तो उसकी परिवीक्षा अवधि (या विèतारित परिवीक्षा अवधि ) के अंत म Ʌ परिवीक्षार्थी की भारत सरकार के कार्मिक और प्रशिक्षण विभाग (DOPT) ɮवारा इसके कार्यालय ज्ञापन, तारीख 28-03-1988 ɮवारा जारी और राÏय सरकार ɮवारा कार्मिक विभाग के कार्यालय ज्ञापन , तारीख 14.06.1994 ɮवारा अंगीकृ त सरलीकृ त प्रक्रिया के अनुसार अधिçठायी Ǿप मɅ पुçिट की जाएगी। | |
| आचरण। | 21 | (1) | राÏय/जिला आयोग का प्र×येक अधिकारी और कर्मचारी सभी समयɉ पर कर्तåय के प्रति पूर्ण स×यनिçठा और समर्पण बनाए रखेगा। |
| (2) | राÏय/जिला आयोग का कोई भी अधिकारी/कर्मचारी कार्यालय मɅ अनुशासन, शालीनता और समुचित åयवèथा पर प्रतिकू ल प्रभाव डालने वाली रीति मɅ कार्य नहीं करेगा। | ||
| (3) | आचरण के विषय मɅ हिमाचल प्रदेश सरकार के सरकारी कर्मचारियɉ को त×समय प्रवृत और लागू नियम और आदेश राÏय/जिला आयोग के अधिकारियɉ और अÛय कर्मचारियɉ को यथावæयक परिवर्तन सहित लागू हɉगे। | ||
| अनुकàपा आधार पर नियुक्ति। | 22 | अनुकàपा आधार पर नियुक्ति राÏय सरकार की विɮयमान नीति और उसमɅ समय -समय पर किए गए पæचातवर्ती संशोधनɉ, यदि कोई हो, के अनुसार की जाएगी। | |
| प्र×यायोजन। | 23 | अÚयक्ष, राÏय आयोग इन नियमɉ के अधीन उसमɅ निहित शक्तियɉ को राÏय/जिला आयोग के किसी समुचित अधिकारी को प्र×यायोजित कर सके गा। | |
| शिथिल करने की शक्ति। | 24 | जहाँ राÏय सरकार की यह राय हो कि ऐसा करना आवæयक और समीचीन है, वहां वह, कारणɉ को लिखित मɅ अभिलिखित करके और अÚयक्ष, राÏय आयोग के परामर्श से, आदेश ɮवारा, इन नियमɉ के किसी/किÛही उपबÛध (उपबÛधɉ) को किसी वर्ग या åयक्ति (åयक्तियɉ) के प्रवर्ग या पद (पदɉ) की बाबत, शिथिल कर सके गी। | |
| निर्वचन। | 25 | यदि इन नियमɉ के लागू होने या निर्वचन संबंधी को विवाद या प्रæन पैदा होता है तो उस पर राÏय सरकार का विनिæचय अंतिम होगा। | |
| कठिनाइयɉ को दूर करना। | 26 | इन नियमɉ के उपबंधɉ को प्रभावी बनाने मɅ यदि कोई कठिनाई उ×पÛन होती है तो सरकार, लिखित मɅ आदेश ɮवारा, जो इसे कठिनाई को दूर करने या इन नियमɉ का संशोधन करने के लिए आवæयक प्रतीत हɉ, कर सके गी। | |
| संविदा नियुक्ति ɮवारा पद पर नियुक्ति के लिए चयन। | 27 | इन नियमɉ मɅ किसी बात के होते हु ए भी पद (पदɉ) पर संविदा×मक नियुक्तियां कार्मिक विभाग ɮवारा समय-समय पर जारी अनुदेशɉ/ मार्गदर्शक सिɮधाÛतɉ के अनुǾप उपाबंध "क" मɅ दी गई शतɟ और निबÛधनɉ के अÚयधीन की जाएगी। | |
| अवशिçट मामले। | 28 | अधिकारियɉ/और अÛय कर्मचारियɉ की सेवा शतɟ, उनके आचरण और अनुशासन को शासित करने वाले मामलɉ सहित उन मामलɉ की बाबत, जो इन नियमɉ ɮवारा या इनके अधीन विनिर्दिçट Ǿप मɅ समावेशित नहीं होते हɇ, राÏय सरकर के कर्मचारियɉ को लागू विधियɉ, नियमɉ और विनियमɉ या मानकɉ ɮवारा, जहाँ तक वे समाÛय Ǿप मɅ इन नियमɉ से असंगत या विǽɮध नहीं है, ɮवारा शासित हɉगे। |

(cid:622)वितीय पक्षकार ने उपरोक्त प्रथम पक्षकार को लगाया है और प्रथम पक्षकार ने .................. के (cid:510)प म(cid:581) संविदा के आधार पर नि(cid:224)नलिखित निब(cid:219)धन और शत(cid:607) पर सेवा करने के लिए सहमति दी है:--
1. यह कि प्रथम पक्षकार के (cid:510)प म(cid:581)..................से प्रार(cid:224)भ होने और....................को समा(cid:220)त होने वाले दिन तक, एक वर्ष की अवधि के लिए (cid:622)वितीय पक्षकार की सेवा म(cid:581) रहेगा। यह विनिर्दि(cid:231)ट (cid:510)प से उ(िcid:227)लखित किया गया है और दोन(cid:585) पक्षकार(cid:585) (cid:622)वारा करार पाया गया है कि प्रथम पक्षकार की (cid:622)वितीय पक्षकार के साथ संविदा, आखिरी कार्य दिवस अर्थात ् .................. दिन को (cid:232)वयंमेव ही पर्यवसित (समा(cid:220)त) समझी जाएगी और सूचना नोटिस आव(cid:230)यक नहीं होगा:
पर(cid:219)तु संविदा अवधि म(cid:581) वर्षानुवर्ष आधार पर वि(cid:232)तारण/नवीकरण के लिए स(cid:224)ब(cid:622)ध विभागा(cid:218)यक्ष, यह प्रमाण-पत्र जारी करेगा कि संविदा पर नियुक्त (cid:229)यक्ति की सेवा तथा आचरण वर्ष के दौरान संतोषजनक रहा है और के वल तभी उसकी संविदा की अवधि नवीकृ त/वि(cid:232)तारित की जाएगी।
2. प्रथम पक्षकार की संविदा(cid:215)मक रकम................../- (cid:509)पए प्रतिमास होगी (जो संबंधित संवर्ग के पे मैट्रिक्स के लागू (cid:232)तर के प्रथम को(cid:231)ठ का 60 प्रतिशत होगी)।
3. संविदा पर नियुक्त (cid:229)यक्ति की सेवा पूर्णतया अ(cid:232)थाई आधार पर होगी। यदि संविदा पर नियुक्त (cid:229)यक्ति का कार्यपालन/आचरण ठीक नहीं पाया जाता है, तो नियुक्ति पर्यावसित (समा(cid:220)त) किए जाने के लिए दायी होगी।
4. संविदा पर नियुक्त (cid:229)यक्ति एक कै ले(cid:214)डर वर्ष म(cid:581) एक मास की सेवा पूरी करने के प(cid:230)चात ् एक दिन के आक(िcid:232)मक अवकाश, दस दिन के चिकि(cid:215)सा अवकाश और पांच दिन के विशेष अवकाश के लिए हकदार होगा/होगी। संविदा पर नियुक्त महिला को दो जीवित ब(cid:205)च(cid:585) तक एक सौ प(cid:583)तीस दिन का प्रसूति अवकाश दिया जा सके गा। संविदा पर नियुक्त महिला कर्मचारी पूरी सेवा के दौरान, गर्भपात हो जाने सहित गर्भपात कराने की दशा म(cid:581), प्राधिकृ त सरकारी चिकि(cid:215)सा अधिकारी (cid:622)वारा जारी चिकि(cid:215)सा प्रमाण-पत्र प्र(cid:232)तुत करने पर प(cid:583)तालिस दिन से अनधिक प्रसूति अवकाश (जीवित ब(cid:205)च(cid:585) की संख्या का विचार किए बिना) के लिए भी हकदार होगी। संविदा पर नियुक्त कर्मचारी चिकि(cid:215)सा प्रतिपूति र् और एल० टी० सी० आदि के लिए हकदार नहीं होगा/होगी। संविदा पर नियुक्त (cid:229)यक्ति को उपरोक्त के सिवाय अ(cid:219)य किसी प्रकार का कोई अवकाश अनुज्ञात नहीं होगा ।
अनुपभुक्त आक(िcid:232)मक अवकाश, चिकि(cid:215)सा अवकाश और विशेष अवकाश को एक कै ले(cid:214)डर वर्ष तक संचित किया जा सके गा और अगले कै ले(cid:214)डर वर्ष के लिए अग्रनीत नहीं किया जाएगा ।13077 राजपत्र, हिमाचल प्रदेश, 11 मार्च 2024/21 फाल्गुन, 1945 5. निय(cid:219)त्रक अधिकारी के अनुमोदन के बिना क(cid:419र्)(cid:229)य से अनधिकृ त अनुप(िcid:232)थति से (cid:232)वतः ही संविदा का पर्यवसान (समापन) हो जाएगा। तथापि आपवादिक मामल(cid:585) म(cid:581) जहां पर चिकि(cid:215)सा आधार पर क(cid:419र्)(cid:229)य
((cid:620)यूटी) से अनधिकृ त अनुप(िcid:232)थती के हालात संविदा पर नियुक्त (cid:229)यक्ति के निय(cid:219)त्रण से बाहर ह(cid:585) तो
उसके नियमितिकरण के मामले म(cid:581) विचार करते समय ऐसी अवधि अपवर्जित नहीं की जाएगी, पर(cid:219)तु
पदधारी को इस बाबत समय पर निय(cid:219)त्रण प्राधिकारी को सूचित करना होगा। तथापि, संविदा पर नियुक्त (cid:229)यक्ति क(cid:419र्)(cid:229)य से अनुप(िcid:232)थति की ऐसी अवधि के लिए संविदा(cid:215)मक रकम का हकदार नहीं होगा:
पर(cid:219)तु उसे सरकार के प्रचलित अनुदेश(cid:585) के अनुसार चिकि(cid:215)सा अधिकारी (cid:622)वारा जारी बीमारी / आरोग्य का प्रमाण-पत्र प्र(cid:232)तुत करना होगा ।
6. चयनित अ(cid:223)यर्थी को, सरकारी/रजि(cid:232)ट्रीकृ त चिकि(cid:215)सा (cid:229)यवसायी से अपना आरोग्य प्रमाण-पत्र प्र(cid:232)तुत करना होगा। उन बारह स(cid:220)ताह से अधिक समय से गर्भवती महिला अ(cid:223)यर्थिय(cid:585) की दशा म(cid:581), प्रसवाव(cid:232)था समा(cid:220)त होने तक; को अ(cid:232)थायी (cid:510)प से अनुपयुक्त किया जाएगा। महिला अ(cid:223)यर्थिय(cid:585) का किसी प्राधिकृ त चिकि(cid:215)सा अधिकारी/(cid:229)यवसायी से उपयुक्तता के लिए पुनः परीक्षण किया जाना चाहिए।
7. संविदा पर नियुक्त (cid:229)यक्ति का, यदि अपने पदीय क(cid:419र्)(cid:229)य(cid:585) के स(cid:224)ब(cid:219)ध म(cid:581) दौरे पर जाना अपेक्षित हो, तो वह उसी दर पर, जैसी नियमित प्रति(cid:232)थानी पदधारी को पद के वेतनमान के (cid:219)यूनतम पर लागू ह(cid:583), यात्रा भ(cid:419)े/दैनिक भ(cid:419)े का हकदार होगा/होगी।
8. संविदा पर नियुक्त (cid:229)यक्तिय(cid:585) को कर्मचारी सामूहिक बीमा योजना के साथ-साथ ई० पी०एफ०/जी० पी० एफ० भी लागू नहीं होगा।

No. FDS-A(3)-2/2022.—In exercise of the powers conferred by clauses (i) and (n) of section 102 read with sub-section(3) of section 33 and sub-section (3) of section 46 of the Consumer Protection Act, 2019 (35 of 2019) and in supersession of all rules, regulations and orders in so far as they relate to matters covered under these rules, except as respects things done or omitted to be done before such supersession, the Governor of Himachal Pradesh is pleased to make the following rules in respect of salaries and allowances payable to and other terms and conditions of, service of officers and other employees of the Himachal Pradesh State Consumer Disputes Redressal Commission and District Consumer Disputes Redressal Commission namely:—

| (e) | "President" means the President of State Commission/District Commissions; | NaN | ||
| (f) | "Department of Finance" means the Department of Finance of Himachal Pradesh Government; | NaN | ||
| (g) | "Disciplinary Authority" means the authority competent to impose penalty on officers and other employees of the State/District Commissions as specified in SCHEDULE-III appended to these rules ; | NaN | ||
| (h) | "Other Employees" means non-gazetted Group-B, C and D employee of the State /District Commissions; | NaN | ||
| (i) | "Governor" means the Governor of Himachal Pradesh; | NaN | ||
| (j) | "Officers" mean Officers appointed to, or borne on the Gazetted cadre/service of the State/District Commissions and officers appointed from amongst the members of staff of the State/District Commissions; | NaN | ||
| (k) | "Post" means a post on the establishment of the State/District Commissions carrying a definite scale of pay and includes the posts specified in Schedule-I of these rules; | NaN | ||

| (m) | "SCHEDULE" means the SCHEDULE appended to these rules; | NaN | ||

| STRENGTH OF OFFICERS AND OTHER EMPLOYEES OF THE STATE/ DISTRICT COMMISSIONS | 3. | The posts of officers and the other employees consisting of the posts in Group-A, B, C & D Services created by the State Government for the State/District Commissions shall be treated to have been created on the establishment of State Commission, as specified in the SCHEDULE-I. | NaN | |
| ADMINISTRATION AND CONTROL OF THE STATE COMMISSION | 4. | Subject to the superintendence and control of the President, State Commission, the Registrar/Joint Registrar/Asstt. Registrar shall administer the office of the State Commission and shall exercise full control over the officers and the other employees serving on the establishment of State Commission. | NaN | |
| METHOD OF RECRUITMENT | 5. | Recruitment to a post or group of posts shall be made as per the mode of appointment shown in SCHEDULE-II. | NaN | |

| PAY AND ALLOWANCES. | 8. | The persons borne on the establishment of the State/District Commissions shall draw such pay and allowances as are indicated in SCHEDULE-I. | NaN | |
| ELIGIBILITY. | 9. | A person shall not be eligible for appointment in any post, unless he possesses all the necessary qualifications, academic | NaN | |
| or otherwise and also fulfils the requirements of such appointment prescribed in SCHEDULE-II: Provided that in any particular case, where an officer or other employee, if based upon his/her seniority comes within the zone of consideration or promotion/selection to a higher post, but does not possess the requisite educational or academic or other qualifications prescribed for such post, he/she may be considered for such promotion after relaxation of the eligibility criteria with the approval of the State Government with respect to such qualification, if in the opinion of the President, State Commission, he/she possesses outstanding merit and ability and, looking to the nature of the duties of the higher post, is fully capable of performing such duties. For forming such an opinion, the President, State Commission may in a given situation, refer the case for assessment of the merit and the capability to perform the duties of higher post by such officer/employee to a Committee, to be constituted by him. | NaN | |||
| STOP-GAP APPOINTMENT | 10. | Where it is necessary to fill up a vacancy in any post and undue delay is expected in appointing a duly qualified and experienced person, the State Government may appoint any officer or employee as a stop-gap arrangement in accordance with these rules to avoid administrative inconvenience. | NaN | |
| SENIORITY | 11. | The seniority of officers and other employees of State/District Consumer Commission shall be determined in accordance with the general principles of seniority adopted/issued by Department of Personnel, Government of Himachal Pradesh from time to time. | NaN | |
| OTHER CONDITIONS OF SERVICE. | 12. | The conditions of service of the officers and other employees of State/District Commissions in the matter of Pay, Allowances, Leave, Provident Fund, Age of superannuation, Pension and retiral benefits, medical facilities and other conditions of service for which no express provision or insufficient provision has been made in these rules, shall be regulated by the rules, regulations and orders as are applicable to the officers and other employees belonging to Group-A, B, C or D, as the case may be, of the corresponding posts or scales of pay stationed at those places under the State Government. | NaN | |
| DESIRABLE QUALIFICATION FOR DIRECT RECRUITMENT. | 13. | Knowledge of customs, manners and dialects of Himachal Pradesh and suitability for appointment in the peculiar conditions prevailing in the State shall be desirable qualifications. | NaN | |
| AGE FOR DIRECT RECRUITMENT. | 14. | Age: Between 18 and 45 years : Provided that the upper age limit for direct recruits will not be applicable to the candidates already in service of the Government: | NaN |
| Provided further that upper age limit is relaxable for Scheduled Castes/Scheduled Tribes, Other Backward Classes candidates and other categories of persons to the extent permissible under the general or special orders of the State Government. Note.—Age limit for direct recruits will be reckoned as on the 1st day of the year in which the posts are advertised by inviting applications or notified to the employment exchanges, as the case may be; | ||
| ESSENTIAL REQUIREMENT FOR DIRECT RECRUITMENT. | 15. | A candidate for appointment to any service or post must be a Citizen of India. |
| RESERVATION. | 16. | Appointment to a post shall be subject to orders regarding reservation for Scheduled Castes/Scheduled Tribes/Other Backward Classes/other categories of persons issued by the State Government from time to time. |
| PART-IV | ||
| POSTINGS AND TRANSFERS. | 17. | Notwithstanding the initial appointment of any person on any particular post or in any particular group or category, the President, State Commission, owing to exigencies of service or in the interest of administration may transfer any such person to any other post, or in any other group or category, in the State/District Commissions. |
| APPLICATION OF CENTRAL CIVIL SERVICES (CLASSIFICATION, CONTROL AND APPEAL) RULES, 1965. | 18. | In disciplinary matters, the provisions of the Central Civil Services (Classification, Control and Appeal) Rules, 1965, shall apply and the Disciplinary and Appellate Authorities shall be as specified in SCHEDULE-III: Provided that no appeal shall lie from any order passed by the President under these rules. |
| PART-V | ||
| PROBATION. | 19. | (1) Persons appointed on the establishment of the State Commissions either by direct recruitment or by promotion shall be on probation for a period of two years from the date of their initial appointment as under :- i) Direct Recruitment:- (a) Two years subject to such further extension for a period not exceeding one year as may be ordered by the Competent Authority in special circumstance and reasons to be recorded in writing. (b) No probation in the case of appointment on contract basis, tenure basis, re-employment after superannuation and absorption. |
| ii) Promotion:- Two years in the case of promotion from one Group to another e.g. from Group-B to Group-A. In special circumstances, the President, State Commission may extend the period of probation with reasons to be recorded in writing. | ||
| (2) It shall be permissible with respect to any individual officer/other employees or group of such officers/other employees to provide for passing of any special examination(s) as condition precedent for completion of the probation period. | ||
| CONFIRMATION. | 20. | A probationer shall be confirmed substantively at the end of his/her probation period (or extended probation period) if his/her act and conduct during the period of probation has been found to be satisfactory in accordance with the simplified procedure laid down by Government of India, DOPT vide its O.M dated 28-03-1988 adopted by the State Government in the Department of Personnel vide O.M dated 14-06-1994. |

| APPOINTMENT ON COMPASSIONATE GROUNDS. | 22. | Appointment on compassionate grounds shall be made/done as per prevailing policy of the State Government and subsequent amendments, if any, carried out therein from time to time. |
| DELEGATION. | 23. | The President, State Commission may delegate the powers vested in him under these rules to an appropriate officer of the State/District Commissions. |
| POWER TO RELAX. | 24. | Where the State Government is of the opinion that it is necessary or expedient to do so, it may, by order for reasons to be recorded in writing and in consultation with the President, State Commission, relax any of the provisions of these rules with respect to any Group or category of persons or posts. |
| INTERPRETATION. | 25. | If any dispute or question arises relating to the applicability or interpretation of these rules, the decision of the State Government thereon shall be final. |
| REMOVAL OF DIFFICULTIES. | 26. | If any difficulty arises in giving effect to any of the provisions of these rules, the Government may by an order in writing do, what appears to be necessary for the purpose of removing the difficulty or amend these rules. |
| SELECTION FOR APPOINTMENT TO THE POST BY CONTRACT APPOINTMENT. | 27. | Notwithstanding anything contained in these rules, contract appointments to the post(s) will be made subject to the terms and conditions given in the Annexure "A" as per instructions/guidelines issued by the Department of Personnel from time to time. |
| RESIDUARY MATTER. | 28. | With regard to the matters not specifically covered by or under these rules, including the matters governing service conditions of the officers/and other employees, their conduct and discipline, the same shall be governed by law, rules and regulations or norms applicable to the State Government employees in general insofar as those are not inconsistent with or repugnant to these rules. |

| Candidates must be having speed of 100 W.P.M., in English Stenography and accurate transcription of the matter dictated within a period of 5 times to the time allotted for dictation and typing speed, in English, at 50 W.P.M., on computers, wherefor a separate test shall be held: Provided that only 10% of the mistakes in transcribing the dictated matter and typed matter in typing test shall be allowed. In other words the candidates committing more than 10% mistakes in transcribing the dictated matter and the typed matter in typing test shall be declared as unqualified: Provided further that taking into consideration any administrative exigency, Hon'ble the President, in his discretion, may grant exemption in the aforesaid speed limit either, in typing or in transcription or in both and also in the mistakes as referred to above. The test shall be of two hours duration. 4. The contract appointee will be entitled for one day's casual leave after putting one month's service, 10 days' medical leave and 5 days' special leave, in a calendar year. A female contract appointee with less than two surviving children may be granted maternity leave for 135 days'. A female contract appointee shall also be entitled for maternity leave not exceeding 45 days' (irrespective of the number of surviving children) during the entire service, in case of miscarriage including abortion, on production of medical certificate issued by the authorized Government Medical Officer. A contract employee shall not be entitled for medical re-imbursement and LTC etc. No leave of any other kind except above is admissible to the contract appointee.
Un-availed casual leave, medical leave and special leave can be accumulated upto the calendar year and will not be carried forward for the next calendar year.
5. Unauthorized absence from the duty without the approval of the Controlling Officer shall automatically lead to the termination of the contract. However, in exceptional cases where the circumstances for un-authorized absence from duty were beyond his/her control on medical grounds, such period shall not be excluded while considering his/her case for regularization but the incumbent shall have to intimate the controlling authority in this regard well in time. However, the contract appointee shall not be entitled for contractual amount for this period of absence from duty:
Provided that he/she shall submit the certificate of illness/fitness issued by the Medical Officer, as per prevailing instructions of the Government.

No. SADA (Chintpurni) C-1/19-Vol.-III-212-216.—In exercise of the powers vested under sub-section (1) of Section 19 of the Himachal Pradesh Town and Country Planning Act, 1977 13104 राजपत्र, हिमाचल प्रदेश, 11 मार्च 2024/21 फाल्गुन, 1945 (Act No. 12 of 1977), the Draft Development Plan prepared for Shri Chintpurni Special Area, under Section 70 of the Himachal Pradesh Town and Country Planning Act, 1977 (Act No. 12 of 1977), is hereby published and the Notice is given that a copy of the said Draft Development Plan is available for inspection during the office hours in the following offices:—
1. Member-Secretary Special Area Development Authority Shri Chintpurni-cum- Assistant Town Planner, Sub-Divisional Town Planning Office Una.
2. Camp Office, Special Area Development Authority Shri Chintpurni, Vill. Rehi (Near Petrol Pump) Distt. Kangra.
The particulars of the said Draft Development Plan have been specified in the Schedule below.
If there be any objection or suggestion with respect to the said Draft Development Plan, it should be sent in writing to the Chairman, Special Area Development Authority, Shri Chintpurni- cum-Deputy Commissioner, Una, District Una (H.P.) within thirty days from the date of publication of this Notice in the Official Gazette of Himachal Pradesh.
SCHEDULE
1. The Existing Land Use Maps.
2. A narrative report, supported by maps and charts explaining the provisions of the Draft Development Plan.
3. The phasing of implementation of the Draft Development Plan as suggested by the Chairman Special Area Development Authority Shri Chintpurni-cum-Deputy Commissioner Una.
4. The provisions for enforcing the Draft Development Plan and stating the manner in which permission for development may be obtained.
