File No. STE-A (3)2/2018.—Whereas, the State Level Environment Impact Assessment Authority (SEIAA), Himachal Pradesh has been constituted by MoEF&CC, GoI in pursuance to EIA Notification, 2006 for granting Environmental Clearance (EC) to the Category 'B' Projects in Himachal Pradesh.

Whereas, State Level Environment Impact Assessment Authority (SEIAA), Himachal Pradesh through its Member Secretary-cum-Director (EST&CC) has sent a proposal to the Government in accordance to its decision in 27th Meeting held on 10th June, 2016 to levy13152 राजपत्र, हिमाचल प्रदेश, 13 मार्च 2024/23 फाल्गुन, 1945 Processing/Administrative charges for grant of Environment Clearances on the analogy in other states such as Odissa, Jharkhand, Chhatisgarh, Karnataka, Kerala, Maharashtra etc.

Whereas, the Department of Environment, Science, Technology & Climate Change has been providing all financial and logistic support including accommodation, transportation and such other facilities for smooth discharge of all statutory functions of SEIAA and State Level Expert Appraisal Committee (SEAC), Himachal Pradesh. The sitting fee, travelling allowances/dearness allowances to Chairman and Members of SEIAA & SEAC are being paid by the Department and no separate funds have been allotted to the SEIAA to meet out the entire expenditure for the functioning of both SEIAA and SEAC.

Now, therefore, after careful examination of the proposal, the Governor of Himachal Pradesh is pleased to permit SEIAA, Himachal Pradesh to collect Processing/Administrative charges at the rate as given in the table below for the grant of EC to the Project Proponents for Category-'B' projects.

The processing charges collected from the Project Proponents will be deposited in the Nationalized Bank in the name of "Member Secretary, SEIAA, Himachal Pradesh".

Note:

1. The above Processing/Administrative charges are excluding expenses to be incurred by the Project Proponents for advertising Public Hearing Notification in one major13153 राजपत्र, हिमाचल प्रदेश, 13 मार्च 2024/23 फाल्गुन, 1945 National Daily and one Regional Daily News Paper and expenses for arranging public hearing in the case of Category-B Projects. The Project Proponent shall also remit the Processing Charges of `5,000 only while seeking the Transfer of Environmental Clearance.

2. 50% of the total amount received by the SEIAA through Processing/Administrative charges shall be deposited in the Government Treasury under relevant receipt head.

NOTIFICATION

Dated the 12th March, 2024

No. I/358790/2024 /LA(e-125447).— WHEREAS, it was brought to the notice of the undersigned through Sub-Divisional Officer (Civil) Jawalamukhi that Nagar Panchayat Pradhan of Jawalamukhi and some local shop owners had requested that keeping in view the bad condition of the temple road, movement of traffic beyond the Peepal should be prohibited;

WHEREAS, the Sub-Divisional Magistrate, Jawalamukhi had forwarded the matter to In-Charge Police Station, Jawalamukhi for investigation and report of the same was submitted vide letter No. 74/SPL, dated 16-09-2022, which states that the width of the said road is not uniform and varies at many points beyond the Peepal;

WHEREAS, the Regional Manager, HRTC, Dehra had also inspected the matter and submitted a report vide letter No. 2057, dated 06-07-2022, which reveals that beyond Peepal tree the width of the road is not sufficient which may causes situation of traffic jam and the steep gradient may lead to accident and pose threat to the safety of pilgrims;

WHEREAS keeping in view and considering the aforesaid facts, the order were passed by the District Magistrate Kangra at Dharamshala vide No 39-42/LA, dated 10-01-2023 in exercise of the powers vested under Section 115 of Motor Vehicle Act, 1988 (Act No. 59 of 1988) and direct to prohibit the movement of auto rickshaws and commercial vehicles on temple road Jawalamukhi beyond Peepal tree, and the directions were conveyed to Sub-Divisional Officer (Civil), Jawalamukhi and Deputy Superintendent of Police at Jawalamukhi to ensure the compliance of this order.

WHEREAS the Sub-Divisional Officer (Civil), Jawalamukhi had further passed the separate orders on dated 25-4-2023, which were further withdrawn on dated 16-10-2023.

THEREFORE, considering the aforesaid facts, representation received from the local residents and reports received from Sub-Divisional Magistrate Jawalamukhi, I, Hemraj Bairwa, District Magistrate, Kangra at Dharamshala, in exercise of the powers vested in me under Section13154 राजपत्र, हिमाचल प्रदेश, 13 मार्च 2024/23 फाल्गुन, 1945 115 of Motor Vehicle Act, 1988 (Act No. 59 of 1988) do hereby notify and direct to prohibit the movement of auto rickshaws and commercial vehicles on temple road Jawalamukhi beyond Peepal tree, in order to welfare of the public at large as well as to avoid any untoward incident.

COMPLIANCE to this order shall be ensured by Sub-Divisional Officer (Civil), Jawalamukhi and Deputy Superintendent of Police at Jawalamukhi.
